В статье автор раскрывает вопросы, касающиеся механизма проведения проверки доказательств путем собирания доказательств. Автор попытался вывести правила, по которым должна проводиться проверка, поскольку законодатель не регламентировал этот процесс. ; In this article the author discloses the questions, considering the mechanism of the verification of the evidence by means of collecting the evidence. The author made an attempt to draw the rules of the evidence verification, for this process was not regulated by the legislator.
The author of the article considers necessary to specify the concepts which do not have exact legislative registration. It is affirmed in this article that the proofs are: 1) the data received from a source provided by the law, established according to the criminally-remedial law, fixed in the corresponding remedial form and allowing to establish presence or absence of the circumstances which are to be proved; 2) sources of data about the facts received by different methods, including the ones received during investigatory and operativesearch actions. The investigatory actions are a version of the remedial actions performed for the purpose of collecting and estimating of proofs by the authorities. In this article the author offers the more accurate definition of the content of article 86 of the Criminal Remedial Code of the Russian Federation: 1. В статье раскрывается проблема собирания доказательств защитником в рамках состязательного уголовного процесса. Исследованы пределы действия принципа состязательности и равноправия сторон в российском уголовном процессе. Анализируется Уголовно-процессуальный кодекс РФ в части регламентирования процесса собирания доказательств защитником по уголовным делам. Делается вывод, что законодатель, устанавливая права защитника, не закрепил правовой механизм их реализации, предлагаются идеи улучшения качества адвокатской деятельности. ; The author reveals the problem of collecting evidence by the defence attorney within the framework of adversary criminal procedure, researches the action range of the principle of adversary nature and parts equality in the Russian criminal procedure, analyzes the Criminal Procedure Code of the RF as to the regulation of collecting evidence process by the defence attorney within criminal cases, concludes that the legislator, establishing the defence attorney's rights, did not consolidate the legal mechanism of their realization, and suggests the ideas for the improvement of advocacy quality.

Согласно части 1 статьи 86 УПК РФ, следователь, дознаватель, прокурор и суд собирают доказательства путем производства следственных и иных процессуальных действий, предусмотренные настоящим кодексом. В то же время законодатель не разъясняет, что он имеет в виду под «иными процессуальными действиями», используемыми при собирании доказательств, что порождает неоднозначные, а порой противоречивые взгляды среди ученых-процессуалистов, и вызывает определенные сложности на практике. Поэтому автор в настоящей статье рассматривает проблемные вопросы классификации иных процессуальных действий в уголовном процессе, используемых при собирании доказательств.According to paragraph 1 of Article 86 of the Code, the investigator. Investigator, prosecutor and court gather evidence though the production of investigative and other procedural actions provided for in this Code. At the same time the legislator has not explained what he meant by other proceedings used in the taking of evidence, which leads to ambiguous and sometimes conflicting views among scientists protsessualistov, and causes some difficulties in practice. Therefore, the author of this article examines the problematic questions of classification of certain legal proceedings in the criminal process used in gathering evidence.
Рассматриваются различные точки зрения ученых-процессуалистов относительно статуса доказательств, полученных как стороной обвинения, так и стороной защиты. Повышенное внимание автор уделил концепции «свободных доказательств» и перспективам ее развития. Аргументируется, что деятельность защитника по собиранию доказательств не может рассматриваться как непроцессуальная или альтер-процессуальная, предлагается отказаться от любых попыток ее дискриминации в доказательственном значении и определить ее роль в получении электронных доказательств (действия по получению доказательств это не только следственные действия). Обоснована роль адвоката как субъекта доказывания в уголовном судопроизводстве. Констатируется отставание Российской Федерации в реформировании уголовно-процессуального права, в том числе и от некоторых бывших союзных республик. Анализируется грузинское процессуальное законодательство, в котором реализовано равенство прав сторон в собирании доказательств по уголовному делу. Заключается, что грузинский законодатель создал весьма привлекательную правовую модель за счет расширения прав обвиняемого в этой части. Это особенно очевидно в свете проблематики использования электронных доказательств в доказывании. Поддерживается право стороны защиты собирать доказательства или истребовать их через суд самостоятельно, если это не связано с необходимостью нарушения специальных запретов, установленных законом. Режим открытого доступа к электронной информации позволяет любому субъекту доказывания получать ее и использовать в своих интересах. При определении юридической силы таких доказательств речь должна идти не о соблюдении протокольной формы, а о наиболее убедительном для судьи способе получения доказательств. ; Different viewpoints of scientists-processualists on the status of evidence obtained by both the prosecution and defence are considered. Great attention is paid to the concept of free evidence and prospects of its development. It is argued that defence attorney's activity aimed at collecting evidence cannot be considered as nonprocedural or alter procedural. It is proposed to refuse any attempts to discriminate it basing on its proving importance and to determine its role in obtaining electronic evidence (actions aimed at obtaining evidence imply not only investigative actions). The role of attorney as a subject of proving in the criminal proceedings is argued. It is stated that Russia drops behind some former union states in the reform of criminal procedure law. The Georgian procedural legislation, providing for equality of parties' rights in collecting evidence for a criminal case, is analyzed. It is noted that the Georgian legislators have created quite attractive legal model due to expanding the rights of the accused in this respect. It is especially evident in relation to problems of using the electronic evidence in proving. The right of the defence to collect evidence or to obtained evidence independently (if it does not imply violation of special statutory prohibitions) is supported. The regime of open access to the electronic information allows any subjects of proving to obtain and use it in their own interest. When determining the validity of such evidence, the judge should choose the most convincing way of obtaining evidence.
The article analyzes the right of the defender to collect and present evidence at the pre-trial stages of criminal proceedings as one of the main ways to implement the principle of adversarialism, to ensure equality of parties in criminal proceedings. In the framework of a systematic analysis of the epistemological nature of the process of proof, the author comes to the conclusion that the powers of the defender, specified in the criminal procedural law as ways of collecting evidence, have a different procedural essence. The author's position is that only state bodies are the subjects of collecting evidence, and for the defense party another way of exercising the right to participate in proving is provided-the presentation of evidence. Examples are given from the investigative and judicial practice, illustrating the problems arising in the course of implementation by the party protecting their rights, and confirming the legal incompleteness of their procedural regulation. The peculiarities of collecting electronic evidence by the defense party on the Internet are considered, the necessity of adopting legislative provisions ensuring its fixation is argued. ; В статье анализируется право защитника на собирание и представление доказательств на досудебных стадиях уголовного процесса как один из основных способов реализации принципа состязательности, обеспечения равноправия сторон в уголовном судопроизводстве. В рамках системного анализа гносеологической природы процесса доказывания автор приходит к выводу, что полномочия защитника, указанные в уголовно-процессуальном законе как способы собирания доказательств, имеют иную процессуальную сущность. Аргументируется авторская позиция о том, что субъектами собирания доказательств в полной мере являются только государственные органы, а для стороны защиты предусмотрен иной способ реализации права на участие в доказывании – представление доказательств. Приводятся примеры из следственной и судебной практики, иллюстрирующие проблемы, возникающие в ходе реализации стороной защиты своих прав, и подтверждающие правовую незавершенность их процессуальной регламентации. Рассматриваются особенности собирания стороной защиты электронных доказательств, находящихся в сети Интернет, аргументируется необходимость принятия законодательных положений, обеспечивающих их фиксацию.

Приобщение сведений к материалам дела является единственным способом вовлечения их в процесс доказывания по делу, поэтому исследование и изучение данной темы имеет большое значение для теории уголовного процесса, доказательственного права и применения на практике законодательных положений, регламентирующих указанные правоотношения. ; In this article the author analyses the procedure of deposition to the case files of evidentiary information assembled by the defendant and practical problems related to it. Deposition of information to the case files is the only means to involve it in the proof process in the case, therefore study and research of this theme if of great importance for the theory of criminal procedure, evidence law and practical application of legislative provisions which regulate the abovementioned legal relationship.
В современном уголовном судопроизводстве важнейшую роль играет принцип законности, реализуемый в уголовно-процессуальной деятельности в ходе доказывания. Исследования показывают недостатки правоприменительной практики и правового регулирования интститута уголовно-процессуальных доказательств. В связи с этим важное прикладное значение имеет формулирование научно обоснованных конкретных предложений по совершенствованию уголовно-процессуального законодательства. Цель настоящей статьи предложить несколько обоснованных проектов дополнения действующего Уголовно-процессуального кодекса РФ в части определения термина «недопустимые доказательства» и процедуры признания доказательств недопустимыми. Теоретическая и практическая значимость статьи состоит в том, что внесение указанных изменений в действующее законодательство позволит устранить противоречия и пробелы в действующем законе и правоприменительной практике, позволит добиваться большего единообразия в понимании допустимости доказательств в судебной практике. Также материалы публикации могут быть использованы в учебном процессе высших учебных заведений для обучения студентов при изучении дисциплин «Уголовный процесс», «Судоустройство и правоохранительные органы», «Прокурорский надзор». В статье использованы актуальные публикации, применены общенаучные методы исследования. ; The principle of legality, implemented in the course of proof, plays the crucial part in modern criminal proceedings. Studies show the shortcomings of law enforcement practice and legal regulation of the proof institute of criminal procedure. In this regard, the great practical importance assumes the formulation of concrete and scientifically based proposals for improving the criminal procedure legislation. The purpose of this article is to offer some reasoned projects in order to complement the existing Criminal Procedure Code regarding the definition of «inadmissible evidence» and the procedures of recognition the evidence as inadmissible. Theoretical and practical significance of the paper is that making these changes to the existing legislation would eliminate the inconsistencies and gaps in the current law and legal practice, and will allow achieving greater uniformity in understanding of admissibility of evidence in judicial practice. Also, the paper may be used in the educational process of higher educational institutions in studying subjects like «Criminal Procedure», «Judicial system and law enforcement authorities», and «Public Prosecutions». The article draws on relevant publications and general scientific methods of research.

Введение: проблемы, связанные с собиранием доказательств при рассмотрении уголовных дел в суде апелляционной инстанции, являются актуальными и активно обсуждаемыми как в научном сообществе, так и правоприменителями. В настоящее время суд апелляционной инстанции располагает тем же арсеналом способов собирания доказательств, что и суд первой инстанции, но с учетом ряда особенностей, предусмотренных главой 45.1 УПК РФ, в связи с чем автором в работе поставлена цель исследования и анализа некоторых аспектов собирания доказательств в суде апелляционной инстанции. Методы: методологическую основу данного исследования составляет совокупность методов научного познания, среди которых основное место занимают методы системности, анализа, синтеза и сравнительно-правовой. Результаты: обоснованная в работе авторская позиция опирается на действующее законодательство и разъяснения Пленума Верховного суда РФ. На основании анализа норм, содержащихся в главе 45.1 УПК РФ, рассматриваются особенности собирания доказательств на стадии апелляционного производства. Делается акцент на том, что реализация предоставленных законом для сторон возможностей по собиранию доказательств с учетом действующих положений закона зависит от усмотрения суда. Выводы: в результате проведенного исследования автор предлагает законодательно закрепить детальную процедуру рассмотрения дела судом апелляционной инстанции, что позволило бы усовершенствовать институт собирания доказательств на стадии апелляционного производства. ; Introduction. The issues connected with the collection of evidence during hearing of a criminal trial in the court of appeal are burning and given a great deal of consideration both in the academic community and by law enforcement officials. Currently the court of appeal possesses the same range of ways for collection of evidence as the court of the first instance, but considering some peculiarities as provided for by chapter 45.1 of the Russian Federation Code of Criminal Procedure. In this respect the author of the work sets a purpose to study and analyze some of the aspects of collection of evidence in the court of appeal. Methods. Methodological foundation of this research consists of a system of procedures of scientific knowledge. The centerpiece includes methods of consistency, analysis, synthesis and a comparative-legal method. Results. The position of the author justified in the work is based on the legislation in power and interpretations of the Plenum of the Supreme Court of the Russian Federation. In accordance with the analysis of regulations given in chapter 45.1 of the Russian Federation Code of Criminal Procedure, peculiarities of evidence collection at the stage of appeal proceedings are considered. It is pointed out that implementation of capabilities for collecting evidence provided by the law for parties depends on the discretion of the court. Conclusions. As a result of the research the author makes suggestion to codify a detailed procedure of hearing a trial carried out by the court of appeal which would allow to improve the institution of collection of evidence at the stage of appeal proceedings and would help avoid judicial errors during hearing of criminal trials in court of the first instance.
В статье исследуется вопрос понятия процесса доказывания и его составных элементов. Отмечается, что помимо традиционного представления о триаде структурных составляющих доказывания в виде собирания, проверки и оценки доказательств существуют и иные позиции. Так, в соответствии с одной их них элементом процесса доказывания является «исследование доказательств». Авторами проводится анализ указанного явления и соотношение его с элементами доказывания, закрепленными в законодательстве. ; The burden of proof includes the obtaining and use of evidence to reconstruct real circumstances of the event under study; it is the only means for the protection of rights and legal interests of the injured party and protects a person against illegal criminal liability and restriction of his/her rights and freedoms. It is impossible to adjudicate social conflicts in the field of law without the burden of proof. Therefore, the burden of proof has always been and still is the heart of criminal procedure. Meanwhile, the development of national legislation gave rise to different positions connected with the structure of evidence. The Criminal Procedure Code of the Russian Federation 2001, Article 85 has stated that the process of proof includes collection, examination and evaluation of evidence. The authors point out that none of the above constituent part got a detailed legislative regulation and this resulted in the discussion about their content and correlation with each other. It has been noted in the present article that verification of evidence is a central element of the burden of proof. The authors give a critical analysis of the opposite viewpoint (it is the examination of evidence that is a central element) and come to the conclusion that in this case examination of evidence is understood as collection of evidence and its evaluation, but this is inadmissible. Moreover, the problem of the structure of the burden of proof is solved in the legislation of foreign states in different ways. The article examines the renewed criminal procedure legislations in the countries of CIS and their interpretation of verification of evidence. According to the Criminal Procedure Codes of the Republic of Moldova (Article 100), Republic of Tajikistan (Article 87), Kyrgyz Republic (Article 92), Azerbaijan Republic (Article 144) the verification of evidence has no procedural character but is a constituent element of the collection of evidence. The Criminal Procedure Codes of Kazakhstan (Article 124) and Turkmenistan (Article 135) name the above element as "examination of evidence". On the whole the Criminal Procedure Codes of CIS interpret the examination of evidence loosely, the analysis of collected evidence being included into it. The authors come to the conclusion that all elements of the burden of proof are tightly intertwined and interpenetrated but examination of evidence has an independent character. Unlike other elements its purpose is to obtain some supplementary materials which at the final stage of burden of proof enable us to define whether the obtained evidence has all necessary characteristics and is able to supplement the set of other collected evidence.
Рассматриваются положения действующего уголовно-процессуального законодательства, регламентирующего возможность возвращения судом уголовного дела для устранения препятствий для его рассмотрения в судебном заседании. Указывается, что нормы УПК РФ не позволяют судье возвратить уголовное дело, по которому расследование произведено некачественно, для производства предварительного расследования. С учетом того, что суд призван вынести обоснованное справедливое решение, предлагается предоставить суду право направлять уголовное дело прокурору в случае недостаточности для вынесения приговора доказательств, если в судебном заседании без несоразмерных затрат невозможно устранить нарушения, допущенные органом расследования, и восполнить пробелы в доказательствах нельзя. ; The article explains that returning criminal cases for further investigation is needed. In accordance with Part. 4 Art. 302 of the Criminal Procedure Code of the Russian Federation (RF CPC), the "guilty" verdict cannot be based on assumptions; it is delivered only if during the trial the defendant's guilt in committing an offense is established by the evidence the court has examined. However, not every criminal case provides solid adequate evidence, sufficient for an unambiguous conclusion, to the court. Т1ю situation is complicated by the fact that the RF CPC, unlike the RSFSR Code of Criminal Procedure of 1960, allows the judge neither to return criminal cases that were poorly investigated to the prosecutor, nor to make criminal proceedings participants work. It is also known that in 2009 the legislator deprived prosecutors of most of their powers to supervise investigation bodies, which further reduced the quality of the preliminary investigation and the quality of the evidentiary material. As a result, to resolve the question of guilt or innocence, the court is forced to make expert studies, additional inspections, sometimes collecting more evidence than a preliminary investigation body, performing the function it does. Under such circumstances, it appears that returning criminal cases for further investigation is urgently needed, and it will not be a sign of prosecutorial bias. The author states that society and the state grow more stable when the tasks of criminal justice are solved. The tasks involve the punishment of the guilty, the justification of the innocent, the protection of the rights of victims, the restoration of violated rights, etc. It is extremely difficult to identify the "guilty" and "exculpatory" evidence in its pure form rather than in theory before assessing the whole bulk of it; one fact, depending on its connection with other evidence, can both convict and acquit the defendant. In case of a lack of evidence or in the presence of low-quality evidence it is far more preferable to require an investigation body to finish its work according to the norms of the current RF CPC rather than to make a controversial procedural decision that can have a negative impact on the state of the rule of law, as it sometimes happens today. Russian judges' conscience and decency should not be denied, and the court's task is to deliver a fair and reasoned verdict that can be made only after examining sufficient adequate evidence. A hierarchical and institutional judicial system will allow to properly control the validity of decisions on returning criminal cases for further investigation.
