Die Verfassungsentwicklung in Estland von 1917 bis 1940
Diese Diplomarbeit beschäftigt sich mit der Verfassungsentwicklung in Estland zwischen den beiden Weltkriegen, mit besonderem Bezug auf die Veränderung des politischen Systems und der politischen Realität. Die Republik Estland erlangte, nach dem Zusammenbruch des Russischen Kaiserreichs im Jahre 1918, ihre Unabhängigkeit als souveräner Nationalstaat unter einer demokratisch-parlamentarischen Verfassungsordnung. Trotz vielversprechender Ausgangslage kam es zu einem umfassenden Abbau des Parlamentarismus und zur Einführung einer demokratisch-präsidialen Verfassungsordnung, die sich in weiterer Folge zu einer Präsidialdiktatur entwickelte. Im Rahmen der rechtshistorischen vergleichenden Analyse der Verfassungstexte wird auch auf die Verfassungswirklichkeit, sowie die politische, wirtschaftliche und soziale Entwicklung Estlands eingegangen. Die Arbeit besteht aus 6 Kapiteln: nach einer kurzen theoretischen Annäherung an die Geschichte und Definition des Verfassungsbegriffes im 1. Kapitel, wird im 2. Kapitel die Entwicklung der unabhängigen Republik Estland unter zwei vorläufigen Verfassungsordnungen dargestellt. Das 3. Kapitel beinhaltet die Untersuchung des Grundgesetzes von 1920, welches die erste endgültige Verfassung Estlands darstellte. Im 4. Kapitel wird die Verfassungsänderung des Jahres 1933 behandelt, durch welche die estnische Verfassungsordnung derart tiefgreifend verändert wurde, dass es als neues Grundgesetz bezeichnet werden kann. Das 5. Kapitel handelt von der dritten Verfassung Estlands, dem Grundgesetz von 1937. Nach der inhaltlichen Untersuchung dieser Verfassung wird deren anschließende Anwendung bis zur Annexion Estlands durch die Sowjetunion im Jahre 1940 behandelt. Den Abschluss der Arbeit bildet das 6. Kapitel durch einen zusammenfassenden Vergleich der Ergebnisse mit den verbundenen Schlussfolgerungen. ; This diploma thesis deals with the constitutional development in Estonia in the interwar period, with particular reference to changes in the political system and the political reality. The Republic of Estonia gained its independence following the collapse of the Russian Empire in 1918, as a sovereign nation state under a democratic-parliamentary constitutional framework. Despite this rather favourable position, parliamentarianism was significantly weakened and a democratic-presidential constitutional framework was introduced, which subsequently developed into a presidential dictatorship. In addition to the comparative legal historical analysis of the constitutional texts, the constitutional reality and Estonia's political, economic and social developments are treated as well. This thesis consists of six chapters: after a short theoretical approach concerning the history and development of constitutional concepts in the first chapter, the second chapter deals with the development of the independent Republic of Estonia under two provisional constitutions. The third chapter contains the analysis of the Basic Law of 1920, which was the first final Estonian constitution. The fourth chapter deals with the constitutional amendment of 1933, which changed the Estonian constitutional framework in such a drastic way, that it can be seen as a wholly new constitution. The fifth chapter addresses the third Estonian constitution, the Basic Law of 1937. Following the substantive analysis of this constitution, it's subsequent application will be examined until the annexation of Estonia by the Soviet Union in 1940. Die Oktoberrevolution 1917 stellte für die internationale Sozialdemokratie eine Herausforderung dar; sie widersprach den bisherigen Prämissen sozialdemokratischer Theorie und Politik. Zudem standen die revolutionären Kampfmethoden der Bolschewiki im Gegensatz zu den von der Zweiten Internationale propagierten Methoden. Die russische Revolution und die ihr folgende Entwicklung rückten Grundfragen der Strategie und der Politik sozialistischer Parteien in den Mittelpunkt. Zu diesen Grundfragen zählen die Bedingungen und Möglichkeiten einer sozialistischen Entwicklung, Demokratie und Diktatur, Inhalt und Formen des Übergangs zum Sozialismus sowie das Verhältnis von Klasse, Partei, Staat und Führung. Die internationale Sozialdemokratie nahm bis zum Zweiten Weltkrieg nie eine einheitliche Haltung zur Oktoberrevolution und zur sowjetischen Entwicklung ein. Es dominierte die Ablehnung von Inhalten, Formen und Methoden der Machtübernahme durch die Bolschewiki wie auch der sowjetischen Entwicklung. Eng verknüpft mit dieser Haltung war die Stellung zu den kommunistischen Parteien. (ICE)
