RESEARCH OBJECTIVE: The scientific goal of the article is to analyze traffic safety policy, in a problem-chronological perspective, as part of the Swedish "welfare state" model, with particular emphasis on internal political and social factors.THE RESEARCH PROBLEM AND METHODS: In exploring the issues of road safety in Sweden, the author used a functionalist approach to examine the relationship of political forces affecting their shape. The genetic method has allowed to mention qualitative factors that are the foundations of Swedish policy. Institutional and normative approach with regard to the characteristics of decision-making processes, law-making processes resulted in a system analysis in line with the theoretical model proposed by David Easton. Each stage of the legislative process has been followed – from the change initiative to the entry intoforce of the "Vision Zero". The method of content analysis and the institutional and legal method served to illustrate the role that it has for Sweden for 20 years.THE PROCESS OF ARGUMENTATION: Ensuring broadly understood, multi-tasked road traffic safety is today a prerequisite for harmonious economic and social development of the country (for example, due to the cost of treatment of accident victims, but also the legitimacy of authority, whose task is to ensure safety).RESEARCH RESULTS: The necessity of introducing a nationwide road safety strategy was convinced by all the groups that sat in the Swedish parliament in 1997 (as evidenced by its voting through acclamation). The consolidation attitude of many social groups, institutions and individual road users, promoted by the Vision Zero, resulted in considerable successes. First of all, the number of fatalities in road accidents in 1997-2012 dropped by 48%. At the same time, the number of people who suffered minor injuries in the same period as a result of road accidents has increased. This testifies to the correct decisions of Swedish strategists who were already well aware in 1997 that it is impossible to eliminate accidents as such (which is why they focused on reducing the most tragic effects).CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: The Vision of Zero, which is now a general philosophy of approach to road safety issues in Sweden, thanks to its efficiency and effectiveness has become not only a source of pride on the part of the Swedes themselves. Few (Sweden's population for the first time reached a ceiling of 10 million inhabitants in January 2017), although the very innovative Swedish society developed an innovative model of cooperation between private and public sector entities as well as every single user of transport infrastructure that contributed to the radical decline the number of accidents resulting in death or serious injury. Thus, once again, the descendants of the Vikings became a role model for other nations – both among European Union countries and on a global scale.

The model of cooperative leadership is an alternative solution to leadership understood in terms of domination, hegemony or imposing its own political will on other entities participating in the system of mutual connections. The specificity of the political system of the European Union gives great importance to both intergovernmental and supranational mechanisms, while the key role in shaping this system is still played by the Member States. Although the treaty provisions ensured formal equality of states, the importance of Germany as an informal leader of the Community is increasingly becoming the subject of political debate about the EU. Taking into account the assumptions of neoliberal institutionalism related to both the key position of states and the great importance of institutions guaranteeing the transparency of their activities, as well as taking into account the long-term benefits of cooperation, the article defines the concept of leadership in the context of state cooperative behavior. The adopted methodological and theoretical framework allowed for a detailed analysis of Germany's influence in the EU, especially in the field of diplomatic activities. The aim of the article was to define the main determinants of the role of Germany as the EU leader, which bases its leadership on cooperation with other Member States, recognizing and respecting institutional solutions that limit the possibility of implementing individual priorities and guarantee transparency of actions for common interests, and in the long run legitimize the role of the state as an informal leader who represents a common position negotiated in the forum of the institutions. Using the institutional and legal method, the method of existing research and a case study (peace negotiations under the Normandy format), the main assumptions were verified and it was confirmed that the determinant of Germany's leadership is not only its political and economic potential, but also the ability to cooperate and provide information to EU institutions on activities in the implementation of the priorities of the Common Foreign and Security Policy. The approach based on respect for common interests and transparency of actions strengthened Germany's image as a leader. ; Model przywództwa kooperatywnego jest rozwiązaniem alternatywnym wobec przywództwa rozumianego w kategoriach dominacji, hegemonii czy narzucania własnej woli politycznej pozostałym podmiotom uczestniczącym w układzie wzajemnych powiązań. In 2015 we celebrate the twenty-fifth anniversary of the first free local elections to self-governing bodies. Those elections activated local citizens initiatives and greatly contributed to the transformation in our social awareness, leading to real change in Poland's political regime. The underlying rationale of free local elections, however, was the package of laws adopted on 8 March 1990 which created real self-government, enabled the elections to commune and municipality councils of 27 May 1990 and introduced a new dynamic to the process of the decentralisation of the state.Changes are always the result of dreams and our ability to realise them. It is possible to make them if there exist organisational structures and institutions which allow such changes to be made. The need for political transformation had long been felt and deliberated on by those involved in spatial development or and for whom the state monopoly status quo was unacceptable. To quote the late and much missed Professor Jerzy Regulski, the implementation of self-governance was departure from the monopoly of central government, which in turn meant an actual change in the political regime. The reform of 1990 broke up five monopolies of an authoritarian state which had existed in Poland since the end of the World War II: the political monopoly of one party, of centralised power, of uniform state ownership, of public finances and the state budget, and of the uniform public administration of the state.However, it must always be remembered that the possibility of realising dreams of a change in the nature of the state was shaped in the first triumphant stage of the Solidarity period in 1989, and later became a stable basis for the future in the resolution of the First National Congress of Solidarity Delegates and in the 'Samorządna Rzeczpospolita' (A Self-governing Republic) document. The success of the real change of 1990 was rooted in the long term determination and persistence of those whose personal experiences were involved in the quest for rationality in land management. Both Professor Jerzy Regulski and Professor Michał Kulesza drew their inspiration to change the political regime from the need to ensure that society worked in a way that would allow the local needs and initiatives be articulated, and inhabitants having the ability to take concrete decisions about the surrounding environment. In this way, the existing possibility of active involvement in local initiatives, incapable of being realised in the former political system, would become a reality and the citizens would be able to make collective decisions about their local area. This would also give a chance to oppose formally the investment logic resulting from the central planning of those times.The analytic work aimed at the transformation of the political regime that Professor Regulski started in the 1970s during his employment at the University of Lodz were subsequently continued at the Economic Institute of the Polish Academy of Sciences and led to the formation of a group of individuals for whom self-governance became a core value of the new regime and a way of looking at the modern state. The change that took place in 1990 was the beginning of the building of a de-centralised, modern state, the status of which was subsequently confirmed when Poland adopted the Council of Europe Framework Convention for the European Charter of Local Self-Government. Self-government is never an institution whose constitution is ever finished. This was shown during the reform carried out by Prime Minister Jerzy Buzek's government, which continued the break-up of the monopoly of power and implemented subsidiarity principles at the regional level enabling them to exercise powers locally, in newly created districts (powiat), as well as in the later legislative changes pertaining to the regulations governing the election of mayors (wójt or burmistrz) or the work of the Komisja Wspólna Rządu i Samorządu (Joint Committee of the Government and Self-Government). Today, after 25 years of our experience with self-government, we are much more aware of the changes needed in the self-governing system. They include the strengthening of actual independence of self-government achieved through the ensured free choice of the manner in which self-government bodies will carry out their tasks, guaranteed revenues and the possibility given to commune and municipality authorities of exercising real influence on their size, improved cooperation between communes and municipalities (gmina) and districts (powiat), and, fore and foremost, by ensuring all citizens a chance of co-decision on matters which directly affect them. Changes in the regime of self-governance are a consequence of its assessment by external, independent experts but are also motivated by the natural dynamics of the changes resulting from the very essence of self-governance and its institutions, communes and municipalities (gmina), districts (powiat) and regions (voivodships).In 2010 associations of self-governing units realised the need for change and amendments to the law on self-governance. Thus, they formulated a number of proposals which were included in a document called 'Requests to the President of the Republic of Poland to commence work on the white book of territorial self-government in the year of the 20th anniversary.' This document initiated work on a draft law which in 2013 became the subject of a legislative initiative put forward by President Bronisław Komorowski. The purpose of the new law on the collaboration of self-governing bodies in local and regional development is to strengthen the role of the citizen as well as the community in the work of self-government in Poland. The effort that Professors Jerzy Regulski and Michał Kulesza in their capacity as Advisors to President Komorowski put into the legislative work remains invaluable. It is believed that the involvement of individual citizens constitutes the strength of self-government and is a guarantee of its role at the service and in the interest of communities, individual inhabitants and businesses. Hence the need for enhanced collaboration and the partnership of different bodies of self-government and the increased involvement of citizens. There is draft law that contains regulations supporting these activities.Under the draft law, a local referendum is seen as an important tool to ensure the participation of citizens in decision-making processes, including those concerning local development plans. Local referenda should constitute a mechanism used to solve local issues of material importance to residents. Their result should be binding regardless of the turnout.Self-governance helps to create and strengthen the natural inclination of individuals to act together in areas where because of their social, business or cultural ties, a local community spirit develops. In today's world of global challenges and competition, we are looking for a space for the individual which provides a feeling of security. Another important value of self-governance is the possibility of creating affiliations with a community as well as individual entrepreneurship, social activity and a regard for the collective memory of the symbols of a place. The ability to participate in community life is inseparable from the functioning of democracy at a local level, with the consultation process, election of public officers, or participation in referenda.Self-governance is a special value which gives each of us a chance to exercise a real influence on local matters. It therefore occupies a very special place where politics has a personal dimension. The variety of self-governance means at the same time a variety of development policies since there are different communities, with different emotions, different experiences or ability to participate in democratic management. This variety is a special asset in the process of the stabilisation of the state as a whole. The diversity of opinions and experiences, appointments to public office of citizens not affiliated to or necessarily recommended by any party creates the solid foundations of a democratic state. This feeling of freedom within self-governing communities must be continued and promoted.The authors of many of the texts published in this issue of Ruch Prawniczy, Ekonomiczny i Socjologiczny devoted to self-governance are, at the same time, authors of the transformation of Polish law and Poland's administration in the last 25 years. Contributions submitted by, among others, Prof. dr hab. Irena Lipowicz, Prof. Jerzy Stępień, Prof. dr hab. Jerzy Buzek, Prof. dr hab. Leon Kieres or Prof. dr hab. Once again I thank them for such active involvement and participation in the jubilee celebrations of Self-Government and this special issue of the journal.We need self-governance not only to feel that we can influence decisions being made about local issues but also to be continually able to renew our confidence in institutions at a local level, and through their collaboration at the national level.
The article discusses the problem of procedures and specific features of functioning of a modern democratic state, as well as threats resulting from weaknesses of democracy despite existence of mechanisms protecting it from abuse. This problem is analysed on the example of the ongoing political conflict about the Constitutional Tribunal: an institution of constitutionally guaranteed independence. This conflict reveals that in Poland a need for discussion and perhaps for verification of the current philosophy and practice of democracy, has arisen. Furthermore, it demonstrates that law and the rule of law are neither sufficient guarantors of a democratic system's stability, nor guardians of civil rights and freedoms. A weakness of the democratic system lies in the fact that in the name of correctly understood democratic principles it is possible to distort the system through enacting wrong laws. Even though the acts of democracy participants, mainly decision-makers, are lege artis, they lead to impairment of democracy. Without doubt, a democratically organized society is an autonomous community and polyarchy which has adopted a democratic system of government as a form of its organization. On the other hand, democracies are highly conflict-prone systems, for example, due to the fact that they are based on the principle that all views and all participants of democracy are equal. As a consequence, such logic leads directly to emergence of disagreements, conflicts and even fights among democracy participants. This feature of democracy has enforced the establishment of appropriate procedures of conflict solving so that to ensure a possibly optimal resolution of crisis situations which could ultimately cause even a collapse of the democratic system. Thus, a simple mathematical rule has been adopted, albeit secondary in relation to any other methods of conflict solving, that is the majority principle. This is a standard of the democratic conduct without which the rule of majority would not be possible. The Constitutional Tribunal has recently become the object of popular interest – one of the many institutions of a democratic state which has not aroused so much factual and political dispute ever before. The conflict over the Tribunal has basically the formal and legal character, this is a technical dispute whose solution should be dictated by binding regulations and developed by experts in law. However, this is not the case. This conflict has turned into an argument of a political character, so it has become a genuine clash of interests, additionally aggravated by values. Moreover, it has stirred up the society and the environment of lawyers. When a political conflict, as one of the conflict types, is analysed, it is defined as a disagreement over power, whose participants are these individuals, groups, institutions and organizations which have a direct impact on politics or influence it through political channels. The practice of democratic states of the Western world does not prescribe a way at the beginning of which there is a sign "the winner takes it all". This practice is corroborated by philosophy and theory of democracy, as well as by several hundred years of achievements including such principles as Montesquieu's tripartite system of the separation of powers or the contemporary definition of democracy which describes it as a rule of majority that guarantees rights to minorities. ; Artykuł porusza problem procedur i specyfiki funkcjonowania nowoczesnego państwa demokratycznego oraz zagrożeń wynikających ze słabości demokracji mimo istnienia mechanizmów zabezpieczających ją przed nadużyciami. Problem ten jest rozpatrywany na przykładzie toczącego się konfliktu politycznego o Trybunał Konstytucyjny, instytucję o gwarantowanej konstytucyjnie niezależności. Konflikt ten pokazał, że w Polsce pojawiła się konieczność dyskusji i być może weryfikacji dotychczasowej filozofii i praktyki demokratycznej. Również to, że prawo i rządy prawa nie są wystarczającymi gwarantami stabilności ustroju demokratycznego, tym bardziej strażnikami praw i wolności obywatelskich. Ułomność systemu demokratycznego polega na tym, iż w imię właściwie pojętych zasad demokratycznych możliwe jest wypaczanie systemu przez tworzenie złego prawa. Działania uczestników demokracji, głównie decydentów, są lege artis, ale prowadzą do jej osłabiania. Demokratycznie urządzone społeczeństwo jest bez wątpienia autonomiczną wspólnotą i poliarchią, a przyjęło jako formę swojej organizacji demokratyczny system rządów. Demokracje są natomiast systemami wybitnie konfliktogennymi, choćby z tego powodu iż opierają się na zasadzie równości wszystkich poglądów i wszystkich podmiotów biorących udział w demokracji. Taka logika prowadzi w prostej konsekwencji do pojawienia się niezgodności i konfliktów, a nawet walk pomiędzy uczestnikami demokracji. Ta właściwość demokracji wymusiła stworzenie odpowiednich procedur rozstrzygania konfliktów, by zagwarantować w miarę optymalne wychodzenie z sytuacji kryzysowych, mogących w ostateczności doprowadzić nawet do upadku systemu demokratycznego. Przyjęto zatem prostą zasadę matematyczną, co prawda wtórną wobec wszystkich innych sposobów rozwiązywania konfliktów – zasadę większości. Jest ona regułą demokratycznej gry, bez której nie mogłyby istnieć rządy większości. Przedmiotem społecznego zainteresowania stał się ostatnio Trybunał Konstytucyjny, jedna z wielu instytucji demokratycznego państwa, która dotychczas nie wywoływała aż takich sporów merytorycznych i politycznych. Konflikt o Trybunał ma przede wszystkim charakter formalno-prawny, jest to techniczny spór, którego rozwiązanie powinno być podyktowane przez obwiązujące prawo, a jego rozstrzyganiem powinni się zająć eksperci z dziedziny prawa. Tak jednak nie jest. Konflikt ten przerodził się w konflikt o charakterze politycznym, stał się więc rzeczywistym konfliktem interesów, uzupełnionym dodatkowo o wartości. Zaktywizował ponadto społeczeństwo oraz środowisko prawnicze. Gdy rozważa się jeden z typów konfliktów, mianowicie polityczny, definiuje się go jako taki, którego przedmiotem jest władza, a podmiotami biorącymi w nim udział są te jednostki, grupy, instytucje, organizacje, które bezpośrednio mają wpływ na politykę lub oddziałują na nią za pośrednictwem kanałów politycznych. Praktyka demokratycznych państw świata zachodniego nie wskazuje drogi, na początku której stoi znak "zwycięzca bierze wszystko". Praktykę tę wyznacza filozofia i teoria demokracji oraz kilkusetletni dorobek z takimi dogmatami, jak choćby monteskiuszowski trójpodział władz czy współczesna definicja demokracji, według której są to rządy większości gwarantujące prawa mniejszościom.
The article analyzes the peculiarities of the conflict in Ukraine, its preconditions and geopolitical consequences. It provides the examples and numbers, which show the low level of trust to government institutions, law enforcement agencies, judicial system and a much higher level of trust to non-governmental organizations. It covers the issue of democracy condition or, to be more precise, the lack of democracy, which causes the society's tendency to protest. It is stated that the public's discontent was with the oligarchs' influence on the country, with the corruption on all the levels of social relations, with the pressure on small and medium enterprises, and ambiguity about the strategic course of the state's development (European Union, Customs Union). The article defines the issues connected with the beginning and reasons, which made the people go out to the Maidan. The most prevailing causes include the severe beating of the demonstrators on the Maidan overnight into November 30, repressions, Viktor Yanukovych's refusal to sign an EU association agreement, and the desire to change life in Ukraine. There was also a great wish to change the authorities in Ukraine. The article analyzes the Russian Federation's armed aggression against Ukraine, which became a long-term factor of influence on the Ukrainian political, economical, military and social reality. It is stated that due to the RF actions within 2014-2015, the system of global and regional security and the current system of international law have been deformed. Almost all international security assurances for Ukraine (the Budapest Memorandum, in particular) proved to be deprived of legal capacity in conditions when the aggressor is one of the guarantors – Russian Federation. It is demonstrated that the Russian invasion and seizure of the part of the Eastern-Ukrainian region, the Crimea became a direct challenge both to the European system of security and Ukraine. ; W artykule przeanalizowano сechy konfliktu na Ukrainie, jego uwarunkowania oraz konsekwencje geopolityczne. Autor podaje przykłady, dane, które wskazują na niski poziom zaufania do instytucji rządowych, sił bezpieczeństwa, wymiaru sprawiedliwości i znacznie wyższy poziom zaufania do instytucji pozarządowych. Rozważane jest pytanie o stan demokracji, a raczej jej braku, co tworzy w społeczeństwie tendencję do protestu. Powszechne niezadowolenie ludności skierowane było przeciwko rosnącemu wpływowi oligarchów w kraju, korupcji na wszystkich poziomach relacji społecznych, naciskowi na małe i średnie przedsiębiorstwa, niepewności kursu strategicznego państwa (Unia Europejska, Euroazjatycka Unia Celna). Autor określa zagadnienia związane z początkiem i motywami, które doprowadziły ludzi do Rewolucji godności. Główne przyczyny niezadowolenia: ciężkie pobicie demonstrantów na Placu Niepodległości w noc na 30 listopada, represje, odmowa Wiktora Janukowycza podpisania umowy stowarzyszeniowej z UE oraz pragnienie zmiany stanu życia na Ukrainie.Również dość wyraźne było pragnienie zmiany władzy na Ukrainie. Przeanalizowano zbrojną agresję Rosji przeciwko Ukrainie, która stała się długoterminowym czynnikiem wpływającym na rzeczywistość polityczną, gospodarczą, wojskową i społeczną. Z powodu działań Federacji Rosyjskiej w latach 2014–2015 był zniekształcony system globalnego i regionalnego bezpieczeństwa oraz obecny system prawa międzynarodowego. Prawie wszystkie międzynarodowe gwarancje bezpieczeństwa dla Ukrainy (w tym w ramach Memorandum Budapesztańskiego) okazały się niezdolne w sytuacji, gdy agresorem został jeden z gwarantów – Federacja Rosyjska. Достатньо вираженими виявилися також прагнення змінити владу в Україні. Здійснено аналіз збройної агресії Російської Федерації проти України, яка стала довгостроковим чинником впливу на українську політичну, економічну, військову та соціальну реальність. Зазначено, що внаслідок дій РФ впродовж 2014–2015 рр. було деформовано систему глобальної та регіональної безпеки, а також чинну систему міжнародного права. Майже всі міжнародні гарантії безпеки для України (зокрема в межах Будапештського меморандуму) виявилися недієздатними в умовах, коли агресором виступив один із гарантів — Російська Федерація. Доведено, що російське вторгнення Ціна свободи: конфлікт в Україні та його геополітичні наслідки 99 та захоплення частини Східноукраїнського регіону, Криму, стало безпосереднім викликом і європейській системі безпеки, і українській державі.
Spór o granicę austriacko-węgierską przy Morskim Oko był po rozbiorowym rabunku (1772 r.) kontynuacją ciągnącego się od XVI w. konfliktu granicznego między Królestwem Polskim a Węgrami. Próby ugodowego ustalenia granicy nie przyniosły przez niemal cały XIX w. efektu. W 1879 r. majątek graniczny po stronie węgierskiej (Jaworzyna) kupił pruski książę Chrystian Hohenlohe i podjął działania w celu zajęcia spornego terytorium. Jednak gdy hrabia Władysław Zamoyski w 1889 r. kupił w Galicji dobra (Zakopane) położone z drugiej strony spornego obszaru, zdecydowanie przeciwstawił się roszczeniom pruskiego magnata. Konflikt o własność prywatną (konflikt prawa cywilnego) eskalował w postaci sąsiedzkich gwałtów i trafiał przed sądy, jednak ich orzeczenia, bez ustalenia przynależności politycznej (państwowej) spornego terytorium, nie mogły wiązać zwaśnionych stron. Wobec zagrożenia bezpieczeństwa i spokoju na granicy austriacko-węgierskiej (doszło nawet do grożenia przez żandarmów węgierskich urzędnikom sądowym Galicji bronią palną) rządy w Wiedniu i Budapeszcie doszły do porozumienia, ustalając poufnie linię podziału. Ponieważ uznano, że publiczne ujawnienie rządowego kompromisu, wiążące się z przyznaniem do wzajemnych ustępstw obu stron, zostanie wykorzystane w walce politycznej zarówno w Austrii, jak i na Węgrzech, postanowiono zrzucić odpowiedzialność za kompromis na międzynarodowy sąd polubowny. W artykule autor przedstawia rozwiązania oraz instrumenty polityczne i prawne, do których sięgnęły władze obu państw, by zapewnić taki wyrok sądu rozjemczego, który realizowałby wcześniej przyjęte międzyrządowe porozumienie, a równocześnie przenosiłby na trybunał odium za dokonane ustępstwa. ; The dispute over the Austro-Hungarian border at Morskie Oko was, after the predatory partition of Poland in 1772, a continuation of a border conflict between the Kingdom of Poland and Hungary which started in the 16th century. The attempts to amicably delineate the border did not yield any results for the majority of the 19th century. In 1879, Christian Hohenlohe, a Prussian Prince, bought a border estate situated on the Hungarian side (a village called Jaworzyna) and he subsequently took steps with a view to seize the disputed territory. However, Count Władysław Zamoyski purchased lands in Galicia (Zakopane), located on the other side of the border, in 1889 and then he firmly resisted the claims of the Prussian magnate. The conflict concerning private property (a civil law conflict) continued to escalate and resulted in violence in the area and ended up in courts afterwards. However, without determining the political (state) affiliation of the disputed territory, no decisions made by the courts could be binding for the feuding parties. In the face of danger to safety and peace at the Austro-Hungarian border (there were even threats aimed at Galician court clerks with the use of firearms by Hungarian gendarmes), the governments in Vienna and Budapest came to a covert agreement and delineated a demarcation line. It was deemed that public disclosure of the compromise as well as of the concessions made by both parties would be used in political conflicts in both countries. As a consequence, it was decided that the blame should be put on the international arbitral tribunal. The paper presents solutions as well as the legal and political instruments used by both governments in order to secure such a court decision which would implement the international agreement they had previously reached and, at the same time, it would allow to lay the blame for the concessions on the tribunal.
The book contains a thorough analysis of the European Union institutional system as a specific, sui generis international organisation, in the context of its legitimization (its validity and legitimacy). The book is mainly theoretical. Primarily, the author aims at presenting a reliable depiction of the EU institutional system legitimization through the prism of the theoretical output concerning legitimization of the political power, including and accentuating the indicated specificity of the EU as a distinct international organisation. Secondly, he took into consideration the changes introduced into the legal foundations of the EU functioning, pursuant to the Lisbon Treaty – the latest treaty reforming the structures of the Union. In the context of the main theme of the present study, these changes are important not only in terms of the EU institutions themselves, i.e. their competences and reciprocal relations, but also with regard to the fundamental change of the legal character of the EU, and the alterations introduced into the individual Union politics. Thirdly, the author attempts to present the problem of the EU institutional system legitimization in the special circumstances, i.e. in the situation of the most profound economic crisis that the EU members have faced since the beginning of the integration process. The EU is regarded as a specific structure, being neither a state nor a typical international organisation. Such an approach was the starting point for the main premise of the present book – the idea that the thesis about the deficiency of democracy in the EU, formulated in the literature on the subject and in the public debate, is a certain simplification, and the characteristic features of the EU and its institutions, which provoked the formulation of such a thesis, should be considered in a broader context, such as the problem of the EU institutional system legitimization and, alternatively, the deficiency of that legitimization. For the direct democratic legitimization is only one of many sources of legitimacy of the EU institutional system and of the Union as a specific international organisation in general – an extremely important source, perhaps the most important, yet not the only one. Thus, the legitimization of the EU and its institutions should be analysed in a broader perspective, which also includes other sources of legitimization – as it is done in case of every political power which, striving for its legitimization to be as strong as possible, attempts to derive it from the largest number of sources. According to the author of the book, to base the EU institutional system legitimization only on the grounds of the direct democratic legitimization characteristic of a democratic state, would be tantamount to a certain disruption of the right order. It would rather be a symptom of too advanced an integration on the "institutional" level in comparison to the extent of the "material" integration. Until the EU is a structure sui generis, in which case it is a combination of features characteristic of an intergovernmental, international organisation, a supranational organisation or a state, the nature of legitimization of this structure should also be specific. The most important role should be played by the democratic legitimization, which should be completed with other sources, owing to which the functioning of the EU institutional system, and the whole EU, could be recognised as legally valid. Apart from the main thesis also other theses and hypotheses are posed in the book. The first chapter is a certain theoretical introduction and a basis to the deliberations presented in the further parts of this study. In the first subsection, with reference to the literature on the subject, the problem of legitimization (legitimacy) of the political power, i.e. the concept, classifications and sources of legitimization (legitimacy) of the political power, have been synthetically depicted. In another part of chapter one, the author attempts to relate the problem of legitimization to the EU as a specific international organisation and to formulate his own definition of legitimization deficiency with regard to EU institutional system. Bearing in mind that the problem of legitimization deficiency in the EU (EC) has not been discussed on a larger scale until certain stage of development of integration process was reached, in 1.3. subsection, the author raises some questions concerning: the sufficiency of legitimization of the integration process during the first few decades after the Second World War, the grounds for that legitimization and the reasons why, at a certain stage of the EU (EC) development the legitimization of the Union's institutional system started to be considered insufficient, which was manifested in the opinions acknowledging the democracy and legitimization deficiency. The first chapter ends with a passage devoted to the importance of the EU institutional system legitimization, whereas the significance of legitimization to the political power and political institutions in general, consitutes its reference point. The second chapter (subsections 2.3.–2.8.) presents a synthesis of the evolution of the EU (EC) institutional system in the context of its legitimization, from the moment of the EC founding treaties ratification, till the time the changes pursuant to the Lisbon Treaty were introduced. The author focused here mainly on the competences of the particular EC (EU) institutions and their reciprocal relations, which should make it possible to observe two main tendencies in the dynamics of changes taking place in this field, and present its specificity and distinctiveness in comparison to the systems of democratic states. At the beginning of this chapter, a thesis has been formulated (simultaneously, becoming an extension of the attempt to determine why, at a certain stage of the integration process, the issue of democracy/legitimization deficiency started to be discussed – a question that was raised in the first chapter), which states that the legitimization of the EU institutional system will be sufficient, if the law regulations and political practice of their functioning are convergent with the level of advancement of the integration process in various spheres of social life; in other words, the "institutional" integration should correspond with the "material" integration (that is the Union politics). To that end, the author made an attempt to present, in a synthetized form, the development of the "material" integration (subsection 2.1.), which he completed with an analogical endeavour to illustrate the evolution of the EU (EC) institutional system in the context of its legitimization (subsection 2.9). For in accordance with the increasingly common approach, the EU institutions are treated as a system, the concept and principles of which have been presented in 2.2. subsection. In the third chapter, the author presents the EU institutional system in its current form, that is with the changes introduced under the Lisbon Treaty. Here, the selected aspects regarding competences and functioning of the particular EU institutions have been depicted, as well as the relations between them in the context of legitimization. Additionally, three selected problems regarding the EU institutional system have been raised, which are especially important in the context of its legitimization (the relation between the EU institutional system and the institutions of the EU member states, the question of transparency in the functioning of the EU institutions, as well as the Union budgets in the consecutive years). In the last subsection (3.9.) the specific features of the EU institutional system, significant in the context of its legitimization, have been identified. The fourth chapter is devoted to the functioning of the EU institutional system in the perspective of four basic sources of its legitimization, i.e. indirect and technocratic, direct and democratic, utilitarian, and one consisting of "values". The chapter ends with a conclusion outlining the specificity of the EU and its institutional system with regard to the sources of its legitimization, which is especially important in the context of the book's main thesis. The fifth chapter concerns the problem of legitimization of the EU institutions in the context of the economic crisis, which the EU member states struggle with since around the year 2008. The sixth chapter, in turn, regards the so called subjective (empirical, social) dimension of the EU institutions' legitimization, that is, the way this problem is perceived by the citizens of the EU member states. It has been based on the results of opinion polls conducted for the use of Eurobarometer, from among which these questions and answers were selected, which could be applied to illustrate the way the EU citizens perceive the Union institutions in the context of their legitimization. The closing remarks include the most important conclusions drawn from the conducted analyses and the potential reforms and modifications of the EU institutional system, which may allow for the reinforcement of its legitimization, primarily in its democratic aspect. Finding much needed funds from taxes to state budgets and an ever-increasing mistrust of politicians and public opinion to the tax optimization schemes of multinational enterprises (MNEs) and high net worth individuals (HNWIs) have sparked an unprecedented political enthusiasm to address international tax avoidance in the last decade. This enthusiasm morphed into a political mandate given by G20 to the OECD in 2012. Amid a plethora of anti-avoidance rules delivered by the OECD under the BEPS Project, the principal purposes test (PPT) and its derivative under the EU Anti-Tax Avoidance Directive (ATAD) – the General Anti-avoidance Rule (GAAR) – are pivotal. The purpose of this contribution is to take an attempt to answer the main research question: is there room for an application of the GAAR (ATAD) and PPT (MLI) in a similar fashion? The assumption positively verified under this study via the prism of tax policy and technical (legal) reasons is that the less dissimilar an application of the GAAR and PPT will be, the less tax avoidance and fewer disputes arising from this phenomenon appear. However, there is a major caveat: the GAAR and PPT must gravitate towards the General Anti-abuse Principle (GAAP) as follows from the jurisprudence of the Court of Justice of the European Union's (CJEU) rather than to the OECD's version of the GAAR in the MLI (PPT). Only such an interpretative approach may ensure the right balance between fiscal interests of countries and individual economic freedoms of taxpayers. This contention stems from an analysis of the wording and structure of the GAAR and PPT, tax policy aims articulated in the preambles to the MLI and ATAD, the Court of Justice of the European Union's (CJEU) case law, the OECD's Commentary, and the relevant literature. ; Potrzeba znalezienia środków z podatków na finansowanie funkcjonowania państw oraz coraz większa nieufność polityków i opinii publicznej wobec schematów optymalizacji podatkowej przedsiębiorstw wielonarodowych (multinational enterprises, MNE) i najbardziej majętnych osób fizycznych (high-net worth individuals, HNWI) wywołały bezprecedensowy entuzjazm polityczny dotyczący przeciwdziałania międzynarodowemu unikaniu opodatkowania. Ten entuzjazm przerodził się w mandat polityczny udzielony OECD przez G20 w 2012 r. Wśród mnogości propozycji środków prawnych przeciwdziałających unikaniu opodatkowania opracowanych przez OECD w ramach projektu BEPS, za kluczowe należy uznać: test jednego z głównych celów (principal purposes test, PPT) z MLI i ogólną klauzulę przeciwdziałania unikaniu opodatkowania (general anti-avoidance rule, GAAR) z unijnej dyrektywy przeciwdziałającej praktykom unikania opodatkowania (anti-tax avoidance directive, ATAD). Celem niniejszego artykułu jest znalezienie odpowiedzi na główne (tytułowe) pytanie badawcze: Czy GAAR (ATAD) i PPT (MLI) powinny być stosowane w podobny sposób? Hipotezą pozytywnie zweryfikowaną w ramach niniejszego opracowania jest to, że: im bardziej zbiegające się (koherentne) będzie stosowanie GAAR i PPT, tym mniej praktyk unikania opodatkowania i sporów wynikających z tego zjawiska będzie występować między podatnikami i organami podatkowymi. Istnieje jednak poważne zastrzeżenie: GAAR i PPT powinny być stosowane zgodnie z ogólną zasadą przeciwdziałania nadużyciom (general anti-abuse principle, GAAP) wynikającą z orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), a nie zgodnie z PPT zaprojektowanym przez OECD. Tylko takie podejście do stosowania GAAR i PPT może zapewnić właściwą równowagę między interesami fiskalnymi różnych państw a swobodami gospodarczymi podatników. Tom Cyberbezpieczeństwo wyzwaniem XXI wieku jest opracowaniem, które wpisuje się w kontekst rozważań poświęconych wielorakim aspektom bezpieczeństwa w cyberprzestrzeni. Autorzy, którzy zostali zaproszeni do realizacji tego projektu, prezentują różne spojrzenia na tę problematykę. Pomysłodawcą pierwszego rozdziału – Główni aktorzy cyberprzestrzeni i ich działalność jest Tomasz Hoffman. Autor, piszący z perspektywy prawno-politologicznej, posiłkujący się dorobkiem nauk o bezpieczeństwie, koncentruje się na ukazaniu potencjalnych aktorów cyberprzestrzeni, ich działalności, a w tym również zachowań niezgodnych z prawem. Cyberbezpieczeństwo, zdaniem Hoffmana, jest nową dziedziną bezpieczeństwa narodowego, z którą nieodłącznie wiążą się takie wyzwania, jak cyberprzestępczość oraz cyberterroryzm. Drugi rozdział – Cyberbezpieczeństwo jako wyzwanie dla współczesnego państwa i społeczeństwa – wyszedł spod pióra Marka Górki. Badacz dokonał przeglądu aktualnego stanu bezpieczeństwa cybernetycznego w kontekście rozprzestrzeniania się zagrożeń pochodzących z cyberprzestrzeni, tworzonych przez organizacje państwowe oraz niepaństwowe. Górka stoi na stanowisku, że cyberprzestrzeń stała się podstawową cechą świata i stworzyła nową rzeczywistość dla prawie wszystkich krajów, co sprawia, że problemy z cyberprzestępczością oraz cyberbezpieczeństwem mają istotne, globalne znaczenie zarówno w wymiarze politycznym, jak i gospodarczym. Z przemyśleniami Górki koresponduje tekst Bogusława Węglińskiego – Cyberterroryści w cyfrowych czasach – profesjonalizacja i digitalizacja współczesnych organizacji terrorystycznych. Autor poddał analizie ewoluujące wraz z rozwojem technologii instrumentarium wykorzystywane przez grupy terrorystyczne, zwracając uwagę na Internet, który otworzył przed nimi nowe możliwości oddziaływania, a w tym także w sferze kreowania przekazu medialnego. W tekście zawarte są również dociekania dotyczące możliwości użycia przez terrorystów dronów. Nadmieńmy, że także czwarty rozdział Ataki cyberfizyczne a system bezpieczeństwa narodowego, którego autorem jest Bogusław Olszewski, wpisuje się w nurt wcześniejszych dociekań. W tej części tomu poruszone zostały sprawy związane z niepożądanym oddziaływaniem systemów cyberfizycznych na bezpieczeństwo otoczenia międzynarodowego. Zdaniem Olszewskiego, ich hybrydowy (cyfrowo-materialny) charakter sprawia, że wpływają nie tylko na logiczną warstwę cyberprzestrzeni, ale także na dziedzinę fizyczną. Umożliwiają m.in. destabilizację porządku wewnętrznego państwa, co w konsekwencji może prowadzić do destrukcyjnych zmian w szerszym, międzynarodowym kontekście. Stanowią zatem wielowymiarowe zagrożenie dla szeroko pojętego systemu bezpieczeństwa globalnego W rozdziale piątym, Marcin Adamczyk przedłożył tekst Cyberszpiegostwo w relacjach chińsko-amerykańskich w kontekście potencjalnej zmiany światowego hegemona. Opracowanie poświęcone jest działaniom Chińskiej Republiki Ludowej w cyberprzestrzeni, ukierunkowanych na nielegalne pozyskanie amerykańskich technologii wojskowych i cywilnych. Zdaniem autora, Państwo Środka jest aktualnie jedynym krajem, który obecnie mógłby rzucić wyzwanie dominacji Stanów Zjednoczonych. Dążenie do uzyskania statusu państwa hegemonicznego wymaga zatem od Pekinu zbudowania odpowiedniej koalicji wspierającej Chiny na arenie międzynarodowej, ale również zmniejszenia dystansu ekonomicznego, jaki dzieli to państwo od Waszyngtonu. Autorem kolejnego rozdziału jest Kamil Baraniuk, którzy przygotował tekst Zarys przemian instytucjonalnych rosyjskiego wywiadu radioelektronicznego. Baraniuk podkreśla, że współczesny wysoki stopień zinformatyzowania społeczeństw i powszechności korzystania z technologii informatycznych sprawia, iż dane o charakterze sygnałowym i elektromagnetycznym stanowią bardzo istotne źródło informacji dla wyspecjalizowanych instytucji, zajmujących się ich gromadzeniem oraz przetwarzaniem. W tym kontekście zarysowuje genezę i przekształcenia instytucjonalne wywiadu radioelektronicznego Federacji Rosyjskiej, a co za tym idzie wojskowe i cywilne instytucje zajmujące się tego rodzaju działalnością na przestrzeni ostatnich kilkudziesięciu lat, przy uwzględnieniu ich zadań, a także zmian personalnych w ich kierownictwie. Rozdział siódmy napisany został przez dwie autorki z Ukrainy. Tetiana W. Nagachevskaya i Lyudmila Frliksowa przygotowały rozważania zatytułowane Napriamky formuwannia miżnarodnoji konkurentospromożnosti IT-sektoru Ukrajiny. Zawierają one analizę stanu i osobliwości kształtowania się międzynarodowej konkurencyjności sektora IT na Ukrainie. Nagachevskaya i Frliksowa zaprezentowały pozycję ukraińskiego sektora IT rozpatrywaną w kontekście Networked Readiness Index, który mierzy skłonność do wykorzystywania przez kraje możliwości oferowanych przez technologie informacyjno-komunikacyjne. Ponadto, ukazały przewagę konkurencyjną i wady ukraińskich firm IT na rynkach międzynarodowych oraz kierunki wzrostu międzynarodowej konkurencyjności sektora informatycznego Ukrainy. Kolejne dwa rozdziały dotykają problematyki religijnej w cyberprzestrzeni. Autorem dociekań – Religijne i parareligijne grupy destrukcyjne: wyzwania cyberprzestrzeni – jest Wojciech Gajewski, który zwraca uwagę na sprawę penetrowania wirtualnej przestrzeni przez destrukcyjne grupy religijne. Jego zdaniem, stanowią one wzrastające zagrożenie nie tylko dla jej indywidualnych użytkowników, ale także zbiorowości społecznych. Religioznawca jest zwolennikiem podejmowania szeroko zakrojonych działań badawczych, edukacyjnych, a także prawnych, które wpłyną na ograniczenie negatywnych następstw ich aktywności w cyberprzestrzeni. Z kolei, Lucjan Klimsza przedłożył tekst Filozoficzne aspekty działania Internetu w kontekście zadań misyjnych Kościoła. Autor, który jest duchownym ewangelickim, zwraca uwagę na możliwości, jakie otwiera przed współczesnym chrześcijaństwem dostęp do przestrzeni cyfrowej. Klimsza wyraźnie zaznacza, że obecny Kościół musi być wspólnotą multimedialną, jednakże nie wirtualną, która jest oddalona od człowieka i jego realnej egzystencji. Autor, Internet postrzega zatem jako metamedium umożliwiające przekazywanie treści religijnych, które może być pomocne m.in. w spotkaniu i relacjach człowieka z człowiekiem oraz Boga z człowiekiem. Dziesiąty rozdziały Cyberbezpieczeństwo jako konstrukt w polskiej przestrzeni publicznej, będący rozważaniami o nachyleniu politologicznym, napisał Przemysław Mikiewicz. Tekst jest refleksją nad obecnością kategorii cyberbezpieczeństwa w polskiej przestrzeni publicznej, którą autor zawęził do opiniotwórczego oddziaływania centralnych instytucji państwowych oraz partii politycznych. Autor wskazuje, że pojęcie cyberbezpieczeństwa jest obecne w polskiej przestrzeni publicznej w różnym stopniu w dokumentach rządowych i w programach partii politycznych. Zdaniem Mikiewicza, występuje zasadnicza asymetria pomiędzy oboma typami dokumentów: dokumenty urzędowe poświęcają uwagę cyberbezpieczeństwu w znacznym stopniu, podczas gdy w dokumentach partyjnych kwestia ta jest jedynie wzmiankowana. Tak więc, cyberbezpieczeństwo jawi się jako rodzaj konstruktu, za pomocą którego kreowany jest obraz świata pełnego nienamacalnych niebezpieczeństw, do zwalczania których nieodzowne wydaje się publikowanie dokumentów pod postacią kolejnych doktryn i strategii walki z zagrożeniami w cyberprzrestrzeni. W nurt rozważań politologicznych wpisują się także dwa kolejne teksty. Autorem pierwszego jest Grzegorz Tokarz, którego dociekania zostały zatytułowane Internet jako instrument nawoływania do przemocy – przykład organizacji "Krew i Honor" Polska. Tekst przybliża działalność polskiej sekcji neonazistowskiej organizacji "Krew i Honor", a w tym zawartość jej strony internetowej, która jest istotnym narzędziem w propagowaniu idei tego środowiska, jak również źródłem informacji o osobach oraz instytucji uznawanych za zdrajców "białej rasy". Drugi tekst, który zarazem kończy niniejszy tom przygotował Mariusz Kozerski. W rozdziale Dawne afery polityczne ze współczesnej perspektywy: przykład sprawy Barschela/Pffeifera analizowana jest rola, jaką media odgrywają w nagłaśnianiu afer politycznych. Autor poddał oglądowi wydarzenia, które rozegrały się w latach 80 XX wieku, w północnoniemieckim landzie Szlezwik-Holsztyn, a w których ważną rolę odegrał opiniotwórczy tygodnik "Der Spiegel". Dodajmy, że Kozerski podejmuje się również próby odpowiedzi na pytanie, w jaki sposób afera kilońska mogłaby przebiegać współcześnie, w kontekście potencjału informacyjnego/opiniotwórczego, którym charakteryzuje się globalna sieć komputerowa. ; "Cybersecurity as the challenge of the XXI century" is a collection of considerations dedicated to various aspects of security in cyberspace. Authors, who have been invited to this project, present different views on this subject. An author of the first chapter, "The main actors of cyberspace and their activities", is Tomasz Hoffman. Writing from a legal and political perspective, including the achievements of security sciences, he tries to present potential actors of cyberspace, and their activities, including behaviors against the law. Cybersecurity, according to Hoffman, is a new element of national security and is related to challenges, such as cybercrime and cyberterrorism. The second chapter, "Cybersecurity as a challenge for modern countries and societies", has been written by Marek Górka. The researcher has reviewed the current situation of the cybersecurity in the context of the spread of dangers in cyberspace, created by government and non-government organizations. Górka states that cyberspace has become a basic feature of the world and has created a new reality for almost all countries, what caused that the problems with cybercrime and cybersecurity became significant in both, the political and the economic aspect. A text, which corresponds to the Górka's thoughts, is the text "Cyberterrorists in digital times - professionalization and digitalization of modern terrorist organizations" by Bogusław Węgliński. The author has analyzed the instruments used by terrorist groups. The instruments which have been evolving along with the development of technology. The most important of them is the Internet, which has opened new opportunities for terrorists, including digital communicating. The text also includes aspects of the usage of drones by terrorists. The fourth chapter, "Cyber-physical attacks and the national security system", by Bogusław Olszewski, is also related to the previously mentioned issues. This part of the book deals with matters of the undesirable impact of cyber-physical systems on the safety of the international environment. According to Olszewski, their hybrid (digital-material) character causes that they affect not only the logical aspect of cyberspace but also the physical one. They enable destabilization of the internal structure of countries, what can lead to destructive changes in the wider, international context. They are a multifaceted danger to the broadly understood system of the global security. In the fifth chapter, Marcin Adamczyk has presented a text titled "Cyberspying in Chinese-American relations, in the context of the potential change of the world hegemon". The study is dedicated to the activities of the People's Republic of China in cyberspace, taken to acquire American military and civil technologies. The author claims that China is currently the only country that could challenge the global domination of the United States. However, to obtain the status of the hegemonic state, Beijing would need to build a solid coalition, supporting China on the international arena, but also reduce the economic distance between Beijing and Washington. An author of the next chapter is Kamil Baraniuk, who has prepared a text titled "Outline of the institutional changes in the Russian radio-electronic intelligence". Baraniuk emphasizes that the high level of computerization of societies and the common use of information technologies makes the signal and electromagnetic data a very important source of information for specialized institutions dealing with information collection and processing. In this context the author outlines the genesis and the institutional transformation of the Russian radio-electronic intelligence, as well as the military and civil institutions dealing with this kind of activities over the last decades, analyzing their tasks and personnel changes in their management. The seventh chapter has been written by two authors from Ukraine. Tetiana W. Nagachevskaya and Lyudmila Frliksowa prepared a text "Napryamky formuvannya mizhnarodnoyi konkurentospromozhnosti IT-sector Ukrayiny". This text contains an analysis of the current situation and peculiarities in the shaping of the international competitiveness of the IT sector in Ukraine. Nagachevskaya and Frliksowa have presented the position of the Ukrainian IT sector, considered in the context of the Networked Readiness Index, which measures the tendency of different countries to use the opportunities offered by informational and communicational technology. In addition, they have shown competitive advantages and disadvantages of Ukrainian IT companies on international markets, and directions of growth of the international competitiveness of the IT sector in Ukraine. Next two chapters have been related to religious issues in cyberspace. "Religious and pseudoreligious destructive groups: the challenges of cyberspace" has been written by Wojciech Gajewski, who pays attention to the matter of penetrating of the virtual space by various destructive religious groups. In his opinion, they become increasing dangers not only for individual users of the cyberspace but also for entire social groups. The religious scholar is a supporter of extensive research, educational and even legal activities, that suppose to reduce the negative consequences of the sectarian activity in cyberspace. Next author, Lucjan Klimsza, has presented a text "Philosophical aspects of the Internet in the context of missionary tasks of the Church". Klimsza, who is a Protestant pastor, pays attention to the possibilities that the access to the digital space opens to contemporary Christianity. He clearly states that the current Church must be a multimedia, but not a virtual community, distant from a man and his real existence. The author sees the Internet as a meta-medium enabling the transmission of religious content, which may be helpful in cognition and relationship between man and God, as well as between man and man. Tenth chapter, "Cybersecurity as a construct in the Polish public space", has been written by Przemysław Mikiewicz from a political perspective. The text is a reflection of the presence of the cybersecurity in Polish public space, which has been specified by the author as the opinion-making influence of the central government institutions and political parties. The author indicates that the concept of the cybersecurity is present in the Polish public space in government documents and programs of political parties. According to Mikiewicz, there is a fundamental asymmetry between these two types: government documents pay a lot of attention to cybersecurity, programs of political parties, however, only mention about the issue. Finally, cybersecurity appears as a kind of a construct used to create an image of the modern world, full of immaterial dangers, which might be eliminated only by publication of new doctrines and strategies, created to combat dangers in cyberspace. The political aspect of the cybersecurity issue is present also in the next two texts. An author of the first one is Grzegorz Tokarz, whose section has been titled "The Internet as an instrument to incite violence - an example of Poland". The text introduces activities of the Polish section of this neo- Nazi organization, including the content of its website, which is an important tool, used to promote the ideas of this environment, as well as a source of information about people and institutions considered to be the traitors of the "white race". The second text, which also ends this book, has been prepared by Mariusz Kozerski. In this chapter, titled "Former political scandals from a modern perspective: an example of the Barschel/Pffeifer case", the analyzed issue is the role played by media to publicize political scandals. The author has reviewed incidents that took place in the 1980s, in the German land of Schleswig-Holstein. A significant role in those happenings was played by "Der Spiegel", an opinion-forming weekly magazine. Let's add that Kozerski also tries to answer the question of how that, socalled "Kiel scandal" could look like if it happened today, in the context of the contemporary informational/opinion-forming potential, which characterizes the global computer network.
The Horn of Africa, which is situated in the north-east Africa, comprises mainly Ethiopia, Somalia, Eritrea and Djibouti which cover region of the Somali peninsula. It is one of the area of the world belonging to the most affected by natural disasters, poverty, famine, conflicts and crime. Due to its geographical location on point of the Red Sea, the Gulf of Aden and the Indian Ocean as well the close position to the Arabian peninsula it is the most geo-strategically important regions of the world in terms of military and economic significance. That is why the world powers were and are still interested in it.The main topic of this article is the fragile state - Somalia. It was selected here in terms of its geographical location, high level of instability, civil war, famine and piracy problem or terrorist groups activities as an example of difficult political situation of the Horn of Africa and the attempts of the main economic competitors in Africa - The European Union, China and The United States of America - in order to achieve stabilization in the region.The prime aim of this analysis based on the source materials, subject reading matters and media news, is the presentation the most essential current activities of the above international actors that lead them to rise in the level of security in Somalia and neighbouring sea, straits, ocean and strengthening the Federal Government of Somalia and its security structure. The present condition of the Somali National Army and its future transformation are also presented in this work. Taking all above into consideration it was hard not to give attention to peacekeeping African Union Mission in Somalia AMISOM active since 2007 with approval of the United Nations Security Council. Despite the deep criticism of its activities by the nongovernmental organization Human Rights Watch, AMISOM has taken over most areas of central and south Somalia until now. What is more, the research points also the main legal framework that make possible foreign security aid in Somalia. In case of the EU - The Global Strategy for the European Union's Foreign and Security Policy (2016) and the Strategy for the Horn of Africa (2011). In the case of the US - the New National Security Strategy announced by president Trump in December 2017. Additionally, the article is focused on the growing presence of China in the Horn of Africa what is highly visible in the creation of the first foreign military Chinese base opened in July2017 in the neighbouring to Somalia - Djibouti.As a result of the analysis of the current activities of AMISOM, pointed American or Chinese actions and the European External Action Service (EEAS) in Somalia: European Union Naval Force ATALANTA (EUNAVFOR ATALANTA Somalia), European Union Training Mission (EUTM Somalia) and European Union Capacity Building Mission (EUCAP Somalia) a few essential conclusions can be made:the regular trade competitors in the race for their impacts in modern Africa - EU, China, US - are able to cooperate in taking care about either own and the Horn of Africa benefits if it is necessary,the level of security and democracy in Somalia has risen significantly in the last decade and a threat of piracy has fallen definitely in region of the Aden Gulf, The Red Sea and the Indian Ocean as an effect of activities of AMISOM, the Combined Task Forces, the EU peace missions and separate states. Nevertheless, the level of security which has been reached is really fragile and it may be disturbed easily when international security aid services will be over,the foreign peace missions active nowadays will be continued but with the tendency to their limitation in the next few years,the tasks of the peacekeeping African Union Mission in Somalia AMISOM, that is step by step limited and it is planned to stop in 2020, will be taken over by the transformed Somali national Army and Police,it is highly impossible to become self-supporting and to reach full independence of the Somali security structure from foreign peacekeeping assistance just in 2 years so that Somalia itself can guarantee own security and take over the prior AMISOM tasks,the full security and saving the political and economic stability in Somalia in the future may be possible not only by temporary military and humanitarian aid but also by so called fundamental work. So both of them are necessary at this stage of development of Somalia;Key words: Somalia, the Horn of Africa, piracy, Al-Shabaab, international security, maritime security, peace missions, terrorism ; Znajdujący się w północno-wschodniej części kontynentu afrykańskiego Róg Afryki, obejmujący głównie położone na Półwyspie Somalijskim Etiopię, Somalię, Erytreę, Dżibuti, jest jednym z regionów w tej części świata należących do najbardziej dotkniętych naturalnymi katastrofami, ubóstwem, głodem oraz konfliktami i przestępczością. Region ten ze względu na swoje położenie geograficzne na styku Morza Czerwonego, Oceanu Indyjskiego i Zatoki Adeńskiej, jak również ze względu na bliskość Półwyspu Arabskiego stanowi strategicznie ważne miejsce pod względem gospodarczym jak i militarnym. Stąd znajdował się i znajduje wciąż w strefie zainteresowania światowych mocarstw. Tematem niniejszego artykułu jest państwo upadłe - Somalia, która ze względu na swoje położenie geograficzne, wysoki poziom niestabilności, wojnę domową, problem głodu i piractwa morskiego oraz aktywność grup terrorystycznych na jej terenie została wybrana jako przykład ilustrujący trudną sytuację polityczną Rogu Afryki i wysiłki konkurujących ze sobą o wpływy ekonomiczne w Afryce Unii Europejskiej, Chin i Stanów Zjednoczonych podejmowane w celu ustabilizowania sytuacji w regionie rogu Afryki.Celem niniejszego analizy opartej o dokumenty źródłowe, literaturę przedmiotu i doniesienia medialne jest zaprezentowanie najważniejszej bieżącej aktywności w/w międzynarodowych aktorów prowadzące do podniesienia poziomu bezpieczeństwa w Somalii i otaczających ją wodach oraz wzmocnienia Federalnego Rządu Somalii i jego struktur bezpieczeństwa. Zaprezentowano również stan bieżący Narodowych Sił Zbrojnych Somalii oraz plany ich restrukturyzacji w najbliższych latach. Analizując w/w kwestie nie pominięto również zaangażowania Unii Afrykańskiej w postaci operacji pokojowej AMISOM prowadzonej w Somalii od 2007 roku posiadającej autoryzację Rady Bezpieczeństwa ONZ. Operacji, która choć w ostatnich latach krytykowana przez pozarządową organizację Human Rights Watch za łamanie praw człowieka przejęła kontrolę nad znaczną częścią środkowej i południowej części Somalii. W artykule wskazano również ramy prawne, w oparciu o które opisywana pomoc pokojowa może być udzielana. W przypadku UE - Globalną Strategię na Rzecz Polityki Zagranicznej i Bezpieczeństwa Unii Europejskiej (2016) oraz Strategię dla Rogu Afryki (2011). W przypadku USA - Nową Strategię Bezpieczeństwa Narodowego Stanów Zjednoczonych ogłoszoną przez prezydenta D. Trumpa w grudniu 2017r. Artykuł odnosi się również do rosnącej obecności Chin w tym rejonie Afryki wyraźnie widocznej przez otwarcie w lipcu 2017 roku pierwszej chińskiej zagranicznej bazy wojskowej w sąsiadującym z Somalią kraju - Dżibuti.Analiza bieżącej działalności AMISOM oraz aktywnych obecnie misji Europejskiej Służby Działań Zewnętrznych w Somalii: European Union Naval Force ATALANTA (EUNAVFOR ATALANTA Somalia), European Union Training Mission (EUTM Somalia) czy European Union Capacity Building Mission (EUCAP Somalia) doprowadziła do kilku istotnych wniosków:rywale handlowi zabiegający o wpływy w Afryce - UE, Chiny, USA - potrafią w razie potrzeby współpracować dla dobra swoich interesów i krajów Rogu Afryki, w tym Somalii,poziom bezpieczeństwa i demokracji w Somalii w ostatniej dekadzie znacznie wzrósł a zagrożenie piractwem zdecydowanie zmalało w rejonie Zatoki Adeńskiej, Morza Czerwonego i Oceanu Indyjskiego w efekcie działań podejmowanych przez AMISOM, międzynarodowe siły zadaniowe, misje pokojowe UE oraz pomoc poszczególnych państw. Osiągnięty poziom bezpieczeństwa jest jednak bardzo kruchy i po zakończeniu wspierających działań międzynarodowej społeczności może łatwo powrócić do stanu poprzedniego,w najbliższych kilku latach zagraniczne misje pokojowe działające od wielu lat w Somalii będą kontynuowane z tendencją do ich ograniczania,zadania misji pokojowej Unii Afrykańskiej AMISOM, która jest stopniowo ograniczana i formalnie planuje się jej zakończenie w 2020r., zostaną przejęte przez zreformowane Narodowe Siły Zbrojne Somalii,wątpliwym jest by w ciągu najbliższych 2 lat struktury bezpieczeństwa Somalijskiej Republiki Federalnej były w pełni samodzielne i mogły przejąć w pełni zadania AMISOM oraz zapewnić krajowi bezpieczeństwo,do osiągnięcia pełnego bezpieczeństwa oraz zachowania stabilizacji politycznej w Somalii potrzebna jest nie tylko doraźna pomoc wojskowa i humanitarna ale tzw. praca od podstaw;Słowa kluczowe: Somalia, Róg Afryki, piractwo, Al-Shabaab, bezpieczeństwo międzynarodowe, bezpieczeństwo morskie, operacje pokojowe, terroryzm; ; Розташований в північно-східній частині африканського континенту Африканський Ріг, який охоплює розміщені на Сомалійському півострові Ефіопію, Сомалі, Еритрею, Джибуті, є одним з регіонів в цій частині світу, який належить до найбільш постраждалих від стихійних лих, убогості, голоду, конфліктів і злочинності. Цей регіон через своє географічне розташування на стику Червоного моря, Індійського океану і Аденської затоки, а також через близькість до Аравійського півострова є стратегічно важливим місцем з економічної та військової точки зору. З огляду на це даний регіон знаходився і продовжує знаходитися в зоні уваги світових держав. Предметом дослідження даної статті є неспроможна держава – Сомалі, яка через своє географічне положення, високий рівень нестабільності, громадянську війну, проблеми голоду і морського піратства та діяльність терористичних груп на своїй території була обрана в якості прикладу, що ілюструє складну політичну ситуацію в районі Африканського Рогу і демонструє зусилля щодо економічних впливів в Африці конкуруючих між собою Європейського Союзу, Китаю та Сполучених Штатів, спрямованих на стабілізацію ситуації в даному регіоні.Метою даного аналізу, який ґрунтується на основі первинних джерел, спеціалізованої літератури і повідомлень засобів масової інформації, є представлення найбільш важливих аспектів діяльності провідних міжнародних гравців, спрямованих на підвищення рівня безпеки в Сомалі та навколишніх водах і зміцнення федерального уряду Сомалі та його безпекових структур. Представлено також сучасний стан національних збройних сил Сомалі та плани їх реструктуризації на найближчі роки. Аналізуючи названі вище проблеми, не залишено без уваги участь Африканського Союзу у формі миротворчої операції AMISOM, яка проводиться з 2007 року відповідно до рішення Ради Безпеки ООН. Операції, яка в останні роки зазнала критики з боку неурядової організації Human Rights Watch через порушення прав людини, дала змогу взяти під контроль більшу частину центральної та південної частини Сомалі. У статті також вказується правова база, на підставі якої може бути надана описана допомога по встановленні миру. З боку ЄС це Глобальна стратегія зовнішньої політики і політики безпеки Європейського Союзу (2016) та Стратегія Африканського Рогу (2011). З боку США – Стратегія нової національної безпеки Сполучених Штатів, оголошена президентом Д. Трампом у грудні 2017 року. У статті також йдеться про зростаючу присутність Китаю в цьому регіоні Африки, що чітко видно через розміщення в липні 2017 року першої іноземної військової бази Китаю в сусідній з Сомалі країні – Джібуті.Аналіз поточної діяльності AMISOM та місій Європейської служби зовнішньої діяльності в Сомалі: European Union Naval Force ATALANTA (EUNAVFOR ATALANTA Somalia), European Union Training Mission (EUTM Somalia) та European Union Capacity Building Mission (EUCAP Somalia) дав змогу зробити такі важливі висновки:• конкуренти, які прагнуть впливати на торгівлю в Африці – ЄС, Китай, Сполучені Штати Америки за необхідності можуть працювати разом на благо своїх інтересів і країн Африканського Рогу, включаючи Сомалі;• рівень безпеки і демократії в Сомалі за останнє десятиліття суттєво зріс, а загрози піратства в Аденській затоці, Червоному морі та Індійському океані значно зменшилися в результаті заходів, вжитих AMISOM, міжнародної цільової групи, миротворчих місій ЄС і допомоги окремих країн. Однак досягнутий рівень безпеки є дуже крихким і після завершення підтримуючої діяльності міжнародного співтовариства ситуація може легко повернутися до попереднього стану;• іноземні миротворчі місії, що діяли протягом багатьох років в Сомалі, будуть продовжені протягом наступних декількох років з тенденцію до їх обмеження;• завдання миротворчої місії Африканського Союзу АМІСОМ, яка поступово згортається і має бути офіційно завершена в 2020 році, будуть перейняті реформованими Національними збройними силами Сомалі;• викликає сумніви те, що в найближчі два роки безпекові структури Федеративної Республіки Сомалі стануть повністю незалежними і будуть здатними взяти на себе повністю завдання АМІСОМ і забезпечити країні безпеку;• для досягнення повної безпеки та збереження політичної стабільності в Сомалі необхідна не тільки екстрена військова та гуманітарна допомога, але так звана робота з початків.Ключові слова: Сомалі, Африканський Ріг, піратство, Аль-Шабааб, міжнародна безпека, безпека на морі, миротворчі операції, тероризм.
W artykule przyglądam się temu, jaką edukację polityczną warto rozwijać we współczesnej polskiej szkole i wszędzie tam, gdzie buduje się w ludziach zdolność do wspólnej i niewyalienowanej pracy. Kierunek rozważań wyznaczyła konieczność ustosunkowania się myśli pedagogicznej – i równoległego dostosowania praktyk wychowawczych – do zmian w sposobie koordynacji społeczeństwa, które dokonują się w atmosferze groźby wybuchu wojny. Rozważania te buduję na dotychczasowych badaniach własnych z obszaru uczenia się w ruchach społecznych, analizując trzy porządki zapewniające koordynację społeczeństw (neoliberalizm, nacjonalizm, militaryzm) w kontekście wykluczanych przez nie wartości: dobra wspólnego, samorządu i pokoju. Rezultatem pracy jest matryca przyporządkowująca te kontrwartości różnym typom współpracy (koordynacji, kooperacji i kolaboracji). Matryca pozwala identyfikować specyfikę konkretnych przykładów mobilizacji społecznej, jak i rozpoznawać luki w kształceniu kolektywnych umiejętności współdziałania. Rezultaty analizy pozwalają zoperacjonalizować praktyki oporu pod kątem celów wychowania i stawiają w nowym świetle problemy powiązań i nawarstwiania się wrogich szkole ideologii neoliberalizmu, nacjonalizmu i militaryzmu. ; The paper analyses types of political education worth developing in contemporary Polish schools and in other places dedicated to building human capacity to work together in a non-alienated way. The analysis is based on my own research from the area of learning in social movements. I analyze three orders ensuring social coordination (neoliberalism, nationalism, and militarism) in the context of the values they exclude: the common good, self-government and peace. The result of the work is a matrix assigning these counter-values, accordingly, to coordination, cooperation and collaboration. The matrix allows for identification of the specificity of some examples of social mobilization, as well as identification of gaps in teaching collective interaction skills. The results of the analysis can be used to operationalize the practices of resistance in terms of educational goals.
