This book provides a complete overview of the jurisprudence on maritime delimitation. Each case is presented under a series of identical headings, so as simultaneously to provide the reader with a complete analysis of the individual case and a uniform measure of comparison with other cases. The headings are as follows: geographical context; submissions and arguments of the parties; specific features of the case; the judgement, broken down into its various elements; individual and dissenting opinions; and academic comment (together with a bibliography). The longest section on each case is that devoted to the judgement. The analysis of each relevant element (the role of third States, equity, equidistance, the displacement of a provisional line, islands, proportionality etc.) is presented in three ways: (1) a brief introductory part introducing, and offering a critique of, the essential features of the relevant part of the decision; (2) relevant extracts from the judgement; (3) commentaries (either brief or more developed, according to the needs of the case), that endeavour to bring out the substance of the judgement, in particular by drawing out the various consequences, making connections with previous and future cases so as to chart the development of the jurisprudence, and offering critical reflections. The book thus presents a complete panorama of the jurisprudential problems associated with maritime delimitation. The clarity and comprehensive nature of the presentation, and the quality of the commentaries, makes it an indispensable reference work for academics and for practitioners alike

Applying the social rights of the European Social Charter: some commentaries concerning the Belgian case ; La mise en œuvre des droits sociaux de la Charte Sociale Européenne: quelques aspects de l'expérience de la Belgique
This article tries to illustrate the influence of the European Social Charter (1961) on the evolution of Belgian Social Law. The finding is that most of the pillars of the Belgian Social Model were already established before the late ratification of the Charter by Belgium, in 1990. Afterwards the case law of the European Committee of Social Rights (ECSR) pointed out some necessary adaptations. Some others have been decided by the ECSR as a response to some collective complaints directed against Belgium. This country considered the ratification of the Protocol introducing this procedure as a meaningful progress for all the Contracting Parties. It gives the civil society a direct access in the development of the Charter, but only 15 State Parties did ratify it. The article comments also on how Belgium is confronted, like other Parties, with the competing mutual influence of the Charter and the Community Law of the EU. The revised Charter (1996) was a major contribution in favour of more coherence between both legal orders. Belgium argued strongly for more explicit convergences. It seems desirable that both the EU Court and the ECSR try to deliver more visibility about the common rights and their complementarity. ; Dans cet article, l'auteur tente d'identifier les principaux facteurs d'influence sur le système social belge issus de la prise en compte des droits sociaux garantis par la Charte sociale européenne. Cette influence n'a été en réalité que marginale, car les piliers du système ont été élaborés, en l'absence de dispositions constitutionnelles sur les droits sociaux avant 1994, avant l'application de la Charte, dont la ratification fut tardive. Le pays a cependant soutenu les protocoles de même que la version révisée de la Charte. Les principaux facteurs repris sélectivement sont la jurisprudence dans le cadre d'un système moniste, qui reconnaît la primauté du droit international et du droit communautaire sur le droit interne, certaines conclusions du Comité européen des droits sociaux à l'appui des rapports périodiques du pays et certaines décisions du Comité à l'appui de réclamations collectives contre la Belgique. L'auteur pense que l'influence du droit communautaire européen fut plus déterminante, parce qu'il était obligatoire. L'article discute certains effets positifs et négatifs de l'application concurrente des deux corps de règles dans les pays concernés par le droit de l'Union européenne et les droits de la Charte. L'auteur pense qu'il y aurait lieu de pousser plus loin la coopération entre l'Union et le Conseil de l'Europe au bénéfice d'une plus claire interpénétration et d'une convergence plus évidente des droits sociaux. The political context in Poland in 2015 and 2016 generated a veritable war of words, internet memes and comments between supporters and opponents of the ruling party. The objective of this article is to examine a corpus of political commentaries published by Polish Twitter and Facebook users between May 2015 and November 2016 in order to identify the language mechanisms used in the political struggle by public authorities and Internet users. ; Le contexte politique en Pologne en 2015 et en 2016 a généré une véritable guerre aux mots, aux mèmes Internet et aux commentaires entre les partisans et les adversaires du parti au pouvoir. L'objectif de cet article sera celui d'examiner ces commentaires politiques afin de relever les instruments linguistiques employés dans cette lutte par les autorités publiques et par les internautes. Sera soumis à l'analyse un corpus de commentaires politiques relevés entre mai 2015 et novembre 2016 sur les réseaux sociaux Twitter et Facebook. ; Politične razmere na Poljskem so v letih 2015 in 2016 privedle do prave besedne vojne na internetu in do nasprotujočih si komentarjev med pristaši in nasprotniki stranke na oblasti. Namen članka je preučiti politične komentarje, da bi odkrili jezikovna sredstva, ki jih v tem boju uporablja tako oblast kot uporabniki interneta. Analizirani korpus bodo tvorili politični komentarji, ki so bili na družbenih omrežjih twitter in facebook objavljeni v času med majem 2015 in novembrom 2016.

« A woeful pageant have we here beheld » : Esquisse d'une esthétique de la compassion dans le théâtre de William Shakespeare
International audience ; In early modern England, compassion is understood and gradually fashioned as a key notion encompassing various anthropological, aesthetic, political, theological, philosophical discourses and practices. Compassion permeates Shakespeare's drama as an emotional expression stemming organically from the actual performance echoed by the inserted commentaries in the characters' speeches, intended for the audience to interpret and experience. Thus it contributes to the fashioning of the identity of each character on stage, together with the identity of the spectators in the theatre house. By so doing it has a major influence on the relationship between the inner self of the spectator and his contemporaries. The playwright uses a device in order to highlight this aspect for the spectators in the theatre house. He initially pits the seemingly indifferent verbal commentaries of the inner spectators of the play against the crude violence of the various events occurring on stage. Then he inserts within the play's dialogues oblique references to the suffering of the onstage victim. The spectator is expected to reconstruct the emotional experience of suffering of the tortured character, while listening to the commentaries of the other characters on stage who appear fairly immune to the spectacle of the violence inflicted to the victim. Hence the emerge of some form of cognitive distance between words and stage action that may ultimately trigger the spectator's empathy, or his compassion. La démission de la Commission européenne : scandale et tournant institutionnel (oct. 1998 - mars 1999)

La version définitive est à consulté dans Cultures et Conflits ; La démission de la Commission Santer est souvent présentée comme un évènement fondateur témoignant d'une victoire de la démocratie sur la technocratie. En revenant sur la dynamique du scandale dans une perspective de sociologie des crises politiques et des mobilisations, cet article montre que cette « crise » et les interprétations qui en ont résulté ont été permises par des processus bien différents. D'une part, des transformations liées à un ensemble de tensions internes à la Commission, et plus particulièrement aux effets du déplacement nordiste et « managérial » de son centre de gravité sur le climat administratif ; d'autre part, une redéfinition des relations entre les membres du Collège, les parlementaires et les journalistes passant par la mise en cohérence de chacun de ces groupes et le recours à des savoir-faire politiques nouveaux au sein des institutions européennes. En ce sens, et au-delà d'un cas de scandale, c'est sur les différentes facettes de la politisation des institutions européennes que revient cette contribution.

The renewal of various forms of associationism in France since the sixties has generated a lot of commentaries. It is expected to play a significant rôle in the implementation of social experimentation. The author observes that the main actor in these processes seems clearly to be the State. This leads him to a more complex qualification of the process and a more thorough investigation of the specific social groups leading the movement.

The Adages of Erasmus, far from being a simple dictionary of ancient expressions, constitutes a complex work, strongly marked by the personality of the Dutch humanist. On the one hand, Erasmus' will not to merely take the material gathered by paremiographers and lexicographers gives rise to a "factory of new adages". On the other hand, many commentaries include quotations from sources, encyclopedic data, practical advices for the use of the studied expression, as well as Erasmus' personal opinions on topics that are of the greatest concern to him. One of these topics is the question of good government. Admittedly, the collection, as a whole, cannot be considered as a political work. However, it is in the Adages that we can find the basics of Erasmus' political thought. Although this collection, ranged among the didactic works of Erasmus, is not directly intended for a prince, it is nevertheless addressed to the elite, to the noblemen close to the Court. That is why it seemed interesting to us to study the Adages as a tool for political education. Our study consists of three parts. We first carry out a preliminary analysis of the entire collection to see how creative Erasmus is in the way he deals with the ancient legacy. We then examine those commentaries, where the political ideas are expressed more or less directly. Our purpose here is to identify the elements of a speculum principis in the commentaries of the adages n° 201, 1001, 1401 and 2601. We question the nature of the link established between the adage and politics. Furthermore, we are interested in the way the ideas expressed in the Adages are developed in Erasmus' other writings, especially in the Institutio principis christiani. We also focus here on the methodological aspect, studying the use of the adages and of the terminology, as well as the other means used by the humanist to instill good values in his readers. Finally, we analyse the way the legendary kings of Antiquity are presented and treated in the Adages. We have chosen three well-known ...
