'Seit dem Ende des Vietnam-Kriegs 1975 hat es in Südostasien keine zwischenstaatlichen Kriege mehr gegeben. Kleine Krisen unter den südostasiatischen Staaten weiteten sich nicht aus, sondern wurden gewaltlos bearbeitet. Dazu hat die ASEAN maßgeblich beigetragen, die als Dialogforum Vertrauensbildung und Kooperation ermöglicht. Dieser Befund ist umso erstaunlicher, da in der ASEAN das Prinzip der Nichteinmischung gilt. Es gibt auch kaum institutionalisierte Strukturen und Mechanismen, durch die Druck auf Konfliktparteien ausgeübt werden könnte, zu einer Einigung zu gelangen. Dennoch wirkt die ASEAN auf ihre Mitglieder friedensfördernd, und zwar durch Normen, die sich innerhalb dieser Regionalorganisation herausgebildet haben. Das Handeln nach diesen Normen hat sich als Praxis des 'ASEAN Way' bewährt. Dies zeigt die Autorin in ihrer Studie und sieht in der ASEAN ein mögliches alternatives Modell zu klassischen, stärker institutionalisierten und eher westlichen Sicherheitsorganisationen. Das Modell könnte auch für andere Regionen der Welt attraktiv und tragfähig sein.' (Autorenreferat)

Argues that long term stability depends on whether East Asia is able to socialize China into its regional arrangements; economic development, security cooperation, and democratic transition. Develops concept of a "Pax Pacifica" (Pacific peace), a new global pluralistic community having a sense of common destiny.
ASEAN is considered as the most successful multilateral organization in the Asia region, especially in maintaining regional security and peace. The majority of the international observers, though, ASEAN has not produced any significance breakthrough and notable impact and thus deemed to be an ineffective regional organization. The key that separates ASEAN with others and allows it to maintain regional peace and co-operation is its unique diplomatic engagement with its member states, known as the ASEAN Way. The most important element of the ASEAN Way is the practice of the principle of non-interference among its member states. ASEAN members practiced this principle since the founding of the organization to ensure state sovereignty that serves as an expression of respect and equal standing for all member countries. This article explores the possibility of ASEAN Way and its practice of internal diplomacy to be applied in other regional or multilateral organizations. The purpose is first to measure and analyse whether the ASEAN Way is an effective practice that benefits the ASEAN members and the Asia region. If the practice is effective, according to the measure and the scope of the paper, the author is interested to observe whether the practice can be applied to other multilateral organizations. This is a qualitative article, the effectiveness of the ASEAN Way will be observed and analysed through the process and the result from conflict resolutions in ASEAN. The source of research comes from a bevy of academic literature on ASEAN and ASEAN Way as well as journalistic paper and articles.

Der Beitrag untersucht Ideen und Weltbilder, die Kooperation im südostasiatischen Raum nachhaltig mitbestimmen und damit einen wichtigen Beitrag bei den Bemühungen der Region um die Konstruktion einer regionalen kollektiven Identität leisten. Letztere findet ihren Ausdruck im so genannten ASEAN Way der 1967 gegründeten Gemeinschaft Südostasiatischer Staaten (ASEAN). Der ASEAN Way kann dabei als Versuch gelten, in Ergänzung zur asiatischen Wertehypothese einen asiatischen "Exzeptionalismus" auf außenpolitischem Gebiet zu begründen. Der ASEAN Way versteht sich als eine (südost-)asiatische Kooperationskultur, die sich grundlegend vom international dominanten Kooperations- und Integrationsmodell der EU und anderen westlichen, auch als "kartesianisch" bezeichneten Staatenverbünden unterscheidet. Die grundlegenden Prinzipien und Normen des ASEAN Way stehen jedoch spätestens seit der Asienkrise auch in Südostasien selbst auf dem Prüfstand und sind seither Gegenstand intensiver Debatten sowohl in der politikwissenschaftlichen Forschung als auch in der politischen Praxis. Der Beitrag zeigt insgesamt, dass die Kooperationskultur und die ihr zugrunde liegenden Werte nicht auf Vergemeinschaftung (also die Entstehung eines neuen einheitlichen Akteurs auf einer höheren politischen Handlungsebene) ausgelegt sind, sondern dass sie im Wesentlichen dem Politikverständnis des politischen Realismus entstammen, das sich seinerseits wiederum aus tief im kollektiven Gedächtnis der Region verwurzelten Weltsichten (Konfuzianismus) speist. International relations held between countries, either towards individually or amongcountries within the same International Organization are not always well established. Fromits inception and at the initial phase of its development, the main purpose of ASEAN was tomaintain peace and security among the member countries. To date, the settlement of disputesin ASEAN still cause confusion regarding the regulations, mechanism and method of work.This is primarily due to the ASEAN Way as an approach that emphasizes "at a pacecomfortable for all" for all ASEAN member countries, and is characterized by elements ofnon-interference and consensus. At the early stage, disputes among ASEAN member Statesare usually negotiated and formulated through the ASEAN Way. However, these disputes areoften difficult to resolve due to various constraints, in particular the existence of ambiguousprovisions which make the implementation of the provisions in the resolution of the disputebecome difficult. With this background, several problems that arise are as follows: How is theformulation of the problem? How is the dispute settlement mechanism in ASEANimplemented? What are the impacts of the ASEAN Way towards the dispute resolutionmechanism in ASEAN? What are the challenges and obstacles in resolving disputes inASEAN? This study uses a Sociological-Legal approach which is focused on the existingcases combined with the use of secondary data sources and qualitative analysis. This studyshowed that the primary instruments pertaining to dispute settlement mechanism in ASEANare the Treaty of Amity and Cooperation (TAC), Dispute Settlement Mechanism (DSM),Enhanced Dispute Settlement Mechanism (EDSM), and ASEAN Way. The ASEAN Way hasan impact on both security and regional stability. However, the rule of law is usually absentin the settlement of the dispute. Consequently, the dispute may reoccur or have an impact onthe same dispute later in the future. Challenges and barriers that often happen include the lackof ratification of ASEAN member States towards the ASEAN instruments regarding disputesettlement and also lack of trust towards fellow Member States.Keywords : Implications, ASEAN Way, Mechanism, Dispute Settlement

The article seeks to test the degree to which ASEAN has been able to develop a security identity based on its collectively held norms. The article begins by isolating two norms that are central to ASEAN, namely non-intervention in the internal affairs of sovereign states and non-use of force. The article then seeks to determine how consistently these norms have been upheld within ASEAN by analysing the policies of member states during two major crises where these norms were threatened: the 1979 Vietnamese invasion of Cambodia (Kampuchea) and the 1995 Chinese occupation of Mischief Reef. If member states pursued policies which upheld the norms in question (even where alternative unilateral policies may have been more beneficial to them), then this would suggest such a security identity existed. On the other hand, should unilateral interests take precedence over the will to uphold these collective norms, questions must be raised over the strength of ASEAN's security identity, both then and now.
