Safeguards Agreements are the important legal institution in the system of international control of peaceful utilization of the atomic energy. The control is kept by the International Atomic Energy Agency. The control activities of this organization have to secure that any help offered by itself, by its request, or under its supervision or control cannot be diverted into any military goals. The control activities of the Agency in this scope have to preclude any proliferation of nuclear technology by means of eliminating the situations of inadequate utilization of the Organization's assistance by a State and to prevent a seizure or increase in an army nuclear supplies used and produced in the objects subjected to the safeguards system of the IAEA. The control activities of the Agency is regulated by many acts, the essential ones are: the IAEA Statute, the Safeguards Document, the Inspectors Document. They provide the key model of the control system. These provisions are specified in the Safeguards Agreements. The agreements are concluded between the Agency and one or several member states and they contain commitments of the states- -parties to the agreement to use materials equipment and installations subjected to the IAEA safeguards solely for peaceful goals, the organization is granted the right to control carrying out the commitments of the contracting states. The agreements can concern whether a project of utilization of the Agency assistance or bilateral or multilateral regulation in the scope of utilization of the atomic energy, enabling a contracting state to apply to the organization asking for executing safeguards, they can also refer to any activity of a state pertinent to the atomic energy which is unilaterally subjected to the safeguards of the Agency. The author of the article indicates at the substance of the Safeguards Agreements and discusses their particular types in the IAEA regulations and practice. These are: Project Agreements, Safeguards Transfer Agreements, Safeguards Execution Agreements, Unilateral Safeguards Submission Agreements, Supplementary and Subsidiary Agreements. As of today the European Union is the space of freedom, security and justice. This entails the free movement of persons and the lack of internal borders. The establishment of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union on 26th October, 2004 was another stage of the Member States' integration. With the increasing number of conflicts and the continuous development of the EU, Frontex ensures security of the EU citizens as well as helps the EU to harmonize its activities on all borders. It does so thanks to its appropriately trained staff and the co-operation between the Member States. This article emphasizes the increasing role of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union. ; Artykuł nie zawiera streszczenia w języku polskim.

The article describes the more important quality assurance projects in higher education that originated in Poland in 1993-1998. The thesis that in most of the countries of Central and Eastern Europe accreditation agencies are a substitute for central control of the state over higher education is discussed on selected examples of Solutions to the quality monitoring problem existing in those countries. On the basis of studies, observations and results of the discussion that has been going on for many years in the academic community, the author sketches possible scenarios of development and changes in the conceptions being implemented today. The expression optima, I solution here means a solution that perhaps to a lesser degree results from an analysis of real needs, but is the one that has a chance of being accepted by the academic community. ; W artykule zostały przedstawione ważniejsze projekty systemów zapewniania jakości kształcenia w szkolnictwie wyższym, powstałe w Polsce w latach 1993-1998. Teza, iż w większości krajów Europy Środkowo-Wschodniej agencje akredytacyjne stanowią substytut centralnej kontroli państwa nad szkolnictwem wyższym omawiana jest na wybranych przykładach istniejących w tych krajach rozwiązań problemu monitorowania jakości. Na podstawie badań, obserwacji oraz wyników dyskusji toczącej się od wielu lat w środowisku akademickim autorka wskazuje na możliwe scenariusze rozwoju i zmian obecnie wdrażanych koncepcji. Przedstawia również własną propozycję optymalnego rozwiązania problemu. Określenie optymalne rozwiązanie oznacza tu w istocie rozwiązanie, które może w mniejszym stopniu wynikać z realnej analizy potrzeb, ale za to ma szanse akceptacji przez środowisko akademickie.

W ostatnich latach ESA podejmowała liczne projekty naukowo-badawcze. Mimo potężnego zaplecza, jakim jest europejska gospodarka, ESA ma jednak znacznie mniejsze możliwości niż jej główna konkurentka – amerykańska NASA. Badania kosmosu, prowadzone przez ESA często mają charakter uzupełniający i pomocniczy wobec planów NASA. Silnymi konkurentami dla ESA są też agencje kosmiczne innych państw – Rosji, Chin czy Japonii. ; The article is devoted to the genesis, structure and present potential of the European Space Agency. This structure consolidates the projects of European countries related to the exploration of space. In recent years, ESA has undertaken numerous scientific and research projects. Despite the powerful base, which is the European economy, ESA has much less opportunities than its main competitor – the American NASA. Space research conducted by ESA is often complementary and auxiliary to NASA's plans. Space agencies from other countries – Russia, China and Japan – are also strong competitors for ESA.

The article is devoted to the process of creating European structures after 1990, and in particular the actions taken by the representatives of the Polish state. An effective process of bringing Poland closer to the European structures began with the actions that were aimed at establishing Poland's membership in the Council of Europe; those actions, however, were also aimed at obtaining member status in other specialized organizations, such as: the Organization for Economic Co-operation and Development (OECD), the International Energy Agency (IEA), and the Nuclear Energy Agency (NEA). These accessions were followed with a crowning achievement of obtain ing a full member status in the NATO. Nevertheless, it was accession to the EU that required particular engagement from all environments, including both political and academic. The author, who was directly involved in those events, pays particular attention to the works and output of the Convention on the Future of Europe (the European Convention).

Rozwój Europejskiej Agencji Zarządzania Współpracą Operacyjną na Zewnętrznych Granicach Państw Członkowskich Unii Europejskiej (Frontex) jest związany z funkcjonowaniem strefy Schengen i ewolucją polityki zintegrowanego zarządzania granicami zewnętrznymi. Podstawowym celem funkcjonowania agencji Frontex jest poprawa współpracy operacyjnej między państwami członkowskimi w zakresie zapewnienia wysokiego i jednolitego poziomu kontroli i ochrony granic zewnętrznych Unii Europejskiej. Jednak przyjęcie roli koordynatora tej współpracy ograniczyło zdolności kompetencyjne agencji, uzależniając jej działalność od woli państw członkowskich. Wśród szeregu zadań powierzonych agencji największe wątpliwości budzą jej uprawnienia w zakresie działalności operacyjnej, co potwierdził trwający kryzys migracyjny. W obliczu narastających zagrożeń zewnętrznych dotychczasowe kompetencje agencji okazały się nieskuteczne. Analiza wydarzeń związanych z kryzysem migracyjnym w UE nasuwa pytania o przyszłość agencji oraz całej strefy Schengen. Z pewnością konsekwencją kryzysu migracyjnego będzie przekształcenie obecnego charakteru agencji. Najnowsza propozycja zmian dotyczy bowiem utworzenia Europejskiej Straży Granicznej i Przybrzeżnej, która byłaby zdolna do podjęcia bardziej efektywnego działania na granicach zewnętrznych UE. ; Development of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union (Frontex) is related to the functioning of the Schengen area and evolution of the integrated management of external borders, which is to ensure a high and uniform level of control and protection of external borders of the EU. The main objective of the Frontex agency is to improve the operational cooperation between Member States at the external borders of the EU. Adopting the role of coordinator has limited the competencies of the agency, making its activities conditional on the will of the Member States, which remain mainly responsible for the control and protection of external borders. Among a number of tasks entrusted to the agency, the greatest doubt arises concerning the permissions in the area of operational cooperation, which in the face of increasing external threats show the weakness of the impact of the agency on the nature of cooperation in the protection of external borders. Analysis of recent events related to the migration crisis in the EU raises questions about the future of the agency. Certainly, consequence of the migration crisis will be to transform the current nature of the agency. Latest proposal of changes concerns the establishment of the European Border and Coast Guard, which would be able to take more effective action at the external borders of the EU.

Artykuł stanowi próbę nakreślania metodologii umożliwiającej socjologiczną konceptualizacją problemu ryzyka korupcji w instytucjach państwowych Rzeczpospolitej Polskiej. Proponowane podejście skupia się na pojęciu "zdarzenia korupcyjnego", terminu łączącego w sobie podmiotowe predyspozycje do udziału w korupcyjnych wymianach wraz z ich systemowymi oraz strukturalnymi uwarunkowaniami. Dzięki obraniu teorii stawania się społeczeństwa, dokonano wglądu w zagadnienie korupcji z perspektywy tych teorii socjologicznych, które postulują ontologię rzeczywistości społecznej umożliwiającą przezwyciężenie dychotomii: podmiotowość – struktura społeczna. ; The paper is an attempt to outline a coherent methodological framework fostering a more sociologically informed perspective on the problem of corruption risk as it is typical of the functioning of state institutions in Poland. The approach is based upon the concept of a 'corruption event' which combines agential dispositions to take part in corrupt exchanges as well as their structural and systemic determinants. In this way, assuming the theory of social becoming as a starting point, the postulated methodology investigates the problem of corruption from the theoretical perspective of sociologies aiming to provide a holistic and synthetic ontology whose objective is to overcome the dichotomy between agency and structure.

Teoria agencji jest wykorzystywana przede wszystkim do opisu zjawisk składających się na ład korporacyjny. Podejmowane są również próby użycia tej platformy teoretycznej do opisu procesów zawiązanych z funkcjonowaniem systemu szkolnictwa wyższego. Związki kontraktowe w tym sektorze umożliwiają wskazanie instytucji, które w zależności od przyjętej perspektywy badawczej mogą pełnić rolę pryncypała lub agenta. Najczęściej przedmiotem analiz są relacje występujące na styku państwo/rząd (pryncypał) – uczelnie publiczne (agenci). Celem artykułu jest ocena propozycji reformy systemu szkolnictwa wyższego w Polsce, przy wykorzystaniu perspektywy badawczej zawartej w teorii agencji. Jest to punkt wyjścia po pierwsze do identyfikacji najważniejszych dysfunkcjonalności obecnego systemu traktowanych jako przejawy problemu agencji. Po drugie propozycje nowych zasad funkcjonowania systemu zostały skonfrontowane z teoretycznymi mechanizmami łagodzenia konfliktu interesów: kontraktem opartym na wynikach i kontraktem opartym na obserwacji zachowań agenta. Rozważania zaprezentowane w artykule wskazują na możliwość identyfikacji efektywnych struktur instytucjonalnych w systemie szkolnictwa wyższego, których istotą jest rozwiązywanie problemu agencji. Fundamentem rekomendacji zawartych w propozycjach reformy systemu jest postulat zwiększenia autonomii instytucyjnej uczelni publicznych w stosunku do władz państwowych, ale również w stosunku do wewnętrznych jednostek. To silne kierownictwo uczelni, motywowane przez pryncypała za pomocą zindywidualizowanych narzędzi, przede wszystkim finansowych, sprawujące efektywną kontrolę nad procesami wewnątrz uczelni, jest warunkiem realizacji celów stojących przed polskim sektorem szkolnictwa wyższego. ; Agency theory is a concept used primarily to describe corporate governance phenomena. This theoretical platform is also used to describe the processes associated with the functioning of the higher education system. Contractual relationships in this sector make it possible to identify institutions that may act as principal or agent, depending on the perspective of the research perspective. Relations between the state / government (principal) and public universities (agents) are the most commonly studied subjects. The aim of the article is to present proposals for the reform of the higher education system in Poland, using agency theory as the research perspective. This was the starting point first to identify the most important dysfunctionalities of the current system as a manifestation of the agency problem. Secondly, the proposed new standards for the functioning of the system were confronted with theoretical mechanisms which are used to reduce conflict of interest: outcome-based contract and behavior-based contract. The considerations presented in the article point to the ability to identify effective institutional structures in the higher education system, the essence of which is to solve the agency problem. The foundation of the recommendations contained in all reform proposals is the desire to increase the institutional autonomy of public universities, in relation to state authorities, but also in relation to internal academic units. It is the strong leadership of the university, motivated by the principle of using personalized tools, primarily financial, with effective control over the processes within the university, is a fundament for achieving the goals of the Polish higher education sector.

This article deals with issues in the field of enslavement and agency. Slavery is understood as an area of political science research located at the intersection of issues of political agency and theories of power. In the first part, slavery is treated as a form of enslavement, and other forms of enslavement are presented using a modified, four-part scheme proposed by Szymon Wróbel. The second part describes some fields of transgression, emancipation and agency.

Creating independent agencies, offices or anti-corruption commissions becomes a common practice used by the states aiming to a comprehensive fight against corruption. This kind of institutional arrangements introduced in many countries in Europe, Africa, Asia and America, also in Poland created an anti-corruption agency called the Central Anticorruption Bureau. The need for creation of anti-corruption agencies also highlighted at international level. A number of international documents on preventing and combating corruption contain a requirement to create the appropriate agency or unit whose main purpose is to prevent and combat corruption. The paper reviews the institutional solutions adopted in different countries, with special emphasis on the leading anti-corruption agencies in the world (in Hong Kong, Singapore and Australia) and those countries, where according to the Corruption Perceptron Index, which estimates the level of corruption in the country, have not reached the highest results, to demonstrate that such institutions per se do not eliminate corruption. Many other factors play more important role, like, three-dimensional strategy: detection, prevention and public education. ; Tworzenie niezależnych agencji, biur lub komisji antykorupcyjnych staje się częstą praktyką stosowaną przez państwa zmierzającą do kompleksowej walki z korupcją. Tego rodzaju rozwiązania instytucjonalne wprowadziło wiele państw w Europie, Afryce, Azji i Ameryce, również w Polsce utworzono antykorupcyjną agencję pod nazwą Centralne Biuro Antykorupcyjne. Na potrzebę tworzenia agencji antykorupcyjnych zwrócono również uwagę na płaszczyźnie międzynarodowej. Szereg konwencji dotyczących zapobiegania i zwalczania korupcji zobowiązuje strony do tworzenia odpowiedniego organu lub organów, których głównym celem będzie zapobieganie i zwalczanie korupcji. W opracowaniu dokonano przeglądu rozwiązań instytucjonalnych przyjmowanych w różnych państwach, zwracając szczególną uwagę na wiodące w świecie agencje antykorupcyjne (w Hong Kongu, Singapurze i Australii) oraz na te państwa, które wg indeksu percepcji korupcji szacującego ogólny poziom korupcji w państwie nie osiągnęły najwyższych wyników, by wykazać, że instytucje takie per se nie likwidują korupcji. Istotną rolę bowiem odgrywa wiele innych czynników, w szczególności trójwymiarowa strategia: wykrywania, zapobiegania i edukacji społecznej.

The basic goal of the article is analyse the current regulations about credit rating agency and their activity in European Union and United States and answer the question which one the issuer or investor paid credit rating model is better, as a result building the own credit rating management model. It has been made a literature review abut actual models of risk management. Then are presented the current trends and propositions of changes in regulations. There have been described models: "issuer pays" and "investor pays" and introduced the original model management agency, taking into account the rating of four players, namely: the investor, issuer, rating agency and supervisory institutions. It has been put the following hypothesis: The introduction of regulations on credit rating agencies and credit ratings, improve the social welfare and the quality of the presented notes. ; Celem artykułu jest analiza aktualnych przepisów regulujących działalność agencji ratingowych stosowanych w krajach Unii Europejskiej oraz Stanach Zjednoczonych, a także odpowiedź na pytanie, który z modeli: "emitent płaci" czy "inwestor płaci" jest lepszy z punktu widzenia funkcjonowania rynku finansowego i w związku z tym zbudowanie autorskiego modelu zarządzania agencją ratingową. Dokonano również przeglądu literatury dotyczącej aktualnych modeli zarządzania ryzykiem. Następnie zaprezentowano bieżące trendy i propozycje zmian w przepisach. Opisano modele "emitent płaci" i "inwestor płaci" oraz przedstawiono autorski model zarządzania agencja ratingową przy uwzględnieniu czterech graczy, a mianowicie: inwestora, emitenta, agencji ratingowej oraz instytucji nadzorczej. Postawiono hipotezę badawczą, że wprowadzenie regulacji prawnych dotyczących agencji ratingowych oraz credit ratingów poprawia wypłatę społeczną oraz podnosi jakość prezentowanych not.

In the second half of the first decade of the twenty-fi rst century has become apparent stagnation in the development of defense policy of the European Union. This happened in the time when the EU was to realize its ambitious plans to develop the resources and capabilities to conduct a wide range of crisis management operations (Petersberg tasks). The stagnation of the CSDP contributed reduce the political importance of the EU in the international arena. Its causes were: an increase of disparities between the member states of the EU, strengthening by the Treaty of Lisbon the mechanisms of intergovernmental cooperation; the fi nancial crisis of 2008, and a general weakening of the international activity of the EU. Conditions for removal of the CSDP from stagnation stuck in the change in the security environment of the EU and in regulations of the Treaty of Lisbon. The main chance of reviving and strengthening the CSDP is not in its institutional development, but in the opportunity and conscious need to develop a new EU security strategy, as well as in strengthening the military capabilities and European defence sector, and also in increasing practical cooperation between the EU and NATO.

By focusing on the Western Balkans, this paper asks two questions: first, how small states that are both EU members and candidates for membership understand their role within this normatively powered order and, second, what their roles and agency mean for the order they are socialised into via democratic norms. The notions of hierarchies and orders are conceptualised in this paper as processes of norm diffusion and understood within the socialisation of democratic norms, which, according to the literature, can be institutionalised, rejected, or modified locally. First, I argue that such measurements can help us understand how the EU's practices shape the broader understanding of its actorness in normative and strategic terms toward the Western Balkans. Second, I scrutinise national strategies related to the processes of state-building, security, economy, and society to demonstrate how Serbia and Croatia present their agency as supporting and affirming of the prevalent conception of order in norm localisation, or being more critical of it in the process of localised norm contestation. Third, the effects of EU approaches that provide more tactical and technical views of Europeanisation, rather than (a strategic) full thrust on enlargement, are discussed in the conclusion by bringing the comparative insights together and parsing them by means of the shelter theory for small states.
