Resolving disputes of international character by both international commercial arbitration courts and national courts, based on international legal sources and their norms, is an important contribution to legal science. Arbitration practice should harmonize the existing differences between the rules of national legislation, giving a special significance to the interpretation of the sources of international trade law.

To highlight the most important aspects of arbitration law reform, and examines the effects they will have on the development of arbitration in RussiaMethodology. The author uses a formal-legal method.Results, scope of application. The author distinguishes the difference between constantly acting arbitration courts and arbitration courts ad hoc). The special status of a number of arbitration institutions (the ICAC and MAC at the Russian Chamber of Commerce and Industry), is contrary to the constitutional principle of equality under the law. A major achievement of the new legislation on arbitration courts is expanding the range arbitrarily disputes.Conclusions. The new legislation more clearly prescribed the interaction of arbitration and state courts, including requiring the latter to promote the arbitrators, acting under the regulations of the permanent arbitration institutions in obtaining evidence.In addition, the reform of the arbitration law have left aside the problem of improving the quality of judicial control over arbitration decisions.The arbitration law will still be able to improve the arbitration, to enhance its credibility and attractiveness for the participants of civil turnover. ; УДК 347.73:341.63В статье информационного характера освещаются недавние изменения, внесенные в законодательство Российской Федерации о третейском разбирательстве. The subject. This informational article is devoted to the peculiarities of recognition and enforcement of international commercial arbitration awards according to different countries' legislation and international legal regulation.The purpose of the article is to identify legal patterns of recognition and enforcement of international commercial arbitration awards in different countries.Methodology. The study is based on comparative law and formal law methods, analysis and synthesis.Results, scope of application. Enforcement of arbitral awards in foreign countries is ensured and guaranteed by multilateral conventions, bilateral treaties and national legislation. The New York Convention 1958 in a certain way limits the scope of legal protection of arbitral awards and leaves the procedure for recognition and enforcement of arbitral awards for consideration of the state court. The author analyses of differentiation of the recognition and enforcement regime of so-called "domestic" and "foreign" solutions of international commercial arbitration in terms of doctrinal approaches and practice of foreign countries. Special attention is given to the analysis of foreign arbitral awards of recognition and enforcement procedures is given to a denial of recognition and enforcement of foreign arbitral awards and their reasons. In spite of the explicit grounds for refusal of recognition and enforcement of foreign arbitral awards in New York Convention 1958, some countries try to establish certain exceptions to the rule in the national legislation. Results may be applicable in improvement of international legal regulation.Conclusions. The courts of the countries – participants of the New York Convention 1958 cannot cancel the foreign arbitral award or revise it substantially. The refutation of this award is possible only in the court of the state in whose territory the relevant arbitral award was made, and such court is not formally bound by the rules of the New York Convention 1958, when deciding whether to cancel or modify the award. ; УДК 347.73:341.63Статья посвящена характеристике порядка признания и исполнения решений международного коммерческого арбитража через призму международно-правового регулирования. This article deals with the issues of regulation of property relations of spouses in private international law. The article deals with the conflict issues of marriage, as well as the contractual regime of a property of spouses. The article reveals the content of the Minsk and Chisinau conventions on property relations between spouses. In particular, the conventions say that the property relations between spouses are determined by the legislation of the Contracting Party in whose territory they live together. If the husband lives in one Contracting State and the wife in the other and both have the same nationality, the law of the country of which they are nationals governs their property relations. Attention is paid to bilateral agreements on legal assistance to States in the field of property relations between spouses. For example, such an agreement exists between Russia and Estonia, and it helps to resolve various property issues between spouses. The domestic legislation of different States regulates the issue of determining the regime of matrimonial property in different ways. For example, in the States of the Anglo-Saxon legal system and in most Muslim countries there is only a regime of separate property. On the contrary, in the States of the Romano-German legal system, preference is given to the regime of the common property of spouses, and it is possible to establish a different regime of property relations by agreement of the spouses. The relevance of the topic of a scientific article is related to the frequent cases in practice when there is a dispute over the application of the law of a particular state. With the help of the analysis of family law and private international law, a circle of subjects of legal relations is established that is connected with maintenance obligations complicated by a foreign element. In modern times there are many problems, in particular, the consequences of the dissolution of a marriage between spouses (one of whom is a foreign citizen) in the presence of minor children are poorly regulated internationally. The main problem in resolving issues related to alimony relations is the definition of applicable law. That is the law of which country (the right of citizenship of the husband's state or the right of citizenship of the wife's state) will be applied to resolve the dispute. In this paper, we will consider existing problems and offer our own vision of ways to solve such problems.

Russian scientists attach great importance to one of the fundamental principles of private international law – the principle of the closest connection. The concept of the closest connection was developed in England on the basis of case law, the rules of which were created by judges in court decisions on specific cases. The legislator has included the principle of closest connection to the civil code, however, in light of the changes it made in the reforms of 2013, the closest connection principle was assigned a secondary role in relation to the principle of characteristic performance. The main purpose of the principle of the closest connection is to find the law and order that can most effectively regulate cross-border relations. The court will have to determine the will of the parties to the contractual relationship, aimed at choosing the right. Therefore, a close relationship is established based on the court's assumption of what right the parties would have chosen if they had considered this issue. The principle of the closest connection, in connection with this approach, often loses its independent significance. Article 1187 of the civil code of the Russian Federation does not specify the conditions of its application, as well as the scope of its action. For this reason, the category of the closest relationship is universal and applies regardless of the nature of the cross-border civil relationship. Russian legislation does not have clear criteria for determining the closest relationship, which may lead to a subjective decision by the court. In this regard, the study of problems related to the application of the principle of the closest connection in judicial practice is undoubtedly relevant.

Purpose: the article examines the main problems associated with the extension of arbitration of domestic and international financial disputes in Singapore. The characteristics of the development of international commercial arbitration in Singapore, including the role of the Singapore International Arbitration Center SIAC, examined the new SIAC Arbitration Rules - the Arbitration Rules of 2016 and the Investment Arbitration Rules of 2017, as well as the Arbitration Regulations of the Singapore Exchange 2006 and the Arbitration Rules Singapore Exchange on the Derivatives Trade 2005. In order to achieve this goal, the article must solve the following tasks: to determine whether there are institutions providing services in Singapore and on the arbitration of financial disputes; to study the main problems of transferring a cross-border financial dispute to international arbitration; to study the practice of international arbitration on this issue.Methods: this article is based on an interdisciplinary concept of research, which allowed to distinguish the distinctive features of the legal regulation of the settlement of financial disputes in Singapore.Results: the provisions of the Arbitration Rules of 2016 and the Investment Arbitration Rules of 2017 are innovative not only for the SIAC Center, but for all international commercial arbitration as a whole. The new regulations of the SIAC Center enshrined provisions for the consolidation of arbitral proceedings in disputes from two or more treaties; on attracting additional parties; the refusal of claims or objections at an early stage if the claim or objection is manifestly unfounded from a legal point of view or the claim / objection is obviously beyond the jurisdiction of the Arbitration Tribunal; on delocalization of the place of arbitration; additions to the provisions on extraordinary arbitration and the procedure for accelerated production. The new Arbitration Rules came into force on January 1, 2016 and proved itself from the very best side. The statistics of the SIAC Center for 2016 were unprecedented.Conclusions and Relevance: the materials presented in the article show the special role of arbitration in resolving domestic and international financial disputes. The practical application of its results will improve the Russian legislation in the field of resolving financial disputes. ; Цель: В статье рассматриваются основные проблемы, связанные с распространением арбитража внутренних и международных финансовых споров в Сингапуре. Дана характеристика развития международного коммерческого арбитража в Сингапуре, в том числе роли Сингапурского международного арбитражного центра SIAC, изучены новые Арбитражные Регламенты SIAC – Арбитражный Регламент 2016 г. и Регламент инвестиционного арбитража 2017 г., а также Арбитражный Регламент Сингапурской биржи 2006 г. и Арбитражный Регламент Сингапурской биржи по торговле деривативами 2005 г. Для достижения поставленной цели в статье необходимо решить следующие задачи: выявить, имеются ли в Сингапуре учреждения, предоставляющие услуги по арбитражному разрешению финансовых споров; исследовать основные проблемы передачи трансграничного финансового спора в международный арбитраж; исследовать практику международных арбитражей по данному вопросу.Методология проведения работы: Данная статья основана на сравнительно-правовом методе исследования, который позволил выделить отличительные особенности правового регулирования разрешения финансовых споров в Сингапуре.Результаты работы: Положения Арбитражного Регламента 2016 г. и Регламента инвестиционного арбитража 2017 г. являются новаторскими не только для Центра SIAC, но и для всего международного коммерческого арбитража в целом. В новых регламентах Центра SIAC были закреплены положения о консолидации арбитражных разбирательств по спорам из двух и более договоров; о привлечении дополнительных сторон; об отказе в требованиях или возражениях на ранней стадии, если требование или возражение является очевидно необоснованным с правовой точки зрения, или требование/ возражение очевидно выходит за пределы юрисдикции Состава арбитража; о делокализации места арбитража; дополнения в положения о чрезвычайном арбитраже и процедуре ускоренного производства. Новый Арбитражный Регламент вступил в силу с 1 января 2016 г. и зарекомендовал себя с самой лучшей стороны. In the article there is given a general overview of the sources of the international sport law, which is a new dynamically developing branch of law. The author underlines that international sport law unites norms of international law and national legislation regulating sport relations of international nature.

The subject. The article discusses the international legal positions of Russia and Japan that prevent the conclusion of a peace treaty between them and impede a radical improvement in relations, which is perceived as an urgent need for both sides.The purpose of the article is to show the fundamental differences in the official positions of the governments of Russia and Japan and suggest a fundamentally new diplomatic and legal solution to the long-standing territorial dispute among the states, which will result in finally breaking the deadlock.Methodology. The research is based on the methods such as historical research, formal logic, including analysis, synthesis, and modeling, as well as systematic, comparative and interpretation. Materials include national and international laws and scholarly articles, books relating to Russian-Japanese relations, as well as its international legal aspects.The main results, scope of application. The authors note that the end of the Cold War transformed Europe. Since that time there have been a reformatting of military alliances, the unification of Germany, reconciliation of the nations warring since ancient times. All these are based on the recognition of the inviolability of the outcome of the Second World War and established territorial structure. In comparison with Europe, it had smaller consequences in Asia. All previous dividing lines and lines of conflicts are preserved. Nothing was done to reunite the divided nations. Reconciliation by and large also did not happen. One of the burning problems has remained the territorial claims of Japan to Russia on the four islands of the Southern Kuril and the unresolved long-standing dispute over affiliation of the islands. Given the historical facts of occurrence of arbitration and public courts. Justified by reasons of arbitration courts in Ukraine. We analyze the performance of arbitration decisions, participate in the process of public authorities. Attention is drawn to the fact that the enforcement of arbitral awards is outside the arbitration dispute resolution and is a task of the competent courts and the state executive service. Relevance of the study due to the fact that since the adoption in 2004 Law of Ukraine "On arbitration courts" was not long, however, as the longawaited legalization in Ukraine arbitration already capable of destroying the institution itself. This trend has become critical and demands immediate attention, because of the advantages and democratic method of resolving disputes justly earned widespread in many jurisdictions economically developed and developing countries alone. Today, following the practice of arbitration in Ukraine, many articles of the Law require changes. Arbitration should not be a tool in the hands of a legally illiterate, unscrupulous people who see in it only a way to improve personal well-being. In the process of getting rid of this kind of arbitration "judges" of the great role of the Ministry of Justice and Arbitration Chamber of Ukraine.

The article substantiates the necessity of a system analysis of the processes of applicationof the norms of international treaties by commercial courts of the Russian Federation. Thisneed is justified, at least, by the following: an insignificant amount of special research inthis field in comparison with a similar subject within the courts of general jurisdiction, thecreation of a relatively new body of supranational control over compliance with the normsof international treaties in the field of commercial courts' practice.The purpose of the study is to identify problems of application of international treaties ofthe Russian Federation arbitration courts of Russia.The author uses methodology of formal legal analysis of Russian legislation and courts' decisions.The results and scope of it's application. The author, taking into account the specifics ofcommercial proceedings and the nature of disputes heard in commercial courts, proposedlegal grounds in a concentrated form which allow to state the existence of the obligation toapply the norms of international treaties by Russian commercial courts. Two levels of suchgrounds can be stated – international and domestic.Publication of the texts of international treaties as a problematic segment of their applicability.The article highlights one of the problematic segments of the application process ofthe norms of international treaties for the purpose of more detailed reflection. The practiceof commercial courts demonstrates that in both legislative acts and acts of applying law,the concepts of "official publication" and "bringing to the public" are alternated with eachother. Despite the reform, the procedure of official publication has not acquired the characterof a systemic institution of Russian law. This significantly complicates the activity ofadministering justice with respect to the legislative acts of international law.Conclusions. From the point of view of international law, the state, independently determiningthe procedure and methods of implementing international treaties within its legalsystem, is not limited in its ability to burden itself with the need to abide by additional proceduresnot provided by the international legal system of procedures. Official publication,as a necessary procedure for the entry of a legislative act into the force, represents such anadditional procedure designed to protect more effectively human rights and freedoms andto streamline law enforcement practice. УДК 342.951+347.999This informational introductory article is devoted to the peculiarities of the procedure of creation of the arbitration institution according to the new 2015 Federal Law "On arbitration (arbitration proceedings)". The aim of the article is the identification of the new law preconditions to the emergence of administrative barriers in the establishment of arbitral institutions. The study is based on methods of formal law, analysis and synthesis, the sociological method of survey is also used. The results and scope of the results. The article notes the objective difficulties in the establishment of arbitration institutions as well as provides a critical analysis of the innovations in 2015 Federal Law "On arbitration (arbitration proceedings) in the Russian Federation". The procedure for creating the arbitration courts became more bureaucratic and it is focused on filtering such institutions by tightening the requirements. The procedure for creating the arbitration courts can be described as permissive and multi-stage. The second noticeable trend in the 2015 Federal Law is broad sphere of control over arbitration courts and substitution of their competence by a competent court. According to the results of a survey of representatives of the business community authors identify the legislative background of administrative barriers on a way of establishment of arbitration courts. The results of the study can be used in the improvement of legislative procedures for the estab-lishment of arbitration courts. Conclusions. New Law actually creates a "quasi-judicial" bodies, that have highest level of bureaucratization, so arbitration courts lose their main characteristics: contractual and dispositive principles. Novels of Law, aimed at stricter administration and control, are obvious, however, a new quality for arbitration as the most popular form of alternative dispute resolution is still not created. ; УДК 342.951+347.999Вступительная статья информационного характера посвящена особенностям процедуры создания арбитражного учреждения согласно новому Федеральному закону от 29 декабря 2015 г. № 382-ФЗ «Об арбитраже (третейском разбирательстве) в Российской Федерации». Civil law States that the legal capacity of individuals is defined as the ability of the individual to have rights and obligations. This legal category arises from birth and ceases with death, it characterizes a person as a living being and does not depend on age and health. However, it is necessary to pay attention to the fact that it can be limited by a court decision, in particular in criminal proceedings it can be expressed in deprivation of the right to engage in certain activities, to occupy certain positions. The article reveals the content of legal capacity in private international law, the basic powers included in the legal capacity, in particular, the right to a name, its use and protection, analyzes the foreign legislation concerning the procedure of recognition as missing and the Declaration of a person as dead. The article deals with the conflict issues arising in the foreign and Russian legislation in the regulation of relations included in the content of legal capacity, the study of international legislation characterizing the legal status of the person.

Под таможенным правом понимают институт административного права, подотрасль административного права, самостоятельную комплексную отрасль административного права либо комплексную отрасль законодательства. Исследование правовой природы показывает, что в современном таможенном праве можно выделить наднациональную (международную) и национальную части. Наднациональная часть включает нормы Таможенного кодекса таможенного союза и иных нормативных актов, которые принимаются международными договорами. Нормы национальной части принимаются законодательными актами страны. Таким образом, таможенное право — комплексная отрасль права, регулирующая общественные отношения в сфере перемещения товаров через таможенную границу Таможенного союза. = Scientists differ in their opinions regarding the place of customs law in the legal system. Customs law is understood as the institute of administrative law, a sub-branch of administrative law, a separate complex branch of administrative law or a complex branch of legislation. The research of its legal nature shows that it is possible to distinguish supranational (international) and national parts within the contemporary customs law. The supranational part includes the Customs Code norms of the Customs Union and other legal acts which are adopted by international treaties. The norms included into the national part are adopted by legislative acts of the country. Thereby, customs law is a complex branch of law regulating public relations in the sphere of movement of goods across the customs border of the Customs Union.
