Nowelizacja ustawy o Trybunale Konstytucyjnym uchwalona 22 grudnia 2015 r. budzi liczne wątpliwości krajowych i zagranicznych ośrodków naukowych, medialnych i politycznych. Obawy wywołuje zwłaszcza to, że nie mieści się ona w granicach określonych w art. 197 Konstytucji RP. Wbrew pozorom wykracza bowiem poza sprawy organizacyjne i proceduralne. Przepisy narzucające zasadę orzekania w 13-osobowym składzie, w kolejności wyznaczanej datami wpływu spraw oraz brak vacatio legis uniemożliwiają w praktyce normalną działalność orzeczniczą Trybunału Konstytucyjnego. W szczególności blokują możliwość zbadania w rozsądnym terminie konstytucyjności ustawy z 22 grudnia 2015 r., co z kolei rodzi niebezpieczeństwo powstania absurdalnych sytuacji prawnych. Może to oznaczać ingerencję w kompetencje orzecznicze Trybunału Konstytucyjnego zagwarantowane w art. 188 Konstytucji RP. Do niego też powinno należeć ostateczne rozstrzygnięcie wszystkich dylematów związanych z wymienioną wyżej ustawą. ; The Amendment to the Act on the Constitutional Tribunal passed on 22 December 2015 has raised serious doubts in Polish and foreign academic and political institutions and the media. Of particular concern is the fact that the amendment does not correspond to the limitations of Article 197 of the Constitution of the Republic of Poland. Contrary to appearances the amendment exceeds organisational and procedural questions. The amendment imposing a rule that 13 judges must rule on cases in the chronological order of their submission and the lack of vacatio legis makes it impossible for the Constitutional Tribunal to continue in practice its normal judicial function. In particular it makes it impossible for the Constitutional Tribunal to decide on the constitutional legality of the Amendment of 22 December 2015 within a reasonable time scale which in itself could result in dangerous and absurd legal situations. This could be tantamount to an interference in the judicial competences of the Constitutional Tribunal guaranteed by Article 188 of the Constitution of the Republic of Poland. It is the Constitutional Tribunal itself that should rule on all dilemmas concerning this amendment.

The article tries to bring to the light the role of symbolism in the organized human life, in general, and the contemporary societies with the accelerating changes almost in all social structures, in particular. The rational of symbolism in changing socio-political and legal environment creates complexity of the issue, which has been studied in the article, taking into account the methodology of complex system theory. The interconnectivity and interdependency of law, morality and politics create the picture of synergy of different social norms with each other in changing environment. Their positive synergy is able to create a perception of the 'ethical state' – the focal point of equilibrium expressed in the attractor of future admired development. In the legal perspective, the symbol of that attractor appears to be the constitution as the society's and the nation's symbol of coexistence based on the values of mutual past, necessary present and admired future. It is substantiated that the Constitution is the phenomenon, representing a concrete constitutional idea and constitutional identity, and should be the one to be considered as such in a lot of people's minds if we intend to have a proper constitutional system and values. Hence, the Constitution is not just a document with a highest legal force, but also a symbol of a concrete constitutional system, and from this viewpoint the Basic Law has a symbolic significance. The authors substantiate that the mentioned significance of the Constitution makes it clear that constitutional policy in any state should be established and implemented in a manner, obviously demonstrating an attitude towards the Constitution, in the frames of which it is considered as a symbol of a concrete constitutional system. The most important circumstance in this context is to never transform the Constitution (directly or indirectly) from a symbol to an instrument in the hands of both the people and the state power and the whole constitutional policy of the state should be based on the discussed essential idea. Moreover, according to the authors the Constitution should not be subject to amendment parallel to every change of political situation of the state or formation of a new political majority merely conditioned by the mentioned changes. The Constitution has a fundamental role from the aspect of regulating social relations, has symbolic significance and can't be used just as a tool for solving ongoing political problems.

RESEARCH OBJECTIVE: Assessment of the possible impact of the amendment of the Act on Regional Accounting Chambers on the extent of autonomy of local government units.THE RESEARCH PROBLEM AND METHODS: Independence is one of the most important features of self-government. The solutions adopted in the draft amendment to the Act on Regional Accounting Chambers (RACs) concerning the extension of the scope of control over territorial self-government units (TSGUs), as well as the way of appointing the presidents of the RACs induce the hypothesis of creating potential conditions for the unregulated interference of government administration in the activities of local governments. Equally important is the symbolic significance of such an initiative. The analysis used the institutional and comparative method, the study was primarily concerned with a bill amending the law on regional accounting chambers and documents created during the consultations and project agreements.THE PROCESS OF ARGUMENTATION: The article describes the current legal regulations governing the supervision and control of regional accounting chambers over TSGUs, and these were set against the proposed changes in legal and political terms. The possible effects of the changes were indicated. The analysis also referred to the opinions of the subjects involved in the agreement and consultation process. RESEARCH RESULTS: The analysis confirmed that the proposed changes are very likely to create unauthorized access to the constitutional principle of the autonomy of territorial self-government units that may create the possibility of indirect interference in their activities. In the political dimension, the prepared draft amendment creates an impression of the government's tightening of control and supervision over TSGUs.CONCLUSIONS, INNOVATIONS AND RECOMMENDATIONS: The legislative bill submitted in the Sejm requires further changes. The withdrawal of the drafter from the extension of the scope of RACs control during the consultations needs to be seen as inadequate. The proposed way of appointing presidents of regional accounting chambers is still a serious concern. ; CEL NAUKOWY: Ocena możliwego wpływu nowelizacji ustawy o regionalnych izbach obrachunkowych na zakres samodzielności jednostek samorządu terytorialnego.PROBLEM I METODY BADAWCZE: Samodzielność jest jedną z najważniejszych cech samorządności. Przyjęte w projekcie nowelizacji ustawy o regionalnych izbach obrachunkowych (RIO) rozwiązania, dotyczące rozszerzenia przedmiotowego zakresu kontroli nad jednostkami samorządu terytorialnego (JST), jak również sposobu powoływania prezesów RIO, skłaniają do postawienia hipotezy o stworzeniu potencjalnych warunków dla nieuprawnionej ingerencji administracji rządowej w działalność samorządów. Nie mniej ważne jest również symboliczne znacznie takiej inicjatywy. W analizie wykorzystano metodę instytucjonalno-prawną i porównawczą, badaniu poddano przede wszystkim projekt ustawy o zmianie ustawy o regionalnych izbach obrachunkowych oraz dokumenty powstałe w toku konsultacji i uzgodnień projektu.PROCES WYWODU: W artykule scharakteryzowano obowiązujące regulacje prawne dotyczące nadzoru i kontroli regionalnych izb obrachunkowych nad JST, a na tym tle dokonano analizy proponowanych zmian w wymiarze prawnym oraz politycznym. Wskazano ich możliwe skutki. W toku analizy odwołano się również do opinii podmiotów uczestniczących w procesie uzgodnień i konsultacji.WYNIKI ANALIZY NAUKOWEJ: Przeprowadzona analiza potwierdziła, że zaproponowane zmiany stwarzają nieuprawnione w myśl konstytucyjnej zasady samodzielności JST rozwiązania, które mogą stworzyć możliwość pośredniego ingerowania w ich działalność. W wymiarze politycznym przygotowany projekt nowelizacji stwarza wrażenie zaostrzenia kontroli i nadzoru rządu nad JST.WNIOSKI, INNOWACJE, REKOMENDACJE: Złożony w Sejmie projekt ustawy wymaga dalszych zmian. Za niewystarczające należy uznać wycofanie się projektodawcy w toku konsultacji z przedmiotowego rozszerzenia zakresu kontroli RIO. Poważne zastrzeżenia budzi nadal proponowany sposób powoływania prezesów regionalnych izb obrachunkowych.

Trybunał Konstytucyjny uznaje Konstytucję za podstawowe źródło wzorców kontroli (konstytucyjne wzorce kontroli) aktów normatywnych (ustaw, przepisów prawa wydawanych przez centralne organy państwowe), stanowiących o sytuacji samorządu terytorialnego. Trybunał przywołuje również postanowienia Europejskiej karty samorządu lokalnego jako źródło wzorców kontroli aktów normatywnych, które regulują sytuację samorządu terytorialnego. Przywoływanie to ma jednak przede wszystkim charakter wspierający argumentację i jej wyniki, które Trybunał wywodzi z Konstytucji. Karta w trybunalskiej kontroli zgodności aktów normatywnych, stanowiących o sytuacji samorządu terytorialnego, pełni tym samym rolę aktu pomocniczego. Trybunał dopuszcza zarazem wyłączność Karty w tej kontroli, jeżeli Konstytucja nie pozwala na ustalenie wzorca kontroli w sytuacji zaniechania przez ustrojodawcę ujęcia w Konstytucji problemu, który został uregulowany w Karcie. Pogląd ten ma jednak znaczenie prospektywne i odnosi się do ewentualnych zmian w Konstytucji, które prowadziłyby do takiego konstytucyjnego zaniechania. ; When it comes to deciding upon a review model of normative acts regulating the situation of self-government, the Constitutional Tribunal regards the Constitution as the main source of such a model. However, the Constitutional Tribunal also invokes provisions of the European Charter of Local Self-Government as the source of a review model of normative acts that regulate the situation of self-government. The latter, however, is done only to support the rationale of judgments based on the Constitution, thus in the process of a Constitutional Tribunal review of normative acts, the European Charter is an ancillary document. At the same time, it is permissible to exclude the provisions of the European Charter when it is impossible to determine a review model due to the fact that an issue regulated in the European Charter has not been addressed in the Constitution. The significance of this, however, may only become apparent in the future, if certain amendments to the Constitution have been made, resulting in a constitutional omission.

The paper aims to present the legal tools used by the Austrian legislature to exert control over the federal government and its members, particularly the role of the commission of inquiry and its position in the system. The assumed research hypothesis is that the scope and efficiency of legislative oversight of the executive in Austria have increased due to the strengthened position of the parliamentary minority. The key factor was the 2014 Constitutional Amendment allowing the opposition to propose issuing a commission of inquiry at the National Council. The paper consists of four parts. First, it describes the instruments of political control the Austrian parliament has at its disposal. Next, it analyses the application of the individual supervisory tools at the National Council in the years 2006–2021. The third part presents the procedure for issuing a commission of inquiry and its powers. The reflections are concluded by an analysis of the hitherto existing commissions of inquiry in the Second Republic in terms of their frequency, the scope of inquiry, proponents, and the duration and intensity of their work. The paper also seeks to answer the questions of the scrutiny potential of the National Council, the importance of commissions of inquiry in system practice in Austria and the possible political consequences of the changes to how the parliamentary commissions of inquiry are issued and how they function.

The rule of adequacy of financial resources to the local government's responsibilities is one of the basic rule of local government finance, which was expressed in Polish Constitution and in the European Charter on Local Self Government. Because of the fact, that the system of own resources of Polish local governments was not reformed since 2004 – any amendment causes decrease of their transferable resources (grants, subsidies) should be regarded as the inconsistent with the rule of adequacy and therefore – unconstitutional. Such nature has the new 80% limit for the amount of the specific grant from the State Budget to local government own tasks, which was introduced by Article 128 of Public Finance Act. The paper presents argumentation proving the above thesis and also raises an increasing problem of inadequacy of subsidies for the central government's task delegated to local authorities. ; Jedną z podstawowych zasad finansów lokalnych wyrażonych w Konstytucji RP i Europejskiej Karcie Samorządu Lokalnego jest zasada adekwatności zasobów finansowych społeczności lokalnych do przydzielonych im zadań. Ponieważ system dochodów własnych polskich jednostek samorządu terytorialnego nie był reformowany od 2004 r., wszelkie zmiany powodujące zmniejszenie wysokości ich dochodów transferowanych (dotacji i subwencji) należy obecnie uznać za sprzeczne z zasadą adekwatności. Zmianą taką z pewnością jest 80-procentowy limit wysokości dotacji celowej na zadania własne jednostek samorządu terytorialnego wprowadzony w art. 128 ustawy o finansach publicznych. Artykuł przedstawia argumentację na poparcie powyższej tezy, a także porusza wzrastający problem niewystarczalności dotacji celowych przekazywanych samorządom na zadania zlecone z zakresu administracji rządowej.

The article presents the Constitution of the Fifth French Republic from 1958 by showing fundamental principles of political system, the most important institution and the most essential amendments to the Constitution. According to the intention of its authors, the Constitution enhanced the position of the President of the Republic, whereas the role of the Parliament was less important. New political solution is the Constitutional Council, which is sui generis constitutional court. Amendments to the Constitution (particularly the reform from 2008) restricted the role of executive power, strengthened the political position of the Parliament and allowed France to integrate with the European Communities. ; Artykuł przedstawia Konstytucję V Republiki Francji z 1958 r. przez ukazanie podstawowych zasad ustroju państwa, najważniejszych instytucji państwowych i omówienie najistotniejszych zmian tej Konstytucji. Zgodnie z zamysłem twórców Konstytucja V Republiki wzmocniła pozycję prezydenta, natomiast osłabieniu uległa rola parlamentu. Nowym rozwiązaniem ustrojowym było stworzenie Rady Konstytucyjnej – instytucji pełniącej funkcję sui generis sądu konstytucyjnego. Nowelizacje Konstytucji (zwłaszcza ta z 2008 r.) przyczyniły się do ograniczenia roli władzy wykonawczej, dowartościowały rolę parlamentu oraz pozwoliły na integrację Francji ze Wspólnotami Europejskimi.

The author of the book analyzes the constitutional foundations of the government systems of modern Ukraine during the years 1917–2017. The book is devoted to the analysis of enacted constitutions, the complete or partial amendments to the constitution and the analysis of directions introduced or initiated changes.

The aim of the study is to draw attention to new forms of democracy that are decomposing modern parliamentarism. They break the link between the election of representative bodies (parliaments) and general elections. The introduced forms of citizen representation are based on the sampling method. It is a return to the roots of Athenian democracy and the political practice of national sovereignty. These innovative forms include deliberative democracy and participatory democracy. The most famous form of deliberative democracy are citizens' assemblies. The aim of citizens' assemblies is to develop a consensus and restore confidence in the non-party way of making political decisions. They try to solve important social and political problems. In Ireland, they led to a constitutional amendment. It was not only the media success of this new form of citizen representation. The use of the latest information and communication technologies is also reflected in contemporary parliamentarism. They contribute to the accumulation of information in the hands of the government. This increases its informal position. Against this background, the concepts of media democracy and smartphone democracy appear. These new phenomena also contribute to the decomposition of the parliamentarism of our time. ; Celem opracowania jest zwrócenie uwagi na nowe formy demokracji, które dekomponują współczesny parlamentaryzm. Rozrywają one związek pomiędzy wyłanianiem ciał przedstawicielskich (parlamentów) z wyborami powszechnymi. Wprowadzane formy reprezentacji obywateli opierają się na metodzie losowania. Jest to powrót do korzeni demokracji ateńskiej i politycznej praktyki suwerenności narodu. Do tych nowatorskich form należy zaliczyć demokrację deliberatywną i demokrację uczestniczącą. Najbardziej znaną formą demokracji deliberatywnej są panele obywatelskie. Celem paneli obywatelskich jest wypracowanie konsensusu oraz przywrócenie zaufania do pozapartyjnego sposobu podejmowania decyzji politycznych. Starają się one rozwiązywać ważne problemy społeczne i polityczne. W Irlandii doprowadziły do zmiany konstytucji. Był to, nie tylko medialny, sukces tej nowej formy reprezentacji obywateli. Stosowanie najnowszych technologii informatycznych i komunikacyjnych znajduje swoje odzwierciedlenie także we współczesnym parlamentaryzmie. Przyczyniają się one do kumulowania informacji w rękach rządu, co zwiększa jego nieformalną pozycję. Pojawiają się tu pojęcia demokracji medialnej i demokracji smartfonowej. Te nowe zjawiska przyczyniają się także do dekompozycji parlamentaryzmu naszych czasów.

Prescriptively included in the amendment to the codex of administrative process, the equality of parties rule embodies the widespread use of this directive based on constitutional rules and the courts' judicature. The equality of parties rule is a necessary element for the development of citizens' trust towards the public administrative bodies. The directive showcases the shift from vertical to quasi‑horizontal perspective of understanding the administrative relationship, that is towards more partnership. The amendment aims to introduce european standards to the polish legal order. The equality of parties rule facilitates the above by requiring the public authority to consider the opinion of the other side while settling cases and eliminating any signs of discrimination or unfair treatment of either side from the relationship. Per theoretical analysis of the directive to be introduced, a comparative treatment seems compulsory. Analysing the administrative procedure through the prism of civil and criminal proceedings allows the crystallisation of constitutional traits of the equality of parties rule. Moreover, it reveals the details distinguishing the administrative procedure on a comparative background.

The article aims to analize the nature and systemic implications of the constitutional reform carried out in the Italian Republic in 2020, which reduced the number of members of the chambers of parliament. It was the first revision of the Italian constitution since 2001 that was approved in a nationwide referendum, which was the condition for the entry into force of the amendment (two other constitutional revisions: from 2005 and 2016, were rejected in a referendum vote). The concept of rationalization of parliamentarism has been adopted as the leading theoretical reference in this text. The initial research question focused on to what extend the postulate of rationalization of the Italian parliamentarism was achieved by the way of undertaken initiatives to revise the constitutional order. The analyzes carried out allowed to formulate a proposal to explain the potential of rationalization of parliamentarism within the so-called partial reform in the face of failures in implementing comprehensive reforms.

This article presents the main ideas of constitutional reform, governments in Italy over the last thirty years. "Blocked Italian democracy" was looking for ways of overcoming the legal framework. Conceived the idea of the great constitutional reform in the late seventies. There are three main ways of that reform: 1) the establishment of the Constituent Assembly, 2) creating a bicameral committee on constitutional reform, 3) by art.138 of the Constitution for its revision. The first solution only enjoyed the support of the right of the political scene. But failed to establish three committees for the bicameral constitutional reform: in the years 1983–1985 A. Bozziego Commission, in 1992–1994 the Commission C. De Mita and N. Iotti, in 1997, the Commission M. D'Alema. Presented by reform projects have failed due to lack of agreement between the main political forces. Thus, the third way of constitutional reform became Article 138 of the Constitution. However, in cases where an amendment has been approved only by an absolute majority of both houses of parliament, it can be put to the vote in a referendum on ratification. Twice held such a constitutional referendum, once on the center-left proposals 7 October 2001 year, the second time against the center-right approach June 25–26, 2006. The last referendum did not obtain public support. So it seems that the idea of the great constitutional reform has failed to deep divisions between the main political parties.

The transformations of post-soviet republics that followed the collapse of the USSR created a need for new political, social and economic agreements to be drawn up to befit the new times. The reforming process of these realms of Ukrainian society's activity was reflected in the evolution of Ukrainian constitutional principles. The Ukrainian Constitution determines the political and administrative system of the state. The amendments proposed have favored either the President or the Highest Council, depending on the political situation in the country. Despite numerous attempts, the most important reforms of the system have still not been implemented in Ukraine, which is hardly conducive to the state's stability.
