Anayasa hukukunda seçme hakkı ; Voting right in constitutional law
Devletlerin iç hukuklarında, seçme hakkının da içerisinde bulunduğu belirli temel hak ve hürriyetler, anayasa ve ilgili kanunlar tarafından düzenlenme altına alınmış, sınırları tanımlanmış ve bireylere de etkili bir şekilde kullanım imkânı tanınmıştır. Seçme hakkının varlığı, demokratik bir seçim müessesinin bulunmasına bağlıdır. Demokratik bir seçimle iktidara gelmeyen yönetim, diktatör rejimin başlıca kaynağıdır. Seçme hakkı Türkiye'de sadece Türk vatandaşlarına tanınmıştır. Ancak seçme hakkı ile ilgili çağdaş düzenlemelerde yerleşik yabancılara yerel seçimlerde seçme hakkı tanınmasına yönelik bir eğilim söz konusudur. Seçme hakkı, Anayasalarda, bir temel hak ve özgürlük olarak düzenlenmiş ve kabul edilmiş haklardandır. Ancak seçme hakkı da toplumun bu haklar ile ilgili beklentisinin en adil yollardan sağlanması için diğer haklar gibi sınırlandırılabilmektedir. Demokrasi ile yönetilen ülkelerin olmazsa olmazı seçme hakkını kullanılmasının, kişilere külfet ve zahmet olacak şekilde yansıtılmaması ve seçme hakkının kullanılmasını teşvik eden yöntemler bulunması gerekir. Bu nedenle, ülkenin her toprağında, seçimlerin güvenli bir şekilde gerçekleşmesi sağlanmalı, seçmenler üzerlerinde etki ve baskı olmadan seçim sandıklarına gitmeleri ve tercihlerini özgür bir şekilde sandığa yansıtabilmeleri gerekmektedir. ; In the domestic law of the states, certain fundamental rights and freedoms, including the right to vote, have been regulated by the constitution and related laws, their borders have been defined and individuals have been given the opportunity to use them effectively. The existence of a right to vote depends on the existence of a democratic election institution. The government, which has not come to power with a democratic election, is the main source of the dictator regime. The right to choose is only granted to Turkish citizens in Turkey. However, there is a tendency towards the right to vote in the local elections for foreigners who are resident in the contemporary arrangements concerning the right to vote. The right to vote is one of the rights that are regulated and accepted as a fundamental right and freedom in the Constitution. However, the right to choose can be limited as other rights to ensure the society's expectation about these rights in the most fair way. The use of the right of choice for the countries which are governed by democracy should not be reflected in the way they are burdened and inconvenient, and there should be methods that encourage the use of the right to elect. Therefore, in every country of the country, elections should be ensured safely, voters should go to the ballot boxes without any influence and pressure and they should be able to freely reflect their preferences to the ballot box.

This dissertation reports on the research into Surinamese constitutional law during the military administration between 1980 and 1987. During this period of martial law there was neither an elected parliament nor any other form of authority with parliamentary legitimacy in Suriname. The research into the military administration is predominantly normative research into the formal constitutional arrangement of the Surinamese state during the 1980-1987 era. During the military period, historically developed principles and requirements of the rule of law and democracy were discarded either completely or in part, with some being completely absent and others remaining intact. This turnaround also brought about a fundamental change in the administrative structure and laws of Suriname. In addition, new legal institutions were added to the judicial system.During this period, the then ruling political powers argued that Suriname remained a constitutional democracy and that martial law was only a necessity under the circumstances. To assess to what extent there was democratic rule as well as the justification of the use of martial law, a study was conducted into the theoretics of constitutional democracy and martial law. States often are described as constitutional democracies; however, around the world there are differences as regards to what extent. To measure the degree of democracy, it is tested against internationally recognized frameworks enshrined in international conventions, treaties and doctrines. Theories on the subject of the constitutional democracy and martial law have been developed and fine-tuned over the years.
