Nearly three decades have passed since the collapse of the Soviet Union in 1991. At the time, the scholarly community was keen on joining Fukuyama in his belief in the "end of history" that was supposed to propel Russia away from the ideological "otherness" of the Soviet legal thought towards European liberal democratic values. The new spirit of optimism of 1991 had created a deceptive euphoria: Russia's dark legacies of Communism and authoritarian rule were seen merely as a bump on the road. Yet, the dream of united Europe from Lisbon to Vladivostok had failed to materialize.
Verfassungsrechtlich werden Bildung und Chancengleichheit in Deutschland von der Schulpflicht her gedacht, die wiederum als Ausdruck des staatlichen Bildungs-, Erziehungs- und Integrationsauftrags verstanden und bislang weitgehend mit einer Schulbesuchspflicht gleichgesetzt wird. Die in der Pandemie gesammelten Erfahrungen erschüttern diese Sichtweise und fordern zu einer Neubewertung der verfassungsrechtlichen Grundlage staatlichen Schulehaltens heraus. Sie ergibt, dass sich Schule rechtlich nicht mehr sinnvoll von der Schulpflicht, sondern vom Recht auf Bildung und einer (bedingten) Pflicht zu Bildung her denken lässt. School attendance duty is normally thought of as a corollary of the educational mission of the nation state. The experiences gathered during the Corona pandemic (such as distance learning) have shaken this conventional wisdom and should lead to an unbiased interpretation of the constitutional bases of state schooling. The article argues that, rather than compulsory schooling, the right to education and a (limited) duty to educate oneself is at the heart of the constitutional law framework for schooling. Welche Bedeutung haben die Rechts- und Geschichtswissenschaft füreinander? Diese Frage stellte sich Ernst-Wolfgang Böckenförde, der Staatsrechtler und Historiker, in seinem juristischen, verfassungshistorischen und rechtsphilosophischen Werk. Böckenförde zielte darauf, zwei Disziplinen, die in der institutionellen Auffächerung seit dem 19. Jahrhundert auseinandergestrebt waren, in einem gemeinsamen Interesse an der Erklärung von Zusammenhängen in der "Geschichte politisch-sozialer Entwicklungen" zusammenzuführen. Er fügte dabei methodische Perspektiven und theoretische Ansätze zusammen, die viele Historiker trennten: die politische Geschichte und die Sozialgeschichte, die Geschichte des Rechts und die der Gesellschaft. Für ihn waren dies durch ein übergreifendes Erkenntnisinteresse an "Strukturen" und "Ordnungsproblemen" miteinander zu verbindende Gegenstandsbereiche. In Anlehnung an Otto Brunner stellte Böckenförde Juristen und Historikern die gemeinsame Aufgabe, die "politisch-soziale Bauform einer Zeit" zu begreifen. Diesen Anspruch löste er durch einen seiner Zeit vorausweisenden hermeneutisch-wissenschaftsgeschichtlichen Zugang zum Staatsrecht wie zur Verfassungsgeschichte ein sowie in grundlegenden Beiträgen zu den "Geschichtlichen Grundbegriffen" und zur Geschichte der Rechts- und Staatsphilosophie. Ein wissenschaftliches Vermächtnis des im Februar 2019 verstorbenen Gelehrten liegt in der tiefen Einsicht in die Geschichtlichkeit und damit Zeitgebundenheit aller staatlich-rechtlichen Ordnung: Deshalb müssen Juristen die vermeintliche Überzeitlichkeit ihrer normativen Arbeitsgrundlagen in Frage stellen und Historiker das Recht als zentralen Gegenstand ihrer Wissenschaft begreifen. Ansonsten verstehen sie weder ihre Geschichte noch ihre Gegenwart. ; What do jurisprudence and historiography mean for one another? This was the question Ernst-Wolfgang Böckenförde, expert in public and constitutional law and historian, addressed in his writings on jurisprudence, constitutional history, and legal philosophy. Böckenförde endeavoured to bring together two disciplines – estranged since the nineteenth century by institutional diversification – in the common aim of explaining the big picture in the "history of politico-social developments". He coupled methodological perspectives with theoretical approaches that set many historians at variance: political history and social history, the history of law and that of society. For him, these areas of study shared an overarching cognitive interest in "structures" and "problems of order". Following Otto Brunner, Böckenförde set jurists and historians the common task of exploring the "politico-social design of an epoch". In tackling this challenge, he adopted a hermeneutic, intellectual-history approach to public law and constitutional history, making an innovational contribution to "basic historical concepts" and to the history of the philosophy of law and the state. The scholarly heritage of Böckenförde, who died in February 2019, lies in the profound insight he provided into the historicity and thus temporality, time-boundedness of all state legal order – obliging jurists to question any assumption that the normative basis for their work is timeless, and requiring historians to realize that law is a focal concern of their discipline. They will otherwise fail to comprehend both the past and the present of their field of study.
