Alternatif uyuşmazlık çözüm yolları, onarıcı adalet kavramının ortaya çıkmasıyla uygulanmaya başlamıştır. Bunlardan biri uzlaşma kurumudur. Günümüzdeki anlamıyla ilk olarak Kanada'da 28 Mayıs 1974 tarihinde meydana gelen bir olayda uygulanmıştır. Uzlaşma kurumunun ortaya çıkmasının çeşitli sebepleri vardır. Bunlardan en önemlisi klasik ceza adalet sistemlerinin uyuşmazlığın taraflarını, özellikle de mağduru tatmin etmemesidir. Uzlaşma kurumu ülkemizde ilk olarak 1 Haziran 2005 tarihinde yürürlüğe giren 5237 sayılı Türk Ceza Kanunu ve 5271 sayılı Ceza Muhakemesi Kanunu'nda yer alan düzenlemeler ile uygulanmaya başlanmıştır. Uyuşmazlığın taraflarının özgür iradelerine dayanan uzlaşma kurumunun mağdur veya suçtan zarar gören bakımından, şüpheli veya sanık bakımından, toplum bakımından, yargı organlarının iş yükü bakımından ve kamu harcamaları bakımından birçok faydası bulunmaktadır. Tezimiz iki ana bölümden oluşmaktadır. Birinci bölümde, uzlaşma kavramı, uzlaşma kavramının hukuki niteliği, alternatif çözüm yöntemleri ve onarıcı adalet kavramlarını ve bunların ortaya çıkış sebepleri, uzlaşmanın karşılaştırmalı hukuktaki ve uluslar arası belgelerdeki yeri inceleme konusu yapılmıştır. İkinci bölümde ise, uzlaşmanın koşullarını, Yüksek Yargı içtihatları doğrultusunda soruşturma ve kovuşturma aşamasındaki uygulanma sürecini, olumlu ve olumsuz sonuçlarını, faydalarını incelemeye çalıştık. Çalışmamızı, uzlaşma kurumu konusunda genel bir değerlendirme yaparak sonlandırdık. ; Alternative dispute resolution methods, with the emergence of the concept of restorative justice, began to be implemented. One of these is mediation institution. Meaning today as the first in Canada on May 28, 1974 was implemented in an event occurring. There are the various reasons for the emergence of mediation institutions. Most importantly, classic criminal justice system does not satisfy the parties to the dispute, particularly the victims. Mediation institution in our country was introduced by the regulations of the No. 5237 Turkish Penal Code and No. 5271 the Criminal Procedure Code which came into force on 1 June 2005. Mediation institution which based on the free will of the parties to the dispute has many benefits in terms of the person who has suffered damages from the crime, in terms of the suspect or the accused, in terms of the society, in terms of courts? workloads and in terms of public expenditure. Our study is composed of two main sections. At the first chapter, the concept of mediation, legal character of mediation, alternative dispute resolution methods and restorative justice concepts and their emergence causes, its places in the comparative law and on intirnational documents had been expressed. And at the second chapter, the rules of the mediation, in accordance with high judicial case law, the implementation process of the mediation at the investigation stage and prosecution stage, positive and negative results of mediation, the benefits of mediation had been expressed. At the final section, We had terminated our study making an overall assessment about the the concept of mediation with examples of decisions which we made at the practice.

Yerel dinamiklerin harekete geçirilerek, bölgesel kalkınma hareketine son yıllarda önem ve öncelik verildiği görülmektedir. Kalkınma hamlesi aynı zamanda sosyal hukuk devleti olabilmenin de bir gereğidir. Devlet, bu ödevini oluşturduğu kural ve kurumları aracılığıyla yerine getirmeye çalışmaktadır. Çağımızda devletin kalkınma ve ekonomik yaşamda önemli bir aktör durumundadır. Devlet bir yandan ekonomik kalkınmayı gerçekleştirmek, diğer yandan da toplumsal barışı ve kamu düzenini korumakla ödevlidir. Türkiye?de sosyo-ekonomik kalkınmanın gerçekleştirilebilmesi maksadıyla son yıllarda idari teşkilata dahil edilen kalkınma ajansları, gerek kuruluş ve gerekse işleyiş yapıları bakımından birtakım sorunlar barındırmaktadır. Kalkınma sürecinin bürokratik engelleri bu türden idari yapılarla aşılmaya çalışılırken, "her şeye rağmen kalkınma mı?" sorusu akla geliyor Kuşkusuz değil. Çevresel değerleri yok edici bir kalkınma düşünülemeyeceğine göre, devlet sağlıklı ve dengeli bir çevrede yaşama hakkını göz ardı eden bir sosyo-kalkınma sürecine evet diyemez. Devlet, elindeki hukuk enstrümanları ile rasyonel bir denge kurmak zorundadır. Türkiye?nin kalkınma arayışında bölge ajansları kamu ve özel sektör paydaşlığında amacına uygun biçimde işletildiğinde olumlu sonuçlar elde edileceği söylenebilir. Ancak kalkınma ajanslarının uluslararası sermayenin doymak bilmeyen iştahını körüklemekten çok, toplum yararını kollaması şartıyla bu sonucun elde edilmesi mümkündür. Demokrasi kilidinin anahtarı pozisyonundaki seçimler, bireylerin geleceklerini inşa etmeye aday siyasi partiler arasından seçim yapmak suretiyle iktidarı belirlediği en etkin siyasi denetim aracıdır. Seçimlerin siyasal hayatı şekillendirmedeki rolü, seçimlere büyük ilgi gösterilmesine neden olmaktadır. Seçimler, geçmişte sadece siyasi iktidarı belirleme aracı olarak görülürken, günümüzde özellikle de 2000 Amerikan Başkanlık seçimleri ve sebep olduğu gelişmelerinde tesiriyle, siyaset kurumunun ve akademik dünyanın ilgi odağı haline gelmiştir. Demokratik olsun ya da olmasın, diktatörlükle yönetilen ülkeler hariç, dünyadaki bütün ülkelerde iktidarlar seçimle belirlenmektedir. Seçmen tercihlerinin sandığa adil ve dürüst şekilde yansıdığı bir seçim gerçekleştirme arzusu, seçimlerin ülke genelinde iyi teşkilatlanmış, liyakat esasına göre belirlenmiş personelin istihdam edildiği, teknolojik alt yapıya sahip ve toplumsal itibarı ve intibaı yıpranmamış ve siyasi iktidarın müdahale alanından tamamen uzaklaştırılmış özerk ve kurumsal yapıları zorunlu kılmaktadır. Adil ve dürüst seçimlerin mümkün kılınabilmesi ancak seçimlerin yönetim ve denetiminden sorumlu kurum ve kurulların etkin yönetim ve denetim mekanizmaları ile donatılmış olmasıyla mümkün olabilecektir. Seçimlerin yönetimi ve denetimi faaliyetleri, ülkelerin benimsedikleri seçim yönetim ve denetim modellerinin farklılık göstermesi sebebiyle ülkeden ülkeye farklılık sergilemektedir. Bu farklılığa rağmen, bu modellerin hepsinin ortak amacı, seçmen iradesinin sandığa yansıması sürecini sağlıklı bir şekilde yönetmek ve sürece ilişkin yaşanabilecek hukuksuzluklara engel olmaktır. Türkiye'de seçim teşkilatı ile seçimlerin işleyişinin karşılaştırmalı hukuk perspektifinden tüm yönleriyle ele alındığı bu çalışmanın amacı; ülkemiz açısından daha etkin bir seçim yönetim ve denetim mekanizmasının hayata geçirilebilmesi için uygulayıcılara karşılaştırmalı hukuk pratikleri perspektifinden bir model önerisi sunmaktır. ; Elections, which are the key to democracy, are the most effective means for political supervision in which individuals make choices from among political parties, which compete to build their lives. The role of elections in shaping political life causes them to be paid enormous attention. In the past, elections were regarded as a means to determine the political power only, but today, especially under the influence of the 2000 American presidential elections and the developments it led to, they have become the center of attention for politics and academic World. Whether they are democratic or not, governments are determined through elections all over the world except for countries that are governed by dictatorships. The fact that countries of the world have different political and historical experiences and have their own unique political traditions have caused different elections systems to be adopted. This difference in turn has caused different methods and models to be adopted in the activities conducted during the implementation of elections. The desire to hold an election where voters' choices are reflected fairly and honestly in the ballot boxes requires autonomous and organizational structures that are well-organized, where personnel determined on the basis of merit are employed, that possess the technological infrastructure, have an undamaged social prestige and image and are totally out of reach of the interference of the party in power. Fair and honest elections will be possible only when institutions and boards that are responsible for the management and supervision of elections are equipped with effective managerial and supervisory mechanisms. Activities aimed at managing and supervising elections exhibit variations because the election management and supervision models which countries adopt change from country to country. In spite of this difference, he common goal of all these models is to manage the process of transferring voters' will to the polls properly and prevent injustices that might arise in the process. In this sense, these institutions and committees have very serious tasks and obligations in ensuring sustainability of democracy. Positive performance that will be displayed by the said institutions and committees will guarantee that the election process will take place and be completed fairly and honestly. The purpose of this study, in which election organization and election mechanisms have been handled in all aspects from the perspective of comparative law, is to propose a model to implementers from the perspective of comparative law practices in order to put into a practice a more effective election management and supervision mechanism.

Kamu hizmetlerinin kamu ilkeleri ölçüsünde, doğrudan kamu kuruluş ve kurumları tarafından yerine getirilmesi alışılagelmiş bir durumdur. Günümüzde kamu hizmetlerinin yerine getirilişinde özel girişimciliğin de etkinliğinin arttığı görülebilmektedir. Bu etkinliğe rağmen kamu kurum ve kuruluşlarının yerine getirdiği hizmet yoğunluğu devam etmektedir. Kamu hizmetleriyle birlikte kamu kurum ve kuruluşlarının idari ve örgütlenmeyle ilgili birtakım sorumlulukları da bulunmaktadır. Hizmetlerin ve sorumlulukların değişen toplum, nitelik, ekonomik ve sosyal davranışlar nedeniyle tek bir merkezden yerine getirilmesini zorlaşabilmektedir. Merkezi yönetimlerin bu iş ve sorumluluk yükünün altından kalkabilmesi için bazı hizmetlerin mahalli idareler tarafından gördürülmesi kaçınılmaz hale gelebilmektedir. Demokratik ilkelerin uygulanabilirliliği açısından da önem arz eden mahalli idarelerin etkinliği, vatandaşın tercihlerinin ve isteklerinin daha kolay ilgili idari yönetimlere ulaşmasını sağlayabilmektedir. Belediyelerin idari ve karar organlarının halk tarafından seçilmesi, vatandaşlara en yakın yönetimlerden biri olması kurulurlarken iyi bir hukuki zemine dayandırılmalarını gerekli kılar. Bu çalışma ile amaçlanan Türkiye'de yerel yönetimlerin en önemli idarelerinden biri olan belediye idarelerinin Osmanlı'dan günümüze hukuksal altyapısını ortaya koyabilmektir. ; It is customary for public institutionst of fulfill public institutions and organizations in accordance with public principles. Nowadays, it can be seen that the efficiency of private entrepreneurship has increased in the performance of public services. Despite this activity, the service density of public institutions and organizations continues. Public institutions as well as public institutions and organizations have some responsibilities related to administration and organization. Services and responsibilities can be difficult to fulfill from a single center due to changing society, quality, economic and social behaviors. In order to overcome the burden of work and responsibility of the central administrations, it may be inevitable that some services will be seen by the local administrations. The effectiveness of local administrations, which are important in terms of the applicability of democratic principles, can enable the citizen's preferences and wishes to reach the administrative administrations more easily. The selection of the administrative and decision-making bodies of the municipalities by the public makes it necessary for them to be based on a good legal ground when they are to be one of the closest administrations to the citizens. This study aimed at Turkey from the Ottoman Empire to the present day, one of the most important authorities of the municipal administration of local authorities to reveal the legal infrastructure.

Bu makalenin amacı Azerbaycan ve Türkiye'nin yabancı yatırım hukuku ve siyasal yapısını mukayeseli açıdan değerlendirmektir. Geçilen on yılı aşkın zaman içerisinde, Azerbaycan ve Türkiye hükümetleri hem siyasal istikrar ve hem de teşvik edici yatırım ortamı kurmuş ve bunları da gerek iç hukukları üzerinde yapmış oldukları düzenlemeler aracılığıyla, gerekse de ikili ve çok taraflı anlaşmalara taraf olarak gerçekleştirmişlerdir. Türkiye, sınırlayıcı yapıya haiz olan önceki yabancı yatırım kanunu ve politikasını özgürleştirerek yabancı yatırımcıyı teşvik eden bir politika izlerken, benzer bir şekilde Azerbaycan ise yabancı yatırımcıyı teşvik amaçlı birçok kanun ve yasal düzenlemeleri, kanun çıkarmaya yetkili otoriteleri vasıtasıyla gerçekleştirmiştir. Bu çalışma gösterdi ki, yabancı yatırımcı için Azerbaycan ve Türkiye'de yatırımcı dostu bir ortam bulmasına rağmen, bu ülkelerdeki bazı problemler, yatırım yapılabilirliği hususunda engel teşkil etmektedir. Bürokratik verimsizlikler, yetersiz şeffaflık ve yüksek derecede ki yolsuzluk Azerbaycan'da yatırım açısında problem teşkil etmektedir. Türkiye'nin yabancı yatırımcı açısından başlıca sorunu ise, yargı sistemindeki aşırı iş yükü ve ağır bürokrasidir. ; The purpose of this article is to examine Foreign Investment Laws, and Political Structure of Azerbaijan and Turkey from a comparative perspective. The governments of Azerbaijan and Turkey have both secured political stability and established an appealing investment environment via adjustments to their domestic law, as well as signing up to bilateral and multilateral international investment treaties over the past decade. Turkey has liberalised its previously restrictive foreign investment law and policy to give encouragement to international investors. Similarly, since the establishment of the Republic of Azerbaijan, its legal authorities have been active in passing various laws with regard to foreign direct investment. The work has provided that although foreign investors seem to have found a friendly investment environment in Azerbaijan and Turkey, there are some major problems which render doing business problematic. Inefficient bureaucracy, a high level of corruption and a lack of transparency in legal and political processes are the major problem for Azerbaijan. From the perspective of investors, Turkey's chief weaknesses lie in its overburdened judiciary system and its cumbersome bureaucracy.

Antik Yunan'dan, ayı balıklarının peşinde güneye inen avcılar tarafından keşfine kadar bir fantezi ya da hayalet olan buz kıta Antarktika, keşfedildiği 19.yüzyıldan bu güne, başlangıçta ekonomik, sonrasında bilimsel ve turistik cazibe merkezi haline gelmiştir. Bu gün Dünyanın iklimsel, biyolojik denge ve hayat kaynağı olarak görülmektedir. Bu nedenle Antarktika Antlaşmalar Sistemi (AAS) adıyla bilinen bir rejime sahiptir. Bu rejimin özünde Kıta'nın bilimsel ve barışçıl amaçlarla ama sömürüsüz kullanılması prensibi yer almaktadır. AAS'ın en önemli ve güncel unsuru olan Antarktika Antlaşması Çevre Koruma Protokolü (Madrit Protokolü / PEPAT) sayesinde Kıta'nın 2048 yılına kadar sömürüye açılması yasaklanmıştır. O tarihten sonra sömürüye açılması kaygıları bulunmakla birlikte, bizce bu kaygıları çok abartmamak gerekmektedir. Günümüzde olduğu gibi yakın gelecekte de bağlam çevre sorunları olacaktır. Dolayısıyla AAS'ın ana ilkesi varlığını sürdürecek fakat rejim zamana bağlı ihtiyaçlar doğrultusunda dönüşüm geçirecektir. Türkiye'de Antarktika'ya ilgi henüz entelektüel düzeydedir. Türk bilim camiasından seçkin kişilerin gayretleriyle Kıta'da yazlık bir üs kurulması başarılmış olsa da AAS içerisinde karar verici statüyü ifade eden Danışman Ülke sıfatı kazanabilmek için daha yapılması gereken çok şey vardır. Öncelikle Antarktika Türk bilimsel araştırma altyapısı kurumsal ve fiziksel açıdan güçlendirilmelidir. Antarktika araştırmaları iç politika malzemesi yapılmamalıdır. ; The ice continent that being a fantasy or ghost from Antique Greece to it's exploration by hunters that descended to southest to follow seals in nineteen century, the Antarctic, has initially been center of economic and then scientific and touristic attraction. The continent are recognized to be the source of climate balance and biological life today. Therefore it has the legal regime named the Antarctic Treaty System (ATS). At the core of the regime, there is the principle consist using of the continent with scientific and peaceful aims without exploitation. It has been banned that exploiting of the continent to 2048, owing to the Protochol of Environmental Protection of Antarctic Treaty (Madrid Protocol / PEPAT) which are the most important element of ATS. Although there is concerned about to starting of exploitation after that date, it can be said that this concerning not be exaggerated. Because, as it is at present, the Context will be environmental problems in the future too. Thereby, the base principle will proceed its exist. But the regime will be able to transformed in the direction of needs according to time. The interest about Antarctic remains level of intellectual in Turkey at present. In spite of the fact that, establishing one summer base would be achieved in 2019 summer season, there are much to do necessary for able to participate among consultative states of which decision-making authority in ATS. Firstly, the Turkish scientific research infrastructure should be developed in terms of institutional and fisical. The Turkish Antarctic studies should not be made domestic policy instrument.

Çevresel etki değerlendirmesi (ÇED), çevre üzerinde olumsuz etkileri muhtemel projelerin hayata geçirilmesinden önce tüm yönleriyle incelenerek, çevreye verebileceği zararların, alınabilecek tedbirlerin ve alternatif yöntemlerin tespiti maksadıyla halkın katılımı ile birlikte yürütülen disiplinler arası bir çalışma ve süreçtir. ÇED sürecinde projeden etkilenecek bölge halkı, konunun uzmanları ve proje sahibinin sağlayacağı bilgi ve değerlendirmeler projenin akıbeti hakkında verilecek kararı etkileyecektir. Bu karar kimi zaman proje için maddi kaynak, zaman ve emek harcayan proje sahibinin aleyhine sonuçlanacak kimi zaman da projeden etkilenecek bölge halkını tatmin etmeyecektir. Bu şartlar altında idari kararın yargı makamları önüne gelerek denetlenmesi gerekecektir. ÇED, idari kararın alınması ve sonuçlarının denetlenmesinde halkın katılımına yer vererek iyi yönetim ilkesini idare hukukuna yansıtmaktadır. Çağdaş bir idari usul müessesi olan ÇED, idarenin çevre ile ilgili kararının ortaya çıkış ve icrasını önceden belirli şekil ve kurallara bağlamakta, böylelikle proje sahibinin ve bundan etkilenecek halkın menfaatlerini korumaktadır. Kuramsal çerçevede önemli bir fonksiyon icra etmesi beklenen çevresel etki değerlendirmesi kavramının ortaya çıkışı, idare hukukuna, idari usule ve idari yargıya yansıması bu tez çalışmasında incelenecek, uygulamadaki sorunlara ilişkin tespit ve çözüm önerilerimiz sunulacaktır. ; Environmental impact assessment (EIA) is an interdisciplinary study and process carried out in order to identify and predict the potential environmental impacts of an investment project and propose means to avoid or reduce the significant impacts. Public participation, the involvement of consultants, and the proponent (investor) during the decision-making process are the main principles of EIA. All the information gathered during the process and evaluation helps the authority at decision making. Unless the positive decision of the authority the proponent can't obtain the permits and licenses to initiate his project. So the final decision can be disadvantageous for the project owner, who spends financial resources, time, and effort. O the other hand sometimes the decision may not satisfy the public that will be affected by the project. Both situations cause a legal conflict that has to be judged at the administrative jurisdiction. The public participation function of EIA ensure reflecting the principle of good governance to the administrative law. EIA, which is a contemporary administrative procedure institution, secure the emergence and execution of the administration's environmental decision to certain rules, thus protecting the interests of the project owner and the public. The development of the concept of environmental impact assessment, its reflection on administrative law, administrative procedure, and administrative jurisdiction will be examined in this thesis, and our determination and solution suggestions regarding the problems in practice will be presented.

anemon ; In this study, the legal and structural transformations on theaxis of thestate of law in Turkey after the Helsinki Summit on 10-11 December 1999 were intended to examine in the context of compliance to the European Union Acquis. For this purpose, the conceptual framework of the rule of law was primarily addressed. Subsequently, the process of unity of the European Union experiencing an axis shift from the economic base to the political ground was evaluated. Then the transformation after the Helsinki Summit, which is the problematic of the study, has been examined in terms of the conditions of the European Union by considering historical moments of the Turkey-European Union relations. After the period in whichTurkey had taken can didacy status, the country took important steps in terms of legal and structural sphere at the point of rule of law. However, the European Union has criticized Turkey for the irexperienced negative developments after 2014. Thus, the positive atmosphere in the first years of the progress reports has been replaced by intense criticism. ; Bu çalışmada, 10-11 Aralık 1999 Helsinki Zirvesi sonrasında Türkiye'de hukuk devleti ekseninde yapılan yasal ve yapısal dönüşümlerin, Avrupa Birliği Müktesebatına uyum bağlamında ele alınması amaçlanmıştır. Akabinde ekonomik temelden siyasal zemine eksen kayması yaşayan Avrupa Birliği'nin birlik oluşturma süreci değerlendirilmiştir. Daha sonra da Türkiye-Avrupa Birliği ilişkilerinin tarihsel uğrakları ele alınarak, çalışmanın sorunsalı olan Helsinki Zirvesi'nin ardından yaşanan dönüşüm, Avrupa Birliği üyelik koşulları açısından incelenmiştir. Türkiye adaylık statüsü elde ettiği dönemden sonra hukukun üstünlüğü noktasında yasal ve yapısal alana taalluk eden önemli adımlar atmıştır. La administración de justicia tiene que ser honesta, servida por personas con una sólida formación jurídica; pero, al mismo tiempo, dotadas también de una inseparable formación complementaria en campos tan próximos al derecho como son la ética, la criminología, la educación psicosocial. Political power prefers jurists who merely apply the law literally and neutrally. The main objective of the law is to decibe what is fair. The administration of justice must be honest, served by people with solid legal training. Hoewer, they must also be endowed with an inseparable complementary training in areas close to law such as ethics, criminology.

Avrupa Birliği Ortaklık Mevzuatı'nda gerçek kişilere tanınan serbest dolaşım özgürlüğü, Kurucu Andlaşma'da yer alan hükümler gereğince tüzel kişilere de uygulanabilir niteliktedir. Bu durumun sonucu olarak herhangi bir Birlik üyesi devlette kurulan bir ticari şirket, Birlik'e üye diğer devletlerde, herhangi bir kısıtlamaya maruz kalmaksızın ticari faaliyette bulunabilecektir. Serbest dolaşım ve yerleşme özgürlüğü tüzel kişilerde, şirket merkezinin bir ülkeden diğerine taşınması; ya da diğer ülkelerde şube veya bağlı şirket açılması yoluyla sağlanmaktadır. Üye devletler, serbest dolaşım ve yerleşme özgürlüğü ilkesi uyarınca yabancı şirketlerin, ülkelerinde ticari faaliyette bulunmasına kısıtlama getiren iç hukuk hükümlerinden kaçınmak durumundadır. Tüzel kişilere tanınan bu iki hakkın altında yatan temel gaye ise yerli-yabancı şirket ayrımının ortadan kaldırılması suretiyle sermaye akışının hızlandırılması ve ortak pazar ekonomisinin sağlanmasıdır. Ancak üye devletlerin iç hukuk hükümleri ve kanunlar ihtilafı mevzuatlarındaki farklılıklar, uygulamada büyük sorunlara yol açmaktadır. Çalışmanın konusunu da; uygulamada karşılaşılan bu sorunların Ortaklık Mevzuatı ve Avrupa Birliği Adalet Divanı kararları ışığında incelenmesi oluşturmaktadır. ; The freedom of mobility granted to natural persons in the European Union Association Legislation is also applicable to the member state legal persons as per the provisions in the Founding Treaty. As a result, a commercial established in an EU member state can conduct commercial activities without any limitations in other EU member states. Freedom of mobility and establishment in legal persons is realized through the relocation of the corporation headquarters from one country to the other or through establishment of branches or affiliated corporations in other countries. Member states are obliged to refrain from legislating national legal provisions which restrict the commercial operations of foreign corporations in their country pursuant to the principle of freedom of movement and establishment. The main purpose of these two rights granted to the legal persons is to increase capital flow and promote common market economy through the ablosihment of foreign – domestic corporation distinction. However, the differences between member states' national legislation and the legislation regarding the conflict of laws lead to crucial problems in practice. This study focuses on the examination of these problems in the light of Association Legislation and the decisions of the European Union Court of Justice.

El present article és un informe que recull l'estat de les presons i la situació legal a Mèxic i que apunta possibles millores a implementar en aquest àmbit. Per abordar el tema penitenciari a Mèxic, s'inicia l'informe puntualitzant la normativitat específica amb la qual es compta, assenyalant tres articles fonamentals de la Constitució Política dels Estats Units Mexicans i l'existència de la Llei Nacional d'Execució Penal, que actualment impacta en tota la República Mexicana. ; This article presents an overview of the state of the prisons and the legal situation in Mexico and suggests a number of possible improvements that might be implemented in this area.
