İdari işlemin kimliğini oluşturan icrailik karakteri, idari işlemin üçüncü kişiler üzerinde doğrudan doğruya çeşitli hukuksal sonuçlar doğurmasını sağlamaktadır. İdari yargıcı tarafından idari işlemin icrailiği ile kesin ve yürütülebilir olma şartı birlikte kullanılmaktadır. İcrailik karakteri zincir işlemler ve ayrılabilir işlemler kuramlarının oluşmasında rol oynamıştır. Böylece iptal davalarının uygulama alanı genişlemiştir. İcrai olmayan idari işlemler kural olarak iptal davasına konu olmamaktadır. Ancak somut olayda ilgili idari işlemin icrailik karakterine sahip olup olmadığı değerlendirilmelidir. ; The executability character that make up the identity of the administrative act provide the administrative act cause a variety of legal results directly on third parties. The executability of the administrative act and the condition of being final and executable for administrative act are used in conjunction by the administrative judge. The executability character played a role in the formation of theories of chain acts theory and severable acts theory. Thereby, the application area of action for annulment is expanded. As a rule, non-executory acts are not subject to action for annulment. However, whether or not having the executability character of the administrative act should be considered for the present case.

İdari merci tecavüzü kavramı, İdari Yargılama Usulü Kanunu'muzda yer alan ve yargı yerlerince uygulanan kendine özgü bir idari yargılama usulü kavramıdır. İdari merci tecavüzü ve bu bağlamda zorunlu idari başvurularla ilgili olarak mevzuattaki belirsizlikler nedeniyle yargı yerlerince birbirinden farklı yönde kararlar verildiği görülmektedir. Bu noktada idari merci tecavüzü kavramının, idare hukukunun çıkış noktası olan idari işlemin sahip olduğu özellikler bakımından değerlendirilmesi önem arz etmektedir. Çalışmada, ilgili kanuni düzenlemeler, öğretideki görüşler ve idari yargı kararları eşliğinde, idari merci tecavüzünün etkileri ve sonuçları ele alınmıştır. Bu değerlendirme sonucunda, idari merci tecavüzü kurumuna ve onun dayanağını oluşturan zorunlu idari başvurulara ilişkin eleştirilerimiz ortaya konulmuştur ; Encroachment into administrative authority is a sui generis concept relevant to the administrative procedure, it takes place in the Administrative Procedure Act and it is applied by the courts. Due to encroachment into administrative authority and related ambiguities in legislation regarding compulsory administrative application, it appears that decisions differ from one court to another. At this point, it is important to evaluate the concept of encroachment into administrative authority in the context of properties of an administrative act, which constitutes the starting point of administrative law. In this study, the effects and the consequences of encroachment into administrative authority are discussed in the light of legal regulations, the views expressed in the doctrine and decisions of administrative courts. As the result of this evaluation, our criticisms regarding the institution of encroachment into administrative authority and compulsory administrative applications which form its judicial basis are submitted

İdari makamlar, "idari işlemler" yoluyla irade açıklaması yapmaktadır. İdari işlemin, idari makamlar tarafından sona erdirilmesi yine idari işlemler yoluyla olmaktadır. Bu yetki, "İdari İşlemin kaldırılması" ve "İdari İşlemin Geri Alınması" şeklinde kullanılacaktır. Türk Kamu Yönetiminde, bu yetki kullanımında hatalar olmaktadır. Bu temel bilgiden yola çıkarak, bu çalışmada, öncelikle. "İdari İşlemin kaldırılması" ve "İdari İşlemin Geri Alınması" kavramlarından bahsedilmiştir. Daha sonra Türk Kamu Yönetiminde bu yetkinin kullanımında yönelik uygulamalar açısından incelenmiştir. Ayrıca idari işlemin geri alınması ve kaldırılmasının yargı kararlarına konu olan içeriği ve hukuki durumuna değinilmiştir. Türk Kamu Yönetimi'nde idari işlemin idarece sona erdirilmesinin çeşitli uygulamalarına yer verilmiştir. Son olarak, Türk Kamu Yönetiminde idari işlemlerin idare tarafından sona erdirilmesinin etki ve sonuçları ayrı ayrı ele alınmıştır. ; Administrative authorities are making a will disclosure through "administrative procedures". In Turkish Public Administration, there are mistakes in using this authority. Starting from this basic knowledge, in this study, firstly, the concepts of "Removal of Administrative Process" and "Reinstatement of Administrative Process" are mentioned. Then it was examined in terms of applications for the use of this authority in Turkish Public Administration. It also mentions the content and legal status of the withdrawal and removal of administrative proceedings, which are subject to judicial decisions. In Turkish Public Administration, various implementations of the end of the administrative process by the administration have been included. Finally, the impact and consequences of the administrative ending of administrative procedures in the Turkish Public Administration are addressed separately.

Bu çalışma siyasal iktidar ve meşruiyet arasındaki ilişkiyi ve siyasal iktidarın kendisine toplumsal rıza arayışını siyasi düşünceler literatürü bağlamında incelemektedir. Çalışma, siyasal iktidar ve meşruiyet ilişkisinde ortaya atılan tanımlar ve eleştiriler üzerine yoğunlaşmaktadır. Çalışma, meşruiyetin; statükonun haklılaştırılması, kendi dışındakileri olumsuzlaması ve toplumun siyasal, sosyal ve ekonomik olarak yeniden kurulması fonksiyonlarını tartışmaktadır. Bu çalışma, siyasal iktidar geleneğinin kendisini meşrulaştırmak için kullandığı yöntemleri de ele almaktadır. ; The study analyzes the relationship between the most important concepts of political science, political power and legitimacy and evahlates the phases, deflnitions and critiques of legitimacy in the history of political thought. it examines the political power's pursuit of social obedience before and after the theories of the modern state. The function of legitimacy and the relationship between political power and society are discussed. These functions consist of the legitimizaüon and justification of the statü s quo, the creation and exclusion of the "others", and thereconstnıction of the society in terms of social, economic and political engineering. The study, in detail, examines and criticizes the means that the legitimacy resorts to justify the political power.

Genel idari yargı Danıştay, bölge idare mahkemesi, idare ve vergi mahkemesinden oluşmaktadır. İdare ve vergi mahkemeleri ilk derece mahkemeleridir. Bölge idare mahkemesi istinaf mahkemesi iken, Danıştay hem ilk derece mahkemesi hem de temyiz merci, idare ve vergi mahkemeleri ise ilk derece mercileridir. Bu mahkemeler arasında görev uyuşmazlığı, olumlu görev uyuşmazlığı ve olumsuz görev uyuşmazlığı olarak görülebilmektedir. İlk derece mahkemeleri olan Danıştay, idare ve vergi mahkemeleri arasında, istinaf merci olan bölge idare mahkemesi ile temyiz merci olan Danıştay arasında, Danıştay daireleri arasında ve bölge idare mahkemesi daireleri arasında görev uyuşmazlıkları çıkabilmektedir. İdari yargıda çıkan bu görev uyuşmazlıklarının çözümü ve çözümünde yetkili olan makamların tespiti önem arz etmektedir. ; The general administrative judiciary consists of the Council of State, the district administrative court, the administrative and tax courts. The resolution of these disputes in the administrative judiciary and the determination of the authorities that are competent in the solution are important.
