This study is devoted to analysing the structural decisions related to the administrative jurisdiction in Germany in comparison with other European countries. It focuses, in particular, on the institutional structure of the administrative jurisdiction and the functions associated with it to it. Different understanding of the scope of the administrative jurisdiction pre-determine how individual regulations of administrative procedural law are designed, for example, regulations concerning access to courts and the judicial powers of the administrative courts. Therefore, the article aims to demonstrate – from a comparative legal perspective – the processes of mutual interaction, namely how the structural decisions made about the administrative jurisdiction have been received, and to highlight the different developmental trends characteristic of individual countries. ; pracowanie poświęcone jest analizie decyzji strukturalnych dotyczących sądownictwa administracyjnego w Niemczech na tle innych krajów europejskich. Z opodatkowaniem wiążą się nie tylko złożone problemy prawne, lecz także etyczne. Uwidaczniają się one w procesie stosowania przepisów prawa. Zdarza się, że prawo podatkowe przeradza się w swoje przeciwieństwo, gdy rygoryzm w wykonywaniu litery prawa przestaje się liczyć z kontekstem społecznym. Właśnie wtedy, z uwagi na złośliwe tłumaczenie prawa (Cyceron), szczególna rola przypada sędziom sądu administracyjnego.Ochrona przed bezprawnym działaniem organów podatkowych wynika z wysokiej wiedzy interpretacyjnej sędziów, sędziowskiej dociekliwości i wnikliwości, moralnej wrażliwości sędziów na prawo, solidności kontroli instancyjnej.Pojawia się też problem relacji norm etycznych wywodzących się z wartości aksjologicznych do norm prawnych. Te relacje są następujące: normy prawne powinny posiadać legitymację aksjologiczną, natomiast normy etyczne legitymacji jurydycznej nie potrzebują. A to oznacza, że niesporne wartości aksjologiczne (dobro, godność, sprawiedliwość, równość, wolność) obowiązują niezależnie od umownie przyjętych w danym czasie konwencji stanowienia prawa. Zawsze więc stają się częścią systemu prawa w państwie. Prawo pozytywne jest wynikiem kompromisu sił politycznych i sił społecznych, które w życiu publicznym odgrywają istotną, ważną rolę. Dlatego też prawo pozytywne nie może być pełnym odbiciem uniwersalnych wartości aksjologicznych. I stąd właśnie pochodzą różnice zakresów pomiędzy obowiązującym systemem prawa a systemem norm etycznych wynikających z uniwersalnych wartości aksjologicznych. ; Taxation is not only associated with complex legal problems but also with ethical ones which become apparent in the process of applying legal regulations. When the rigorous application of the letter of the law ignores the social context taxation law degenerates into its opposite. In such situations, owing to malicious legal explanations (Cicero), a vital role is played by the judges of the administrative courts.Protection against the unlawful actions of tax institutions derives from the great interpretative knowledge of the judges, their inquisitiveness and insight, their moral sensitivity to legal issues as well as the soundness of the control processes of the courts.The problem arises here of the relationship between ethical norms which derive from axiological values and legal norms. This relationship can be defined as follows: legal norms ought to have axiological legitimacy but ethical norms do not require judicial legitimacy. This means that undisputedaxiological values (such as good, dignity, justice, equality, freedom) are valid independently of the legal conventions of law making applying at a given time. They are always incorporated into the legal system of a state. Positive law is a consequence of a compromise between the political and social forces which play an important and vital role in public life. This is why positive law cannot be a full reflection of universal axiological values. This explains why there are differences of scope between the legal system in force and the system of ethical norms which derive from universal axiological values.

The subject of this study is an analysis of legal norms focused on the efficiency of administrative procedure, including norms establishing the time limits for the administrative authorities to deal with cases and legal remedies to ensure that cases are settled without unnecessary delay. The considerations seek to verify whether the currently applicable regulations in the Polish legal system protect the right for cases to be considered in a fair manner, without undue delay, and whether they do not differ from the solutions adopted in other countries of the European Union. To compare models of administrative procedure in these terms, two Scandinavian procedures were chosen: Swedish and Finnish. It is widely accepted that Scandinavian countries are mature democracies, highly regarded for the administrative services provided to citizens and their guarantees of human rights protection. The Swedish model of administrative procedure was chosen due to the introduction of a new Administrative Procedure Act. In turn, the Finnish legal system is considered one of the most citizen-friendly public administration systems. In both Sweden and Finland, a number of improvements have been made to popularize e-administration, including actions taken to facilitate administrative procedure. ; Przedmiotem niniejszego opracowania jest analiza regulacji dotyczących sprawności postępowania administracyjnego, w tym w szczególności norm ustanawiających terminy załatwienia spraw administracyjnych i środków prawnych przysługujących stronom w celu zagwarantowania realizacji przez organ administracji publicznej obowiązku załatwienia sprawy bez zbędnej zwłoki. On 1 June 2017, a major amendment to the Code of Administrative Procedure came into force. The article deals with mediation incorporated into the Code as a new institution of administrative proceedings. The authors presented the advantages and disadvantages of mediation in public matters and discussed the theoretical foundations of this construction. They analysed the effectiveness of the mediation conducted in the proceedings before the administrative courts, pointing that en­trusting mediation to professional mediators (by amending the Act of 7 April 2017) was justified. The new regulation provides for mediation that is voluntary, secret, and conducted by an impartial mediator. The amending act does not specify the preferred mediation strategies, leaving this issue to the mediators, but the analysis of the content of the new provisions leads to the conclusion that the evaluative type of mediation is the leading one. The amended provision of Article 13 § 1 of the Code allows mediation in any matter, provided its the nature is sufficiently suitable. In the Authors' opinion, mediation should be allowed especially in matters that need to be resolved basing on the administrative discretion and in matters whose settlement requires the interpretation of terms that are not specified. In the authors opinion, mediation may be an effective instrument for eliminating administrative disputes but requires proper preparation of the clerks involved.

Dzieje się tak pomimo zmian w systemie międzynarodowym i innym spojrzeniu na zakres siły państw. Zmiany w systemie spowodowały, iż obok tak oczywistych wyznaczników siły państwa, jak wojskowych czy ekonomicznych należy również uwzględnić inne, definiowane poprzez soft power. Należy uwzględnić również mechanizm uruchamiania siły w postaci sprawnie działającego państwa czy woli wspólnoty do realizacji celów. W ocenie współczesnej potęgi należy również uwzględnić aspekt systemu międzynarodowego, który w dużym stopniu wpływa jakie elementy siły są ważne, a jakie mniej istotne w danej sytuacji. Uwzględniając powyższe uwarunkowania, ważne jest przyjęcie, że siła państwa jest zespolonym wynikiem wojskowych, ekonomicznych i miękkich czynników. Należy jednak uwzględnić czynniki zewnętrzne, systemowe, które ostatecznie określają siłę państwa. W badaniach nad problematyką siły państwa wykorzystano kilka metod badawczych. Analiza systemową, której wartość w badaniach siły jest szczególnie ważna z uwagi na konieczność określenia jej miejsca w systemie międzynarodowym na jego różnych poziomach. Ważne, szczególnie w zakresie potęgometrii są metody statystyczne, które uwzględniają zarówno stronę ilościową, jak i jakościową badanych zjawisk. It has to be recognized that the power of the state is a complex outcome of military, economic and soft factors. However, external, systemic factors that ultimately determine the power of the state should also be taken into account. Several research methods have been used in researching the power of the state. One is the method of systemic analysis, which is particularly important in power studies as it determines where power is located on different levels of the international system. The statistical methods that take into account both quantitative and qualitative aspects of the phenomena studied are important, especially in the field of power. The comparative method (analogy) is also used, as it allows similarities and differences between processes and phenomena to be detected.

Zgodnie z omawianą w artykule regulacją, sądownictwo administracyjne w demokratycznej Rosji miało być trójinstancyjne, co oznaczało, że wykonywane będzie przez sędziów administracyjnych w powiecie, wydziałach sądów administracyjnych sądów okręgowych w guberniach lub obwodach i wreszcie przez Senat Rządzący. Szybkość wprowadzania nowych sądów motywowana była planem przeprowadzenia reformy organów samorządu terytorialnego i wyborów do nich – legalność tych wyborów chronić miały nowe sądy. Rozpad państwa i przewrót bolszewicki sprawiły jednak, że nowych regulacji nie zastosowano w praktyce. ; Th is article presents the tradition and process of shaping the administrative judiciary before 1917 in the Imperial Russia and the reform of the Provisional Government of 30 May 1917, which introduced independent administrative courts in that country. According to this regulation, the administrative judiciary in democratic Russia was to be tri-state, which meant that it would be performed by administrative judges in the ujezd, the departments of the administrative courts of the district courts in the provinces or vicissitudes and fi nally by the Ruling Senate. Th e speed with which new courts were introduced was motivated by the fact that the reforms of local self-government bodies and the elections to them were legally protected by new courts. However, the breakup of the state and the Bolshevik revolution made it impossible to apply the new regulations in practice.

The work of the administration should serve the interests of the parties involved and of the public. That very need for proportionate and reasonable actions of the administration has led to establishing one of the basic principles in the process of issuing administrative acts, the participation of the interested parties in the procedure before the administrative authority. This is achieved by the requirement that, before issuing the act, the authority is to gather the opinions and statements of the members of the public who will be affected by it and to reflect them in the final act. The guarantee that members of the public will be allowed to participate in the procedure and influence the final content of the act is the judicial review of the administrative act.

The author analyses the pattern of governance of the right-wing parties in Poland between 2015 and 2019. It bears many features of a concentration of powers as a method of achieving desired goals in the sphere of political competition and public policy along with the use of informal components. The manifestation of concentration of power is centralisation, understood as the transfer of functions of the state from the lower (in particular local government) levels to the higher, as well as strong interference of the central government in many areas of public life that previously remained apolitical.

Legislative powers of the Council of Europe have a crucial impact on the domestic legal systems of the EU Member States including substantive administrative law, i.e. such an area of administrative law which defines rights and responsibilities of the public administration bodies and citizens. The legislation created by the Council of Europe's bodies has a great impact on the areas of law which were earlier regarded as the exclusive responsibility of a given country. The Council of Europe has always been a major source of standard setting. This paper analyses selected areas of substantive administrative law taking into account hard law and soft law documents developed under the auspices of the Council of Europe. ; Kompetencje legislacyjne Rady Europy mają istotny wpływ na systemy prawa krajowego państw członkowskich, włącznie z materialnym prawem administracyjnym, a więc działem prawa administracyjnego regulującym prawa i obowiązki organów administracji publicznej i obywateli. Akty prawne tworzone przez organy organizacji mają znaczący wpływ na te obszary prawne, które wcześniej uważane były za wyłączną kompetencję wewnętrzną. Rada Europy zawsze była ważnym źródłem stanowienia standardów. W niniejszym artykule analizie poddano wybrane obszary materialnego prawa administracyjnego, biorąc pod uwagę dokumenty hard law i soft law opracowane pod auspicjami Rady Europy.

The aim of the article is to present the issues of the Russian revolutions, their course and effects in the Polish press published under the partitions, representing various ideological and political trends. Foreign dailies remained the source of information about the revolution. A review of press publications allowed us to determine what information reached the readers of the Polish press. The creators of the Polish press assumed the attitude of observers of political and social life. The influence of revolutionary events on the development of the situation in Poland was discussed. A review of press publications allowed us to determine what information reached the readers of the Polish press. The press content analysis method and qualitative analysis of the presented content were used.

The article covers the legal and tax aspects of the implementation of general anti-avoidance clause in Polish tax law, including the historical outline of the clause, its essence, and the usefulness of achieving the legislator's intended effects.
