; SUMMARYWestern extraterritoriality in East Asia has long been considered a symbol of asymmetrical power relations and criticized as an infringement of the sovereignty of China, Japan and Korea. By contrast, imperial powers justified their need to maintain "the rule of law" in an uncivilized East Asian region lacking rational and humane ways of justice. Recent scholarship paints a more balanced and nuanced picture of a system that was more complex with multiple stakeholders. Most international research, however, focused on the interaction of the major Anglo-Saxon states, especially Great Britain, with China and Japan. Little attention has so far been paid to Imperial Germany and its system of consular jurisdiction in Japan and Korea. This article is the first study of its kind and therefore it relies heavily on unpublished primary sources from diplomatic archives and on late nineteenth century press reports. Its aim is to recreate the German consular court experience and contextualize it in the broader framework of Western extraterritoriality and of German legal history. It narrates three interrelated chronological stories, how international bilateral treaties and German laws formed the backbone of the system, how the German consular courts worked in practice, and finally how Japan terminated the German and Western consular court system in her own country and in Korea. Imperial Germany was one of the major players in operating extraterritorial jurisdiction in Japan and Korea. It guarded its rights and privileges with caution, sometimes in cooperation and sometimes in competition with the other European powers. Lagging behind the UK and the US in the total number of judgments, especially due to fewer criminal cases, it can be estimated that the German consular courts in Japan conducted about 2,000 trials whereas their counterpart in Korea barely decided less than thirty cases over the years of extraterritoriality. As seen through the statistics and extant records of decisions it appears to have been a reasonably well-functioning system of justice administration across national and language barriers. A Japanese coolie or a local maid could successfully sue their German employers for damages or could enforce contracts. Nevertheless, elements of an "unfair system" may still have existed in terms of the willingness to admit oral evidence when the counterpart was not "a Christian gentleman". Conversely a Japanese Court rejected a case by a German plaintiff merely on the formal grounds that the Japanese government refused to communicate with its court. Different laws applied to similar crimes when committed in Yokohama. Two individuals who had cooperated in stealing newspapers were sentenced by different national courts to jail sentences ranging between 7 days (German) and one year (Japanese) according to the criminal codes of their respective countries that were then in force. Theoretically expected to apply German law, in many of the trade and commercial affairs the German consular court followed what one could call "treaty port customary law", which was neither strictly German nor Japanese. In fact the German law of consular jurisdiction of 1879 explicitly permitted such a use of local customary law in commercial affairs. One does see consular court judges, Germans and others, considering the wider community implications of their actions and asking questions about the laws and regulations of countries of the parties and Japan and finally settling the case by proposing a compromise. Sometimes a court would simply defer a decision altogether in respect to law suits in other national courts within the same litigation complex of suits and countersuits. Although the scope of this study was mostly confined to the German consular court as an institution of justice, tracing some of the cases involving German speakers in other courts as plaintiffs and witnesses shows an intricate web of transcultural social and economic relations across national and institutional boundaries. Contrary to the popular image evoked by the term "unequal treaties" the majority of law suits, civil as well as criminal, in both the German and other consular courts stayed within the parameters of the Western community and this study argues that they may have contained the further spread of Western imperialism through legal self-regulation. Extraterritoriality receded when Japan had convinced foreign powers of the reliability of her new justice system modeled after Western laws and procedures. Previously, nationalist fervor, through public opinion and administrative action, also helped in confining the "midas touch of extraterritoriality" to stretch beyond the legal defense of individuals in the consular courts of their own nations. The application of Japanese administrative laws such as quarantine, firearm, custom and press regulations became contested ground in the process leading up to revising the unequal treaties. Although Imperial Germany was involved in some of these controversial incidents, together with the United States, she was one of the first Western powers willing to give up her extraterritorial privileges in Japan to the chagrin of the British diplomats. In a series of diplomatic conferences and consultations all Western powers agreed to a settlement that ended the consular court system in Japan by July 1899. In contrast to Japan, the initial unequal treaties with Korea had extended the scope of extraterritoriality to land acquired by foreigners and gave foreigners broad travel permissions in the country at large. Due to the small number of German residents in Korea these treaty stipulations were not a core issue except that a German subject was one of the largest foreign landowners benefitting from extraterritorial stipulations. When Japan unilaterally cancelled Korea´s international treaties with the annexation of Korea in August 1910, the German Consul to Korea questioned the legality of the Japanese action and insisted on the continuation of Western extraterritorial rights. In a process of multilateral negotiations Japan then addressed the legal and commercial concerns of Western diplomats and by April 1913 signed an agreement mutually ending Western consular jurisdiction in Korea. After all Western nations had already agreed that Japanese laws where in principle on par with their own, it was difficult on this ground to maintain consular court privileges in Korea and oppose the extension of Japanese laws Korea.
; Sessile oak (Quercus petraea [MATT.] LIEBL.) is an important tree species in the northeastern lowlands of Germany. The widespread introduction of the species into mature Scots pine (Pinus sylvestris L.) stands as a means of ecological forest conversion has further enhanced its relevance in forest science and management. For a few decades, however, increasing numbers of trees and stands showing a severe decline in vitality have led to critical discussions on the possible role of oaks in today's forest development strategies. The adaptive capacity of Sessile oak will be further challenged by climate change in the future. In this context, more information is needed on the relations between the vitality status and growth, including the development of these relations in the next decades. Thus, the study investigates the dependencies between annual radial increment in Quercus petraea (measured as tree-ring width, TRW) and individual-tree vitality as well as the effects of climatic variables on TRW on different temporal scales. Investigations were carried out using two sets of trial plots. The core plot sequence K1-K5 comprises five mature mixed stands of Sessile oak with Scots pine along a gradient from Saxony-Anhalt to eastern Poland. Trees are 110-150 years old and grow on sandy and partly podsolic cambisols with average water supply. A set of 20 additional plots was established in mixed oak-pine stands in Brandenburg. In addition to growth and yield data for the whole plot, increment cores were extracted from a representative sample of 20 trees per plot. Time series data of local daily mean temperatures and daily precipitation sum were provided by the Potsdam-Institute for Climate Impact Research. Data for 2007-2060 come from the median scenario of the regional climate model "STAR 2" based on the SRES-scenario A1B and assumes an increase in temperature of two Kelvin until 2060. Individual vitality was recorded from 2006 to 2011on the core plots (i) according to the European standard method for the assessment of crown condition based on defoliation percentages in summer (EICHHORN et al. 2006) and (ii) following the approach by KÖRVER et al. (1999) for crown structure classification in winter. Both methods were applied to all dominant and co-dominant oaks in the five subsequent years. Trees on the additional plots were assessed only once. Because they are regarded a reliable indicator of tree vitality, annual radial increment as expressed in tree-ring width (TRW) and the resulting growth rate (tree-ring index) are at the center of the analyses. For TRW time series the parameters autocorrelation and sensitivity were calculated both for the whole investigation period and as floating means ("moving windows"). The program "CLIMTREG" (BECK et al. 2013) was applied to eliminate long-term trends in individual TRW series by means of cubic spline functions and to minimize auto-correlation within the resulting TRI time series. Pointer years were identified on the basis of the mean and standard deviation of annual TRI distributions. Plot-specific "chronologies" were calculated as arithmetic means of all "typical" tree-specific TRI series per plot. To analyze the relations between climate and growth, the programs CLIMTREG (for daily climate data resolution) and "bootRes" for R (monthly resolution; ZANG & BIONDI 2012) were applied to local climate data and the TRI chronologies. The repeated assessments show that during the interval 2006-2011 crown condition as expressed in summer foliage as well as in crown structure has improved considerably. Crown structure values are correlated more closely to individual basal area increment than defoliation percentages. At the same DBH, trees with larger crowns exhibit a significantly better crown structure and less defoliation. Annual radial increment has been increasing on the core plots over the past decades, thus the increment level of the dominant trees is on average slightly higher than that of the first yield class in the table by ERTELD (1963). On the additional plots, mean TRW is parallel to yield table values but shows a slowly decreasing trend in a number of stands. The two core plots in Poland exhibited the highest radial increments 2006-2011, both absolutely and relatively. On the annual level, TRI time series are correlated more closely to precipitation sums than to annual mean temperatures. Except for one of the additional plots, the respective correlation coefficients are statistically insignificant. Correlations did not increase when climate parameters were calculated exclusively for the vegetation period instead of the whole year. According to dendroclimatological analyses on the monthly scale with bootRes, trees on core plots K1 and K3 respond almost similarly to climatic influences: High TRI values are related to above-average precipitation mainly during the winter months, as well as in late summer and early fall of the year of growth. On the other core plots, dependencies are less clear. The relations of TRI to monthly temperature are weaker than those to precipitation with the same ranking of plots regarding their sensitivity. The most favorable influence on TRI is exerted by cool spring to early summer months in the year of growth. Correlation patterns are very similar for both dominant and suppressed trees. Separate analyses of the first and the last half of the investigated interval show that the strength of correlations between TRI and climatic variables has been increasing over the past decades. When summarized over all plots, there were distinctly more significant correlation coefficients in the period from 1984-2006 than from 1951-1983. The analyses using CLIMTREG showed that high summer precipitation in the preceding year clearly promotes above-average TRI values. Another conspicuous climate-influenced time period ranges from late November to February with positive correlations both to precipitation and to temperature (at least partly). The third important period for TRI in most trees on the core plots starts in early April and lasts until Mid-July. During this time, high TRI values are correlated with low temperatures and high precipitation. For most of the plots, the average modeled TRI is higher if the second half of the data interval 1951-2006 is used for calibration rather than the entire interval or its first half. The results of the models based on different calibration periods do not differ very much in terms of the identified variables (i.e. length of influential period and type of climatic parameter). However, the direction of correlations becomes more variable in the more recent past. The results of this study are summarized in a number of risks and opportunities regarding future vitality and growth of Sessile oak under regional conditions. Finally, several options of silvicultural management to support vitality and growth of the species are recommended. These consist basically in promoting favorable conditions and limiting negative influences. A large crown with dense foliage and a well-developed root system are crucial conditions for individual vitality which should be strengthened for instance by reducing stand densities at an early age. Mixed stands have a higher stability towards disturbances and provide more diverse habitats for natural antagonists against defoliators. The relatively weak competitiveness of oaks should be taken into account when advocating mixed stands. Regeneration activities should enhance genetic diversity, promote phenotypes with above-average vitality, and accelerate the adaptation of the species by "assisted migration" of drought-tolerant provenances. Competition for water may be eased by lower stand densities. However, the canopy should be kept sufficiently closed to prevent excessive growth of ground vegetation or increased evapotranspiration. An adapted system to monitor forest growth and vitality should be used to technically assist the species in counteracting major insect outbreaks and other severe biotic risks as early as possible. On a more general level, productive discussions are needed between all stakeholders, interest groups, and the public on the social and political role of forests and the required level of management. This should lead to a stable social and political appreciation of forestry and provide the resources and staff necessary to cope with an uncertain future.
; The supply of short-lived deciduous trees (ALn) in Lower Saxony was analysed using data from the German national forest inventory (NFI, 2002 and 2012). The standard results of the NFI were augmented by own calculations, which allowed ALn species to be looked at individually. In terms of both standing volume and area covered, birch and alder, with 80 %, make up the major share of the ALn in Lower Saxony. Apart from these species, poplars are of some importance, while the remaining ALn species (willow, Mountain ash, wild fruit trees, chestnut, Red cherry, hazel) combined make up only around 10 % of the volume / ground cover. Almost one third (10 Mio. m³) of the ALn stock is growing in specially protected biotope areas (§ 30 BNatSchG – the nature protection legislation in Germany), with the alder, at ca. 8 Mio. m³, making up the greatest share. Around 5 million m³, or 12 % of the total standing volume, are subject to limitations on usage, either legal restraints or restrictions caused by difficult terrain. Birch and Mountain ash, with 30-40 % respectively, make up the highest proportion of the regeneration, with Red cherry (15 %) also having a considerable share. Trees in the second and third age-class (birch, poplar), or the third age-class (alder), make up the bulk of the main crop. The remaining ALn consists mainly of trees in the first age-class. The age-class structure means that, while the standing volume of birch and alder will probably further increase in the next inventory period, this volume will, however, decrease in the medium term. Both species have, at least theoretically (i.e. without taking economic restrictions into account), a relatively high usage potential, particularly as it could be shown, that a considerable proportion of the harvested wood-volume is currently not used. The transformation of poplar stands planted in the 1950s has already resulted in a reduction of the timber volume of poplar, the species with the third highest share of the ALn timber volume. As poplar is no-longer of importance for silvicultural planning, this trend will continue in the future. It can be assumed that ALn will continue to make up a significant share of the forest area, above all in the lowlands, although a slight decrease in the area covered is anticipated. Due to the very specific site requirements of alder, no intentional changes in the area covered for this species are expected. The remaining ALn species (e.g. birch, Mountain ash, willow, aspen) may benefit from some aspects of a silvicultural strategy change, for instance the inclusion of natural regeneration in stand establishment, the increased proportion of deciduous trees, or the targeted increase in secondary and admixed tree species. On the other hand, the increased planning of shade-tolerant species (for instance the replacement of pine with beech or Douglas fir in lowland areas) and the re-wetting of degraded moors will, through increased competition or denial of habitat, mean a reduction in the potential area available for ALn species. Furthermore, in the inventory period 2002-2012 a decrease in natural afforestation through succession on marginal ground in lowland areas has been recorded. This process was the main reason for the clear increase in ALn (above all birch) in the previous inventory period (1987-2002). The aim was to construct single-tree models for each ALn species and subsequently to integrate these models in a forestry simulation software. Each single-tree model consists of several components (regression models). The focus lay on the depiction of diameter and height growth, crown width, height to crown base, single tree volume and biomass, site index, as well as density and age related mortality. As far as possible the functions were parameterised using the national forest inventory (NFI) data for Lower Saxony and the Lower Saxony state forestry service inventory. Where insufficient data was available, models were researched in the relevant literature, checked and selected on merit. The diameter growth at the level of the single tree was formulated using a model with left-sided variable transformation. For this the Box-Cox transformation proved to be superior than the logarithmic transformations usually used. The diameter, age and the competitiveness of the observed single tree were used as predictors. The height growth was modelled non-linearly using the algebraic difference approach as a function of the initial tree height and tree age. Different models were tested, the goodness of fit statistic being the selection criteria. Functions for determining the site index were developed using the same method. In both cases robust parameter estimates were achieved for all observed tree species. Using quantile regression, an age and species specific maximal height-growth was determined from the single tree data. A limiting function for height-growth was thus created. The crown width was described as a linear function of tree diameter. Because of insufficient available data, data from the literature had to be used in this case. The same was true for the volume estimate at the level of the single-tree. The crown basal height was described non-linearly using tree height, diameter, height/diameter ratio and stand top height as input variables. If the estimation of one or more parameters proved to be unstable then reduced models were used. The single-tree biomass was derived using a three parameter exponential function. For birch and alder own data was used. For the remaining ALn species pseudo-observations were generated from the NFI data on single-tree biomass and fitted to the model. The maximum stand density (for factoring density-related mortality into the model) was derived from the stand basal area as a function of stand top height. The threshold value, above which the age-related mortality is applied with a pre-defined probability, was determined per species from the 95 % quantile of the underlying age distributions. The single-tree models introduced here form the basis of a silviculture scenario simulation for the species birch and alder. Current recommendations for silvicultural treatments, which envisage a stand treatment, that begins early and is aimed at the production of logs (NLF concept), were compared with four alternative treatment variants (no-action alternative, yield-table, extensive, elite-tree selection). This comparison was carried using yield performance indicators. Economic restrictions were not taken into account. The model stands were initialised with top-height site quality classes of 27 m for birch and 32 m for alder, while the initial age was set to 15 years for birch or 10 years for alder. The simulation ran to age 70. The comparison showed that the NLF concept is a good compromise between volume productivity (VP, = remaining volume + harvested volume) and the diameter growth development of the elite trees. The maximum total productivity (TP = VP + mortality) exhibits, for both species, the no-action treatment, although here the diameter (dg and dg of the crop trees) were considerably smaller than in the other variants. It was confirmed, that even few, early thinnings can lead to a recognisable increase in the incremental diameter growth (extensive variant). In comparison, although permanent release of crop trees over the entire simulation period led to the highest incremental diameter growth, the volume growth in the remaining trees was greatly reduced, in particular for alder, and the TP for this variant was lower. The yield table variant showed medium to good performance for both volume growth and in achieved diameter for both species. In contrast to the extensive NLF concept, the thinnings are performed over the entire simulation period and, in addition to the release of crop-trees, a thinning form above is carried out on the remaining stock until the targeted stand basal area is achieved. The maintenance costs are thus higher. It could also be shown that, for both species, the density-related mortality can make up a high proportion of the TP, if no stand treatment is undertaken. Which treatment concept is most appropriate depends entirely on the objectives, with regard to the desired assortment structure. The treatment variants listed here can provide some guidelines. No treatment, the no-action alternative, can be adequate if the harvesting costs are high and the goal is to produce fuel wood. On the other hand, even a few interventions, especially in the early phase, can improve the diameter growth, and thus improve the assortment structure. Keeping crop trees free over the entire production period does not seem advisable, as this leads to a reduction of volume productivity in the stand as a whole.
März 1848 in Chemnitz geboren. ; This work investigated life and work of the mining engineer, entrepreneur, patron and mineral collector Dr. Richard Baldauf (1848-1931) and brought it into a scientifically historical context. A new revision of Richard Baldauf´s biography made appear interesting details, especially concerning the political and economical conditions of his time. The examination of mineral samples of his collection shows how the scientifical branch of mineralogy has developed and improved during the last 100 years. Julius Richard Baldauf was born on 9th March 1848 in Chemnitz. After having finished successfully his studies of mining science in 1869, Baldauf remained enroled at the Mining Academy Freiberg as a mining trainee, in order to achieve the title of a mine surveyor. Afterwards he was employed from 1871 to 1874 at "Frisch Glück" at Oelsnitz, which at that time was the deepest coal mine of Germany, and at "Hänichener Steinkohlenbauverein" (1874-1876). Towards the end of the 19th century the Bohemian brown coal started becoming a rival product for the Saxon hard coal. Already in 1880, it was transported into Saxony via six railway lines and the river Elbe. Later it was used more widely, in the complete German Empire. Among others, Richard Baldauf recognised this economical chance. He moved with his wife Rosalie (née Rudolph, 1855-1918) and their children to the northwest of Bohemia to work in the brown coal mining. In the beginning Baldauf became employed as a mining administrator in Klostergrab (Hrob) and as a mining director in Ladowitz (Ledvice), until he founded with his brother-in-law, Hermann Eduard Rudolph (1846- ?), the so-called "Baldauf-Rudolphsche Braunkohlenwerke", which had its main base in Dux (Duchcov). The "Baldauf-Rudolphsches Braunkohlenwerk" bought, as the years went by, some mining fields, among them the mine Hermann at Sobrusan (Zabrusany), mine Richard at Brüx (Most) and the mine Marianne at Skyritz (Skyrice). In 1913 the company possessed all in all 20 mines in the brown coal region in the northwest of Bohemia. Richard Baldauf was a man who was interested in progress and technology. No later than in 1883 he wanted to introduce modern machines from England into Bohemia. These machines were designed to remove the mining waste. His modern manner of thinking lead also to his creating the mine Richard at Brüx (Most) as an economically-working mining factory. It was counted among the region´s most modern constructions. Co-founder of the "Baldauf-Rudolphsches Braunkohlenwerk" was the architect Hermann Eduard Rudolph. He had finished his studies at the Kunstakademie Dresden in 1872, afterwards he became constructor and architect in Teplitz (Teplice). His construction plans were made reality in the building of the Teplitz synagogue. That demonstrates impressively how successful Hermann was. Martin Baldauf, only son of Richard and Rosalie Baldauf, was encouraged to study mining at Freiberg, too, in order to succeed his father later as administrator of their coal-mining company. From 1908 on he did the economical work at the administrational building of the Hermann-shaft at Dux (Duchcov). Being successful entrepreneurs in the Bohemian brown coal mining region meant for the Baldauf family living in prosperity. This financial background helped Richard Baldauf to establish, from 1904 on, a valuable collection of minerals and to made himself known as patron of the geological sciences of Saxony. In 25 years he had collected 10 000 mineral specimens. He established his collection according to scientific aspects. It was divided into four sections. In his Public Mineralogical Museum, which he in 1916 opened in Dresden, at Geinitzstraße 5, he presented his impressive mineral specimens without demanding an entrance free. After the First World War, his brown coal mining company could no longer exist successfully, for after the war Europe was politically divided and organised differently. Therefore, the Baldauf mines in Bohemia had to be sold to the Czech Trade Company in 1920. After having been given his share of the proceeds of the brown coal mining company, Richard Baldauf´s son Martin endeavoured a new start as a chocolate entrepreneur at Braunschweig, for after the First World War food and drink were needed urgently, no matter if for every day or semi-luxury. But there was high competition in this field, money was losing its valour increasingly and in 1929 the worldwide economic crisis began. That is why the Baldauf family, like many others, started having financial problems. Now it was not possible to go on with the newly-found enterprise. Richard Baldauf wanted to help his son to emerge of the financial crisis. Therefore, he was thinking of selling his valuable collection. That is why in 1929 and 1930 many sale negotiations took place, all without success. Only in 1939 the heirs of the Baldauf family were able to sell the complete collection. Between 1904 and 1929, Richard Baldauf was establishing his mineral collection and became active in Saxony as a patron. Particularly among specialists and scientists of his field, he was famous for his generosity and his commitment as a patron. He made it possible for the Museum for Mineralogy and Geology Dresden, the Institute for Mineralogy and Geology of the TH Dresden, the Mining Academy Freiberg and its Institute for Geology and Economic Geology to acquire valourable minerals, even as whole collections, and scientific instruments. Furthermore, he sponsored the work of scientific and other assistants. In that context the Baldauf foundation has to be emphasized in particular. It was founded in 1920 with a sum of 1 million Deutschmarks. This money had been earned with the sale of the "Baldauf-Rudolphsches Braunkohlenwerk" and was designed to support the TH Dresden. In this doctoral thesis a part of Richard Baldauf´s mineralogical collection was revised and put into a scientifically historical context. First, the methods for mineral identification in the Baldauf era and mineralogical classification systems that he used for his collection work were presented. Furthermore, the systematization and nomination of minerals that are applied today are discussed. That leads to the revision work. In the doctoral thesis 25 samples from the Baldauf collection were revised, applying X-ray diffraction (XRD), scanning electron microscope (SEM), combined with an energy-dispersive microanalytical spectrometer (EDS) and thermal analysis, including a combination of differential thermal analysis (DTA), thermal gravimetric analysis (TG) and derivative thermogravimetry (DTG). So entire research could be made about minerals that in Baldauf´s times still were totally unknown and minerals that had been classified wrongly or not at all. 17 of the research results made here are definitive, seven samples could only partly be clarified. No result at all could be made for one sample, using the modern, mineralogical examination methods. Those mineral samples for which a complete examination was not possible should be prepared and examined again. To revise the whole Baldauf collection thoroughly would take some years. There is still much potential in the revision work. In the future, that should be used cooperatively even more than today by the scientific community. Baldauf´s wide archival holdings, too, could not be seen through completely in this doctoral thesis as far as its content is concerned. In a second examination probably more interesting details would come to light. Since the archival holdings only contain the letters and receipts that Baldauf himself received, it seems probable that in other institutions further papers can be found the author of which he is. Using the corporal catalogue for heritages and autographers, "Kalliope", four letters can be proven, written by Richard Baldauf to the mineralogist Paul Heinrich Groth, of Munich, of the Bavarian State Library, Munich. Baldauf´s final thesis with the Mining Academy Freiberg, from 1869, was intraceable and could not be found anymore at the University Archive at Freiberg. After the Second World War numerous files have been destroyed there. Few information could be found to details about Baldauf´s work in the Saxon hard coal region (the shaft Frisch-Glück-Schacht in Oelsnitz, the Hänichener Steinkohlenbauverein). The reason might be that Baldauf worked there for only some years. In the end it must be emphasized that it becomes evident that, in the future, too, the Baldauf collection offers numerous research opportunities: for the collection documentation and for the mineralogical and scientifically historical investigation for the said time.
; Nowadays, we are accustomed to the claim that fattening pigs' farming must be based upon considered care of the animals on the one hand and of the environment on the other hand. An increasing ecological way of thinking as well as a demand for finding ways of how to keep and to care for animals as far as the public and the legislation alike are concerned, are clearing the way for the demand of new housing systems, capable of fulfilling the new ecological as well as the ethological laws and demands, in order to give farmers the possibility to survive the struggle of European competition. Housing systems where pigs are kept on litter acquire an increasing practical importance for a just ecological as well as a just ethological housing system. It was the aim of this work to analyse the behaviour of pigs kept on straw, especially taking into account climatic factors as well as stable jobs, to make note of the interchangeable reactions regarding the behaviour of the animals and the climate in the stable and to keep diary as to the well-being of the livestock on the one hand and the economic value of sold pigs on the other hand. The data were gained during the cold season in a pen within a stable permanently closed in winter and where the straw was kept and simply piled up during the period off attending (deep litter system). The ethological research was done by means of video cameras. 4 observation periods were chosen for one periodical observation of one and the same group (42 pigs), further one aperiodical observation of the group for 2 specially chosen jobs in the stable (throwing of fresh straw in the morning and providing a bale of straw for the pen chosen for observation), further a 24 hours' period observation of one animal allowing 3 animals with different weight to be observed during two periods of observation with a 4 weeks' period of interval in between. It was the aim of the observation of the chosen group of pigs to find so nothing about the attitude of the animals in view of their body positions allotted to their given place. The aim of the observation of the one animal on the other hand was to gain additionally knowledge of the pigs' activities as well as of the duration of their activities. The following climatic factors were measured: outside temperature, temperature within the stable (as close as possible to the animal), relative humidity in the stable and the temperatures of the layers of straw/dung underneath the animals. The results can be summarized as such: • There could be seen a daily rhythm in the behaviour of the animals. From the ethogram taken of the position of the bodies of the group of pigs (42 pigs) could be seen a clear change between lying down and not lying down positions. On the whole, there could be registered a main lying down period during the night and a shorter one before noon. In the afternoon, there could be noted a high percentage of standing as well as sitting positions. The existance of a consolidated rhythm during the day can be respectively seen as an adequate way of life in the stable. • The temperature in the stable was always higher than the outside temperature. From the inside of the stable to its outside wall the temperature was going down. The higher level of the temperature inside the stable was mainly achieved by the loss of body temperature of the animals and of the layers of dung and straw mixture. In the place where the bale of straw was put in, there could be measured a hot temperature nucleus inside the dung mattress. During the time of taking the measurements, in February, the relative humidity in the stable was mainly above the best measurements noted in Iiterature (60 to 80 %). Especially high it was during the last observation period (85 to 97 %). • As to the inside temperature of the stable there could be seen a certain rhythm during the day. It was influenced by the course of the outside temperature and by the activities caused by movement and metabolism. The following coefficients of correlation between the inside temperature of the stable and the positions of the bodies were calculated: between temperature and lying down on the side there was a negative relation of -0,47 (significant, α=0,01), between temperature and total lying down position (on the stomach and on the side) another negative relation of -0,47 % (significant, α=0,01); a positive relation was seen on the other hand between the temperature and the position on the stomach with a coefficient of correlation of +0,30 (significant, α=0,01) and between the temperature and a standing plus a sitting position with a coefficient of correlation of +0,47 % (significant, α=0,01). The best position of rest and therefore the best way of relaxation is lying on the side, meaning that the activity of movement of the animals is at its lowest at that time. The position on the stomach can either be seen when resting (meaning sleeping quietly) or during activities of movements. • During the time of work in the stable there could be counted more standing and sitting positions than usual. Also, there was measured a rise in temperature. Though all side doors were opened during the work in the stable (while bales of straw were put into the boxes) and though the outside temperature was lower than the temperature within the stable there was still a small rise in the temperature in the stable. • On average 48,1 % of pigs within the group of pigs were lying down on the side during the 4 periods of observation (one observation period equals 24,1 hours; every 12,8 minutes the body positions of the pigs were noted), 31,4 % of them were lying down on their stomach, 15,0 % were in a standing and 5,5 % were in a sitting position. From Iiterature can be learned, that the animals like to be on the side as long as it is warm enough for doing so, meaning that there was enough warmth caused by the animals themselves as well as caused by the warmth of the fermenting dung mattress. During the last time of observation where there was a high relative humidity (85 to 97 %) there could be counted significantly (α=0.05) more pigs lying on their stomachs and less lying on their sides. Lying on the stomach is taken place while resting, whenever the animal is too cold or too warm or whenever there is another reason for being unwell. • For sure there was to be seen an attitude of the animal which was related to the structure of the box. It provided certain places of influencing the behaviour of the animals: on the dung/straw mattress there was a place where dung was separated from the main place of resting as well as a place for digging where the bale of straw was put. The highest number of pigs were registered on the concrete floor and the lowest number of pigs were registered in the manure area. On the left side of the concrete floor there was a densely populated area aroused where both the watering place and the access to the left side of the automatic feeder were placed. During the time of observation, the feeder in the pen, providing 4 places, was visited less than 50 %. • The results of the one-pigs' watching as to its body position its age taken in course agree with Iiterature concerned: as pigs grew older, there was a steady increase in the lying down position on the side as well as in their sitting position; there was a decrease in standing up and in lying on their stomachs. With a 10.87 % digging activity in regard to total activity, pigs showed an extreme liking for digging. Accordancing to literature, the older the pigs the longer it lasted. Differences in activity because of weight could not be traced. • Productivity data showed a daily weight gain of 714 g and a food utilization of 2.77 (kg food/kg weight gain). Both were good in accordance to the results of the figures of the production areas of animal husbandry in Bavaria in 1994/1995 (656 g daily weight gain, food utilization of 3.0 kg food/kg weight gain). The amount of muscle meat of 55 % in slaughtered animals was below average (58 %). It is seen, that the housing system of the animals can be judged as a keeping system just to the animals in relation to their daily routine. Also the animals liked to make use of the possibility to occupy themselves with the supply of straw and/or straw bales. But the temperatures on the surface of the dung/straw mattress and so within the microclimate of the pigs were above 20 °C and therefore beyond the recommended best measurements for temperatures which should be around pigs, especially older pigs. Regarding this it has to be mentioned that on the surface of concrete floor the highest percentage of pigs could be calculated. Therefore it would be wise to consider either to provide a bigger area of concrete flooring in order to provide for more room for the animals to get rid of their excessive body temperatures or to give them the possibility to take a shower in order to cool down. During winter there are problems concerning the airing system: it could be seen, that humidity was without doubt too high. Hence improvements of the airing system have to be carried out. The results of this work also tolerate the idea of an open housing system. More could be done in repeating the measurements, taken in the cold season, in summer as well as in placing additional instruments of measuring climatic factors in the stable such as for air velocity, emissions and developments of dust and to make note of the interchangeable relations in between these studies related to the behaviour of pigs.

From the introduction: 'The more you know about the Olympics, the less it is about sport'. (Bob Perry, Design director of Olympic Projects at Scott Carver Pty. Ltd, http://www.infolink.com.au). The Olympic Games as a mega sports event attracts millions of people from all over the world. New records, fascinating performances, scandals or gigantic celebrations are just some of the attractions provided by this event. One attraction for urban planners is the fact that the Games imply opportunities to promote urban development. From an urban planning perspective, the Olympic Summer Games in Barcelona 1992 set a new standard in defining success of an event of this scale. The city used the Games to promote urban development and planning strategies, profiting from the event in a long-term perspective. Furthermore, the city took another opportunity to find again a place on the 'global map" through the Olympic Games. The case of Barcelona is one of the mostly cited successful urban development initiatives connected with a mega sports event. Olympic Cities have taken the opportunity to promote urban development with the event very differently in the history of the Olympics. The International Olympic Committee (IOC) as the event-owner sets some requirements giving only a few cities the right to stage the event. These requirements are checked in the bidding process ending with the decision which city succeeds in getting the right of staging the event. Integrating the success of an Olympic City in terms of urban development and in terms of the bidding process, the main question from an urban planning perspective is: What is the relevance of Urban Development in the Bidding Process for Olympic Games? To answer the definition of the city's success in terms of urban development and the Olympic Games bidding process, it is helpful to investigate the role of Olympic Infrastructure with a view towards urban sustainability. As such, it is believed that respecting specific planning principles in the bidding process can help to (1) ensure sustainable urban development and (2) enhance the quality of the bid. - The first aspect is relevant for the success of the city in terms of urban development to benefit from the Games in a long time perspective. - The second aspect is relevant for the city's success in the bidding process to acquire the right for staging the Games. The aim of this thesis is to examine how the quality of the bid may respond to principles of sustainable urban development. Two main objectives are identified to reach the aim: 1. Identifying opportunities and threats connected to Olympic Infrastructure in the history of the Olympics in order to formulate six main principles of sustainable urban development for the Olympic Games. 2. Analyzing official bidding documents of the IOC connected with these principles in order to understand how sustainable urban development can be considered in the bidding process. The thesis will conclude with recommendations which can be realized in the bidding process striving to ensure the defined success for the city. Abstract: This thesis is structured in four major parts. Part I consists of chapter 2 and 3 and includes the theoretical framework and methodology of the thesis. Chapter 2 describes the character of mega-events and mega sports events in specific. Based on a concept of sustainable urban development, it will place mega sports events in the context of such a development, forming a theoretical approach for the thesis. Chapter 3 presents the methodology used. Part II consists of chapter 4 and 5 and provides an overall understanding of the Olympic Games in the context of urban development. Chapter 4 gives an overview of the characteristics of the Olympic Games in order to understand the event and its background. Chapter 5 examines the relationship between urban development and the Olympic Games. A model will be presented in order to define 'Olympic Urban Development" for the following sections of the chapter. The chapter will then continue with an historical overview of Olympic Urban Development and present the decisions determining the scale of development. Finally, chapter 5 concludes with the summary of opportunities and threats identified in a literature review of the Olympic Games. The research questions of Part II can be defined as follows: - What are the significant characteristics of the Olympics in terms of mega-event factors? - How can Olympic Urban Development be defined and modelled? - Which are the opportunities and threats for the built, natural, economic and social environment related to Olympic Urban Infrastructure? An intermediate result re-structures the identified opportunities and threats putting them in connection with the concepts presented in the theoretical part. Chapter 6 will conclude with a definition of six principles of sustainable urban development for planning the Olympic Games. The research question leading to the intermediate result can be defined as follows: - Which kind of principles may respond to a sustainable Olympic Urban Development? The second part ends with Chapter 7 in which relevant IOC documents about sustainable urban development will be presented. Part III sets the bidding process in connection with sustainable urban development. Chapter 8 provides relevant information to understand the bidding process, its different phases and the selection procedure. Chapter 9 finally analyses the official bidding documents of the IOC for the defined principles of sustainable urban development. Summaries and recommendations will introduce the main findings for each principle and respond to three main research questions: - Which parts in the bidding documents deal with the principle? - How relevant is the principle in the evaluation of the bid? - Which strategies support the quality of the bid and contribute to meet the objectives of the principle? Part IV includes the conclusion of the thesis and summarizes the main findings of the analysis.Inhaltsverzeichnis:Table of Contents: Preface0 Index1 List of Figures and Tables4 1.INTRODUCTION5 1.1Aim and purpose of the thesis5 1.2Structure of the thesis6 PART I: THEORETICAL FRAMEWORK AND METHODOLOGY 2.THEORETICAL FRAMEWORK9 2.1Mega Events9 2.2Factors of mega-events11 2.3Mega Sports Events12 2.3.1Phases of Mega Sports Events13 2.3.2Bidding14 2.3.3Impacts of Mega Sports Events14 2.4Physical Impact: Mega sports event Infrastructure18 2.5Sustainable Urban Development20 2.6Sustainable Urban Development in the context of a mega sports event22 2.7Definitions and Limitations23 3.METHODOLOGY25 PART II: UNDERSTANDING THE OLYMPIC GAMES IN THE CONTEXT OF URBAN DEVELOPMENT 4.Olympic Games Characteristics29 4.1History of the Olympic Games29 4.2The Olympic Movement30 4.3Olympic Games Factors31 4.4Olympic Games Phases35 5.Olympic Urban Development37 5.1Definition37 5.1.1Olympic Infrastructure38 5.1.2Urban Infrastructure38 5.1.3Modelling an Olympic City40 5.2History of Olympic Urban Development42 5.3Decisions determining Olympic Urban Development47 5.3.1Local distribution of Olympic Infrastructure48 5.3.2Funding Model50 5.3.3Expenditure on Olympic Infrastructure51 5.3.4Use of existing Olympic Infrastructure53 5.4Opportunities and Threats54 5.4.1Built environment54 5.4.2Natural Environment57 5.4.3Economic Environment60 5.4.4Social Environment61 5.4.5Summary64 6.Intermediate Result: Defining Principles of Sustainable Urban Development for Planning Olympic Infrastructure66 6.1Principles66 6.2Objectives68 7.Relevant IOC Documents on Sustainable Urban Development70 7.1Olympic Charter70 7.2Olympic Agenda 2170 7.3IOC Manual on Sports and the Environment72 7.4Olympic Games Study Commission73 PART III: THE BIDDING PROCESS IN THE CONTEXT OF SUSTAINABLE URBAN DEVELOPMENT 8.Olympic Games Bidding Process74 8.1History of the Olympic Games Bidding Process74 8.2The process78 8.2.1Phase 1: Candidature Acceptance Procedure (CAP)78 8.2.2Evaluation of the Working Group Report79 8.2.3Phase 2: Candidature Procedure83 8.3Selection of the Host City85 8.3.1Election Procedure85 8.3.2Decision Making in the Electing Procedure for a host city86 8.4Summary88 9.Analysing Principles of Sustainable Urban Development in the Bidding Process90 9.1Principle 1: Integrate Olympic Infrastructure in urban development plans92 9.1.1Phase 1: Candidature Acceptance Procedure92 9.1.2Evaluation in the Working Group Report92 9.1.3Phase 2: Candidature Procedure94 9.1.4Summary95 9.1.5Recommendations96 9.2Principle 2: Ensure Post-Event Use for Olympic Infrastructure97 9.2.1Phase 1: Candidature Acceptance Procedure97 9.2.2Evaluation in the Working Group Report98 9.2.3Phase 2: Candidature Procedure99 9.2.4Summary100 9.2.5Recommendations101 9.3Principle 3: Maximise the use of existing infrastructure by respecting the city's budget104 9.3.1Phase 1: Candidature Acceptance Procedure104 9.3.2Evaluation in the Working Group Report105 9.3.3Phase 2: Candidature Procedure107 9.3.4Summary107 9.3.5Recommendations108 9.4Principle 4: Ensure environmental standards for Olympic Infrastructure and accessibility to environmental goods109 9.4.1Phase 1: Candidature Acceptance Procedure109 9.4.2Evaluation in the Working Group Report109 9.4.3Phase 2: Candidature Procedure111 9.4.4Summary112 9.4.5Recommendations113 9.5Principle 5: Integration of citizens in the planning process of Olympic Infrastructure114 9.5.1Phase 1: Candidature Acceptance Procedure114 9.5.2Evaluation in the Working Group Report114 9.5.3Phase 2: Candidature Procedure115 9.5.4Summary116 9.5.5Recommendations117 9.6Principle 6: Stimulate improvement of Urban Infrastructure through Olympic Infrastructure118 9.6.1Phase 1: Candidature Acceptance Procedure118 9.6.2Evaluation in the Working Group Report119 9.6.3Phase 2: Candidature Procedure120 9.6.4Summary121 9.6.5Recommendations122 PART IV: CONCLUSION126 10.Conclusion126 10.1Conclusion of the analysis126 10.1.1Relevance of Sustainable Urban Development in the Bidding Process126 10.1.2How to respond to principles of sustainable urban development in the bid127 10.2General Conclusions130 10.2.1The interest of the IOC in Sustainable Urban Development130 10.2.2The real winner of a bidding process130 10.2.3Outlook on the future of the Games131 11.Appendix133 11.1References133 11.2Abbreviations137 11.3Extracts from Bidding Documents138 11.3.1Phase 1: Candidature Acceptance Procedure (CAP)138 11.3.2Evaluation: Working Group Report140 11.3.3Phase 2: Candidature Procedure142Textprobe:Text Sample: Chapter 5.4, Opportunities and Threats: This section study provides a discussion on opportunities and threats related to Olympic Infrastructure. Potential effects are presented and ordered according to the different environments of a city (section 2.4). The IOC officially uses the term 'Legacy' for potential post-event effects preferably underlining positive ones. The sources used in this literature review (Cashman, 2002; Essex Chalkley, 2003; Furrer, 2002; Matos, 2006; Liao Pitts, 2006; Preuss, 2006; Centre On Housing Rights and Evictions (COHRE), 2007; Ward, 2007; WWF, 2004) reflect the potential effects of the Olympics critically from different perspectives (researchers, NGOs, IOC related person). If applicable, the opportunities and threats are illustrated with examples. A summary is given in the end of this section as a basis for developing principles of sustainable urban development. As the potential effects have a multidimensional character, two selection criteria limit their number: - Time: The potential effect might occur at any period of the event but must have a relevance for the city in a long-time perspective. - Space: The potential effect might occur at a micro (e.g. dislocation) or macro (e.g. polycentric development) level but is relevant mainly for a city (not a region or nation). 5.4.1, Built environment: - Boost for urban development projects and urban renewal. Locational decision on Olympic Infrastructure opens the opportunity for a city to boost its urban development projects in favour of the city. There is a chance to connect a city's urban development strategy with Olympic Infrastructure projects. History of the Olympics shows that cities have dealt very differently with this opportunity (see section 4.1). Some have used the Olympics to reinvent the city while others have concentrated solely on the successful organization of the event itself. In many cases, Olympic Infrastructure is also used to trigger massive urban regeneration projects and the idea to create new centralities within the city. Development corridors can be focused through Olympic Infrastructure and stimulate urban development nearby. Strategic positioning of Olympic Infrastructure in specific urban areas may contribute to a polycentric development. This is especially true for the positioning of key Olympic Infrastructure represented by the Olympic Main Stadium, the main indoor halls and the aquatic centre. Barcelona 1992 is probably the most successful Olympics regarded to large-scale urban development. Urban planners of the city saw the Olympic Games as an useful instrument to achieve the objectives of development plans which had been the improvement of transport system, creation of new facilities, definition of central space and balancing the city. The initial authorized to make the first draft of the Olympic from an urban perspective was part of the Olympic Bidding Team and later entered into the Organizing Committee. The changes of the entire urban fabric connected to Olympic Infrastructure based on what was already existing in Barcelona became a best practice in terms of mega-event related urban development. - Changes of Urban Development plans in favour of the event/bid. Potential changes of existing urban development plans can occur in the preparation phase of the event due to tight time constraints. To speed up land acquisition for Olympic Infrastructure some cities approve special legislative acts and give power to Organizing Committees. Special building permits are created in the area where Olympic Infrastructure has to be built and can contribute to long-lasting procedural changes in the city. A special law for the Athens 2004 Games recognized the strategic significance of the Olympic Games to the evolution of the metropolitan area. The location of Olympic Infrastructure was determined as to be in accordance with the regional, environmental and urban development guidelines of the master plan of Athens. Through this legislation and the installation of special agencies it was possible to accelerate permits of Olympic Works. - Modernization and Upgrading of existing facilities. In terms of existing infrastructure, the Olympics bring the opportunity to upgrade and modernize sports facilities. This may also decrease financial risk. The main Olympic Stadium as the centrepiece of Olympic Infrastructure relies traditionally on public funding. Some Olympic Cities have strived to use existing facilities or refurbished ones for this major infrastructure project. Naturally, development of sports facilities had to be faced by almost all Olympic cities. Moscow 1980 and Barcelona 1992 used mainly existing sports facilities and refurbished existing Stadiums to Main Olympic Stadiums. Los Angeles 1984 used existing facilities to a large extent. - Unused large-scale facilities. The history of the Olympic Games shows that many Olympic sports facilities received poor post-Games usage. International Olympic Sports Federations have often pushed host cities to provide over-ambitious state-of-the-art facilities which are not in line with the local popularity of the sport. Furthermore, local agendas have often pushed for grandiose landmark legacies to be built in order to showcase the local economy and engineering ability. These objects might be designed over-sized and turn in a post-event period to 'White elephants'. They may neither integrate a long-term urban planning policy nor relate to the population's need for leisure and culture facilities. It is sometimes difficult to convince leading teams in specific sports to move their home ground to new Olympic Infrastructures. Another problem in this respect is the difficulty to attract large crowds to newly developed parts of the city away from trying to opportunity the citizens habits. The Olympic stadium of Sydney 2000 generated continuing losses at A$38 million/year six years after the event. The competition for sports events with other stadia in Sydney caused limited booking and shows the lack of post-use planning. 'Sydney Jurassic Park' is a symbolic expression used by criticizers of the post-use of Sydney Olympic Park. - Increase of Housing stock through Olympic Village. The Olympic Village is often located close to the sports facilities and represents the accommodation for the Olympic Family. It is an essential part of Olympic Infrastructure and has to be addressed by every hosting city. In many cases, Olympic Villages become residential areas for local people or halls of residences for a local university or college after the Games. Thus, an Olympic Village is a chance to increase the city's housing stock and provide facilities for alternative uses in a post-event period. 'In Barcelona and Sydney the former Olympic Villages now provide a mixture of housing that contributes to the cities' housing stock and adds a valuable source of revenue to cover Games-related expenditure'. - Improvement of transport infrastructure. As we have seen in the previous chapter, Olympic Infrastructure induces also the upgrade of the city's transport infrastructure. For an effective transport of athletes, spectators and officials during the event many host cities tend to expand their transport system Investment of previous Olympic Cities is often focused especially on underground or light rail system. Recent Olympic Cities (Athens and Beijing) invest in tram and overhead urban rail system due to high costs and implementation difficulties of underground transport. This may contribute to a better infrastructure for citizens and decreases traffic pressure in inner city and congestion. Asian Olympic Cities have strongly linked the Games to transport infrastructure. Between 1957 and 1964 Tokyo established 73 km underground, 13.2 km monorail and 500 km Shinkansen connecting Tokyo, Kyoto and Osaka. Seoul added 157.1 km to the length of its underground network from 1978 to 1993 for the preparation of the Games. Finally, Beijing extended its light rail length by 87.1 km before 2008. A strong reliance to public transport can be observed in Seoul and Tokyo through this investment related to Olympic Infrastructure. - Development of other Infrastructure. Furthermore, development of Olympic Infrastructure can be a driver for additional infrastructural improvements in the city, affecting the entire urban fabric. A basic infrastructure is needed serving Olympic facilities. Many cities have used the event as a catalyst to induce such investment and bring other infrastructure to a higher level appropriate for international visitors. Such investments can enhance the Quality of life for citizens, tourists and attract inward investment. Tokyo included the improvement of water supply system, higher public health standards for refuse collection, street cleaning, public toilets and three sewage disposal plants. Barcelona, Atlanta and Sydney invested in telecommunication systems through the staging of the event. Cultural and research facilities (Olympic Studies Centre, Olympic Museum) close to Olympic Infrastructure supporting the Olympic Cultural Programme were realized in many Olympic Cities. - Destruction of cultural heritage. There is a potential risk that Olympic Infrastructure may affect the cultural heritage of a city negatively. The potential risk seems to be higher for Olympic Cities approaching development in the inner city. Consequently, disregarding the laws may lead to the destruction of culturally built environment and displacement of residents. Infrastructure development for the Games of Beijing 2008 negatively affected the cultural heritage of the city. Demolition in Beijing was an ongoing process in the whole city, especially threatening the old 'hutong' and 'siheyuan' areas. According to reports of COHRE the violation of Cultural Heritage Protection laws and regulations effected both irreparably damaged cultural heritage and also violated residents' rights to adequate housing.
