Alternatif uyuşmazlık çözüm yolları, onarıcı adalet kavramının ortaya çıkmasıyla uygulanmaya başlamıştır. Bunlardan biri uzlaşma kurumudur. Günümüzdeki anlamıyla ilk olarak Kanada'da 28 Mayıs 1974 tarihinde meydana gelen bir olayda uygulanmıştır. Uzlaşma kurumunun ortaya çıkmasının çeşitli sebepleri vardır. Bunlardan en önemlisi klasik ceza adalet sistemlerinin uyuşmazlığın taraflarını, özellikle de mağduru tatmin etmemesidir. Uzlaşma kurumu ülkemizde ilk olarak 1 Haziran 2005 tarihinde yürürlüğe giren 5237 sayılı Türk Ceza Kanunu ve 5271 sayılı Ceza Muhakemesi Kanunu'nda yer alan düzenlemeler ile uygulanmaya başlanmıştır. Uyuşmazlığın taraflarının özgür iradelerine dayanan uzlaşma kurumunun mağdur veya suçtan zarar gören bakımından, şüpheli veya sanık bakımından, toplum bakımından, yargı organlarının iş yükü bakımından ve kamu harcamaları bakımından birçok faydası bulunmaktadır. Tezimiz iki ana bölümden oluşmaktadır. Birinci bölümde, uzlaşma kavramı, uzlaşma kavramının hukuki niteliği, alternatif çözüm yöntemleri ve onarıcı adalet kavramlarını ve bunların ortaya çıkış sebepleri, uzlaşmanın karşılaştırmalı hukuktaki ve uluslar arası belgelerdeki yeri inceleme konusu yapılmıştır. İkinci bölümde ise, uzlaşmanın koşullarını, Yüksek Yargı içtihatları doğrultusunda soruşturma ve kovuşturma aşamasındaki uygulanma sürecini, olumlu ve olumsuz sonuçlarını, faydalarını incelemeye çalıştık. Çalışmamızı, uzlaşma kurumu konusunda genel bir değerlendirme yaparak sonlandırdık. ; Alternative dispute resolution methods, with the emergence of the concept of restorative justice, began to be implemented. One of these is mediation institution. Meaning today as the first in Canada on May 28, 1974 was implemented in an event occurring. There are the various reasons for the emergence of mediation institutions. Most importantly, classic criminal justice system does not satisfy the parties to the dispute, particularly the victims. Mediation institution in our country was introduced by the regulations of the No. 5237 Turkish Penal Code and No. 5271 the Criminal Procedure Code which came into force on 1 June 2005. Mediation institution which based on the free will of the parties to the dispute has many benefits in terms of the person who has suffered damages from the crime, in terms of the suspect or the accused, in terms of the society, in terms of courts? workloads and in terms of public expenditure. Our study is composed of two main sections. At the first chapter, the concept of mediation, legal character of mediation, alternative dispute resolution methods and restorative justice concepts and their emergence causes, its places in the comparative law and on intirnational documents had been expressed. And at the second chapter, the rules of the mediation, in accordance with high judicial case law, the implementation process of the mediation at the investigation stage and prosecution stage, positive and negative results of mediation, the benefits of mediation had been expressed. At the final section, We had terminated our study making an overall assessment about the the concept of mediation with examples of decisions which we made at the practice.

This article proposes a model of anthropocentric ocean connectivity based on the concept of human perspective as location. Within this location, anthropocentrism can be, but is not necessarily, an exclusive or dominant valuation of the human. In fact, conceptions of both anthropocentrism and of ocean connectivity are pluralistic. These and other pluralisms are borne out in this article's content and structure, which takes the form of explorations of anthropocentric connectivity in relation to four specific ocean-related human activities. First, Jan Solski applies understandings of connectivity as "flow" in the context of strategic ocean geopolitics. Second, Iva Parlov analyzes current doctrinal issues and interactions at the international level with respect to the legal regime for places of refuge for ships in need of assistance. Third, Maria Madalena das Neves examines ocean connectivity in the context of transboundary energy trade and market integration, with particular attention to geopolitical and ecological connectivity. Finally, Julia Gaunce proposes that the making and application of transnational rules and standards for ships in polar waters enhances certain connections and disrupts others, to the detriment of oceans and people, and that broadening connectivity especially in respect of Arctic Indigenous people(s) could help address challenges faced by oceans and ocean governance.

Yerel dinamiklerin harekete geçirilerek, bölgesel kalkınma hareketine son yıllarda önem ve öncelik verildiği görülmektedir. Kalkınma hamlesi aynı zamanda sosyal hukuk devleti olabilmenin de bir gereğidir. Devlet, bu ödevini oluşturduğu kural ve kurumları aracılığıyla yerine getirmeye çalışmaktadır. Çağımızda devletin kalkınma ve ekonomik yaşamda önemli bir aktör durumundadır. Devlet bir yandan ekonomik kalkınmayı gerçekleştirmek, diğer yandan da toplumsal barışı ve kamu düzenini korumakla ödevlidir. Türkiye?de sosyo-ekonomik kalkınmanın gerçekleştirilebilmesi maksadıyla son yıllarda idari teşkilata dahil edilen kalkınma ajansları, gerek kuruluş ve gerekse işleyiş yapıları bakımından birtakım sorunlar barındırmaktadır. Kalkınma sürecinin bürokratik engelleri bu türden idari yapılarla aşılmaya çalışılırken, "her şeye rağmen kalkınma mı?" sorusu akla geliyor Kuşkusuz değil. Çevresel değerleri yok edici bir kalkınma düşünülemeyeceğine göre, devlet sağlıklı ve dengeli bir çevrede yaşama hakkını göz ardı eden bir sosyo-kalkınma sürecine evet diyemez. Devlet, elindeki hukuk enstrümanları ile rasyonel bir denge kurmak zorundadır. Türkiye?nin kalkınma arayışında bölge ajansları kamu ve özel sektör paydaşlığında amacına uygun biçimde işletildiğinde olumlu sonuçlar elde edileceği söylenebilir. Ancak kalkınma ajanslarının uluslararası sermayenin doymak bilmeyen iştahını körüklemekten çok, toplum yararını kollaması şartıyla bu sonucun elde edilmesi mümkündür. Osmanlı Devleti'ne bağlı Rusçuk kazâsının ceza tarihi hakkındaki bu çalışma, mahkeme kayıtlarının (şer'iyye sicili) analizi üzerine kurgulanmıştır. Ceza kavramının Osmanlı taşrasındaki uygulamasının küçük bir kesitini ortaya koymayı hedefleyen çalışmada, mahkeme hükümleri incelenerek tespit edilmiş ve bu hükümler ceza çeşitlerine göre tasnif edilerek çıkarımlarda bulunulmuştur. Çalışma, giriş, sonuç hariç üç bölümden oluşmuştur. İlk bölümde, Rusçuk şehrinin tarihçesi ve sosyo-ekonomik şartları incelenmiştir. İkinci bölümde İslam ceza hukukunun Osmanlı dönemi uygulamaları genel ve nazari bir bakışla araştırılıp üçüncü bölüme altyapı oluşturmak istenmiştir. Üçüncü bölümde, XVIII. yüzyıl mahkeme kayıtlarında yer alan bilgiler doğrultusunda Rusçuk'ta suçlulara verilen cezalar çok boyutlu olarak araştırılmıştır.
Osmanlı Devleti'nin suç ve ceza tarihi hakkında yazmak, olumsuzlukların hatırda kalıcı ve bu açıdan olması gerekeni daha açık gösteren bir yanı bulunması sebebiyle özellikle önemlidir. Ayrıca günümüzle kıyaslama imkânının bulunması da konu ile ilgili çalışmaların artması gerektiğini gösteren diğer bir işarettir.

The impacts of climate change on marine resources are well known and demand mitigation and adaptation measures in order to protect the ecosystems. This entails more than simply altering management practices; it requires altering goal setting and managing transitions to new ecosystemic conditions. In the European Union, the main legal tool for protection of the marine environment is the Marine Strategy Framework Directive. Greece, as a member state of the European Union, has transposed the Marine Strategy Framework Directive into its national legal order and has developed legal structures to protect its marine resources from various threats, including climate change.
The present paper aims to present the legal and policy management tools in Greece, relevant to implementation of the Marine Strategy Framework Directive and climate change adaptation. For methodological reasons, the paper is divided into two parts: The first part deals with those legal tools that apply to an initial assessment of the environmental quality of Greek marine waters, while the second part analyzes legislative activities pertinent to the design and implementation of programs and measures. The aim of the national legislation is to maintain the ecosystemic integrity of the marine waters of Greece and to preserve the unique characteristics of the aquatic environment with respect to present and future generations. However, the analysis shows that a holistic legal framework demands explicit provisions for climate change impacts, while the existing framework focuses primarily on anthropogenic pressures on the marine environment.

Demokrasi kilidinin anahtarı pozisyonundaki seçimler, bireylerin geleceklerini inşa etmeye aday siyasi partiler arasından seçim yapmak suretiyle iktidarı belirlediği en etkin siyasi denetim aracıdır. Seçimlerin siyasal hayatı şekillendirmedeki rolü, seçimlere büyük ilgi gösterilmesine neden olmaktadır. Seçimler, geçmişte sadece siyasi iktidarı belirleme aracı olarak görülürken, günümüzde özellikle de 2000 Amerikan Başkanlık seçimleri ve sebep olduğu gelişmelerinde tesiriyle, siyaset kurumunun ve akademik dünyanın ilgi odağı haline gelmiştir. Demokratik olsun ya da olmasın, diktatörlükle yönetilen ülkeler hariç, dünyadaki bütün ülkelerde iktidarlar seçimle belirlenmektedir. Dünya ülkelerinin siyasal ve tarihsel olarak farklı tecrübelere sahip olmaları ve kendilerine has siyasal geleneklerinin varlığı farklı seçim sistemlerinin kabulüne de beraberinde getirmiştir. Bu farklılık, seçimlerin işleyişi faaliyetlerinde de değişik yöntemlerin ve modellerin benimsenmesine neden olmuştur. Seçmen tercihlerinin sandığa adil ve dürüst şekilde yansıdığı bir seçim gerçekleştirme arzusu, seçimlerin ülke genelinde iyi teşkilatlanmış, liyakat esasına göre belirlenmiş personelin istihdam edildiği, teknolojik alt yapıya sahip ve toplumsal itibarı ve intibaı yıpranmamış ve siyasi iktidarın müdahale alanından tamamen uzaklaştırılmış özerk ve kurumsal yapıları zorunlu kılmaktadır. Adil ve dürüst seçimlerin mümkün kılınabilmesi ancak seçimlerin yönetim ve denetiminden sorumlu kurum ve kurulların etkin yönetim ve denetim mekanizmaları ile donatılmış olmasıyla mümkün olabilecektir. Seçimlerin yönetimi ve denetimi faaliyetleri, ülkelerin benimsedikleri seçim yönetim ve denetim modellerinin farklılık göstermesi sebebiyle ülkeden ülkeye farklılık sergilemektedir. Bu farklılığa rağmen, bu modellerin hepsinin ortak amacı, seçmen iradesinin sandığa yansıması sürecini sağlıklı bir şekilde yönetmek ve sürece ilişkin yaşanabilecek hukuksuzluklara engel olmaktır. Bu anlamda bu kurum ve kurullara demokrasinin sürdürülebilirliğinin sağlanması adına çok önemli görevler düşmektedir. Söz konusu kurum ve kurulların gösterecekleri olumlu performans seçim sürecinin adil ve dürüst bir şekilde yürütülmesi ve sonuçlandırılmasının teminatını oluşturacaktır. Türkiye'de seçim teşkilatı ile seçimlerin işleyişinin karşılaştırmalı hukuk perspektifinden tüm yönleriyle ele alındığı bu çalışmanın amacı; ülkemiz açısından daha etkin bir seçim yönetim ve denetim mekanizmasının hayata geçirilebilmesi için uygulayıcılara karşılaştırmalı hukuk pratikleri perspektifinden bir model önerisi sunmaktır. ; Elections, which are the key to democracy, are the most effective means for political supervision in which individuals make choices from among political parties, which compete to build their lives. The role of elections in shaping political life causes them to be paid enormous attention. In the past, elections were regarded as a means to determine the political power only, but today, especially under the influence of the 2000 American presidential elections and the developments it led to, they have become the center of attention for politics and academic World. Whether they are democratic or not, governments are determined through elections all over the world except for countries that are governed by dictatorships. The fact that countries of the world have different political and historical experiences and have their own unique political traditions have caused different elections systems to be adopted. This difference in turn has caused different methods and models to be adopted in the activities conducted during the implementation of elections. The desire to hold an election where voters' choices are reflected fairly and honestly in the ballot boxes requires autonomous and organizational structures that are well-organized, where personnel determined on the basis of merit are employed, that possess the technological infrastructure, have an undamaged social prestige and image and are totally out of reach of the interference of the party in power. Fair and honest elections will be possible only when institutions and boards that are responsible for the management and supervision of elections are equipped with effective managerial and supervisory mechanisms. Activities aimed at managing and supervising elections exhibit variations because the election management and supervision models which countries adopt change from country to country. In spite of this difference, he common goal of all these models is to manage the process of transferring voters' will to the polls properly and prevent injustices that might arise in the process. In this sense, these institutions and committees have very serious tasks and obligations in ensuring sustainability of democracy. Positive performance that will be displayed by the said institutions and committees will guarantee that the election process will take place and be completed fairly and honestly. The purpose of this study, in which election organization and election mechanisms have been handled in all aspects from the perspective of comparative law, is to propose a model to implementers from the perspective of comparative law practices in order to put into a practice a more effective election management and supervision mechanism.

Kamu hizmetlerinin kamu ilkeleri ölçüsünde, doğrudan kamu kuruluş ve kurumları tarafından yerine getirilmesi alışılagelmiş bir durumdur. Günümüzde kamu hizmetlerinin yerine getirilişinde özel girişimciliğin de etkinliğinin arttığı görülebilmektedir. Bu etkinliğe rağmen kamu kurum ve kuruluşlarının yerine getirdiği hizmet yoğunluğu devam etmektedir. Kamu hizmetleriyle birlikte kamu kurum ve kuruluşlarının idari ve örgütlenmeyle ilgili birtakım sorumlulukları da bulunmaktadır. Hizmetlerin ve sorumlulukların değişen toplum, nitelik, ekonomik ve sosyal davranışlar nedeniyle tek bir merkezden yerine getirilmesini zorlaşabilmektedir. Merkezi yönetimlerin bu iş ve sorumluluk yükünün altından kalkabilmesi için bazı hizmetlerin mahalli idareler tarafından gördürülmesi kaçınılmaz hale gelebilmektedir. Demokratik ilkelerin uygulanabilirliliği açısından da önem arz eden mahalli idarelerin etkinliği, vatandaşın tercihlerinin ve isteklerinin daha kolay ilgili idari yönetimlere ulaşmasını sağlayabilmektedir. Belediyelerin idari ve karar organlarının halk tarafından seçilmesi, vatandaşlara en yakın yönetimlerden biri olması kurulurlarken iyi bir hukuki zemine dayandırılmalarını gerekli kılar. Bu çalışma ile amaçlanan Türkiye'de yerel yönetimlerin en önemli idarelerinden biri olan belediye idarelerinin Osmanlı'dan günümüze hukuksal altyapısını ortaya koyabilmektir. ; It is customary for public institutionst of fulfill public institutions and organizations in accordance with public principles. Nowadays, it can be seen that the efficiency of private entrepreneurship has increased in the performance of public services. Despite this activity, the service density of public institutions and organizations continues. Public institutions as well as public institutions and organizations have some responsibilities related to administration and organization. Services and responsibilities can be difficult to fulfill from a single center due to changing society, quality, economic and social behaviors. In order to overcome the burden of work and responsibility of the central administrations, it may be inevitable that some services will be seen by the local administrations. The effectiveness of local administrations, which are important in terms of the applicability of democratic principles, can enable the citizen's preferences and wishes to reach the administrative administrations more easily. The selection of the administrative and decision-making bodies of the municipalities by the public makes it necessary for them to be based on a good legal ground when they are to be one of the closest administrations to the citizens. This study aimed at Turkey from the Ottoman Empire to the present day, one of the most important authorities of the municipal administration of local authorities to reveal the legal infrastructure.

The 2010s was a busy decade for the Northern Sea Route (NSR). It started with the first shipping season to feature the international use of the NSR for commercial purposes, followed by a significant reform of the domestic legal regime, as well as the adoption of the Polar Code. The traffic has gradually picked up, and although the expectations of a significant surge in trans-Arctic navigation have not materialized, the NSR's annual turnover has grown beyond the old records set by the USSR. While the Russian authorities have struggled to find the most optimal means of development of the NSR, the latter has recently been re-marketed as a Polar Silk Road, part of the grand Chinese One Belt One Road initiative. While Russia has been rebuilding its military presence in the Arctic, the French Navy vessel BSAH Rhone unexpectedly navigated through the NSR, inciting strong political, but yet not legal, response. The present article aims to take stock of the last decade, paying primary attention to the Russian State practice in developing, adopting, and enforcing legislation in the NSR. By describing the current status and identifying some of the regulatory trends, the article will draw cautious predictions on the role of the law of the sea in the management of the NSR in the near future.

Bu makalenin amacı Azerbaycan ve Türkiye'nin yabancı yatırım hukuku ve siyasal yapısını mukayeseli açıdan değerlendirmektir. Geçilen on yılı aşkın zaman içerisinde, Azerbaycan ve Türkiye hükümetleri hem siyasal istikrar ve hem de teşvik edici yatırım ortamı kurmuş ve bunları da gerek iç hukukları üzerinde yapmış oldukları düzenlemeler aracılığıyla, gerekse de ikili ve çok taraflı anlaşmalara taraf olarak gerçekleştirmişlerdir. Türkiye, sınırlayıcı yapıya haiz olan önceki yabancı yatırım kanunu ve politikasını özgürleştirerek yabancı yatırımcıyı teşvik eden bir politika izlerken, benzer bir şekilde Azerbaycan ise yabancı yatırımcıyı teşvik amaçlı birçok kanun ve yasal düzenlemeleri, kanun çıkarmaya yetkili otoriteleri vasıtasıyla gerçekleştirmiştir. Bu çalışma gösterdi ki, yabancı yatırımcı için Azerbaycan ve Türkiye'de yatırımcı dostu bir ortam bulmasına rağmen, bu ülkelerdeki bazı problemler, yatırım yapılabilirliği hususunda engel teşkil etmektedir. Bürokratik verimsizlikler, yetersiz şeffaflık ve yüksek derecede ki yolsuzluk Azerbaycan'da yatırım açısında problem teşkil etmektedir. Türkiye'nin yabancı yatırımcı açısından başlıca sorunu ise, yargı sistemindeki aşırı iş yükü ve ağır bürokrasidir. ; The purpose of this article is to examine Foreign Investment Laws, and Political Structure of Azerbaijan and Turkey from a comparative perspective. The governments of Azerbaijan and Turkey have both secured political stability and established an appealing investment environment via adjustments to their domestic law, as well as signing up to bilateral and multilateral international investment treaties over the past decade. Turkey has liberalised its previously restrictive foreign investment law and policy to give encouragement to international investors. Similarly, since the establishment of the Republic of Azerbaijan, its legal authorities have been active in passing various laws with regard to foreign direct investment. The work has provided that although foreign investors seem to have found a friendly investment environment in Azerbaijan and Turkey, there are some major problems which render doing business problematic. Inefficient bureaucracy, a high level of corruption and a lack of transparency in legal and political processes are the major problem for Azerbaijan. From the perspective of investors, Turkey's chief weaknesses lie in its overburdened judiciary system and its cumbersome bureaucracy.
