V magistrskem diplomskem delu je predstavljena Konvencija Združenih narodov proti korupciji, prvi in edini univerzalni mednarodnopravno zavezujoči protikorupcijski instrument. Ta je rezultat večletnih naporov številnih držav in iskanja potrebnega konsenza za njeno sprejetje, danes pa ima že 182 pogodbenic. Konvencija obravnava preventivne ukrepe, inkriminacijo, kazenski pregon, mednarodno sodelovanje, povračilo premoženja, strokovno pomoč in izmenjavo informacij. Vzpostavljen je ocenjevalni mehanizem implementacije Konvencije, ki se v ciklih posveča vsem njenim določbam, tudi pravno nezavezujočim, katerih število in odsotnost strogega režima izvrševanja neizbežno pomeni, da Konvencija sama po sebi ne bo odpravila korupcije. Kljub temu državam nudi skupni okvir na katerega se lahko oprejo ter dodatno vzpodbudo za sodelovanje. Zato je ključno uporabiti in po potrebi nadgraditi regionalne mehanizme, ki lahko kakovostno dopolnjujejo cilje Konvencije. Končno poročilo prvega cikla ocenjevanja implementacije III. in IV. poglavja je za Slovenijo vzpodbudno. Izdana so bila določena priporočila, a hkrati prepoznani številni primeri dobre prakse. Učinki Konvencije bodo vidni postopoma, ko in če bodo države upoštevale izdana priporočila, počakati pa je treba še na zaključek drugega cikla in s tem pregled II. in V. poglavja. Za prihodnost brez korupcije je bistveno, da ob spoštovanju nacionalne suverenosti države ohranijo voljo za skupen mednarodni boj, Konvencija pa zaenkrat deluje kot dober skupni imenovalec na tej poti. ; This master thesis analyses United Nations Convention against Corruption, first and only universal legally binding anti-corruption instrument. The latter is a result of years of efforts made by numerous states in search of required consensus to adopt a document, which has 182 parties by now. Convention deals with preventive measures, criminalization, law enforcement, international cooperation, asset recovery, technical assistance and information exchange. An implementation review mechanism has been established, which will address all the Convention's provisions in cycles, including the non-binding ones. The number of those and lack of a strict enforcement regime inevitably means that Convention on its own cannot put an end to corruption. What is crucial, is a common framework for states to lean on and above all, encouragement for cooperation. Therefore it is vital to utilize and, depending on the needs, upgrade existing regional mechanisms, which can complement goals of the Convention. Final report of the first review cycle of the implementation of chapters III. and IV. is reassuring for Slovenia. Certain recommendations were made, but numerous examples of good practice were also recognized. Effects of the entire Convention will be seen gradually, when and if states follow issued recommendations, plus we need to wait for the end of the second cycle and with it the review of chapters II. and V. For a future without corruption it is crucial that states, while respecting national sovereignty, preserve their will for the joint international fight. And so far Convention works as a good common denominator on this path.

L'obiettivo è quello di mostrare la valenza economica del settore turistico del congressuale come risorsa socio-economica e possibile volano dell'economia di un intero sistema produttivo locale. La filiera del congressuale coinvolge una molteplicità di soggetti e segmenti industriali che se interconnessi in modo efficiente ed efficace sono in grado di generare: forti economie di scala, destagionalizzazione, valore aggiunto, incremento del PIL e aumento dell'occupazione.Nasce così l'esigenza di sviluppare una sinergia tra settore pubblico e privato, capace di garantire, attraverso un adeguata politica di supporto di lungo periodo, un maggiore grado di certezza e di concorrenza per gli operatori del settore congressuale italiano. Per tale scopo gioco un ruolo importante la creazione sul territorio pisano di un Convention Bureau con la forma di rete di imprese.Appare necessario da parte del settore pubblico avviare politiche strategiche che possano cogliere efficacemente l'eventuale ripresa futura dall'attuale situazione di crisi economica.

Recentemente si è assistito ad una costante crescita della sensibilità della tutela marina, alimentata dallo sviluppo tecnologico e dalla libera fruizione degli stessi per mezzo dei canali informativi. Attualmente non è sostenibile prendere delle decisioni politiche che prescindano dalle tematiche ambientali. Sono in atto dei cambiamenti irreversibili per i quali gli Stati sentono il dovere di prendere posizione affinché non possano essere lesi i diritti delle generazioni future. D'altro canto, negli ultimi anni si è assistito ad un incremento impressionante di traffico marittimo, legato anche al fenomeno del gigantismo navale e della globalizzazione. Sono state stipulate svariate convenzioni, per le quali l'Italia si è mostrata in prima linea come Paese guida, in materia di tutela dell'inquinamento marino da navi. Una recente convenzione, la Ballast Water Management Convention, ha posto l'attenzione sul fenomeno dell'inquinamento marino causato dall'introduzione, per mezzo delle acque di zavorra, di specie non indigene che intaccano l'ecosistema e minano la sopravvivenza della biodiversità. L'elaborato si propone di illustrare le modalità di tutela introdotte con la Convenzione e di analizzare i dati attualmente raccolti, ricordando che l'Italia non ha ancora ratificato la Convenzione.

Konvencija o pristupu informacijama, sudjelovanju javnosti u odlučivanju i pristupu sudstvu o pitanjima okoliša – Aarhuška konvencija – međunarodni je pravni okvir na području zaštite okoliša. Ova konvencija, pokrenuta pod pokroviteljstvom UN-a, najambiciozniji je pothvat kada je riječ o zaštiti okoliša. Njezinim usvajanjem ujedno je učinjen golem korak u razvoju međunarodnoga prava. Prihvaćajući načela i formalno pristupajući Aarhuškoj konvenciji, države naše regije (Jugoistočna Europa) zorno pokazuju da prava na području okoliša nisu luksuz rezerviran samo za bogate. Ovim se dokumentom utvrđuju prava u svezi s okolišem te čine pouzdan temelj za uključivanje najšire javnosti u politike okoliša čime se potvrđuje i naša obveza prema budućim pokoljenjima. To je dokaz kako se održivi razvoj može postići jedino uključivanjem svih sudionika u društvu. Aarhuška konvencija poveznica je između odgovornosti tijela javne vlasti i zaštite okoliša, jer se sudjelovanjem javnosti povećava odgovornost i transparentnost pri donošenju odluka, kao i svijest javnosti o pitanjima okoliša, a osigurava se i podrška za donesene odluke. Učinkovitim sudjelovanjem javnosti promiču se načela suradnje i konzultacija između građana i donositelja odluka, čime se pridonosi općoj demokratizaciji društva. To je omogućeno provedbom Aarhuške konvencije koja uključuje: pristup informacijama, sudjelovanje javnosti pri donošenju odluka i pristup pravosuđu kada je riječ o okolišu. To su ujedno i tri glavna stupa Konvencije. Prije dvanaest godina tadašnji je glavni tajnik UN-a Kofi Annan opisao Konvenciju kao "najambiciozniji pothvat na području 'okolišne demokracije' dosad poduzet pod okriljem Ujedinjenih naroda". Možemo reći kako je taj opis vjerojatno i danas točan, iako je na području okolišne demokracije došlo i do drugih znatnih pomaka. ; Convention on access to information, public participation in decision making and access to justice in environmental matters – The Aarhus Convention – is an international legal framework in the area of the environment protection. This convention, initiated under the auspices of UN, is the most ambitious venture as far as environment protection is concerned. Its adoption made at the same time a huge step in the international law development. Accepting the principles and formally accessing to the Aarhus Convention, countries from our region (Southeast Europe) show that rights in the environment protection area are not the luxury reserved only for the rich ones. This document defines the rights in the environment area and makes the reliable foundation for involving the general public in the environment policies which confirms our commitment to future generations. That is a proof that sustainable development can be achieved only by involving all participants in the society. The Aarhus Convention is a link between the authorities' responsibilities and environment protection, because participation of the public increases responsibility and transparency in decision making, as well as consciousness of the public about environmental matters. It also provides support for the made decisions. Efficient participation of the public promotes cooperation principles and consultation between citizens and decision makers, which contributes to general society democratization. That is enabled by the Aarhus Convention implementation which includes: access to information, participation of the public in decision making and access to jurisdiction when speaking of environment. These are at the same time three main Convention pillars. Twelve years ago the UN Secretary General Kofi Annan described the Convention as "the most ambitious venture in environmental democracy undertaken under the auspices of the United Nations". We can say that the mentioned descriptionis probably correct even today, although there have been many other significant improvements in environmental democracy.

2006/2007 ; Questa tesi indaga, sotto il riferimento teorico della Value Chain Analysis e della Teoria delle Convenzioni, i dispositivi di qualificazione di prodotto e le corrispondenti forme di coordinamento che gli attori del contesto produttivo caffeicolo brasiliano e del Minas Gerais hanno, nel corso della storia, adottato come strategia di sopravvivenza prima e, in seguito, di crescita. In questa analisi, particolare rilevanza viene data allo spazio e al ruolo della referenza territoriale, quale dispositivo di qualificazione del prodotto caffè e strategia di sviluppo nella storia caffeicola brasiliana. Il fine ultimo è di analizzarne una sua specifica dimensione, quella del terroir, presentandone concetti, definizioni, e mettendo in luce, in via descrittiva, possibili approcci per la sua caratterizzazione pedologico - spaziale. The preface aims at introducing some areas of comparison between Italy and Spain, by focusing on three thematic elements: the role of political parties in shaping the form of government; the legislative activity carried on by the executive as indicator and measure of political constitutional change; the fragmentation of traditional party system as a cause of government instability, and occasion for institutional innovation as well. The comparison leads to investigate the role of constitutional conventions in defining the form of government, so suggesting some methodological criteria for assessing their relevance. The final part, in line with the monographic issue, discusses the «open» future of democratic governments in Italy and Spain, suspended between constitutional rules and political dynamics. ; La prefazione introduce ad alcuni ambiti di comparazione tra Italia e Spagna, soffermandosi su tre nuclei tematici: il ruolo della variabile partitica nel plasmare la forma di governo; la normazione dell'esecutivo come spia e misura del cambiamento politico costituzionale; la frammentazione del sistema di partito tradizionale come causa della difficile stabilizzazione dell'indirizzo politico, e al contempo occasione di innovazione istituzionale. La comparazione porta a riflettere sul ruolo delle convenzioni costituzionali nel definire la forma di governo, suggerendone alcuni criteri metodologici per valutarne la rilevanza. La parte conclusiva si sofferma, in linea con le riflessioni del numero monografico, sulla sorte dei governi democratici in Italia e Spagna, sempre più «a fattispecie aperta» nella continua interazione tra assetto istituzionale e dinamiche politiche.

Autori u radu daju osvrt na postanak i razvitak stanarskog prava, te presjek domaćih pravnih propisa koji su se odnosili na stanarsko pravo, kao i propisa kojima je izvršena pretvorba stambenih odnosa. Pišu o značaju stupanja na snagu Zakona o najmu, kada je prestalo stanarsko pravo osobama koje su to pravo stekle prema ranijim propisima te su one po sili zakona postale najmoprimci (u pravilu, zaštićeni najmoprimci). Podsjećaju da pitanja vezana uz pretvorbu iz stanarskog prava u vlasništvo na stanovima te brojni sudski sporovi koji su proizašli iz te materije još uvijek nisu, niti stvarna niti sudska, prošlost. Autori navode stajališta i praksu Ustavnog suda Republike Hrvatske, te Europskog suda za ljudska prava (ESLJP). Posebno ističu presudu ESLJP-a Statileo protiv Hrvatske, u kojoj je Europski sud uvažio činjenicu da su hrvatske vlasti tijekom tranzicije bile suočene s teškim zadatkom stvaranja ravnoteže između prava najmodavaca i zaštićenih najmoprimaca koji su stanovali u stanovima dugo vremena, te je zaključio da u konkretnom slučaju nije postojala pravedna raspodjela socijalnog i financijskog tereta koji je nastao kao posljedica reforme u stambenom sektoru. Umjesto toga, prema ocjeni ESLJP-a, na podnositelja je stavljen nerazmjeran i pretjerani pojedinačni teret, budući da je morao snositi većinu socijalnih i financijskih troškova stambenog zbrinjavanja zaštićene najmoprimke i njezine obitelji, zbog čega je ESLJP utvrdio povredu članka 1. Protokola br. 1. ; The authors of this paper provide an overview of the creation and development of tenancy rights, and of the domestic legislation dealing with tenancy rights, as well as legislation that was used to reform tenancy relations. They mention the significance of the enactment of the Lease of Flats Act, when tenancy rights were withdrawn from persons who were entitled to that right pursuant to earlier legislation, and consequently, they became lessees (tenants) by force of law (generally, protected lessees). The authors recall that issues related to the transformation of tenancy rights into ownership of flats and to the numerous court cases that followed from this matter have not yet become either general, or court, history. The authors cite the positions and case law of the Constitutional Court of the Republic of Croatia, and of the European Court of Human Rights (ECtHR). They stress in particular the ECtHR judgment Statileo v. Croatia, where the ECtHR took into consideration the fact that the Croatian authorities during the transition were faced with the difficult task of striking a balance between the right of the lessor and that of protected lessees who had lived in the flats for a long time, and concluded that in the given case there was no fair distribution of the social and financial burden resulting from the reform of the housing sector. Rather, the ECtHR held that a disproportionate and excessive individual burden was placed on the applicant as landlord, as he was required to bear most of the social and financial costs of providing housing for the protected lessee and her family, due to which the ECtHR found a violation of Article 1 of Protocol no. 1.

Right of access to a court, enshrined in Article 6 § 1 of the European Convention on Human Rights and Fundamental Freedoms forms one of the basis for reinforcement of the principle of rule of law. However, the right of access to a court may be limited by provisions of national legislation regulating the functioning of the judicial system and rules of judicial procedure. The higher the hierarchy of the court, the more limits may be placed on the right of access to it. The aim of this article is to examine the different modalities of organisation of supreme judiciaries in European countries (members of the Council of Europe) and mechanisms established in national legislation for filtering applications to those jurisdictions in civil cases, in light of the principles set forth in that regard by the ever evolving case-law of the European Court of Human Rights, and the effects of its judgments and decisions on national legal systems. ; Right of access to a court, enshrined in Article 6 § 1 of the European Convention on Human Rights and Fundamental Freedoms forms one of the basis for reinforcement of the principle of rule of law. In this essay we propose a new interpretation of Bernardo Bertolucci's Last Tango in Paris (1972); starting from the Nietzschean categories of Apollonian and Dionysian, we would like to approach the topicality of both the socio-political and existential themes considered in the movie. In the analysis of the relationship between the social conventions that rule the dominant culture and the excess of life that gives itself as an irreducible rest, the stake is a possible emancipation from the logic of consensus. ; Il saggio propone una lettura di Ultimo tango a Parigi (1972) di Bernardo Bertolucci. La riflessione, condotta a partire dalle categorie nietzscheane di apollineo e dionisiaco, concerne l'attualità dei temi politico-sociali e esistenziali oggetto del film. Nell'analisi del rapporto tra le convenzioni sociali che regolano la cultura dominante e l'eccesso di vita che si dà come resto irriducibile, la posta in gioco è una possibile emancipazione dalla logica del consenso.

Il principale obiettivo della tesi è dimostrare come la connessione tra i differenti livelli giuridici che riguardano le relazioni tra Stati membri dell'UE richieda un'interpretazione sistematica delle convenzioni contro le doppie imposizioni intracomunitarie, ed in particolare richieda l'applicazione della clausola della nazione più favorita. ; The main goal of this thesis is to demonstrate how the connections between different juridical levels in the relationship between Member States of the European Union requires a systematic interpretation of the intra-EU double tax conventions, in particular the obligation of the most-favoured-nation treatment. The starting point is a dualistic interpretation of the non-discrimination principle; considered both as an obligation of equal treatment on the national level and an application of the most-favoured-nation clause. These principles are investigated in the context of intra-EU relationships and furthermore in the light of the main objective of the EU, i.e. to build an Internal Market. The analysis of the above-mentioned principle is considered in relation to the network of intra-EU double tax conventions, which are inspired by reciprocity due to their bilateral nature and other legal levels which operate in such context, namely the EU and the WTO. In fact, the exclusion of the direct taxation from the competences of the EU and, consequently, exclusive competence that the EU Member States have to negotiate and sign double tax conventions, cannot give to them the opportunity to provide every kind of rules. In particular, according to the CJEU case law, EU Member States must comply, on one side, with EU law and especially with the four market freedoms that cannot be restricted by international bilateral agreements based on reciprocity and, on the other side, with international obligations derived from the WTO (whose parties are EU Member States and the EU too). By contextualizing intra-EU double tax conventions in a EU internal market law-logic, this thesis has demonstrated that the existence of a most-favoured-nation clause enforceable to the provisions of such double tax conventions is the obvious consequence of a systematic EU interpretation.
