Unauthorised use of the trademark logo on social media on a massive scale has led to frequent legal conflicts between trademark holders, social media providers and internet users and legal uncertainty. The thesis concludes that trademark infringement and dilution laws in the U.S. and EU are inadequate to solve this problem. The trademark logo on social media should be protected against unauthorised use, even though it is not used to sell the good or service the trademark indicates, but is used in a commercial environment. Two premises for any solution are that first the enforcement should be made automatic, since litigation on a case-by-case basis is not scalable, and second that the safe harbour provisions for online service providers, that aggravate the problem, should be substituted for strict liability. The trademark logo can be seen as the personification of the trademark holder, and one can argue that the stability of the trademark logo is not only in the interest of the trademark holder but also of society at large. One can argue that trademark dilution already provides a kind of moral right of integrity for the trademark logo. However, this right is limited to trademark logos that are considered famous or have a reputation, and, moreover, that are used in a commercial way. This thesis argues that also the trademark logo that did not reach the requested level of fame or reputation and is used in a non-commercial way should also be protected against unauthorised use on social media. Therefore the moral right of integrity is proposed for the trademark logo. Until the law will be amended to include a moral right of integrity for the trademark logo, this thesis suggests to implement proactive solutions in the walled gardens of social media as a testing ground for potential legislation. This automated solution is scalable, makes intellectual property protection and enforcement not only effective but also more calibratable to social policy goals and will inevitable lead to an algorithmic justice. ...

This paper aims at promoting prospective Intellectual Property (IP) securitization as a feasible mode of financing creative industries demanding instant capital to operate, develop products and promote market expansion. The proposed approach is dedicated to accelerate new financial sources of support to strengthen and develop creativity and productivity in the creative industries. The current paper introduces a new legal institution which is not regulated yet under Indonesia's positive laws. It shows how creative companies might use the institution to gain direct and indirect benefits. It is acknowledged that this proposal may spark challenges at the doctrinal, normative and practical levels. At the doctrinal level, the potential for challenge refers to the philosophical issue related to exclusive rights doctrine. At the normative level, the challenges are caused by the absence of regulation concerning IP securitization in Indonesia influencing the validity and viability of IP securitization transactions. At the practical level, this proposal may not guarantee the certainty of IP valuation as a unique asset involving complex procedures, interdisciplinary laws, profesionals and so forth. In order to overcome the doctrinal challenge, this paper offers relevant principles which may function to balance the acceleration of IP securitization as a new financing mechanism for creativity and prevent unrestricted exploitation of IP exclusive rights. For addressing any normative and practical challenges, this work promotes the need for government involvement in developing and promoting IP securitization by providing economic and legal frameworks, started by enactment of IP securitization regulation and the establishment of infrastructures for IP securitization
A lack of proper interpretation of Decentralisatie Van Het Onderwijs or education decentralization in practice has led to confusion in understanding the legal aspects of education decentralization to oversee the targeted acculturation of Indonesian citizens. Decentralisation Van Het Onderwijs, a Dutch education reform law, was the impetus for this study, which seeks to shed light on the role that decentralization plays in the process of cultural assimilation. Through an examination of the decentralization concept associated with Law No. 23 of 2014 concerning regional government, the legal meaning of education decentralization is determined. Of primary importance is creating an educational framework, which includes teaching student's values such as morality and respect for others. This framework can only be established through a well-resourced educational system. When it comes to education, moral training, character development, and social responsibility are all part of formal education. Only traditional religious schools, such as pesantren, can provide all of this information.
Indonesia's marine territory has become a big challenge for the Government of Indonesia to manage it. Nowadays, Indonesian marine has lot of regulation in the sea. But it's cannot prevent the basic interest of all people that earnings life from there. A lot of migrant has been smuggled in and by Indonesian's marine territory. The main concerns that arouse are: how should government give an equation for Indonesian migrant workers that are smuggled and how should the government put migrant workers protection to supply the equation for them. These questions will solve by a normative juridical study on the protection of natural resources and the resources of Indonesian fisherman. The study uses normative legal research which elaborated with conceptual approach from numbers of regulations that apply in marine labor law and employment law. This research is also complemented by a literature approach in the form of Indonesian legal literature and marine journals to address the issues raised in this paper. The findings in practice prove that the government should give more attention for the fisherman's welfare and protection related to fish catching. The objective protection for Indonesian marine resources is from regulated all the regulation to develop Indonesia economic from Maritime sector. It is all needed to make a new system in legal protection for Fisherman and Marine Resources in Indonesia.
Undang-Undang No. l Tahun 1974 In people's lives there is still a frequent way of marriage which is a violation of Law , especially article 2 paragraph 2, namely: "Each marriage is recorded according to the applicable laws and regulations". The definition of violation in the law, known as siri marriage. In this case the law must be understood as a set of rules governing, controlling society. According to Gustav Radbruch law must contain three basic values, namely: 1. Value of justice (philosophical aspect). The validity of the law is justified on the basis of human philosophical beliefs. 2. Value of certainty (juridical aspect). The law is enforced because it is determined by the state (gemeenschap), namely by the government and the people's representative council. 3. Value of benefits (sociological aspects). The validity of the law is due to social reality (society as a whole). In a sociological and philosophical view, siri marriage is relatively acceptable to the community, but judicially cannot be justified because it will have an impact on the low legal awareness of the community. Marriage recording does not determine the validity of a marriage, but only states that the marriage event actually happened, so it is merely administrative. Thus, the marriage is legitimate because it is carried out in accordance with religious law but has a weakness, namely the absence of a recording as referred to in article 2 paragraph 2 of Undang-Undang No. l Tahun 1974 . Penal mediation is an alternative form of settlement of cases outside the court by prioritizing the principle of resortative justice which aims to achieve justice that is oriented towards improving the relationship between perpetrators and victims. This study aims to examine how the implementation and the obstacles faced by the Makassar City Police in conducting penal mediation in the settlement of minor theft cases. This research is a normative empirical research with a qualitative analysis approach. The result of the research obtained is that the implementation of penal mediation by the Makassar City Police in resolving minor theft cases is carried out based on police discretion as regulated by Law Number 2 of 2002 concerning the State Police of the Republic of Indonesia and Circular No. SE / 8 / VII / 2018 dated 27 July 2018 concerning the Application of Restorative Justice in the Settlement of Criminal Cases. The circular regulates how to apply the concept of restorative justice in solving criminal cases at the level of investigation or investigation in the police, while in its implementation there are still obstacles faced by the Makassar City Police, including emotional factors, namely the existence of selfishness between the perpetrator or victim justifying oneself and blaming the opposing party and financial (economic) factors, namely the inconsistency between the victim and the perpetrator to make peace, especially in matters of compensation.
Ormas, which are familiarly referred to as community organizations, are organizations that exist and are formed from the community voluntarily based on the same needs, interests, common aspirations, activities and goals in participating in development for the sake of the Unitary State of the Republic of Indonesia based on Pancasila. The purposes of this study are to reveal the scope of government authority in the dissolution of civil society organizations in Indonesia and the mechanism for the dissolution of civil society organizations in Indonesia. The research method used is normative legal research with a statutory approach. Sources of legal materials used in the form of secondary and primary legal sources through recording and documentation studies in which legal materials and data are managed using interpretive analysis. The results of the study indicate that the scope of government authority in the dissolution of community organizations is based on the attribution authority. Regarding the mechanism for dissolving community organizations, it refers to the provisions of Law Number 16 of 2017 concerning Ormas. The author suggests that the government always conduct socialization and supervision related to the activities of community organizations so that the community and mass organizations must be guided by the 1945 Constitution of the Republic of Indonesia and Pancasila because it is the most important principle in establishing community organizations.
In the perspective of environmental law, welfare which is the political goal of national law is not enough to be based only on the rule of law and democracy, but must also be based on the principles of the utilization of natural resources and environmental management. The principle must be a direction and policy making in the implementation of development, otherwise the welfare achieved will not last long, because Natural Resources as one of the elements of development capital cannot be functioned sustainable. Based on these arguments, conceptually the concept of implementing natural resource utilization and environmental management is the most important thing in national development that has been outlined in the legal policies set by the state or government to achieve the goals and objectives of environmental management. The goals and objectives are so that the environment is not damaged or polluted and maintained its function is preserved to preserve the carrying capacity and environmental capacity in order to achieve national development goals. UU No. 8 tahun 1999 tentang Perlindungan Konsumen tidak menyatakan secara jelas standar dan syarat yang harus dipenuhi pelaku usaha pengaturan hukum perlindungan konsumen terhadap produk SNI wajib dalam perundang-undangan di Indonesia, pertanggungjawaban pelaku usaha terhadap produk yang tidak memenuhi kewajiban SNI, dan upaya perlindungan hukum terhadap konsumen Air Minum Dalam Kemasan (AMDK) dengan menganalisis Putusan Mahkamah Agung RI Nomor 501 K/Pdt.Sus-BPSK/2020. Perlindungan hukum terhadap konsumen melalui SNI wajib megacu kepada Undang Undang No. 20 Tahun 2014 tentang Standardisasi dan Penilaian Kesesuaian. Pengaturan standardisasi wajib juga dapat ditemukan di dalam UU Nomor 3 tahun 2014 tentang Perindustrian dan UU Nomor 7 tahun 2014 tentang Perdagangan. Pada dasarnya, UU Standardisasi dan Penilaian Kesesuaian merupakan derivatif dari Pasal 9 ayat 1 huruf (a) UU No. 8 Tahun 1999 Tentang Perlindungan Konsumen. Mandatory standardization arrangements can also be found in Law number 3 of 2014 concerning Industry and Law number 7 of 2014 concerning Trade. Basically, the Law on Standardization and Conformity Assessment is a derivative of Article 9 paragraph 1 letter (a) of Law no. 8 of 1999 concerning Consumer Protection. The responsibility of business actors for products that do not meet SNI obligations refers to product liability. Business actors can be held civilly responsible by providing compensation to consumers by referring to the Consumer Protection Act regarding the losses incurred.
