On Monday, July 24, the Israeli legislature passed a constitutional amendment that would constrain the courts' ability to use the reasonableness doctrine. The reasonableness doctrine is a common law doctrine developed by the Israeli courts to review executive decisions. Without the reasonableness doctrine, Israel is more conflicted than ever, and vulnerable to the spread of the scourge of corruption. The government shot itself in the foot both domestically and internationally.

"Decision-making in matters of constitutional change seems hardly to comply with the rules associated with a parliamentary form of government. Constitutional changes require - at least - a two third majority in parliament. Thus, normally at least one party in opposition has to support bills aiming at amending the constitution. Due to these formal requirements the standard approach explaining law-making in parliamentary governments seems inappropriate to explain the essential aspects of constitutional politics. However, constitutional politics in the state of Brandenburg between 1992 and 2013 show many features of majoritarian decision-making in parliamentary systems. In addition, in the Landtag of Brandenburg constitutional amendments are dealt with in the same way as 'normal' bills. Overall, in Brandenburg constitutional politics is similar to the one in the Bundestag regardless of some specifics." (author's abstract)

Israel is in the midst of an acute struggle over its constitutional identity. We are witnessing a government adamant about revolutionizing Israel's constitution ("Basic Laws"), which may typically be amended by a simple majority of the legislature and is thus prey to the whims of an extreme government. The most recent move on the government's agenda, passing a constitutional amendment that would severely restrict the reasonableness doctrine, would bring Israel closer to the brink of constitutional chaos. In this blog, I explain the theoretical arguments in favor and against the proposal and lay out the implications, should this proposal go through, given the government's true, concerning motivations that are already evident on the grounds.

This is the first country report in the new yearbook. It outlines the different instruments of direct democracy in Switzerland. Some of these instruments, like the public initiative for a total revision of the constitution, have been around since the inception of the federal state in 1848. Others, like the public initiative for constitutional amendments (partial revisions) – being the most popular instrument of all – have been added later (1891). The report presents an outline of the different stages of public initiatives and lists all active initiatives within theses stages.

"Trotz medienwirksamer Erfolge im Kampf gegen die Guerillas steht die kolumbianische Regierung derzeit unter starkem Druck. Die angekündigten politischen Reformen sind ebenso gefährdet wie die sicher geglaubte Kandidatur Álvaro Uribes zu einer dritten Präsidentschaftswahl. Im sechsten Jahr seiner Amtszeit wird Präsident Uribe von Entwicklungen eingeholt, die er zum Teil selbst in Gang gesetzt hat. Eine Reihe politischer Initiativen Uribes produzierte ungewollte Nebenwirkungen. Insbesondere der von ihm zu Beginn seiner ersten Wahlperiode mit viel Energie und gegen beträchtliche rechtliche Bedenken eingeleitete Versuch, durch das 'Friedens- und Gerechtigkeits'-Gesetz das Problem des 'Paramilitarismus' aus der Welt zu schaffen, ist gescheitert. Ziel war die Demobilisierung von Tausenden von Paramilitärs. Selbst die geringen Anforderungen, die das Gesetz an die Paramilitärs stellte, wenn sie die Waffen niederlegten, waren politisch und juristisch nicht in vollem Umfang durchsetzbar. Unzufrieden mit dem Ergebnis des Prozesses begannen viele Paramilitärs, öffentlich und vor der Justiz über ihre Hintermänner in der Politik, dem Militär und der Wirtschaft zu berichten. Erstmals kam damit das ganze Ausmaß des parastaatlichen Machtapparats unter dem neuen Schlagwort 'Parapolitik' ans Licht. Die kolumbianische Justiz arbeitet sich bisher beharrlich in das Dickicht dieses Netzwerkes vor. Ihre Ermittlungen stellen auch Uribes politische Basis in Frage und damit die Absicht, mittels einer weiteren Verfassungsänderung eine dritte Amtszeit für den Präsidenten durchzusetzen. Die Regierung und der Präsident haben sich bislang vergeblich bemüht, die Ermittlungen der Justiz gegen Politiker mit Verbindungen zu den Paramilitärs zu bremsen. Die offen ausgetragene Machtprobe zwischen Regierung und Justiz droht zu einer schweren Verfassungskrise zu werden. Sinnvolle Reformvorschläge im Bereich der Justiz bleiben im Getriebe des politischen Machtkampfs stecken. Ungeachtet hoher Werte bei Meinungsumfragen ist die Aussicht, eine vieldiskutierte dritte Wahlperiode Uribes legitimieren zu können, getrübt. Der Präsident hat bereits angedeutet, dass er unter Umständen auf eine erneute Kandidatur verzichtet." (Autorenreferat)
