Раздел "Международное право" - рубрика "Международное частное право" ; В статье автор стремится проиллюстрировать различные подходы к идее заключения многосторонних налоговых конвенций, а также перспективы развития идеи заключения многосторонних конвенций об избежании двойного налогообложения. В современном глобализирующемся мире логичным представляется стремление государств регулировать международные вопросы на многостороннем, а не на двустороннем уровне. Под эгидой Организации по экономическому сотрудничеству и развитию ведется работа по замене двусторонних инвестиционных соглашений одним многосторонним соглашением по инвестициям. Избежание двойного налогообложения по-прежнему регулируется в подавляющем большинстве случаев двусторонними соглашениями. Хотя нельзя исключить такого развития событий, при котором некоторые аспекты международного налогового регулирования все же будут облачены в форму многосторонней конвенции. Скорее всего, это произойдет сначала на региональном уровне, на территории государств, объединенных в экономические блоки, например в странах Европейского союза. = The article aims to review and illustrate various approaches to the idea of concluding multilateral tax conventions as well as the prospects for the multilateral conventions to be an alternative to avoid double taxation. The globalizing world makes it logical for countries to try to regulate international issues on the multilateral, not bilateral level. Work is underway under the aegis of the Organization for Economic Cooperation and Development to replace bilateral investment agreements by multilateral agreements on investments. Double tax avoidance is still regulated by bilateral agreements in most cases. But developments can be foreseen, when some aspects of international tax regulations will assume the form of a multilateral convention. It is likely to happen at the regional level first, with the countries belonging to an economic bloc, like the European Union, for instance.
The relationship between economic development, energy consumption and the environmental issues is complex. However, energy law is based on reciprocal benefits for governments while environmental law is based on common interests and erga omnes. Studies have shown that despite the implementation of several energy and environmental conventions at international levels, the situation of global environmental conditions is critical. Different concepts and conflicting interests between the energy supply system and environmental protection have led to poor implementation of some conventions. The present study examined some existing rules and regulations on energy and the environment and identified the strengths and weaknesses of the descriptive-analytic method. The purpose of investigating these conventions is to decrease the weaknesses and increase the strengths. The strengths can then be used for environmental concerns and international obligations of states under the rules of erga omnes to protect the environment and sovereignty of states for jurisdictional and energy management within national boundaries. The investigations revealed the characteristics of an international convention to decrease conflicts of interest between the energy supply system and environmental protection. In addition, two facilitator mechanisms are proposed for effective implementation of the international convention on energy and the environment.
В статье рассматриваются проблемы гарантирования прав осужденных и лиц, отбывших наказание и освобожденных от него, с учетом конвенционных норм. Проанализированы нормы Конвенции ООН против пыток и других жестоких, бесчеловечных или унижающих достоинство видов обращения и наказания (1984 г.), Конвенции Совета Европы о защите прав человека и основных свобод (1950 г.), Минимальных стандартных правил ООН в отношении обращения с заключенными (Правил Нельсона Манделы (2015 г.) и других международных актов, гарантирующих права осужденных. Показаны проблемы формирования российской пенитенциарной политики в сфере ресоциализации осужденных. Предложены пути совершенствования норм уголовно-исполнительного законодательства об основных средствах исправления, направленных на ресоциализацию осужденных после отбывания наказания: о воспитательной работе, общественно полезном труде, профессиональной подготовке и общественном воздействии. Предложено в уголовно-исполнительном законодательстве предусмотреть профилирование исправительных учреждений под определенные виды производственной деятельности, в том числе на основе государственно-частного партнерства. Сделан вывод о необходимости кооперирования производственной деятельности в учреждениях уголовно-исполнительной системы с аналогичной производственной деятельностью в иных организациях в целях дальнейшего трудоустройства осужденного в этих организациях. ; The article deals with the problems of guaranteeing the rights of convicts and persons who have served a sentence and have been released from it, taking into account conventional norms. The norms of the UN Convention against Torture and Other Same-Wanted, Inhuman or Degrading Treatment or Punishment (1984), the Council of Europe Convention for the Protection of Human Rights and Fundamental Freedoms (1950), the UN Standard Minimum Rules for the Treatment of prisoners (Rules of Nelson Mandela (2015) and other international acts guaranteeing the rights of convicts. The problems of formation of the Russian penitentiary policy in the field of re-socialization of convicts are shown. The ways of improving the norms of the criminal-executive legislation on the main means of correction aimed at the re-socialization of convicts after serving the sentence: educational work, socially useful work, vocational training and social impact are proposed. It is proposed in the penal legislation to provide for the profiling of correctional institutions for certain types of production activities, including on the basis of public-private partnership. The conclusion is made about the need to cooperate production activities in the institutions of the penitentiary system with similar production activities in other organizations in order to further employment of the convicted person in these organizations.
No one shall be subjected to torture, cruel, inhuman or degrading treatments or punishments (Art. 5, The Universal Declaration of Human Rights and the Convention for the protection of Human Rights and fundamental freedoms). Torture significantly undermines and violates fundamental human rights, humiliates human dignity and basic values in modern society. An extremely important and relevant conclusion is that torture is recognized as one of the most serious crimes of all time, and even more so in the present time. We draw attention to the fact that torture is prohibited by both international legal norms and national legislation. The analysis of this problem is the research topic of this article.
The article describes the provisions of the Customs Code of Ukraine with regard to their compliance with regulatory rules of the Kyoto Convention. The author researches the issues of improving the legislation of Ukraine concerning customs procedures in order to implement the standards of the international convention on a larger scale. ; В статье рассмотрены положения Таможенного Кодекса Украины с точки зрения их соответствия нормативным правилам Киотской Конвенции. Автор исследует вопросы улучшения законодательной базы Украины касательно таможенных процедур с целью реализации стандартов международной конвенции в более широком масштабе.
This article addresses the issue of implementation to the legislation of the Republic of Uzbekistan certain provisions of Article 53 of the UN Convention against Corruption on criminal assets recovery in terms of permitting foreign state to initiate civil suits in the courts of the member states to establish ownership of property acquired through corruption offenses. The author analyzed the existing mechanism for filing civil claims for recognition of ownership of assets by foreign states in the courts of the Republic of Uzbekistan, as well as solving civil suit within criminal proceedings.

Раздел "Международное право" - рубрика "Права человека" ; В статье анализируется вклад БССР в международный нормотворческий процесс в области защиты прав женщин. Будучи полноправным членом Организации Объединенных Наций, Белорусская ССР внесла определенный вклад в развитие принципа равноправия на международном уровне (в том числе и по признаку пола). Принцип равноправия стал одним из основополагающих принципов ООН. Белорусская делегация принимала активное участие в разработке Всеобщей декларации прав человека, выдвигая конструктивные предложения, улучшающие содержание ее проекта. Всеобщая декларация прав человека послужила платформой, на основе которой стали разрабатываться международные договоры, предусматривающие специальные нормы, регламентирующие права женщин как определенной социальной группы. Кроме того, БССР, являясь на протяжении длительного времени членом Комиссии по положению женщин, участвовала в разработке большей части специальных международных соглашений по правам женщин, таких как Конвенция о политических правах женщин, Конвенция о гражданстве замужней женщины, Конвенция о согласии на вступление в брак, брачном возрасте и регистрации браков. Благодаря продвижению делегациями БССР антидискриминационных принципов в области регулирования вопросов равноправия мужчин и женщин, конвенции установили универсальные стандарты отношения государственной власти к женщине, а их нормы стали базовыми при толковании национального законодательства. ; The article explores the contribution of the BSSR to international rule-making process in the sphere of women rights protection. A UN's full member, the BSSR made a certain contribution to the development of the principle of equality, including gender equality, on the international level. That was the beginning of forming of the institution of women rights protection in the system of international human rights protection. The principle of equality has become one of the basic principles of the United Nations. Belarusian delegation took an active part in the development of the Universal Declaration of Human Rights, making constructive proposals on improving the content of Declaration' draft. The Universal Declaration of Human Rights became the foundation for further international treaties, which included specific regulations on women's rights. Besides, a member of the Commission on the Status of Women for a long time, the BSSR participated in developing of the major part of special international treaties, such as Convention on the Political Rights of Women, Convention on the Nationality of Married Women, Convention on Consent to Marriage, Minimum Age for Marriage and Registration of Marriages and other, in the sphere of women's rights. Thanks to Belarusian delegation's efforts in elimination of discrimination in gender equality regulation, the Conventions set universal standards of state authorities attitude towards women. Nowadays these standards are grounds for interpretation of national legislation.
The Johannesburg Convention on Mutual Administrative Assistance in CustomsMatters as of 2003 is a crucial breakthrough and important legal tool for theimplementation of risk analysis systems by customs authorities governed by the the WorldCustoms Organization (WCO) around the globe. However it has not entered into force yet.Is this new legal tool failing early? The old Nairobi Convention from 1977 is outdated andhas never been widely accepted. This paper addresses the need for mutual Customs assistance, a common legal basisand analyses the current situation. The author underlines the idea that the JohannesburgConvention recognises the increased global concern for the security and facilitation of theinternational trade supply chain, and that offences against customs law are prejudicial tothe security of the Contracting Parties and their economic, commercial, fiscal, social, publichealth and cultural interests. It also recognises that the international exchange ofinformation is an essential component of effective risk management and that such exchangeof information should be based on clear legal provisions. The author also points out that though mutual customs assistance is possible on thebasis of the Nairobi Convention or on the basis of bilateral agreements and other binding ornon-binding WCO and/or UN legal tools, the Johannesburg Convention would make thingsbetter, clearer and modern. In conclusion the author argues that in case the JC is not going to be ratified by mostcountries the overall aim of a more secure supply chain is about to fail due toadministrational hindering and hesitating governments. The methods used during the study are analysis, synthesis, comparison,generalization, systematic and functional analysis. ; Йоханнесбургская конвенция о взаимной административной помощи втаможенных делах, подписанная в 2003 году, является существенным достижениеми важным правовым инструментом для внедрения систем анализа рисковтаможенными органами под эгидой Всемирной таможенной организации (ВТамО) повсему земному шару. Однако, принимая во внимание тот факт, что данная конвенцияеще не вступила в силу, возникает закономерный вопрос: является ли она новымправовым инструментом, который уже на начальном этапе оказалсянеэффективным? Опыт показывает, что Найробийская конвенция от 1977 года насегодня устарела и так никогда не была широко принята. Исходя из вышесказанного, в данной статье автор рассматриваетнеобходимость взаимной таможенной помощи и общей правовой базы, а такжепроводит анализ текущей ситуации. Автор подчеркивает, что Йоханнесбургскаяконвенция подчеркивает важность вопросов безопасности и упрощения процедурмеждународной цепи поставок товаров, а также определяет нарушениятаможенного законодательства как такие, которые угрожают безопасностисторон договора и их экономическим, коммерческим, финансовым, социальныминтересам, а также вопросам здравоохранения и культуры. Она такжепредусматривает, что международный обмен информацией является важнымкомпонентом эффективного управления рисками, и что такой обмен долженосновываться на четких правовых положениях. Автор также утверждает, что хотя взаимная административная помощь втаможенных вопросах возможна на основе Найробийской конвенции или на основедвусторонних соглашений и других, обязательных или необязательных правовыхинструментов ВТамО и/или ООН, Йоханнесбургская конвенция включаетусовершенствованные, четкие и современные положения. В заключение автор делает вывод, что в случае, если Йоханнесбургскаяконвенция не будет ратифицирована большинством стран, общая цель,заключающаяся в более безопасной цепочке поставок, не будет достигнута. В ходе исследования использовались следующие методы: анализ, синтез,сравнение, обобщение, системно-функциональный анализ.
Раздел "Международное право" - рубрика "Международное гуманитарное право" ; В статье раскрывается значение статьи 3 Женевских конвенций 1949 г., впервые регламентировавшей защиту жертв внутренних вооруженных конфликтов. Основываясь на положениях Женевских конвенций, решениях Международного суда ООН, доктрине международного гуманитарного права, автор подчеркивает императивность и универсальную применимость статьи 3 Женевских конвенций. В статье исследуются проблемы, возникающие при применении статьи 3 Женевских конвенций в силу отсутствия в международном гуманитарном праве развернутого определения внутреннего вооруженного конфликта. = The article reveals the significance of Article 3 of the 1949 Geneva Convention which was the first to regulate protection of the victims of internal military conflicts. The author underlines the imperative nature and universal applicability of Article 3 on the basis of the Geneva Conventions provisions, the UN International Court verdicts and the international humanitarian law doctrine. The article investigates the issues that arise during application of Article 3 of the Geneva Conventions due to the absence of a detailed definition of the internal military conflict in humanitarian law.
The article analyzes the work of the psychological and pedagogical support service for students in school education, key areas of activity and their relationship with the principles of the Convention on the rights of the child.The analysis of the PPS service shows the need for its legislative consolidation in the Convention. ; В статье анализируется работа службы психолого-педагогического сопровождения учащихся в рамках школьного образования, ключевые сферы деятельности и соотношение их с принципами Конвенции о правах ребенка. Анализ службы психолого-педагогического сопровождения показывает необходимость ее законодательного закрепления в Конвенции.

Несмотря на то, что Европейская конвенция по правам человека 1950 г. напрямую не предусматривает охрану художественных выражений, Европейский суд по правам человека признал, что свобода творчества также пользуется конвенционной защитой. При этом свобода творчества как одна из форм свободы выражения мнения обладает существенными гарантиями от необоснованного посягательства со стороны государства. = The article examines the case law of the European Court of Human Rights with regard to artistic freedom. Notwithstanding that the 1950 European Convention on Human Rights does not directly provide for protection of artistic expressions, the European Court of Human Rights acknowledged that artistic freedom also enjoys conventional protection. Artistic freedom, as one of the form of freedom of expression, has significant guarantees against unwarranted encroachments from government.
Раздел "Международное право" - рубрика "Международные организации" ; Конвенция о расширении трансграничного сотрудничества, в частности, в борьбе с терроризмом, трансграничной преступностью и нелегальной миграцией была подписана 27 мая 2005 года в г.Прюм (Германия). Ее участниками стали 5 государств-основателей Шенгенской интеграции (страны Бенилюкс, Франция и ФРГ), а также Австрия и Испания. В силу этого Прюмская конвенция уже получила название Шенген-III. Положения Конвенции обеспечивают более тесное сотрудничество в области сбора, хранения и обработки данных (ДНК, отпечатков пальцев, регистрационных данных транспортных средств) на основе «принципа доступности информации», – нового правового явления на Европейском континенте. Полицейское сотрудничество в рамках данной конвенции обеспечивает максимально допустимое на сегодняшний день взаимодействие органов внутренних дел, вплоть до проведения совместного патрулирования и выполнения полицейскими служащими своих обязанностей на территории другого государства-участника конвенции. Конвенция легализует практику применения «воздушных маршалов» на борту воздушных судов. Также положения Конвенции идут дальше других правовых актов в целях обеспечения совместных действий государств-участников в борьбе с нелегальной миграцией, в частности в том, что касается обмена информацией, выявления фальшивых документов и проведения совместных акций по репатриации. Вступление в силу Прюмской конвенции 2005 года, а также возможная последующая интеграция ее положений в правовую систему ЕС будут иметь огромное значение для развития интеграции государств ЕС в области правосудия и внутренних дел. = The Convention on stepping up cross-border cooperation, particularly in combating terrorism, cross-border crime and illegal migration was signed on May 27, 2005 in Prüm (Germany). The contracting parties are all 5 states-founders of Schengen co-operation, as well as Austria and Spain. Therefore the Prüm convention has already acquired a second name: Schengen-III. The Convention provides for closer co-operation in area of gathering, storing and processing the data (DNA, fingerprints, vehicle registration data) on the basis of the "principle of availability of information", a new phenomenon on the European continent. Police co-operation under the Convention provides for every joint effort of the police authorities, even joint patrolling and carrying out police duties on the territory of another contracting party of the Convention. The Convention creates the legal grounds for employing «sky marshals» on board of airplanes. The Convention also goes far beyond other legal acts to provide for joint operations of the contracting parties in fighting illegal migration; in particular, in the areas of information exchange, forged documents detection and conduct of joint repatriation operations. Entry to force of the Prüm Convention and further possible integration of its provisions in the legal framework of the European Union will have an important impact on the prospects of integration of the EU Member States in the area of Justice and Home Affairs.
The object of the master's work is public relations that arise in connection with the use of artificial intelligence and possible violations of human rights in the context of the European Convention on Human Rights. The purpose of the work is to study possible violations of human rights in the context of the European Convention on Human Rights in connection with the use of artificial intelligence. The tasks of the master's work: to determine the concept of artificial intelligence and to identify the challenges that makes the application of artificial intelligence; to consider the European Convention on Human Rights as the main instrument for protecting the right to privacy; on the basis of judicial practice to analyse the problem of privacy of personal life, guaranteed by Article 8 of the ECHR, in connection with the use of artificial intelligence. There were used the dialectical method, the methods of formal logic, the comparative legal method, the system method and other methods of cognition. The European Convention on Human Rights establishes human rights and freedoms, obliging each member country that has ratified this agreement to guarantee them. Many governments and regions recognize the fundamental nature of the rights protected by Article 8 of the ECHR. The use of artificial intelligence is fraught with a number of dangers and legal problems. It leads to a narrowing of the sphere of privacy and there's the need to establish at the legislative level the conditions for the limits of its application. The closer AI programs get to human skills – thinking and creativity, the more damage will be done to human rights protected by Art. 8 ECHR. It is necessary to find the right balance between technical development and the protection of human rights.
