"Obwohl die Existenz transnationaler Gemeinschaften in der Globalisierungsforschung immer mehr anerkannt wird, bleibt deren Einfluss auf globale Steuerung und Regulierung immer noch größtenteils im Dunkeln. Studien über die Rolle transnationaler Gemeinschaften im Bereich internationaler Regulierung konzentrieren sich meist auf spezifische Typen, wie epistemische Gemeinschaften, soziale Bewegungen oder politische Netzwerke, und beschränken deren Effekte auf Agenda-Setting oder Framing von Themen. In diesem Papier wählen wir eine breitere Perspektive. Wir untersuchen regulatorische Effekte, die entstehen, wenn verschiedene Typen von transnationalen Gemeinschaften mit einem gemeinsamen Ziel gleichzeitig sämtliche Phasen des Regulierungsprozesses durchlaufen. Der empirische Teil des Papiers konzentriert sich auf transnationale Regulierung im Bereich des Urheberrechts. Konkret untersuchen wir transnationale Gemeinschaften, die Beschränkungen des vorherrschenden Urheberrechtsregimes angesichts neuer Informationstechnologie zu überwinden suchen. Auf Basis einer Längsschnittstudie zeigen wir, wie eine epistemische Gemeinschaft und eine soziale Bewegung rund um die gemeinnützige Organisation 'Creative Commons' interagieren und so unvorhergesehenen Schwung in ihrem Regulierungsprojekt auslösen. Diese Dynamik erzeugte funktionale ebenso wie verborgene Effekte. However, the system is complex, with a multiplicity of licenses options, formats and versions available, including translations into different languages and adaptation to specific legislations towards versions that are declared compatible with each other after an international porting process. It should be assessed whether all licenses cover exactly the same subject matter, rights, and restrictions or whether small language differences may have an impact on the rights actually granted, ensuring legal security of current users or availability of works for future generations to access and build upon. As different licenses have different phrasing, differences may change the content of the grant and its substantial conditions, thereby affecting users' expectations and threatening the validity of the consent along the modification chain. Possible sources of legal uncertainty and incompatibility - as well as their actual or potential consequences on the validity and enforceability of the licenses across jurisdictions with different and possibly inconsistent legislations - need to be evaluated. This study presents the different licenses (chapter 2), identifies various possible sources of legal incompatibility (chapter 3), evaluates their actual impact (chapter 4) and finally proposes recommendations (chapter 5) to mitigate risks and improve compatibility, consistency, clarity, and legal security by restructuring and simplifying the system.

The website Creative Commons went online in December 2002 to counter shifts towards an 'intellectual property' conception of copyright in American law dominant since the 1970s. This conception equates creative work with property per se, eclipsing the previously dominant American framework of copyright as a monopoly limited in duration. This legal shift in turn ties in with a concentration in the American media and fear among media corporations that the internet will undermine their dominant market position. Yet this very media concentration removes such issues from broadcast debates, a fact that combines with the complex technical nature of Creative Commons' arguments to undermine public understanding of their position. By presenting a social history of the site and an overview of how it operates, the relation of the site's work to media concentration and the future of representative democracy is clarified.
