The author's goal is to determine the consequences of implementing treaty solutions concerning public debt to the Polish Constitution and to define the differences between the methodology of counting public debt in the European Community and Polish legal order. The raised issues concern important problems from the substantive and practical point of view, therefore the study's content is important for science and practice. The research methodology was based on the analysis of the EU and Poland's normative solutions, opinions expressed in the international and national literature on the subject, and the case law of the Polish Constitutional Tribunal. The paper applies mostly the dogmatic-analytic and legal-comparative method with reference to available statistical data on Poland's public debt. The study allowed the author to gain an understanding of the significance of fiscal rules implemented at the EU level to ensure stability. Article 216(5) of the Constitution of the Republic of Poland indicates that the treaty solutions regarding the reference value (public debt-to-GDP ratio) were reenacted. However, until this day, the EU and Poland's debt measurement methods do not fully correspond. In order to counteract excessive debt incursion, a state is required to take not only efficient actions but also ones that are adequate and, to some extent, flexible. This is an expression of acceptance of the EU's preventive assumptions. However, there is still no full correlation in the methodology of calculating public debt in the EU and the Republic of Poland.
The inauguration of Nelson Mandela as South Africa's first democratic president on 10 May 1994 became a symbol of the end of apartheid and the beginning of a new chapter in the country's history. As South African society was deeply divided, the 1993 Interim Constitution expressed the need for reconciliation between the people of South Africa and the reconstruction of its society. The legacy of apartheid was to be addressed based on 'a need for understanding but not for vengeance, a need for reparation but not for retaliation, a need for ubuntu but not for victimization'. Due to its introduction into the Constitution, ubuntu – a philosophy of unity, cooperation, compassion and respect for human dignity, which originated in small African communities – became a source of values for the whole legal system. The goal of the text is to present the ubuntu philosophy and to describe its role in the South African transitional justice process and in selected areas of South African law (criminal law, evictions and defamation). On the whole, South Africapresents a unique case in which both the political transformation and the legal system were strongly shaped by the said philosophical and ethical concepts, which bear close resemblance to the idea of restorative justice. ; Zaprzysiężenie 10 maja 1994 r. Wobec istniejących w społeczeństwie głębokich podziałów przejściowa Konstytucja RPA z 1993 r. wyrażała potrzebę pojednania pomiędzy obywatelami RPA, a także rekonstrukcji wspólnoty. Przezwyciężenie spuścizny apartheidu miało być oparte na potrzebie "zrozumienia, a nie zemsty", "rekompensaty, a nie odwetu" oraz "ubuntu, a nie wiktymizacji". Filozofia ubuntu (wywodząca się z małych afrykańskich wspólnot filozofia jedności, kooperacji, współczucia i respektu dla ludzkiej godności), do której odwołanie zamieszczono w Konstytucji – stała się rezerwuarem wartości dla całego systemu prawa. Celem artykułu jest przedstawienie filozofii ubuntu oraz omówienie jej roli w rozliczeniach z przeszłością w Republice Południowej Afryki i w wybranych obszarach południowoafrykańskiego prawa: w prawie karnym, regulacjach dotyczących eksmisji z nielegalnie zajmowanego gruntu oraz w regulacjach przewidujących odpowiedzialność deliktową za zniesławienie. RPA jawi się przy tym jako wyjątkowy kazus, w którym zarówno polityczna transformacja, jak i system prawny kształtowały się pod istotnym wpływem omawianych koncepcji filozoficznych i etycznych, silnie nawiązujących do idei sprawiedliwości naprawczej.
Starting from 18 October 2018, public procurement procedures with a value equal to and exceeding the amounts specified in the secondary legislation issued pursuant to Article 11 (8) of the Public Procurement Law (i.e. above the so-called EU thresholds) are covered by the obligation of full electronic communication between the contracting authority and economic operators. Currently, a tender (or an application to participate in the procedure) in a procedure above the EU thresholds, to be valid, must be submitted only in electronic form (and not in paper form) and signed with a qualified electronic signature. The new legal situation resulted in the need to employ, both by economic operators and contracting authorities, new IT tools allowing them to achieve compliance in this regard. Meanwhile, many economic operators, especially medium and small ones, have not had sufficient IT infrastructure (especially software) as well as sufficient knowledge of the ways and methods of electronic preparation and implementation of public procurement processes. A provisional way to implement new solutions is to provide the miniPortal for e-Procurement, which allows for the safe submission of a tender or application for participation in proceedings and statements, including a European Single Procurement Document compliant with the requirements laid down in both the EU law and national law. However, this tool poses many technical problems, causing a number of disruptions in the public procurement process. The publication contains information stemming from the author's and other practitioners' direct observation of the communication between parties in the public procurement process. ; Począwszy od 18 października 2018 r. w postępowaniach o zamówienie publiczne o wartości równej i przekraczającej kwoty określone w przepisach wykonawczych, wydawanych na podstawie art. 11 ust. 8 Prawa zamówień publicznych (czyli powyżej tzw. progów unijnych), obowiązuje pełna elektroniczna komunikacja pomiędzy zamawiającym a wykonawcami. Operations under the auspices of the Security Council mandate span over 70 years. Repeatedly involved in resolving armed conflicts, they have made a significant contribution to ensuring security and stability around the world. In practice, they have taken the form of operations by individual states, coalitions, other international organizations or simply as United Nations missions composed of contingents provided by Troop Contribution Countries (TCC). While operations under the auspices of the United Nations have been involved on several occasions in offensive activities under Chapter VII of the Charter of the United Nations, and the question of responsibility for these actions has been the subject of many legal analyses and judgments, missions organized by the United Nations are always recognized as neutral, and their activities as conciliatory and focused on monitoring the cessation of hostilities, or supervising the disengagement between the parties of the conflict, with the use of force limited to self-defence. Thus, such operations benefited from legal protection, and any action against them was considered a violation of international law. The current engagement of United Nations goes far beyond the traditional understanding of peacekeeping operations. UN missions are frequently authorized to employ all necessary means, up to and including the use of lethal force or even neutralization of the armed group. This creates a situation where in the light of International Humanitarian Law, such actions can be recognized as involvement in armed conflict. This article is intended to show the problems that the international community will soon face to in using United Nations' missions as an instrument for resolving armed conflicts and as a tool for restoring peace and providing stability and securityin the area of operations. It presents the processes of decision-making and subordination, which in some circumstances might result in the United Nations missions being deprived of legal protection and, in addition, made liable for non-compliance with the provisions of International Humanitarian Law. ; Operations under the auspices of the Security Council mandate span over 70 years. Reserved contracts are a legal instrument that allows the promotion of those economic operators who, as part of their business, pursue also social goals. Pursuant to Article 22 (2) of the Act of 29 January 2004 – Public Procurement Law (Journal of Laws 2018, item 1986 as amended), they may only be applied for by sheltered workshops and other economic operators whose activities include the social and professional integration of members of socially marginalised groups. Unfortunately, the use of reserved contracts is in practice marginal, which is also caused by difficulties in interpretation of national laws. The article discusses the institution of reserved contracts and the terms of application thereof, in the context of the EU legislation. ; Zamówienia zastrzeżone są prawnym instrumentem pozwalającym promować tych wykonawców, którzy w ramach prowadzonej działalności realizują także cele społeczne. There are about 2.2 million prisoners in the USA. It is generally viewed that this number is a result of a too severe penal system connected with the introduction of the absolute intolerance for drug crimes policy. But not only gang members and drug dealers are doing time in prison, this system also applies to war veterans. In 2012, there were 181,500 veterans behind bars, especially participants of the recent wars. Most of them face problems with addiction or struggle with permanent unemployment, homelessness or psychological disorders. This phenomenon is alarming because veterans as a privileged group have a social, medical, education cover and all capabilities not to break the law. Veterans as former soldiers, disciplined and well familiar with criminal law, who received ethics and international humanitarian law training courses, from practical point of view should not break the rules stated by the legal system. The image of former veterans who served their country, totally disagree with penitentiary statistics. Recent years have shown that military service, especially in the area of conflict, may become a double-edged sword, and in fact veterans may pose a threat to society.
Artykuł dotyczy poziomu dostosowania ustawodawstwa ukraińskiego do norm Unii Europejskiej w zakresie oceny oddziaływania na środowisko. W materiale poddano analizie główne dokumenty unijne i ukraińskie przede wszystkim: dyrektywę Parlamentu Europejskiego i Rady 2011/92/UE z dnia 13 grudnia 2011 r. w sprawie oceny skutków wywieranych przez niektóre przedsięwzięcia publiczne i prywatne na środowisko, dyrektywę 2001/42/WE Parlamentu Europejskiego i Rady z dnia 27 czerwca 2001 roku w sprawie oceny wpływu niektórych planów i programów na środowisko, oraz ustawę Ukrainy o ekspertyzie ekologicznej. Na podstawie tego można stwierdzić, że pomimo rozbudowanej bazy ustawodawczej na Ukrainie w tym zakresie, poziom jego dostosowania do norm unijnych jest niski. ; The article is about the level of adaptation Ukrainian legislation to the European Union standards in the area of environmental assessment. In the material the main European and Ukrainian documents are analysed: Directive 2011/92/EU of The European Parliament and The Council of 13 December 2011 on the assessment of the effects of the certain public and private projects on the environment, Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment and The Law of Ukraine "On the environmental assessment". Due to the above it is necessary to emphasize that, in spite of large legislation base in Ukraine in this area, the level of its adaptation to the EU standards is low.
The subject of considerations are the legal aspects of the influence of the EU climate and energy framework and trade policy on implementation of permanently sustainable forestry. Even though forestry belongs to the competences of Member States and there is no formal establishment of common forest policy in the TFEU, the new LULUCF Regulation and provisions of regulations regarding prevention of illegal timber trade prove that there is an ongoing process of subjecting forestry to the competencies of the European Union to a growing extent as well as reducing the area left to Member States. It must be stated that the platform for expansion of EU regulations on Member States' forestry in terms of land use and timber trade – acts adopted within the trade policy and climate and energy framework – is the principle of sustainable development that derives from international legislation and is also included in the Constitution of the Republic of Poland. This principle is also the foundation for development of the beginnings of common forest policy that emerges at the verge of EU policies. ; Przedmiotem rozważań są prawne aspekty wpływu unijnej polityki klimatyczno-energetycznej oraz handlowej na realizację trwale zrównoważonej gospodarki leśnej. Mimo zaliczenia gospodarki leśnej do kompetencji krajów członkowskich i braku formalnego ustanowienia wspólnej polityki leśnej w TFUE nowe rozporządzenie LULUCF oraz przepisy rozporządzeń dotyczących przeciwdziałania nielegalnemu obrotowi drewnem świadczą o postępującym procesie coraz większego podporządkowania gospodarki leśnej kompetencjom Unii Europejskiej i redukowania obszaru zostawionego krajom członkowskim. Realizując cel rozważań, stwierdzić należy, że płaszczyzną ekspansji unijnej regulacji obejmującej gospodarkę leśną krajów członkowskich w sferze zarządzania gruntami, a także obrotu drewnem, a więc aktów przyjętych w ramach polityki handlowej i klimatyczno-energetycznej, jest zasada zrównoważonego rozwoju wywodząca się z prawa międzynarodowego, uregulowana także w Konstytucji Rzeczypospolitej Polskiej. Zasada ta stanowi również podstawę do kształtowania się zalążków wspólnej polityki leśnej, wyłaniającej się na styku innych unijnych polityk.
