В статье рассматривается прецедентная практика Европейского суда по правам человека при решении споров относительно ограничений свободы творчества. Сделана попытка вывести обобщенные принципы и подходы суда к решению этих вопросов. Показано, что в демократическом обществе презумпция свободы творчества должна признаваться абсолютной, ограничения возможны относительно отдельных тем, касающихся детей, подростков, национальных меньшинств и верующих, с обоснованием необходимости таких ограничений. ; The article features the case practice of the European Court of Human Rights when resolving disputes on restricting freedom of artistic expression. The author tries to specify general principles and approaches of the court to solving these issues. The article shows that in democratic society, the presumption of the freedom of artistic expression should be deemed absolute, restrictions subject to their justifications may concern certain themes concerning children, teenagers, national minorities and believers
ANNOTATION: the article outlines the problematic issues of the institution of detention, clarifies its relationship with the constitutional human right to liberty and security of a person, reviews the practice of the European Court of Human Rights regarding detention, focuses on the violation of the principle of legal certainty in the current procedural legislation. It is fundamentally important in the study to determine the subjective composition of the persons who are detaining, in particular, the attention is focused on their procedural status, a position is considered regarding the limited terms of reference of authorized officials, in terms of the right to detention solely for committing a crime for which a penalty of imprisonment is provided, unlike persons holding legal detention who are authorized to detain a person in the commission of a criminal offense regardless of the severity. The article deals with the manipulation of procedural rules, which correlates with the so-called hidden purpose and occurs by substituting administrative detention in the understanding of criminal procedural legislation and is the basis for violation of human rights. The concept of immediate judicial control is considered and supported, which provides for an obligation on an authorized official to deliver a detained person directly to a court to resolve the issue of the legality of detention, bypassing the pre-trial investigation authorities, where the detained person is still long (60 hours, since this period should not be exceeded to deliver the detainee to the investigating judge, where a decision is made on the selection of a preventive measure against him), pressure may be applied. It is indicated that there is no clear and comprehensive definition of the category «authorized official» in the current Criminal Procedure Code, which leads to the problem of a which leads to the problem of a narrowed or broader interpretation of this concept. Proposals for its normative consolidation are presented. The work is fundamentally different in that specific problems became the basis for the study of domestic legislation, which were subsequently supported by the decisions of the ECHR, but today they remain in the current legislation anyway. This is a comprehensive approach to the issue of legislative imperfections, and it focuses the legislator's attention on them. ; АННОТАЦИЯ: в статье обозначены проблемные вопросы института задержания, выяснено его соотношение с конституционными правами человека на свободу и личную неприкосновенность, осуществлен обзор практики Европейского суда по правам человека относительно задержания, акцентировано на нарушении принципа правовой определенности в действующем процессуальном законодательстве. Принципиально важным в исследовании является определение субъектного состава лиц, осуществляющих задержание, в частности, сосредоточено внимание на их процессуальном статусе, озвучена позиция относительно ограниченного круга полномочий уполномоченных должностных лиц, в части права на задержание исключительно за совершение преступления, за которое предусмотрено наказание в виде лишения свободы, в отличие от лиц, осуществляющих законное задержание, которые уполномоченные задерживать человека при совершении уголовного правонарушения независимо от тяжести. Освещено манипулирование процессуальными нормами, которое коррелирует с так называемой скрытой целью и происходит путем подмены задержания в понимании уголовного процессуального законодательства административным задержанием и является основой для нарушения прав человека. Рассмотрена и поддержана концепция немедленного судебного контроля, что предусматривает возложение на уполномоченное должностное лицо обязанности доставить задержанное лицо непосредственно в суд для решения вопроса законности задержания, минуя органы досудебного расследования, где на задержанное лицо еще долго (60 часов, поскольку именно этот срок не должен быть превышен для доставки задержанного к следственному судье, где принимается решение об избрании в отношении него меры пресечения), может оказываться давление. Указано, на отсутствие в действующем уголовном процессуальном Кодексе четкого и исчерпывающего определения категории «уполномоченное должностное лицо», что приводит к проблеме суженного или расширительного толкования этого понятия. Представлены предложения по его нормативному закреплению. Работа принципиально отличается тем, что основой для исследования отечественного законодательства, среди прочего, стали конкретные проблемы, которые впоследствии были подкреплены решениями ЕСПЧ, однако на сегодня еще остаются в действующем законодательстве. Такой подход позволяет комплексно подойти к вопросу законодательных несовершенств и сосредоточить на них внимание законодателя. ; АНОТАЦІЯ: у статті окреслено проблемні питання інституту затримання, з'ясовано його співвідношення із конституційним правом людини на свободу та особисту недоторканість, здійснено огляд практики Європейського суду з прав людини стосовно затримання, акцентовано на порушенні принципу правової визначеності у чинному процесуальному законодавстві. Принципово важливим у дослідженні є визначення суб'єктного складу осіб, які здійснюють затримання, зокрема, зосереджено увагу на їхньому процесуальному статусі, озвучено позицію стосовно обмеженого кола повноважень уповноважених службових осіб, у частині права на затримання виключно за вчинення злочину, за який передбачено покарання у вигляді позбавлення волі, на відміну від осіб, що здійснюють законне затримання, які уповноваженні затримувати особу при вчинені кримінального правопорушення незалежно від тяжкості. Висвітлено маніпулювання процесуальними нормами, що корелює із так званою прихованою метою та відбувається шляхом підміни затримання в розумінні кримінального процесуального законодавства адміністративним затриманням – що і є підґрунтям для порушення прав людини. Розглянуто й підтримано концепцію негайного судового контролю, що передбачає покладення на уповноважену службову особу обов'язку доставити затриману особу безпосередньо до суду для вирішення питання законності затримання, минаючи органи досудового розслідування, де на затриману особу ще протягом тривалого часу (60 годин, оскільки саме цей строк не повинен бути перевищений для доставлення затриманої особи до слідчого судді, де приймається рішення про обрання стосовно неї запобіжного заходу), може чинитись тиск. Указано, на відсутність у чинному кримінальному процесуальному Кодексі чіткого та вичерпного визначення категорії «уповноважена службова особа», що призводить до проблеми звуженого або розширювального тлумачення зазначеного поняття. Надані пропозиції щодо його нормативного закріплення. Робота принципово відрізняється тим, що основою для дослідження вітчизняного законодавства, з-поміж іншого, стали конкретні проблеми, що згодом були підкріплені рішеннями ЄСПЛ, проте на сьогодні ще лишаються у поточному законодавстві. Такий підхід дозволяє комплексно підійти до питання законодавчих недосконалостей та зосередити на них увагу законодавця.
Статья посвящена анализу практики Европейского суда по правам человека по части 1 статьи 10 Конвенции о защите прав человека и основных свобод от 4 ноября 1950 г., в которой закреплены общие положения, касающиеся свободы слова. Из толкований Европейского суда следует, что содержание части 1 статьи 10 Конвенции расширяется, она становится именно гарантией свободной коммуникации. Рассматриваются отдельные правовые позиции Европейского суда, наиболее важные с точки зрения аргументации этого утверждения. ; This paper is devoted to the analyses of the European Court in Human Rights practice. The subject to be analyzed is the European Court in Human Rights practice in viewing the affairs by the 1st part of the article 10 of the Convention on the Human Rights and Fundamental Freedoms published on the 4th of November 1950 which sets the general points of the freedom of speech. Out of the European Court's explanations it follows that the content of the 1st part of the article 10 is extended so that it guarantees the freedom of communication. This paper deals with the European Court's legal attitudes considered the most important to illustrate this point. The paper gives the detailed appraisal to the European Court's legal attitude according to which the 1st part of the article 10 of the Convention defends not only the informational content but also the way of its expression and the form of its spreading. The named legal attitude of the European Court means that the 1st part of the article 10 guarantees the freedom to select the form of message and the freedom to select the communication channels and the corresponding signal for its spreading. In other words, the 1st part of the article 10 supposes a human has the right to present the same piece of information verbally or non-verbally, in writing, with the help of visual or audible images. The greatest interest is found in the principle that the article 10 guarantees are also extended to persons who do not initiate messages nor create products. The European Court's legal attitude is that the article 10 guarantees the freedom of opinion to any person and does not make difference on the basis of aims or roles played by natural or juridical persons in realizing this freedom. Another significant conclusion in the European Court's practice analysis is that in the European Court's explanations the article 10 guarantees the universal right to receive all the messages that are spread. The crucial in this context are the following European Court's attitudes. On viewing a number of affairs the European Court concluded that the article 10 forbids the government to make obstacles or keep a person out of getting information from other persons who wish or may wish to spread it to him/her.

The protection of human rights is one of the main topics of modern states. But the high status of the Institute for Human Rights is undoubtedly the result of the creation and functioning of international control mechanisms designed to ensure the implementation of human rights treaties in accordance with the agreement they signed. For example, we examine the legal nature of the European Court of Human Rights. It is concluded that the jurisprudence operates within the framework established by the legislator, and is «alive», that is actually existing law.From the first years of its activity, the European Court of Human Rights makes decisions in accordance with the principles of case law, referring to its previous decision, the decision of the European Commission on Human Rights or established case law while clarifying «the interests of legal certainty». It should also be noted that, unlike the Anglo-Saxon legal family, which applies the concept of «precedent» in the countries of continental law to describe the phenomenon under consideration use another term – «Litigation», which in this case is interpreted in a wide and narrow sense. In the first case, it is regarded as a synonym for judicial activities in general, and in the second (narrower) it is understood as a legal provision, rule, definition-definitsyiyu, a statement made in the course of judicial activity and endowed with some degree of generality, general validity.Compliance with the stare decisis principle limits the interpretation of the Convention that is too dynamic. This is a kind of mechanism of checks and balances in the practice of the ECHR. Stare decisis limits dynamic interpretation. The right to life is protected by the Constitution of Ukraine from birth. Broad interpretation of Art. 2 of the 1950 Convention, which would establish a different moment in the beginning of the protection of life, is contrary to its norms.In law, the beginning of life prevails is the moment of separation of the fetus from the mother's body. Failure to recognize the status of a person in an embryo leads to the possibility of manipulating him, the use of reproductive technologies.The active development of biology and medicine affects a person's life, his rights and dignity. Доступность правосудия следует рассматривать как гарантию скорого и эффективного механизма достижения в суде желаемого результата по восстановлению первоначального положения, существовавшего до нарушения субъективных прав и интересов. Решения Европейского Суда по правам человека, в том числе связанные с толкованием Конвенции, имеют прецедентный характер. С учетом правовых позиций данного суда должна строиться работа и по совершенствованию российского процессуального законодательства, и по формированию адекватной правоприменительной практики, прежде всего судебной. ; Justice availability should be considered as a guarantee of a quick and efficient mechanism of achievement of the intended effect of restoration of the original position which existed before the violation of subjective rights and interests. Грубые и массовые нарушения прав человека в Европе стали мощным стимулом к учреждению эффективных гарантий основных прав человека на региональном уровне (Совет Европы). Международно-правовые обязательства Российской Федерации, связанные с ее участием в Европейской конвенции о защите прав человека и основных свобод, предусматривают необходимость исполнения государством постановлений Европейского Суда по правам человека, вынесенных в отношении Российской Федерации. Правозащитные ценности, составляющие основу Конституции Российской Федерации и Европейской конвенции о защите прав человека и основных свобод, не вступают в противоречие друг с другом в силу конституционных положений, которые не могут быть противопоставлены друг другу. Реализация Европейской конвенции о защите прав человека и основных свобод как международного договора не может сопровождаться свободой усмотрения государства относительно обязывающего характера постановлений Европейского Суда по правам человека. Отношение к правовым позициям Европейского Суда по правам человека должно базироваться на принципе уважения практики межгосударственных органов по защите прав и свобод человека. Во-первых, государство, признавшее юрисдикцию межгосударственного органа по защите прав и свобод человека, обязано учитывать практику этого органа по делам в отношении соответствующего государства. Во-вторых, государство не может заявлять о невозможности исполнения решений межгосударственного органа по защите прав и свобод человека, вынесенных по результатам рассмотрения индивидуальных обращений, или иным образом игнорировать взятые на себя международные обязательства. В то же время, допуская возможность вмешательства государства в осуществление тех или иных прав и свобод, Европейская конвенция о защите прав человека и основных свобод предусматривает наличие у государства определенной свободы регулирования прав и свобод человека. International legal obligations of the Russian Federation in connection with its participation in the European Convention for the Protection of Human Rights and Fundamental Freedoms require the state of execution of judgments of the European Court of Human Rights issued in respect of the Russian Federation. Human rights values forming the basis of the Constitution of the Russian Federation and the European Convention for the Protection of Human Rights and Fundamental Freedoms do not come into conflict with each other in the force of constitutional provisions which cannot be opposed to each other. The implementation of the European Convention for the Protection of Human Rights and Fundamental Freedoms as an international treaty could not be accompanied by the discretion of the state in relation to the binding nature of judgments of the European Court of Human Rights. Attitude towards the legal positions of the European Court of Human Rights should be based on the principle of respect for the practice of intergovernmental bodies for the protection of the rights and freedoms of the individual. First, the state recognized the jurisdiction of the intergovernmental body on protection of the rights and freedoms of the individual, obliged to consider the practice of this body in the matter in respect of the state concerned. Second, a state may not plead impossibility of performance of decisions of the intergovernmental body for the protection of the rights and freedoms of the individual, issued upon review of individual complaints, or otherwise ignore the undertaken international obligations. At the same time, admitting the possibility of state interference in the exercise of those rights and freedoms, the European Convention for the Protection of Human Rights and Fundamental Freedoms requires the state some discretion to regulate the rights and freedoms of the individual. Evolution of the European Court of Human Rights as an institution of international protection of the rights and freedoms of the individual should be based on the recognition by member States of the Council of Europe the principle of respect for the practice of the European Court of Human Rights.
В статье рассматривается практика применения принципа правовой определенности Европейским судом по правам человека и Конституционным судом РФ. Анализ практики показывает, что данный принцип, как правило, формулируется не законодателем, а высшими судами, что в спорных ситуациях периодически приводит к самостоятельным толкованиям с их стороны, а так как практика применения этого принципа на международном уровне сложилась значительно раньше, чем в России, то в статье рассматривается, как решения Европейского суда по правам человека влияют на решения Конституционного суда РФ. ; In the article the practice of the application of the legal certainty principle by European Court of Human Rights and the Constitutional Court of the Russian Federation is considered. The analysis of the practice shows that the given principle, as a rule, is formulated not by a legislator but by supreme courts. In disputable situations it periodically leads to an independent interpretation from their side. As the practice of the application of this principle at the international level had developed much earlier than in Russia in the article the way the decisions of European Court of Human Rights influence on the decisions of the Constitutional Court of the Russian Federation is considered.

Дана характеристика механизма обеспечения исполнения вынесенных решений. ; The article describes the identifying areas of influence of the European Court on the legal system of Ukraine, as well as the enforcement mechanism of decisions. Analyzes the problems that affect the designated question and points of view of different scholars and practitioners. In Europe there are different documents convention covenants, charters that provide and ensure the inclusion of a special protection mechanism in case of violation of human rights. These documents Convention on Human Rights and Fundamental Freedoms (Rome, 1950, hereinafter the Convention), which provides the most effective and real protection mechanism for human rights. Convention not only proclaimed fundamental human rights, but also created a special mechanism to protect them. The key to this mechanism is the European Court of Human Rights. European Court of Human Rights (hereinafter the Court) located in Strasbourg, France. Its jurisdiction extends to forty-seven European states that are members of the Council of Europe and signatories. Article 9 of the Constitution of Ukraine clearly states that international treaties, ratified by the Verkhovna Rada of Ukraine are part of the national legislation of Ukraine. The Court can not apply the law that governs the legal relationship in question, other than an international agreement. However, international agreements apply if they do not contradict the Constitution of Ukraine. Urgency of the problem by the growth requirements of the rule of law in the judiciary, increasing legal awareness of citizens and their activity to protect their rights and freedoms, the presence of non judicial legislation with international legal acts. Procedural legislation of Ukraine in many aspects not harmonized not only in line with the decisions of the European Court, but also to the current constitution. Ukraine ratified the Convention for the Protection of Human Rights and Fundamental Freedoms July 17, 1997. Since then, the citizens of our country have an opportunity to apply for protection of violated rights to the European Court. The Convention, the basic human rights and freedoms, and in performance of work by an international agreement is necessary to consider the interpretation of the Court. It follows from Article 32 of the Convention, according to which the jurisdiction of the Court shall extend to all matters concerning the interpretation and application of the Convention and its Protocols. The case-law of the European Court increasingly becoming an important source of law in Ukraine The European Court is the subject of judicial lawmaking. The high authority of the European Court was obtained by ensuring uniform interpretation and application of the Convention across the entire European continent. Number of appeals to the European Court is growing, and more and more of its decision relating to the interpretation of law, and the problems of its imperfection.Law of Ukraine «On execution of decisions and application of the European Court of Human Rights» dated February 23, 2006 by fundamental for the legal system of Ukraine provisions. The existence of precedents of the European Court as a unique source of law is due, usually gaps in the law or its ambiguous understanding. In terms of reforming legislation of Ukraine, the European Court in its systematic conceptual models provide certain legislative activities. The court is designed to ensure strict adherence to and compliance with the rules of the Convention by the States Parties. It carries out this task through the consideration and resolution of specific cases taken him to the proceedings on the basis of individual complaints filed by an individual, group of individuals or non-governmental organization. It is also possible filing complaints of violations of the Convention by the State a member of the Council of Europe of another Member State. European court can not reverse the decision rendered by a public authority or national court does not give instructions to the legislator, the abstract does not control the national legislation or judicial practice has no right to order measures with legal consequences. European Court puts the main purpose of the payment of financial compensation for infringement of the applicant's main task to draw attention to the fact of violation of the relevant articles of the Convention and provide the applicant all remedies, where he was denied a national legal system.
Рассматривается порядок разрешения противоречий между позицией Конституционного Суда и позицией Европейского Суда по правам человека по одному делу; уделяется внимание необходимости поиска путей согласования позиций и реализации постановлений ЕСПЧ в России при наличии противоречий национального законодательства с наднациональным прецедентным правом.Article deals with the procedure for resolving conflicts of interpretation in the positions of Constitutional Court and the European Court of Human Rights given in relation to the same subject matter. Attention is paid to the need for finding ways to harmonize positions and implement the ECtHR judgment in Russia in the situation of conflict between the national legislation and supranational case law.
