Whether originating from copyright scholarship or from legislative discussion, proposals to authorize the transfer of copyrighted works through peer-to-peer ("P2P") networks have been abundant in the last ten years as an alternative to seemingly difficult to enforce and unsuccessful repression-based solutions. As Neil Netanel described it: P2P controversy is a story of the copyright industries' increasingly brazen— some say desperate—attempts to shut down P2P file-swapping networks, disable P2P technology and shift the costs of control onto third parties, including telecommunications companies, consumer electronics manufacturers, corporate employers, universities, new media entrepreneurs and the taxpayers.
In the past fifteen years, file sharing of digital cultural works between individuals has been at the center of a number of debates on the future of culture itself. To some, sharing constitutes piracy, to be fought against and eradicated. Others see it as unavoidable, and table proposals to compensate for its harmful effects. Meanwhile, little progress has been made towards addressing the real challenges facing culture in a digital world.

La prova informatica richiede l'adozione di precauzioni come in un qualsiasi altro accertamento scientifico. Si fornisce una panoramica sugli aspetti metodologici e applicativi dell'informatica forense alla luce del recente standard ISO/IEC 27037:2012 in tema di trattamento del reperto informatico nelle fasi di identificazione, raccolta, acquisizione e conservazione del dato digitale. Tali metodologie si attengono scrupolosamente alle esigenze di integrità e autenticità richieste dalle norme in materia di informatica forense, in particolare della Legge 48/2008 di ratifica della Convenzione di Budapest sul Cybercrime. In merito al reato di pedopornografia si offre una rassegna della normativa comunitaria e nazionale, ponendo l'enfasi sugli aspetti rilevanti ai fini dell'analisi forense. Rilevato che il file sharing su reti peer-to-peer è il canale sul quale maggiormente si concentra lo scambio di materiale illecito, si fornisce una panoramica dei protocolli e dei sistemi maggiormente diffusi, ponendo enfasi sulla rete eDonkey e il software eMule che trovano ampia diffusione tra gli utenti italiani. Si accenna alle problematiche che si incontrano nelle attività di indagine e di repressione del fenomeno, di competenza delle forze di polizia, per poi concentrarsi e fornire il contributo rilevante in tema di analisi forensi di sistemi informatici sequestrati a soggetti indagati (o imputati) di reato di pedopornografia: la progettazione e l'implementazione di eMuleForensic consente di svolgere in maniera estremamente precisa e rapida le operazioni di analisi degli eventi che si verificano utilizzando il software di file sharing eMule; il software è disponibile sia in rete all'url http://www.emuleforensic.com, sia come tool all'interno della distribuzione forense DEFT. Infine si fornisce una proposta di protocollo operativo per l'analisi forense di sistemi informatici coinvolti in indagini forensi di pedopornografia. ; Digital evidences require precautions as in any other scientific investigation. We provide an overview about methodology and application of computer forensics based on the recent ISO / IEC 27037:2012 relating to the processing of finding information in the stages of identification, collection, acquisition and preservation of digital data. These methods comply with the requirements of integrity and authenticity of the rules of computer forensics, in particular the Law 48/2008 about the ratification of the Budapest Convention on Cybercrime. Concering the child pornography crime, we offer an overview of EU and national legislation, with emphasis on relevant aspects for computer forensic analysis. We provide an overview of the peer-to-peer protocols and systems used for file sharing, with an emphasis on the eDonkey and eMule software that are widely spread in Italy. The design and implementation of eMuleForensic allows the computer forenser to perform a highly accurate and rapid operations analysis of the events that occur using eMule; the software is available in the url http://www.emuleforensic.com network, both as a forensic tool in the distribution DEFT. Finally, we provide a proposal for an operating protocol for forensic analysis of computer systems involved in forensic investigations on child pornography.
In informatica e telecomunicazioni il file sharing è la condivisione di file all'interno di una rete di calcolatori comuni e come fenomeno di massa, è strettamente legato alla diffusione di Internet e della banda larga. Il file sharing è cresciuto in popolarità e si è diffuso rapidamente grazie alle connessioni di Internet sempre più veloci e al formato dei file audio MP3. Il nuovo modello di condivisione peer to peer (P2P) si è rivelato, però, destabilizzante per il sistema del copyright, proprio perché ha provocato una massiccia diffusione di materiale coperto da copyright, spingendo le major discografiche e mediali ad attacchi legali per tutelare i propri diritti. La condivisione di materiali coperti da copyright è ritenuta illegale, ma ha acceso non poche discussioni anche a causa delle diverse legislazioni in vigore nei vari paesi. I problemi di fondo che gli ordinamenti giuridici hanno incontrato nel tentativo di regolamentare questo fenomeno sono sostanzialmente di tre tipologie: 1) Il conflitto con le libertà fondamentali: Il File sharing rientra nella sfera dei diritti fondamentali previsti dalle convenzioni internazionali e dalle carte costituzionali di tutti gli stati democratici, dal momento che si basa sulla comunicazione tra privati. 2) La non percezione di illiceità: Lo scambio di file è oggi molto semplice da effettuare e molto vantaggioso economicamente. Insieme alle moderne tecnologie informatiche, che hanno portato gli individui a non potersi più privare di oggetti e servizi fino a poco tempo fa sconosciuti, ha rivoluzionato le consuete abitudini di vita e risulta essere in costante ampliamento, nonostante sia una pratica riconosciuta come illecita e quindi sanzionabile. 3) L'inesistenza di sistemi centralizzati da colpire: Il modello peer-to-peer rende difficile sanzionare la violazione del diritto poiché la rete è composta da un'infinità di soggetti, difficilmente individuabili e con diverse gradazioni di responsabilità: la posizione dell utente che si connette saltuariamente e scambia qualche file è diversa da quella di chi viola il diritto di autore condividendo e scambiando migliaia di file, criptando dati e rendendosi non immediatamente identificabile Nel lavoro in oggetto, verrà ricostruita la storia del file sharing da un punto di vista filosofico e tecnologico. Inoltre, verranno forniti degli spunti di riflessione per poter arginare la pirateria software nei programmi peer to peer. Solo pensando come un pirata si può combattere realmente la pirateria.

For industries ranging from software to pharmaceuticals and entertainment, there is an intense debate about the appropriate level of protection for intellectual property. The Internet provides a natural crucible to assess the implications of reduced protection because it drastically lowers the cost of copying information. In this paper, we analyze whether file sharing has reduced the legal sales of music. While this question is receiving considerable attention in academia, industry, and Congress, we are the first to study the phenomenon employing data on actual downloads of music files. We match an extensive sample of downloads to U.S. sales data for a large number of albums. To establish causality, we instrument for downloads using data on international school holidays. Downloads have an effect on sales that is statistically indistinguishable from zero. Our estimates are inconsistent. Adapted from the source document.
