The article is devoted to the study of the peculiarities of advertising creativity. Creativity as a problem for analysis has always been of interest to sociologists, psychologists, economists. In recent decades, the economy of experience has been popular and has been in demand. The economy of experience involves the active use of emotions, emotional creativity, which is called to form an advertising message that is interesting to consumers. However, despite numerous studies of the problems of creativity by representatives of various sciences, some aspects of its use, for example, in advertising, are still insufficiently studied, which determines the topicality of the work. The aim of the article is to identify the features of formation advertising creativity. Measurements (indicators) of creativity (fluency, flexibility, originality, elaboration, semantic flexibility, figurative flexibility, spontaneous flexibility) and their examples in advertising are considered. Features of emotional creativity are analyzed, which may include the development or modification of standard emotions to better adapt to the needs of the individual / group or the development of new forms of expression of emotions. Examples of Ukrainian advertising practices illustrating the use of tools for formation of creative content according to J. Goldberg are given: unification tool, activation tool, metaphor tool, subtraction tool, extreme consequence tool, absurd alternative tool, inversion tool, extreme effort tool. The criteria of creativity are noted: novelty, efficiency, authenticity, and all three of these criteria work only together. The question of the efficiency of advertising creativity is considered: the most famous formula for the impact of advertising product AIDA provides answers to questions about the functions of creativity in advertising - to attract attention, create an emotional response and as a result interest, create a need, stimulate to action. This focuses on the emotional component, emphasizing that without emotion, the chain of effectiveness of the advertising message will not work. It is noted that at each stage of the impact of advertising, creativity can be both functional and dysfunctional. Functional, ie one that contributes to the ultimate goal of advertising – to sell a product / change the pattern of behavior (for social advertising) creativity may be under certain conditions. The conditions of functional and dysfunctional creativity are indicated. Consideration of the conditions of functionality of the advertising creativity allowed us to highlight its features. These are: relevance of the advertised product; adaptation to consumer needs, namely: conformity with consumer values; heterogeneity: the type of creativity may differ depending on the target audience, the stage of the product life cycle and the advertising message; focus on ethical norms. The line between creativity and insults, discrimination can be sensitive. Emotional perception is a key factor in the communicative efficiency of the advertising message.

Introduction. The article is devoted the musical impression which became the inalienable constituent of the original creation of European symbolists of the end XIX to beginning XX of the century on the background of the European tendencies. Oleksandr Oles and European symbolists brought the idea of the "inner individual". They revolted against the world and the public and government norms.Purpose. The revelation of the musical images, which creates the metaphorical universe, filled with symbols of the human existence.Methods. The methods of the research is based on the main principles of the philological analysis of the text. The determined tasks foresee the use of elements of comparative and hermeneutic analysis as a general interpretation of literary texts.Originality. The originality of the system of the artistic images, motives, spirits, rhythm and melodic absorbed the powerful lyricism of the poets' sensitive soul. The creativity of Oleksandr Oles, European symbolists are marked by the influence of the romantic poetics. The most important component of which were the lyrical mood and the melodiousness of the phrases, that created the individual image of the spiritual being on the way to the beauty and dream.Results. The radical change in the formation of european thinking, that determined the representation of the image of the world as a vivid and dynamic organism, that can be known only by intuition and fancy, was still in Romanticism in contrast to versus rationalistic and empirical philosophy of Enlightenment. Based on the new concept of the world and of human being, the transition from Enlightenment to Romanticism led to the revaluation of the ideological and aesthetic principles. In the 1820-th years, when the conceptual basis of romantic art appeared for the first time in french and german literature, his adherents defined it as «parnassian atheism» and «the doctrine of literary freedom».The dominating idea of the romantic attitude was the liberation of literary standards, the idea of «nationality», the rebellious of the individualism, the perception of the nature through imaginative and emotional contrasts, the interest in the old legends, the folklore and the appeal to the national antiquities. The lyrical spirit of Romanticism denied its existence in the close frameworks of the rationalistic aesthetics of Enlightenment, because the romantic artist needed the air, the space, the magic of the last, the witchcraft of the distant horizons, the majestic scenery of the history and the nature.Oleksandr Oles considered the art to be the most consummate variety of the perception and drew the truth of life from the book of nature, placing the poetry as a form of self-expression, that shouldn't take into consideration the traditional models and is programmed to open the human soul, the mysteries of the space and the contradictions in the society. The motion of the poetic thought, the search for the imagination, the passions of the lyrical feelings were the basis of the pantheistic world-view in the works of Oleksandr Oles, suggested by the beauty of the nature of the native country. The important role in understanding of the ukrainian poet's world-view is the attention to the floral symbols, representing the original projection of the human world on the world of plants. The images of the flowers had the symbolic and significative meaning, that reflected the national specificity of the literature and represented the most significant features of the ethnics. Therefore, the interest in the floral symbolism created the unique musical images in the poetic imagination of the artists, which were the result of the interaction of the human being with nature – source of the creative inspiration, the peace and the harmony. The flowers which have become the object of the worship and the amulets in the familiar and calendar rituals, witnessed the profound wisdom and philosophy of every nation in all its complex and contradictory unity.Oleksandr Oles fascinated the beauty of the nature, which gave him the soul equipoise and caused the poetic inspiration. The combination of the diverse memoirs and impression indicate the intertextual richness of the poetic associations of the ukrainian poet. The individual experiences of Oleksandr Oles embodied in the symbols of the flowers, that gave rise to the birth of the new ones, filled with different content figurative modifications. It is primarily about the organic unity of the light ethereal source (sun), the soul of the plants and the artist as the personification of the creative bloom of the vitalistic flowering of the nature's forces. The important feature in the works of Oleksandr Oles played the elements of the landscape: the nature was not just depicted, it was felt by the poet, merged, contrasted with feelings, mood, state of his soul, expressed the melancholy, the boredom, the thoughts.Conclusion. The structure of the world of Oleksandr Oles built on the binary oppositions, that outlined two spheres of his experience, based on the complexity and diversity of human being and nature. The beauty of the environment for ukrainian poet became an expression of the acquisition of his own soul, which sank into the dynamics of the life, which was love, hope, faith and the irrational and fatal force at the same time, that brought the suffering and the death.
In the article, the author considers the question of the criterion of creativity (originality) as a condition of protectability of subject matter of copyright. It is indicated that the current civil legislation does not provide an understanding of the creative activity (originality) of the work. At the same time, the case law is based on the principle that the creative component in subject matter of copyright is presumed. Nevertheless, the question of the creative nature of the work may arise in the event of a dispute. In addition, an understanding of the criterion of creativity is necessary during the examination process. The criterion of creativity (originality) of the work is analyzed from the point of view of the subjective approach – through the prism of expression of the author's individuality, the reflection of his personality, and objective approach, which is based on the presence of objective novelty. The author concludes that today the majority in both scientific circles and actually in the judicial practice of disclosing the criterion of creativity is carried out through the subjective approach. The signs are given in the presence of which we can assume that the work has a creative (original) nature. It is noted that in order to recognize a work as original, there is no need for the form of expression to be absolutely original, and to have any features of previously created works (for example, citations, etc.), but only a certain level of creative individuality of the author in the work is enough. The question of determining the level of originality of the form of expression of the work is analyzed, namely, what should be the minimum component of originality in order to recognize the existence of a creative nature and extend to the work the regime of copyright protection. It is indicated that in each case, for different types of works, the assessment of the originality of the work is different and is determined for each work separately, taking into account its features. The study of the criterion of ...

The development of a democratic society, effective economy and legal state in Ukraine turned out to be a much more difficult matter than it was expected. On the background of dramatic collisions, problems and difficulties of nowadays, in the context of extreme transformation of social links, global erosive changes in culture and moral sphere, it is especially difficult to think about the creativity as a part of a spiritual world of personality. Because only through creativity which is considered by the community and supported by the government, a person shows his/her need to create, overcomes daily routine, realizes his/her life targets, goes from today into the future with the help of new discoveries. As spiritual world of a person extends, theoretical and practical aspects of his/her actions are getting more distinguished. The interrelation between the creativity and personality in the process of spiritual world and outlook formation is considered on the socio — philosophic examples.
The article presents the scientific and theoretical analysis of the legal regime of the invention, especially the acquisition of patent rights for inventions, as well as the scope and content of exclusive patent rights for inventions in foreign countries. It is generally recognized that the most common and significant result of scientific and technical creativity are inventions with high social and economic significance, which necessitated the legal regulation of relations related to the creation, design and use of inventions. The term "invention" in the human mind reflects a reality that exists independently of law, since the invention is not a legal but a natural- technical category and the creation of inventions, as well as their use, has not always been associated with legal regulation. The term "invention" in technical, philosophical, and fiction refers to something new, original (new technology, construction). In patent law, this term has a narrower and strictly defined content: here we are talking about a legally significant, patentable invention, therefore, in the specialized literature they speak about an invention in a technical sense and about an invention as an object of legal protection. It follows that a person who considers himself an inventor can officially be recognized as such only if a patent for the invention is obtained. This title of protection shall be issued if the object requested to be recognized as an invention meets the patentability criteria established by law. The acquisition (registration) of patent rights to an invention requires the passage of a number of formalities, and quite complex. The purpose of this article is to analyze the mechanism of legal protection of inventions in foreign countries, taking into account the unification of international and European legislation in the field of patent law, as well as to reveal the features of the procedure for acquiring (registering) patent rights to inventions in foreign countries.

The national origins of musical artifacts (in the composership, as well as in performance) in many cases are the inherent implication that determines the particularities of the concepts, image systems, the composition and the structure of musical integrity, as well as the character of the special means selected by an artist to embody nuances of meaning. Each nation has a specific mentality, which embodies the facets and nuances of the conscious character and of the "collective unconscious" (Jung), expressed as a specific characteristics of the ethnic group in general: mental sets, worldview images, automatic actions, patterns of behavior, associations and others.Features of mentality are determined by the configuration of the ethnic dominants, by cognitive and emotional benchmarks, which include: geographical and climatic conditions, language, nuances of synesthesis, stereotypes of national character and behavior, national feeling of time and space, religious and contemplative world settings, historical and political factors, cultural traditions, rituals, etiquette, fashion and so on.It is difficult to study the mentality because of its integrity and the specific nature of the system. The initial element of this system is a combination of factors that form the specific relationships between themselves, while saving the factor of heredity. These relationships can be transformed, causing the inclusion (or exclusion) of certain elements in the system while maintaining the inherent shape of the overall configuration. Therefore, to identify the particularities of the national logic, we need to compare the integrity of the being of one nation with the same integrity of the other. When you create certain conditions and establish the contextual links, the etno-differentiative contextual factors may acquire the status of national mental determinants of musical creativity. For example, vocal orientation of Italian art is determined by:- features of the Italian speech (non-reduced vowels, clear articulation and the active work of the entire speech apparatus, the prevalence of open syllables, the alteration of vowels and consonants, the match between the intonation contour of the utterance and the original code of the articulation complex, a significant range of the speech sound, the permanent emphasis which provides the rhythm of the sound, the presence of numerous hiatuses, many double consonants which create the physiological precondition of the high palatal position, high speed speech which forms virtuosity in the process of performance and in the conditions of musical perception);- paralinguistic factors (active gestures and facial expressions);- specific climate (warm sunny climate determines muscular freedom, lack of pinches in the singing apparatus);- historical features of formation of bel canto school, the rich vocal tradition that existed in the Roman Church, and others.Musical mentality is also presented as a multi-level system of many elements of the musical text (from the tone, the single sound, to the dramatical and conceptual opus features or performing artifact), which, due to the subsign nature of musical speech (M. Bonfeld), can selectively "respond" to the manifestations of qualities (or properties) of the national mentality. Moreover, the etno-differentiative features of the musical mentality may be a more general phenomena: the tradition of music-making, the main genres, the factors of synesthesis, the dominant emotional and psychological characteristics of musical images and the tendencies of their implementation, etc. Thus, the term "etno-differentiative musical properties" denotes the subsigns of the musical language – the elements of musical text, the properties of musical expression, the nuances of the scenic behavior, musical traditions and trends which:1) while actualized at some moment in some context, acquire the status of the value;2) while perceiving and reflecting the specific etnomental context, represent the national musical mentality. To indicate the actual time of response, of the communication between the systems of "national mentality" and of "music mentality", at the point (or in the area) of intersection of their semantic fields, we offer the term "mental-semantic resonance." The phenomena of mental-semantic resonance can occur in any versions of combinations of the subsystems and their individual elements. We develop the concept of "representative type of art" proposed by J. Melchakova with introducing its' purely musical projections: 1) The representative genre: a genre of music that symbolizes features of the national music culture. For Spain, for example, the representative genres are flamenco and cante hondo. The musical and expressive specificity of these genres became the basis of hispanisms which embody the "Spanish dream" in other national cultures. 2) Representative type of music: the type of musical communication that is predominant for the national musical culture. For example, the representative type of music in Sweden is the choral singing.Representative national musical culture types (genres, types of music, etc.) are the basis of the etnomental music model, a kind of "emanation of mentality" (L. Gumilev) that stimulates the international interest in this phenomenon. We term the energetic and the charismatic phenomena the emanation of the mental field in music (passionate image of Spain, meditative image of the East, the charm of French chanson, etc.) that give rise to echoes and imitations in a foreign musical cultures. Therefore, in the article the author's theoretical concept of national mental determinants of musical creativity is proposed and its' nature is explored. Musical mentality is considered as an integral variable system in the light of its determinism of national mental factors. Within etnomental approach, the concept of "musical speech" (as a potential (composer's work) or topical (performing interpretation) expression) is interpreted as a way of displaying the nuances of national mentality in musical creative activities.

Future teachers of Mathematics in Bulgaria and Great Britain, studying in higher education, also receive the basics of creative development, but in fragments, not systematically, because among the knowledge and competencies the development of certain personal creative qualities of future teachers is presented.
The article provides an attempt to follow the development of the concept of creativity in the history of philosophy and the history of culture as a whole. It also explores the role of religion and science in the development of this concept. The creativity is usually defined as a process of creation of something new (very often it is added that it must be «new in quality»). But it would be just an attempt to see the new without its connection to the old and declare it the main feature of the creativity. In our opinion, it is impossible to form the concept of creativity by enumerating the features of the process of creation. In this way, it is only possible to describe the process, but it will not help to understand creativity. The formation of the concept of creativity is possible only through its genetic definitions that have been developed in the framework of so-called «activity approach».The author investigates the subject from the point of view of dialectical and historical materialism. However, he criticizes the position of naturalistic materialism on the matter. Moreover, the author highlights the positive impact of idealistic dialectical tradition on solution of the problem in the framework of philosophy. Also, he emphasizes the importance of political economy for practical solution. The author points out that the only adequate form of creativity is a collective creation of history. It has always been this way. However, providing social orders that are based on division of labour, creation of personality and history happened rather defying conscious actions of people, than as a result of them. Thus, creativity was understood as a supernatural or extra-natural ability. Now, it's time to secularize and demystify the creativity. It has to be returned to its real source — to the social activity of people. However, it's impossible unless we bring the understanding of nature of creativity up to the level of the philosophical concept. Only this can become a reliable basis for creation of the real program of making creativity a usual way of person's life in society.

The article studies the main characteristics of A. Averchenko as a writer in the pre-revolutionary, post-revolutionary and emigration periods of his creativity, which was initially divided into journalistic feuilletons and two groups of humorous stories – every day with common life situations and works with grotesque and paradoxical plots. In later works during his emigration, the writer became a master of satire and humour at the European level. It is established that many of his works created in exile reached the level of world classics or were innovative in genre and style. The article defines A. Averchenko's creative activity – organizational (as an editor and administrator of «Satyricon» and «New Satyricon»), literary (as a prolific author of humorous/satirical stories) and theatrical (as a director, screenwriter and actor of theatres «The House of Artist» and «The Nest of Migratory Birds»). It was found that the writer had a humorous attitude to life, including ridicule of his shortcomings. He is best characterized through public communication – his interviews, speeches, and private correspondence. It is concluded that the artist's activity satisfied his vital need not only to be at the forefront of creative development of Russian and European literature but also to create a team of like-minded, talented authors, provide a fruitful atmosphere of creative work, fight censors, arrange financial success of print or theatre, as well as to conduct journalistic activities, to be a master of the feuilleton, who keeps his hand on the pulse of political events in the country and abroad, has observation and analytical skills.
