Abstract. The Covid-19 pandemic has transformed our
society, with administrative procedures – as relationships between public authorities and citizens and businesses – being no exception. Still, the innovative digitalisation of such procedures means the 58 administrative
units across Slovenia have been able to develop a responsive administrative system. Using normative, descriptive
and statistical research methods, the article identifies the
relevant drivers and barriers, like user demands leading to a more responsive service, the lack of legal bases,
and the top-down approach discouraging progress.
Correlation analysis shows that digitalisation also holds
important positive implications for the principles of good
governance. Moreover, larger administrative units are
more likely to achieve a higher degree of digitalisation
and hence better public governance. The findings are
useful for designing evidence-based public policies to
properly respond to pandemic-associated challenges.

La tesi affronta il tema dell'abuso del processo all'interno del sistema penale italiano, tentando una ricostruzione che, muovendo dal piano interno, adotta come ulteriori punti di riferimento l'indagine comparatistica (in particolare, diretta verso il sistema anglosassone) e l'analisi sintetica della nozione di Abuse of Right a livello sovranazionale (più nello specifico, con riguardo alla Convenzione europea dei diritti dell'uomo e delle libertà fondamentali e alla Carta dei diritti fondamentali dell'Unione europea). Da una ricognizione dello scenario maturato nel sistema interno, si tenta di tracciare una delimitazione dei connotati della categoria dogmatica in oggetto (attraverso l'analisi, in particolare, della pronuncia della Suprema Corte (Sez. un., 29 settembre 2011 (dep. 10.1.2012) n. 155, Rossi). Si prosegue con lo studio comparatistico: il sistema preso a modello è quello anglo-gallese, con uno studio diretto ad evidenziare punti di divergenza e, al contempo, l'esistenza di tratti comuni che possano consentire un'eventuale mutuazione delle soluzioni adottate in quella sede. Si procede con la ricognizione del panorama normativo ed interpretativo sovranazionale in materia: i summenzionati testi legislativi rendono contezza del radicamento di tale categoria anche a tale livello, palesando concretamente l'idea della necessità di un adeguamento interno in materia. Le riflessioni finali convergono in una critica delle impostazioni giurisprudenziali emerse nell'ordinamento italiano e dei limiti dell'inquadramento offerto, nonché dell'incapacità della categoria dogmatica così elaborata di offrire adeguate soluzioni ai reali generati dall'abuso del processo; donde la necessità di pervenire alla prospettazione di un diverso paradigma della nozione, secondo una ricostruzione che, pur non negando l'essenzialità del principio di stretta legalità in ambito processuale, ne concepirebbe un temperamento, con l'ipotesi di una elaborazione per via interpretativa di una clausola generale di divieto di abuso, diretta ad offrire una risposta sia agli eventuali comportamenti scorretti dell'accusa (capaci di minare alla radice le garanzie della difesa), sia a quelli dell'imputato. ; The thesis faces the topic of the abuse of process within the Italian criminal system, through an analysis which, moving from the national view, adopts as further points of reference the comparative research (particularly, focused on the England and Wales legal system) and the synthetic analysis of the notion of Abuse of Right on to international level (more in the specific one, with respect to the European Convention of the Human Rights and the Fundamental Chart of Human Rights). From a recognition of the scenario, matured in the italian system, I attempt to trace a delimitation of the essential elements of the dogmatic category (through the analysis, particularly, of the pronunciation of the Supreme Court (Sez. Un., September 29 th 2011, Rossi). The research keeps on with the comparative perspective: I focus the England and Wales system, with a study aimed at highlighting points of divergence and, at the same time, the existence of common traits that may allow to mutuate solutions adopted in that headquarters. Therefore, I conduct a recognition of the international legal scenario and interpretative panorama on the subject is made. Final reflections converge in a critique of the jurisprudence made in Italian law and of the limits of the framing offered, as well as of the inability of the dogmatic category so elaborated to offer appropriate solutions to the real problems generated by the abuse of process and, perhaps, the necessity to come up with the prospect of a different paradigm of the notion, according to a reconstruction that, while not denying the essence of the principle of strict legality in a procedural context, would conceive of a temperament of it, intended to offer an answer to any untrue behavior of the prosecution (capable of undermining the defense's defense), as well as those of the defendant.

This article focuses on administrative reforms in two countries of the Western Balkans – Croatia and Serbia – within the context of democratization and Europeanization processes. It explores, in particular, the administrative simplification measurdes and regulatory reforms that have been undertaken by the two countries in order to reduce administrative burdens on both businesses and citizens, and improve public governance and regulatory quality. In this article, particular attention is given to the progress reached by Croatia and Serbia in establishing the one stop shop principle and e-Government services. The main aim of the article is to verify the impact of the EU integration on administrative simplification measures, especially in the areas of administrative procedure and relationships between public administration and citizens.

Along several legislative interventions, following the Covid-19 pandemic, simplification Decrees (i.e. Decreto Semplificazioni and Semplificazioni bis) have made even permanent changes to the law on administrative procedure, law no. 241/1990, intervening in the public-private relationship, constantly evolving. Observing the articles of the law concerned by the reforms, attention is focused on the persistent decisory self-protection recognized to the public administration even in the emergency, proof of the inexhaustibility of administrative power. The need to achieve the public interest, even in the contemporary crisis of state sovereignty, is inevitably based on the principle of legality, which becomes more properly in "legality-justice". ; Tra i numerosi interventi legislativi, a seguito della pandemia da Covid-19, rilevano i decreti-semplificazione che hanno apportato modifiche anche permanenti alla legge sul procedimento amministrativo, l. n. 241/1990, intervenendo nel rapporto pubblica amministrazione-privato, in costante evoluzione. Ripercorrendo gli articoli della legge interessati dalle riforme, viene focalizzata l'attenzione sulla persistente autotutela decisoria riconosciuta alla pubblica amministrazione anche nella situazione emergenziale, prova dell'inesauribilità del potere amministrativo. La necessità di perseguire l'interesse pubblico, anche nella contemporanea crisi della sovranità statale, trova fondamento inevitabilmente sul principio di legalità, che declina più propriamente nella "legalità-giustizia".

Agamben's paradoxical treatments of potentiality seem to leave little room for any robust theory of the subject, political or otherwise. His Aristotelian conception of potentiality entails, in the highest instance, "that potentiality constitutively is the potentiality not to (do or be)," which suggests that even if potential is realized, it is realized only by its lack of activity. Agamben's Aristotelianism is a thread that runs throughout his work, and by looking back to The Man Without Content, particularly his discussion of Marx, it is clear that the framework of potentiality means that it is impossible for him to see in Marx anything other than an odd combination of a "metaphysics of will", and man simply as a kind of natural, living being. This in turn shapes his later discussion in Homo Sacer of the entry of zoe into the polis, which founds Agamben's entire claim vis-a-vis bare life. His wager, namely that the question "In what way does the living being have language?" corresponds exactly to the question "In what way does bare life dwell in the polis?", equates the living being with its political, linguistic, and natural potentialities so completely that there seems to be no room for any kind of historically anomalous or collectively unprecedented subject, one that would break with history or disrupt everyday order. Agamben's work could easily be criticized from the standpoint of a Marxism that would stress the constructed nature of human potential and the necessity to think through forms of organization from within shifts in the nature of work. However, in order to stay closer to Agamben's Aristotelianism, it is far more productive to compare him to a thinker for whom questions of linguistic capacity and politics are also central, and also stem from a certain complex relation to naturalism, namely Paolo Virno. This paper will thus, via a careful reading of Agamben's Aristotelian conception of praxis and potentiality alongside Virno's work on the relation between language and labor, demonstrate the constitutive reasons why Agamben cannot consider any kind of substantial notion of the subject, and why Virno's more nuanced conception of capacity, which draws upon both rationalist and naturalist theories of the subject might constitute a more relevant alternative. In modern realities the study of the processual form of administrative proceedings under quarantine caused by COVID-19 is important due to the increased need to protect the rights, freedoms and legitimate interests of individuals. The purpose of the study is to analyze the modern processual form of administrative proceedings and the compliance of law modifications with the quarantine conditions caused by COVID-19. The methodological basis of the study represents a set of updated methods of scientific research. The use of formal-logical and structural-functional methods allowed to highlight the elements of the processual form of administrative proceedings and to characterize the main aspects of their transformation, including processing in the quarantine period and restrictions caused by COVID-19. It is of interest to analyze the introduction of an electronic court, electronic exchange of processual documents, as well as participation in court sessions in the mode of the videoconference. With the help of the modeling method the disadvantages and risks of taking part in court sessions in the mode of the videoconference are highlighted. System analysis contributed to the consideration of the processual form as the most distinctive feature of administrative proceedings. The study revealed that the processual form of administrative proceedings had undergone particular fragmentary changes due to the test launch of individual subsystems of the Unified Judicial Information and Telecommunication System (UJITS) (as example: "E-Court") and the introduction of taking part in court sessions in the mode of the videoconference. It has been found that in the present realities, the processual form of administrative court proceedings needs further modifications aimed at ensuring the flexibility and a high degree of adaptability of legislative assistance to new conditions of implementation, allowing to guarantee the observance and protection of the rights, freedoms and interests of citizens whenever previously used methods and ...

L'effettività della tutela cautelare, intesa come tutela tempestiva, adeguata e piena, è stata la linea cardine dell'evoluzione della giustizia amministrativa, che, nel corso di un periodo durato più di un secolo, grazie all'opera della giurisprudenza e della dottrina, si è strutturata oggi su un vero processo. Approdo recente, e allo stesso tempo, simbolo di questa evoluzione, è sicuramente il Codice del processo amministrativo emanato con il d. lgs. 2 luglio 2010, n. 104. La ricerca, di cui questo contributo costituisce un resoconto, è iniziata contestualmente all'entrata in vigore del nuovo testo, e quindi è stata anche l'occasione per vederne le prime applicazioni giurisprudenziali. In particolare la lettura del Codice, prescindendo da una mera ricognizione di tutto il suo lungo articolato, è stata fatta alla luce di una ponderazione, nell'attualità, non solo del principio di effettività, ma anche del principio di strumentalità che lega tradizionalmente la fase cautelare con la fase di merito. I risultati della ricerca manifestano la volontà del legislatore di confermare questo rapporto strumentale, per fronteggiare una deriva incontrollata verso una cautela dagli effetti alle volte irreversibili, quale verificatasi nell'applicazione giurisprudenziale, ma contestualmente evidenziano la volontà di estendere la portata della tutela cautelare. Guardando a cosa sia diventata oggi la tutela cautelare, si è assistito ad un rafforzamento degli effetti conformativi, tipici delle sentenze di merito ma che si sono estesi alla fase cautelare. I giudici, pur consapevoli che la tutela cautelare non sia una risposta a cognizione piena, bensì sommaria, intendono comunque garantire una tutela tempestiva ed effettiva, anche per il tramite di tecniche processuali particolari, come quella del remand, cui, all'interno della ricerca, viene dedicato ampio spazio. Nella sua ultima parte la ricerca si è focalizzata, sempre volendo guardare in maniera globale agli effetti della tutela cautelare, sul momento dell'esecuzione e quindi sul giudizio di ottemperanza. ; During more than a century, the core of administrative justice evolution was the effectiveness of interim legal protection, that is a protection timely adequate and full. Thanks to case law and doctrine contribution, it is now structured on a complete judicial proceeding. Issued by legislative decree no. 104 of 2010, the Code of Administrative Proceeding is symbolic of this evolution (from now on, the Code). The present research begun at the time when the Code entered into force. For this reason, it is an opportunity to examine its first judicial application. In particular, the study of the Code aimed to an evaluation in the light of principle of effectiveness and the principle of instrumentality. The latter bounds traditionally interim protection with the judgment not only in the administrative actions but in any type of actions. The results show, on the one hand, a legislative confirmation of this instrumental relationship, in order to face uncontrolled drifts towards irreversible effects of interim protection, as partially noticed in case law, on the other, a desire to extend the scope of protection pending trial. In order to point out what the interim protection has become today, it is necessary to consider concrete effects of such measures on an application level. In that regard, binding effects have been strengthened along with suspension effects or not. Binding effects towards administrative decisions, typical of annulment actions, are now extended to a pre-trial moment . Judges are aware though that interim protection is not a full knowledge solution. However, they intend to ensure a timely and effective protection, even by peculiar technical proceedings such as remand, deeply analysed during the research. Finally, the last part of the present research focused on execution and compliance, still in the light of the effects of interim protection.

Dottorato di ricerca in Diritto dell' economia ; La tesi affronta il tema degli effetti spiegati sul piano civilistico da alcuni provvedimenti adottati dalle Autorità Amministrative Indipendenti. Dopo il richiamo, seppure in sintesi, dell'ambito storico-economico (liberalizzazioni del mercato e privatizzazioni) nel quale si colloca e va individuata la genesi di tali organismi indipendenti, si è proceduto alla analisi sistematica delle Autorità medesime, suddividendo la trattazione in due parti. L'una, dedicata alle Autorità cd. "di regolazione" - Autorità per l'energia elettrica ed il gas; Autorità per le garanzie delle comunicazioni; ISVAP - preposte alla regolazione ed al successivo controllo del settore di propria competenza. L'altra, riservata alle Autorità cd. "di garanzia" - Banca d'Italia; Consob, Antitrust – istituite allo scopo di garantire ed assicurare la tutela di interessi pubblici o collettivi di rilevanza costituzionale. Per ciascuna delle Autorità menzionate è stata richiamata ed esaminata sia la legge istitutiva sia le successive che ne hanno integrato e/o modificato la disciplina. La vastità del panorama normativo - cui corrisponde, peraltro, la complessità e la diversità dei poteri e delle funzioni riconosciuti a ciascun organismo – e l'ambito del profilo specifico trattato hanno reso necessaria la individuazione selettiva delle norme più rilevanti sotto il profilo civilistico, anche alla luce della prassi applicativa. Si è, quindi, proceduto ad enucleare le norme che attribuiscono alle Autorità: - poteri di natura prevalentemente "regolatoria", che si esplicano e si realizzano mediante provvedimenti normativi di natura secondaria ("regolamenti" ed anche "direttive" dell'Autorità per l'energia elettrica ed il gas e dell'Autorità per le garanzie delle comunicazioni; regolamento ISVAP in ordine al contenuto ed allo schema della "nota informativa"); - poteri di natura più squisitamente amministrativa cui corrispondono atti amministrativi a carattere discrezionale ("autorizzazione in deroga" dell'Antitrust); - altri poteri, infine, cui il legislatore non attribuisce un preciso nomen (potere della Banca d'Italia di prescrivere il "contenuto tipico determinato" per determinati contratti o titoli), lasciando spazio a diverse soluzioni interpretative. Quanto agli effetti conseguenti alla mancata osservanza dei provvedimenti delle Autorità, talora è prevista la sanzione di "nullità relativa" (in caso di "inosservanza" della forma prescritta dalla Consob ed in caso di contratto "difforme" rispetto al contenuto tipico determinato prescritto dalla Banca d'Italia). Altra volta (nell'ambito del mercato vincolato della energia elettrica) conseguono la "modifica" e la "revisione" del regolamento di servizio. L'approfondimento dei temi trattati nell'ampiezza del quadro legislativo rende palese la difficoltà di affrontare in termini unitari il profilo degli "effetti privatistici" delle (diverse) attività delle Autorità Amministrative Indipendenti e di pervenire ad univoche conclusioni di sintesi. ; The thesis addresses the civil-law effects of several measures issued by the Independent Administrative Authorities. A brief review of the historical and economic context leading up to the establishment of the independent authorities (market liberalization and privatization), is followed by a two-part systematic analysis of the Authorities themselves. The first part focuses on the so-called "regulatory" authorities, such as the electricity and gas regulator, the telecommunications regulator, and the insurance market regulator (ISVAP), set up to regulate and control their respective market sectors. The second part focuses on the so-called "supervisory" authorities, such as the Bank of Italy, the financial services authority (Consob) and the competition authority, set up to ensure the protection and safeguarding of constitutionally relevant public or collective interests. The laws establishing each of the above mentioned Authorities are examined, including any later supplements and/or amendments. Due to the vastness of this body of regulations, which, moreover, reflects the great complexity and diversity of the powers and functions of each organization, and the specific profile addressed, it has been necessary to selectively determine the more relevant civil-law rules and provisions, also in the light of their application. Therefore, the thesis highlights the provisions vesting the Authorities with the following powers: - powers of a predominantly "regulatory" nature, which translate into the issuing of secondary legislation (the "regulations" or "directives" issued by the electricity and gas regulator and the telecommunications regulator; the ISVAP regulation relating to the layout and contents of the "nota informativa" or notice providing information on insurance policies); - administrative powers, translating into the introduction of discretionary administrative measures (in the form of the "autorizzazione in deroga" by the competition authority, namely authorized exceptions to the law); - other powers without a specific name (such as, for example, the power of the Bank of Italy to lay down, in a pre-determined manner, a "template" for certain contracts or securities), leaving room for various legal interpretations. With regard to the effects of the failure to comply with and abide by the measures introduced by the Authorities, a penalty of "nullità relativa" (relative voidness) is sometimes provided (in the case of failure to comply with the form laid down by the Consob, and in the case of contracts "differing" from the standard template set out by the Bank of Italy). In other cases (with regard to the regulated electricity market) there is the "amendment" or "revision" process of the supply regulation. The in-depth investigation of the subject matter, with respect to the broadness of the statutory framework, clearly highlights the difficulty of addressing the "civil-law effects" of the (different) activities of the Independent Administrative Authorities in unitary terms, and, therefore, to reach univocal summary conclusions.

Il presente lavoro trae origine dal dirompente ingresso della figura dell'abuso del diritto tributario sul palcoscenico penale, divenuto protagonista di una tra le più discusse rappresentazioni di cd. 'diritto penale giurisprudenziale' e portato per la prima volta in scena dal celebre filone interpretativo Dolce&Gabbana. Così, una volta introdotto il concetto generale di abuso del diritto, lo si distinguerà dalle nozioni di evasione fiscale e di risparmio (lecito) d'imposta; tre concetti fondamentali i cui rispettivi limiti e interazioni costituiranno uno dei fil rouge dell'analisi. Si darà conto, poi, dell'operato del 'diritto vivente' in materia: una stagione giurisprudenziale caratterizzata, come si vedrà, più da ombre che da luci, intrisa di frequenti contrasti applicativi (sia diacronici che sincronici) e portatrice – in conseguenza – di una forte imprevedibilità del giudizio penale per le condotte classificate come abusive. L'analisi della genesi e dell'ascesa della punibilità dell'abuso del diritto in materia fiscale costituirà poi un'occasione per proiettarsi in una più ampia riflessione sulla crisi di legalità che affligge ormai da decenni l'ordinamento penale, di cui il filone Dolce&Gabbana ne costituisce paradigmatico esempio. Dopo avere ricondotto il fenomeno dell'abuso del diritto nell'alveo della più ampia crisi che investe la scienza penale contemporanea, si tornerà ad apprezzare il dato legislativo, rappresentato dal nuovo art. 10-bis dello Statuto del contribuente. Infine, l'indagine toccherà l'interrogativo che permane, latente, sulla materia: esistono perduranti ipotesi penalmente rilevanti di condotte riconducibili al genus dell'abuso del diritto? Come si avrà modo di osservare, oltre a fornire una risposta diretta a tale interrogativo, la riflessione sarà un'occasione per procedere ad una ridefinizione – concettuale e terminologica – degli 'attori' che hanno da sempre recitato in questo complesso settore del diritto penale tributario. ; The PhD thesis draws its origin from the appearance of the tax abuse of right in criminal procedures and by becoming one of the main actors in one of the most controversial performances of cd. 'ciminal jurisprudential law', brought to our attention by the renowned interpretative branch of Dolce&Gabbana. Therefore, once introduced the general concept of tax abuse, it will be separated from the notions of tax evasion and tax savings (legal); these three fundamental concepts and their limits and interactions will be the leitmotiv of the analysis. Moreover, there will be a study on the action of the "living law": a jurisprudential season characterized, as it may be noticed, by light and shadow, full of application contrasts (diachronic and synchronic) and with a strong unpredictability on the criminal judgement for those behaviors assessed as violations. The analysis of the origin and the development of the punishability of the violation of the law in tax policy will allow a broader consideration on the crisis of the criminal law principles. After tracing back the phenomenon of violation in the broader trend that has struck contemporary criminal science, the study will concentrate on the law data represented by the new Article 10-bis of the l. 212/2000 The novelty represented by the legislative decree 128/2015 represents a fundamental achievement on the topic: not only it (finally) gives a fundamental definition of the concept of violation of law, but also the legislator has expressly stated expressis verbis the criminal irrelevance. However, the interpretation of the article 10-bis and of its interactions with the Criminal Tax Law has its own critical points. Therefore, this study will try to suggest a possible solution.
