According to the geopolitical dimension, the concept of security is ambiguous. Security usually involves protection from external military threats or risks to a state by another state, as well as protection from internal military threats from non-state entities. In recent decades, the traditional concept of security has been completed by other concepts that have expanded the nature of possible threats, joining to the military threats the threat of terrorism, organized crime and diseases, combined with economic, political, social, environmental and biological risks. Accordingly, the list of threats has been revised, in particular for security at the global, national and individual levels.Today, we observe the world's leading countries struggling to overcome the financial and economic challenges caused by the COVID-19 pandemic. At the end of the twentieth century and in the first twenty years of the twenty-first century the ecological and biological threats and the insidious danger they bring became especially acute. The means of mass destruction include toxic and bacteriological (biological) weapons. The action of the latter is based on the use of pathogenic properties of biological warfare agents – microorganisms that can reproduce in humans, animals and plants and cause mass diseases. The use of infectious agents for base purposes can have not only military but also terrorist and criminal purposes. Therefore, in recent years, the international community has made significant efforts to analyze the effectiveness of compliance with national laws, codes of conduct and ethics, disease surveillance and response, bioprotection and biosecurity. Together with the developed mechanisms of counteraction and security, the development of microbiological and medical technologies, the real challenge of the scale of civilization at the end of 2019 was the spread of the COVID-19 virus. ; У геополітичному вимірі поняття безпеки є неоднозначним. The 2009 ECtHR's decision in case Sejdić and Finci v. Bosnia and Herzegovina initialized the discussions concerning the discrimination in enjoyment of the right to be elected in Bosnia and Herzegovina and afterwards this topic received substantial attention. However, the related latter decisions did not receive the same attention. This was reflected in the academic literature whereas latter cases that have since then come forth, have not been sufficiently examined and analysed. Even the decision in case Sejdić and Finci v. Bosnia and Herzegovina was generally evaluated in connection to the country's prospective EU membership, while its other impacts have not been examined. In this respect, this thesis aimed for analysing all relevant ECtHR's decisions concerning the right to be elected in Bosnia and Herzegovina and their impacts. In conducting this analysis, applying an interdisciplinary approach was opted for in particular. Likewise, the international human rights regimes were taken as a basis in constructing the theoretical framework of the discussed topic, which is in the scope of international human rights law. Adopting this approach was essential because the international human rights regimes are the topic of intersection between international law and international relations. Thereby, regime theory was used as the theoretical framework of the thesis, and the analysis was developed through the application of document analysis and case study methods. When regime theory is discussed in connection with human rights, it basically argues that states commitment to international legal human rights regimes' rules and theircompliance with the decisions of international human rights tribunals occurs in the same way and cannot be thought of separately. Furthermore, it stresses that obtaining the image of 'a country that respects human rights' for states in international community is a necessity. In this sense, the core debate of this thesis is if the right to be elected is a political right guaranteed on a national and an international level. Although not explicitly guaranteed in the Dayton Constitution, the right to be elected is guaranteed in the Law on Election in Bosnia and Herzegovina. The main reason for this is in the fact that the Dayton Peace Agreement and its annexes primarely aimed on peacebuilding, but also extensive state-building and reconstruction of the society in this war-torn country. The privileges given to the constitutional peoples in Agreement's annex IV – the Dayton Constitution - left the country vulnerable to political maneuvers and have created obstacles for progress concerning the enjoyment of the right to be elected. Within this period, the problem of the implementation of the relevant ECtHR decisions had also arised. By becoming a member of the Council of Europe, Bosnia and Herzegovina has ratified ECHR and accepted its standards, and the implementation of the ECtHR's decisions became one of its international commitments. In practice, the most important effect of the implementation problem regarding the ECtHR decisions for Bosnia and Herzegovina came forward by non-acceptance of much needed and long negotiated constitutional reforms proposal in the Parliament. The results of this research show that the right to be elected and the discrimination in enjoyment of the right to be elected have not been sufficiently researched and theorized. This concept deserves to be more examined in literature, as well as to be more discussed in practice. In this thesis, it was aimed both to contribute to filling the indicated gap in literature, and to provide a contribution to the discussions on fundamental constitution reform in Bosnia and Herzegovina in connection with the impacts and results of implementation of the ECtHR decisions examined in this thesis. ; AİHM'nin 2009 yılında verdiği Sejdić ve Finci/Bosna-Hersek kararı, Bosna-Hersek'te seçilme hakkından yararlanmada ayrımcılıkla ilgili tartışmaların başlamasını sağlamış ve karar sonrası konu büyük bir ilgi görmüştür. Ancak daha sonra alınan alakalı kararlara aynı ilgi gösterilmemiştir. Akademik literatürde de aynı şekilde sonraki kararlar ilgi görmemiş; yeterince incelenip analiz edilmemiştir. Sejdić ve Finci/Bosna-Hersek kararı bile genellikle ülkenin AB'ye üyelik sürecine bağlı olarak tartışılmış; diğer etkileri yeterince ele alınmamıştır. Bu bağlamda bu tezde, AİHM'nin Bosna-Hersek ile ilgili seçilme hakkı bağlamında verdiği ilgili tüm kararların ve bu kararların etkilerinin analiz edilmesi amaçlanmıştır. Analiz yapılırken özellikle disiplinlerarası bir yaklaşımın kullanılması tercih edilmiştir. Zira, uluslararası insan hakları hukuku kapsamında ele alınan konunun teorik çerçevesinin çizilmesi noktasında uluslararası insan hakları rejimleri esas alınmıştır. Uluslararası insan hakları rejimleri hem uluslararası hukuk hem de uluslararası ilişkilerin kesiştiği bir konu olması dolayısıyla, bu yaklaşımın benimsenmesi elzem hale gelmiştir. Böylece tezin teorik çerçevesi olarak rejim teorisi benimsenmiş, belge analizi ve vaka çalışması yöntemleri uygulanarak analiz geliştirilmiştir. Rejim teorisi insan hakları bağlamında ele alındığında temelde devletlerin uluslararası insan hakları rejimlerinin kurallarına uyum sağlamasının ve insan hakları mahkemesi kararlarına riayet etmesinin aynı minvalde gerçekleşebileceğini, birbirinden ayrı düşünülemeyeceğini ileri sürmektedir. Ayrıca, uluslararası toplum nezdinde 'insan haklarına saygı duyan bir ülke' imajı kazanmanın devletler açısından bir gereklilik olduğunu vurgulamaktadır. Bu paralelde tezin merkezinde seçilme hakkının ulusal ve uluslararası düzeyde garanti edilen bir siyasi hak olup olmadığı yer almaktadır. Seçilme hakkı Bosna-Hersek mevzuatında, Dayton Anayasası'nda açık olarak ifade edilmemiş olup, Bosna-Hersek Seçim Kanunu'nda düzenlenmiştir. Bunun temel nedeni, Dayton Barış Anlaşması ve ekleri ile öncelikle savaştan zarar görmüş Bosna-Hersek'te hem barışın tesisi, hem kapsamlı bir devlet inşası amaçlanmış olmasıdır. Anlaşma'nın IV. eki olan Dayton Anayasası'nın içinde var olan kurucu halkların ayrıcalıkları da ülkeyi siyaseten alınacak manevralara karşı savunmasız bırakmış; seçilme hakları konusunda ilerleme sağlanmasına engel olmuştur. Ayrıca bu süreçte verilen konuyla ilgili AİHM kararlarının uygulanması sorunu da doğmuştur. Bosna-Hersek Avrupa Konseyi'nin üyesi olunca AİHS'i onaylayıp standartlarını kabul etmiş ve AİHM'nin kararlarını uygulamak uluslararası sorumluluklarından bir tanesi olmuştur. AİHM kararlarının uygulanması sorununun Bosna-Hersek için en önemli etkisi, ciddi bir biçimde ihtiyaç duyulan ve uzun süre müzakere edilen anayasa değişiklikleri önergesinin mecliste kabul edilmemesi şeklinde ortaya çıkmıştır. Bu çalışma boyunca elde edilen veriler seçilme hakkı ve seçilme hakkından yararlanmada ayrımcılıkla ilgili konuların yeterince araştırılmamış ve teorize edilmemiş olduğunu göstermiştir. Halbuki seçilme hakkı literatürde daha çok incelenmeyi hak ettiği gibi, pratikte de daha tartışılır olunmayı hak eden bir kavramdır. Bu tezle hem literatürdeki bu boşluğun doldurulmasına katkı sağlanması; hem de tez kapsamında incelenen AİHM kararlarının etkisi ve verilen kararların uygulanması sonucu konu ile ilgili Bosna-Hersek'te temel bir anayasa reformu yapılması tartışmasına katkı sağlanması amaçlanmıştır.

In both Argentina and Brazil, the emergence of fiction was linked to a central contradiction. At the heart of fiction in nineteenth-century Argentina and Brazil there was a resistance to fiction. Fiction's defining trait was, precisely, its displaced use: in the impossibility of autonomous existence, its presence was highlighted by its forced absence; fiction became the negative condition of possibility of the written word both in the politically charged climate of national self-assertion following post-independence Argentina and in the early years of the Brazilian First Republic. As a result of this negative or residual formation, fiction --the non-authoritative discourse par excellence-- was both able and forced to engage with other --authoritative-- disocurses, such as those of philosophy, law, science, and political theory. At the same time, owing to its non-committal to pre-established categories of thought and theoretical frameworks, fiction was able to open up a discursive space from within which a crtical examination of both the authority and the legitimizing mechanisms of such discourses became possible. In this dissertation, I focus on the Brazilian and Argentine contexts to examine two key moments of the intersection of between fiction, aesthetics, and the theoretical triad of philosophy, law, and political theory, , tracing a critical genealogy in which the rise of autonomous fiction and discourses of authority are seen as mutually determinant. I begin, in Chapter 1, by analyzing the ambiguities surrounding two founding figures in the canon of each country: Domingo Faustino Sarmiento, in Argentina, and Euclides da Cunha, in Brazil. Not the least among these ambiguities is that, from the start, the discursive canon of which they occupy the center cannot be clearly defined. It is a canon that is both literary and socio-political, tellingly oscillating between the boundaries of the fictional and the non-fictional. Sarmiento and da Cunha, I contend, are located, each in their respective contexts, at a historical crossroad that offers a privileged glimpse into the mechanisms of formation of discursive authority. Writing at a time when received models and existent criteria proved insufficient and new ones were yet to be formed, they found themselves at a transitional moment in which the urgency of judgment was all the more pressing in light of the absence of criteria by which to judge. Examined from this perspective, new light is cast on the difficulty of generic classification which has marked the reception of Sarmiento's Facundo and da Cunha's Os Sertões to this day. I bring critical theory into dialogue with aesthetic theory and law studies to suggest that the aesthetic dimension in their works lies in the fact that in both texts we see a discourse at work in which the productive moment is emphasized over its doctrinary, legislative moment. In them, form, not yet crystallized into the formulas and formalities of categories and genres, is witnessed at its moment of formation, which is also the moment in which the authority of discourse, not yet having covered the tracks of its own genesis, reveals itself at its most fragile and contingent. It is the aesthetic dimension understood in this critical and productive relationship to pre-established categories of thought that I take up in the second and final part of the dissertation, encompassing Chapter 2 and 3, where I focus on the works of João Guimarães Rosa and Jorge Luis Borges, in Brazil and Argentina, respectively. In Chapter 2, dedicated to Rosa, I offer a reading of Grande Sertão: Veredas which emphasizes the book's allegorical dimension and the connection between allegory's interplay of identity and difference, presence and absence, with fiction's own modus operandi vis-à-vis the authoritative discourses of political and legal theory. I also offer a reading of a central episode in Grande Sertão: Veredas -- the trial of Zé Bebelo at the Sempre-Verde ranch-- in which fictional representation and political representation --the problematic history of political representation in Brazil-- are played against each other. In the final chapter, I examine the work of Jorge Luis Borges to show how fiction, understood as a discourse that does not conceal its moment of artifice, plays a mediating function between the production of authority and its legislating role, and in so doing opens up the possibility of a critical examination of its own validating assumptions and epistemic frameworks. I first examine how Borges problematizes the question of tradition and national identity through a discussion of his essay "El Escritor Argentino y la Tradición". In that essay, Borges offers as an alternative to a substantive national identity an identity that is relational and adjectival. This notion of an "adjectival identity"-- an identity that defines itself contextually, by means of the interplay of similarity and difference with all other identities, will guide Borges's own aesthetic project and his own insertion within the literary tradition with which he is, from the start, always already in dialogue. I then offer a close-reading of an essay and two fictional short stories of Borges's in which the genesis of authority is thematized - namely, Una vindicación del Falso Basílides, Los Teólogos, and Tres Versiones de Judas, in which the violent consolidation of the religious canon is set against the greater plausibility of heretic alternatives. I go on to examine how Borges's fictions find their counterpart in his essayistic work so as to constitute a coherent critique of philosophical authority. It is a critique in which the non-apodictic logic of fiction, by means of a semblance that mirrors the structural plausibility of philosophical discourse yet replaces philosophy's quest for the unity of truth with the forking paths of discursive possibility, denounces the contingency that underlies the categorical postulates of philosophy. To the extent that acknowledging the contingency of its own postulates poses a threat to the authority of a philosophical system, Borges's aesthetic critique of philosophical authority seems to suggest that philosophical logic ultimately resides on a fundamental denial, one in which what is at stake is precisely its categorical distinction from fictional discourse: the denial of its own moment of artifice.

Legalisation cannot be fully explained by interest politics. If that were the case, the attitudes towards legalisation would be expected to be based on objective interests and actual policies in France and Germany would be expected to be more similar. Nor can it be explained by institutional agency, because there are no hints that states struggle with different normative traditions. Rather, political actors seek to make use of the structures that already exist to guar-antee legitimacy for their actions. If the main concern of governmental actors really is to accumulate legitimacy, as stated in the introduction, then politicians have a good starting position in the case of legalisation of illegal foreigners. Citizens" negative attitudes towards legalisation cannot be explained by imagined labour market competition; income effects play only a secondary role. The most important explanatory factor is the educational level of each individual. Objective interests do not trigger attitudes towards legalisation, but rather a basic men-tal predisposition for or against illegal immigrants who are eligible for legalisation. Politics concerning amnesties are thus not tied to an objectively given structure like the socio-economic composition of the electorate, but are open for political discretion. Attitudes on legalising illegal immigrants can be regarded as being mediated by beliefs and perceptions, which can be used by political agents or altered by political developments. However, politicians must adhere to a national frame of legitimating strategies that cannot be neglected without consequences. It was evident in the cross-country comparison of political debates that there are national systems of reference that provide patterns of interpretation. Legalisation is seen and incorporated into immigration policy in a very specific way that differs from one country to the next. In both countries investigated in this study, there are fundamental debates about which basic principles apply to legalisation and which of these should be held in higher esteem: a legal system able to work, humanitarian rights, practical considerations, etc. The results suggest that legalisation is "technicized" in France by describing it as an unusual but possible pragmatic instrument for the adjustment of the inefficient rule of law. In Germany, however, legalisation is discussed at a more normative level. Proponents of conservative immigration policies regard it as a substantial infringement on the rule of law, so that even defenders of a humanitarian solution for illegal immigrants are not able to challenge this view without significant political harm. But the arguments brought to bear in the debate on legalisation are not necessarily sound because they are not irrefutable facts, but instruments to generate legitimacy, and there are enough possibilities for arguing and persuading because socio-economic factors play a minor role. One of the most important arguments, the alleged pull effect of legalisation, has been subjected to an empirical investigation. In the political debate, it does not make any dif-ference whether this is true or not, insofar as it is not contested by incontrovertible findings. In reality, the results suggest that amnesties indeed exert a small attracting influence on illegal immigration, which has been contested by immigration friendly politicians in the French par-liament. The effect, however, is not large; therefore, some conservative politicians may put too much stress on this argument. Moreover, one can see legalisation as an instrument to restore legitimacy that has slipped away from immigration politics because of a high number of illegally residing foreigners. This aspect explains some of the peculiarities in the French debate on legalisation, e.g. the idea that the coherence of the law is secured by creating exceptional rules for legalising illegal immigrants. It has become clear that the politics of legalisation are susceptible to manipulation by introducing certain interpretations into the political debate, which become predominant and supersede other views. In this study, there are no signs of a systematic misuse of this constellation by any certain actor. However, the history of immigration policy is full of examples of symbolic politics in which a certain measure has been initiated while the actors are totally aware of its lack of effect. Legalisation has escaped this fate so far because it is a specific instrument that is the result of neglecting populist mechanisms rather than an ex-ample of a superficial measure. This result does not apply to policies concerning illegal immi-gration in general, both with regard to concealing a lack of control and flexing the state- muscles. ; Die Dissertation beschäftigt sich mit illegaler Einwanderung und der Legalisieurng von illegalen Einwanderern in Europa. Sie geht drei zusammenhängenden Fragen nach, die empirisch untersucht werden: Welches sind die bestimmenden Gründe für Einstellungen der europöischen Bevölkerung gegenüber der Legaliserung von illegalen Ausländern, die bereits seit einigen Jahren im Einwanderungsland leben? Wie werden Maßnahmen für oder gegen Legalisierungen in der politischen Diskussion Deutschlands und Frankreichs legitimiert? Haben Legalisierungsmaßnahmen einen Effekt auf zukünfitge illegale Einwanderung? Die Beantwortung der ersten Frage baut auf theoretischen und empirischen Arbeiten zu Einstellungen gegenüber Einwanderung auf. Diese werden auf Einstellung gegenüber Legalisierungen angewendet. Arbeitsmarktkonkurrenz, das soziale Sicherungssystem uns sozialpsychologische Erklärungen werden mit einer Mehrebenenanalyse einer Eurobarometerumfrage von 2003 getestet. Die Ergebnisse zeigen, dass Bildung die wichtigste Rolle spielt. Zusammen mit früheren Legalisierungen in dem betreffenden Land führt höhere Bildung zu einer höheren Zustimmung zu Legalisierungen. Wettbewerb auf dem Arbeitsmarkt tritt demgegenüber in den Hintergrund. Legalisieren bedeutet zuzugeben, dass der Staat nicht in der Lage ist, seine Gesetze zu Einwanderung und Aufenthalt umzusetzen. Dies stellt besondere Anforderungen an die Legitimierung von Amnestien. Frankreich und Deutschland gehen unterschiedlich an mit illegalem Aufenthalt verbundenen Problemen heran. Im zweiten Teil der Arbeit werden parlamentarische Debatten daraufhin untersucht, wie Regierung und Opposition ihre zustimmende oder ablehnende Haltung zu Legalisierungen begründen. Auf der Grundlage von mehreren Dutzend Reden werden Argumetnationsmuster identifiziert, mit denen die Redner Zustimmung zu ihren Vorschlägen zu erzeugen versuchen. In Deutschland wird die politische Debatte von der Vorstellung einer Steuerbarkeit der Einwanderung und der Gefährung der Kohärenz des Rechts durch Legalisierungen bestimmt. Dagegen werden Legalisierungen in Frankreich von beiden Seiten des poltischen Spektrums auf einer etwas pragmatischeren Ebene diskutiert, so dass sie Gegenstand einer offenen politischen Auseinandersetzung sind. Ausgangspunkt für den dritten Teil sind die von eingen Mitgliedstaaten der Europäischen Union geäußerten Befürchtungen, dass die in einigen Ländern nicht unüblichen Legalisierungen von illegalen Einwanderern zu verstärkter illegaler Einwanderung führen können. Diese Frage wurde bislang für Euopa nicht empirisch überprüft, was auch mit bislang nicht verfügbaren Daten zusammenhängt. Das Design von empirischen Untersuchungen von Steueramnestien wird für die Analyse der Auswirkungen von Amnestien im Ausländerrecht übernommen. Ein Datensatz der Europäischen Kommission (Cirefi) wird für eine Panelanalyse genutzt, wobei für Arbeitsnachfrage, Netzwerkeffekte und Kontrolldichte kontrolliert wird. Die Daten weisen Beschränkungen hinsichtlich ihrer Konsistenz auf. Unter diesem Vorbehalt lässt sich feststellen, dass Legalisierungskampagnen einen leichten positiven Effekt auf illegale Zuwanderung ausüben.

Obilježavajući 250-tu obljetnicu šumarstva u Hrvatskoj kroz mnogobrojna događanja i aktivnosti, naznačene u programu objavljenom u Zapisniku 4. sjednice Upravnog i Nadzornog odbora HŠD-a u Šumarskome listu 11-12/2014., svoj doprinos ovoj značajnoj obljetnici nastojali smo dati i u ovoj rubrici.U dvobroju 1-2/2015. tekstom "Lutanja u gospodarenju privatnim šumama" ukazali smo na neke probleme u gospodarenju tim šumama, koristeći se i tekstovima iz povijesti šumarstva. Naime, mogli bismo reći da se tim problemima prilazi kao da se radi o zanemarivoj površini, a zapravo je to više od 1/5 površina šuma u Hrvatskoj, za koju također vrijedi Zakon o šumama, što se nažalost zaboravlja. Posebno smo ukazali na nekontrolirane sječe i "haračenje" bez učinkovitog nadzora i mjera suzbijanja takvoga stanja, te bez jasnih zakonskih podloga za kažnjavanje odnosnih sudionika. Još jednom se ukazuje na potrebu udruživanja malih privatnih šumo-posjednika, čime bi se izbjeglo dosadašnje gospodarenje na razini čestice i osigurala mogućnost lakšeg gospodarenja u duhu ZOŠ-a, te mogućnost učinkovitijeg korištenja EU fondova.U dvobroju 3-4/2015. ukazujemo na sve očitiji odmak od načela potrajnog gospodarenja i upravljanja šumom kao obnovljivim resursom i najsloženijim ekosustavom, poistovjećujući ga sve više s "tvorničkom halom". U svrhu proiz­vodnje najveće kvalitete i kvantitete drvnih sortimenata, potrebno je maksimalno korištenje potencijala šumskog staništa, ali strogo se držeći načela potrajnog gospodarenja, jer bi njegova degradacija vodila u katastrofu. Stoga je neophodno da cijelim procesom upravljanja i terenskog rada rukovode i nadziru ga "teoretično i praktično naobraženo gospodarstveno osoblje". Ako je proklamirani cilj gospodarenja proizvodnja najvrjednije drvne mase, onda i njeno korištenje mora biti racionalno, usmjereno ponajprije na domaći visoko finalizirani proizvod, koji uz financijski rezultat osigurava i visoku zaposlenost.U dvobroju 5-6/2015. uz "pomoć" teksta "Državni ispiti za samostalno vođenje šumskog gospodarstva" iz Šumarskoga lista 1880. i 1881. godine, osvrnuli smo se na važnost stručnog upravljanja i gospodarenja šumama, zalažući se ponajprije za stručno, a ne političko kadroviranje. Ističe se, kako nije dovoljno imati samo odgovarajuću stručnu spremu, nego je potrebno postepeno stjecanje praktičnih znanja i iskustva za rukovođenje šumskog gospodarstva. Tako osposobljeni šumarski kadrovi imaju svoj limit. "Ne ima svatko sposobnosti, da ono bude, što hoće, i uz najbolju volju može se dogoditi, da komu njegove vlastite naravne sposobnosti reknu: dovde i ne dalje. Ne treba tumačenja, da uslied ovakovih pogrešaka trpi ponajprije šuma".U dvobroju 7-8/2015., također uz "pomoć" teksta iz Šumarskoga lista iz 1895. godine, povlačeći paralelu s današnjicom, skrenuli smo pozornost na već tada traženu stručnu i organizacijsku sposobnost šumarskoga kadra na najodgovornijim radnim mjestima u šumarskim institucijama, ponajprije "nadšumara, protustavnika i šumara (upravitelja šumarije)". Zaključak, kako uz postepeno stručno usavršavanje kroz praksu "poštenje je kruna vrlina čovjeka, kojemu su povjereni milijuni narodnog imetka" i danas bi trebalo biti sastavnica etičkog profila šumarskoga stručnjaka.Riječ Uredništva "Jesmo li iz povijesti nešto naučili" iz dvobroja 9-10/2015., kako čujemo "uzbudila je duhove", a mi smo samo "pušuć i na hladno" uz primjer iz povijesti upozorili na ono što bi se moglo dogoditi osnivanjem većinske privatne tvrtke Hrvatsko drvo d.o.o., s udjelom od 25 % Hrvatskih šuma d.o.o. kao suosnivača. Razvidno je, da je tema bila pogođena.Kako "nada umire posljednja", i mi se u idućoj godini nadamo boljitku i adekvatnom vrednovanju šumarske struke na svim razinama. S tom željom svim čitateljima Šumarskoga lista želimo Čestit Božić te sretnu i uspješnu 2016. godinu. Uredništvo ; The 250th anniversary of forestry in Croatia was marked by a number of events and activities set down in the Minutes of the 4th meeting of the CFA Managing and Supervisory Board and published in Forestry Journal 11-12/2014. Our column has also tried to give a contribution to this grand anniversary.In the double issue I-2/2015, the text "Disorientation in private forest management" highlights some problems in the management of these forests. Some tests from the history of forestry were also used to reinforce the problem matter. It could almost be said that the problems are treated as if the area in question was almost negligible, while in fact private forests account for one fifth of the forested area in Croatia and are governed by the Law on Forests, a fact often forgotten. We particularly pointed to uncontrolled felling operations and "pillage" and to lack of efficient supervision, measures of preventing such activities and clear legal bases for the punishment of perpetrators. A renewed plea was made for small private forest owners to unify in order to avoid management at the level of a plot, make management easier in line with the Law on Forests and ensure the possibility of more efficient use of EU funds.The double issue 3-4/2015 is concerned with a growing shift away from the principle of sustainable management and planning of forests as a renewable resource and the most complex ecosystem, as well as with the treatment of this system as a "factory hall". In order to achieve the best quality and quantity of wood assortments, it is necessary to make maximum possible use of forest site potential, at the same time taking care that the principles of sustainable management are strictly adhered to, since its degradation would lead to catastrophe. It is therefore essential that the entire process of management and field work is undertaken and supervised by "highly educated management personnel who posses theoretical and practical knowledge for useful and sustainable management of forests". If the proclaimed goal of management is to produce the most valuable wood mass, then its use should also be rational and directed primarily to domestic highly finalized product, which guarantees not only financial gains but also high employment.In the double issue 5-6/2015, drawing on the text "State exams for independent management of a forest enterprise" from Forestry Journal of 1880 and 1881, we tackled the importance of expert forest planning and management and advocated professionally based rather than politically based selection of personnel. It is not sufficient to possess adequate school credentials: what is necessary it to gradually gain practical knowledge and experience for the management of a forest enterprise. Even forest personnel trained in such a way have their limits. Not everybody is capable of being what he wants to be; try as hard as one might, one's own natural abilities tell you: you can get no further than this. Needless to say, it is the forest that suffers the most in the aftermath of such errors".The double issue 7-8/2015, also using the text from Forestry Journal of 1895, draws a parallel with the present time and highlights expert and organisational abilities of the forest personnel in the most responsible work places in forestry institutions. This refers primarily to county foresters, accountants and foresters (chief forest managers). As in the past, gradual specialized education through practice, combined with "honesty as the crown virtue of a person who has been entrusted with the wealth of national property", should constitute the ethical profile of a forestry expert today as well.The Editorial "Have we learnt something from history" in the double issue 9-10/2015, as we hear, has "stirred up the ghosts"; however, what we only attempted, just to be on the safe side, was to use some historical examples to warn of what might happen if a major private company Hrvatsko Drvo Ltd is founded, with 25% share of Hrvatske Šume Ltd as a co-founder. Clearly, the topic hit the target.As we all know, "hope dies last", so we truly hope that the forestry profession will be improved and adequately evaluated at all levels in the year to come. With this in mind, we would like to wish all the readers of Forestry Journal Merry Christmas and Happy and Successful New Year 2016.Editorial Board

This aim of this report is to assess the accounting and financial auditing standards and practices in Burkina Faso in the private and semipublic sectors, using as benchmarks International Financial Reporting Standards (IFRS) and International Standards on Auditing (ISA) and taking into account the good practices noted in the international sphere in these two areas. The main objective of this assessment is to make recommendations aimed at strengthening accounting, financial auditing, and financial transparency practices in the private sector and semipublic enterprises in Burkina Faso. The development objectives associated with these recommendations are as follows: (i) stimulating private investment and enhancing the competitiveness of enterprises; (ii) improving governance in the private market and semipublic sector; and (iii) achieving greater integration of the Burkinabe economy at the regional and international levels.

A review of the history of the United States from its colonial origins shows how Americas successful development has always been guided by two basic principles: representative democracy, and a proper division of power between national and subnational governments. The United States of America was established as an independent nation by a congress of delegates from 13 provincial assemblies, each of which consisted of representatives elected by their communities. Since colonial times, local democratic rights have attracted immigrants to help build new towns in the growing nation. Responsible local governments in America have had the power and the incentive to make local public investments for developing prosperous communities. Democratic competition in America has been strengthened by the ability of successful local leaders to become competitive candidates for higher offices. But in spite of Americas example, many nations since the French Revolution have instead been drawn to centralized democracy, as national elites may prefer to centralize power around themselves. Americas successful growth ultimately depended on its citizens basic understanding that their welfare and security were enhanced by a balanced federal division of power between their elected local governments and the higher sovereign government of their nation.

Last Thursday, the Supreme Court struck down President Biden's student loan forgiveness program, finding that it was not plausibly authorized by statute and that the State of Missouri had standing to challenge the program via a state‐​created loan‐​servicing entity that would lose tens of millions of dollars in fees if the program took effect. This post will explain why Cato filed its own, now‐​moot challenge to the loan forgiveness program, followed by some thoughts on the increasingly pernicious role of "avoidance doctrines" such as standing, ripeness, and mootness in public‐​policy litigation.
The great miltitary strategist Sun Tzu famously said that the acme of skill in war is to subdue the enemy without fighting. For government lawyers, the acme of skill is to shield unlawful policies from judicial review by persuading courts that there is some procedural bar against challenging them. Last week, the Supreme Court rebuffed the Biden administration's attempt to employ that precise stratagem to forestall a judicial determination as to whether the president has the power to forgive nearly half‐​a‐​trillion dollars worth of student loans without express congressional authorization. Surprising no one, the Court's answer to the substantive question was a resounding "no." But constructing a legal challenge that would ensure the judiciary reached the merits of that question was a dicey proposition. Why? One word: standing.
In brief, standing is a court‐​created rule that says only certain people can challenge a given policy in court. To have standing, the would‐​be plaintiff must have suffered a concrete injury that was caused by the policy at issue and can be fixed (or "redressed") by the courts. Thus, for example, I do not have standing to challenge the Justice Department's sweetheart plea deal with Hunter Biden, both because I've not been personally injured by it (mere outrage is insufficient) and because there's really nothing the courts can do about DOJ's propensity for coddling VIPs.
Like so many judge‐​made legal rules, however, standing is both amorphous and prone to abuse. It's amorphous because it lacks clear doctrinal parameters and can be easily enlarged or constricted as a matter of judicial whim. And of course that makes it prone to abuse, since judges can simply declare that a given plaintiff either does or does not have standing depending on whether they do or don't want to reach the merits of the case at hand. To be clear, not all standing inquiries represent such an exercise in procedural roulette, but an increasing number of them do—particularly as poliymakers become more conscious of their ability to defeat judicial review through strategic legerdemain.
Thus, the key question in the loan‐​forgiveness case was not so much the legality of the program itself, but instead whether the Biden administration and its lawyers could persuade the judiciary that the executive branch can expend nearly half‐​a‐​trillion dollars in unappropriated funds without causing a sufficiently concrete injury to confer standing on any individual or entity affected by that program. As we learned last Thursday, the answer is no. But boy, was it close.
Without delving too much deeper into federal standing doctrine, the basic problem here was that the Supreme Court has generally rejected the concept of "taxpayer standing"—that is, the idea that any given person who pays taxes can sue the government simply because it is (arguably) spending that revenue unlawfully. Accordingly, when President Biden announced his intent to forgive student loans without express congressional authorization, there was a scramble among people and groups who opposed that policy to identify a concrete and individualized theory of standing that might pass muster with a judiciary that tends to be more comfortable rubber‐​stamping challenged government programs than striking them down—especially when they involve things like the proper scope of federal power, economic regulations, property rights, or tax policy.
As noted, Missouri and a handful of other states led with the theory that a blanket student loan forgiveness policy would deprive them of fees generated by their respective loan‐​servicing entities. Another suit was filed by two college graduates from Texas who challenged the Department of Education's failure to follow proper administrative procedures, which they said might have resulted in better debt‐​forgiveness terms for each of them.
At the time, it was unclear whether either of those standing arguments would prove viable, and additional complaints were filed by other groups, each asserting a different theory of standing. This included a lawsuit brought on Cato's behalf by the New Civil Liberties Alliance, which alleged that Biden's blanket loan forgiveness program would prejudice non‐​profit employers like Cato, for whom Congress had created a more targeted policy called the Public Service Loan Forgiveness Program that was designed to give non‐​profits a recruiting edge by providing loan‐​forgiveness to their employees after ten years. Whether legitimate or illegitimate from a policy perspective, the advantage conferred on charitable employers by that program would be eliminated by across‐​the‐​board debt forgiveness, which represents a cognizable injury that is redressable by the courts—et voila: standing.
As it turns out, the Supreme Court held unanimously that the two Texans lacked standing to challenge Biden's loan forgivness program while ruling 6–3 that the states (or at least one of them, which is all that mattered) did have standing. Bottom line, it was a close call, and it was fortunate that Cato and others were waiting in the wings with their own unique—and potentially more persuasive—standing theories. But those other cases, including Cato's, are now moot in light of the Court's decision to find standing in the states' challenge and strike down Biden's loan forgiveness scheme.
In retrospect, the half‐​dozen lawsuits filed against that program may seem like overkill. But as a colleague at my first law firm used to say of a judge in one of his cases, "You never know on any given day what's going to get his attention: Will it be the red rubber ball, the shiny metal object, or the baby rattle? So you bring 'em all." And so it is when seeking to overcome the slew of avoidance doctrines routinely deployed in public‐​policy litigation by government lawyers like ink from a fleeing squid. If standing, ripeness, and mootness can fairly be compared to a game of craps—and they can—then it makes sense for both sides to get as many chips on the table as possible.
If that sounds like hyperbole, consider the following examples, which represent merely the barest hint of the jaw‐​dropping bad faith with which avoidance doctrines are asserted by government lawyers and employed by judges to make potentially troublesome cases go away:
Cato v. SEC (DC Cir. 2022). This case involved a First Amendment challenge to the SEC's policy of imposing a lifetime gag order on defendants in civil enforcement actions as a condition of settlement. Cato sued on behalf of an author who wrote a memoir about being caught up in that process that it was unlawful for him to publish due to the gag order. As a would‐​be publisher of that work, Cato asserted the well‐​established theory of third‐​party standing, but the DC Circuit held that the "redressability" requirement for standing was not met on the premise that all of the challenged gag orders had been incorporated into judicially enforceable consent decress around the country that judges in DC were powerless to disturb. Besides being incorrect on the law, that holding was based on a demonstrably false factual premise: Contrary to the DC Circuit's completely baseless assertion—that was supported nowhere in the pleadings or the record because it was false—all gag orders (including the very one at issue in this case) had not been incorporated into judicially enforceable consent decrees—a fact that Cato pointed out repeatedly throughout the litigation and again in its petition for rehearing, which the DC Circuit ignored.
Parker v. Heller (DC Cir. 2007). Another example of standing gamesmanship from the DC Circuit arose in the Second Amendment challenge to the District of Columbia's gun laws brought on behalf of six DC residents by me, former Cato board chair Bob Levy, and Alan Gura. In blatant and acknowledged disregard for Supreme Court precedent, the DC Circuit invoked its special law of standing for guns and held that five of the six plaintiffs lacked standing because they had not yet violated the law and received a specific threat of prosecution—actions that are never required in any other setting to establish standing. Only Dick Heller was ultimately found to have standing because he had made an entirely futile attempt to register a handgun in DC and was denied—an act that the DC Circuit risibly (but correctly, as a matter of circuit precedent) held supplied an alternative basis for standing.
Alvarez v. Smith (2009) and NY State Rifle & Pistol Ass'n v. City of New York (2020). These are both examples of "strategic case mooting," a common practice whereby government lawyers will vigorously defend an unconstitutional policy in the lower courts and then moot the case if it looks like the challengers might win on appeal and thereby establish favorable precedent. Alvarez was a challenge to Illinois' unconstitutional civil forfeiture procedure, which the state defended below but then mooted when the case got to the Supreme Court by returning the plaintiffs' unlawfully seized vehicles. NY State Rifle & Pistol involved a challenge to a New York City ordinance that severly constrained people's ability to move a lawfully registered pistol from one location to another (e.g., from an apartment in Manhattan to a cabin in upstate New York), which the City defended vigorously in the lower courts but then repealed immediately after the Supreme Court granted certiorari, in a transparent (and ultimately successful) effort to derail the case. So much for all the assertions the government made in the lower courts about the supposed importance of the law, the momentous safety issues involved, etc.—all of which turned out to be cynical, disingenuous prattling.
As suggested above, the list could go on almost indefinitely. But the takeaway is this: When it comes to the willingness of government lawyers and judges (a wildly disproportionate number of whom were themselves courtroom advocates for government before taking the bench) to employ standing, ripeness, mootness, and other "avoidance doctrines" in order to derail challenges to plausible allegations of unlawful government action, there is no bottom.
And that's why Cato joined the fray over President Biden's unlawful student loan forgiveness scheme—not because there was ever any doubt about the merits; but instead to help make it as difficult as possible for the judiciary to sweep that unlawful power grab under the rug with the handy‐​dandy standing‐​broom.

This tenth edition of Doing Business sheds light on how easy or difficult it is for a local entrepreneur to open and run a small to medium-size business when complying with relevant regulations. It measures and tracks changes in regulations affecting eleven areas in the life cycle of a business: starting a business, dealing with construction permits, getting electricity, registering property, getting credit, protecting investors, paying taxes, trading across borders, enforcing contracts, resolving insolvency and employing workers. Doing Business presents quantitative indicators on business regulations and the protection of property rights that can be compared across 185 economies, from Afghanistan to Zimbabwe, over time. The indicators are used to analyze economic outcomes and identify what reforms have worked, where and why. This economy profile presents the Doing Business indicators for Indonesia. To allow useful comparison, it also provides data for other selected economies (comparator economies) for each indicator. The data in this report are current as of June 1, 2012 (except for the paying taxes indicators, which cover the period January - December 2011).

The article aims to study and analyze the influence of transformation on business relations in East European countries. It includes revealing the essence of the transformation change, formal rules, informal constraints and enforcement characteristics. Literature review suggests that political and socioeconomic changes can affect transformation reforms in the framework of speeding them up. The process of convergence of the new institutional economy and the evolutionary economy theories demonstrate confirms the existence of common theoretical foundations. They include recognition of the existence of limits of rational behavior of economic entities, unpredictability, and irreversibility of business decision-making process. Institutional transformation assumes a complex process, where mechanical copying and transferring institutions do not provide quantitative changes, and need the development of formal rules and informal institutions, law enforcement mechanism, as well as consciousness and mental characteristics of the population. The content of the modern institutional system of transformation, including the institutional-legal, institutional-economic and institutional-technological systems, is presented. The systematization of classification features is carried out: content, the main tasks and results of the functioning of the institutional transformation subsystems. The effectiveness of the present system is considered, based on revealing the relationship and the influence of all its subsystems. Transformation changes affect business environment, and result in foundation of a stronger legal framework and a system of property rights, decreasing bureaucracy, and enhancing competition. The success of any efforts to weaken the influence of ineffective institutions will depend primarily on whether East European countries' present-day facade institutions can be replaced with institutions that are robust and independent. Application of the interdisciplinary approach promotes an in-depth study the drivers of transformation reforms, and proposes scenarios for future development of East European countries. ; Целью статьи является изучение и анализ влияния трансформациина деловые отношения в странах Восточной Европы. Статьяраскрывает сущность трансформационных изменений, формальных и неформальных правил, ограничений и применение форм принуждения. Обзор литературы свидетельствует о том, что политические и социально-экономические изменения могут влиять на скорость проведения реформ в направлении их ускорения. Процесс сближения теорий новой институциональной и эволюционной экономик подтверждает существование общих теоретических основ. К ним относятся признание существования границ рационального поведения экономических субъектов, непредсказуемости и необратимости процесса принятия деловых решений. Институциональная трансформация предполагает сложный процесс, в котором механическое копирование и перенос институтов не приводит к количественным изменениям и нуждается в создании формальных правил и неформальных институтов, применении правовых механизмов, сознательности и ментальных особенностей населения. Рассмотрено содержание современной институциональной системы трансформации, включающей институционально-правовую, институционально-экономическую и институционально-технологическую системы. Проведена систематизация классификационных признаков: содержание, основные задачи и результаты функционирования подсистем институциональной системы трансформации. Эффективность действующей системы рассмотрена на примере выявления влияния и взаимосвязи всех ее подсистем. Трансформационные изменения влияют на бизнес-среду и приводят к укреплению правовой базы и системы прав собственности, снижению бюрократии и усилению конкуренции. Успех любых усилий по ослаблению влияния неэффективных институтов зависит, прежде всего, от того, насколько быстро можно заменить существующие государственные институты восточноевропейских стран на более надежные и независимые институты. Применение междисциплинарного подхода способствует углубленному изучению движущих сил проведения реформ и может использоваться для определения сценариев будущего развития стран Восточной Европы. ; Метою статті є вивчення та аналіз впливу трансформації на ділові відносини в країнах Східної Європи. Стаття розкриває сутність трансформаційних змін, формальних і неформальних правил, обмежень і застосування примусових форм. Огляд літератури свідчить про те, що політичні та соціально-економічні зміни впливають на швидкість проведення реформ в напрямку їх прискорення. Процес зближення теорій нової інституціональної та еволюційної економік підтверджує існування загальних теоретичних основ. До них відносяться визнання існування меж раціональної поведінки економічних суб'єктів, непередбачуваності і незворотності процесу прийняття ділових рішень. Інституційна трансформація передбачає складний процес, в якому механічне копіювання та перенесення інститутів не сприяє кількісним змінам і потребує розробки формальних правил і неформальних інститутів, застосування правових механізмів, свідомості та ментальних особливостей населення. Розглянуто зміст сучасної інституційної системи трансформації, що включає інституційно-правову, інституційно-економічну та інституційно-технологічну системи. Проведена систематизація класифікаційних ознак: зміст, основні завдання і результати функціонування підсистем інституційної системи трансформації. Ефективність діючої системи розглянута на базі виявлення впливу і взаємозв'язку всіх її підсистем. Трансформаційні зміни впливають на бізнес-середовище та призводять до зміцнення правової бази та системи прав власності, зниження бюрократії і посилення конкуренції. Успіх будь-яких зусиль з послаблення впливу неефективних інститутів залежить, перш за все, від того, наскільки швидко можна замінити існуючі державні інститути східноєвропейських країн на більш надійні і незалежні інститути. Застосування міждисциплінарного підходу сприяє поглибленому вивченню рушійних сил проведення реформ і може використовуватися для визначення сценаріїв майбутнього розвитку країн Східної Європи.

Multinational companies whose importance has increased or improved depending on global capitalisation and travelling around the world without knowing borders have activities in developing countries due to suitable conditions (e.g. cheap workers costs, flexible legal arrangements). In this study, the precautions set forth to prevent environmental troubles, to obliterate or to minimise it, are the activities undertaken by the multinational companies which are considered. In the study, Turkey as a case country in which this subject was studied. Globalisation is the last step of economical sovereignty set up by means of multinational companies all over the world by capitalism which affects our age deeply. Unlimited capital stocks of capitalism and its economical development aim "whatever the result is" fastens the problems internationally as a result of not recognizing the social developments and justice, inequality, poverty and unsocializing people in developing countries. As a result of this, we're having environmental problems, the speed of nature's being consumed has been increased and there have been troubles almost every field of the social lives. However there is no one else who accepts the responsibilities of cost and social policies in the global economies in which international capital and global corporations decide on the rules; there is also no one else who accepts the responsibilities of environmental pollution and natural possessions' destruction as the result of the activities of international capital and global companies. The reason for this is that it is assumed that the government must take the responsibility "to protect and to development the environment". According to this idea, protecting and developing the environment has been supplying public use and public service. Thus public service is the duty of the state. Environmental rights subject, known as third generation rights or corporation rights, is to protect the environment and to development it. People who have the environmental rights are those actors who will make use of these rights and who will have the responsibilities of these rights. The people who will make use of these rights and who will have the responsibilities are generally the same actors. These are not only the people but also public and special institutions including communities; states and public; and the next generation. In this case, all the right owners who have the rights to live in a healthy and well balanced environment are obliged to protect and to development the environment at the same time, including the multinational companies. Every economic activity has an effect on the environment. Multinational companies have activities in the fields like gold mining, petrol, chemicals and food industry which have high potential effects on the environment in developing countries like Malaysia, Indonesia and Nigeria. On this point the question why multinational companies choose these countries should be answered. The answer doesn't only help to explain the issue's political sides but also it could show that the most dirtying foreign capital activities take place in developing countries. Why multinational companies have chosen these developing countries was studied under two titles. (1) Dirtying industries are choosing the countries which don't have severe legal arrangements, (2) The public opinion in developing countries is unconscious of the harms that economical activities give to the environment. If the first finding hadn't been true, the activities in most polluting sectors wouldn't have been directed to the countries where environmental laws are flexible/flexibly practised. Besides, the public opinion in these low educational level countries doesn't have enough knowledge about the environmental problems and importance of environment. This information also gives assurance to the multinational companies that they don't face with the opposing activities of the public there. Nevertheless, foreign capital is wanted by these countries to supply new technologies, to supply the political and economical support of the countries which export development and capital, to open their economy to other countries and to protect the environment of the country. But, in practice, these countries which are under pressure to pay their debts don't pay attention to the ecological defects of the activities let the multinational companies to settle in the country, import the wastes which supply currency entrance, to be stored in the national borders and to be reused without evaluation. Foreign capital entrance in gold mining fields is a small example about being served and defended as a gold opportunity to pay Turkey's foreign debts. As a result, multinational companies are unsuccessful in sharing environmental responsibilities in the developing countries. Multinational companies have been making use of the opportunities that the environment presents but they don't do their duties to environmental rights. The efforts by multinational companies have been improving as prevention of increasing the environmental standards. Related to this, in the countries mentioned and also in Turkey, where economical activity fields like ecological sensitivity isn't assured enough by law and isn't protected wholly is a kind of great danger for Turkey.
