My project explores and compares different forms of gender performance in contemporary art and visual culture according to a perspective centered on photography. Thanks to its attesting power this medium can work as a ready-made. In fact during the 20th century it played a key role in the cultural emancipation of the body which (using a Michel Foucault's expression) has now become «the zero point of the world». Through performance the body proves to be a living material of expression and communication while photography ensures the recording of any ephemeral event that happens in time and space. My questioning approach considers the gender constructed imagery from the 1990s to the present in order to investigate how photography's strong aura of realism promotes and allows fantasies of transformation. The contemporary fascination with gender (especially for art and fashion) represents a crucial issue in the global context of postmodernity and is manifested in a variety of visual media, from photography to video and film. Moreover the internet along with its digital transmission of images has deeply affected our world (from culture to everyday life) leading to a postmodern preference for performativity over the more traditional and linear forms of narrativity. As a consequence individual borders get redefined by the skin itself which (dissected through instant vision) turns into a ductile material of mutation and hybridation in the service of identity. My critical assumptions are taken from the most relevant changes occurred in philosophy during the last two decades as a result of the contributions by Jacques Lacan, Michel Foucault, Jacques Derrida, Gilles Deleuze who developed a cross-disciplinary and comparative approach to interpret the crisis of modernity. They have profoundly influenced feminist studies so that the category of gender has been reassessed in contrast with sex (as a biological connotation) and in relation to history, culture, society. The ideal starting point of my research is the year 1990. I chose it as the approximate historical moment when the intersection of race, class and gender were placed at the forefront of international artistic production concerned with identity, diversity and globalization. Such issues had been explored throughout the 1970s but it was only from the mid-1980s onward that they began to be articulated more consistently. Published in 1990, the book "Gender trouble: feminism and the subversion of identity" by Judith Butler marked an important breakthrough by linking gender to performance as well as investigating the intricate connections between theory and practice, embodiment and representation. It inspired subsequent research in a variety of disciplines, art history included. In the same year Teresa de Lauretis launched the definition of queer theory to challenge the academic perspective in gay and lesbian studies. In the meantime the rise of Third Wave Feminism in the US introduced a racially and sexually inclusive vision over the global situation in order to reflect on subjectivity, new technologies and popular culture in connection with gender representation. These conceptual tools have enabled prolific readings of contemporary cultural production whether fine arts or mass media. After discussing the appropriate framework of my project and taking into account the postmodern globalization of the visual, I have turned to photography to map gender representation both in art and in fashion. Therefore I have been creating an archive of images around specific topics. I decided to include fashion photography because in the 1990s this genre moved away from the paradigm of an idealized and classical beauty toward a new vernacular allied with lifestyles, art practices, pop and youth culture; as one might expect the dominant narrative modes in fashion photography are now mainly influenced by cinema and snapshot. These strategies originate story lines and interrupted narratives using models' performance to convey a particular imagery where identity issues emerge as an essential part of fashion spectacle. Focusing on the intersections of gender identities with socially and culturally produced identities, my approach intends to underline how the fashion world has turned to current trends in art photography and in some case turned to the artists themselves. The growing fluidity of the categories that distinguish art from fashion photography represents a particularly fruitful moment of visual exchange. Varying over time the dialogue between these two fields has always been vital; nowadays it can be studied as a result of this close relationship between contemporary art world and consumer culture. Due to the saturation of postmodern imagery the feedback between art and fashion has become much more immediate and then increasingly significant for anyone who wants to investigate the construction of gender identity through performance. In addition to that a lot of magazines founded in the 1990s bridged the worlds of art and fashion because some of their designers and even editors were art-school graduates encouraging innovation. The inclusion of art within such magazines aimed at validating them as a form of art in themselves supporting a dynamic intersection for music, fashion, design and youth culture: an intersection that also contributed to create and spread different gender stereotypes. This general interest in fashion produced many exhibitions of and about fashion itself at major international venues such as the Victoria and Albert Museum in London, the Metropolitan Museum of Art and the Solomon R. Guggenheim Museum in New York. Since then this celebrated success of fashion has been regarded as a typical element of postmodern culture. Owing to that I have also based my analysis on some important exhibitions dealing with gender performance like "Féminin-Masculin" at the Centre Pompidou of Paris (1995), "Rrose is a Rrose is a Rrose. Gender performance in photography" at the Solomon R. Guggenheim Museum of New York (1997), "Global Feminisms" at the Brooklyn Museum (2007), "Female Trouble" at the Pinakothek der Moderne in München together with the workshops dedicated to "Performance: gender and identity" in June 2005 at the Tate Modern of London. Since 2003 in Italy we have had Gender Bender - an international festival held annually in Bologna - to explore the gender imagery stemming from contemporary culture. In few days this festival offers a series of events ranging from visual arts, performance, cinema, literature to conferences and music. Being aware that any method of research is neither race nor gender neutral I have traced these critical paths to question gender identity in a multicultural perspective taking account of the political implications too. In fact, if visibility may be equated with exposure, we can also read these images as points of intersection of visibility with social power. Since gender assignations rely so heavily on the visual, the postmodern dismantling of gender certainty through performance has wide-ranging effects that need to be analyzed. In some sense this practice can even contest the dominance of visual within postmodernism. My visual map in contemporary art and fashion photography includes artists like Nan Goldin, Cindy Sherman, Hellen van Meene, Rineke Dijkstra, Ed Templeton, Ryan McGinley, Anne Daems, Miwa Yanagi, Tracey Moffat, Catherine Opie, Tomoko Sawada, Vanessa Beecroft, Yasumasa Morimura, Collier Schorr among others.
Dottorato di ricerca in Scienze e tecnologie per la gestione forestale e ambientale ; Nell'economia agricola della regione Campania la produzione del latte di bufala ricopre un ruolo centrale per fatturato, con oltre 260.000 capi allevati. Le superfici vocate all'allevamento sono limitate ad alcune aree di pianura della provincia di Caserta e Salerno e conseguentemente il carico di bestiame per unità di superficie è molto alto. Esiste, quindi, un problema di gestione dei reflui zootecnici, come in tutte le regioni d'Europa in cui si pratica l'allevamento intensivo. Da recenti ricerche è emersa una sostanziale discrepanza tra l'inquinamento rilevato ascrivibile a fonti non puntiformi (NPS) e l'effettivo carico di bestiame. L'inquinamento da nitrati, in particolare, è risultato in Campania relativamente contenuto, pur in presenza di elevati carichi. Partendo da questi risultati, è stato determinato l'effettivo contenuto medio di nutrienti (azoto e fosforo) nel refluo della bufala, quantificandone l'effettivo valore agronomico e quindi l'effettiva propensione degli agricoltori ad utilizzarlo. La tesi approfondisce le possibilità di gestione dei reflui zootecnici bufalini, coerentemente con la normativa, con le esigenze agronomiche, valutando anche le possibili tecniche di trattamento. Difatti la normativa e le tecniche di gestione vengono approfonditamente discusse, anche con riferimento ad un'azienda reale del salernitano. A supporto delle attività degli allevatori, viene presentato inoltre un software di gestione appositamente elaborato in Visual Basic, utile alla compilazione del modello di comunicazione per l'utilizzazione agronomica degli effluenti zootecnici, obbligatorio in regione Campania. A seguito di questo approfondimento, si comprende che il costo di gestione agronomica, tra 1,4 - 2,3 €/m ³ di refluo da gestire (a seconda della tecnica di spandimento utilizzata) a fronte di un contenuto di azoto invero molto basso, dell'ordine dei 2 kg/m³ e per di più con una resa al campo molto bassa. Con questa sproporzione tra il costo di gestione e l'effettivo scarso valore agronomico, si giustifica, almeno dal punto di vista economico, lo scarso impegno degli allevatori nella corretta gestione. Con queste premesse, il contributo della tesi è mirato a valutare le strategie gestionali per migliorare le possibilità di impiego agronomico. La tesi principale è che ottimizzando l'impiego del raschiatore nel paddock ossia limitandolo ad alcuni periodi dell'anno, sia possibile aumentare l'evaporazione e ridurre sensibilmente quindi i volumi da gestire. A questo scopo sono stati adattati i due modelli empirici di evapotraspirazione di Tombesi Lauciani e Hargreaves, rispettivamente, e ne sono state confrontate le diverse performance in termini di rispondenza fra dati previsti e stimati. I dati utilizzati per la stima dell'evaporazione dei reflui in situ, sono stati ricavati da misure del peso del refluo stesso, su una pesa sperimentale in grado di risolvere variazioni di peso di pochi etti su una superficie di 2 m². La pesa è stata realizzata in acciaio inox, e dotata di 4 celle di carico, provviste di un dispositivo di finecorsa per prevenire danni dovuti a sovraccarichi accidentali. È stata, quindi, posta in opera nel paddock di un'azienda, a filo con il piano di calpestio. Contestualmente sono stati installati gli strumenti per la misura dei parametri agrometeorologici. I dati sono stati raccolti da un data logger Campbell. I due modelli sono stati calibrati e confrontati sulla base dei dati raccolti nel periodo dal 23 Giugno al 24 Settembre 2011. Il modello più efficiente, in termini di rispondenza fra i dati stimati e quelli misurati è stato poi implementato su un periodo di 5 anni (dal 2006 al 2011), consentendo un calcolo su base annua dell'evaporazione. I risultati hanno mostrato che il modello basato sulla formula di Tombesi Lauciani è più accurato. Col modello è stata dedotto che con una strategia di gestione appropriata è possibile ridurre il volume di reflui da gestire del 30 %, riducendo i periodi di azionamento del raschiatore. La strategia di gestione ottimale prevede di ridurre, per quanto possibile, l'uso del raschiatore tra il 100° e il 250° Giorno Giuliano Apparentemente con questo tipo di gestione aumenterebbero le perdite per volatilizzazione dell'azoto ammoniacale. Per altro, in base allo studio effettuato, in Campania con l'attuale pratica di gestione dei reflui (carro botte e piatto deviatore), che per necessità viene utilizzato anche nelle ore centrali della giornate, si hanno egualmente elevate perdite di azoto ammoniacale. Con questo lavoro di tesi si introduce una nuova visione per la gestione degli effluenti zootecnici nel clima mediterraneo, dove ci sono più problemi legati alle emissioni di gas serra rispetto alle piogge acide. ; Buffalo husbandry plays an important role in Campania region's economy with over than 260,000 buffalo heads reared, the industry contributes an annual turnover of 500 million Euros. Agricultural lands suitable for livestock production, in Campania region, are limited to both Caserta and Salerno provinces' plains. Consequently the number of head per hectare is very high. Therefore there is a big challenge in terms of manure management, as in all the European country where there are intensive livestock farms. Recent studies have shown a discrepancy between the NPS pollution in the monitoring wells and the actual number of buffalo in Caserta province. Results showed presence of nitrate pollution in shallow groundwater, but the values were not comparable to the nitrate concentrations characteristic of other strongly agricultural systems in Europe. Starting from these results, new studies have characterized the composition of buffalo manure quantifying the actual nitrogen and phosphorous content, its agronomic value and consequently the real propensity of farmers to use it. Basing on this background, the present work concerns about buffalo manure management in Campania region (South Italy), analyzing the possibility to manage the farms according to the regulations, the agronomic requirements, evaluating also the possible treatment techniques. Legislation and management techniques are discussed in detail, with reference to specific farm near Salerno. Moreover a management software, developed with Visual Basic®, is introduced. The software provides all the calculations required in the "communication form for the manure utilization", which is the regional instrument for manure management monitoring. The first part of the thesis show that the cost for spreading activities are expensive (1,4 - 2,3 €/m ³ of manure) compared to the actual nitrogen content that is about 2 kg/m³. This difference between the cost for manure application to the land and the low agronomic value, is the reason why the many farmers don't apply manure management in a correct way. Therefore the research is aimed at evaluating management strategies to improve the possibilities for agronomic use. The main thesis is that optimizing the use of the scraper in the farmyard, limiting it to certain times of the year, it is possible to increase natural manure evaporation and therefore significantly reduce the volumes to be handled. With this aim, this study compares the output of two empirical models for buffalo (Bubalus bubalis) manure evaporation, with measured data, in order to evaluate models performance. The two models were developed by adapting the potential evapotranspiration of Tombesi-Lauciani and Hargreaves. The data used for assessing the real manure evaporation in situ, were derived from the manure weights recorded by an experimental platform, equipped with load cells, installed within the farmyard. The experiments were carried out in Serre (SA), in the South of Italy in the period from 23 of June to 24 of September. The more efficient model, in terms of closeness between estimates and measures, was implemented over a period of 5 years, allowing annualized calculation of evaporation. On this basis, an optimal management strategy was established, which corresponds to maximizing the manure evaporation, minimizing the use of the scraper from the 100th day of the year (DOY) to the 250th DOY. This leads to a potential reduction in weight of the manure by 650 kg/m2 of farmyard/year, which corresponds to management cost reduction of about 30%. It is necessary to underline that this management strategy could increase the ammonia losses for volatilization. On the other hand, it has to be considered that in the study area, the spreading activities are concentrated in the central hours of the days, with high temperature. With this thesis it is introduced a new vision for the manure management in the Mediterranean climate, where there are more problems related to greenhouse gas emissions than to acid rain.
Dottorato di ricerca in Diritto dei contratti pubblici e privati ; In data 11 maggio 2005, il Parlamento europeo e la Commissione hanno adottato la direttiva 2005/29/CE relativa alle pratiche commerciali sleali poste in essere tra imprese e consumatori nel mercato interno. La presente direttiva intende contribuire al corretto funzionamento del mercato interno e al conseguimento di un livello elevato di tutela dei consumatori mediante l'armonizzazione delle disposizioni legislative, regolamentari e amministrative degli Stati membri in materia di pratiche commerciali sleali. Scopo del presente lavoro vuole essere quello di indagare la fattispecie in commento, avendo particolare riguardo alle disposizioni nazionali di recepimento della suddetta direttiva comunitaria (D.Lgs., n. 146 del 2 agosto 2007). Ove si volesse sinteticamente rievocare la recente evoluzione normativa che ha condotto all'affermazione di un diritto dei consumatori anche nel nostro Paese, sarebbe possibile configurarla come un tentativo di superamento dell'inadeguatezza della disciplina codicistica e delle tecniche di tutela dei diritti basate sull'azione in giudizio del singolo interessato. Il fine è quello di attribuire al consumatore e, oggi, anche alle microimprese, una posizione giuridicamente più forte per compensare la loro intrinseca debolezza sul piano sostanziale. La disciplina relativa alle pratiche commerciali scorrette estende la tutela del consumatore - oltre la soglia stessa del contratto - all'intero rapporto di consumo. Il complesso di questa normativa, elaborata proprio per superare la constatata inadeguatezza della tutela "formale" garantita dal codice civile, determina una necessaria esigenza di adeguamento del sistema e degli stessi abiti mentali degli operatori del diritto, aprendo una serie di questioni su cui è utile soffermarsi. Si tratta di individuare il nuovo punto di equilibrio nei rapporti tra autonomia dei privati e ordinamento. In tale contesto, occorre ricostituire un bilanciamento degli interessi e degli adeguati criteri di giudizio volti a chiarire se la normativa a tutela dei consumatori esprima un'istanza di tipo dirigista oppure si configuri come una nuova frontiera dell'affermazione della libertà dell'individuo. Si può proporre un primo tentativo di risposta che ruota intorno alla consapevolezza e all'autonomia della scelta di consumo. Queste devono essere garantite nella loro effettività in quanto divengono, nel quadro del mercato concorrenziale, un momento altrettanto essenziale come quello della competizione tra le imprese. Il consumatore, infatti, potendo scegliere tra le varie offerte induce una pressione nei confronti delle imprese che devono sforzarsi di offrire beni e servizi sempre migliori. La volontà e la capacità di giudizio del consumatore devono essere protette da abusive pressioni esterne, senza però essere annullate o sostituite integralmente da determinazioni eteronome di natura amministrativa o giudiziale. In questo contesto assume un ruolo rilevante l'Autorità Garante della Concorrenza e del Mercato la quale, chiamata a vigilare anche in materia di pratiche commerciali scorrette, ha il delicato compito di rendere operativo l'insieme delle tutele previste in astratto dalla legge senza pregiudicare la libera e consapevole scelta del consumatore nonché la libertà di impresa. Seguendo tali linee programmatiche sarà possibile individuare i punti di forza e nello stesso tempo di debolezza che potrebbero rilevare in sede di tutela civilistica delle ragioni del consumatore non trascurando il fatto che, da un lato, la disciplina delle pratiche commerciali scorrette non è stata disegnata dalla direttiva 2005/29/CE in funzione della produzione di effetti inerenti ai rapporti contrattuali tra il professionista e il consumatore, dall'altro, è la prassi che impone di approfondire tale interessante profilo di indagine. Tra gli obiettivi del presente lavoro si inseriscono, altresì, talune necessarie considerazioni in merito alla disciplina statunitense delle unfair commercial practices – frutto di un periodo di ricerca che, colui che scrive, ha avuto l'onore e il piacere di svolgere negli Stati Uniti d'America presso la Fordham University School of Law (New York City). ; The Directive on Unfair Commercial Practices was adopted on May 2005. Commercial practice refers to activities linked to the promotion, sale or supply of a product to consumers. It covers any act, omission, course of conduct, representation or commercial communication – including advertising and marketing – which is carried out by a trader. If it is unfair, this means it is deemed to be unacceptable with regards to the consumer, according to specified criteria. The Directive has been passed to strengthen the confidence of European consumers in cross-border transactions. Evidence showed that citizens were unsure if their rights would be adequately protected in international purchases and were therefore not taking advantage of the European Internal Market. The Directive aims to clarify consumers' rights and to simplify cross-border trade. Common rules and principles will give consumers the same protection against unfair practices and rogue traders whether they are buying from their corner shop or purchasing from a website based abroad. The Directive brings harmonization and mutual recognition between states, bringing down internal market barriers. On September 21, 2007, Legislative Decrees n. 145/2007 and 146/2007 entered into force, transposing Community Directive 2005/29/EC into the Italian law. These decrees modify the rules on misleading and unlawful comparative advertising (by modifying the Legislative Decree no. 206/2005 - Consumer Code) and introduce a new set of rules on improper or unfair commercial practices, entrusting its implementation to the Antitrust Authority. Commercial practices are considered unfair if they run "contrary to the requirements of professional diligence and materially distorts or is likely to materially distort the economic behaviour with regard to the product of the average consumer whom it reaches or to whom it is addressed, or of the average member of the group when a commercial practice is directed to a particular group of consumers. " (Section 20(2) of the Consumer Code). Two different types of unfair commercial practices have been distinguished. One concerns "misleading practices," which may involve " misleading actions" or " misleading omissions." Actions or omissions are considered misleading to the extent that they induce average consumers to make decisions they would not have made otherwise. Another type of unfair commercial practices concerns "Aggressive practices" wich are practices that employ harassment, coercion or other undue forms of influence to pressure the average consumer into making commercial decisions they would not have made otherwise. The new set of rules also identifies commercial practices which are in all circumstances considered misleading or aggressive and no additional burden of proof is necessary to demonstrate their capacity to misguide consumer choices. About unfair commercial practices, misleading and unlawful comparative advertising, the new rules empower the Antitrust Authority to launch proceedings also ex-officio (i.e. even when no complaints have been received from external sources). It is endowed with investigatory powers, including the ability to gain access to any pertinent document and to request pertinent documents or information from anyone, the capacity to sanction refusals to cooperate or the transmission of untruthful documentation or information, to conduct inspections, to receive assistance from the Italian Tax Police and to conduct surveys and economic analyses. From the studies relating to the Italian law discipline it has emerged that the discussion about unfair commercial practices finds a significant example in unfair practices regulated from Federal Trade Commission Act wich is even worth analyzing. The Phd thesis also investigates the likely impact of the consumer regulation on the private law of contract and the consumer's right of redress.
SENTIERI Project (Mortality study of residents in Italian polluted sites) studies mortality of residents in the sites of national interest for environmental remediation (Italian polluted sites, IPS). IPSs are located in the vicinity of industrial areas, either active or dismissed, near incinerators or dumping sites of industrial or hazardous waste. SENTIERI includes 44 out of 57 sites comprised in the "National environmental remediation programme". For each IPS contamination data were collected, both from the national and local environmental remediation programmes. Contamination data are mainly for private industrial areas; municipal and/or green and agricultural areas were poorly studied, therefore it is difficult to assess the environmental exposure of populations living inside and/or near IPSs. Each one of 44 SENTIERI IPSs includes one or more municipalities. Mortality in the period 1995-2002 was studied for 63 single or grouped causes at municipality level computing: crude rate, standardized rate, standardized mortality ratios (SMR), and SMR adjusted for an ad hoc deprivation index. Regional populations were used as reference for SMR calculation. The deprivation index was constructed using 2001 national census variables on the following socioeconomic domains: education, unemployment, dwelling ownership and overcrowding. A characterizing element of SENTIERI Project is the a priori evaluation of the epidemiological evidence of the causal association between cause of death and exposure. Exposures for which epidemiological evidence was assessed are divided into IPSs environmental exposures and other exposures. The former are defined on the basis of the decrees defining sites' boundaries; they are coded as chemicals, petrochemicals and refineries, steel plants, power plants, mines and/or quarries, harbour areas, asbestos or other mineral fibres, landfills and incinerators. The other exposures, considered for their ascertained adverse health effects are: air pollution, active and passive smoking, alcohol intake, occupational exposure and socioeconomic status. The epidemiologists in SENTIERI Working Group (WG) developed a procedure to examine the epidemiological literature published from 1998 to 2009; the WG identified a hierarchy in the literature examined to classify each combination of cause of death and exposure in terms of strength of causal inference. The selected epidemiological information included primary sources (handbooks and Monographs and Reports of international and national scientific institutions), statistical re-analyses, literature reviews, multi-centric studies and single investigations. This hierarchy relies on the epidemiological community consensus, on assessments based on the application of standardized criteria, weighting the studies design and the occurrence of biased results. Therefore, to put forward the assessment, the criteria firstly favoured primary sources and quantitative meta-analyses and, secondly, consistency among sources. The epidemiological evidence of the causal association was classified into one of these three categories: Sufficient (S), Limited (L), and Inadequate (I). The procedures and results of the evidence evaluation have been presented in a 2010 Supplement of Epidemiologia & Prevenzione devoted to SENTIERI. SENTIERI studied IPS-specific mortality and the overall mortality profile in all the IPSs combined. Some IPS-specific results are noteworthy and are herementioned. The presence of asbestos (or asbestiform fibres in Biancavilla) was the motivation for including six IPSs (Balangero, Emarese, Casale Monferrato, Broni, Bari-Fibronit, Biancavilla) in the "National environmental remediation programme". In these sites (with the only exception of Emarese) increases in malignant pleural neoplasm mortality were observed, in four of them the excess was in both genders. In six other sites (Pitelli, Massa Carrara, Aree del litorale vesuviano, Tito, Area industriale della Val Basento, Priolo), in which additional sources of environmental pollution were reported, mortality from malignant pleural neoplasm was increased in both genders in Pitelli, Massa Carrara, Priolo and Litorale vesuviano. In the twelve sites where asbestos was mentioned in the decree, a total of 416 extra cases of malignant pleural neoplasms were computed. Asbestos and pleural neoplasm represent an unique case. Unlike mesothelioma, most causes of death analyzed in SENTIERI have multifactorial etiology, furthermore in most IPSs multiple sources of different pollutants are present, sometimes concurrently with air pollution from urban areas: in these cases, drawing conclusions on the association between environmental exposures and specific health outcomes might be complicated. Notwithstanding these difficulties, in a number of cases an etiological role could be attributed to some environmental exposures. The attribution could be possible on the basis of increases observed in both genders and in different age classes, and the exclusion of a major role of occupational exposures was thus allowed. For example, a role of emissions fromrefineries and petrochemical plants was hypothesized for the observed increases in mortality from lung cancer and respiratory diseases in Gela and Porto Torres; a role of emissions frommetal industries was suggested to explain increased mortality from respiratory diseases in Taranto and in Sulcis-Iglesiente-Guspinese. An etiological role of air pollution in the raise in congenital anomalies and perinatal disorders was suggested in Falconara Marittima, Massa-Carrara,Milazzo and Porto Torres. A causal role of heavy metals, PAH's and halogenated compounds was suspected for mortality from renal failure in Massa Carrara, Piombino, Orbetello, Basso Bacino del fiume Chienti and Sulcis-Iglesiente- Guspinese. In Trento-Nord, Grado and Marano, and Basso bacino del fiume Chienti increases in neurological diseases, for which an etiological role of lead, mercury and organohalogenated solvents is possible, were reported. The increase for non- Hodgkin lymphomas in Brescia was associated with the widespread PCB pollution. SENTIERI Project assessed also the overall mortality profile in all the IPSs combined. The mortality for causes of death with a priori Sufficient or Limited evidence of causal association with the environmental exposure showed 3 508 excess deaths for all causes, corresponding to 439 per year; the number of excess deaths was 1 321 for respiratory diseases, 898 for lung cancer and 588 for pleural neoplasms. When considering excess mortality with no restriction to causes of death with a priori Sufficient or Limited evidence of causal association with the environmental exposure, the number of excess deaths for all causes was 9 969 (SMR 102.5, about 1 200 excess deaths per year; the excess was 4 309 for all neoplasms (SMR 103.8, about 538 excess deaths per year), 1 887 for circulatory systemdiseases, and 600 for respiratory systemdiseases. Most of these excesses were observed in IPSs located in Southern and Central Italy. The distribution of the causes of deaths showed that the excesses are not evenly distributed: cancer mortality accounts for 30% of all deaths, but it is 43.2% of the excess deaths (4 309 cases out of 9 969). Conversely, the percentage of excesses in noncancer causes is 19%, while their share of total mortality is 42%. SENTIERI is affected by some limitations, such as the ecological study design and a time window of observation possibly inappropriate to account for induction-latency time; the analyzed outcome (mortality instead than incidence) might be unsuitable as well. Despite its limitations, SENTIERI documented increased mortality for single IPSs and an overall burden of disease in residents in Italian polluted sites. These excesses could be attributed to multiple risk factors, that include also the environmental exposures. The study results will be shared with the Ministries of Health and Environment, Regional governments, Regional environmental protection agencies, Local health authorities and municipalities. A collaborative approach between institutions in charge of environmental protection and health promotion will foster, among else, a scientifically sound and transparent communication process with concerned populations. ; Il Progetto SENTIERI (Studio Epidemiologico Nazionale dei Territori e degli Insediamenti Esposti a Rischio da Inquinamento) riguarda l'analisi della mortalit? delle popolazioni residenti in prossimit? di una serie di grandi centri industriali attivi o dismessi, o di aree oggetto di smaltimento di rifiuti industriali e/o pericolosi, che presentano un quadro di contaminazione ambientale e di rischio sanitario tale da avere determinato il riconoscimento di "siti di interesse nazionale per le bonifiche" (SIN). Lo studio ha preso in considerazione 44 dei 57 siti oggi compresi nel "Programma nazionale di bonifica", che coincidono con i maggiori agglomerati industriali nazionali; per ciascuno di essi si ? proceduto a una raccolta di dati di caratterizzazione, e successivamente a una loro sintesi. La maggior parte dei dati raccolti proviene dai progetti di bonifica ipotizzati per i diversi siti, da cui si evince che oggetto di caratterizzazione e di valutazione del rischio sono state prevalentemente le aree private industriali, quelle, cio?, ritenute causa delle diverse tipologie di inquinamento (definite in SENTIERI esposizioni ambientali). Le aree pubbliche cittadine e/o a verde pubblico e le aree agricole comprese all'interno dei SIN sono state poco investigate. I SIN studiati sono costituiti da uno o pi? Comuni. La mortalit? ? stata studiata per ogni sito, nel periodo 1995-2002, attraverso i seguenti indicatori: tasso grezzo, tasso standardizzato, rapporto standardizzato di mortalit? (SMR) e SMR corretto per un indice di deprivazione socioeconomica messo a punto ad hoc. Nella standardizzazione indiretta sono state utilizzate come riferimento le popolazioni regionali. L'indice di deprivazione ? stato calcolato sulla base di variabili censuarie appartenenti ai seguenti domini: istruzione, disoccupazione, propriet? dell'abitazione, densit? abitativa. Gli indicatori di mortalit? sono stati calcolati per 63 cause singole o gruppi di cause. La presenza di amianto (o di fibre asbestiformi a Biancavilla) ? stata la motivazione esclusiva per il riconoscimento di sei SIN (Balangero, Emarese, Casale Monferrato, Broni, Bari-Fibronit e Biancavilla). In tutti i siti (con l'esclusione di Emarese) si sono osservati incrementi della mortalit? per tumore maligno della pleura e in quattro siti i dati sono coerenti in entrambi i generi. In sei siti con presenza di altre sorgenti di inquinamento oltre all'amianto, la mortalit? per tumore maligno della pleura ? in eccesso in entrambi i generi a Pitelli, Massa Carrara, Priolo e nell'Area del litorale vesuviano. Nel periodo 1995-2002 nell'insieme dei dodici siti contaminati da amianto sono stati osservati un totale di 416 casi di tumore maligno della pleura in eccesso rispetto alle attese. Quando gli incrementi di mortalit? riguardano patologie con eziologia multifattoriale, e si ? in presenza di siti industriali con molteplici ed eterogenee sorgenti emissive, talvolta anche adiacenti ad aree urbane a forte antropizzazione, rapportare il profilo di mortalit? a fattori di rischio ambientali pu? risultare complesso. Tuttavia, in alcuni casi ? stato possibile attribuire un ruolo eziologico all'esposizione ambientale associata alle emissioni di impianti specifici (raffinerie, poli petrolchimici e industrie metallurgiche). Tale attribuzione viene rafforzata dalla presenza di eccessi di rischio in entrambi i generi, e in diverse classi di et?, elementi che consentono di escludere ragionevolmente un ruolo prevalente delle esposizioni professionali. Per esempio, per gli incrementi di mortalit? per tumore polmonare e malattie respiratorie non tumorali, a Gela e Porto Torres ? stato suggerito un ruolo delle emissioni di raffinerie e poli petrolchimici, a Taranto e nel Sulcis-Iglesiente-Guspinese un ruolo delle emissioni degli stabilimenti metallurgici. Negli eccessi di mortalit? per malformazioni congenite e condizioni morbose perinatali ? stato valutato possibile un ruolo eziologico dell'inquinamento ambientale a Massa Carrara, Falconara, Milazzo e Porto Torres. Per le patologie del sistema urinario, in particolare per le insufficienze renali, un ruolo causale di metalli pesanti, IPA e composti alogenati ? stato ipotizzato a Massa Carrara, Piombino, Orbetello, nel Basso bacino del fiume Chienti e nel Sulcis-Iglesiente-Guspinese. Incrementi di malattie neurologiche per i quali ? stato sospettato un ruolo eziologico di piombo, mercurio e solventi organo alogenati sono stati osservati rispettivamente a Trento Nord, Grado e Marano e nel Basso bacino del fiume Chienti. L'incremento dei linfomi non-Hodgkin a Brescia ? stato messo in relazione con la contaminazione diffusa da PCB. Ulteriori elementi di interesse sono stati forniti dalle stime globali della mortalit? nell'insieme dei siti oggetto del Progetto SENTIERI. In particolare, ? emerso che la mortalit? in tutti i SIN, per le cause di morte con evidenza a priori Sufficiente o Limitata per le esposizioni ambientali presenti supera l'atteso, con un SMR di 115.8 per gli uomini (IC 904.4-117.2, 2 439 decessi in eccesso) e 114.4 per le donne (IC 902.4-116.5; 1 069 decessi in eccesso). Tale sovramortalit? si riscontra anche estendendo l'analisi a tutte le cause di morte, cio? non solo per quelle con evidenza a priori Sufficiente o Limitata: il totale dei decessi, per uomini e donne, ? di 403 692, in eccesso rispetto all'atteso di 9 969 casi (SMR 102.5%; IC 902.3-102.8), con una media di oltre 1 200 casi annui. Si ritiene opportuno ricordare che il Progetto SENTIERI, per obiettivi, disegno e metodi, rappresenta uno strumento descrittivo che verifica, in prima istanza, se e quanto il profilo di mortalit? delle popolazioni che vivono nei territori inclusi in aree di interesse nazionale per le bonifiche si discosti da quello cause delle popolazioni di riferimento. Ai fini dell'interpretazione dei risultati, si ricorda che la presenza di eccessi di mortalit? pu? indicare un ruolo di esposizioni ambientali con un grado di persuasivit? scientifica che dipende dai diversi specifici contesti; invece, un quadro di mortalit? che non si discosti da quello di riferimento potrebbe riflettere l'assenza di esposizioni rilevanti, ma anche l'inadeguatezza dell'indicatore sanitario utilizzato (mortalit? invece di incidenza) rispetto al tipo di esposizioni presenti, o della finestra temporale nella quale si analizza la mortalit? rispetto a quella rilevante da un punto di vista dell'esposizione. La condivisione dei risultati con i ministeri della salute e dell'ambiente, le Regioni, le ASL, le ARPA e i Comuni interessati consentir? l'attivazione di sinergie fra le strutture pubbliche con competenze in materia di protezione dell'ambiente e di tutela della salute, e su questa base l'avvio di un processo di comunicazione con la popolazione scientificamente fondato e trasparente. La filosofia del diritto occidentale, mentre si è ampiamente preoccupata di indagare i fondamenti giustificativi dei diritti di proprietà intellettuale, raramente si è occupata di quelli del loro antagonista concettuale, ovvero del pubblico dominio. Lo scarso interesse manifestato dalla letteratura scientifica trova plausibile spiegazione nella concezione largamente diffusa che identifica il pubblico dominio nel concetto opposto e contrario di "proprietà", finendo per cadere nell'equazione che considera una risorsa valorizzabile e meritevole di attenzione e tutela solo ciò che è appropriabile e tratta ciò che non lo è come scarto privo di intrinseco interesse. Oggi, a questa visione se ne è sostituita un'altra, che vede il pubblico dominio non più come res nullius, ma come res publici iuris, ovvero proprietà collettiva, comune, di tutti. Riconoscere che sul pubblico dominio insiste un interesse proprietario comune, equivale a dire che ciascun membro della collettività vanta un interesse a rivendicarne la comune proprietà, ovvero ad opporsi a tentativi di loro privata appropriazione. In relazione al diritto dei marchi tale interesse si contrappone al fenomeno di appropriazione indebita dei segni distintivi che devono considerarsi patrimonio comune, sottratto a qualsiasi diritto di privativa e liberamente disponibile per la collettività. Il capitolo introduttivo affronta i problemi definitori del pubblico dominio con riferimento alle principali privative industrialistiche, per poi concentrarsi, in particolare, sul rapporto con il diritto dei marchi. Esso dà conto delle principali iniziative mosse a livello internazionale per studiare le interazioni tra diritto dei marchi e pubblico dominio e si conclude con l'individuazione degli interessi collegati alla salvaguardia di un pubblico dominio ricco ed accessibile e delle minacce a tale interesse, ravvisabili nella tendenza all'espansione e al cumulo delle tutele. La durata tendenzialmente illimitata del diritto e la revocabilità dello status di pubblico dominio di un segno, caratterizzano il diritto di marchio rispetto alle altre privative industrialistiche per non avere una struttura di per sé favorevole e predisposta alla salvaguardia del dominio pubblico. Tale limite strutturale è però temperato dal legislatore mediante la previsione di limiti alla possibilità di acquisizione del diritto, nonché alla sua portata una volta acquisito. I capitoli II e V si occupano dei meccanismi che il diritto dei marchi prevede al fine di garantire spazi di pubblico dominio cui gli operatori del mercato possono liberamente attingere senza perciò interferire con l'area dei diritti di esclusiva dei titolari di marchio. Il capitolo II, in particolare, si occupa dei meccanismi di salvaguardia del pubblico dominio costituito dai segni esclusi dalla registrazione. I singoli impedimenti alla registrazione sono presi in esame evidenziandone la scarsa capacità escludente anche alla luce della tendenza all'estensione dell'oggetto della tutela di marchio, evidenziata attraverso una rassegna dei principali marchi-non convenzionali cui negli anni è stata concessa tutela. Tra tali meccanismi di salvaguardia del pubblico dominio spazio centrale è dedicato al principio dell'imperativo di disponibilità dei segni distintivi. Tale dottrina è stata elaborata dal formante giurisprudenziale tedesco sotto il nome di "Freihaltebedürfnis" (letteralmente "necessità di mantenere libero") e fatta propria dalla dottrina anglosassone come "right to keep free" e sostiene, almeno nel suo impianto originale, la necessità di subordinare la registrazione di un marchio ad una previa valutazione di opportunità che il segno per cui si domanda tutela debba rimanere in pubblico dominio, ovvero liberamente appropriabile dalla collettività. Oggi è più che mai in dubbio quale sia il ruolo di questo principio all'interno del diritto comunitario dei marchi. Il capitolo III illustra l'iter della giurisprudenza comunitaria con riferimento alla questione del riconoscimento e della rilevanza dell'imperativo di disponibilità nel giudizio di registrazione. L'analisi evidenzierà come la Corte sia giunta a conclusioni differenti a seconda del diverso impedimento alla registrazione oggetto di interpretazione, con risultati considerati irragionevoli da larga parte della dottrina e non banali difficoltà e incertezze applicative per gli Uffici di registrazione. Nonostante ciò si evidenzierà l'emergere di una linea interpretativa comune alla maggior parte delle decisioni analizzate, tesa a riconoscere un ruolo effettivo all'imperativo di disponibilità nel giudizio di registrazione, seppur solo di carattere strumentale alla valutazione di distintività di un segno. Il capitolo IV illustra come il recente progetto di riforma di Direttiva e Regolamento comunitari non abbia colto l'opportunità di positivizzare tale principio, restando insensibile alla proposta originaria formulata dallo Studio del Max Planck Institut diMonaco di Baviera di inserire un riconoscimento espresso del suo operare all'interno del giudizio di registrazione. Conclusa la prima parte del lavoro dedicata alle interazioni tra il principio di disponibilità dei segni distintivi e la registrazione di marchio, nel capitolo V si entrerà nel terreno meno battuto dei riflessi che lo stesso principio dispiega nei confronti del giudizio di contraffazione. Dopo aver analizzato i diversi meccanismi previsti dal legislatore al fine di salvaguardare il pubblico dominio costituito dalle libere utilizzazioni di un segno registrato, si darà conto della loro scarsa capacità escludente e delle conseguenti minacce che la tutela assoluta prevista per i casi di contraffazione per doppia identità e quella aggravata del marchio che gode di rinomanza pongono alla salvaguardia dello spazio di pubblico dominio, specialmente con riguardo ai numerosi casi in cui il marchio altrui è utilizzato per scopi "atipici", ovvero non chiaramente distintivi dell'attività imprenditoriale e dei beni o servizi dell'avente diritto. Con riferimento ad essi, l'interprete ha l'arduo compito di capire, di volta in volta, se sia maggiormente meritevole di tutela il titolare di marchio nel suo interesse di escludere i terzi dall'utilizzo del proprio segno, o i terzi stessi nell'interesse antagonista di fare uso del segno per finalità descrittive, espressive, decorative ecc. La giurisprudenza non ha offerto alcuna interpretazione univoca di questo bilanciamento, stentando a tracciare lo spartiacque tra usi leciti ed illeciti del marchio altrui. Molti di questi casi sono allora stati risolti dalla giurisprudenza ricorrendo, per sancirne la liceità, ad un principio di "necessità dell'uso" che porta nel giudizio di contraffazione gli stessi interessi di libera disponibilità presenti in sede di registrazione. Anche all'interno del giudizio di contraffazione, tuttavia, tale interesse resta sostanzialmente un oggetto misterioso per la Corte di Giustizia, che resta ancorata alla contraddizione che vede tale interesse confinato ad operare come principio interpretativo generale della normativa, privo però di qualsiasi implicazione concreta ed effettiva nel giudizio di registrazione e di contraffazione. In conclusione si suggerisce la necessità di sciogliere questo paradosso e si individua nella proposta del Max Planck un'occasione inspiegabilmente mancata per farlo. ; Among the 45 Recommendations adopted under the WIPO Development Agenda, two indicate the preservation of public domain as a key task for firms, individuals and Member States. This study explores the notion of "public domain" in relation to trademark law, with particular reference to the challenging issue of how safeguarding it, avoiding misappropriation of signs which should remain usable by the public. Some studies have shown that legal instruments provided by trademark law to keep signs and certain forms of use free, risk not being appropriate counterbalances to prevent the misappropriation of public domain. A general exclusion from registration does not exist for many signs which are part of a communal heritage and even if a refusal for registration may be grounded on the lack of distinctiveness, this requirement may still be overcome, showing that the sign has acquired a "secondary meaning". Furthermore, a look into the registers reveals that trademark right is often used as a vehicle to extend prior patent, design or copyrights, with great public domain's concerns. At last, the space of public domain is endangered by the expanded protection of new types of marks and by the anti-dilution enhanced protection, which gave the registered trademark's owner more general control over his sign, making it unavailable for socially and culturally valuable use, such as news reporting, criticism, review and parody. German case law was the first to address the issue of the safeguard of this room for free signs and uses, suggesting that trademark registration should be subject to a prior assessment of the opportunity that a sign remain public available (Freihaltebedürfnis). This interest raises from the observation of the negative impact that granting rights to certain types of trademark may have on market competition and led most countries to refrain from recognising trademark rights to descriptive and generic signs and functional shapes. Otherwise, by choosing these signs, right holders may acquire strategic competitive advantages on competitors whose marketing strategies and communication, deprived of the opportunity to use them, would result much less effective than that allowed to the trademark's holder. This advantage has nothing to do with the essential function to guarantee the trade mark as an indication of origin and is therefore not justified in the light of the objectives underlying trade mark law. The ECJ, requested to preliminary ruling on whether this "need to keep free" should play any role in the European trademark law, answered contradictorily. Notwithstanding, courts still rely on public policy concerns in order to preclude or limit the trademark protection, such as the "color depletion" and the "functionality" doctrine used by U.S. Courts for granting protection to color or shape marks. This work suggests that public interest should still play a role as a key-factor in order to assess the distinctive character relevant both in registration and infringement proceedings and shares the view that wording should be added in the Trademark Directive and Regulation, that the assessment of distinctive character should take into account the "right to keep free". This proposal becomes particularly actual in the light of the works in progress for reforming the European trademark legislation, which appear to have ignored the problem of striking the proper balance between trademark right and public domain.

Coloro i quali, per qualsiasi motivo, si sentono a disagio nell'usare la loro manualità, possono trovare un'apparente via di uscita nell'uso dei software. Tuttavia, questo trend rinforza la perdita di manualità impedendo alle persone di costruire un loro personale linguaggio artistico. L'aiuto delle macchine nella produzione artistica incontra un'esigenza di mercato, consolidando l'idea fittizia che la creatività umana possa essere espressa attraverso processi standardizzati. Certamente, ciò è funzionale all'interesse del mercato. Per esempio, uno dei software più usati in ambito artistico progettuale è il CAD (Computer-aided design). Il nome del software immediatamente svela la relazione asimmetrica con l'utente. In molti casi, software come il CAD possono interagire direttamente con altre macchine complesse (ossia macchine a controllo numerico) per intraprendere attività di larga scala ed estrema precisione. È una via possibile che però delimita l'identità del compositore, piegandolo a una narrazione semplificata, mentre invece il cammino creativo di un artista è un complesso caleidoscopio. Per Caterina di Bruno Maderna è un breve brano per violino e pianoforte composto nel 1963, il cui esito, pur ponendosi in rottura rispetto ad altre sue opere e agli stilemi stilistici degli anni '50 e '60, si colloca con naturalezza nell'arco creativo dell'autore. Il flauto e l'oboe sono "gli" strumenti della mitologia classica, e il loro suono particolare rimanda immediatamente alla Grecia antica, alla civiltà che il popolo greco ha creato e al culto della bellezza che ne è scaturito, influenzando il corso della storia dell'Occidente. Maderna guarda, attraverso il suono di questi strumenti, a questo mondo – oggi perduto – con il preciso desiderio di riproporre utopicamente, in una modernità segnata dalla violenza delle macchine e nel contesto di una società disumanizzata, un ideale superiore ma irraggiungibile di armonia. It is a possible way but that can restrict the identity of the composer, bending it to a simplified narrative whereas the creative journey of an artist is a complex kaleidoscope. Per Caterina by Bruno Maderna is a short piece for violin and piano composed in 1963, and despite being in contrast with his other works and stylistic styles of the '50s and '60s, it is naturally placed in the creative arc of the author. It is an emblematic piece of his way of experiencing music as a unitary event, without stylistic fences and categorizations. Rhetoric is for Maderna a means and not an aesthetic and music is a complex experience that mixes sound with the perception, the motor and the emotional. Identity, Song, Ancient, Modernity, Freedom Tommaso Rossi Conservatorio Statale di Musica di Benevento "Nicola Sala" info@tommasorossi.it Una grande Aulodìa The Flute and the Oboe in Bruno Maderna's "Arcaic Melody" In Bruno Maderna's varied and copious musical production, the choice to devote particular attention to the flute and the oboe – the two highest pitched members of the "woodwind" family – seems to go beyond the composer's understandable interest in the timbre investigation of two fascinating instruments, but it is linked to deeper reasons, which reside in fundamental aspects of the composer's musical poetics. The flute and the oboe are "the" instruments of classical mythology. Their particular sound immediately recalls ancient Greece, the civilization that the Greeks founded, with its inherent cult of beauty, which influenced the whole history of Western civilization. Through the sound of these instruments, Maderna looks at this world – now lost – with the precise desire to re-propose utopically–in a modernity marked by the violence of machines and in the context of a dehumanized society–a superior but unattainable ideal of harmony. Through the analysis of many of his works, which feature the flute and the oboe, the author reconstructs some aspects of Maderna's aesthetics. RIASSUNTO TESI Il concetto della performance, della sua misurazione, gestione e controllo, accanto a quelli di efficienza, trasparenza, accountability e responsabilità, rappresentano gli elementi fondanti la dottrina del New Public Management e in quanto tali sono stato oggetto di studi accademici e analisi da parte dei professionisti del settore pubblico. La crisi economica dei primi anni '90, le sue implicazioni e le conseguenti tensioni politiche hanno aumentato l'interesse dei governi e parlamenti italiani, che si sono susseguiti, sulle problematiche dell'aumento incontrollato della spesa e del debito pubblico. La conseguenza immediata di questa nuova attenzione, anche per le nuove esigenze di bilancio derivanti dal processo di adesione all'Unione Europea, è stata un incremento della produzione legislativa. In questo contesto gli interventi legislativi, a partire in primo luogo dalla legge n. 142 del 1990, hanno avuto tutti il medesimo filo conduttore, ovvero l'obiettivo di realizzare in concreto il disegno costituzionale di articolazione del governo centrale nei suoi livelli territoriali, quali Comuni, Province e Regioni (queste ultime previste successivamente nel 1970, operative con il d.P.R. n 616/77). I governi e i parlamenti hanno incentrato la loro azione legislativa su interventi finalizzati a favorire il decentramento amministrativo e l'autonomia locale, dapprima solo statutaria e regolamentare, poi anche impositiva, finanziaria e gestionale. L'attenzione nei confronti della programmazione dell'attività amministrativa locale, e successivamente anche sulle prestazioni pubbliche, è aumentato contestualmente al crescere delle esigenze informative dei cittadini sulle modalità di utilizzo delle scarse risorse pubbliche (derivanti in grande parte dal gettito fiscale), al fine di poter garantire i servizi essenziali alla collettività. Gli organi di indirizzo politico – amministrativo orientano la gestione tramite il complesso di decisioni ed azioni organizzative che seguono le linee di indirizzo generali (D.Lgs 165/2001), la definizione di piani, programmi e direttive generali. L'oggetto della Legge n. 150 del 2009 (c.d. riforma Brunetta) è la performance della pubblica amministrazione, la performance organizzativa ed individuale dei dipendenti pubblici. Quest'ultima in particolare è un tema sensibile nel dibattito pubblico, spesso con un'accezione negativa nell'opinione pubblica. A seguito dei più recenti interventi in materia di armonizzazione contabile, si è ritenuto fosse necessario e interessante avviare una riflessione sul complessivo sistema di programmazione e controllo della performance negli enti locali allo scopo di sviluppare un modello della performance integrato. In questo senso, la presente tesi di dottorato si è concentrata sugli strumenti a disposizione degli enti locali italiani per la programmazione, la misurazione e la gestione della performance, partendo dai primi dettati legislativi in materia di programmazione e controllo, analizzando successivamente quanto introdotto dal D.Lgs 150/09 e più recentemente dal D.Lgs 118/2011, al fine di giungere allo sviluppo di uno strumento che rispondesse alle principali esigenze informative in materia di performance della PA locale. A questo scopo, inizialmente è stata effettuata un'analisi della letteratura, il più completa possibile, sul concetto della performance e della sua misurazione, sottolineando i benefici e gli effetti inaspettati delle misure di performance, i limiti e la differenze esistenti tra misurazione e gestione della performance. La trattazione successivamente si concentrerà sull'illustrazione dei concetti di indicatori e misure di performance, dal punto di vista delle caratteristiche e differente principali, oltre che dell'utilità, dei possibili usi ed utilizzatori dell'informazione di performance (ad esempio: decision-makers, politici e cittadini). L'analisi del background teorico sarà finalizzata alla descrizione del complessivo contesto del tema della performance tramite i) il contesto internazionale del settore pubblico e ii) le dinamiche della performance delle pubbliche amministrazione. Il contesto specifico di rifermento è quello degli enti locali italiani, 1) descritto nei suoi aspetti normativi e dottrinali in termini di programmazione, performance, pianificazione e gestione della performance nonché di armonizzazione contabile e di controllo, con particolare riferimento ai controlli interni, e 2) analizzato con riferimento a principi, criteri, obiettivi e strumenti pluriennali ed annuali che ogni ente è tenuto e può utilizzare per poter al meglio pianificare, programmazione e controllare le proprie prestazioni di breve, medio e lungo termine. Una volta delineato il background teorico si procederà alla descrizione di un'ipotesi di piano integrato della performance, sotto il punto di vista del processo di sviluppo e degli strumenti, con l'evidenziazione di punti di forza, possibili benefici, ma anche dei limiti e delle questioni non affrontate o che rimangono senza una risposta efficace. A titolo di approfondimento verrà presentato un caso di studio per evidenziare come un sistema integrato di performance possa essere considerato un sistema di governance amministrativa. La definizione del modello è stato guidata da due principi guida: i) semplificazione del contesto e ii) riduzione della complessità degli strumenti. Il tutto, in una prospettiva di possibile futura applicazione pratica all'interno degli enti locali italiani di piccole dimensioni. Tali enti sono caratterizzati da strutture organizzative con un minor grado di complessità, minori risorse economiche, finanziarie, strumentali ed umane, rispetto ad enti di maggiori dimensioni. Per queste ragioni, questi enti rappresentano un miglior contesto in cui adottare uno strumento di pianificazione e programmazione semplice e chiaro che possa aggiungersi agli altri adempimenti previsti per legge, senza appesantire troppo la gestione amministrativa. Se da un lato il modello proposto ha il vantaggio di riunire in un unico documento gli elementi di pianificazione e programmazione della performance strategica con collegamenti chiari e diretti ai documenti di programmazione pluriennali dell'intera attività amministrativa degli enti (DUP) e a quelli di gestione amministrativa e di bilancio (PEG), dall'altro potrebbe incorrere nel rischio di recepimento dello stesso come mero elemento formale, senza un'utilità sostanziale. Lo strumento ipotizzato permette, da un lato, di rispondere a quanto previsto dalla riforma del 2009 e con i dettati derivanti dal processo di armonizzazione contabile, ma, dall'altro, potrebbe contribuire a creare confusione, soprattutto all'interno di quegli enti locali con competenze limitate e risorse inadeguate all'utilizzo di strumenti innovativi per la gestione strategica e dell'intero ciclo di programmazione e controllo A questi punti possono e devono essere aggiunte riflessioni in merito alle modalità di trasmissione, gestione e comunicazione dell'informazione di performance oltre che di conciliazione e sintesi con i processi di decentramento amministrativo, di sviluppo ed affermazione dell'autonomia locale, nel nuovo quadro dei vincoli finanziaria, economici ed istituzionali nazionali e comunitari. THESIS SUMMARY Performance, performance measurement, management and control, alongside the concepts of efficiency, transparency, accountability and responsibility are considered the basis of New Public Management by both scholars and practioners of public sector. The economic crisis at the beginning of the 90's, its implications and political tensions have increased the concern of Italian governments and parliaments (over the years) on uncontrolled growth of public expenses and public debt. An increasing legislative provision on local government dynamics and principles was a consequence of this concerning, amplifying also by the new European Union's budget procedures and needs. The State organization in different levels of government as stated by the constitutional prevision was the focus of main legislative measures (starting form the law no. 142/1990) . In particular Italian local governments are articled in three different levels: Municipality, Provinces and Regions (last are stated in 1970 but became operating with the republican president decree no. 616/77). Moreover governments and parliaments focused their attention on the promotion of administrative decentralization and local statutory, regulative, fiscal, financial and management autonomy. The focus on local government planning activity and performance increased as well as the attention on citizens' informative needs about the use of scarce public resources in order to guarantee the public services. Decisions and actions of the political and administrative bodies followed the general guidelines (legislative decree 165/2001), plans and programs. The object of the Law no. 150 of 2009 (Brunetta Law) is public administration performance, organizational and individual performance of public employees. The public performance is often a sensitive issue in the public debate and generates negative point of views. The last regulation on accounting harmonization generates i) a rethinking process about the overall local governments performance programming and control systems ii) to develop an integrated system to satisfy informative needs on local public administration performance. The present PhD thesis's focused on Italian local governments tools and procedures to i) program, ii) measure and iii) manage the performance by the analysis of the legislative provisions until the last legislative decree 150/09 and the legislative decree 118/2011. First, a full literature review about performance meanings and performance measurement has been carried out. This work highlighted the benefits and the unexpected effects of the performance measures, their limitations and the existing differences between performance measurement and management. Then, concepts of indicators and performance measures are introduced, their principal features and differences, utility and possible uses and the users of performance information (e.g. decision makers, politicians, citizens). The presentation of the theoretical background will be aimed to describe the overall context of performance issue through, i) the international context of public sector and ii) the local public administration performance dynamics. The specific context of this dissertation will be the Italian local government focusing on 1) the description of legislation and doctrine for the programming, planning and management of performance, as well as the accounting harmonization and internal controls and 2) the analysis of local governments' principles, criteria, aims and tools for long and short term performance planning, programming and controls. The next section will be dedicated to describe an hypothesis of integrated performance plan, its development process and tools, its strengths and weaknesses, and the non-addressed and unresolved issues. Further a case study is presented in order to highlight how an integrated performance system can be considered as an administrative governance system. The overall analysis is guided by two principles: i) context simplification and ii) tools' complexity reduction. The future perspective of its practical application is represented by small local governments, characterized by lower complexity and economic, financial, instrumental and human resources than larger ones. For these reasons small governments are better context to apply a new simple tool in addition to the traditional legislative fulfillments without increasing the administrative complexity. Elements of performance planning and programming and their connections with the others multiannual programming, budgeting and management documents (Single Programming Document: DUP, Executive Management Plan: PEG) are included in one single document. However, this system can be seen as another mere formality, without substantial benefits. It meets the aims of the 2009 reform and the principles of the accounting harmonization but it can also create confusion, in particular for local governments with limited skills and inadequate resources to use innovative tools of strategic governance, programming and control. Finally, it will be presented a reflection about systems of performance information transmission, management and communication and the settlement between decentralization processes, development and statement of local autonomy, national and European economic-financial constraints.
Dottorato di ricerca in Storia d'Europa: Società, politica e istituzioni(XIX-XX Secolo) ; Una curiosa espressione di Jacques Delors, più volte utilizzata nel corso della sua carriera, definì le istituzioni comunitarie come un "O.P.N.I., oggetto politico non identificato". L'affermazione di Delors appare come un compromesso tra l'interesse a tutela dei diritti degli Stati e la necessità di attribuire al processo di integrazione europea istituzioni stabili e soprattutto autonome. In realtà, i caratteri di profonda instabilità mostrati dal modello di Comunità ne fecero scaturire due orientamenti interpretativi differenti. Il primo considerò il raggiungimento dell'obiettivo prefissato nella realizzazione di una unione politica; come sostiene Riccardo Perissich, "Ai limitati trasferimenti di sovranità già decisi, altri ne sarebbero seguiti, anche se sempre in modo graduale. Coerentemente con questo approccio, le istituzioni avrebbero dovuto evolvere verso un modello classico. La Commissione si sarebbe trasformata in un esecutivo federale; il Consiglio dei ministri in un "Senato degli Stati"; l'Assemblea parlamentare in un vero Parlamento federale"1. Il secondo orientamento si basò sull'idea che il principio di sovranità non potesse essere frammentato e che il conferimento di potere previsto dai Trattati fosse più di carattere tecnico che politico. Questa seconda interpretazione aumentò i dubbi e la diffidenza nei confronti della Commissione e ancor più del Parlamento. C'è da dire inoltre, che gli Stati firmatari dei Trattati si riconobbero più nella prima lettura del modello, con un necessario distinguo per la Francia che, all'epoca dell'entrata in vigore era presieduta dal generale Charles De Gaulle, fortemente contrario, come noto, all'idea di una qualsiasi minima cessione di potere a livello sovranazionale. A seguito della fusione di CECA, CEE ed EURATOM una sola Commissione unificò l'apparato amministrativo mentre al Parlamento europeo venne assegnato unicamente il compito di esercitare il potere in materia di bilancio, oltre ad una funzione meramente consultiva; l'elezione diretta del Parlamento fu contemplata nell'articolo n.138 del Trattato istitutivo della Comunità europea nel quale, oltre ad essere indicato il sistema di elezione dei parlamentari europei delegati come provvisorio, 1R. Perissich, L'Unione Europea una storia non ufficiale, Milano, Longanesi, 2008, p.54. venne previsto che il Parlamento avrebbe elaborato progetti volti alla realizzazione di una procedura di elezione uniforme per tutti gli Stati membri. Di fatto, negli anni che intercorsero tra il 1951 e il 1976, furono presentate numerose proposte orientate all'istituzione della procedura di elezione a suffragio universale diretto che, dopo molte difficoltà, trovarono soltanto nel 1979 la loro attuazione; questo risultato rappresentò l'inizio di una nuova era in cui l'importanza della comunicazione politico-istituzionale giocò un ruolo fondamentale per creare il necessario contatto con i cittadini, in previsione della loro partecipazione al voto europeo. Ricordiamo come nel 1974, al vertice francese presieduto da Valéry Giscard D'Estaing, venne adottata la decisione di istituire il Consiglio europeo e l'elezione diretta del Parlamento. L'evento avrebbe esercitato una notevole influenza nella dinamica istituzionale europea; nonostante il suo assetto di Assemblea diversa da quelle nazionali, il Parlamento europeo direttamente eletto avrebbe preteso un aumento della propria influenza politica così come del proprio peso istituzionale. Attraverso le elezioni, i cittadini europei avrebbero potuto accrescere progressivamente il loro interesse nei confronti dei temi comunitari riuscendo a percepire meglio l'esistenza di un'istituzione fino ad allora poco conosciuta. Su questo aspetto federalisti e "gradualisti" si collocarono su posizioni discordanti, in quanto i primi da sempre consideravano il Parlamento eletto come "Congresso del popolo europeo" e quindi come il potere costituente della futura Federazione europea. Personalità di spicco sui singoli piani nazionali, costantemente impegnate nella causa dell'integrazione europea (solo per citare alcuni nomi si ricordano Altiero Spinelli, Simone Veil, Helmut Kohl, Jacques Chirac), oltre ad esponenti politici ed intellettuali che interpretarono un ruolo di forte influenza all'interno dei loro partiti riguardo alla scelta europeista (per l'Italia ricordiamo Giorgio Amendola, Enrico Berlinguer, Mauro Ferri, Gaetano Arfè), si impegnarono con l'intento di legittimarne il ruolo rispetto alle altre istituzioni, in particolar modo la Commissione. I parlamentari eletti nel primo suffragio universale diretto si trovarono quindi ad affrontare temi che andavano dalla questione dei paesi comunisti ai rapporti con il Terzo mondo, alla progettazione di una televisione europea fino alla necessità di redigere una prima bozza di Costituzione europea. Il ricorso alle candidature di personalità politiche ben note all'opinione pubblica quali Enrico Berlinguer, Simone Veil, Willy Brandt, si pensò potesse offrire un maggiore potenziale all'organizzazione della propaganda. La campagna elettorale del giugno 1979, così come le altre due successive, fu tuttavia caratterizzata, soprattutto in Italia e Francia, da argomenti troppo spesso collegati alla dialettica politica della propria nazione. In ogni caso l'informazione data ai cittadini europei fu in grado di suscitare un inevitabile interessamento ai problemi comunitari, ma soprattutto alla realtà sovranazionale. L'affluenza al voto fu comunque inferiore rispetto alle elezioni nazionali. Nei motivi della scarsa partecipazione al voto, oltre l'assenza di dibattito propriamente europeo vi fu anche il fatto che le strategie dei partiti tesero ad una sorta di strumentalizzazione delle elezioni europee, puntando attraverso le campagne elettorali al perseguimento di obiettivi nazionali. Il primo scrutinio diretto fu in grado comunque di dare una ventata di novità al concetto di democrazia europea. La nuova legittimità consentì al Parlamento di consolidare nel tempo i propri poteri e di interpretare un ruolo all'interno del processo decisionale comunitario che all'epoca poteva dirsi quanto meno "nebuloso". Una volta fissato il periodo di svolgimento delle prime elezioni, le forze politiche nazionali dovettero sostenere una sfida che le avrebbe costrette a rimettersi in gioco, cercando di rinnovare gli argomenti e i temi individuati per le campagne elettorali nazionali. Una maggiore consapevolezza riguardo alla necessità di allargare l'orizzonte, senza trascurare tuttavia il contatto con i propri elettori e cercando le possibili somiglianze con gli altri partiti europei, avrebbe consentito di conciliare la propria ideologia in un contesto più ampio. Occorre tener presente come tra il 1975 e il 1979 si fossero create all'interno dell'Assemblea parlamentare non eletta, formazioni politiche rappresentative di partiti accomunati da un orientamento affine a quello nazionale. La diversità di ideologie, tuttavia rendeva queste coalizioni molto deboli, soprattutto per via della tanto difficile integrazione ostacolata dalla predominanza degli interessi nazionali anteposti a quelli comunitari. La primazia dei partiti nazionali ha sempre costituito un ostacolo all'autonomia di azione dei gruppi e delle federazioni lasciando, fino ad oggi, inattuata la costituzione di veri e propri partiti europei. All'indomani del primo suffragio universale diretto, tuttavia, il nuovo parlamentare europeo avrebbe assunto il ruolo di trait d'union tra il proprio elettorato, il proprio partito, la coalizione europea e il Parlamento stesso. I tratti caratterizzanti il percorso politico-istituzionale del Parlamento europeo sono stati oggetto di approfondimento nello studio dei casi relativi ai tre Paesi considerati rivelando le differenze che, per la natura stessa del ruolo giocato nel contesto sovranazionale, non hanno risparmiato il processo di integrazione e, nel caso specifico, la partecipazione alle elezioni dirette del Parlamento. Accomunando Italia e Francia, paesi fondatori della Comunità europea che si dimostrarono troppo intenti a trattare temi nazionali durante le campagne elettorali, nel Regno Unito l'idea di Europa si coniugò con la costante valutazione di tutti gli elementi che sarebbero risultati convenienti per partecipare, senza che tutto ciò costringesse a modificare o rinunciare a quanto già in possesso, atteggiamento che trovò nella linea di governo di Margaret Thatcher una perfetta interpretazione durata per l'intero decennio esaminato. Se per il primo suffragio universale diretto l'attività maggiore fu quella di approntare nuovi metodi organizzativi per le campagne elettorali, adatti alla ricerca di un consenso più ampio, diretto a legittimare l'istituzione sovranazionale, nella seconda e terza tornata le riflessioni delle forze politiche si resero necessarie per cercare di individuare le cause del progressivo calo partecipativo. I difetti di una comunicazione politica spesso basata su issues nazionali, soprattutto riguardo la Francia, ha di sicuro rappresentato una delle possibili cause, ma l'atteggiamento stesso dei partiti, apparso frequentemente poco incline a credere seriamente nell'importanza delle elezioni, ha lasciato percepire incertezza ai cittadini europei. Per altro verso, anche le campagne elettorali comunitarie, sebbene abbiano investito molte risorse per cercare di catturare il consenso dell'opinione pubblica, hanno mostrato la parziale efficienza dei mezzi messi in atto. Elezioni di second'ordine quindi? E' possibile parlarne ancora in questi termini? Da quanto emerso nel corso della ricerca condotta sul versante storico-politologico, il livello delle elezioni europee non risulta affatto secondario. Il dato partecipativo, anzi è inversamente proporzionale alla quantità di lavoro preparatorio sia dal punto di vista politico che amministravo-istituzionale, ben superiore a qualsiasi suffragio nazionale. Ci si chiede allora perché gli elettori non abbiano risposto con altrettanto entusiasmo. Qui le risposte trovano differenti possibilità da tenere nella giusta considerazione: la poca attenzione ai temi comunitari, la qualità della comunicazione, l'errore di propagandare l'evento troppo a ridosso delle date di svolgimento, l'eccessiva distanza tra istituzioni e cittadini, il livello culturale degli elettori, i giorni della settimana individuati per i suffragi spesso troppo vicini ad elezioni nazionali appena svolte, la classe politica poco convinta. In realtà tutti questi fattori rappresentano concause della scarsa partecipazione. Il cittadino europeo in mezzo a questo guazzabuglio è il personaggio principale di una performance in cui lui stesso determina la riuscita. Nonostante i numeri evidenzino una progressiva flessione nei dieci anni esaminati, i cittadini non sono rimasti indifferenti di fronte alle novità introdotte dal processo di integrazione europea. Spesso, soprattutto durante i sondaggi, accanto ad una percentuale di "indifferenti" o "euroscettici", molti intervistati hanno lamentato la poca autorità del Parlamento europeo nel contesto istituzionale comunitario2 confidando in ulteriori progressi strutturali. Il mancato raggiungimento di questo obiettivo, preannunciato già prima del 1979, insieme alle vicende politiche legate al proprio Paese, ha gradualmente provocato negli elettori reazioni di protesta attraverso il non voto o il voto negativo3, comportamenti capaci di delineare una partecipazione differente rispetto alla decisione di esprimere la propria scelta. Questo tipo di elettore ha mostrato di essere stato raggiunto dall'informazione diffusa durante le campagne elettorali e, sulla base di quanto appreso, ha deciso consapevolmente di non votare o di esercitare un voto diverso annullando o votando scheda bianca; quindi si è recato ai seggi, 2 Si vedano a questo proposito i risultati emersi nella pubblicazione della Commissione delle Comunità europee, Eurobarometro – L'opinione pubblica nella Comunità europea, Vol.1, 32/89, Direzione generale Informazione, comunicazione e cultura, Bruxelles, 1989. 3 Cfr. Votare tutti e tutto assieme fa bene alla democrazia?, cit. non è rimasto inerte disinteressandosi di quanto stava accadendo. L'auspicio di un consolidamento istituzionale del Parlamento e di una maggiore coesione politica della Comunità europea non ancora raggiunti, anche per responsabilità delle politiche nazionali, ha posto l'elettore in condizione di negare il proprio contributo o protestare verso il mancato conseguimento dei risultati. L'accrescimento della conoscenza e del coinvolgimento, sebbene presenti, non sono andati di pari passo con la partecipazione. Elementi di insoddisfazione hanno caratterizzato il comportamento dell'elettore realmente europeista. I cittadini europei possono in realtà collocarsi in tre macro aree nelle quali si ritrovano gli europeisti, gli euro avversi e gli euroscettici. Se le aspettative degli europeisti sono rimaste deluse, gli euroavversi hanno parzialmente esercitato il diritto di voto alimentando quelle liste comunque presenti nella competizione europea. Gli euroscettici, invece hanno rappresentato il punto nevralgico dell'elettorato. Trovandosi in quella parte di popolazione attenta ad osservare quali e quanti cambiamenti sarebbero avvenuti a partire dal 1979 hanno avuto modo di consolidare la loro posizione continuando a percepire la Comunità ancora lontana e prevalentemente scomoda se non inutile. A differenza dell'europeista deluso che comunque ha continuato a partecipare, magari protestando, e dell'euroavverso che ha espresso il suo disappunto preferendo i partiti antieuropeisti, l'euroscettico ha proseguito nell'osservazione, affiancandosi agli incerti che sono rimasti a casa. A questo punto sono apparse inevitabili ulteriori valutazioni verso quegli elementi che caratterizzano le elezioni in genere. Ciò che attrae il cittadino ai seggi elettorali è prevalentemente il peso che le elezioni possono esercitare sui cambiamenti del governo nel proprio Paese. Il "less at stake" delle elezioni europee ha rappresentato sicuramente uno dei motivi scatenanti i sentimenti appena descritti; lo scenario si profila diverso, In such 'marker-setting' elections, voters have an incentive to behave tactically, but in a sense of the word 'tactical' that is quite different from what we see in National elections, where large parties are advantaged by their size. In a markersetting election the tactical situation is instead characterized by an apparent lack of consequences for the allocation of power, on the one hand, and by the attentiveness of politicians and media, on the other4. La mancanza di conseguenze sul livello nazionale garantita dalle elezioni europee ha "alleggerito" l'elettore della responsabilità di orientare con la propria scelta il corso della politica nazionale. Sebbene nel 1979 vi fu un'attività partitica a livello transnazionale, consentita anche dalla disponibilità di fondi in quel periodo, l'attenzione dell'elettorato fu minima. In termini di risultati transnazionali la percezione fu praticamente irrilevante; circa il cinquanta per cento dei votanti ammise di non aver idea di quali gruppi avessero ottenuto maggiori consensi. Altro aspetto da non sottovalutare si collega allo sproporzionato successo ottenuto dai partiti più piccoli rispetto ai grandi; è in questo caso che si può parlare di voto punitivo nei confronti della politica del governo nazionale. Molte le sfaccettature e tutte fondamentali per riuscire a capire il perché delle differenze comportamentali dell'elettorato, differenze che nei tre Paesi oggetto di studio si sono rivelate estremamente rappresentate. In linea con la tradizione, gli elettori dell'Italia e della Francia hanno mostrato una partecipazione considerevole, evidentemente legata alle vicende che hanno caratterizzato il dibattito politico nazionale negli anni 1979 – 1989. Il voto "pseudo-obbligatorio" dell'Italia ha mantenuto alta la percentuale dei votanti, ma i risultati hanno mostrato orientamenti variabili nelle tre tornate esaminate. Il caso francese ha mostrato una escalation della destra attraverso i consensi ottenuti dal Front National in risposta ad un importante declino del Partito comunista, anche in considerazione di una progressiva dispersione di voti dovuta alla presenza di numerose liste, in particolar modo nel 1989. Il caso anglosassone si colloca in una posizione particolare rispetto agli altri due Paesi, ma sarebbe più giusto dire rispetto a tutti gli altri. A fronte di un orientamento nazionale tendenzialmente contrario alla Comunità europea, fra le ideologie maggiormente rappresentative si è distinto un Partito conservatore desideroso di giocare un ruolo importante nel contesto europeo, consapevole quindi del significato che la competizione europea 4 C. L'importanza del suffragio sovranazionale non fu invece immediatamente compresa dai Laburisti, che di fatto ottennero una pesante sconfitta nel corso del primo appuntamento con lo scrutinio europeo, ravvedendosi in seguito e riuscendo a superare i Conservatori anche grazie all'inizio del declino del governo Thatcher. Un elemento che ha accomunato tutti i Paesi della Comunità è stato rappresentato dalla progressiva affermazione dei Verdi. Lo studio effettuato attraverso una costante attenzione al dibattito politico di ciascun Paese, insieme alle strategie attuate dagli attori, consapevoli fin dall'inizio che la sfida europea li avrebbe impegnati non più o meno di quella nazionale, ma sicuramente in modo diverso, ha condotto ad un approfondimento verso il singolo cittadino che assumendo in sé il ruolo di attore principale ne ha determinato gli esiti. Le risultanze dei dati emersi dalle consultazioni avvenute negli anni 1979 – 1989 non possono considerarsi soltanto per il puro dato numerico. La molteplicità dei fattori che hanno influito sulla scelta di votare o meno ha mostrato un elettore che, pur appartenendo a paesi diversi e con differenti livelli culturali, è stato in grado di decidere basandosi su considerazioni affatto superficiali, operando un'attenta scelta dei numerosi elementi che avrebbero potuto favorire il rafforzamento politico-istituzionale europeo: una tacita selezione dell'elettorato, che inevitabilmente ha lasciato fuori tutti coloro che non hanno ritenuto importante impegnarsi per una consultazione ritenuta priva di un qualsiasi tornaconto. Classe politica poco convinta, informazione discutibile, scarsa conoscenza da parte dei cittadini riguardo al ruolo del Parlamento europeo, inefficacia della comunicazione, hanno contribuito a costruire un elettore diverso dal solito, più attento, in possesso di maggiore senso critico nei confronti di uno scenario nuovo e molto più complesso rispetto a quello nazionale5. Dalla pluralità di elementi emersi durante la ricerca attraverso il ricorso all'interdisciplinarietà per cercare di comprenderne maggiormente i significati, sono emersi dettagli che hanno stimolato ad ulteriori approfondimenti. 5 Cfr. Successivamente alle considerazioni storico – politiche , ciò che si è voluto sottolineare, attraverso l'analisi sociologica, riguardo alle elezioni europee nel loro complesso e nella loro perpetua considerazione di elezioni secondarie, è che tutti i fattori esaminati ne mostrano un'immagine differente, che non vuole assolutamente porsi in contrasto con l'interpretazione dei dati puri, ma vuole indurre a considerare maggiormente i numerosi fattori, che per la qualità e la quantità riscontrata permettono di ottenere un quadro più completo dei fatti, andando oltre al mero dato partecipativo sul quale, indubbiamente, la differenza con la partecipazione nazionale è di tutta evidenza. L'esame approfondito è apparso ancor più necessario alla luce del tortuoso processo di costruzione europea e del macchinoso assetto istituzionale comunitario, al fine di poter tenere nella giusta considerazione il maggior numero di elementi possibile, non tanto per giustificare i risultati, ma quanto, piuttosto, per riflettere su di essi cercando di distribuire una responsabilità policentrica a partire dalle forze politiche per finire al cittadino stesso. ; Jacques Delors used to talk about European institutions as an O.P.N.I Object Politique Non Identifié. His opinion appears a compromise between his interest to protect National rights and the need to give lasting and autonomous governance to the European integration process. Actually from the European Community model, two different ways of thinking the governance derived both influenced by the instability of the model itself. The first one aimed at a political union; as Riccardo Perissich says: "Ai limitati trasferimenti di sovranità già decisi, altri ne sarebbero seguiti, anche se sempre in modo graduale. Coerentemente con questo approccio, le istituzioni avrebbero dovuto evolvere verso un modello classico. La Commissione si sarebbe trasformata in un esecutivo federale; il Consiglio dei ministri in un "Senato degli Stati"; l'Assemblea parlamentare in un vero Parlamento federale"6. The second one tried not to neglect the sovereignty principle by transferring technical and political power according to the Treaties. This second view increased doubts and mistrust towards the European Parliament and Commission as well. European Member States agreed above all with the first view, except for the France of Charles De Gaulle who was still convinced of his idea of not giving power to supranational level. Following the unification between ECSC, EEC and EAEC there was a single Commission for the whole administrative system while the Parliament had competence on the European budget; direct election to European Parliament was referred to as "temporary" in Article 138 of the European Community Treaty; then the Parliament would plan the way for a single procedure election regarding all Member States. Between 1951 and 1976 there were many proposals to define a direct universal suffrage, but only in 1979 this target was achieved. This result meant a significant change also for the polical and institutional 6R. Perissich, L'Unione Europea una storia non ufficiale, Milano, Longanesi, 2008, p.54. communication that became fundamental to reach citizenship during the election campaign. In 1974, during the French summit chaired by Valéry Giscard d'Estaing, were both established the European Council and the direct election of the European Parliament. The European Parliament finally elected by European citizens would require an increase in both political and institutional influence. The direct elections would enhance popular interest in European affairs as well as raise people's awareness of the Parliament itself. This last aspect emphasized the differences between the federalist and the "gradualist" trend. The first one considered the direct elected Parliament as a "Congress of European People", that is to say the constituent power of the future European Federation. Many famous people were constantly engaged in the European integration cause as politicians and intellectuals did by committing themselves to legitimizing the role of the European Parliament in relation to other institutions, particularly the European Commission. Reference can be made to Altiero Spinelli, Enrico Berlinguer, Simone Veil, Helmut Kohl, Jacques Chirac, just to mention some of them. Members of the European Parliament (MEP's) began their job by addressing many issues such as the question of communist nations or planning for a European TV or preparing a draft for the European Constitution. Appointing political celebrities such as Enrico Berlinguer, Simone Veil, Willy Brandt was a way to make the propaganda more effective. The 1979 election campaign as well as the other two following ones was, however, characterized by arguments too often associated with the national political discourse. All the information given to European citizens succeeded in generating interest in supranational reality above all. The turnout was lower than in national elections and the reason has to be found in the behaviour of political parties in discussing mostly national issues aiming at national targets. In spite of this, the first direct election to the European Parliament gave a breath of fresh air to the meaning of European democracy. The newly acquired legitimacy gave the European Parliament the opportunity to consolidate its power by acting a definite role inside the European decisional process that was, at that time, nebulous to say the least. Once the electoral date was scheduled all the national political parties had to face a challenge that forced them to renew their themes and topics previously chosen in national campaign. There was greater awareness of the necessity to broaden the horizon without loosing contact with voters by looking for similarities in other European political parties. This is what would allow single ideologies to merge in a wider context. We must to consider that between 1975 – 1979 inside the European Parliament there were representatives of parties sharing outlooks similar to the national ones, but different ways of thinking made these coalitions too weak, above all because of the predominant national interests. The primacy of national parties has always been an obstacle to the autonomy of groups and federations, neglecting the implementation of European parties. After the first direct European elections the new MEP's were a kind of "trait d'union" with their own electorates, their own party, the European coalition and the Parliament as well. The peculiar features of the political-institutional path of the European Parliament concerning the three countries studied showed differences that have characterized their participation in European elections. While Italy and France, founding members of EC, were too busy to deal with national issues during electoral campaign, the UK was more attentive to evaluate the benefits of participation and Margaret Thatcher, who was Prime Minister from 1979 to 1990 was particularly suited for such an attitude. While during the first direct election there was a need to bring some new element in organizing the electoral campaign in order to reach a wider consensus, the following two elections made political forces more reflective about the decline in turnout. Too many national issues made the communication weak, particularly for the French campaign. What citizens perceived was the little confidence of political parties and that was the reason for such a large incertitude among the people. On the other hand, the Community campaign too showed a partial efficiency. So what kind of elections are we talking about? Still "second order" elections? This is not the picture that emerged from my research conducted on the historical and political fields. Participation is inversely proportional to the preparatory work, both from a political point of view and from an administrative-institutional one, which was far superior to any national suffrage. So, why didn't voters participate so enthusiastically? Many answers are possible because many are the causes of such an odd behaviour: little attention to European issues, quality of communication, propaganda too close to the election date, distance between citizens and istitution, the cultural level of voters, election dates too close to those of national elections, lack of confidence of the political class were all contributing factors in low participation. In the middle of this mess the European citizen becomes the protagonist for the success of such a performance. Despite numbers reveal a gradual decline in the ten years examined, European citizens have not remained indifferent to the changes introduced by the European integration process. Many surveys showed that in addition to a percentage of "indifferent" or "eurosceptical" people, there were citizens who asked for a stronger Parliament hoping that this result would be reached sooner or later. The failure to achieve this goal as well as the political events of each nation have gradually caused an outcry against the vote expressed either in nonvoting or in negative-vote; these different behaviours show a different way of participating . The voter who, though informed by the electoral campaign, decided not to vote or to give a different vote by cancelling his vote or returning blank−voting ballot, went nevertheless to the polling station and didn't stay at home ignoring what was happening. The unfullfilled hope for an institutional strengthening of the Parliament and for greater political cohesion of the European Community, due to political responsibilities, didn't allow the voter to contribute or protest against the non-achievement of results. Citizens' increased knowledge and involvement did not keep pace with the participation; some elements of dissatisfaction have characterized the behaviour of the pro-Europe voter. The three main groups in which European voters may be included are pro- Europe, anti-Europe and eurosceptics. Whereas the pro-Europe voters' expectations have been disappointed, the anti-Europe voters have partially exercised the right to vote feeding this kind of lists in the European competition. Eurosceptics, on the other hand were the centerpiece of the electorate. Being careful observers of which and how many changes have occurred since 1979, citizens have been able to consolidate their position by continuing to perceive the Community as still too distant and mostly uncomfortable if not useless. They have continued their observation by standing together with those uncertain people who stayed at home. At this point it appeared inevitable to assess also those elements that characterized the elections in general. What attracts people to the polling station is mainly the weight that elections may have on the governmental changes in their own countries. The "less at stake" of European elections surely showed one of the reasons just described. We are therefore facing a different context, In such 'marker-setting' elections, voters have an incentive to behave tactically, but in a sense of the word 'tactical' that is quite different from what we see in National elections, where large parties are advantaged by their size. In a markersetting election the tactical situation is instead characterized by an apparent lack of consequences for the allocation of power, on the one hand, and by the attentiveness of politicians and media, on the other7. The lack of consequences on the national level where European elections are concerned lightened voters by taking away their responsibility in directing the national political course. Although in 1979 there was a political activity at the transnational level, the electorate's attention was very scarce. The result showed 50% of voters admitting to their disinformation about the groups that achieved greater consensus. 7 C. Van der Eijk, M. Franklin, M. Another issue is the large success gained by smaller parties; in this case it is possible to talk about a "punishment vote" against the policy of the national government. The three cases studied showed different ways of participating. Italian and French voters showed a considerable participation according to their tradition also because in the 1979 – 1989 period there was an interesting political debate. The Italian "pseudo-compulsory" vote kept the percentage of voters high, but the outcome showed changing directions during the above mentioned period. Looking at the outcomes got by the Front National the French case showed an escalation of the Right next to to a significant decline of the Communist Party. There was also a substantial dispersion of voting because of so many rolls, particularly during the 1989 elections. The British case is a special one for the particular behaviour towards the European integration process. The Conservative Party wanted to play an important role in the European context and for this reason European elections were considered as a way to succeed in it. On the contrary the Labour Party did not immediately understand the importance of such a crucial opportunity; the outcome of the 1979 European elections was disastrous and they met an evident defeat that therefore was useful to understand many things for future elections. All three countries have seen the progressive growth of the Green Party. The present study has paid constant attention to to the political debate in each country, and to the strategies implemented by the actors, who were aware from the beginning that the European challenge would engage them in different ways. It was, moreover, focused on the individual citizen's ability to determine the election outcome. Considering the outcome through the mere numerical data gives a partial view of the whole context. There are so many aspects that influenced the decision to vote or not. There was a selection among voters that showed citizens who desired a more political union operating a political and institutional strengthening in opposition to those who did not want to engage themselves in an election without any gain. An unconvinced political class, questionable information, lack of knowledge among citizens about the role of the European Parliament have built a different voter, a more attentive one, with a greater critical sense towards a newer context different from the national one. The diverse elements which have emerged from this interdiciplinary study have led to further insights. After historical considerations, a sociological analysis has been carried out on European elections as a whole and their "second order" perception. From these considerations a new picture has emerged, which is not in absolute contrast with the interpretation of the raw data. The quality and the quantity of so many factors allow a more complete picture of the facts, going beyond the mere participation on which, undoubtedly, the difference with the national presence is quite evident. Detailed examination appeared necessary in the light of the tortuous European building process, in order to take into account as many elements as possible, not only to justify the results, but rather because, to reflect on them trying to deploy a polycentric responsibility from the political forces to the citizens themselves.
This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, theFerghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan andKyrgyzstan.A basis of the research, field trips spread over the past three years enabled the development ofinstruments such as border analysis, analytical cartography, qualitative interviews with experts andinhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent– noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to thefield trips in Central Asia, a research period in France permitted both a consolidation in geopoliticaltheory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, andadditional bibliographical research at the French National Library (BNF).The topic of the research is hence the analysis of power rivalries between "territorial actors" overthe "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the largergeopolitical context of Central Asia. Always a stake disputed by various territorial actors over time,the Fergana Valley now experiences power rivalries from contemporaneous territorial actors firstand foremost on the border and transborder levels.By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis:the cultural regionalism. The dissertation hence offers a detailed presentation of the culturalregionalism as well as an evaluation of its past and current importance.First focusing on the centrasiatic context and the peculiarities which stem from its borders, theintroduction presents the "stake" Fergana and its economic and physical resources which explainits importance as a territory. A rapid summary of the theory of geopolitics follows, with thejustification of the choice of the French Lacostian school as the theoretical frame of this work. Theintroduction closes on a first analysis of the Fergana as a space of border or frontier.First partThe thesis is structured in two main parts. The first, more theoretical, analyses each of the threeterritorial actors which aim for power over the Fergana: the Nation, the Religion, and the CulturalRegionalism. The presentation of the actors, of their respective embodiments and of theirmanifestations within the ferganian territory is organised according to a conceptual rationale; eventsthat occurred simultaneously are thus not considered following a chronological order, butseparately, according to their respective relations with the actors evoked.The first chapter focuses on the actor Nation. By this word we understand not only the effectiveentity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but alsothe Nation as an ideology which acts upon the territory through nationalistic policies. The force oflegitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in theFerganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchyin the region. This chapter also analyses the representations of the Fergana which are defined andimplemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first becamea transborder region only in these years, through its integration to the Union of the Socialist SovietRepublics (USSR) and its partition between three of the five newly created Socialist SovietRepublics in Central Asia. In the 1990s, following the fall of the USSR and the independence of thethree Republics, the borders which divided the Ferghana stopped being only internal, but becamereal and proper international borders. Among the main representations that this study looks at, aparticular attention is devoted to the study of the national borders , their creation and theirevolution. The chapter also looks at the relations between the different Nation-States, which form aunique actor when they rival against the other territorial actors – the Religion and the CulturalRegionalism –, but three well different ones when they rival among themselves.The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valleyis one of the most pious and practicing region of Central Asia, and the Islamic religion alwaysplayed a major role in the society's administration and organization.The chapter proposes first an analysis of the religion's representations in the Fergana: theautochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam ofthe soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in theFergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistanand Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it inducedbetween the soviet muslims and the afghan mujaheddins.It is then examined how the different variations of the actor opposed themselves to the actor Nation,over the years, for the control over the power and the resources of the Fergana. We look at how thegeopolitical rivalries vary dramatically from the soviet era to that of the independence. A specialattention is devoted to the phenomenon of politization of the actor Religion and the way this led theReligion to endorse a role of protagonist in many of the Fergana's events.The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of thisregional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as theFergana has existed as a place, it has always constituted a geographical, political and social whole.Although its population has been characterized during the past centuries by high levels ofmultiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation ofpopulations which always held multiethnicity as normality, and always attributed to each "group" aspecific social role within the system Fergana.Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic,these populations always shared, each in its own social role, a common life within the region. Thisvery phenomenon is the main characteristic of what we call the Cultural Regionalism of theFergana.However, this equilibrium changes with the loss of political sovereignty of the region and the rise ofnationalism under the soviet sovereignty. This chapter analyzes the main representation of the actorCultural Regionalism over time, and how it took stand against the other territorial actors, especiallythe Nation.Second partThe second part of the dissertation as dedicated to the current manifestations of the territorial actorsin the Fergana valley, particularly in its border zones. This part results from the interviews and fieldobservation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010.The first chapter analyzes the border of this region from a theoretical point of view, especially in thelight of the geostrategical categories of "first line of defence" or "last line of defence".In the context of a transformation of the border from the soviet era to that of the independence, thesecond chapter explores the definition of the centrasiatic border, mainly through the analysis ofborder bureaucracy, control posts and documents required to cross the border. The chapter looks atthemes connected to the commercial transborder relations : how the "three" Fergana still manage tointeract despite growing border rigidity, which social relationships subsist today. The qualitativeinterviews led in the Fergana are a major source in this process of reviewing the difficulties ofpassage and communication within the valley, and of tracking the actual presence of the threegeopolitical actors which play a major role in the border relations and conflicts.The third chapter focuses on the Ferganian urban centres: their history, the relations that theFerganians have with them, et above all the internal and external representations of these centres ina now fully transborder region.The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Upuntil then a land of immigration, the Fergana became a land of emigration following theindependence and the materialization of the borders.The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, andtheir relationship of reciprocal influence with the mutation of the borders in the region.The sixth chapter builds on the theoretical interrogations evoked in the introduction of thedissertation and develops a conclusive analysis of the Fergana of the borders nowadays.ConclusionThe conclusion of this research depicts the current Fergana, the relations between the differentgeopolitical actors and underscores the persistence of the actor Cultural Regionalism.It establishes the existence of tremendous changes in the region Fergana from various viewpoints:the Ferganian population has new frames of cultural, political and social reference whoseimportance increased dramatically ; new political forms and cultural structures influenced its selfimage,its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz),atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian".However, although the territory, its borders and inhabitants changed, and despite the strongobstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, byadapting to the new tendencies and ways of interpretation of the Fergana.The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 andthe Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries whichpersist in the region. ; IntroductionCette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asiecentrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, duTadjikistan et du Kirghizistan.Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers del'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts ethabitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèkeTachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). La première, à dominante théorique, analyse à tourde rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de laNation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leursdifférentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsiabordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsipas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués.Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons nonseulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan,Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers depolitiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère àl'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de lahiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations duFerghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avecson intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre troisdes cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans lesannées 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières quidivisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bieninternationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre,une attention particulière est portée aux frontières nationales, leur création et leur évolution. Lechapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent unacteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et leRégionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoireFerghana entre eux.Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée duFerghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religionislamique y a toujours eu un rôle important dans la gestion de la société.Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : lesoufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans leFerghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée parMoscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbiterécemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite del'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivieentre les musulmans soviétiques et les moudjahiddines afghans.Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sontopposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources duterritoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie dutout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien aucours de l'ère ayant succédé à l'indépendance.Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à lamanière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans denombreux évènements du Ferghana.Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence àl'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes etreligieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana atoujours constitué un ensemble géographique, politique et social à part entière. Bien que sapopulation se soit distinguée au cours des derniers siècles par une grande multiethnicité ethétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui atoujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » unrôle social déterminé au sein du système Ferghana.Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque etsédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé,chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomèneest la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana.Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènementdu nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations del'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteurRégionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteursterritoriaux, en particulier à l'acteur Nation.Seconde partieLa seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dansla vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat desentretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours deséjours en 2007, 2009 et 2010.Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumièrenotamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne dedéfense".Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle del'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, autravers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et desdocuments requis pour le passage de la frontière. Les thématiques liées aux relations commercialestransfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagirmalgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent ausein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôlemajeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dansles descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujoursjouent un rôle fondamental dans les relations et conflits de frontière.Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que lesFerghaniens entretiennent avec eux, et surtout les représentations internes et externes que lescentres urbains assument au sein d'une région désormais tout à fait transfrontalière.Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque làterre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu uneterre d'émigration avec l'indépendance et la concrétisation des frontières.Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré etroutier, et leur rapport d'influence réciproque mutations frontalières de cette région.Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développeune analyse conclusive sur le Ferghana des frontières aujourd'hui.ConclusionLa conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre lesdifférents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel.Force est de constater l'existence de changements dans la région Ferghana à différents points devue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques etsociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structuresculturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin"ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne".Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré lesobstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, ens'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana.La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoirgéopolitique qui persistent encore dans la région.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
Se il lavoro dello storico è capire il passato come è stato compreso dalla gente che lo ha vissuto, allora forse non è azzardato pensare che sia anche necessario comunicare i risultati delle ricerche con strumenti propri che appartengono a un'epoca e che influenzano la mentalità di chi in quell'epoca vive. Emergenti tecnologie, specialmente nell'area della multimedialità come la realtà virtuale, permettono agli storici di comunicare l'esperienza del passato in più sensi. In che modo la storia collabora con le tecnologie informatiche soffermandosi sulla possibilità di fare ricostruzioni storiche virtuali, con relativi esempi e recensioni? Quello che maggiormente preoccupa gli storici è se una ricostruzione di un fatto passato vissuto attraverso la sua ricreazione in pixels sia un metodo di conoscenza della storia che possa essere considerato valido. Ovvero l'emozione che la navigazione in una realtà 3D può suscitare, è un mezzo in grado di trasmettere conoscenza? O forse l'idea che abbiamo del passato e del suo studio viene sottilmente cambiato nel momento in cui lo si divulga attraverso la grafica 3D? Da tempo però la disciplina ha cominciato a fare i conti con questa situazione, costretta soprattutto dall'invasività di questo tipo di media, dalla spettacolarizzazione del passato e da una divulgazione del passato parziale e antiscientifica. In un mondo post letterario bisogna cominciare a pensare che la cultura visuale nella quale siamo immersi sta cambiando il nostro rapporto con il passato: non per questo le conoscenze maturate fino ad oggi sono false, ma è necessario riconoscere che esiste più di una verità storica, a volte scritta a volte visuale. Il computer è diventato una piattaforma onnipresente per la rappresentazione e diffusione dell'informazione. I metodi di interazione e rappresentazione stanno evolvendo di continuo. Ed è su questi due binari che è si muove l'offerta delle tecnologie informatiche al servizio della storia. Lo scopo di questa tesi è proprio quello di esplorare, attraverso l'utilizzo e la sperimentazione di diversi strumenti e tecnologie informatiche, come si può raccontare efficacemente il passato attraverso oggetti tridimensionali e gli ambienti virtuali, e come, nel loro essere elementi caratterizzanti di comunicazione, in che modo possono collaborare, in questo caso particolare, con la disciplina storica. La presente ricerca ricostruisce alcune linee di storia delle principali fabbriche attive a Torino durante la seconda guerra mondiale, ricordando stretta relazione che esiste tra strutture ed individui e in questa città in particolare tra fabbrica e movimento operaio, è inevitabile addentrarsi nelle vicende del movimento operaio torinese che nel periodo della lotta di Liberazione in città fu un soggetto politico e sociale di primo rilievo. Nella città, intesa come entità biologica coinvolta nella guerra, la fabbrica (o le fabbriche) diventa il nucleo concettuale attraverso il quale leggere la città: sono le fabbriche gli obiettivi principali dei bombardamenti ed è nelle fabbriche che si combatte una guerra di liberazione tra classe operaia e autorità, di fabbrica e cittadine. La fabbrica diventa il luogo di "usurpazione del potere" di cui parla Weber, il palcoscenico in cui si tengono i diversi episodi della guerra: scioperi, deportazioni, occupazioni . La ricostruzione serve a arricchire la cultura storica sia a chi la produce, attraverso una ricerca accurata delle fonti, sia a chi può poi usufruirne, soprattutto i giovani, che, attratti dall'aspetto ludico della ricostruzione, apprendono con più facilità. La costruzione di un manufatto in 3D fornisce agli studenti le basi per riconoscere ed esprimere la giusta relazione fra il modello e l'oggetto storico. Le fasi di lavoro attraverso cui si è giunti alla ricostruzione in 3D della Conceria: . una ricerca storica approfondita, basata sulle fonti, che possono essere documenti degli archivi o scavi archeologici, fonti iconografiche, cartografiche, ecc.; . La modellazione degli edifici sulla base delle ricerche storiche, per fornire la struttura geometrica poligonale che permetta la navigazione tridimensionale; . La realizzazione, attraverso gli strumenti della computer graphic della navigazione in 3D. Unreal Technology è il nome dato al motore grafico utilizzato in numerosi videogiochi commerciali. Una delle caratteristiche fondamentali di tale prodotto è quella di avere uno strumento chiamato Unreal editor con cui è possibile costruire mondi virtuali, e che è quello utilizzato per questo progetto.
