Whether considered as a status, a set of activities or from a political philosophy point of view, citizenship has been largely explored by political science and legal studies. Such research are meanwhile mainly normative or theoretical and empirical approaches are much more rare, especially in the French context. This HDR explores and discuss an original anthropological approach in the field of citizenship studies; an approach characterised by a will to analyse the social and political "manufacture" of citizenship and to "destabilise" its theories by a critical analysis. ; La citoyenneté, qu'elle soit abordée comme statut, ensemble d'activités ou en philosophie politique, a déjà fait l'objet de nombreux travaux, notamment en science politique ou en droit. Ces approches laissent cependant la part belle aux approches théoriques et normatives, les travaux empiriques restant beaucoup plus rares, notamment en France. Il s'agit ici est de proposer une approche anthropologique originale dans le champ des études de la citoyenneté. Ce qui la caractérise sans doute le mieux est la volonté de s'intéresser à la " fabrique " sociale et politique de la citoyenneté, et d'en " déstabiliser " les théories par un regard critique.

The Terrorism Risk Insurance Act of 2002 (TRIA) established a public-private program to cover commercial enterprises against foreign terrorism on US soil. It was a temporary measure to increase the availability of risk coverage for terrorist acts by requiring insurers to provide coverage. Initially established to sunset on December 31, 2005, a two-year extension has been voted by Congress and signed by the President in December. This paper provides an extensive series of empirical analyses of loss sharing under this program in 2005, and a prospective analysis for 2006. Using data collected on the top 451 insurers operating in the United States, we examine the impact of TRIA on loss sharing between the key stakeholders: victims, insurers and their policyholders, and the taxpayers. By simulating the explosion of a 5-ton truck bomb in major cities in the United States, we conclude that taxpayers are likely not to pay anything for losses below $15 billion. For a $25 billion loss, insurers and policyholders would handle between 80 and 100 percent of the loss depending on the property take up rate. Only for terrorist attacks where insured losses were $100 billion would taxpayers have to pay 50 percent of the claims. Recent modifications of TRIA will transfer an even larger part of the risk to the private sector. We also show that if TRIA were made permanent in its current form some very large insurers could strategize by collecting large amount of premiums for terrorism insurance but only would be financially responsible for a small portion of the claims. Commercial policyholders from all insurers (whether or not covered against terrorism) and the federal government would absorb the residual insured losses, raising equity issues. The paper also reviews a set of possible long-term alternatives or complementary options to the current design of TRIA that could be important features of a more permanent program. Damage of distress is not enshrined in the Dintilhac nomenclature. It is now only recognised by case law. However, its reparation remains difficult for several reasons. If the case law agrees to compensate for anxiety as such, in principle mere concerns cannot suffice to justify an action for damages. Suicides at workplaces, received as the peak of a suffering-at-work phenomenon, confirm the unease in the culture as well as it sends back its mystery to the social sphere. These suicides ask insistent questions to the working society and peculiar ones about the acting out. First this thesis endeavours to establish the epistemological basis, that is to say the sociologicals and psychoanalyticals ones, that enable to explain both the question and the effects suicides establish. Then, thanks to a clinical case, we will suggest a particular distinction between the unconscious causality of the acting out on the one hand, and the consistency of the phenomenon's serial organization on the other hand. Our thesis concerns the acquisition and the loss of the French nationality between 1804 and 1927.During this period, as well the acquisition as the loss of the French nationality were subjet to the the influence of the political, economic and sociological imperatives of time.On the one hand, as regards the acquisition of the French nationality two criteria were retained by the various authors to grant the quality of French. According to them, only the jus sanguinis or the jus soli allowed to acquire the French nationality. However, we have to admit that it is nothing. Indeed, we were able to establish through the preparatory work study of the Civil code that a third criterion taking into account the essential qualities that is the assimilation of the customs, the manners, the habits and the French culture, was at the origin of a large number of acquisition of the French nationality.On the other hand, these same imperatives determined with more or less of severity the conditions of loss of French nationality.Consequently, it is difficult to determine with precision what is a French. ; Notre thèse porte sur l'acquisition et la perte de la nationalité française entre 1804 et 1927.Pendant cette période, aussi bien l'acquisition que la perte de la nationalité française ont subi l'influence des impératifs politiques, économiques et sociologiques de l'époque.D'une part, s'agissant de l'acquisition de la nationalité française deux critères ont été retenus par les différents auteurs pour octroyer la qualité de Français. Selon eux, seuls le jus sanguinis ou le jus soli permettait d'acquérir la nationalité française. Or, force est de constater qu'il n'en est rien. En effet, nous avons pu établir à travers l'étude des travaux préparatoires du Code civil qu'un troisième critère prenant en compte les qualités essentielles c'est-à-dire l'assimilation des moeurs, des usages, des habitudes et de la culture française, était à l'origine d'un grand nombre d'acquisition de la nationalité française.D'autre part, ces mêmes impératifs ont déterminé avec plus ou moins de sévérité les conditions de perte de la nationalité française.Dès lors, la définition de la nationalité est française est éphémère.Par conséquent, il est difficile de déterminer avec précision ce qu'est un Français.
Ce numéro présente les travaux conduits dans le cadre de l'analyse des Pertes agricoles et alimentaires dont une synthèse a été présentée lors du colloque du 28 novembre 2015 à Paris. ; National audience ; Food losses and wastes are a cutting edge question for national, European and international politics, as they represent a major lever for global food security. They represent around 30% of global production and consume useless resources with linked environmental and economic impacts. These losses are agriculture dependent in less developed countries and at the retail and consumption stage in developed countries. On global level they emit 3.3GT carbon equivalent greenhouse gases, use 250 km3 of water, first rank of every country's agriculture water consumption, and consume 28% of agricultural land surface. Economically, they represent 750 billion $ at agricultural level, and 2 to 3 times more at the consumer level. All these are rough estimates, as figures differ depending on references, countries and typology of products. ; La question des pertes alimentaires est présente dans les agendas politiques au niveau national, européen et international, car elle représente un levier majeur pour la sécurité alimentaire mondiale. Are specific rights edicted to protect the identities of various minorities justified by the respect owed to cultural difference, as Will Kymlicka argues ? The multicultural citizenship project, far from being a national curiosity, raises questions of fundamental interest to all democratic States - it enhances how inadequate the model of religious tolerance may prove when used to protect the right to cultural difference. Indeed, if beliefs belong to the private sphere, cultural identity is obviously a public matter, since no civic nation can be said to exist without some sort of ethnic identity as well. This work aims at shedding a new light on the problem worked out by the Canadian philosopher and the limits of the solution he offers, by using the theories of ethnic identities in modern societies – especially in France – as elaborated by social sciences. The works of Dominique Schnapper et Gérard Noiriel are thus used to understand the ethnic component of a national community, as, in a theoretical level, they promote an original way of achieving this aim – through Emile Durkheim's theory of solidarity. This work purports to show that this theory promotes an idea of national identity that remains open to cultural pluralism, and to study how it grounds the legitimacy of cultural recognition in the philosophical soil, not of political liberalism but of republicanism. The author proposes rethinking the debate on measuring the loss of functional independence, an issue too often addressed by its technical or administrative aspects, omitting its economic, ethical and political dimensions. He explained why, in his view, there was an urgent need to launch the debate on the reforms to finance the loss of independence to make a fundamental change in the rules on the distribution of funds. He called for the tools currently used and which did not meet the current challenges to be abandoned: funding by itinerary, which makes it possible to address the issue of the relevance of decisions both in the health and social fields. ; National audience L'auteur propose de repenser le débat autour de la mesure de la perte d'indépendance fonctionnelle, une question trop souvent abordée par ses aspects technique ou administratif en omettant ses dimensions économique, éthique et politique.
