Reserved contracts are a legal instrument that allows the promotion of those economic operators who, as part of their business, pursue also social goals. Pursuant to Article 22 (2) of the Act of 29 January 2004 – Public Procurement Law (Journal of Laws 2018, item 1986 as amended), they may only be applied for by sheltered workshops and other economic operators whose activities include the social and professional integration of members of socially marginalised groups. Unfortunately, the use of reserved contracts is in practice marginal, which is also caused by difficulties in interpretation of national laws. The article discusses the institution of reserved contracts and the terms of application thereof, in the context of the EU legislation. ; Zamówienia zastrzeżone są prawnym instrumentem pozwalającym promować tych wykonawców, którzy w ramach prowadzonej działalności realizują także cele społeczne. O ich udzielenie, na gruncie art. 22 ust. 2 ustawy z dnia 29 stycznia 2004 r. – Prawo zamówień publicznych (Dz.U. 2018, poz. 1986 z późn. zm.), mogą ubiegać się wyłącznie zakłady pracy chronionej oraz inni wykonawcy, których działalność obejmuje społeczną i zawodową integrację osób będących członkami grup społecznie marginalizowanych. There are about 2.2 million prisoners in the USA. It is generally viewed that this number is a result of a too severe penal system connected with the introduction of the absolute intolerance for drug crimes policy. But not only gang members and drug dealers are doing time in prison, this system also applies to war veterans. In 2012, there were 181,500 veterans behind bars, especially participants of the recent wars. Most of them face problems with addiction or struggle with permanent unemployment, homelessness or psychological disorders. This phenomenon is alarming because veterans as a privileged group have a social, medical, education cover and all capabilities not to break the law. Veterans as former soldiers, disciplined and well familiar with criminal law, who received ethics and international humanitarian law training courses, from practical point of view should not break the rules stated by the legal system. The image of former veterans who served their country, totally disagree with penitentiary statistics. Recent years have shown that military service, especially in the area of conflict, may become a double-edged sword, and in fact veterans may pose a threat to society.
Artykuł dotyczy poziomu dostosowania ustawodawstwa ukraińskiego do norm Unii Europejskiej w zakresie oceny oddziaływania na środowisko. W materiale poddano analizie główne dokumenty unijne i ukraińskie przede wszystkim: dyrektywę Parlamentu Europejskiego i Rady 2011/92/UE z dnia 13 grudnia 2011 r. w sprawie oceny skutków wywieranych przez niektóre przedsięwzięcia publiczne i prywatne na środowisko, dyrektywę 2001/42/WE Parlamentu Europejskiego i Rady z dnia 27 czerwca 2001 roku w sprawie oceny wpływu niektórych planów i programów na środowisko, oraz ustawę Ukrainy o ekspertyzie ekologicznej. The subject of considerations are the legal aspects of the influence of the EU climate and energy framework and trade policy on implementation of permanently sustainable forestry. Even though forestry belongs to the competences of Member States and there is no formal establishment of common forest policy in the TFEU, the new LULUCF Regulation and provisions of regulations regarding prevention of illegal timber trade prove that there is an ongoing process of subjecting forestry to the competencies of the European Union to a growing extent as well as reducing the area left to Member States. It must be stated that the platform for expansion of EU regulations on Member States' forestry in terms of land use and timber trade – acts adopted within the trade policy and climate and energy framework – is the principle of sustainable development that derives from international legislation and is also included in the Constitution of the Republic of Poland. This principle is also the foundation for development of the beginnings of common forest policy that emerges at the verge of EU policies. ; Przedmiotem rozważań są prawne aspekty wpływu unijnej polityki klimatyczno-energetycznej oraz handlowej na realizację trwale zrównoważonej gospodarki leśnej. Mimo zaliczenia gospodarki leśnej do kompetencji krajów członkowskich i braku formalnego ustanowienia wspólnej polityki leśnej w TFUE nowe rozporządzenie LULUCF oraz przepisy rozporządzeń dotyczących przeciwdziałania nielegalnemu obrotowi drewnem świadczą o postępującym procesie coraz większego podporządkowania gospodarki leśnej kompetencjom Unii Europejskiej i redukowania obszaru zostawionego krajom członkowskim. Realizując cel rozważań, stwierdzić należy, że płaszczyzną ekspansji unijnej regulacji obejmującej gospodarkę leśną krajów członkowskich w sferze zarządzania gruntami, a także obrotu drewnem, a więc aktów przyjętych w ramach polityki handlowej i klimatyczno-energetycznej, jest zasada zrównoważonego rozwoju wywodząca się z prawa międzynarodowego, uregulowana także w Konstytucji Rzeczypospolitej Polskiej. Zasada ta stanowi również podstawę do kształtowania się zalążków wspólnej polityki leśnej, wyłaniającej się na styku innych unijnych polityk.

The analysis presented in this article concerns the impact of Court of Justice of the European Union (CJEU) jurisprudence on the legal situation of Supreme Court and Supreme Administrative Court judges in Poland. The main assumption of the presented considerations is that the CJEU, in providing answers to preliminary questions submitted to it by Polish courts adjudicating cases related to judicial appointments and retirements, strengthens the independence of the courts and the independence of the judiciary, assuming that these are systemic elements of a functioning judiciary subject to EU law. For this reason, the CJEU considers itself competent to shape these systemic values under Polish law. At the same time, this body does not notice the problem of jurisdiction of Polish courts posing legal questions, which becomes an important theoretical and practical issue, because it may affect the legality and effectiveness of judgements passed on the basis of answers given by the CJEU. Detailed considerations focus on two types of judgements of the CJEU, which were made in connection with the retirement of judges, as a result of questions submitted to the Court by the Supreme Court and Supreme Administrative Court. The subject of the questions related to the compatibility with EU law of the scope of legal protection granted in Polish law to a judge against resolutions adopted in such cases by the National Council of the Judiciary. The considerations presented conclude that in the case of a CJEU judgement issued as a result of a question posed by the Supreme Court, the jurisdiction of the authority posing the question was infringed, and this should have consequences for the scope of binding the court adjudicating on the answer provided by the CJEU. ; Przedstawiona analiza odnosi się do wpływu orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE) na kształtowanie w Polsce sytuacji prawnej sędziów Sądu Najwyższego (SN) i Naczelnego Sądu Administracyjnego (NSA). Głównym założeniem przedstawionych rozważań jest stwierdzenie, że TSUE w ramach udzielanych odpowiedzi na pytania prejudycjalne, kierowane do niego przez polskie sądy, rozpoznające sprawy związane z powołaniami na stanowisko sędziowskie oraz z przejściem w stan spoczynku, wzmacnia niezależność sądów i niezawisłość sędziowską, przyjmując, że są to elementy ustrojowe funkcjonującego wymiaru sprawiedliwości podlegające prawu Unii Europejskiej. Z tego powodu TSUE uznaje się za właściwy do kształtowania tych wartości ustrojowych na gruncie prawa polskiego. Jednocześnie organ ten nie zauważa problemu właściwości polskich sądów występujących z pytaniami prawnymi, co staje się ważnym zagadnieniem teoretycznym i praktycznym, gdyż może rzutować na legalność i skuteczność orzeczeń zapadających na podstawie udzielonych przez TSUE odpowiedzi. Szczegółowe rozważania koncentrują się na dwóch rodzajach orzeczeń TSUE, które zapadły w związku z sędziowskim stanem spoczynku, na skutek wystąpienia do TSUE z pytaniami przez SN i NSA. Przedmiot pytań odnosił się do zgodności z prawem unijnym zakresu ochrony prawnej przyznanej w prawie polskim sędziemu od uchwał podejmowanych w tych sprawach przez Krajową Radę Sądownictwa. Konkluzją przedstawionych rozważań jest stwierdzenie, że w przypadku wyroku TSUE wydanego na skutek pytania SN doszło do naruszenia właściwości organu występującego z pytaniem, a to powinno mieć konsekwencje dla zakresu związania sądu orzekającego odpowiedzią udzieloną przez TSUE.
W świetle tabel wyników rynku wewnętrznego Komisji Europejskiej Polska należy do krajów członkowskich o najwyższym deficycie zgodności prawa krajowego z unijnym, przede wszystkim ze względu na powtarzające się istotne opóźnienia w zakresie transpozycji dyrektyw. Niniejszy artykuł przedstawia rezultaty badań ilościowych, opartych na bazie aktów prawnych implementujących prawo UE po 2004 r i poszukuje przyczyn opóźnień, w szczególności poddając analizie, czy są one powodowane w większym stopniu przez działania władzy wykonawczej, czy ustawodawczej. Z naszych ustaleń wynika, że o ile parlamentarny proces stanowienia prawa przebiega w odniesieniu do ustaw implementacyjnych z reguły szybciej niż w odniesieniu do ustaw zwykłych, o tyle inicjacja tegoż procesu dokonuje się tak późno, że zazwyczaj nie jest już możliwe dokonanie terminowej transpozycji aktu unijnego. W istocie, większość projektów ustaw implementacyjnych wnoszonych jest do Sejmu w momencie, gdy przewidziany dla implementowanej dyrektywy termin transpozycji już upłynął. Wyniki sugerują, że to raczej rząd, a nie parlament jest odpowiedzialny za rosnące opóźnienia, jak również że skuteczność rządu w implementacji prawa UE ulega systematycznemu pogorszeniu (najmniejszeopóźnienia w transpozycji występowały bezpośrednio po akcesji). Szereg aspektów analizowanego zjawiska – jak np. rola konfliktu politycznego w generowaniu opóźnień – wymaga jednak dalszych badań. ; According to the Commission's internal market scorecards, Poland is among the countries having highest compliance deficits in the European Union, in part due to repeated and substantial delays in implementing EU directives. Using a comprehensive database of implementing acts introduced in the Polish parliament since the country's accession in 2004, we conduct a quantitative analysis of the timing of the governmental and parliamentary legislative processes to test whether those delays are introduced by the executive or the legislative branch. We conclude that while implementing legislation is usually enacted into law faster than ordinary legislation, it is introduced too late to permit successful implementation before applicable deadline. Indeed, most of the bills implementing EU directives are already overdue when introduced. These results suggest that the government – rather than the parliament – appears to be responsible for the delays, and that the governmental performance in this respect deteriorates rapidly (delays were smallest immediately after accession). We also find that numerous aspects of the problem – such as the role of political controversies in delaying implementing bills – require further research.

The first part of the article is dedicated to the classic approach to security in three areas: the security of the individual, the state and on the international stage. Then the author conducts an analysis of the interdisciplinary approach to security. He characterised the behavioural as well as sociological and economic theories. The author analyses the government policies pertaining to internal security in the last fifteen years. He explained the legal and constitutional rules of the government administration in Poland and then characterised the system of institutions responsible for security within the country involving a critical analysis of internal security policy, i.a. its effectiveness and efficiency. The author formulates the thesis which holds that within the last fifteen years the governments have failed to design an effective policy of internal security, so far. The postulated concepts and governmental proposals have been designed as temporary measures and under political pressure without much consideration for systemic solutions. The policy of internal security lacks the systemic approach deriving from the theory of organisation.
ccording to the Section 1 of the Council of European Union Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law, each Member State shall take the measures necessary to ensure that the following intentional conduct is punishable: publicly condoning, denying or grossly trivialising crimes of genocide, crimes against humanity and war crimes. Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law provides for liability in the public glorification of genocide, crime against humanity, crime against peace or war crime or glorification, denial, acquittal or gross trivialisation of committed genocide, crime against humanity, crime against peace or war crime, including genocide, crime against humanity, crime against peace or war crime committed by the U.S.S.R. or Nazi Germany against the Republic of Latvia and its inhabitants. The article aims to initiate a debate on potential problems related to the application of the Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law. The author offers his vision of the regulatory framework application problems.
Z opodatkowaniem wiążą się nie tylko złożone problemy prawne, lecz także etyczne. Uwidaczniają się one w procesie stosowania przepisów prawa. Zdarza się, że prawo podatkowe przeradza się w swoje przeciwieństwo, gdy rygoryzm w wykonywaniu litery prawa przestaje się liczyć z kontekstem społecznym. Właśnie wtedy, z uwagi na złośliwe tłumaczenie prawa (Cyceron), szczególna rola przypada sędziom sądu administracyjnego.Ochrona przed bezprawnym działaniem organów podatkowych wynika z wysokiej wiedzy interpretacyjnej sędziów, sędziowskiej dociekliwości i wnikliwości, moralnej wrażliwości sędziów na prawo, solidności kontroli instancyjnej.Pojawia się też problem relacji norm etycznych wywodzących się z wartości aksjologicznych do norm prawnych. Te relacje są następujące: normy prawne powinny posiadać legitymację aksjologiczną, natomiast normy etyczne legitymacji jurydycznej nie potrzebują. A to oznacza, że niesporne wartości aksjologiczne (dobro, godność, sprawiedliwość, równość, wolność) obowiązują niezależnie od umownie przyjętych w danym czasie konwencji stanowienia prawa. Zawsze więc stają się częścią systemu prawa w państwie. Prawo pozytywne jest wynikiem kompromisu sił politycznych i sił społecznych, które w życiu publicznym odgrywają istotną, ważną rolę. Dlatego też prawo pozytywne nie może być pełnym odbiciem uniwersalnych wartości aksjologicznych. I stąd właśnie pochodzą różnice zakresów pomiędzy obowiązującym systemem prawa a systemem norm etycznych wynikających z uniwersalnych wartości aksjologicznych. ; Taxation is not only associated with complex legal problems but also with ethical ones which become apparent in the process of applying legal regulations. When the rigorous application of the letter of the law ignores the social context taxation law degenerates into its opposite. In such situations, owing to malicious legal explanations (Cicero), a vital role is played by the judges of the administrative courts.Protection against the unlawful actions of tax institutions derives from the great interpretative knowledge of the judges, their inquisitiveness and insight, their moral sensitivity to legal issues as well as the soundness of the control processes of the courts.The problem arises here of the relationship between ethical norms which derive from axiological values and legal norms. This relationship can be defined as follows: legal norms ought to have axiological legitimacy but ethical norms do not require judicial legitimacy. This means that undisputedaxiological values (such as good, dignity, justice, equality, freedom) are valid independently of the legal conventions of law making applying at a given time. They are always incorporated into the legal system of a state. Positive law is a consequence of a compromise between the political and social forces which play an important and vital role in public life. This is why positive law cannot be a full reflection of universal axiological values. This explains why there are differences of scope between the legal system in force and the system of ethical norms which derive from universal axiological values.
The withdrawal of the United Kingdom from the European Union is one of the main challenges for the continued functioning of the European judicial area in criminal matters. In this article, special attention will be paid to selected aspects of ensuring further judicial cooperation in criminal matters after Brexit. This primarily concerns the possibility of further participation of the United Kingdom in specific organs supporting this cooperation (Eurojust and Europol) and the the application of legal instruments implementing the principle of mutual recognition of judgments, with reference to the flagship legal instrument, i.e. the European arrest warrant. It also presents a unique position of the United Kingdom in the Area of Freedom Security and Justice EU, which that state is guaranteed under the provisions of Treaties.
The subject of the study is the Bologna Process, its assumptions and course. The article contains an analysis of the Act on university education and science in order to indicate solutions for the harmonization in Poland under the Bologna movement. This movement is characterized as an example of European integration (harmonization) in the sphere of higher education, which was initiated by the Bologna Declaration of 19 June 1999. The main idea behind this declaration was the joint creation of the European Higher Education Area. The process initiated then goes beyond the scope of activities undertaken only by European Union governments. The analysis covers the following parts: The scope of the Bologna Process, Further European actors and the Sorbonne Declaration, The Bologna Process today, Implementation barriers was well as criticism. The amendment to the Act on Road Traffic Law introduced a new legal institution related to failure to register a vehicle consisting of an administrative fine in the amount of PLN 200 to 1,000. The penalty is imposed by means of an administrative decision issued by a competent starost. With the introduction of the above-mentioned institution in legal circulation, new problems will arise in connection with conducting administrative proceedings to impose a penalty, as well as determining its amount. In addition, a starost, as a creditor, is obliged to initiate enforcement proceedings in the absence of voluntary execution of the decision imposing the penalty. The established body aims to ensure the implementation of Directive 2000/53/EC of the European Parliament and of the Council of 18 September 2000 on end-of-life vehicles, concerning, i.a., the absence of sanctions for not registering an imported vehicle and not registering an end-of-life vehicle. The following article discusses the main problems related to the application of the institution introduced with regard to the administrative procedure, the nature of the penalty imposed, as well as its enforcement. The considerations were carried out on the basis of a dogmatic method. ; Nowelizacja ustawy Prawo o ruchu drogowym wprowadziła nową instytucję prawną związaną z brakiem dokonania zarejestrowania pojazdu, jaką jest administracyjna kara pieniężna w wysokości od 200 do 1000 zł. Kara nakładana jest w drodze decyzji administracyjnej przez właściwego starostę. Wraz z wejściem do obrotu prawnego powyższej instytucji pojawią się nowe problemy związane z prowadzeniem postępowania administracyjnego w przedmiocie nałożenia kary, a także ustalenia jej wysokości. Ponadto starosta jako wierzyciel jest zobowiązany do wszczęcia postępowania egzekucyjnego w sytuacji braku dobrowolnego wykonania decyzji nakładającej karę. Wprowadzona instytucja ma na celu zapewnienie realizacji dyrektywy Parlamentu Europejskiego i Rady 2000/53/WE z dnia 18 września 2000 r. w sprawie pojazdów wycofanych z eksploatacji, dotyczącej m.in. braku sankcji za niezarejestrowanie importowanego pojazdu oraz niewyrejestrowanie pojazdu wycofanego z eksploatacji. W niniejszym artykule omówiono główne problemy związane ze stosowaniem wprowadzonej instytucji w zakresie procedury administracyjnej, charakterem nakładanej kary oraz jej egzekucji. Rozważania przeprowadzono w oparciu o metodę dogmatyczną.
