Part II discusses the World security situation , global World order after the Sept. 11 attacks and after the US-led wars against Afghanistan and the Iraq and the impact on the United Nations´, NATO´s and the European Union´s role in international security and cooperation: The torture issue in the fight against AL Qaeda generated terrorism does increase global risks and new risks to Europe´s security situation. Dilemma problems of collective international security policy if credibility of western values is at stake by violations of human rights in the fight against terrorism ; revival of the nation state in strategic doctrine and foreign policy and the impact on NATO and the European Union´s role in the Afghanistan and Iraqi war theatre. Part III, Conclusion : launching a new design of international security and cooperation in USA- EU transatlantic relationship under the rule of law and human rights : The transatlantic relationship , the USA, the European Union and NATO, are challenged to practice an unconditional commitment to the rule of law, to human rights thus contributing to strengthening cooperative multilateralism in international security and cooperation through restoring credibility of common universal values.
A study prepared for the Swiss Federal Office of Energy (SFOE) The problem of increasing imports of subsidised renewable electricity from neighboring countries and Member States of the EU, undermining level playing fields for traditional hydropower in Switzerland, can be addressed by means of preferential taxation of electricity produced by means of renewable energy. Both under WTO law and the rules of the 1972 Free Trade Agreement, distinctions may be drawn on the basis of non-product related production and process methods, provided the same rules apply to domestic and imported electricity produced with similar methods. Differential taxation can be implemented on the basis of certificates of origin (CO) which need to be made available alike to domestic and foreign producers. A privilege exclusively granted to domestic producers cannot be lawfully sustained. Also, quantitative restrictions of imports cannot be properly justified. The study recommends adopting a system comparable to the UK model of renewable electricity exemption scheme, in place since 2001. It has not been challenged under EU law or under WTO law. To the extent that considerations of industrial policy dominate the motivation, rather than the promotion of green electricity, measures could be adopted on the basis of countervailing duties, offsetting foreign subsidies granted. Also, recourse to safeguard measures, albeit limited in time, can be contemplated. As Switzerland has little experience in taking recourse to trade remedies, a proper methodology taking into account WTO law would need to be developed and communicated in advance. Finally, efforts should be made to address the issue in negotiations with the European Union and Member States. Both unilateral measures relating to differential taxation as well as trade remedies may be used as an argument to bring about a settlement with exporting countries of subsidised electricity.
Die vorliegende Dissertation ist einem sehr aktuellen Thema, 'Zwingende Normen im internationalen Privatrecht', gewidmet. Die zwingenden Normen sind einer der Beschränkungsmechanismen der Wirkung der Rechtskollisionsmethode. Man kann die zwingenden Normen als die Normen definieren, die dank ihrer großen wirtschaftlichen und sozialpolitischen Bedeutung, unabhängig von der zuständigen Rechtsordnung, verwendet werden und durch eine Kollisionsnorm bestimmt (oder durch die Parteien aufgrund der Parteienautonomie gewählt) wird. Die zwingenden Normen können mehrere Ziele verfolgen: Schutz einer schwachen Vertragspartei, Drittschutz, Gewährung der Rechtsordnung und der öffentlichen Sicherheit seitens des Staates.Die Problematik der zwingenden Normen im internationalen Privatrecht ist von Bedeutung, sowohl für die Wissenschaft, als auch für die gesetzgebende und rechtliche Praxis. Dieses Institut ist noch ziemlich jung. Aber seine Festlegung in der internationalen und nationalen Gesetzgebung verlief sehr schnell. Obwohl die Möglichkeiten der Anwendung der internationalen zwingenden Normen durch die Legislative in der Rechtsprechung verankert worden sind, ist ihre praktische Ausführung mit vielen Schwierigkeiten verbunden. In vielen Gesetzgebungen, darunter auch in der weißrussischen, enthält der Artikel, der den zwingenden Normen gewidmet ist, keine klaren und deutlichen Merkmale solcher Normen. Man verwendet unterschiedliche Termine in der Doktrin und in der Gesetzgebung.
The intensified flows of goods, services, peoples and ideas across borders intrinsic to globalization have had numerous and multi-faceted effects. Those affecting culture have been perhaps the most controversial, as it is more often than not difficult to identify the spill-overs across economic and non-economic areas and across borders, as it is equally hard to qualify the effects of these spill-overs as positive or negative. The debate also tends to be politically and even emotionally charged, which has so far not proven advantageous to establishing a genuine dialogue, nor to finding solutions. This contention and the divergent interests of major players in the international community have been reflected in the institutions and rules of global law. It is the objective of this chapter to explore this institutional architecture, in particular its main (and opposing) constituent fora of the World Trade Organization (WTO) and the United Nations Educational Social and Cultural Organization (UNESCO). The chapter traces the evolution of these institutions and their interaction over time, as well as the underlying objectives, demands and strategies of the key proponents in the trade versus culture discourse, which ultimately shaped the existent law and policy. The chapter concludes with an appraisal of the present state of affairs situating the discussion into the contemporary global governance landscape.
This paper develops an analysis of the impacts of the Agreement on Government Procurement (GPA) Principles and Rules on the Peruvian Public Procurement regulation, and Peruvian participation in the process of international standardisation of public procurement through signing different kinds of free trade agreements (FTAs).
"Cultural diversity" has become one of the latest buzzwords on the international policymaking scene. It is employed in various contexts – sometimes as a term close to "biological diversity", at other times as correlated to the "exception culturelle" and most often, as a generic concept that is mobilised to counter the perceived negative effects of economic globalisation. While no one has yet provided a precise definition of what cultural diversity is, what we can observe is the emergence of the notion of cultural diversity as incorporating a distinct set of policy objectives and choices at the global level. These decisions are not confined, as one might have expected, to cultural policymaking, but rather spill over to multiple governance domains because of the complex linkages inherent to the simultaneous pursuit of economic and other societal goals that cultural diversity encompasses and has effects on. Accounting for these intricate interdependencies, the present article clarifies the origins of the concept of cultural diversity as understood in global law and traces its evolution over time. Observing the dynamics of the concept and the surrounding political and legal developments, the article explores its justification and overall impact on the global legal regime, as well as its discrete effects on different domains of policymaking, such as media, intellectual property and culture. While the analysis is legal in essence, the article is meant to speak also to a broader transdisciplinary public. The dissertation carries out a comparative research on mortgage between Germany and China. This is a thesis with a purpose, written to explain and comment on differences between German and Chinese mortgage. Based on different basic ideas of property law between Germany and China, this thesis tries to explore what are the causes of differences of both mortgages. This thesis takes the German and Chinese legal, political economic background into consideration too, in order to explain the causes of differences between German and Chinese mortgage. In addition to principle, content, extra forms and liquidation of mortgage this comparative analysis is also divided into the following parts: mortgage lending value of mortgage object, mortgage of construction contractor and mortgage in bankruptcy. In order to reach a better mutual understanding of legal systems between German and Chinese reader, the rules and regulations in both Germany and China are compared in detail to set out the different contents and peculiarities concerning mortgage. Over a few hundred years´ development, mortgage in Germany has achieved successes in practice. In China, there are similar system and structure to German mortgage. So the future development of Chinese mortgage can use the successful experience of German mortgage theory for reference. The author hopes this research can provide aid for the future development of Chinese mortgage. This paper would be the first research of comparative law on mortgage between Germany and China, because property law was just enforced in 01.10.2007 for the first time in China.
The European Union's original focus was on economic integration among the six founding Member States. The task of securing human rights at a supranational level had been entrusted to the Council of Europe, which oversees and operates the European Convention on Human Rights (ECHR) and its associated Court, the European Court of Human Rights, situated in Strasbourg. The ECHR remains the key instrument in Europe for the protection of human rights. Provisions on investment in the Comprehensive Economic and Trade Agreement (CETA) between Canada and the EU, both on substance and on dispute settlement procedures, are the culmination of a long process of replacement of the original EEC approach to establishment by the approaches followed by the GATS, the North American Free Trade Agreement (NAFTA) and Bilateral Investment Treaties (BITs). The article analyses this process; it focuses in particular on the law of external relations but takes into account the evolution of the law of the internal market and can also be read from this perspective as, in the authors' opinion, the evolution in the former throws light on the latter. The article intends to leave the legal facts to speak by themselves. By unveiling their rationale, it also gives rise to political concerns regarding the evolution of the law. As CETA limits the ability of the EU to legislate and erodes the ECJ's role, the article leads to the conclusion that the underlying rationale for the evolution, both in the internal and the external areas, has not been that of promoting integration but that of deregulation.
The authors article is a contribution to 50 years´ anniversary of signing the Rome Treaty establishing the European Economic Community, to better understanding the European Union, the relationship of the Union and the Member States. The issue of the European Union´s Constitution deadlock including the special issue of the weighting of votes as well as the issue of Poland´s and the Czech Republic´s position on the US offer to install a US led anti-missile system in the two EU Member States : these issues are demonstrating the one crucial identity issue of the relationship of the European Union and its Member States, the relationship of the whole and the parts. Viewing at transdisciplinary comparative reflections on the relationship of the whole and the parts in philosophy, philosophy of economics and in natural science as well as in the law and policy making system of the European Union: the author concludes that the parts do not constitute the whole as an end in itself, they are subject, however, to a functional dialectical role to achieve common objectives, they are bound by the rationalism´s principle of effectiveness which is one of the constitutional essentials of the Treaty establishing the European Union as the legal incorporation of the functional dialectical approach of combining integrative, cooperative and competitive interactions between the Member States. The author has a deeper look at the biology/cytology system of the cell as a complex network of intracellular and extracellular structures the individual components of which are highly interconnected and practice the dynamics of the dialectical relationship of the cell and its structural components of interconnected cooperative and competitive levels of the complex network: ensuring the vitality of the cell and preventing the cell´s intracellular components from losing their independent identity and getting mixed in the cytoplasm. What prevents the smaller Member States of an enlarged European Union from losing identity, from mixing in the "cytoplasm" of the larger European Union: it is the Union´s complex multileveled network system of the functional approach of the dialectical dynamic cooperative and competitive relationship of the Union and the Member States, the whole and the parts, and that dialectical functional relation prevents the enlarged European Union from being dismantled, as well. Part of that system the Membership of which Poland´s Government had signed is the legal and political commitment to respect Treaty obligations: to consult each other within the EU´s Council before undertaking bilateral actions having direct impact on the Common Foreign and Security Policy, to consult within the EU´s Council a common position before consulting the matter within NATO and,actually, before accepting the US offer to install a anti-missile shield in Central Europe.
Der Beitrag stellt zunächst die Arbeitsweise der Rechtswissenschaft vor und geht sodann auf die Entwicklung des Umweltrechts ein. Dieses hat sich von einem anfänglich punktuellen und auf die einzelnen Umweltmedien bezogenen Ansatz zu einem die Umwelt insgesamt in den Blick nehmenden integrierten Umweltschutzrecht entwickelt. Internationale Vereinbarungen, unionsrechtliche Vorgaben und nationale Gesetze insbesondere in den Bereichen Klimaschutz, Biodiversität, Naturschutz, Luftreinhaltung, Lärmschutz, Abfallvermeidung sowie Aktivierung der Öffentlichkeit für Umweltbelange werden vorgestellt und das Verhältnis der Ebenen zueinander bestimmt. Zudem wird ein Überblick über die im Umweltrecht geltenden Prinzipien gegeben, u. a. über das Nachhaltigkeits-, das Verursacher-, das Vorsorge- und das Kooperationsprinzip sowie über den integrierten medienübergreifenden Umweltschutz. Die Prinzipien finden Umsetzung durch die umweltrechtlichen Instrumente, z. B. direkte Verhaltensteuerung durch Ge- und Verbote, indirekte Verhaltenssteuerung durch Subventionen, umweltspezifische Fachplanung, Emissionszertifikatehandel oder Umweltaudits. Das Umweltrecht ist bei alledem auf naturwissenschaftliche Erkenntnisse angewiesen. Zur Beurteilung der Wirksamkeit seiner Steuerungsinstrumente bedarf es zudem wirtschafts-, politik-, sozial- und verhaltenswissenschaftlicher Forschung.
Die Implementierung internationaler Menschenrechtsbindung von Wirtschaftsunternehmen stellt das Privatrecht vor bedeutende, bislang weitgehend unbewältigte Herausforderungen. Der Beitrag umreißt zunächst die zentrale Rolle, die dem Privatrecht bei der Menschenrechtsdurchsetzung zukommt. Darauf aufbauend stellt er die wesentlichen existierenden Durchsetzungsmechanismen vor und setzt sich für eine Kombination aus Deliktsorganisationshaftung und Deliktsdurchgriffshaftung ein. Flankierend befürwortet er für ein Bestimmungsrecht des Geschädigten, bei Menschenrechtsklagen am Sitz einer Obergesellschaft das Recht des Handlungsortes als anwendbares Deliktsrecht zu wählen.
Das von der Bundesregierung beschlossene Gesetz für die gleichberechtigte Teilhabe von Frauen und Männern an Führungspositionen in der Privatwirtschaft vom 06.03.2015 statuiert im Kern eine 30%-Geschlechterquote für den Aufsichtsrat in der Aktiengesellschaft sowie für den Verwaltungsrat in der monistischen Societas Europaea. Der Beitrag beleuchtet den internationalen Anwendungsbereich der Quotenregelung und hält dafür, dass die 30%-Regel auch auf Auslandsgesellschaften mit hinreichendem Inlandsbezug angewendet werden kann.
Der Verfasser befasst sich mit neuen Perspektiven des europäischen Klimaschutzrechts. Anlaß ist ein in Kürze zu erwartender neuer Richtlinienentwurf der EU-Kommission zur Reform des geltenden EU-Richtlinienrechts über europäischen Emissionsrechtehandel. Untersucht wird, ob das auf Verbesserung des Handelssystems zielende Vorhaben Chancen hat, das Ziel eines wirksamen Klimaschutzes zu erreichen. Der Verfasser beschreibt den aus völkerrechtlichen Regeln des Kyoto-Protokolls, EU-Richtlinienrechts und deutschen Rechts des Treibhausgas-Emissionshandelsgesetzes und des Gesetzes über die Zuteilung (Allokation) von Emissionsrechten bestehenden Ordnungsrahmen für die bisherige Entwicklung eines europäischen Emisssionsrechtehandels, als Instrument im Dienst eines gewollt kosteneffizienten Klimaschutzes. Dieser geltende Ordnungsrahmen wird analysiert, ob seine tatsächliche Nutzung Marktentscheidungen betroffener Unternehmen erlaubt, sich kostenbewusst zu entscheiden im Spannungsfeld zwischen kurzfristigen wirtschaftlichen, überwiegend betriebswirtschaftlichen Unternehmensinteressen und langfristigen Interessen an nachhaltigem, wirksamen Klimaschutz. Der Verfasser erinnert an die grundlegende Philosophie des Kyoto-Protokolls, dass seine gesetzgeberische Umsetzung zu kostenbewussten Marktentscheidungen motivieren muss. Kostenbewusste Marktentscheidungen auf dem Gebiet des Emissionsrechtehandels sind Unternehmensentscheidungen über die Frage, ob sie ihre Pflichten zur Verringerung von CO2 –Ausstoß erreichen wollen durch die Wahl betriebsinterner Modernisierungsinvestitionen mit der Vermeidung von Kosten, die andernfalls durch den Erwerb von Emissionsrechten entstehen würden, soweit der Erwerbspreis für Emissionsrechte höher sein würde als der zu zahlende Preis für betriebsinterne Unternehmensinvestitionen. Vor dem Hintergrund der beschriebenen Defizite in der bisherigen Entwicklung eines Marktes für Emissionsrechte befürwortet der Verfasser die Absicht des Reformvorhabens der EU-Kommission, die Lehre aus der Vergangenheit zu ziehen, durch eine Verknappung der Zahl von Emissionsrechten und durch eine entgeltliche Vergabe ab 2013 die Voraussetzungen für einen stabilen und im Sinne des Klimaschutzes wirksamen Emissionshandelsmarkt zu schaffen. Dies bedeutet, eine Entwicklung einzuleiten, die zu einem Preisanstieg von Emissionsrechten über die bisherigen Durchschnittspreise zwischen 15 – 35 Euro pro CO2-Tonnen Äquivalent hinaus führt und damit indirekt zu einem weiteren Anstieg der Kosten für Energieerzeugung beizutragen. Der Verfasser anerkennt auch die Absicht der EU-Kommission, das System umfassend entgeltlichen Erwerbs von Emissionsrechten erst im Zuge eines weltweit wirksamen Handelsmarktes für CO2-Emissionsrechte greifen zu lassen. Dies vermeidet Produktionsverlagerungen in Gebiete ausserhalb der EU mit geringeren Anforderungen an Unternehmen. Für den Verfasser auf der Hand liegt der komplexe Zusammenhang der Problematik, eine Verschärfung des geltenden Rechts des europäischen Emissionshandels an die Entwicklung eines funktionierenden weitgehend universalen Marktes für Emissionsrechte zu knüpfen, wie dies der Vorschlag der EU-Kommission aus seiner Sicht zu Recht beabsichtigt. Der Verfasser erinnert an die noch immer ausstehende universale Beteiligung am Kyoto-Protokoll, gemeint ist vor allem die ausstehende Beteiligung der USA und Chinas, welche einem funktionierenden universalen Markt nicht förderlich ist. Der Verfasser bejaht, dass es gilt, das Risiko zu minimieren, dass vom europäischen Klimaschutzrecht betroffene Unternehmen Schlupflöcher außerhalb der EU suchen, um dort ohne Kosten für den Klimaschutz zu produzieren. Die Hemmschwelle hierfür darf nach Auffassung des Autors allerdings nicht dadurch gesenkt werden, dass der EU-Gesetzgeber- Parlament und Rat- im anstehenden Gesetzgebungsprozeß unangemessenen Forderungen der Stromwirtschaft nachgeben: Die EU würde sonst weltweit ein schlechtes Vorbild abgeben, wenn Rat und Parlament den Zeitplan für die Einführung des Systems des entgeltlichen Erwerbs von Emissionsrechten weit nach hinten, nämlich erst in das Jahr 2020 verschieben würden, obwohl ein System entgeltlichen Erwerbs von CO2-Emissionsrechten bereits für die verbindliche Phase des europäischen Emissionshandels 2008 – 2012 notwendig gewesen wäre, nachdem die stromerzeugenden Unternehmen bereits in der Probephase 2005 – 2007 mit dem System des kostenlosen Erwerb Zeit für ihre Anpassung hatten. Der Verfasser hält daher zügige und nachhaltige Verbesserung des bisherigen Systems für dringlich. Die Forderung stromerzeugender Unternehmen sei nicht glaubhaft, ihnen müsse noch mehr Zeit für ihre Anpassung an die Einführung eines entgeltlichen Erwerbs von CO2-Rechten eingeräumt werden. Die "windfall profits", die sie bisher erzielen, weil sie höhere Stromerzeugungskosten mit Kosten für den Erwerb von CO2-Emissionsrechten begründen, die ihnen wegen des bisher kostenlosen Erwerbs in Wahrheit nicht entstanden sind, beweisen in Verbindung mit den öffentlichen Diskussionen seit 2002/2003 über die Vorbereitungen der einschlägigen Gesetzgebung, dass die stromerzeugenden Unternehmen nicht erst mit der Vorlage des jetzigen Reformvorschlags der Kommission im Januar 2008 Gelegenheit haben, sich auf die Reformen vorzubereiten.
The study offers solutions to the crucial European Union´s crisis issue of how to overcome the present deadlock of the Treaty establishing a Constitution for Europe,giving priority to a short, concise Treaty merging the existing Founding Treaties on European Union and European Community along the traditional line of the dynamic, gradual evolvement of the European integration and cooperation. The author uses the method of applying the lesson taken from the process of dynamically gradual stages in European integration history to current challenges and to the prospects of further reforming the enlarged European Union. The author describes the dynamic stages showing that the Monnet integration method had its successes in European integration,but also experienced its limits, facing a dilemma of how to continue the successful integration process without giving a clear final design of the European Union. The more the EU enlarged with now twentyseven members, the more the doubts about the Union´s identity,namely its decisiveness, increased ,and thus the Union´s need of legitimacy increased requiring broad democratic approval by the European citizens. Establishing a constitution can be taken as political signal giving an European identity building political impulse. But establishing a Constitution can also be taken as an act of political intervention, it can be misunderstood, in the view of the citizens, as a final design of the European Union. The author is giving no priority to any political intervention by establishing a new Treaty text labelled "Constitution" and, by doing so,would again further damage the European Union´s legitimacy and risk misunderstandings to invest a new order, a static order similar to the static nature of nation state´s Constitution. Whatever label a new Treaty text will actually turn out, the enlarged European Union´s identity and legitimacy is the crucial issue: how to further develop the Union´s constitutional essentials – democracy, transparency and decisiveness- , essentials to be incorporated in a new Treaty text. The study´s method of applying the lesson taken from European integration history is exemplified in chapter IX also, applying the findings to the issue of the Union´s decisiveness, to the Union´s role played in the field of the Common Foreign and Security Policy focussing on the Union´s experience made in the years 2001-2003 after the September 11 attacks and on the current crucial issue of international security and cooperation politics of how to overcome the deadlock in Iraq and the serious prospect of another deadlock in Afghanistan.
