One of the most pressing issues in the world today is the protection of children's rights. A major event in this area was the adoption of the 1989 UN Convention on the Rights of the Child. At the time of the development and adoption of the Convention, Ukraine and Azerbaijan were part of the USSR. However, the Ukrainian SSR, unlike the Azerbaijani SSR, was the primary founding member of the United Nations and therefore participated in the development and adoption of the UN Convention on the Rights of the Child, like Turkey, whose observers also participated in this process. This article examines the participation of Ukraine, Azerbaijan and Turkey in the development and adoption of the 1989 UN Convention on the Rights of the Child. However, the adoption and ratification of the Convention is only the first step in the realization of children's rights at the national level. The national special laws of Ukraine, Azerbaijan and Turkey in the field of protection of children's rights are also studied. This article concludes on the different direction of the special laws of these countries. Moreover, there are some differences in the content of the laws, namely some of them includes not only rights, but also the duties of the child. The state of protection of children's rights in Ukraine, Azerbaijan and Turkey is a priority and urgent issue in the state policy of these countries and needs to be improved. The conclusions provide recommendations for improving the legislation of these countries. ; Исследуется участие Украины, Азербайджана и Турции в разработке и принятии Конвенции ООН о правах ребенка 1989 г. Анализируется деятельность представителей и наблюдателей Украины и Турции в деятельности рабочей группы комитета ООН по правам человека по подготовке текста Конвенции. Также исследуются национальные специальные законы Украины, Азербайджана и Турции в сфере защиты прав детей. The system of international acts that apply to the organization of the activities of units of the NCB Interpol is revealed. It is noted that the system of international legal acts is the basis for the development and adoption of relevant national legislation aimed at improving the activities of the National Central Bureau, developing methods and forms of international police cooperation, taking a set of measures to combat and combat transnational organized crime. which are committed with the use of modern technologies and pose both a domestic and international threat to law and order. The Department of International Police Cooperation is a structural unit of the National Police of Ukraine, whose activities are carried out directly in close cooperation between the International Criminal Police Organization Interpol and Europol. That is why international normative legal acts ratified by Ukraine play a particularly important role in fulfilling the set tasks and achieving the goals of such activities. The international acts that apply to the organization of the activities of units of the NCB Interpol include: Charter of the International Organization of Criminal Police - INTERPOL; European Convention on the Extradition of Offenders; European Convention on Mutual Assistance in Criminal Matters; Convention on Legal Assistance and Legal Relations in Civil, Family and Criminal Matters; Cybercrime Convention; United Nations Convention against Transnational Organized Crime. The article reviews the problem of illicit turnover in tobacco products. It is revealed that the illegal transference of tobacco products through the customs border is international in nature. The analysis of some international normative legal acts concerning the illicit turnover of tobacco products (Vienna Convention, Kyoto Convention, Johannesburg Convention and Nairobi Convention) has been carried out. The World Health Organization Framework Convention on Tobacco Control was also considered. The place and role of these documents in counteracting the illegal turnover of tobacco products through the customs border as one of the key components of the said treatment is determined. It has been established that joining the above-mentioned Conventions ensures not only the joint adoption and observance of the principles, standards and norms of international customs law, but also promotes the development of cooperation between national customs administrations on counteracting the violation of customs legislation on the illicit turnover of tobacco products. The necessity of constant thorough study and deep analysis of international legal acts and their changes, peculiarities of integration processes in the fi eld of customs, scientifi c researches and system research of priority trends of development of international and national customs legislation is indicated. ; В статье сделан обзор проблемы незаконного оборота табачных изделий. Установлено, что незаконное перемещение табачных изделий через таможенную границу носит международный характер. Проведен анализ некоторых международных нормативноправовых актов относительно незаконного оборота табачных изделий (Венской, Киотской и Йоханнесбургской Конвенции и Конвенции Найроби). Также рассмотрено Рамочную конвенцию Всемирной организации здравоохранения по борьбе против табака. Определено место и роль этих документов в противодействии нелегальному перемещению табачной продукции через таможенную границу как одной из ключевых составляющих указанного обращения. Установлено, что присоединение к упомянутым конвенциям обеспечивает не только совместное принятие и соблюдение принципов, стандартов и норм международного таможенного права, но и способствует развитию сотрудничества между национальными таможенными администрациями по вопросам противодействия нарушением таможенного законодательства по незаконному обороту табачных изделий. Указано на необходимость постоянного тщательного изучения и глубокого анализа международных нормативно-правовых актов и изменений к ним, особенностей интеграционных процессов в области таможенного дела, научных поисков и системного исследования приоритетных тенденций развития международного и национального таможенного законодательства. ; У статті здійснено огляд проблеми незаконного обігу тютюнових виробів. З'ясовано, що незаконне переміщення тютюнових виробів через митний кордон носить міжнародний характер. Проведено аналіз деяких міжнародних нормативно-правових актів щодо незаконного обігу тютюнових виробів (Віденської, Кіотської та Йоганнесбурзької конвенцій та Конвенції Найробі). Також розглянуто Рамкову конвенцію Всесвітньої організації охорони здоров'я із боротьби проти тютюну. Визначено місце і роль цих документів у протидії нелегальному переміщенню тютюнової продукції через митний кордон як однієї з ключових складових зазначеного обігу. Встановлено, що приєднання до згаданих конвенцій забезпечує не лише спільне прийняття та дотримання принципів, стандартів і норм міжнародного митного права, а й сприяє розвитку співробітництва між національними митними адміністраціями з питань протидії порушенням митного законодавства щодо незаконного обігу тютюнових виробів. Вказано на необхідність постійного ґрунтовного вивчення і глибокого аналізу міжнародних нормативно-правових актів та змін до них, особливостей інтеграційних процесів у галузі митної справи, наукових пошуків та системного дослідження пріоритетних тенденцій розвитку міжнародного та національного митного законодавства.

The article examines the formation of international standards in the field of environmental protection, as well as clarifying their impact on modern environmental legislation of Ukraine. It is established that the issue of the need to protect the environment has been actively discussed at the interna-tional level since the middle of the twentieth century. The first international environmental organization was found-ed in October 1948 in France (International Union for Conservation of Nature), which still operates today.It was found that although international instruments such as the Universal Declaration of Human Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms do not contain provisions on environ-mental rights, there is still a human right to a standard of living that supports its health. It is from the standpoint of the right to life, the right to health and the right to information that the ECtHR deals with matters concerning a safe environment for humans.It is substantiated that special international acts in the field of environmental protection began to be adopted in the 70s of the last century (including: Convention on the Prevention of Marine Pollution by Discharges and Other Materials, International Convention for the Prevention of Pollution from Ships, Convention on Transboundary Air Pollution distance, the Vienna Convention for the Protection of the Ozone Layer was adopted, the European Charter on Environment and Public Health, the Basel Convention on the Control of Transboundary Movements of Hazard-ous Wastes and Their Disposal, the Convention on Environmental Impact Assessment in a Transboundary Context, etc.).These international acts have influenced the formation of legislation in the field of environmental protection of independent Ukraine, especially on the example of acts adopted in 2017-2020. The proposal of scientists on the need to adopt a new systematized act in Ukraine, in particular the Environmental Code, has been studied.It is substantiated that when reforming the environmental legislation of Ukraine it is necessary to pay special attention to the requirements of the Association Agreement with the EU, namely to implement the provisions of a number of Regulations and directives of the European Union. ; У статті досліджено становлення міжнародних стандартів у сфері охорони довкілля, а також з'ясування їх впливу на сучасне екологічне законодавство України.Встановлено, що питання необхідності захисту охорони довкілля активно обговорюється на міжнарод-ному рівні із середини ХХ ст. Перша міжнародна організація з охорони довкілля була заснована ще в жовтні 1948 р. у Франції (Міжнародний союз охорони природи), яка діє до цього часу.Виявлено, що хоча у таких міжнародних актах як Загальна декларація прав людини та Конвенція про захист прав людини і основоположних свобод не містяться положення про екологічні права, все ж є право людини на такий рівень життя, що підтримує її здоров'я. Саме з позиції права на життя, права на здоров'я та права на інформацію ЄСПЛ розглядає справи щодо безпечного довкілля для людини. There are no special jurisdictional bodies in Ukraine responsible for the comprehensive regulation problem of kidnapping.There is no mechanism for supporting and rehabilitating the affected family and the returned child. The issuesof abduction of children should be considered taking into account psychological, social and geopolitical aspects – thiswill allow not to miss the integrity of the phenomenon and lead to an effective solution to key problems. The abduction of children is a special social phenomenon lying in the plane of several sciences and several branches of lawof the entire international community.This issue will be considered not only in the context of jurisprudence, or legislative regulation. It is necessary tosolve the problems of abduction of children taking into account psychological, social and geopolitical aspects – thiswill allow not to miss the integrity of the phenomenon being studied, which willead to the effectiveness of solving keyproblems. The abduction of children is a separate social phenomenon lying in the plane of several sciences and several branches of law of the entire international community.This article will be written by several hypotheses:The abduction of children is an international problem, a separate institution that requires attention, knowledgeand control in several areas: psychological, social, legal.The need to single out a common concept of child abduction and to separate the concept of child abductionin the criminal and civil law aspects at the level of EU legislation, as well as to create a structure for the institutionof child abduction, is the way to structure and, therefore, increase the legislative mechanism for protecting childrenin the world.The need to strengthen cooperation between special bodies authorized to deal with the problems of the returnof children, including the creation of special bodies dealing with the problem of the return of children and their psychological rehabilitation after return. ; В настоящее время очень остро встает вопрос о проблемах похищения детей. Статистика подтверждает,что такое явление, как похищение детей – носит чрезвычайный характер: по данным Еврокомиссии, ежегоднов странах ЕС пропадают 250 тысяч детей, то есть 1 ребенок – каждые 2 минуты. В Украине отсутствуют специальные юрисдикционные органы ответственные за комплексное регулирование данной проблемы; нет механизмаподдержки и реабилитации пострадавших семьей и возвращенного ребенка. Похищение детей – это особоесоциальное явление, лежащее в плоскости нескольких наук и нескольких отраслей права всего международногосообщества.В исследовании будет проведен анализ правового регулирования основных законодательных актов странЕС и Украины, рассмотрены проблемы практической реализации механизма Гаагской Конвенции 1980 года,предложено максимально единое понятие «похищения детей», рассмотрены проблемы судебного рассмотрениядел такой категории ; Нині дуже гостро встає питання про проблеми викрадення дітей. Статистика підтверджує, що таке явище, яквикрадення дітей – має вкрай небезпечний характер. За даними Європейської комісії, щорічно в країнах ЄС пропадають 250 тисяч дітей, тобто 1 дитина – кожні 2 хвилини. В Україні відсутні спеціальні юрисдикційні органи, щовідповідають за комплексне врегулювання даної проблеми; відсутній механізм підтримки та реабілітації постраждалих сімей та повернутої дитини. Викрадення дітей – це особливе соціальне явище, що знаходиться в площірегулювання декількох галузей права.Стаття присвячена аналізу правового регулювання основних законодавчих актів країн ЄС та України, розглядупроблем практичного застосування Гаагської Конвенції 1980 року, запропоновано поняття «викрадення дітей»,розглянуті проблеми судового розгляду справ такої категорії.

The United Nations Convention against Corruption is the only legally binding universal anti-corruption instrument. This Convention was ratified by the Verkhovna Rada of Ukraine on October 18, 2006. Article 8 of the UN Convention against Corruption reads that each State Party shall endeavour, where appropriate and in accordance with the fundamental principles of its domestic law, to establish measures and systems requiring public officials to make declarations to appropriate authorities regarding, inter alia, their outside activities, employment, investments, assets and substantial gifts or benefits from which a conflict of interest may result with respect to their functions as public officials.The Ukrainian legislator decided not to restrict himself to disciplinary measures specified in the Convention in the case of failure to file declarations by state officials, but also introduced the administrative and criminal liability for committing such acts.The features of the objective side of the crime "Declaring the false information" are considered. The article reveals the features of the objective side of this crime and highlights some of the discussion points about their installation.The objective side of the crime "Declaring the false information" is the deliberately filling the appropriate electronic form by a subject of declaring in one's personal electronic cabinet in the Unified State Register of Declarations of Persons with information: 1. An annual declaration until 00 hours 00 minutes on April 01, the year following the reporting year; 2. The declarations of the person who ceased activities related to the performance of functions of the state or local self-government until 00 hours 00 minutes on April 01, the year following the reporting year in which the activity was terminated; 3. or these declarations within 90 calendar days from the date of arrival at the place of military service or the day of completion of military service specified in Part 2, Article 24 of the Law of Ukraine "On Military Duty and Military Service".The article argues that the submission of a declaration by a person applying for a position related to the performance of functions of the state or local self-government due to the lack of public danger of such an action and declaration in the case of termination of activity, since there is no statutory deadline for filing such declaration in case of termination of activity, makes it impossible to state unconditionally the timeliness of such a submission do not contain the crime "Declaring the false information".We believe that the method of declaring the false information is the deliberately filling the appropriate electronic form by a subject of declaring in one's personal electronic cabinet in the Unified State Register of Declarations of Persons with information that does not show the objects of declaring or reduced their value by more than 250 subsistence minimums for able-bodied persons. ; Розглянуто ознаки об'єктивної сторони злочину «Декларування недостовірної інформації». З урахуванням положень регуляторного законодавства, поглядів вітчизняних науковців розкрито ознаки об'єктивної сторони цього злочину, а також наголошено на деяких дискусійних моментах щодо їх встановлення. Аргументовано позицію, що об'єктивна сторона злочину, передбаченого статтею 366-1 Кримінального кодексу України «Деклару­вання недостовірної інформації» не охоплює неподання декларації особою, яка претендує на заняття посади, пов'язаної з виконанням функцій держави або місцевого самовряду­вання через відсутність суспільної небезпеки такого діяння та декларації в разі припинення діяльності, оскільки відсутність законодавчо визначеного терміну подання декларації в разі припинення діяльності унеможливлює безумовну констатацію несвоєчасності такого подання. Запропоновано способом вчинення умисного декларування наперед недостовір­них відомостей вважати умисне заповнення відповідної електронної форми суб'єктом декларування у власному персональному електронному кабінеті у Єдиному державному реєстрі декларацій осіб інформацією, в якій не відображено об'єкти декларування або зменшено їх вартість на суму понад 250 прожиткових мінімумів для працездатних осіб.

Modern international human rights treaties may envisage the rights of states, which participate in these treaties, to derogate from contractual obligations under emergency circumstances. The existence of the right to derogate (based on the provisions of the law of the state right to withdraw from the fulfillment of certain contractual obligations) has a significant impact on the state behavior in the field of ensuring and protecting human rights.On May 21st,2015,Ukraine used this right as a member of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as the Convention), Art. 15 of which establishes the right to derogate from obligations in emergency situations, which led to a closer study by scientists of the question of the derogation right.The normative consolidation of the right to a derogation, in particular in Art. 15 of the Convention treats the possibility of the existence of an objective necessity to reduce the level of protection of human rights and freedoms. Contemporaneously with consolidating the right of the state to the derogation, these provisions of the law contain conditions designed to prevent the unjustifiably wide application of this very right.According to the basic requirements, which are contained in Art. 15, first of all, it is enshrined that the right to withdraw from the state's obligations can arise only due to the war or another public danger threatening the life of the nation.The next key requirement is that measures taken by the state in derogation from their obligations should strictly correspond to the severity of the situation.The third requirement is the inadmissibility of the extension of the right to derogate to the rights, the protection of which is guaranteed by the polls, the list of which is given in Art. 15 of the Convention.Also these measures should not contradict other obligations of the state in accordance with the International Law.And, indisputable is the condition of compliance with the procedural requirements, enshrined in Sect. 3 of Art. 15 concerning the official public announcement of the derogation, which contains some information about the measures taken by the state and the reasons for taking them.Compliance with the requirements, mentioned above, will be served, in particular, by the activities of the Temporary Consultative Body of The Cabinet of Ministers of Ukraine Multiagency Commission on the questions of Ukraine derogation from the duties regarding the Covenant on Civil and Political Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms, which was established on April 19th, in accordance with the Resolution of the Cabinet of Ministers of Ukraine.The activities of the Commission will help to prevent the abuse of the right of the State to derogate from certain obligations defined by the Covenant and the Convention and unreasonable reduction of the level of human rights protection and freedoms as the matter of fact that Ukraine may use this right. And at the same time, as it is rightly suggested in the publications, considering the Court practice, it may be advisable for the applicants to formulate appropriate complaints even in situations in which they are possible due to the derogation of Ukraine, whereas it is the Court that will ultimately assess the derogation and the necessity for taking certain measures under circumstances, existing in the occupied territories of Ukraine and in some areas of ATO (anti-terrorist operation). ; Статья посвящена отступлению Украины от отдельных обязательств, определенных Международным пактом о гражданских и политических правах и Конвенцией о защите прав человека и основных свобод. Contemporaneously with consolidating the right of the state to the derogation, these provisions of the law contain conditions designed to prevent the unjustifiably wide application of this very right.According to the basic requirements, which are contained in Art. 15, first of all, it is enshrined that the right to withdraw from the state's obligations can arise only due to the war or another public danger threatening the life of the nation.The next key requirement is that measures taken by the state in derogation from their obligations should strictly correspond to the severity of the situation.The third requirement is the inadmissibility of the extension of the right to derogate to the rights, the protection of which is guaranteed by the polls, the list of which is given in Art. 15 of the Convention.Also these measures should not contradict other obligations of the state in accordance with the International Law.And, indisputable is the condition of compliance with the procedural requirements, enshrined in Sect. 3 of Art. 15 concerning the official public announcement of the derogation, which contains some information about the measures taken by the state and the reasons for taking them.Compliance with the requirements, mentioned above, will be served, in particular, by the activities of the Temporary Consultative Body of The Cabinet of Ministers of Ukraine Multiagency Commission on the questions of Ukraine derogation from the duties regarding the Covenant on Civil and Political Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms, which was established on April 19th, in accordance with the Resolution of the Cabinet of Ministers of Ukraine.The activities of the Commission will help to prevent the abuse of the right of the State to derogate from certain obligations defined by the Covenant and the Convention and unreasonable reduction of the level of human rights protection and freedoms as the matter of fact that Ukraine may use this right. Modern international human rights treaties may envisage the rights of states, which participate in these treaties, to derogate from contractual obligations under emergency circumstances. The existence of the right to derogate (based on the provisions of the law of the state right to withdraw from the fulfillment of certain contractual obligations) has a significant impact on the state behavior in the field of ensuring and protecting human rights.On May 21st,2015,Ukraine used this right as a member of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as the Convention), Art. 15 of which establishes the right to derogate from obligations in emergency situations, which led to a closer study by scientists of the question of the derogation right.The normative consolidation of the right to a derogation, in particular in Art. 15 of the Convention treats the possibility of the existence of an objective necessity to reduce the level of protection of human rights and freedoms. The article researches development of trust property institute in continental law states and investigates possible development of national legislation in this sphere. The article also characterizes modern state of trust property in Ukraine and proposed models of its improvement. In all researched continental law states it is possible to trace personal way of development of trust property institute as well as a special mean of trust implementation. Approaches of foreign legislators distinguish and can be seen in implementation of single-level and two-level changes. The first one is ratification of the Hague Trust Convention (Italy) as well as enshrining of its own trust like constructions (France, Germany). Two-level changes are represented by first Ratification of the Hague Trust Convention and then adoption of special acts to regulate legislative collisions in regulation of trust relations (Switzerland). The article has also researched prospects in development of Ukrainian national legislation. Draft laws which are registered in the Verkhovna Rada of Ukraine and consider trust property as one more way to ensure performance of duties along with other ones provided for by p. 1 of Art. 546 of the Civil Code of Ukraine such as forfeit, bailment, guarantee, collateral/pledge, retention, deposit (down payment) have been investigated. Reasons for enlarging legislation on trust relations through ratification of conventions and creation of a wide legal regulation of the researched sphere have been provided.

The article deals with the problem of recognition of international war against global terrorism as international armed confl ict in the meaning of the Geneva conventions. It argues that application of the right to self-defence as justifi cation for military interventions by the US, as well as urgent need to regulate the antiterrorist operations and secure human rights make it possible and necessary to grant the status of the international armed confl ict to the war against terrorism by drafting an additional protocol to the Geneva conventions. ; В статье рассматривается проблема признаниямеждународной борьбы против глобального терроризма вооруженным конфликтом международного характера в значении Женевских конвенций. Указывается, что неудовлетворительное правовое регулирование военных антитеррористических операций и необходимость обеспечения соблюдения прав человека, делают необходимым предоставление борьбе с международным терроризмом статуса конфликта международного характера путем принятия дополнительного протокола к Женевским конвенциям.
