Administrative liability, as a type of legal coercion, is important for maintaining law and order, protection of an individual, protection of human rights and freedoms, performance of tasks and functions of the state. The description of administrative liability, given in the article, is connected with its inherent features and peculiarities of an administrative offense (misdemeanour). The most significant attention is paid to the issue, connected with public danger of an illegal act, taking into account the conceptual changes in criminal legislation, and, thus, criminal liability and as a consequence of administrative liability. The concept of reforming the Criminal Legislation provides for the preparation in addition to the Criminal Code of Ukraine, the Code (Law) on Criminal Offenses (misdemeanours) and the Code of Ukraine on Administrative Offenses. Taking into account the emergence of the phenomenon of "criminal misdemeanours" in the legislation of Ukraine, for committing of which there is criminal liability before the court (the judge), the author raises the question of defining such criminal offense as a socially dangerous act, but of less public danger than a crime, and all other misdemeanours (administrative) should be considered harmful, but not socially dangerous. Cases of such misdemeanours should be considered during administrative proceedings, according to the (procedural) rules defined in the Code on Administrative Offenses. Using the experience of legal regulation of European countries, we thus implement our legislation to the European one, but taking into account our national traditions and maintaining the fundamental principles of criminal law and maintaining such principles regarding administrative liability. The author has analyzed the provisions of the draft Law of Ukraine "On Amendments to the Code of Ukraine on Administrative Offenses in relation to increasing liability for violation of legislation in the field of protecting natural ecosystems from fires" and a number of other bills. Their development and adoption is an important step towards bringing the current national legislation in line with European standards and norms, as well as further development of social and economic transformations in Ukraine in the environmental sphere. Also in this article the author indicates the feasibility of amending the Code of Administrative Offenses of Ukraine and other legislative acts in terms of strengthening administrative responsibility for violating fire safety rules, protecting the environment, preventing fires in natural ecosystems in the country. With regard to improving the efficiency of management of the sphere of protecting natural ecosystems from fires, the author points out the need to provide additional powers to the bodies of the State Emergency Service of Ukraine for the implementation of state control and supervision over the state of fire safety at forestry facilities. In this aspect, it is timely to develop and adopt a separate legislative act to secure the rights and obligations of the relevant officials to exercise such state control and determine the procedure for its organization. In addressing the issue of protecting natural ecosystems from fires, it is proposed to pay attention to the need to ensure strict adherence to the principle of inevitability of administrative responsibility for violation of legislation on environmental protection, eliminating the imbalance between the actual amount of damage caused to the environment and the amount of sanctions; an increase in the size of fines for setting fires in natural ecosystems, including for unauthorized burning of stubble on agricultural land (fields) by their owners. ; У статті представлено аналіз сучасного стану діючого адміністративного законодавства України, яким врегульовано відносини у сфері охорони навколишнього природного середовища та раціонального природокористування в державі. The article is devoted to the issue of police responses to animal cruelty cases that contain signs of an administrative offense: the experience of Ukraine. In the article the author developed a step-by-step response for police officers in case of offenses under Article 89 of the Code of Ukraine on Administrative Offenses. The powers of the National Police of Ukraine in this category of cases were also analyzed step by step. The administrative and jurisdictional powers of police officers during proceedings on the fact of animal cruelty are considered. The author details the application of measures to ensure the proceedings in these categories of cases. The article pays special attention to the fact that the police officer decides on the whereabouts of the animal at the time of the proceedings, for example, in the case of leaving the animal in a temporary home. The author also gives practical examples of the interaction between animal protection organizations and the police during the seizure of the animal before considering the case on its merits. The telephone number of the all-Ukrainian hotline for assistance to animals is given, namely 0-800-302-303. An analysis is given of the legal status of the animal in accordance with current Ukrainian legislation. The article separately analyzes the stages of proceedings on animal cruelty. The powers of the National Police and the court to consider this category of cases have been clarified, and their limitations have been clarified. Article 283 of UCAO determines the content of the resolution. The article is devoted to the issue of administrative liability for cruelty to animals: the experience of Ukraine. The article states that factors such as the emergence of humanistic principles of societal organization led to a rethinking the world's existence, animals and people in it. The result was the concept of protecting the natural rights of animals. Today, the issue of animal protection is given considerable attention at the international and national levels. The author examines international agreements in the field of animal welfare, which Ukraine has joined and ratified. The article considers the national legal regulation of prevention and counteraction to animal cruelty. The author analyses in detail the legal status of animals in accordance with current Ukrainian legislation. It is noted that animals in Ukraine are equated with a 'special status' thing, namely the property rights of animals' owners are limited by legislation on the protection of animals from cruel treatment. Administrative liability for cruelty to animals is considered separately. The author analysed in detail the composition of the offense, which is provided by Article 89 of the Code of Ukraine on Administrative Offenses. Special attention is paid to the peculiarities of bringing to administrative responsibility for ill-treatment of minors. The peculiarities of the administrative qualification of non-fulfilment by parents of parental responsibilities for the upbringing of a child who committed cruelty to animals aged 14 to 16 years are analysed.

The article is devoted to the analysis of the subjective side of the criminal offense under Art. 375 of the Criminal Code of Ukraine. The subjective side is a mandatory element of any criminal offense. The absence of this element means the absence of a criminal offense in general. The subjective side significantly influences the qualification of criminal offenses and thus allows to distinguish criminal acts from non-criminal ones, to differentiate related criminal offenses. It is generally accepted that the act provided for in Art. 375 of the Criminal Code of Ukraine, is committed only with intent. This statement is quite true, because the legislator directly at the disposal of Art. 375 of the Criminal Code of Ukraine uses the term "knowingly", which in itself clearly indicates that a criminal offense is committed with intent. The motive and purpose in the disposition of the researched article are not specified and do not influence the final qualification. At the same time, the qualifying feature of the composition of this criminal offense under Part 2 of Art. 375 of the Criminal Code of Ukraine, is to commit the same acts for selfish motives or other personal interests. A selfish motive is defined as a judge's desire to obtain illegal material gain (obtain property, property rights, get rid of personal property costs, etc.) by issuing a knowingly unjust act. The article deals with the most complex issues, arising in the course of qualification of an administrative misconduct provided for in Art. 172-5 of the Code of Ukraine on Administrative Offenses "Violation of legally established restrictions on receiving gifts". According to the results of the study, scientifically grounded proposals for the improvement of anti-corruption legislation, designed to increase the effectiveness of the relevant administrative law prohibition, have been formulated.In particular, it is suggested that the list of close persons (Article 1 of the Law of Ukraine "On the Prevention of Corruption") should be brought in line with the provisions of the civil and family law of Ukraine, by including uncle, aunt, nephew, niece, fiancé and bridegroom into it.It has been proved that for a clearer differentiation of the delicts, provided for in Art. 368 (Article 368-4) of the Criminal Code of Ukraine and Art. 172-5 of the Code of Ukraine on Administrative Offenses clause 1 of Part 1 of Art. 23 of the Law of Ukraine "On Prevention of Corruption", covering the "forbidden" gift, should be deleted at the legislative level.In addition, it is indicated that in Part 1 of the improved article 172-5 of the Code of Ukraine on Administrative Offenses should refer to the ban on the gift (from the subordinates). That is, improved art. 172-5 of the Code of Ukraine on Administrative Offenses should provide for liability not only for violations of the restrictions, imposed by law on gifts, but also for prohibited receiving of gifts from subordinates.The necessity of decriminalization of behavior, directed by universally accepted notions about gratitude and hospitality, has been outlined. The study highlights the dynamics of legislative changes and the current state of legal regulation of administrative and criminal liability for violations of quarantine rules. The shortcomings of the relevant legislative provisions were revealed, in particular, a conclusion was made about the violation of the principle of system-legal coherence of administrative and criminal legislation. Thus, there are issues about the delimitation of the provisions of the administrative provided in the Art. 44-3 of the Code of Ukraine on Administrative Offenses and criminal offenses provided in the Art. 325 of the Criminal Code (in terms of such consequences as the threat of harm, specified in the part 1 of the Article 325 of the Criminal Code of Ukraine). In addition, there is an excessive severity of sanctions in the Art. 44-3 of the Code of Ukraine on Administrative Offenses and their incompatibility with the sanctions of the Art. 325 of the Criminal Code of Ukraine. In the context of the settled case law of the European Court of Human Rights the fine under the part 1 of the Art. 443 of the Code of Administrative Offenses based on its size and subject to appointment may be recognized as corresponding to a criminal offense within the meaning of the Art. 7 of the Convention for the Protection of Human Rights and Fundamental Freedoms. Another drawback of the legislation is the lack of enshrining a criminal offense for violating quarantine regulations. On the basis of the conducted research it is offered to make changes to norms of the Art. 44-3 of the Code of Administrative Offenses and the Art. 325 of the Criminal Code of Ukraine in order to optimally regulate legal responsibility for violation of sanitary rules and regulations for the prevention of infectious diseases and mass poisoning (Article 325 of the Criminal Code), as well as quarantine rules (the Art. 44-3 of the Code of Ukraine on Administrative Offenses). The main task of such changes is to construct a consistent chain of normatively established offenses in the field of compliance with quarantine rules (administrative offense - criminal offense – non-grave offense – grave offense) with adequate and proportionate responsibility for their commission. ; В исследовании освещается динамика законодательных изменений и действующее состояние правового регулирования административной и уголовной ответственности за нарушение карантинных правил. Выявлены недостатки соответствующих законодательных положений, на основании анализа которых сформулированы предложения по совершенствованию норм административного и уголовного законодательства по указанным вопросам. ; Висвітлено динаміку законодавчих змін та чинний стан правового регулювання адміністративної та кримінальної відповідальності за порушення карантинних правил. Виявлено недоліки відповідних законодавчих положень, на підставі аналізу яких сформульовані пропозиції щодо вдосконалення норм адміністративного та кримінального законодавства із зазначених питань.
Досліджено умови та межі застосування українського адміністративно-деліктного законодавства до іноземних осіб, які перебувають на території України, а також норми чинного законодавства України в контексті адміністративної відповідальності іноземців. Виокремлено прогалини чинного законодавства та запропоновано шляхи вирішення цієї проблеми. Висновки сформовано у вигляді пропозицій до Кодексу України про адміністративні правопорушення. ; The conditions and scope of the application of the Ukrainian administrative and tort legislation in regard to foreign persons on the territory of Ukraine, as well as the norms of the current legislation of Ukraine in the context of administrative liability of foreigners have been researched. The gaps in the current legislation have been distinguished and the ways of solving this problem have been suggested. Special attention has been focused on the fact that the Code of Ukraine on Administrative Offenses adopted in 1984, exhausted itself and needed a new wording. This leads to the fact that at the level of applying the law norms there are a lot of unsolved problems, especially those related to the execution of proceedings against a foreigner, the application of administrative penalties against him, the provision of legal assistance, guaranteeing of his rights, etc. Accordingly, the conclusions have been formulated in the form of propositions, which, in the opinion of the author, should be taken into account in the Code of Ukraine on Administrative Offenses (hereinafter referred to as the CUoAO). Among them, special attention should be paid to the following: a) it is necessary to harmonize the norms of the current legal acts regulating the legal status of foreigners during their stay in Ukraine (the emphasis is focused on the norms of the CUoAO and the norms of the Law of Ukraine "On the Legal Status of Foreigners and Stateless Persons"); b) it is offered to supplement p. 1 of the Art. 24 of the CUoAO with such clauses: "9. Administrative deportation of foreigners and stateless persons" and "9-1. Forced return of foreigners and stateless persons"; c) taking into account the propositions to supplement p. 1 of the Art. 24 of the CUoAO with the additional types of sanctions, it is necessary to amend the Section 3 "Administrative Sanction" of the Code of Ukraine on Administrative Offenses, supplementing it with the Articles 32-2 "Administrative Deportation of Foreigners and Stateless Persons" and 32-3 "Forced Return of Foreigners and Stateless Persons", where to regulate the procedure of the application of these types of sanctions.
