The article is about the level of adaptation Ukrainian legislation to the European Union standards in the area of environmental assessment. In the material the main European and Ukrainian documents are analysed: Directive 2011/92/EU of The European Parliament and The Council of 13 December 2011 on the assessment of the effects of the certain public and private projects on the environment, Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment and The Law of Ukraine "On the environmental assessment". Due to the above it is necessary to emphasize that, in spite of large legislation base in Ukraine in this area, the level of its adaptation to the EU standards is low. ; Artykuł dotyczy poziomu dostosowania ustawodawstwa ukraińskiego do norm Unii Europejskiej w zakresie oceny oddziaływania na środowisko. W materiale poddano analizie główne dokumenty unijne i ukraińskie przede wszystkim: dyrektywę Parlamentu Europejskiego i Rady 2011/92/UE z dnia 13 grudnia 2011 r. w sprawie oceny skutków wywieranych przez niektóre przedsięwzięcia publiczne i prywatne na środowisko, dyrektywę 2001/42/WE Parlamentu Europejskiego i Rady z dnia 27 czerwca 2001 roku w sprawie oceny wpływu niektórych planów i programów na środowisko, oraz ustawę Ukrainy o ekspertyzie ekologicznej. Na podstawie tego można stwierdzić, że pomimo rozbudowanej bazy ustawodawczej na Ukrainie w tym zakresie, poziom jego dostosowania do norm unijnych jest niski.

W świetle tabel wyników rynku wewnętrznego Komisji Europejskiej Polska należy do krajów członkowskich o najwyższym deficycie zgodności prawa krajowego z unijnym, przede wszystkim ze względu na powtarzające się istotne opóźnienia w zakresie transpozycji dyrektyw. Niniejszy artykuł przedstawia rezultaty badań ilościowych, opartych na bazie aktów prawnych implementujących prawo UE po 2004 r i poszukuje przyczyn opóźnień, w szczególności poddając analizie, czy są one powodowane w większym stopniu przez działania władzy wykonawczej, czy ustawodawczej. Z naszych ustaleń wynika, że o ile parlamentarny proces stanowienia prawa przebiega w odniesieniu do ustaw implementacyjnych z reguły szybciej niż w odniesieniu do ustaw zwykłych, o tyle inicjacja tegoż procesu dokonuje się tak późno, że zazwyczaj nie jest już możliwe dokonanie terminowej transpozycji aktu unijnego. W istocie, większość projektów ustaw implementacyjnych wnoszonych jest do Sejmu w momencie, gdy przewidziany dla implementowanej dyrektywy termin transpozycji już upłynął. Wyniki sugerują, że to raczej rząd, a nie parlament jest odpowiedzialny za rosnące opóźnienia, jak również że skuteczność rządu w implementacji prawa UE ulega systematycznemu pogorszeniu (najmniejszeopóźnienia w transpozycji występowały bezpośrednio po akcesji). Szereg aspektów analizowanego zjawiska – jak np. rola konfliktu politycznego w generowaniu opóźnień – wymaga jednak dalszych badań. ; According to the Commission's internal market scorecards, Poland is among the countries having highest compliance deficits in the European Union, in part due to repeated and substantial delays in implementing EU directives. Using a comprehensive database of implementing acts introduced in the Polish parliament since the country's accession in 2004, we conduct a quantitative analysis of the timing of the governmental and parliamentary legislative processes to test whether those delays are introduced by the executive or the legislative branch. We conclude that while implementing legislation is usually enacted into law faster than ordinary legislation, it is introduced too late to permit successful implementation before applicable deadline. Indeed, most of the bills implementing EU directives are already overdue when introduced. These results suggest that the government – rather than the parliament – appears to be responsible for the delays, and that the governmental performance in this respect deteriorates rapidly (delays were smallest immediately after accession). We also find that numerous aspects of the problem – such as the role of political controversies in delaying implementing bills – require further research.

The first part of the article is dedicated to the classic approach to security in three areas: the security of the individual, the state and on the international stage. Then the author conducts an analysis of the interdisciplinary approach to security. He characterised the behavioural as well as sociological and economic theories. The author analyses the government policies pertaining to internal security in the last fifteen years. He explained the legal and constitutional rules of the government administration in Poland and then characterised the system of institutions responsible for security within the country involving a critical analysis of internal security policy, i.a. its effectiveness and efficiency. The author formulates the thesis which holds that within the last fifteen years the governments have failed to design an effective policy of internal security, so far. The postulated concepts and governmental proposals have been designed as temporary measures and under political pressure without much consideration for systemic solutions. The policy of internal security lacks the systemic approach deriving from the theory of organisation.

Z opodatkowaniem wiążą się nie tylko złożone problemy prawne, lecz także etyczne. Uwidaczniają się one w procesie stosowania przepisów prawa. Zdarza się, że prawo podatkowe przeradza się w swoje przeciwieństwo, gdy rygoryzm w wykonywaniu litery prawa przestaje się liczyć z kontekstem społecznym. Właśnie wtedy, z uwagi na złośliwe tłumaczenie prawa (Cyceron), szczególna rola przypada sędziom sądu administracyjnego.Ochrona przed bezprawnym działaniem organów podatkowych wynika z wysokiej wiedzy interpretacyjnej sędziów, sędziowskiej dociekliwości i wnikliwości, moralnej wrażliwości sędziów na prawo, solidności kontroli instancyjnej.Pojawia się też problem relacji norm etycznych wywodzących się z wartości aksjologicznych do norm prawnych. Te relacje są następujące: normy prawne powinny posiadać legitymację aksjologiczną, natomiast normy etyczne legitymacji jurydycznej nie potrzebują. A to oznacza, że niesporne wartości aksjologiczne (dobro, godność, sprawiedliwość, równość, wolność) obowiązują niezależnie od umownie przyjętych w danym czasie konwencji stanowienia prawa. Zawsze więc stają się częścią systemu prawa w państwie. Prawo pozytywne jest wynikiem kompromisu sił politycznych i sił społecznych, które w życiu publicznym odgrywają istotną, ważną rolę. Dlatego też prawo pozytywne nie może być pełnym odbiciem uniwersalnych wartości aksjologicznych. I stąd właśnie pochodzą różnice zakresów pomiędzy obowiązującym systemem prawa a systemem norm etycznych wynikających z uniwersalnych wartości aksjologicznych. ; Taxation is not only associated with complex legal problems but also with ethical ones which become apparent in the process of applying legal regulations. When the rigorous application of the letter of the law ignores the social context taxation law degenerates into its opposite. In such situations, owing to malicious legal explanations (Cicero), a vital role is played by the judges of the administrative courts.Protection against the unlawful actions of tax institutions derives from the great interpretative knowledge of the judges, their inquisitiveness and insight, their moral sensitivity to legal issues as well as the soundness of the control processes of the courts.The problem arises here of the relationship between ethical norms which derive from axiological values and legal norms. This relationship can be defined as follows: legal norms ought to have axiological legitimacy but ethical norms do not require judicial legitimacy. This means that undisputedaxiological values (such as good, dignity, justice, equality, freedom) are valid independently of the legal conventions of law making applying at a given time. They are always incorporated into the legal system of a state. Positive law is a consequence of a compromise between the political and social forces which play an important and vital role in public life. This is why positive law cannot be a full reflection of universal axiological values. This explains why there are differences of scope between the legal system in force and the system of ethical norms which derive from universal axiological values.
