Anti-sanction federalism

In recent years, the process of giving the heads of the constituent entities of the Russian Federation additional powers to overcome the consequences of emergency situations (such as the pandemic of the new coronavirus infection COVID‑19 or the introduction of illegal ("sanctions") restrictive economic measures against the Russian Federation) has been actively developing. This allotment, in particular, was carried out by Presidential Ukases No. 239 of April 2, 2020 and No. 121 of March 16, 2022. The author believes that the trend indicated by them is a new one in the development of Russian federalism. At the same time, it should be noted that the measures taken in 2022 to ensure socio-economic stability were not limited to expanding the rights of the heads of the subjects of the Russian Federation, but also provided for a number of other measures that change the design of the system of relations between the federal center and the subjects of the Russian Federation. The article analyzes the content of the above-mentioned measures and activities from the perspective of the theory of state functions, they are regarded as manifestations of the dynamics of the federal function of the state.
Anti-competitive Agreements in Russian Courts

This article presents the analysis of implementation and interpretation of antitrust legislation in Russian courts, in the field of anti-competitive agreements cases. This article proceeds from the previous research which provided the analysis of the court decision database of litigations with the Russian competition authority (the FAS) initiated in 2008-2010. In this research (which covers court cases of 2011-2015) we provide the database of 646 court decisions and examine the tendencies of applying antitrust prohibitions and legislation in courts. We show how the database structure varies from the point of view of main markets and types of agreements, taking into account the standards of proof. The analysis reveals that the Rule of reason (ROR) approach was not actually applied in courts, despite legislative possibilities. Type 1 errors risks tends to decrease, especially in public procurement cases, cases of banks and insurance companies cooperation. Requirements in the field of market analysis in decisionmaking are also increasing.

The article based on an integrated approach to developed within the European Union mechanisms of preventing crimes, which affect the financial interests of the EU. In terms of specific examples the legal basis of anti-corruption interaction, especially the structural building of the basic institutions of the European Union, are analyzed. The article discusses the information potential to facilitate the implementation of effective cooperation among the competent authorities in the sphere of combating corruption, fraud, money laundering and other economic crimes. ; В статье с учетом комплексного подхода рассматриваются механизмы противодействия преступлениям, затрагивающим финансовые интересы Европейского Союза. На конкретных примерах анализируются правовые основы борьбы с коррупцией, легализацией преступных доходов и другими связанными с ними экономическими преступлениями. Автор раскрывает особенности структурного построения основных институтов и органов Европейского Союза и созданный межгосударственный информационный потенциал, способствующие эффективному взаимодействию компетентных органов в сфере противодействия преступлениям, затрагивающим финансовые интересы данной международной организации.

Corruption risks as a category of anti-corruption policy

Одной из наиболее актуальных и социально значимых проблем на сегодняшний день остается борьба с коррупцией. Несомненно, что наиболее эффективной мерой борьбы с коррупционными правонарушениями является их профилактика, выявляющая и предупреждающая такие нарушения. При этом важно отметить, что в ходе проведения профилактических мероприятий необходимо учитывать какие обстоятельства способствуют возникновению и распространению коррупционных нарушений, какие области наиболее коррупциогенны, не иначе как подвержены коррупционным рискам. Антикоррупционная политика представляет собой не только механизм устранения причин коррупционных нарушений, но и их предупреждения. А поскольку наступлению и распространению коррупционных нарушений способствует коррупционный риск для формирования эффективной антикоррупционной политики необходимо своевременное выявление коррупционных рисков. В связи с чем в данной статье автор анализирует особенности теоретико-методологического и нормативного подхода к определению коррупционных рисков, а также рассматривает их место и роль в системе антикоррупционного законодательства.
Image of China as an anti-Muslim "Other" in the Indonesian media

The purpose of this study is to analyze, using Indonesian media contents, images of China as an Alien and as a country pursuing a policy that is interpreted in Indonesia as anti-Islamic. The novelty of the study lies in the analysis of modern nationalist political imagination in the discursive space formed by the Indonesian media. The author comes to the conclusion that in this imaginary space negative images of China are formed, which subsequently circulate in it and are purposefully promoted with the aim of constructing the image of China in Indonesia as a universal ideological and political Other. The article shows that 1) the Indonesian nationalist imagination, through the media, actively reproduces negative images of China as a subject of the policy of assimilation of Muslim minorities on the territory of the PRC, 2) in the discourses of Indonesian expert and analytical communities, narratives are promoted about the authoritarian nature of the political regime of the PRC and its policies aimed at politicizing Islam and its subsequent integration into the functioning mechanism of this regime. Such a policy is interpreted in Indonesia as ideologically limiting the activities of Chinese Muslims and putting them under the control of communist ideology, which gives grounds to characterize the PRC as a political and ideological Other. Narratives that highlight the unresolved problems between the China state and Islamic communities play an important role in promoting the image of the PRC as an undemocratic and authoritarian state. The results of the study suggest that the evolution of anti-Chinese narratives and the further promotion in the Indonesian political imagination of the image of China as a universal Other and a state politically and ideologically alien to Islam will strengthen the legitimation of anti-Chinese phobias and stereotypes traditional for Indonesian society at both the political and religious levels.

MEMORY OF ANTI-FASCISM. THE ITALIAN CASE. PIERO GOBETTI'S BOOKS AND EDITIONS
The report analyzes the importance of the memory of anti-fascism, in a country like Italy where fascism originated. The concept of long Resistance is examined, focusing on the early twenties of the twentieth century, when Mussolini rose to power, considering in particular the notable figure of Piero Gobetti and his activities as a publisher. In the short space of three years, he published 114 volumes. Among the authors there were all the major figures of the anti-fascist culture of the time, from Einaudi to Salvemini, from Amendola to Salvatorelli, from Ruffini to Monti, from Sturzo to Nitti, literary critics such as Fubini and Sapegno, novelists, poets, including Eugenio Montale, future Nobel laureate. A Committee chaired by me took the initiative to republish the entire corpus of Gobettian books, to make available to the new generations the best democratic literature of the time, as a contribution - in an era of right-wing populism and crisis of democracy in various parts of the world - to the struggle against fascism which is always taking on new forms, against the "eternal fascism" Umberto Eco spoke about. Eighty volumes have been released so far (October 2020) which - hopefully - will help to preserve the memory and to maintain an intergenerational message, foreseeing a future without oblivion. ; The report analyzes the importance of the memory of anti-fascism, in a country like Italy where fascism originated. The Jewish Correspondent of the Newspaper "Bezbozhnik" as an Anti-Religious Activist

The article makes an attempt to compare handwritten texts of local correspondence received by the newspaper "Bezbozhnik" in the 1920s–1930s, and citizens' letters published in the newspaper. I consider «a letter to the editorial office of the newspaper "Bezbozhnik'» as the situation of social interaction "here and now" and discuss the roles of the participants, editors and correspondents, in this situation. As a research method, I use the language analysis of texts, its form and content. I review two cases: the implicit editors' struggle against anti-Semitism in the newspaper and five unpublished letters from Odessa demanding the closure of synagogues. The chosen approach allows me to make some observations about the social and cultural attitudes of Jews in the USSR in the 1920s–1930s: their relation to a cultural and family memory, social responsibility, power and time. These attitudes, expressed in the letters language, I guess, had consequences in the further social and, in particular, anti-religious processes in the USSR.
