Türkiye'deki yerelleşme olgusunun yeterince hızlı ve kuvvetli ilerlemesi önündeki engellerden birisi olarak görülen idari vesayet yetkisinin nasıl ve ne kadar zayıfladığının kamu yönetimi disiplini açısından tespit ve analizi bu çalışmanın ana amacıdır. İdari vesayet yetkisinin idare hukuku içindeki yeri, kamu hukuku açısından reform sonrası hukuki düzenlemeler de dikkate alınarak incelense de kamu yönetimi açısından yeterince incelemeye rastlanmamıştır. İdari vesayet yetkisi kamu yönetimi çalışma alanı açısından ele alınarak değerlendirilmektedir. Ayrıca mülki idare amirlerinin mahalli yönetim türleri (belediye, büyükşehir belediyesi, köy ve il özel idaresi) üzerindeki idari vesayet yetkilerinin, yerel yönetimler reformuyla yürürlüğe giren ve mahalli idareleri yakından ilgilendiren kanunlarla ve Anayasa Mahkemesi'nin aldığı iptal kararlarıyla, nereden nereye geldiği araştırmanın diğer bir yönünü oluşturur. Çalışmada idari vesayet yetkisinin kullanılmasına dair akademik ve pratik öneriler geliştirilmekte ve bu konudaki olası yenilikler irdelenmektedir. Bu bağlamda, mülki idare amirlerinin mahalli idareler üzerindeki idari vesayet yetkilerinin mevcut durumunun ne olduğu ve nasıl olması gerektiğine dair saptamalarda bulunulmaktadır. Türkiye'de mahalli idarelerin özerkliklerinin arttırılması yönünde gerçekleştirilen çabalar da bu çalışmada ele alınmaktadır. Mahalli idarelerin özerkliği yönünde atılan somut adımların idari vesayet açısından kamu yönetimi perspektifinden irdelenmesi çalışmada önemli yer tutmaktadır. Ayrıca Avrupa Birliği'ne uyum sürecinin ve Avrupa Yerel Yönetimler Özerklik Şartı'nın mahalli idareler üzerindeki idari vesayet yetkisine etkileri ile yerelleşmeye ve yerel özerkliğe katkıları da sistematize edilmektedir. Yerel yönetimler reformu öncesi ve reform sonrası idari vesayet yetkisinin mahalli idareler üzerinde kullanımına dair literatür taraması yapılmaktadır. Bu betimleyici ağırlıklı çalışmada mevzuat, mahkeme kararları ve uygulamacıların deneyimlerinden faydanılmaktadır. ; The principal goal of this study is to determine and analyze how and to what extent the power of administrative tutelage that is considered as one of obstacles before sufficiently quick and powerful progress the fact ?localization? in Turkey are attenuated in terms of public management discipline. Significance of the power of the administrative tutelage is reviewed in terms of public law by considering post-reform legal arrangements; sufficient studies for public management are not encountered. The power of administrative tutelage is discussed and evaluated within study scope of public management. Furthermore, progress of the power of administrative tutelage of the local authorities on local administration types (municipalities, metropolitan municipalities, villages and provincial private authorities) by laws, which become into force upon the local authority reform and involve closely local authorities, and cancellation decree made by the Constitutional Court, constitutes another aspect of the study. In this study, any academic and practical advices are developed on use of the power of administrative tutelage and any relevant possible news is addressed. In this scope, any determinations on what and how current situation of the power of administrative tutelage of the local authorities on local administration types must be are made. In this study, any endeavors on increase of autonomy of local authorities in Turkey are also discussed. Any material steps taken toward autonomy of local authorities take a critical place in scrutinizing the perspective of public management in respect to administrative tutelage. Furthermore, the effects of the European Union accession period and the European Charter of Local Self Government and their contribution to powers of administrative tutelage are also systematized. Literature investigations are carried out on use of the power of administrative tutelage before and after the reform of local authorities. In this descriptive study, legislation, court decrees and experience of executers are also utilized.
ABSTRACTFORCE PROJECTION IN INTERNATIONAL LAW AND SOVEREIGNTY BY MEANS OF UNITED NATIONS PEACE SUPPORT OPERATIONSIn the threshold of a new era, starting from early 1900's all nations began to appear dependent on each other in an ever-accelerating global world where the concept of classical total sovereignty transitions itself into a new understanding discribed as partial soverignty, especially by financial means.Threats, today are described mainly at economical level but yet not succesfully resolved without use of force projection. After devastating centuries of wars and conflict all around the globe, nations found themselves in a common urge to unite under the flag of International Organizations in the hope of ensuring a safe platform to negotiate over conflicting subjects and find solutions at political level , thus, preventing the painfull history repeat it self again. " United Nations" (U.N.) is inarguably the most widespread of all international organizations with the participation of almost evey country as amember.This dissertation aims to examine how U.N. finds legal grounds to interfere with governmental issues and under what circumstances U.N. resolutions affect national sovvereignty. Althought the unity is suppossed to be founded upon existence of equal members, U.N. unfortunately has acted more like an oligarchical club so far.This situation brings a lot of criticism especially about the special rights and authority of five permanant members of the Security Concil. It is a fact that thronghout decades, many conflicts have arisen in deffrent parts of the global map just because these privileged members used their authority in favour of their foreign policies. Küreselleşme ile şekillenen yeni dünya düzeninde artık tüm devletler birbirlerine muhtaç duruma gelmişlerdir. Yeni dünya düzeninde tehditler daha çok ekonomik düzeydedir. Ancak devletlerin birbirlerine karşı kuvvet kullanmaları engellenememiştir. Muhtemelen bundan sonrada engellenemeyecektir. Dünyanın artık tek isteği barış ve huzur içinde yaşamaktır. Devletler barış ve huzur içinde yaşamak ve geçmişte yaşanan acıların tekrarını önlemek maksadıyla uluslararası örgütler kurma yoluna gitmişlerdir. Yüzyılımızın bu anlamda en etkin örgütü olarak Birleşmiş Milletler kurulmuştur. Bu gün hemen hemen bütün devletler bu örgüte üye durumundadır.Bu çalışmamızda Birleşmiş Milletler Örgütünün devletin egemenliğine hangi nedenlerle müdahale edebildiği anlatılmıştır. Günümüzde özellikle Birleşmiş Milletler Örgütü devletin egemenliğine İnsani amaçlarla müdahale etmektedir. Kendisine ait bir askeri gücü olmayıp, üye devletlerin gönüllü yardımlarıyla oluşturulan Birleşmiş Milletler maalesef büyük devletlerin güdümü altındadır. Haklı olarak bugünkü yapısı eleştirilmektedir. Bu eleştirilerin büyük bir bölümü Güvenlik Konseyinin beş daimi üyesinin statüsü ve bunların veto yetkileri ile ilgilidir. Bu devletler veto yetkilerini hep kendi ülkelerinin dış politikaları yönümde kullanmışlardır. Bu yönden de dünyanın birçok yerinde çatışmalar devam etmektedir. Bu durum Birleşmiş Milletlerin güvenirliğini zayıflatmıştır. Birleşmiş Milletler Örgütünü, devletlerin gerçek anlamda eşit olarak söz sahibi olduğu yapıya kavuşturmak zorunlu bir hal almıştır. Ancak bu durumda Birleşmiş Milletler güvenilir bir örgüt olabilir.
ÖZETSovyetlerden 15 bağımsız cumhuriyetin ayrılışından sonra Rusya Federasyonu içinde demokrasi ve milli özgürlük uğrunda mücadele devam etmiştir.Bu mücadelenin ayrılmaz parçası olan Azerbaycan Cumhuriyetinde gelişen demokratik olaylar sonucu bağımsızlık ilan edilmiş, çağdaş ülke için değişim yoluna girilmiştir. Tarih boyu demokrasi millet ve halkların, toplumsal kuvve ve grupların keskin mücadelelerinin esas çizgisi olmuş ve olmaktadır. Bu mücadele yolunda bir çok fikir ve yöntemler geliştirilmiştir. Ama Marksist teori demokrasinin mahiyetini yanlış ve hatalı açıklamış, onu sınıfsal bir anlayış olarak belirlemiştir. Tarihi tecrübe bu iddiaların gayri hayatiliğini , insan doğasına aykırı olduğunu kanıtlamıştır. Çünkü demokrasiye sınıfsal yaklaşım bu sınıfın iktidarına, bir partinin diktatörlüğüne , gittikçe bozulan bürokratik bir sistemin yaranmasına neden oldu. Oysa demokrasi genel bir kavramdı, ülkeye, sınıfa, millete has demokrasi olamazdı. Demokrasinin uluslar üstü değerleri, prensipleri, şartları ve uygulanacak aşamaları vardı ve demokrasi her şeyden önce millet ve halkların özgürlüğünü hayata geçirmek yöntemiydi. Sovyetler Birliği yukarıdan aşağıya doğru dikey ve yatay yönlerde her şeyi, tüm toplumu, onun tüm halkalarını, sinir hücrelerini kapsıyordu. Fakat iktidarın milyonları korku altında tutması her zaman mümkün olamaz bu yüzden değişik yöntemlere başvuruluyor, özellikle utopik bir ideoloji ile beyinler yıkanıyordu. Ülkede hem Anayasa hem seçim hem çok sayıda kamu kurumları vardı. Fakat bunların faaliyetleri merkezin karar ve direktifleri ile baştan sona kadar parti strüktürleri tarafından idare ediliyordu. Neticede toplum aşırı merkezileşmiş, otoriter karakter kazanmıştı. Sadece yerel organların değil, Anayasalı federe cumhuriyetlerin yasama, yürütme organlarının da hakları kısıtlı ve kontrole tabi idi. İnsanlar ekonomik yönden tamamen devletten asılı durumda, yaratıcılıktan yoksun yukarının emirlerini uygulayan birer pasif fertlere çevrilmişlerdi. Fakat insanlar durumun farkında olmadan yüzyıllarca yaşayamazlardı. Zengin doğal servetleri olan bir memlekette çok kötü durumda yaşamak insanların akıllarında soru işaretleri doğurmuyor değildi. İşte bu yüzden 70'li yıllarda Sovyetler Birliği çökmeye başlamıştı. Azerbaycan Cumhuriyeti açısından olaylara baktığımızda Sovyetlerin kuruluşunun Rusya için getirmiş bulunduğu artı değerlerin burada kesinlikle olmadığını görüyoruz. Çünkü SSCB'ye katılan ülkenin esas doğal zenginliği olan petrol dünya pazarlarında çok ucuz fiyata satılarak kazanılan değerler Moskova'ya akmış, Hazar denizi derin ekolojik problemleri olan göle çevrilmiş, 1920 işgalinden sonra 48 bin insan öldürülmüş 80 bin kişi Iran da kalan Azerbaycan topraklarına göç etmiş, 1948-1953 yıllarında 140 binden fazla kişi, 1988'den itibaren ise tüm Azeri nüfus Ermenistan'dan zorla kovulmuş , ülke ekonomisi merkezden gelen talimatlara uyulmak zorunda kalındığı için derin yaralar almış, 1930'lı yıllarda toplumun aydın kısmı öldürülmüş veya sürgün edilmiş ; ülke içinde bir bölgeye özerklik verilerek ve 70 yıl içinde nüfus dağılımı maksatlı olarak değiştirilerek bağımsızlık mücadelesi önünde bir engel haline getirilmiştir. Bunlara ülkenin Ruslaştırma politikası yüzünden alfabenin değiştirildiğini, tarihinin tamamen saptırıldığını, geleneklerini zorla unutturulmaya çalışıldığını eklersek manevi olarak de bir milleti yok etmek için yapılabilecek her şeyin gerçekleştirildiğini anlamış oluruz.Maalesef ki Sovyetler dağıldıktan sonra bu topraklarda kurulmuş bağımsız devletlerde ve aynı şekilde Azerbaycan'da totalitar düşünce ve idare sistemi halen devam etmektedir.Fakat bu ülkelerde devam eden değişimler her hangi bir kesin sistemden bahsetmenin erken olduğunu kanıtlıyor.SUMMARYAfter 15 republics separated from the Soviet Union, struggle had went on in Russian Federation to reach democracy and freedom. As a result of some democratic phenomenon assured in The Republic of Azerbaijan which was the most important part of the fight from the beginning, independence had been declared and this was the first step for a contemporary country .To reach liberation was important after that long period of slavery and dictatorship but also to understand the idea of democracy and take lessons from the history was essential and vital. Democracy had always been the base of the nations' contention in the history. But Marxism had explained democracy in a wrong way and showed it as the intelligence of the social groups. But history proved that this idea is against the nature of human being. Cause democracy was a general concept and would not have belonged to a country, a social group or a nation. USSR was dominating all nations in the Union. Any objection used to be removed even through against law actions. Also Federative Republics' rights were limited and controlled. But it was not always possible to dominate people with creating fear over them. And people had started to ask themselves the reason of their poor life's although they lived in a country which is very rich in terms of natural sources. As a result; Soviet Union had started to collapse in the years of 70.If we look at the reason of Union's collapse, we first face with the system of common prietorship which is the vital part of the economy. This system had prepared the base of the collapse causing people lose their idea of ownership and pushing them to stealing, lying and bribery.Single political party was protected by the military authoritarian police system. The gap between the government and the citizen was becoming biger and biger every day.In the social area; everybody was considered equal as the result of social equality which was ruining social justice principles In the field of ideology; Marxism and Leninism were accepted and taught as the sole theory representing community phenomenon.If we examine Azerbaijan's situation in the Union we can say that Soviet Union had not affected this country in a positive way. The basic natural source of Azerbaijan was petroleum which was sold in the world market very cheap and the profit was running to Moskow directly. After the occupation of Azerbaijan in 1920 ,48 thousand of people were killed, 80 thousand had migrated to the land of Azerbaijan which was left to Iran. After 1988 all Azerbaijani population was driven away from Armenia. In 70 years allocation of the population had been changed on purpose to prevent any possible independence fight against the Union.Unfortunately after the Union collapsed , totalitarian opinion and government system is still going on in the Republics that separated from the Union like being in Azerbaijan.During the Soviet period Human Rights was called as the bourgeois theory and never been taught in the Universities. Not until the end of 80's human rights were included in the socialist mechanism. As a result, in Azerbaijan , short past of country's independence is still being used as the reason of limiting people's rights. Although freedom of press was arranged by the constitution in 1995, there are still blank lines and pages in the newspapers.War and interruption of the economic relations as a result of Union's collapse are still used as the defence of the above examples of misrule.
Türkiye'de demokratikleşme sürecinde 12 Eylül 1980 Askeri Müdahalesi ve Kırşehir Basını isimli çalışmamda ilk olarak demokrasi, demokratikleşme, ihtilal gibi kavramların anlaşılması gerektiği düşüncesindeyim. Demokrasi, vatandaşların, devlet politikasını şekillendirmede eşit hakka sahip olduğu bir yönetim biçimidir. Cumhuriyet halkın egemenliğine dayanan bir sistem, demokrasi ise cumhuriyetin uygulanış şekillerinden biridir. Demokrasiye uygun bir şekilde yaşama biçimine ise demokratikleşme denilmektedir. İhtilal, Bir ülkenin siyasal, sosyal ve ekonomik yapısını veya yönetim düzenini değiştirmek amacıyla kanunlara uymaksızın kuvvet kullanarak köklü bir değişiklik için yapılan militarist bir hareketidir. Ülkemizde yaşanan askeri müdahalelerin gerekçeleri; ülke bütünlüğünü korumak, millî birlik ve beraberliği sağlamak, muhtemel bir iç savaşı ve kardeş kavgasını önlemek, devlet otoritesini ve varlığını yeniden tesis etmek ve demokratik düzenin işlemesine mani olan sebepleri ortadan kaldırmak olarak gösterilmiştir. Geçmişte çeşitli sebeplerle yaşanılanlar da göstermiştir ki demokrasinin işlemesi ve yürütülmesi için çalışan parlamento kapatılarak demokrasi ve demokratikleşme sağlanamaz. Müdahaleyi yapanların her türlü karar ve tasarruflarından dolayı haklarında cezaî, malî veya hukukî sorumluluk iddiası ileri sürülemez ve bu maksatla herhangi bir yargı merciye başvurulamazlığı sağlayan anayasa maddesi 2010 referandumu sonrası değiştirilmiş ve o dönemle ilgili yargılama 13 Eylül 2010 tarihinde başlamıştır. Şu da bir gerçektir ki hiçbir askeri müdahale ülkeyi rahata, huzura götürememiştir. Müdahale sonrası; ister sağ, ister sol kesimden olsun -Türkiye?nin yarınları, umutları belki de gelecekleri olan büyük çoğunluğu gençlerden oluşan ülkesini milletini seven- birçok insanın mağduriyetine herkes tanık olmuştur. 12 Eylül ülkenin geçmiş birikimini, deneyimini belki de en önemlisi yarınını ortadan kaldırmıştır. Türkiye, 27 Mayıs 1960,12 Mart 1971 ve 12 Eylül 1980?leri yaşayarak, demokrasisi çeşitli sebeplerle askıya alınarak bugünlere gelmiştir. Eğitim seviyesi yükseltilerek ülkenin varlığı ve birliği için çalışan sivil toplum kuruluşlarının daha da yaygınlaşması, temel haklarını bilen vatandaşların yetişmesi ve demokrasinin birlikte yaşama anlayışı olduğunun anlaşılması olarak kabul edilmesi rahat, mutlu, huzurlu ama kesintiye uğramayacak demokratik yarınların göstergesi olacaktır. Evrensel değerler bağlamında amaç birlik ve beraberlik içinde daha güzel, daha mutlu yarınlara ulaşmaktır. Democracy is a form of government that all citizens have equal rights in shaping government policy. Republic is the system that based on the sovereignty of the people, democracy is on the other hand one of the forms of implementation of the republic. Living in accordance with democracy called as `democratization?. The revolution is a wide public movement for a radical change by using force in order to change a country?s political, social and economic structure or layout of the managament. The reasons for military intervention in our country are shown as to protect the integrity of the country, to ensure national unity and solidarity, to prevent a possible civil war and fratricidal quarrel, to re-establish the existence of state authority and to eliminate the raesons that prevent functioning of the democratic system. The events about past for various reasons have shown that by closing the parlament which functioning and executing for democracy, it is not possible to achieve democracy and democratization. Because of their all kind of decisions and possessions for the people who interfere it is not asserted the claim of criminal, financial and legal responsibility and for this purpose it may not be applied any judicial authority. The constitutional court were changed after the 2010 referandum and the trial about that period began 13th September 2010. But this is also a fact that no military intervention take the country to peace and comfort. After the intervention, whether right or left part supporter, many people were lost especially and vast majority of them youngs who are Turkey?s tomorrows, prospects and perhaps the future and this fact has witnessed by many people. September 12th eliminated the country? s past knowledge, experience and perhaps most importantly its future. Turkey has survived until today by living May 27th 1960, March 12th 1971, September 12th 1980 and by suspending its democracy for various reasons. It will be the indicator of comfortable, happy, peaceful but uninterrupted democratic future as the expansion of non-governmental organizations that are working for their country?s existense and cooperation by taking into account or even increasing the level of education,the growth of citizens who know their fundemantal rights and adoption of democracy as the understanding of living together. Türkiye, planlı dönemle birlikte uygulamaya başladığı bölgesel gelişme ve bölgeler arasındaki dengesizlikleri giderici yöndeki politikalarını günümüzde yeniden gözden geçirme zorunluluğu ile karşı karşıyadır. Bu zorunluluğun esas nedeni Avrupa Birliği'ne katılım sürecinde bölgesel gelişme politikalarının entegre edilmiş olmasıdır. Bu nedenle Türkiye, yaklaşık 40 yıldır uygulamakta olduğu bölgesel gelişme model, politika ve araçlarını bir yana bırakarak yeniden bir yapılanma süreci içine girmiştir. Bu yeni yapılanmanın ana öğesini Bölgesel Kalkınma Ajansları (BKA) olarak adlandırılan birimler oluşturmaktadır. Kalkınma Ajansları, bir ülkenin belli bir coğrafi bölgesi içerisindeki özel ve kamusal tüm şirketler, yerel otoriteler ile sivil toplum kuruluşları arasında işbirliği sağlayarak, o bölgenin ekonomik açıdan gelişmesini hedefleyen ve yasal bir hükme dayanarak kurulan yapılar olarak tanımlanmaktadır. Küreselleşme süreci beraberinde getirdiği yapısal uyum politikaları ile birçok konuda özgün süreçler ve araçlar geliştirilmesini gerekli kılmıştır. Bu süreçte Türkiye'ye de AB tarafından bölge planlamanın yeni bir anlayışla ele alınması gerektiği ve bunun aracının da BKA'lar olduğu ifade edilmiş ve konu ilk kez AB'ye tam üyelik müzakereleri ile başlamıştır. Bu dönemin başlangıcı sayılacak süreç ise adaylığın ilk kez tescil edildiği 1999 Helsinki Zirvesi sonunda olmuştur. AB Komisyonu'nun hazırlamış olduğu Katılım Ortaklığı Belgesi'nde orta vadede yapılması gereken düzenlemeler arasında yer alan BKA'ları oluşturmak amacıyla yasal düzenlemeler süreci başlatılmıştır. Bu doğrultuda öncelikle Topluluk kurallarına uygun olarak kısa vadede istatistiksel bölge olarak bilinen AB (NUTS) sistemi 22 Eylül 2002 tarih ve 4720 sayılı Bakanlar Kurulu kararı ile kabul edilmiştir. Daha sonra da 2003 yılı Katılım Ortaklığı Belgesinde, katılım öncesi mali yardım programından yararlanabilmek için BKA'ların kurulması öngörülmüştür. Takip eden süreçte 32 esas ve 5 geçici maddeden oluşan, 5449 sayılı Kalkınma Ajanslarının Kuruluşu, Koordinasyonu ve Görevleri Hakkında Kanun, 25.01.2006 tarihinde TBMM Genel Kurulunda görüşülerek kabul edilmiş, 08.02.2006 tarihli ve 26074 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Ülkemizde, 5449 sayılı Kanunun birinci maddesinde ifade edildiği üzere; ?kamu kesimi, özel kesim ve sivil toplum kuruluşları arasındaki işbirliğini geliştirmek, kaynakların yerinde ve etkin kullanımını sağlamak ve yerel potansiyeli harekete geçirmek suretiyle, ulusal kalkınma plânı ve programlarda öngörülen ilke ve politikalarla uyumlu olarak bölgesel gelişmeyi hızlandırmak, sürdürülebilirliğini sağlamak, bölgeler arası ve bölge içi gelişmişlik farklarını azaltmak amacıyla? BKA'lar kurulmaktadır. 6 Temmuz 2006 tarih ve 26220 sayılı Resmi Gazete'de yayımlanan ?Bazı Düzey 2 Bölgelerinde Kalkınma Ajansları Kurulmasına Dair Bakanlar Kurulu Kararı? ile ilk olarak 06.01.2007 tarihinde Adana ve Mersin illerini kapsayan Çukurova Kalınma Ajansı ve 13.01.2007 tarihinde de İzmir ilini ve çevresini kapsayan İzmir Kalkınma Ajansları kurulmuştur. Kalkınma ajansları; ? Bölgesel gelişme uygulamalarımız ile bölge planlarımızın etkinliğinin ve başarısının yükseltilmesini; bölgelerin ülkemizin genel büyümesine, gelişmesine, refahına ve istikrarına katkısının artırılmasını; sosyal uyum ve adaletin güçlendirilmesini ve değişen küresel rekabet şartlarına adaptasyonunun hızlandırılmasını sağlayacak, ? Yerel potansiyeli, dinamikleri, özgünlükleri, kaynak ve imkânları ortaya çıkararak harekete geçirecek ve ulusal, uluslararası pazarlarda ekonomik, sosyal, kültürel birer değer haline dönüştürecek; Sonuç olarak, hem ulusal, hem de bölgesel-yerel düzeyde başta istihdam ve gelir olmak üzere ekonomik ve sosyal göstergelerin iyileştirilmesine, bölgeler arası ve bölge içi gelişmişlik farklarının azaltılmasına ve dolayısıyla ülkenin genel refahının artırılması ve istikrarının pekiştirilmesine olumlu katkılar sağlayacaktır. ; Turkey today faces the necessity to reexamine its policies, begun to be implemented since the planned period, which aims to eliminate the imbalances between regional development and regions. The main reason of this necessity is that regional development policies weren't integrated in the process of participation of European Union. Therefore, Turkey went into a reconstruction process by abandoning the regional development model, policy and tools that it had been has been using for 40 years. The units called Regional Development Agencies (RDA) constitute the main element of this construct. Development Agencies, all private and public enterprises within a certain geographical region of a country, are defined as structures that aim the economic development of that region by providing cooperation between local authorities and civil society organizations, and that are founded on the basis of a legal provision. As is known, globalization process entails the development of authentic processes and tools in many cases regarding structural adaptation policies that it brought along. In this process, it was explained to Turkey by EU that regional planning should be approached with a new understanding and RDA?s are the means for this and this first started with the negotiations of full membership to EU. The process that can be counted as the beginning of this period is the end of Helsinki Summit of 1999 when the candidateship was first enrolled. The legal regulations process was initiated so as to constitute RDA?s that are among regulations which should be implemented in medium term in Accession Partnership that European Commission arranged. Accordingly, EU (NUTS) system that is known as short term statistical region was initially approved by Cabinet decree no 4720 in September 22 of 2002 in accordance with the rules of congregation. Later in the Accession Partnership of 2003, it was anticipated that RDA's be constituted in order to be able to utilize the pre-accession financial support programmes. In the following process, the law number 5449 regarding the Establishment, Coordination and Missions of Development Agencies that consists of 32 major and 5 temporary articles was debated and approved in General Assembly of Grand National Assembly of Turkey and went in effect after being published in Official Journal of number 26074 and date 02.08.2006. In our country, as stated in the first article of law number 5449, RDA?s are constituted ?in order to accelerate the regional development, to insure its maintainability, reduce the differences of interregional and regional development, compatible with the principles and policies anticipated in national development plans and programmes by developing the cooperation among public sector, private sector and civil society organizations, ensuring the effective usage of resources and activating the local potency?. By ?the Cabinet Decree Regarding the Establishment of Development Agencies in Certain Level 2 Regions? that was published in Official Journal number 26220 of July, 6, 2006, Development Agencies were constituted in Cukurova regions that include Adana and Mersin and Izmir regions including Izmir, and Cukurova Development Agency officially opened in 01.06.2006 and Izmir Development Agency in 01.13.2007. Development agencies; ? Will ensure the promotion of effectiveness and success of our region plans with our regional development applications; increasing of regions' contributions to the general growth, development, welfare and stability of our country; reinforcement of social adaptation and justice and, acceleration of adaptation to changing conditions of global competition, ? Will encourage the participation of all local actors in development attemps, especially administrative, financial and technical supports that it provides to corporations, establishments and persons with its highly qualified crew, flexible resource and employment structure, ? Will improve the culture and ability to produce and manage associate projects that are based on co-financing of person, corporation and establishment in project and activity supports; reinforce the sense of ownage and cooperation; active the entrepreneurship potency of the region and keep improving it, ? Will activate the local potency, dynamics, individualities by revealing the resources and possibilities, and turn into an economic, social and cultural values in international market; Consequently, will contribute to the improvement of economic and social indicators, especially employment and income in both national and regional- local level; reduction of differences of interregional and regional development and thus increasing of general prosperity of the country and solidifying of stability.
Uyuşmazlıkların eskiye göre daha karmaşık ve uzmanlık isteyen hale gelmesi ve insanların ilişkilerini koruma ve devam et-tirme istekleri gibi nedenlerle uyuşmazlık tarafları, ihtiyaçları olan çözüme erişebilmek için yargısal süreçler dışında alternatif yöntem-ler aramışlardır. Bu arayış alternatif uyuşmazlık yöntemlerini do-ğurmuştur. Arabuluculuk, en hızlı yayılan ve tercih edilen alternatif uyuşmazlık yöntemi olmuştur. Arabuluculuk, işçi ve işveren arasında yaşanan anlaşmazlıkların kısa bir zaman zarfında ve düşük maliyet-lerle çözümlenmesini sağlayacak adil ve dostane bir yöntemdir. 5521 sayılı İş Mahkemeleri Kanunu kabul edildiği 1950 yılından günümüze kadar çalışma hayatında yaşanan köklü dönüşümler kar-şısında iş uyuşmazlıklarının çözüm yöntemlerinin yetersiz kaldığı gerekçesiyle, mahkemelerin iş yükünü azaltacak alternatif uzlaşma yöntemlerini benimseyen yeni bir kanun (7036 sayılı İş Mahkemeleri Kanunu) getirilmiştir. 7036 sayılı Kanun'un genel gerekçesinde, alternatif uzlaşma yöntemlerine olan gereksinim, iş mahkemelerinde artan iş yükünün ve işin yapılma şeklinde yaşanan değişim, nüfus artışı, teknolojide yaşanan olağanüstü gelişim, sosyal güvenlik hukuku alanın genişle-mesi ve işçi-işveren uyuşmazlıklarının çeşitlenmesi nedenlerine bağ-lanmıştır. 01.01.2018 itibariyle yürürlüğe girmiş olan "Dava Şartı Olarak Arabuluculuk" sistemini de içeren 7036 sayılı İş Mahkemeleri Kanu-nu bu anlamda çalışma hayatının önemli bir ihtiyacını karşılamış ola-caktır. Dava şartı olarak arabuluculukta, uyuşmazlık taraflarının bir araya getirilerek alanında uzman arabulucuların objektif bir şekilde taraflarla görüşme sağlayarak kendi çözüm yöntemlerini geliştirme-leri sağlanmakta ve iletişim kurmalarına aracı olunmaktadır. Arabuluculuk, Türk hukuk sistemi içerisinde tarafların ihtiyari başvurduğu bir çözüm yöntemiyken, 7036 sayılı Kanun'la yapılan dü-zenlemeyle işçi-işveren uyuşmazlıklarında dava şartı olarak ilk defa yer almıştır. Bireysel veya toplu iş sözleşmesine dayanan işçi veya işveren alacağı ve tazminatı ile işe iade talebiyle açılan davalarda, arabulucu-ya başvurulmuş olması dava şartı olarak kabul edilecek ve mahkeme öncelikli olarak arabulucuya başvurmuş olma koşulunu arayacaktır. 7036 sayılı İş Mahkemeleri Kanunu ile getirilen yeni düzenle-meye göre dava açılmadan önce arabulucuya gitmek zorunlu, ancak tarafların arabulucuda uzlaşmaları zorunlu değildir. Taraflar arasında anlaşma sağlanamazsa anlaşmazlık konusunun iş mahkemelerine götürülmesine herhangi bir engel bulunmamaktadır. Ancak ilgili kanunla yapılan düzenlemede bazı belirsizliklerin olduğu görülmektedir. Belirsiz konuların başında, arabuluculuk tuta-nağında yer alan boşta geçen süreye ait ücretle ilgili Sosyal Güvenlik Kurumu'na yapılacak bildirimlerin usul ve esaslarının belirlenmemiş olması gelmektedir. Bu çalışmada, söz konusu belirsizliklere neden olan hususlara yer verilerek, konuya ilişkin değerlendirmelerimiz ak-tarılmaya çalışılmıştır. ; As the conflicts are becoming more complex and de-manding expertise than the previous practices and as people are re-quiring to maintain their relations, the parties to disputes have star-ted to sought alternative methods outside of the judicial procedures in order to access the solution they need. This search has led to the emergence of alternative dispute resolution methods. Mediation has become the fastest-spreading and most-preferred alternative dispute resolution method. Mediation is a fair and amicable way to ensure the resolution of disputes between the employees and emp-loyers within a short period of time and at low costs. A new act (Act No. 7036 Regarding Labour Courts) has been introduced, which adopts alternative methods of resolution to redu-ce the workload of the courts, with the reason that the conventional methods of resolving labour disputes are inadequate in the face of radical transformations occurring in the labour life since 1950, when the Act No. 5521 on Labour Courts was adopted. On the general reason of The Act No. 7036, the need for alter-native methods of reconciliation has been attributed to the increa-sing workload in the labour courts, the radical changes in the ways of doing business, the population growth, the extraordinary deve-lopments in technology, the expansion of social security law, and the diversification of employee-employer disputes. The Act No. 7036 Regarding Labour Courts No. 7036, which includes "the practice of mediation as a condition of trial", which has come into effect as of 1st of January, 2018, is expected to meet the important needs of working life in this sense. In the practice of mediation as a condition of trial, the parties to the dispute are brought together, and experts in the field are ensuring an objective negotiation between the parties to develop their own solution met-hods through communication. While previously, the practice of mediation was a discretionary solution for the disputing parties in the Turkish legal system, for the first time the regulation is being regulated as a condition of trial for all labour disputes between employee and employers. In the labour disputes arising from an individual or collecti-ve labour agreement (employment contract) and based on the employee's or the employer's claim or a compensation demand or a demand for return to work, the application for mediation first will be applied as a precondition for filing a claim at a labour court. According to the new regulation introduced by the Act No. 7036 on Labour Courts, applying to mediation is compulsory before file the suit however to reach a common ground is not compulsory. If there is no agreement between the parties at the end of the medi-ation procedures, there is no obstacle for the dispute to be brought to relevant labour court. However there seems to be some uncertainty in the regulation made with the applicable law. One of the most important uncerta-in topics is the procedures and principles of the notifications to be made to the Social Security Institution regarding the wages for the idle time passed during the mediation sessions are not being deter-mined. In this study, it has been tried to convey our evaluations abo-ut the issue by mentioning the subjects that cause the uncertainties.
Afganistan Devleti (resmi adıyla Afganistan Ġslam Cumhuriyeti) üzerinde 20. yüzyıla kadar devam eden egemenlik mücadelesi çeĢitli yönetim anlayıĢlarının benimsenmesini beraberinde getirmiĢtir. Ülkenin modern anlamdaki ilk Anayasası 1923 yılında yapılmıĢ ve akabinde bir dizi Anayasal faaliyet gerçekleĢtirilmiĢtir. Ülkenin temel problemi yönetim Ģekillerinin Anayasallarda belirlenen ilkeler doğrultusunda gerçekleĢtirilememesidir. Afganistan"da idari sistem genellikle her yöneticinin kendi anlayıĢına göre değiĢmiĢtir. Bu yüzden ülkede sabit bir idari sisteminden bahsetmek çok zordur. Günümüzde ise 2004 yılında yürürlüğe giren Anayasal ilkeler hâkimdir. Bu ilkelerle Afganistan"daki idari sistem merkezi yönetim ve yerel yönetim temelinde kurulmuĢtur. Örgütsel yapının ve çağdaĢ düzenin sağlanması adına bir dizi reform ve yenilik getirme çabaları baĢlamıĢtır. Ülkede merkezi yönetim teĢkilatının taĢra kuruĢları yanı sıra yerel yönetimlerin Anayasal ve yasal zemine oturtulma çabası, modern anlamda yetersiz görülse de, yerelleĢme açısından umut verici bir geliĢmedir. Ülkede yerelleĢme açısından dikkat çeken bir diğer önemli nokta ise 2007 yılında Bağımsız Yerel Yönetim genel BaĢkanlığı"nın kurulmasıdır. Bu baĢkanlık merkez teĢkilat ile taĢra teĢkilatı ve yerel yönetim arasındaki iliĢkiyi düzenleyecek bir birimdir. Ancak uygulamaya bakıldığında bu kurumun yanı sıra gerek taĢra teĢkilatında gerekse yerel yönetimler üzerinde birden çok birimin söz sahibi olduğu görülmektedir. Ayrıca özellikle yerel yönetimlerde yasal çerçevede seçimle gelmesi öngörülen birimlerin seçimle gelmediği dikkat çekmektedir. Dolayısıyla Afganistan"da yerelleĢme çabaları istenen sonuca ulaĢamamıĢtır. Bu kapsamda, çalıĢmada öncelikle yerelleĢmeye iliĢkin kavramsal ve kuramsal alt yapı incelenmiĢtir. Daha sonra idari yerelleĢme çabaları özelinde Afganistan"ın yapılanmasına yön veren Anayasal ve yasal çerçeve ele alınmıĢtır. Son olarak idari yerelleĢme çabalarının önündeki engeller irdelenmiĢtir. Sonuç olarak ülkenin yerelleĢme çabalarını; dıĢ güçlerin ülkenin iç iĢlerine karıĢması, etnik farklılıkların yoğunluğu, merkezin idari ve mali açıdan hâkimiyeti elinden vi bırakmama istemi, hesap verilebilirlik olgusunun etkin iĢletilememesi gibi nedenler etkilediği görülmüĢtür. The country's first modern constitution was inacted in 1923, followed by a series of Constitutional activities and amendments. The main problem of the country is that the ruling governments do not considers the principles of constitutional law. The administrative system standards in Afghanistan has been changing in accordance to each manager's own understanding. Therefore, it is very difficult to talk about a fixed administrative system in the country. The Constitutional principles that came into force in 2004 is prevailed. With these principles, there is dual administrative system central government and local government. It provides organizational structure and modern order to be started Despite the establishment of local government which is a strong pillar for implementation of constitution at provincial and district level, but still more effort is needed. Another important point for localization of administrations is the establishment of the Independent Directorate of Local Governance (IDLG) in 2007. This institution is a unit that regulates the relationship between central and local government. However, when looking at the application, it is seen that, besides this institution, multiple units can organise in both the district administrations and local governance. In addition, it is noteworthy that the some units at provincial level should be elected in accordance with constitution provisions but in practice it has never happened which has affected the administration negatively. Therefore, localization efforts in Afghanistan did not reach the desired result. In this research, firstly, the conceptual and theoretical infrastructure regarding localization was examined. Then, the Constitutional and legal framework, which directs the structuring of Afghanistan in terms of administrative localization efforts, was discussed. As a result, the country's localization efforts; It has been observed that some major reasons like intervention of foreigners in domestic matters, the tribal structure of the society and ethnic viii discrimination are the main obstacles to distribute power between centre and local government, hence the central government have domination in all aspects of state affairs. Toplumun gündelik ihtiyaçlarıyla ilgili kamu hizmetlerini görme işlevini yerine getiren idarenin, etkin bir işleyişe sahip olması ve kamu hizmetlerinden yararlananların haklarının korunması için idare, çeşitli şekillerde denetime tabi tutulmaktadır. Merkezden yönetim idarelerinin yerinden yönetim idareleri üzerindeki denetim yetkisi olan idari vesayet, günümüzde içeriği ve sınırı bakımından bütün dünyada sancılı bir sorun olup, uzun yıllardır ülkemiz gündemini meşgul etmeye devam etmektedir.Bu çalışma ile, merkezi idarenin yerel yönetimler üzerindeki idari vesayet denetimi, yeni kamu yönetimi anlayışı çerçevesinde ve yeni yapılan yasal düzenlemeler ışığında, değişmeye başlayan görünümü ile anlatılmaya çalışılmıştır. Çalışmamızda idari vesayetin bir denetim türü olması göz önünde bulundurularak, idarenin diğer denetlenme şekilleri olan; yargı denetimi, siyasi denetim, kamuoyu denetimi, hiyerarşik denetim ve ombudsman denetimi hakkında bilgi verildikten sonra, idari vesayet; tanımı, içeriği, ilişkili olduğu temel kavramlar ve diğer denetim yöntemleri ile farklılıkları ortaya konularak ele alınmıştır. İdari vesayet incelenirken, konunun daha iyi anlaşılması bakımından yerel özerklik kavramı ayrıca ele alınmıştır. Bu konular ele alınırken, ilgili kitap, makale, mevzuat, yargı kararları ve uluslararası metin ve sözleşme hükümleri incelenip tahlil edilmiştir.Merkezi idarenin yerel yönetimler üzerindeki idari vesayet denetiminin ağır bir şekilde uygulanması durumunda vesayetin, hiyerarşiye yakın bir görünüme kavuştuğu görülmektedir. Ülkemizde merkeziyetçilik geleneğinin de etkisiyle, günümüze kadar, merkezi idarenin yerel yönetimler üzerinde ağır bir vesayet denetimi uyguladığı görülmektedir. Ancak, Türkiye'nin taraf olduğu uluslararası antlaşmalar ve Avrupa Birliği'ne üyelik süreci ile birlikte, yerel yönetimlerle ilgili olarak yeni kabul edilen düzenlemelerde idari vesayet denetiminin hafifletilmeye başlandığı görülmektedir. Sonuç olarak, günümüzde yükselen yerelleşme ve özerklik kavramları karşısında, demokratik ülkelerde olduğu gibi ülkemizde de, hukuka uygunluğu sağlamaya yönelik idari vesayet denetiminin kabul edilmesi ve yerindelik denetiminden olabildiğince uzaklaşılması gereklidir. Yapılacak düzenlemelerde, idari vesayetin tamamen kaldırılması yerine bu ilkeye uygun hareket edilmesi, idarenin bütünlüğü ilkesinin çağdaş ve demokratik değerlerle sağlanması bakımından daha uygun olacaktır. The administration responsible for carrying out public services related to the daily needs of the public has been under control in different ways in order to secure its operation effective and efficient and protects those getting benefit from these public services. The administrative tutelage of the centralised administration which has the authoriy of monitoring over the local administration is a big problem in all over the world in terms of its content and limits and has been engaging the attention of our country's agenda for a time.With this study, the control of administrative tutelage of the central administration over local administration have been analyzed in the light of new public administration concept and recent legal regulations.Having explained the other controling ways such as sudicial control, political control, public control, hierarchical control and ombudsman control by cosidering the administrative tutelage as a controlling sort, the administrative tutelage has been explained by its related basic concepts, contents, definition and discussing the differences with the other control methods. While analyzing the administrative tutelage, the concept of local autonomy has also been analyzed to make the subject more precise. Moreover; while analyzing these topics it has also been referred to related books, current laws, international texts and contracts.When the central authority carries out the administrative tutelage power over the local administration, we observe that tutelage takes a shape closer to hierarchy. In our country, we observe that central administration have had a heavy tutelage control on the local administrations until now with the impacts of centralisation tradition. However, both in line with the treaties Turkey has agreed and the period that Turkey has entered in the way of European Union, we observe that the control is lessening with the new regulations that have been enacted recently. In conclusion, like in every democratic country and in the light of the concepts like decentralization and autonomy that have been gaining too much importance at the moment; it is necessary that we accept the administrative tutelage to provide law appropriateness in place and go as far as possible from aptness control. In the regulations that will be done, instead of removing administrative tutelage it is more appropiate to act in accordance with this principle in terms of providing administrative integrity by contemporary and democratic values.
ÖZETAvrupa Topluluğu'nun sosyal yönü, Avrupa entegrasyon sürecinin başlangıcından beri vardır. Ancak, Avrupa Topluluğu'nun temel amacı, Topluluk üyeleri arasında etkin bir ortak pazar oluşturarak ekonomik bütünleşmeyi sağlamak olduğundan sosyal politikanın genel Topluluk politikaları içindeki rolü küçüktü. Üye ülkeler arasında Topluluk'un sosyal alandaki rolü konusunda hiçbir zaman bir konsensüs oluşmadı. Ancak, zaman içinde, Topluluk üyeleri ekonomik bütünleşmesinin başarısı için etkin sosyal politikaların gerekliliğini kavradılar. Dolayısıyla, Toplululuk'un sosyal yönüne dikkat çekildi ve 1980'lerin sonlarında bu yönde adımlar atılmaya başlandı. Topluluk seviyesinde etkin bir sosyal politika 1980'lerin sonunda siyasi destek kazandı ve Avrupa entegrasyon süreci boyunca, birbiri ardına gelen Antlaşma revizyonlarıyla devam etti. AB sosyal politikasının bu tarihsel gelişme sürecine paralel olarak, Tek Avrupa Senedi (TAS) ile başlayarak, sosyal politikanın yasal ve yönetişim yönlerinde bir dönüşüm gerçekleşmiştir. AB'de sosyal politika alanı hala üye devletlerin yetkisinde olmasına rağmen, özellikle 1990'lardan itibaren, AB sosyal politikasının yönetişiminde hiyerarşik yapıdan hiyerarşik olmayan yapıya doğru bir gelişim olmuştur. Bu yönetişim yaklaşımında, AB'de değişik katmanlardan çok sayıda aktör, sosyal politika yapım sürecine dahil edilmiştir. AB sosyal politikasının geçirdiği bu gelişim süreci, Avrupa sosyal ortaklarının sosyal politika yapım sürecine katılmalarıyla sosyal diyaloğun yolunu açmıştır. Bu açıdan, Avrupa sosyal diyaloğu, 1985'te o günkü Komisyon Başkanı Delors'un başlattığı 'Val Duchesse' görüşmelerinden bu yana AB'nin gündeminde yer almaktadır. Avrupa sosyal diyaloğunun Maastricht ve Amsterdam Antlaşmaları'yla kurumsallaşmasıyla sosyal diyaloğun etkisi, bağlayıcı olmayan ortak görüşlerden, Komisyon tarafından denetlenen ve Konsey kararıyla uygulanan çerçeve anlaşmalara kadar ulaştı. Avrupa sosyal diyaloğunun bu aşamalı gelişiminde, sürecin temel aktörlerinden olan sosyal ortakların rolü ön plana çıkmıştır, çünkü bunların Avrupa seviyesinde temsili, sosyal diyaloğun Avrupa seviyesinde kurumsallaşması açısından önemlidir. Böylece, Maasricht Antlaşması'ndan beri, bir tarafta işçi sendikaları diğer tarafta işveren örgütlerini Avrupa seviyesinde temsil eden Avrupa sosyal ortakları, sosyal politika yapım sürecinde kurumsal bir role sahip olmuşlar, ve işgücü piyasası ile ilgili konularda yasal olarak bağlayıcı anlaşmaları görüşebilir duruma gelmişlerdir. Bu doğrultuda, sosyal ortakların gücü, sosyal ortaklara Laeken Avrupa Konseyi ile 'otonom çerçeve anlaşmalar' hazırlama ve uygulama yetkisinin verilmesi ile daha bağımsız bir rol verilerek arttırılmıştır.Bu bağlam içinde, çalışma Avrupa sosyal diyaloğunun ve sosyal ortakların rolünün AB sosyal politika yapım sürecindeki etkisini yönetişim yaklaşımı bağlamında araştırmaktadır. Avrupa sosyal diyaloğunun bağlayıcılığı olan çıktıları ve kapsamı kısıtlı olduğu görülmektedir. AB kurumsal yapısının sosyal diyalog üzerindeki etkisi de kısıtlıdır. Avrupa sosyal ortakların temsil yapılarında da eksiklikler mevcuttur. Ancak, bütün bunlara rağmen, Avrupa sosyal diyaloğu, AB sosyal politikasının meşruluğuna katkısı açısından AB sosyal politkasının önemli bir parçasıdır. Bu açıdan, Avrupa sosyal diyaloğu, sadece temelinde uzlaşma, konsensüs, işbirliği olan Avrupa sosyal modelinin önemli parçalarından biri olarak değil, aynı zamanda genel çerçevede Avrupa yönetişimin ve AB'deki demokratikleşmenin önemli bir mekanizması olarak karşımıza çıkmaktadır. ABSTRACTThe social dimension of the Community exists since the inception of the European integration process. However, as the primary rationale of the Community was economic integration among the member states in order to create an effective internal market within the Community in the initial phases, the role of social policy in overall Community policy was minor. There has never been consensus among the member states as to the role of the Community in the social field. However, in time, the member states of the Community perceived the necessity of effective social polices for the accomplishment of economic integration. Thus, increased attention was paid to the social dimension of the Community, with a clear commitment to its development from the late 1980s. This idea for an active social policy, which began to gain political support in the late 1980s, continued its progress with the successive Treaty revisions throughout the European integration process. In parallel to this progressive historical development of European Union (EU) social policy, there has been a transformation in the legal and governance aspects of social policy, starting with the Single European Act (SEA). Although the social policy field is still within the domain of the member states, especially in the 1990s, there has been a transformation in the governance of EU social policy from a hierarchical mode of governance to a non-hierarchical mode of governance, producing soft law rather than the regulatory mode of hard law. According to the governance approach, multiple actors at multiple levels of the EU are involved in the social policy-making process with deliberation and problem-solving efforts. This development of EU social policy paves the way towards the European social dialogue through the active involvement of the European social partners in the social policy-making procedure. In that regard, the European social dialogue has been on the EU's agenda since 1985, when it was initiated with the 'Val Duchesse' talks under the presidency of Delors. With the institutionalization of the European social dialogue process through the Maastricht and Amsterdam Treaties, the influence of the European social dialogue has increased from merely issuing non-binding joint opinions to the point where it now makes framework agreements implemented by Council decision and monitored by the Commission. In this incremental development of the European social dialogue, the role of the social partners as the core actors of the process has come to the fore, since their representation at European level is important for the institutionalization of the social dialogue at European level. Thus, since the Maastricht Treaty, the European social partners, which represent trade union and employer organizations, has enjoyed an institutional role in the policy-making process and can negotiate legally binding agreements on labour market issues. Moreover, the power of the social partners has been enhanced with the Laeken European Council, when they were granted greater independence in the preparation and implementation of 'autonomous agreements'. In this context, the study explores the extent of the influence of the European social dialogue and the role of the social partners in EU social policy-making procedure with reference to governance in the EU. It is notable that, despite the limited outcomes of the European social dialogue process regarding binding legislation, the limited scope of the European social dialogue, the limited influence of the EU institutional framework on the social dialogue, and the deficiencies in the representative structures of the social partners, the European social dialogue is a significant part of EU social policy in terms of its contribution to its legitimacy. In that regard, the European social dialogue has emerged not only as one of the vital parts of the European social model, which comprises the concepts of compromise, consensus, and cooperation, but also as an important mechanism in the general framework of European governance and democratization of the EU. Avrupa Birliği (AB) 2004 yılından bu yana Orta ve Doğu Avrupa ülkelerinin büyük çoğunluğunu resmi olarak birliğe kabul etti ve Batı Balkanlarda geriye kalan üye olmayan ülkeler AB'nin yeni hedefi haline geldi. Ancak, Birlik AB politik üyelik koşulları yoluyla kurallarını Orta ve Doğu Avrupa ülkelerine kıyasla Batı Balkanlardaki diğer üye olmayan ülkelere aktarırken birtakım zorluklarla karşılaşmıştır. Burada akla iki soru gelmektedir: Birinci soru, "Hangi şartlar altında bu koşullar etkili olabilir?" iken; ikinci soru, "AB üyelik koşulları neden Batı Balkanlarda bulunan ülkelerin iç politikasında kısmen sınırlı bir rol oynar?" şeklindedir. Bu meseleyi açığa kavuşturmak için Schimmelfennig ve Sedelmeier (2004) tarafından "dış teşvik modeli" benimsenmiştir. Bu çalışma "dış teşvik modelinin" bu soruları tam anlamıyla cevaplandıramadığını ve ulusal kimliğin Batı Balkan devletleri olan Hırvatistan ve Sırbistan'da AB üyelik koşullarının etkililiğini belirleme noktasında önemli bir role sahip olduğunu ileri sürmektedir. Political conditions, which are necessitated by the Union from the very beginning, can be described as a competitive party system, and free and fair elections. As for the essential political conditions of EU accession that the EU confirmed in 1993, which are also defined as the Copenhagen Criteria, they are the stability of democratic institutions, rule of law, liberal market economy, human rights and lastly the protection of minority rights (Bieber, 2013:2). The required political conditions are flexible. By which it means that some specific requirements could be added to the conditions. For instance, the UE required cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) in the context of Western Balkans (Frerburh and Richter, 2010:269-71). Predominant studies select "external incentive model" to articulate the logic of EU conditionality and political conditions. This model is based on a rationalist cost-benefit calculation that assumes that states are regarded as rational actors, seeking to boost their interests (Schimmelfennig and Sedelmeier, 2004). The tool of conditionality is perhaps the most significant instrument that the EU external governance applies to force would-be member states to obey the rules of the EU. That is, the Union decides its instructions as conditions and would-be member states are expected or required to accept these conditions to receive rewards. Consequently, the target government would face three various pressures namely from the Union, domestic and international politics in return for EU external incentives (Trauner, 2011:8). It is therefore the credibility of the EU conditionality plays a key role in evaluating the pros and cons of EU rewards as opposed to domestic compliance (Schimmelfennig and Sedelmeier, 2004:663-7). This model is, however, unsuccessful in fully articulating why the EU political conditionality could perform better in states like Croatia than in states like Serbia in the context of Western Balkan despite the fact that the Union has provided these countries with rewards. At this point, national identity, as a constructivist variable, has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. National identity is the main theme that determines whether conditionality can be effective or not. Constructivists argue that wouldbe member states would acknowledge the influence of the Union by means of socialisation and persuasion processes. It is these processes internalizing identities with the help of domestic actors (Trauner, 2011). Considering the rules of the EU appropriate and compatible with political conditionality helps domestic actors to stick to given EU rules (Schimmelfennig et al., 2006:27-52). In this sense, national identity, as a filter actor, influences EU conditionality. It is, therefore, crucial to note that states, as social actors, often shape and reshape national identity when they face or interact with different social structures. The EU political conditionality has raised doubts about its effectiveness in the countries in question. This is because they had ethnic conflicts in 1990s that shaped their national identities. It is this historic background affecting the effectiveness of EU political conditionality in Croatia and Serbia in different lights. The way in which the transformation of the EU rules, however, quite varied from one another. Croatian elites saw the cooperation with ICTY as indispensable part of EU accession and in line with Croatian respect of European organizations. Croatia met EU requirements. This is simply because the country was one of the European countries in which the rule of law is respected and obeyed. As far as Serbia is concerned, the cooperation with the ICTY was ensured by Serbian elites who felt forced and oppressed to do so. But they rejected the Hague tribunal. Even though they rejected it, a sense of obligation arising from the fear of being punished by the international community through the cancellation or postpone of EU talks took place regarding detaining suspects. This problematic issue resulted in different images of the EU in the eyes of these two countries. Serbia regards the European Union as a punisher and a superior force that inclined to in Serbia. This could be one of the reasons why there is distance between Belgrade and Brussels. As for Croatia, the image of Europe in the eyes of Croatian people is related to high democratic standards, liberty and civilization (Subotic, 2011:326-7). This could be one of the reasons why there is close cooperation between Croatia and the European Union. The rational incentive model is important for explaining the choice of would-be member states. It is crucial to clarify that this model is valid once the rules of the European Union are compatible with national identity of the would-be member states. Once the national identity of the target state is incompatible with the rules of the EU, it is fair to say that any material condition does not serve a very useful purpose. Sivil Toplum, sivil toplum kuruluşları, Sivil toplum kuruluşlarının devlet içerisindeki yeri, demokrasi, devlet, devlet kurumları, emniyet teşkilatı, Polisin Sivil Toplum kuruluşlarına bakış açısı, özgürlükler, Avrupa birliği kavramları dünyanın olduğu gibi ülkemizin gündemini de uzun süre meşgul etmiştir. Küreselleşen dünyada devletler etkisini kaybetmekte, özgürlükler alanı genişlemektedir. Toplulukların devlet gibi düşünmediği veya devletin düşünmediği konularda bir araya gelerek organize oldukları, devletin boş bıraktığı alanlarda faaliyet gösterdikleri, devletin bazı yetkilerini kullandıklarını görmekteyiz. Ülkemizde sivil toplum kuruluşlarının gelişme dönemi 1980 yılından sonra olduğu görülmekle birlikte, topluma hizmeti görev kabul etmiş bir sivil toplum kuruluşu olan vakıfların kuruluş tarihinin asırlar öncesine dayandığını söyleyebiliriz. Türkiye'de 1995 yılında çeşitli Sivil Toplum Kuruluşları arasındaki ilişkilerin serbest bırakılması önemli bir karar olmakla birlikte 2004 yılında dernekler kanununda yapılan değişiklik ve emniyet teşkilatından bağımsız yapılanma imkânı tanınması, sivil toplum kuruluşlarının gelişmesi ve faaliyetlerinin çeşitliliğinin artması bakımından önemlidir. Bu çalışmamızda sivil toplum, sivil toplum kuruluşları ve bağlantılı terimlerin açıklanmasının yanında görevi sivil toplum kuruluşlarının faaliyetlerini yasalar çerçevesinde güvenli bir şekilde yapmasını sağlamak, yasa dışı söylem ve hareketleri yargıya intikal ettirmek olan Polisin sivil toplum kuruluşlarına bakışını ele alacağız. Emniyet Müdürlüğü bünyelerinde kuruluşu bulunan Güvenlik Şube Müdürlüğü Sivil Toplum Kuruluşları ile yasalardan kaynaklanan ilişkiler kurmak zorundadır. Aynı ilişki kurma zorunluluğu sivil toplum kuruluşları içinde geçerlidir. Polis ilişkilerini kurarken sivil toplum kuruluşlarını kategorize eder ve yasaların izin verdiği ölçüde görev niteliğine bakılarak iletişim içine girer. Bu iletişim ve ilişki sınırlı ve ölçülüdür. Bu çalışmamızda sivil toplum kuruluşları ile Polis ilişkisini incelerken ilgili yasaların neler olduğunu bu yasaların güncelliği ile birlikte eksiklerini, yasalardan kaynaklanan ilişki bozukluklarını inceleyeceğiz Sivil Toplum Kuruluşları demokrasi hayatı ve kültürü için ne kadar önemli olursa olsun faaliyetlerinin belli ölçüde sınırlandırılmasının gerektiği bunun demokrasinin gerekliliği olduğu ve demokrasi hayatının gelişmesinde Polisin davranışı ve yasaların özelliğinin ne kadar önemli olduğudur. Ülkemizdeki Sivil toplum kuruluşları ile Dünya'daki sivil toplum kuruluşları arasında büyük farklılıklar vardır. Bunun çok yönlü sebepleri olsa da demokrasi kültürünün tam anlamıyla yerleşmemiş olması en büyük sebeptir. Ankara Emniyet Müdürlüğü Güvenlik Şube Müdürlüğü bu eksikliğin farkında olarak hareket etmekte, sivil toplum kuruluşlarının faaliyetlerinde davranışları ve iletişimiyle örnek olmaya çalışmaktadır. Bu davranışlar başkente özel ve kişilere bağlı olsa da Türkiye'de uygulanması gereken davranış özelliğini kazanması açısından önemlidir. Çalışmamızda polis teşkilatının tamamının görüşünü yansıtmasa da resmi ve sivil çalışan polislere uyguladığımız ankette; Türkiye'de Polisin ilişki kurduğu sivil toplum kuruluşlarına nasıl baktığı, onları nasıl değerlendirdiği, faaliyetlerdeki tutumu yasaların sivil toplum kuruluşlarına tanıdığı özgürlükler polisin bu konudaki düşünceleri incelenmeye ve bir çerçeve çizilmeye çalışılmıştır. Sivil toplum kuruluşları denince polisin aklına ilk gelen düşüncenin sokaklarda eylem yapan, kaldırım taşlarını söküp kendisine taş atan öğrenci grupları, illegal söylemleri dile getiren, polis ile çatışmaktan çekinmeyen öğrenci platformları ve sendikalar gelir. İllegal örgütlere altyapı sağlayan dernekler, vakıflar, devlet değerlerini ve sistemini tanımayan, yazılı olarak kanuna uygun parti kabul edilen ama söylemlerinde devlete karşı tavır alan veya bölücü, irticai faaliyetleri bulunan siyasi partilerin de bulunduğunu unutmamak gerekir. Her Sivil toplum kuruluşu göründüğü kadar masum değildir. Bu masumiyet halkımız tarafından zamanla anlaşılmakta ve tepkisini yeri geldiğinde ortaya koymaktadır. Kuruluş amacı doğrultusunda hareket eden yasalara saygılı, dürüst, topluma hizmet eden Sivil Toplum Kuruluşlarının polis ile olan ilişkisi sadece evrak üzerinde kalmakta veya güvenlik talebi şeklinde kalmakta ve sorun yaşanmamaktadır. Türkiye'nin küreselleşen dünyanın saygın bir üyesi olabilmesi için, STK'larının çok sayıda, değişik türde ve ölçekte, yüksek potansiyeli, dünyaya açık, işlevlerini başarıyla yerine getirebilen, kendilerine güven duyulan bir biçimde gelişmesini sağlayabilmesi gerekir.Bu çalışma sonucunda elde edilecek verilerle demokrasi kültürüne katkı sağlayacağımızı düşünerek sivil toplum kuruluşlarının polis ile ilişkilerinin ne kadar önemli olduğunu, faaliyet istatistikleri ve Emniyet verileri kullanılarak açıklanmaya çalışılmaktadır. Police, while establishing relation categorizes Civil Society organizations and enters in to the communication according to the nature of the duty and the laws are allowed. This communication is limited and moderate. Sporda güvenlik; İstanbul Maratonunda OHAL öncesi ve OHAL dönemi özel ve kamu güvenlik birimleri tarafından alınan güvenlik önlemlerinin katılımcı yaklaşımı açısından analiz edilmesini esas almaktadır. Son zamanlarda, spor aktivitelerinde yaşanan güvenlik sorunları ülkenin gündemini meşgul etmektedir. OHAL döneminde ülke genelinde çıkan olaylarda yaşanması muhtemel can ve mal kayıplarının önlenmesi için alınan kamu ve özel güvenlik tedbirlerinin yeterliliği tartışılmaktadır. Bu kapsamda, İstanbul Maratonu için de en önemli problemlerinden biri güvenlik ve güvenlik uygulamalarıdır. İkinci kısım "Yasal Düzenlemeler" başlığı altında mevcut yasalarla, alınan önlemlere değinilerek, yasalarda güvenlik birimlerinin teşkilatlanması, güvenlikle ilgili birimlerin görev ve sorumlulukları oluşturmak. 3. Spor organizasyonlarında kullanılan güvenlik sistemleri ile günümüzde karşılaşıla olayları ve alınan önlemleri anlatılmaya çalışılmıştır. Araştırma bölümünde ise, araştırma nicel araştırma metodolojisi içinde yer alan genel tarama modellerinden betimsel tarama modelinde gerçekleştirilmiştir. Spor organizasyon yöneticileri, İstanbul Maraton'da düzenlendiği güzergâhlarda alınan güvenliğin; katılımcı güvenliğini, genel asayişin sağlanması, maratona giriş kontrolü, katılımcı yönlendirme, kalabalık kontrolü, sporcuların ve spor malzemelerinin korunması gibi güvenlik tedbirlerini almak için İstanbul Maraton'da kamu ve özel güvenlik birimlerine ihtiyaç duymaktadır.Önerilen bu projede: Sporda Güvenlik Sistemleri ve İstanbul Maratonun Güvenliğinin yasalar ve kanunlar çerçevesinde; kolluk gücü ve özel güvenliğin müdahale ediş şekillerinin araştırılması amaçlanmaktadır. Bu proje iki ayrı kısımdan oluşmaktadır.1.Birinci kısım sosyal bölümü spor, sporcu, maraton, katılımcı, seyirci, şiddet ve güvenlik kavramları örnekler ile vurgulanarak anlatılmıştır.2.İkinci kısım "Yasal Düzenlemeler" başlığı altında mevcut yasalarla, alınan önlemlere değinilerek, yasalarda güvenlik birimlerinin teşkilatlanması, güvenlikle ilgili birimlerin görev ve sorumlulukları oluşturmak.3.Spor organizasyonlarında kullanılan güvenlik sistemleri ile günümüzde karşılaşıla olayları ve alınan önlemleri anlatılmaya çalışılmıştır. Araştırma bölümünde ise, araştırma nicel araştırma metodolojisi içinde yer alan genel tarama modellerinden betimsel tarama modelinde gerçekleştirilmiştir. Çalışmanın sonucunda:1.Katılımcıların güvenlik algısı; yaşa, cinsiyete, medeni durum, eğitim duruma göre farklılaşmakta mıdır?2.Katılımcıların sporda güvenliğe ilişkin görüşlerinde, sporda şiddetin sorumlusunu tanımlama açısından farklılaşmakta mıdır?3.Araştırmaya katılan katılımcıların maratonda kendini güvende hissetmekte midir?4.Kamu güvenlik görevlilerinin almış olduğu güvenlik tedbirleri yeterli midir? Ayrıca çalışma sonucunda elde edilecek sonuçlardan diğer organizasyonlarda faydalanılması, çalışmanın bir geri bildirim niteliği taşıması da amaçlanmaktadır. İstanbul Maratonu'nda özel ve kamu güvenlik birimleri tarafından alınan güvenlik önlemlerinin, organizasyonun güvenliğini üstlenen İBB'nin güvenlikten sorumlu özel kolluk görevlileri, Spor İstanbul'un maratonda güvenliğini sağlayacak olan çalışanları ve çeşitli üniversitelerden gönüllü olarak güvenlik sağlamak üzere katılan öğrenciler, ki bunların tamamı spor organizasyonlarında güvenliğinde görev alan personeller olarak adlandırılacaktır. İstanbul maratonun ne kadar emin ellerde ve güvenli olup olmadığını araştırmak, ülkemizin içinde bulunduğu özel ve stratejik durumundan dolayı daha sonra düzenlenecek yarış ve organizasyonların güvenliğinde önemli bir rol oynamak ve bu organizasyonlarda güvenlik önlemlerine kaynak oluşturmak ve spor bilimlerinde yeni olan bu alana literatür açısından katkıda bulunmayı amaçlamaktadır. --- Sport is the largest organization of activities that unites countries.
