Боротьба за незалежність України в ХХ столітті стала однією з найбільш величних сторінок в історії українського народу. Серед її важливих складових вагоме місце посідає героїчний чин творців і захисників Західно-Української Народної Республіки. Її виникнення у листопаді 1918 р., ухвалення 22 січня 1919 р. вікопомного Акту Злуки Української Народної Республіки і ЗУНР яскраво засвідчили державотворчі й соборницькі прагнення української нації, що залишаються актуальними й сьогодні, століття потому, в умовах складних для незалежної держави Україна внутрішніх і зовнішніх викликів.
Саме цими імперативами керувалися учасники міжнародної наукової конференції "Західно-Українська Народна Республіка: революція, державність, соборність", яка працювала 30–31 жовтня 2018 р. в Інституті українознавства ім. І. Крип'якевича НАН України (м. Львів) та Прикарпатському національному університеті імені Василя Стефаника і була присвячена 100-річчю з часу утворення ЗУНР. Її співорганізаторами стали також Івано-Франківська та Львівська обласні ради і державні адміністрації, академічні Інститути історії України, політичних і етнонаціональних досліджень ім. І. Ф. Кураса, народознавства, Український інститут національної пам'яті, Київський національний університет імені Тараса Шевченка, Національна академія сухопутних військ імені гетьмана Петра Сагайдачного. Представницький характер цього наукового форуму був засвідчений широкою географією його учасників, які презентували Республіку Польща, Словацьку Республіку й наукові і навчальні установи з 23 міст України: Києва, Львова, Івано-Франківська, Харкова, Одеси. Ужгорода, Чернівців, Черкас, Луцька, Тернополя, Рівного, Миколаєва, Вінниці, Кам'янець-Подільського, Кривого Рогу, Маріуполя, Коломиї, Дрогобича, Мелітополя, Кременця, Галича, Бурштина, Тисмениці. На конференції було заявлено 207 тем доповідей і повідомлень, до участі в її роботі зголосилося 217 науковців, з них 59 докторів наук, професорів.
The article deals with the issue of women's participation in military actions during the national liberation revolution of 1917–1921; analyzes the biographies of the UPR Army and Galician Army soldiers and the role of women in the struggle for Ukrainian sovereignty.The topic of women in the Ukrainian armies of the early 20th century comprehensively covers only the period of the Legion of Ukrainian Sich Riflemen and partly, of the Galician Army. Nowadays, there is no statistics about women in the Army of the Ukrainian People's Republic. There is only fragmentary information about the lists in separate military units and the memoirs of participants of that historical period with separate biographies and names. Until today it has not been determined which drills women had, which exact qualifications they received, as well as their total number in the Ukrainian armies.In this research, we have covered biographies of Iryna Shmyhelska-Klymkevych, Svitlana Kharchenko, Kharytyna Pekarchuk, Khrystyna Sushko, Vira Babenko, Yozefa (Yosypyna) Lysohor, Anastasiia Lynkova, Liusia Hurska, and the data about 47 other women who took part in the military struggle for Ukrainian sovereignty in the UPR and Galician Armies. We have considered conditions in which these women were fighting, and have established that almost all women who served in the UPR Army had multifunctional roles, however, legally registered at traditional female positions, mostly as mourning sisters.Research about women's participation in the Ukrainian War for Independence in 1917–1921 constitutes a part of several areas of the related analysis: the service of women in the UPR Army (their quantity, job responsibilities, biographical explorations, psychological portraits); participation and role of women in insurgent movements in the period of 1917–1921; development of the female veteran movement of the first half of the 20th century; influence of women's organizations on the course of the national liberation struggle of the Ukrainian nation during that time, etc. ; У статті розглядається питання про участь жінок у воєнних діях під час національно-визвольної революції 1917 – 1921 рр., проаналізовані біографії воячок Армії УНР і Галицької армії та роль жінки у боротьбі за українську державність.Тема про жінок в українських арміях початку ХХ ст. комплексно висвітлена лише щодо Легіону Українських січових стрільців та частково Галицької армії. Throughout the course of the 16th – 17th centuries, a new epoch begins in the history of European civilization – the epoch of the New Age. A revolutionary formation and, subsequently, the establishment of a new state system based on political democracy, legal freedom and civil equality are taking place. As in other European countries, significant socio-political transformations in Ukraine were also due to the national revolution of 1648–1676.Analyzing the events in Ukraine in the mid-seventeenth century as a component of the pan-European revolutionary movement, the author considers the attitudinal and ideological origins of the Ukrainian revolution. Their common European features, as well as specific features are clarified and characterized. In general, the change in the worldview system in Ukraine is associated with the renaissance-humanist and reformation ideas that began to spread in the Ukrainian lands without losing its original meaning, but acquiring here a kind of national color, aimed at understanding the urgent problems of Ukrainian society.In the field of political and legal doctrine, the assertion of the legal worldview takes place, replacing the theological. Its classic embodiment became the theory of natural law with its concept of inalienable natural human rights as well as the concept of social contract. These ideas became, to a greater or lesser extent, the basis of the Ukrainian revolution of the seventeenth century. Their embodiment can be found in the works of Ukrainian «Renaissance humanists» of the 16th – early 17th centuries: S. Orikhovsky, J. Vereshchynsky, I. Dombrovsky, S. Klenovych, S. Pekalid, J. Shchasny-Herburt, K. Sakovych.It is found that in the seventeenth century, the works of such prominent political thinkers, theorists of natural law as J. Lipsius, G. Grotius, later B. Spinoza, T. Hobbes, S. Pufendorf were becoming widespread in Ukraine. They found a favorable ground in Ukraine and directly influenced the Ukrainian revolution, as the state and legal ideas of these thinkers became especially popular not only among the intellectual elite, but also among the Cossacks – the main driving force of the revolution.A number of Ukrainian thinkers, despite the fact that until 1649 Ukraine did not have its own state, were considering the future path of its political development. Specific plans of forming own state are embodied, in particular, in the works of J. Vereshchynsky, P. Mohyla, Y. Nemyrych, and others. They became a logical continuation and development of the state approaches of Ukrainian Renaissance humanists and reflected the tendency to combine the understanding of the history of their own state-building tradition with the study of Western experience. The analysis of political and legal ideas of Ukrainian authors, real historical events of the seventeenth century testify to the emergence among the Ukrainian population of clear tendencies to build their own state. Since then, the idea of the Ukrainian nation-state became fundamental to the Cossack state-building and leading in the liberation struggles of the Ukrainian people of all subsequent centuries. ; Аналізуючи події в Україні середини ХVІІ ст. як складову загальноєвропейського революційного руху, автор розглядає світоглядні, ідеологічні та ідейні витоки української революції. З'ясовано і охарактеризовано їх спільні зі загальноєвропейськими, а також специфічні риси. Загалом, зміна світоглядної системи в Україні пов'язується з ренесансно-гуманістичними та реформаційними ідеями, які почали поширюватися на українських землях. З одного боку – вони не втрачали тут свого первісного змісту, а з іншого – набували національного виразу, зумовленого осмисленням актуальних проблем українського суспільства.З'ясовано, що підґрунтям української революції ХVІІ ст. стала теорія природного права з її концепцією невід'ємних природних прав людини та концепцією суспільного договору. Дехто з українських мислителів, незважаючи на те, що до 1649 р. Україна не мала власної держави, обмірковував майбутній шлях її політичного розвитку. Конкретні плани побудови власної держави втілені, зокрема, у працях Й. Верещинського, П. Могили, Ю. Немирича тощо. Вони відображали тенденцію до поєднання осмислення історії власної державотворчої традиції з вивченням західного досвіду. Аналіз політико-правових ідей українських авторів, реальні історичні події ХVІІ ст. засвідчують появу серед українського населення виразних тенденцій до побудови власної держави.
Cтаття підготовлена на основі маловідомих сторінок в історії боротьби українського народу за свою національну державність у період Російсько-польської війни, на завершальному етапі її активної фази у листопаді 1920 року. Розкрито причини та особливості прийняття рішень українським державним і військовим керівництвом щодо продовження збройної боротьби самотужки, після втрати союзницької допомоги з боку Польської Республіки. Розкрито маловідомі факти підписання російсько-польського перемир'я, тактики бойових дій між червоноармійськими та українськими військами на лівому березі Збруча. Вказано на головні причини поразок і невдач Української армії, які призвели до відступу на польську територію з подальшим її інтернуванням.

The article investigates the main directions of activity of the prominent Ukrainian lawyer of beginning of the XX century Volodymyr Starosolskyi. It is found out that the scholar's legal concept formed under the influence of the theories of Neo-Kantians, normativists, theoretical and methodological developments of S. Dnistryansky and G. Jellinek, was based on the sociological concept of law and state. The scientific works of Volodymyr Starosolskyi, his speech as a defender of Ukrainian patriots in Polish courts, pedagogical, political and military activities, speeches at numerous meetings, inspired by relevant ideas, give grounds to speak about the integrity and consistency of his legal concept.It is revealed that his university education, experience of political, military, pedagogical and legal activity made it possible to forecast events. In particular, Volodymyr Starosolskyi drew the attention of his contemporaries to the need for the creation of Ukrainian armed forces, in order to, in his words, put the force on guard of the law of Ukraine with the onset of «iron and blood» time. An important argumentation by Volodymyr Starosolskyi is the need of implementation (realization) of the right to self-determination by all the nations liberated from the domination of the Austro-Hungarian and Russian empires, and a clear and unequivocal denial of the «economic» justification of the alliance of Ukraine and Russia, which was considered an indisputable truth until recently.Developing the idea about the right of nations to self-determination, Volodymyr Starosolskyj argued that the nation could not realize its right differently than through its own statehood. Moreover, the nation cannot waive the right to self-determination, the right to its state will, as well as to J.-J. Rousseau, no one can «deny the will».As a result of the analysis, it becomes clear that the «Principle of the Majority» carries an understanding of many problems in contemporary jurisdiction, and in particular, in international law. In the above-named work, considering the different types of communities, the researcher argues that the communities, based on the «general will», make the decision by a majority vote, whereas assuming that the majority expresses this general will. Based on the concept of Volodymyr Starosolskyj, described in «Das Majoritatsprinzip», we come to the conclusion that international organizations, in particular United Nations, belong to such a type of communities, the base of which includes not the «general will», but amounts to «all wills», and therefore their decisions require unanimity.In communities, where decisions need to be unanimous, a minority, being secured to protect its interests by vetoing the proposals of the majority, should not abuse the law. If there is no unanimity, when voting, the votes are divided; the minority is provided with the right of veto, and the majority continues to seek another appropriate solution. Today this situation has developed on the international scene. In a time when Ukraine is suffering from Russian aggression, and the international community represented by its bodies created «for the maintenance of peace and international security» remain powerless before the state demonstrating the abandonment of the right as a regulator of social relations, which is impossible to force not to abuse the law when applying veto, various proposals for the exit from the crisis appear. One of them is the proposal to change the procedure for the adoption of common decisions in international organizations. However, according to the doctrine of Volodymyr Starosolskyj, the communities that representing the «will of all» (not the «general will»), which, by its legal nature, is the United Nations and its organs, has an appropriate decision-making algorithm for it. Perhaps, countries that pursue aggressive politics, ignore international law, systematically abuse the law, should in fact be devoid of membership in communities whose purpose is to «maintain peace and international security». ; Досліджено основні напрями діяльності видатного українського правника початку XX століття Володимира Старосольського. З'ясовано, що правова концепція вченого, яка формувалася під впливом теорій неокантіанців, нормативістів, теоретично-методологічних напрацювань С. Дністрянського і Ґ. Єлінека, ґрунтувалися на соціологічному розумінні права і держави. Наукова, політична і педагогічна діяльність Володимира Старосольського, проникнута відповідними ідеями, дає підстави говорити про цілісність і несуперечливість його правової концепції.Виявлено, що університетська освіта, досвід політичної, військової, педагогічної та правової діяльності дали змогу прогнозувати події. Зокрема, Володимир Старосольський акцентував увагу своїх сучасників на потребу створення українських збройних сил, аби, за його словами, з настанням часу «заліза і крови» на сторожі права України поставити силу. Важливою є аргументація Володимира Старосольського щодо необхідності реалізації всіма націями, які звільнилися з-під панування імперій, права на самовизначення, а також чітке та однозначне заперечення «економічного» обґрунтування союзу України і Росії, яке ще донедавна вважалося незаперечною істиною.Використовуючи «римську» конструкцію корпорації як уособлення загальної волі, де рішення ухвалюють більшістю голосів, Володимир Старосольський проаналізував також процедуру ухвалення рішень у спільнотах, які ґрунтуються на сумі воль усіх. За своєю правовою природою нині такими спільнотами є ООН та її органи. У сучасних умовах кризи багатьох міжнародних організацій, у тім числі через дії Російської Федерації, ідеї Володимира Старосольського знову набувають актуальності.
The place and role of Lviv history and law school in the system of Ukrainian legal education and science are analyzed. Attention is drawn to the fact that the school of history and law was established at the faculty of law of Lviv University in Austria period, when Galicia was part of the Austrian Empire. The establishment of this school began in 1784, when the diploma of the Austrian Emperor Joseph II was restored to the University of Lviv, and its law faculty. In the same 1784, the Department of Law History was established at the Law Faculty of Lviv University. From 1784 to 1887 it was called the Department of History of German and Austrian Law.Significant changes in the history of the University of Lviv and its law faculty occurred after the accession of the Western Ukrainian lands to the Ukrainian SSR in 1939. Lviv University was radically reorganized. The activity of the Lviv school of history and law was filled with new content. For the first time, Ukrainian became the language of legal education and science. During the Soviet period, the activity of the Lviv School of History and Law was continued – by professors V. Sokurenko and V. Kulchytsky, associate professors V. Kalinovich, B. Tyshchik, M. Nastyuk, and others.With the proclamation of state independence of Ukraine began the active development and activity of the Scientific History and Law School of Ivan Franko University of Lviv, headed by one of the most famous Ukrainian legal scholars at that time in the field of history of the state and law, authoritative scientist-lawyer, doctor of law, professor Volodymyr Kulchytsky (1919–2009). The Law School of History was developed in two directions: one of the history of Ukrainian statehood and law – was coordinated by Professor V. Kulchytskyy and the second from the history of statehood and law of foreign countries - was coordinated and coordinated by Professor B. Tyshchyk.Professor V. Kulchytskyy, as the coordinator of the school of history and law of the history of Ukrainian Statehood and Law after the proclamation of Ukraine as an independent state, became the author of the first objective textbooks on the history of the state and law of Ukraine, which brought up more than one generation of modern lawyers, patriots of our country. of the state. The scheme and periodization, methodological approaches of teaching the Ukrainian history of law and state, laid down by Volodymyr Kulchytsky, became the basis for teaching the course «History of the State and Law of Ukraine», which is used in all legal educational institutions of Ukraine to this day.B. Tyshchyk's scientific works as a coordinator of the school of law and history of the history of statehood and law of foreign countries are marked by a thorough, objective analysis of the complex interweaving of the various causes and consequences of political and legal phenomena and processes in the history of Ukraine and foreign countries. Extensive scientific and pedagogical experience, thorough knowledge of primary sources, which reflected the real legal and political life of their time, understanding of their relevance and detailed knowledge of socio-economic, geopolitical and other conditions of the genesis and evolution of state and legal phenomena, allow scientist to prove validity, sometimes political conjuncture of some approaches to the coverage of particular topics and issues of Ukrainian and foreign history of the state and law. We can say without exaggeration that the scientific works of Professor B. Tyshchyk continue to develop the traditions of the Ukrainian history school, laid down in the works of M. Hrushevsky, M. Arkas, D. Doroshenko, N. Polonsky-Vasylenko, I. Krypiakevych, V. Kulchitsky and others. The scientist has prepared 18 PhDs, two of them defended their doctoral theses. During his years of work at the Lviv University, two doctoral dissertations and more than 40 PhD theses were prepared at his department. Being the head of the Scientific History and Law School of the Ivan Franko University of Lviv, B. Tyshchyk makes a significant contribution to the training of highly qualified scientific and pedagogical staff for our country. Professor B. Tyshchyk's teaching and research experience is 59 years. He is a regular participant in various international and regional scientific conferences, symposia, round tables and more. Professor B. Tyshchyk is one of the leading scientists of Ukraine in the field of history of the state and law, a kind of «patriarch» of this science, his name as an authoritative scientist and experienced teacher widely known in Ukraine and abroad.During the newest period of independence of Ukraine within the framework of the scientific and law school of Lviv Ivan Franko University the concepts of stages of development of the Ukrainian state and law, origin of the Ukrainian statehood and law are developed, researches of the main branches and institutes of the Ukrainian law in their historical development are conducted, the reasons of realization and essence are analyzed codifications of Ukrainian law throughout historical development. ; Проаналізовано місце та роль Львівської історико-правової школи в системі української юридичної освіти і науки. The analysis of life and treacherous path of Oleksandr Sviatotskyi – a prominent contemporary Ukrainian lawyer, Doctor of Law, professor, full member (academician) of the National Academy of Legal Sciences of Ukraine, honored lawyer of Ukraine, director general of the oldest in Ukraine national law journal "Law of Ukraine", honorary professor at the Zaporizhzhya National University – is carried out.After graduating from the Ivan Franko State University of Lviv, he was appointed to the position of responsible secretary of the juvenile affairs commission of the Lviv City Executive Committee in 1980. From his student years, O. Sviatotskyi was attracted to scientific and pedagogical activity. During 1983–1990 he was a graduate student, assistant, senior lecturer, associate professor at the department of criminal law and process at the Law Faculty of the Ivan Franko State University of Lviv. Professor V. Kulchytskyi, who in the Soviet period formed patriotism among students, instilled in them a love of their mother tongue, Ukrainian traditions, introduced the students of the Law Faculty to such outstanding milestones of Ukrainian law, such as "The rights under which the people of Little Russia are being tried", "Extract of Little Russian rights", "Assembly of Little Russian rights", "Court and punishment in the rights of Little Russians" etc., had an important influence on O. Sviatotskyi. Professor V. Kulchytskyi was one of the few lecturers at the Law Faculty of the Lviv University who, during Soviet times, lectured and conducted seminars exclusively in Ukrainian. One of the well-known students and the followers of Professor V. Kulchytskyi was O. Sviatotskyi, who was interested in the problems of establishing and developing of the Bar in Ukraine. The research was completed in 1987, when the young scholar successfully defended his thesis for the degree of the Candidate of Law in a specialty 12.00.01 on the topic: "Establishment and Development of the Soviet Bar (Historical and Legal Aspect)". In 1990 he was awarded the scientific title of the associate professor. In 1990, he became a doctoral student at the Kyiv State University after T. Shevchenko. His research persistence and hard work allowed him to successfully defend in 1995 his thesis for the degree of the Doctor of Law in a specialty 12.00.01 on the topic: "The Bar in the Legal Mechanism for the Protection of Citizens' Rights (Historical and Legal Research)". Since 1994, O. Sviatotskyi has been at the same time engaged in the Bar, which enabled him to become a co-founder and senior partner of the Kairos Law Firm in 1995.One of the greatest achievements of O. Sviatotskyi is his highly professional work as the director general of the oldest law journal in Ukraine, "Law of Ukraine", which started in October 1995 and continues to this day.From 1996 to the present O. Sviatotskyi is a co-founder and president of the "In Yure" Publishing House". In 1997 he was awarded the academic title of professor. In 2000 he was elected an associate member of the National Academy of Legal Sciences of Ukraine. In 2000–2001 and 2003–2004 he was appointed Public Advisor to the Prime Ministers of Ukraine, and from 2002 to 2004 appointed as Advisor to the Minister of Transport and Communications of Ukraine, H. Kirpa. From 2001 to 2004, he held the position of Director of the Scientific Research Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine. In 2009, he was elected a full member (academician) of the National Academy of Legal Sciences of Ukraine. Since October 2014, a co-founder and president of the "All-Ukrainian Charitable Foundation for European Integration, Security and Humanitarian Projects "Revival of Ukraine". In November 2015, by the Bar Council he was appointed the chairman of the Scientific Advisory Board of the National Bar Association of Ukraine. From December 2015 to August 2017, Rector of the High Bar School of the National Bar Association of Ukraine. From June 2016 to August 2019, Adviser to the First Vice Prime Minister of Ukraine on a public basis. The main directions of scientific research are: constitutional law, organization of public authority, theory and history of state and law of Ukraine, philosophy of law, judiciary, intellectual property law, development and modern legal position of the institution of the Bar.Olexandr Dmytrovych's scientific work comprises more than 200 scientific works, among which are monographs, textbooks, manuals, scientific articles. The main stages of life and scientific-pedagogical and social activity of the prominent scientis-jurist in the field of history of the state and law, doctor of law, honored lawyer of Ukraine, honored professor of Ivan Franko National University of Lviv Volodymyr Semenovych Kulchytskyj (1919–2009) are covered in the article.It is stated that the name of V. S. Kulchytsky is known not only to the academic world but also to the general public as the name of a person of high culture, deep erudition, extraordinary simplicity and humanity, a true intellectual, a patriot of his people. As a lawyer, he revealed the secrets of Ukrainian history of law and the state for almost 60 years, educated the young generation, was the organizer of science, educational process, publishing, many cultural events.It is shown that Volodymyr Kulchytsky was a prominent figure not only in legal science and education, but also in the social and political life of Ukraine in the twentieth century. His legacy is an integral part of the gold fund of Ukrainian historical and legal science and culture. It needs study, and the ideas expressed by it need to be translated into life and further development. V. S. Kulchytskyy was not only a legal scholar who wrote more than 500 scientific works. He is an eminent scientist – a jurist of Ukraine, a great humanist, a patriot of his native land.V. S. Kulchytsky in the difficult conditions of the communist regime managed to occupy a worthy place in the history of law. The contribution of V. Kulchytsky to the development of Ukrainian historical and legal science is well known. He has authored and co-authored some 500 scientific and methodological works. His works are devoted to the study of the most urgent historical and legal problems of Ukrainian statehood and law. In the first half of the twentieth century. his scientific activity is related to the problem of the organization and activity of the Galician Regional Diet in the system of the Austro-Hungarian apparatus, which was not studied at that time. V. Kulchytsky devoted a lot of scientific articles to this problem, and on April 19, 1954 he successfully defended his dissertation for a Candidate of Law degree on the topic «Galician Sejm in the system of the colonial apparatus of Austria-Hungary». The results of the scientific study of this historical and legal problem have been greatly received by the legal public.Since the 1970 s V. Kulchytskyi's scientific interest has focused on the problem of the formation and functioning of the apparatus for the management of Western Ukrainian lands in Austria and Austria-Hungary (1772–1918). Due to his deep knowledge of Polish and German languages, archival materials, he researched and conceptually covered the system of law and law in Galicia in Austria and Austria-Hungary. It is this important scientific problem that is devoted to his doctoral dissertation and about 50 scientific papers.V. Kulchytskyy was one of the first Ukrainian legal scholars to study the history of the legal status of Armenian communities in Ukraine. He was one of the initiators and organizers of three scientific conferences dedicated to the historical ties and friendship of the Ukrainian and Armenian peoples that took place in Yerevan (1959), Lviv-Kyiv (1964), Yerevan (1971). The materials of the conferences were published in the scientific collections «Historical ties and friendship of the Ukrainian and Armenian peoples». In addition, V. Kulchytsky studied Ukrainian relations with the Polish, Moldovan, Belarussian, Russian, Hungarian, Austrian, Romanian and other peoples.In the 1990 s, V. Kulchytskyi's scientific activity was mostly related to the problems of the history of Ukrainian statehood and law. During this period a considerable number of articles, manuals and textbooks were published.V. Kulchytsky was a talented teacher of higher vocational school. His name was included in the gold fund not only of the Law Faculty of the Ivan Franko National University of Lviv, but of all Ukrainian law. He was a scientist with encyclopedic knowledge, lectured to students in the course of History of State and Law of Ukraine. The second half of the twentieth century was marked by fundamental shifts in social and cultural bases of the existence of humankind. Independent Ukraine has become a typical transitive society, which faced post-totalitarian ruin along with weakness of political power. Meanwhile, pseudo-elite seeks to preserve amorphous society, where lack of autonomous social subjects and institutes contributes to its dominance. While modern Ukrainian society doesn't fit into existing social and political typologies, there is a critical need for creating a relevant dictionary that would consider specific social reality after the downfall of "real socialism". Still, we need a new social contract that would provide a basis for social peace and outline prospects of social development in line with the idea of Europe. ; Друга половина ХХ століття означилася змінами соціокультурних підвалин існування людства. На цьому тлі незалежна Україна стала типовим транзитивним суспільством, яке на шляху розбудови власної державності зазнало посттоталітарної руїни разом із кволістю політичної волі влади. За умов відсутності політики як суспільної діяльності, що загартовує політичну волю як чинник суспільного життя, псевдоеліта зацікавлена у аморфності суспільства, коли відсутність автономних соціальних суб'єктів, реального законодавства та правопорядку, соціальних інститутів, що виконують автентичні функції, забезпечує її панування. Оскільки нинішнє українське суспільство не підпадає під відомі соціально-політичні типології, постає необхідність вироблення конкретизованого щодо неї словника опису з урахуванням специфіки соціальної дійсності після краху «реального соціалізму». Поряд із тим необхідна нова суспільна угода, що має створити основу соціального миру та окреслити перспективи суспільного розвитку, пов'язаного з цивілізаційним вибором на користь ідеї Європи.
The place and role of the Kyivan Rus in the centuries-old history of Ukrainian statehood are analyzed. The main attention is paid to the fact that the Kyivan Rus was the first state created by Ukrainians. The Rosy, Rusyns, Ukrainians are historical ethnonyms of one Ukrainian nation, in the language of which is Ukrainian, known from the VII century. The formation and development of the Kyiv Principality with the center in Kyiv was a logical result of the internal socio-economic and political development of the Eastern Slavs - the original Ukrainians. The unification within the limits of one Kyivan Rus state gave the Eastern Slavs the opportunity to defend their lands from the attacks of foreign powers and nomadic peoples (in the east and south – from the Pechenegs and Cumans, in the north – from the Varangians, in the west – from the Polish and Hungarian kings, in the south – from Byzantium). The victory of the Kyivan troops over the nomads also saved the West European states from the Turkic invasion.It is emphasized that the Kyivan Rus state in the form of government was considered a medieval monarchy and power in it was carried out on the principle of the suzerainty-vassalage. The relations of suzerainty-vassalage, typical for Europe, especially of its West, acquired here the completed forms, since the power of the Grand Duke over the domain princes, as well as power of the latter over the nobility was minimal. Although the Kyivan prince was a chief, Grand Duke of the entire state, but with the development of medieval relations between Kyiv and local princes the inter-princely agreements were signed, the so-called cross-scribing letters.The Kyivan Rus State – Rus' had the most important features of the state: its territory, the basis of which consisted of modern Ukrainian lands and the name of what is mentioned in the Chronicle, interstate agreements – «our land began to be called Rus'», which testified to the beginning of political identification and, accordingly, was considered one of the important signs of the existence of the state. The formation of the state has gone a long way to its evolution. Its main stages were the identification of the first state (state establishment) with the name of the ruling tribe, then the use of the words «land», «power», etc., and in new times – «nation» (people) to indicate the name of the state.It is emphasized that the Kyivan Rus state had a developed system of state authorities. The organization of state power and society in the Kyiv-Rus' state corresponded to the European model of that time. The supreme state power belonged to the prince, who carried out its most important functions - legislative, executive, judicial. Prince also headed the army, owned a significant state apparatus. He had the right to collect taxes, issue coins and order the treasury.Kyivan Rus' State – Ukraine-Rus' was one of the largest and most powerful states of the early Middle Ages, and had a significant influence on the cultural, political and state-building processes in Eastern Europe. This medieval Ukrainian state had achieved significant political and legal development and, at the level of law, economics and culture, had become one of the most advanced countries of that time in Europe. Subsequently, an equally powerful Galicia-Volyn' state, which also occupies an important place in the history of Ukrainian statehood, became the embodiment of the state idea of the Ukrainian people. ; Проаналізовано місце і роль Києво-Руської держави в багатовіковій історії українського державотворення. Акцентовано увагу на тому, що Києво-Руська держава була тим фундаментом, з якого і розпочалося створення Української держави. Утворення і розвиток княжої Київської держави з центром у Києві –закономірний результат внутрішнього соціально-економічного та політичного розвитку українців. Розкрито характерні риси державно-правового розвитку Київської Русі. Зазначено, що роси, русини, українці – це історичні етноніми одного народу, мовою якого є українська, яка відома ще з VІІ століття Києво-Руська держава відіграла важливу роль в українській та європейській історії. Києво-Руська держава – Україна-Русь справила значний вплив на культурні, політичні та державотворчі процеси у Східній Європі. Ця середньовічна українська держава досягла значного політичного розвитку і за рівнем економіки та культури увійшла до найпередовіших країн тогочасної Європи.
In the first days of the activity of Ukrainian People's Council state and legal institutions were formed, and their functioning created conditions for the revival and development of the Ukrainian state. However, Galician politicians realized that the fate of the ZUNR in those historical conditions was largely dependent on its international recognition and the support of great powers. It was actualized by the fact that the revived Polish state tried to legalize its claims on Eastern Galicia.Along with the plans of national-state construction, Ukrainian politicians faced the problem of forming the conceptual foundations of foreign policy, defining its priorities, and establishing an appropriate foreign policy apparatus. On November 9, 1918, the government was formed – the State Secretariat, which united 14 Secretariats, including the State Secretariat of Foreign Affairs.Trying to take advantage of political and international realities, the ZUNR government concentrated its foreign policy activities on two directions: the establishment of relations with the UPR and the recognition of the WUPR by the victorious countries in the First World War (Entente, USA) and stopping the aggression of Poland with their assistance. Under the act of unification on January 22, 1919, an association of the ZUNR and the UPR was constitutionalized in one sovereign state of the People's Republics. However, there was no real association. Significant historical, psychological, ideological and political disagreements that had accumulated over the centuries came out. The political weakness of the UPR did not allow it to help ZUNR. In addition, the UPR itself was not recognized by the Western world.Galician politicians had good reason to rely on the international recognition of ZUNR during the Paris Peace Conference. However, significant successes in Paris could not be achieved, as Western politicians favored Poland as a stronger partner than ZUNR. In defending the right to their own statehood, Galician politicians at the talks in Riga (1920) sought not to legitimize the annexation of the Eastern Galicia by Poland. Although the goal was not achieved, however, the ZUNR leaders believed that Galician delegation was successful in the negotiations, as information was provided to the world press about the current state of the Galician problem. The ZUNR exiled government in Vienna focused on diplomacy and the international recognition of the Ukrainian state, hoping for international conferences and the League of Nations. However, neither the Council of Ambassadors of the Entente countries nor the League of Nations hastened to return to the issue of Galician statehood.The successes of the foreign policy of the politicians of the Western Ukrainian state were reduced by inconsistency of actions and conflicts within the Ukrainian delegations, by controversial foreign policy opinions, maximalism, and uncompromisingness. Excessive hopes for the Entente states inhibited the formation of practical political thinking. One can agree with the conclusions of the researchers that the ZUNR governments did not formulate clear concept of their foreign policy. ; Обґрунтовано право ЗУНР на міжнародне визнання та реалізацію ідеї самостійного існування власної держави. Простежено зміни в державно-правовому статусі ЗУНР у період її діяльності.
In the article there is analyzed the publicism on the pages of the «Universum» magazine, which primarily deals with the various problems of the establishment and construction of the Ukrainian statehood. In the article it is shown and proved that the well-known journalists, scientists as well as the military personnel, in an analytical and in a bright journalistic form have thoroughly investigated the social reality of Ukraine and the socio-political aspects of the various life phenomena.The author believes that the publicism of the «Universum» is a kind of alloy of science, journalism and literature that allows us to comprehend the important problems from various sides and thus to give a weighted assessment of some facts. At the same time, this kind of creativity allows us to feel and understand the attitude of the society towards the justice and towards the creation of the public ideal in a fair and objective way.Key words: modern Ukrainian publicism, «Universum» magazine, the Ukrainian statehood. ; У статті проаналізовано публіцистику журналу «Універсум», яка насамперед присвячена різноманітним проблемам утвердження і побудови української державності й доведено, як на сторінках видання відомі журналісти, вчені, військовики аналітично, у яскравій публіцистичній формі ретельно досліджували соціальну дійсність України, суспільно-політичні аспекти різноманітних явищ життя. Автор вважає, що публіцистика «Універсума» – це своєрідний сплав науки, журналістики і красного письменства, який дозволяє всебічно осмислити ту чи іншу порушену проблему, дати зважену оцінку тому чи іншому факту. Водночас цей різновид творчості дозволяє глибоко й об'єктивно відчути та зрозуміти ставлення суспільства до справедливості, до творення громадського ідеалу.Ключові слова: сучасна українська публіцистика, журнал «Універсум», українська державність.
