La opinión pública no es una categoría transhistórica, sino que se trata de una configuración sociopolítica que emerge en el siglo XVIII. Fue entonces cuando se multiplicaron de manera exponencial las publicaciones periódicas, cuando proliferaron escenarios tales como los salones, las academias y las casas de café, en el interior de los cuales los individuos pudieron discutir acerca de numerosas cuestiones de la vida pública. Fue entonces, ante todo a partir de 1750, cuando la apelación a la opinión pública comenzó a ser una constante del discurso, cuando esta nueva entidad empezó a ser concebida como la autoridad última que dotaba de legitimidad a las diferentes posiciones adoptadas por los contemporáneos. Nuestra investigación se asienta, ante todo, sobre una apuesta fundamental, que es la distinción entre opinión pública y opinión popular. Enfatizar esta controversia permite, a nuestro juicio, corregir las carencias más importantes del clásico trabajo de Jürgen Habermas, la Historia y crítica de la opinión pública (1962), que centra su atención en la «publicidad burguesa» y desatiende por completo la «publicidad plebeya». Este silencio es el punto de partida de nuestro análisis. Como podemos comprobar a propósito del fallido atentado contra Luis XV perpetrado por Damiens en 1757, las autoridades policiales vigilan muy de cerca no sólo las publicaciones contestatarias que se distribuyen de forma clandestina, sino también las aglomeraciones multitudinarias, los murmullos de las plazas públicas, los carteles sediciosos. El caso Damiens supone además un espléndido laboratorio que condensa la efervescencia política de los últimos decenios del Antiguo Régimen, y permite tomarle el pulso a la creciente desacralización de la monarquía francesa. En segundo lugar, la «publicidad plebeya» no puede ser considerada sin más, como pretende Habermas, como «una variante de la publicidad burguesa». Los discursos de autolegitimación de los abanderados de la «publicidad hegemónica» y la exclusión de las capas bajas de los nuevos escenarios críticos nos enfrentan a una realidad mucho más compleja. Las duras palabras de Voltaire, d'Alembert, Condorcet y tantos otros respecto a la sinrazón de la multitud iletrada no reproducen ingenuamente los prejuicios arraigados en la sociedad de la época, sino que ante todo forman parte de la estrategia urdida por los philosophes, cuyo objetivo último tenía que ver con la instauración de una nueva elite intelectual que supo beneficiarse del debilitamiento de las viejas estructuras que sostenían el edificio del Antiguo Régimen. El philosophe es la figura que posibilita además la compleja articulación de las dos perspectivas en las que, grosso modo, cabe encuadrar las diferentes aproximaciones a nuestro objeto de estudio: el philosophe es una nueva realidad sociocultural (como las abordadas desde el enfoque «referencialista», defendido entre otros por Darnton y Farge) y se destaca a la vez como una de las personalidades que más activamente participan en la invención discursiva de la opinión pública (la cual desde el enfoque «artificialista», desarrollado por Baker, Ozouf o Veysman, es ante todo una construcción ideológica, una entidad conceptual que aparece bajo la forma de un tribunal al que recurren los diferentes actores sociopolíticos). La creciente ascendencia social de la nueva elite de los intelectuales tuvo que ser defendida por éstos en la arena pública, donde no podían dejar de combatir las numerosas sátiras que denunciaban la altanería de los philosophes. Éstos no dejaron de luchar contra la baja literatura -aquellos emborronadores de papel tan detestados por Voltaire-, al igual que no escatimaron esfuerzos con el fin de desvincularse de la multitud, de aquella opinión popular contra la que se recortaba la emergente opinión pública que los ministros de la iglesia invisible de Diderot pretendían colocar bajo su tutela. The philosophe or the birth of the intellectual Víctor Cases Martínez Abstract: Public opinion is not a trans-historical category but a socio-political configuration, which emerged during the 18th century. It was then that periodical publications increased exponentially, scenarios such as salons, academies and coffee houses proliferated becoming spaces where multiple issues of public life could be discussed. It was then, mostly since 1750, that the appeal to public opinion started to become a constant element within discourse; it was then that this new entity started to be conceived as the ultimate authority that conferred legitimacy to the positions taken by contemporary individuals. Our research relies on a fundamental issue, namely the distinction between public opinion and popular opinion. In our view, putting emphasis on this controversy enables us to correct the most important omissions in Jürgen Habermas' classical work The Structural transformation of Public Sphere (1962), which focuses on "bourgeois public sphere" and completely neglects "plebeian public sphere". This absence is the starting point for our analysis. As we can see from the example of Damiens' failed attempt on the life of King Louis XV in 1757, political authorities kept a close watch not only on rebellious publications, which were disseminated clandestinely, but also on multitudinous gatherings, murmurs of disagreement on public squares, seditious posters, etc. Furthermore, the case of Damiens constitutes a magnificent laboratory condensing the political unrest of the last decades of the Old Regime, allowing to take the pulse of the increasing desacralization of the French monarchy. Secondly and unlike what Habermas stipulates, the "plebeian public sphere" cannot simply be considered as a "variation of the bourgeois public sphere". Self-legitimising discourses from the flag-bearers of "hegemonic public sphere", as well as the exclusion of the lower classes from the new criticism scenarios depict a much more complex reality. Voltaire's, d'Alembert's, Condorcet's and many others' harsh words regarding the unreason of illiterate multitudes do not just naïvely aim to reproduce the deep-rooted prejudices of society at that time. But rather belong to a strategy worked out by the philosophes which ultimately aims at the establishment of a new intellectual elite which knew how to benefit from the weakening of the old structures sustaining the Old Regime. Furthermore, the philosophe is the figure that enables the complex articulation of both perspectives which broadly frame the different approaches to our subject of study: the philosophe is a new socio-cultural reality (such as those tackled by the "referentialist" approach and supported among others by Darnton and Farge) and it stands out for being one of the actors which participates more actively in the creation of the discourse of public opinion (which, from the "artificialist" perspective put forward by Baker, Ozouf or Veysman, is above all an ideological construct, a conceptual entity which appears in the form of a court to which the different socio-political actors can resort to). The new intellectual elite had to defend their increasing social advancement on the public arena, where they were confronted with numerous satires denouncing the haughtiness of philosophes. They kept fighting against low-level literature -those people staining sheets of paper which Voltaire loathed-, they spared no effort in order to drop out of the multitude, to drop out of that popular opinion contrasting with another emerging popular opinion which the ministers of Diderot's invisible church tried to place under their tutelage.

This article presents a comprehensive analysis of the role that interpreters and translators of the Federal Office for Migration and Refugees (Bundesamt für Migration und Flüchtlinge [Bamf]) played during the 2015–2016 migration crisis in Germany along with the improvements made by the German Ministry of the Interior. To this end, we first investigated all the occasions when a refugee needs interpreting and translation services. We then present the requirements to be a Bamf interpreter/translator as well as their working conditions. In addition, we offer research into all the working tools that the German Government has made available to these interpreters/translators, so they can get a comprehensive training in the profession of community interpreter, one of the most demanding branches of interpreting and translation services. After 35 years of authorised gaming in Spain, May 2011 saw the enactment of Spain's Gambling Regulation Act. In an explanatory study of the transformations focusing on the emergence of this new legislative framework, after examining the historical background of the regulation of gambling and analysing the complexity of the current scenario, the author takes the view that public policy on gambling over the years has been fearful and inadequate because while pretending to defend moral values, in reality these policies aspired to preserve the interests of revenue collection. In addition, governments have failed to foresee the impact of the Internet. The articles examines the consequences of this failure: the entry into Spain of unregulated operators, the emergence of new and strong collateral interests and unfair competition with licensed operating companies of physical gaming establishments. This has ultimately prevented the Treasury from collecting the taxes and charges that this new activity should have accrued. ; Tras 35 años de juego autorizado en España, en mayo de 2011 ha entrado en vigor la Ley de Regulación de Juego. En un estudio explicativo de las transformaciones que han abocado a la aparición de este nuevo marco legislativo, el autor, tras examinar la trayectoria histórica de la regulación del juego de azar y analizar la complejidad del escenario actual, sostiene la tesis de que las políticas públicas en la materia han sido temerosas e insuficientes porque, pretendiendo defender valores morales, en realidad aspiraban a preservar los intereses recaudatorios. Además, las administraciones públicas no han sabido prever el impacto de internet. Se analizan en este texto las consecuencias de ello: la entrada en España de operadores no controlados, la aparición de nuevos y fortísimos intereses colaterales y la competencia desleal con las empresas operadoras autorizadas para el juego presencial. Esto ha llevado, en definitiva, a que la Hacienda Pública dejara de recaudar los impuestos y tasas que esta nueva actividad debería haber devengado.

In this paper we talk about the honorific pedestals of the Provincial Priesthood from Segobriga. This is the second city of Hispania citerior with more testimonies, since only Tarraco has a greater number. We consider economic, social, political and cultural conditions of Segobriga, as well as his close relationship with Imperial power and his juridical promotion connected with emperor Augustus. Moreover, the analysis of the geographical and social origin of the set of flamines allow us to think of this priesthood as a way of social promotion and visibility in the province. ; En este artículo estudiamos los pedestales honoríficos de los flamines provinciales con origen en Segobriga, puesto que se trata de la segunda ciudad con un mayor número de personajes que alcanzaron este sacerdocio, solo por detrás de la propia capital provincial, Tarraco. La consideración de las condiciones económicas, sociales, políticas y culturales de la ciudad, así como su estrecha relación con el poder imperial y su promoción jurídica, ligada de forma directa al emperador Augusto, junto con el análisis de la tendencia en la procedencia geográfica y social del resto de flamines provinciales, nos permiten acercarnos a su consideración como una herramienta de promoción social y visibilidad en el marco provincial.
