Functioning and noticing cooperative and national agricultural farm as total institutions is connected with comprehending the collectivization, understood as converting individual agricultural farm into farming cooperatives (v. RSP, the collective farm), of craftsman's workshops into production cooperatives, and the like and of large manors into agricultural farm stewarded by the state. In frames of all institutional forms of cooperative and national planting the earth some stamps of total- institutions became discernible the concentration of functioning on the homogeneous area relatively isolated in terms of physics or culturally from the social environment, the division into subordinates and the staff, functioning of second living in the institution in such conditions are an Effect of functioning of people dominating of a welfare state mentality and the lack of the initiative in search for employing outside the domicile.

The subject of the considerations presented in the article is the shape of modern regulations on the protection of agricultural land. The analysis is conducted primarily in the field of protective provisions regarding the so-called quantitative and qualitative protection of agricultural land, as well as economic instruments correlated with these provisions for the protection of agricultural land. Other regulatory areas, including predominantly the existing and discussed solutions of European Union law regarding closer linking of agricultural producer support instruments with requirements in the field of environmental protection, within the scope of the so-called conditionality and greening. The subject of the study is not only the analysis of traditional directions of agricultural land protection as a means of production in agriculture, but also an attempt to determine the areas and directions for further development of this regulation. ; Przedmiotem rozważań prezentowanych w artykule jest kształt współczesnej regulacji dotyczącej ochrony gruntów rolnych. Analiza prowadzona jest głównie w zakresie przepisów ochronnych dotyczących tzw. ochrony ilościowej i jakościowej gruntów rolnych, a także skorelowanych z tymi przepisami instrumentów ekonomicznych ochrony gruntów rolnych. Przedmiotem rozważań są również inne płaszczyzny regulacyjne, w tym przede wszystkim istniejące i dyskutowane rozwiązania prawa Unii Europejskiej dotyczące ściślejszego powiązania instrumentów wsparcia producentów rolnych z wymaganiami w zakresie ochrony środowiska naturalnego, w zakresie tzw. warunkowości i zazieleniania. Przedmiotem opracowania jest zarówno analiza tradycyjnych kierunków ochrony gruntów rolnych jako środka produkcji w rolnictwie, jak i próba określenia płaszczyzn dalszego rozwoju tej regulacji.

In this article the reform of relations between towns and villages is treated in terms of economic undertakings aimed at eliminating the hitherto existing income and civilization discrimination of villages and agriculture in comparison with non-agricultural sectors and townspeople. Responsible for the present state of things is the logic of the former economic system with its roots in directive and distributive method of planning and management in non-agricultural sectors. Without understanding and eliminating the systemic causes of that discrimination no economic reform will ever be possible. The reform must in the first place be concerned with relations between the accumulation input of agriculture into the economic development of the country and the mechanism of income allocation in a macro scale. A replica of these relations is the development of corresponding mechanisms of adaptation in the private-sector agriculture. In order for the qualitative change in the present reform to appear, it is indispensable to take into account the essence of the presented interdependencies. They will allow to determine and allocate relatively high costs of production and low productivity in agriculture. Moreover, they will make it possible to eliminate the promotion of the economic development of the country at the expense of preserving the disparity between the development of towns and villages. Regulations of the Act on Protection of Agricultural and Forest Land are treated as a limitation of the right of ownership of the real estate. Unlike civil law regulations, in this Act the legislator defines agricultural land as the subject of obligations specified in the Act, treating them in separation from the issue of ownership relationships. Unlike in civil law regulations, apart from the owner, a number of obligations associated with the protection of agricultural land is also imposed on other entities, which make economic use of the real estate property. According to the Act, the owner of real estate property has a number of obligations, such as prohibition to use land for non-agricultural purposes without having obtained a decision to designate the land for non-agricultural purposes and consent for exclusion of land from production. The owner also has other positive duties, such as the duty to prevent land degradation and devastation. These obligations, however, do not shape the subjective right of ownership, but are external to it, although they should be treated as a limitation to this right. ; Uregulowania ustawy o ochronie gruntów rolnych i leśnych są traktowane jako ograniczenia prawa własności nieruchomości. Odmiennie niż w regulacji cywilnoprawnej prawodawca przedmiotem obowiązków określonych w tej ustawie czyni grunty rolne, których ujęcie abstrahuje od problematyki stosunków własnościowych. W przeciwieństwie do przepisów prawa cywilnego, oprócz właściciela, szereg obowiązków związanych z ochroną gruntów rolnych został nałożony także na inne podmioty, które wykorzystują nieruchomości w sposób ekonomiczny. Właściciel nieruchomości ma zgodnie z regulacją ustawy szereg obowiązków, takich jak zakaz jej nierolniczego wykorzystania bez uprzedniego przeznaczenia terenu na cele nierolnicze oraz bez uzyskania zgody na wyłączenie gruntów z produkcji. Obciążają go również czynne obowiązki, m.in. obowiązek przeciwdziałania degradacji gruntów. Powinności te nie kształtują podmiotowego prawa własności, ale pozostają wobec niego zewnętrzne, jakkolwiek powinny być traktowane jako jego ograniczenia.

The paper consists of three parts. The first one describes the conditions in which foreign trade with UE countries is carried out. Those conditions are a result of dozens of years of Common Agricultural Policy followed by EEC countries whose objectives and system conditions for their realisation have been presented in the paper. The evolution of objectives and measures taken to achieve them have also been shown. The second part addresses the need to protect the food market in Poland, suggesting to make use of the UE's experience in that respect, including mainly the implementation of certain system conditions and necessary instruments required to provide protection of the market. The third part gives an account of what has happened so far in the area of the realisation of the Agreement about a Liaison between Poland and the European Union countries in the sector of food processing and agriculture. The 'agricultural' part of the Agreement has been presented and the possibilities of trading plus first attempts of its evaluation have also been presented. They do not look too good for Poland which seems to receive disadvantaged treatment in comparison with the countries associated in the EU. The ratification of GATT agreements relatively reduces those benefits, too. Sustainable development requires reconciling the requirements of agricultural land protection with increased investment needs in industry and housing, but also with respect for environmental protection requirements. These objectives should also be pursued in relation to agricultural land within the administrative boundaries of cities. However, with regard to agricultural land in cities, there is a clear conflict between the needs of investors and the resulting pressure to invest and the protection of agricultural land. The analysis of such determined research topic required a territorial approach to the protection of agricultural land, which is reflected in spatial planning. The purpose of this study is to analyze the Polish legislation from the point of view of the admissibility of change to agricultural land use in urban areas. ; Zrównoważony rozwój wymaga pogodzenia wymogów ochrony gruntu rolnego ze zwiększonymi potrzebami inwestycyjnymi w przemyśle i budownictwie mieszkaniowym, a także z poszanowaniem wymogów ochrony środowiska. Cele te powinny być realizowane również w odniesieniu do gruntów rolnych położonych w granicach administracyjnych miast. W odniesieniu do gruntów rolnych w miastach dochodzi jednak do jaskrawego konfliktu pomiędzy potrzebami inwestorów i wynikającą z tego presją na realizację inwestycji oraz ochroną gruntów rolnych. Analiza tak zakreślonego tematu badawczego wymagała podejścia terytorialnego do ochrony użytkowej gruntów rolnych, co znajduje swój wyraz w planowaniu przestrzennym. Celem niniejszego opracowania jest analiza polskiego ustawodawstwa pod kątem dopuszczalności zmiany przeznaczenia gruntów rolnych na obszarach miast.

The Common Agricultural Policy of the European Union plays a particular role in the process of European integration and the implementation of numerous community goals that go beyond the traditional functions of agriculture, associated with the production of food, and concern the multifunctional development of rural territories. The CAP played the main role in enlarging the EU, by incorporating the twelve new states from Central and Eastern Europe by means of ensuring their smooth integration into the common market and facilitating the accelerated adaptation, modernization and restructurization of the agricultural and food sectors, as well as the non-agricultural fields of the socio-economic and cultural activation of rural populations. The EU's agricultural and rural policy continues to undergo evolutionary transformation, and its shape in the new 2014–202 financial perspective is of vital and justified interest for Poland. The article aims to examine the role of non-farm actors and environmental interest groups in the Common Agricultural Policy (CAP) of the European Union (EU). It uses policy networks as an analytical tool to understand the structure, dynamics and outcomes of the EU's agricultural decision-making processes. Both locations of actors in the CAP policy structures and interaction modes between actors are examined. Also, the role of networks in shaping the CAP's reform decisions is assessed. The article shows that non-farm actors, and specifically environmentalists, researchers and other agents interested in major CAP reforms, have limited influence on final policy outcomes. At the same time though it has been found that non-farm actors play an increasingly important role in framing the CAP policy debate. They form active and vocal issue networks that impinge upon initial stages of the agenda setting phase in the policy cycle process. Also, the EU institutions become more and more dependent on non-farm actors' expertise when it comes to policy evaluation. Although the pro-reform approach of these actors is clearly noticeable, it is still too small to bring more than incremental changes within the policy
