As the origin of decision is based on a body elected its position in historical process of localization will be analyzed. ; Seksenli yıllardan sonra gündeme gelen yerelleşme söylemleri, uluslararası örgütlerin talepleriyle güç kazanmış, doksanlı yıllarda Avrupa Yerel Yönetimler Özerklik Şartı ile yasal zeminde yer bulmuştur. Ülkemizin üniter yapısı itibariyle çeşitli maddelerine çekince koyduğu anlaşma, kabul edilen haliyle maksadını gerçekleştirmekten hayli uzak görülmektedir. İkibinli yıllarda ise çeşitli yerel yönetim reformlarıyla özerkliğe özgü düzenlemeler yapılmaya çalışılsada yargı tarafından iptaliyle sonuçlanmıştır. 2005 yılında çıkan 5302 Sayılı İl Özel İdaresi Kanunu; izlenilen yargı süreci ve yapılan değişikliklerin yönü itibariyle benzer yerelleşme nüveleri içermektedir. İl genel meclisi ile valilik organı arasındaki ilişkide bazı değişiklikler dikkat çekmektedir; il genel meclisi başkanının kim olduğu, kararlarına karşı yapılabilecek merkezi denetim şekli, toplanma süresi ve sıklığı gibi. Seçimle gelen bir organ olan il genel meclisinin evrilen durumu çalışmanın kapsamını çizecektir. Kararın menşeinin seçimle gelen bir organa dayanması itibariyle, yerelleşmenin tarihsel sürecindeki yeri analiz edilmeye çalışılacaktır. ; 22321
Milli Görüş Hareketi, Türk Siyasi Hayatı içerisinde son 50 yıllına sosyal, siyasal, fikirsel ve dış politika açısından farklılıklar getirmiş bir siyasi harekettir. 1969 yılında Bağımsızlık Hareketiyle başlayan daha sonra Milli Görüş adını alarak mücadelesini vermiştir. 1970 yıllın da günümüze kadar Partileşme sürecine girmiş siyasi hayatı boyunca beş siyasi partisi "laikliğe aykırı" sebepler dolayısı ile dört partisi kapatılmıştır. Partileşme süreçleri boyunca kurmuş oldukları teşkilat yapısı ve temel esasları ile siyasete içerisinde çeşitli kavram ve söylemler ile yenilikler ortaya atmıştır. Teşkilat modeli ve beli kuraları temel esaslar üzerinden belirleyerek varoluş şekli ve mücadele sebeplerini hem İslami hem de ülke şartlarına göre olması. Teşkilat mensuplarının siyaset yapma amaçlarını öğretmesi, eylem, söylem ve fikir birliği için çalışması siyaset içerisindeki kendi has yapısını göstermektedir. Mücadelesini yaratılış, manevi ve yasal açıdan açıklaması ile varoluş sebebini tarif etmiştir. Siyasi hayata getirmiş olduğu Önce Ahlak ve Maneviyat söylemi ile yeni bir eğitim (maarif) model ortaya çıkmış, ekonomik açıdan ortaya atmış olduğu Adil Ekonomik düzen ve Ağır Sanayi söylemi ile kendine özgü bir ekonomik model ortaya atmıştır. Avrupa Ekonomik Ortak Pazarı günümüzdeki adıyla Avrupa Birliği karşıtı olması ve onun karşısına İslam Birliği söylemi hatırlatması ile D-8 aktif hale getirmesi ile kendine özgü dış politika hamlesi belirlemesi. Hukuk açısından Adil Hukuk Sistemi oluşturarak çok hukuklu sistem üzerinden Adalet, Hürriyet ve İnsan haklarına dayalı adil düzen söylemi olmuştur. Sonuç olarak Milli görüş hareketi TSH içinde eli yılık mücadelesi boyunca kendine çalışma metodu olarak belirlediği Temel Esasları ve Söylemleri nasıl oluştuğunu ve devam ettiğini üzerinde durulmuştur. ; The National Vision Movement is a political movement that has brought social, political, and intellectual and foreign policy differences to the last 50 years in Turkish Political Life. The movement, which started with the name of Independence Movement in 1969, continued struggle with the name the National Vision later. Since 1970 up to the present, the national movement, which has been on way to becoming a political party, had been closed for four times during its political life, it has been claiming that its political party was contrary to secularism. Throughout the process of becoming a political party, they have introduced various concepts and discourses and innovations within their organizational structure and basic principles. The fact that the national vision movement determined its organizational model and certain rules based on the basic principles that are both Islamic and suitable to the country conjecture shows its unique structure. Its discourse of which the priority is morality and morale revealed a new educational model. It has created a unique economic model with its economic outlook; "Fair Economic Order" and "Heavy Industry". Its foreign policy formed D-8 Union as an alternative to the European Economic Common Market and it is the anti-European Union. In terms of law regulations, 'Fair Legal System' has been formed by 'Fair Order' based on Justice, Honesty and Human Rights through a multi-legal system. As a result, the National Vision Movement in Turkish political life has focused on how the Fundamental Principles and Discourses, which were determined as a method of self-study during the fifty-year struggle, were formed and continued.
ÖZET10 Kasım 1938 tarihinde Mustafa Kemal Atatürk'ün hayatını kaybetmesi ile bir-likte Cumhurbaşkanı olan İsmet İnönü ülke yönetiminde en yetkili kişi haline gelmiştir. İnönü'nün CHP ve ülke yönetimindeki adete tek kişilik hakimiyeti ( Milli Şef ) Celal Bayar başta olmak üzere dönemin CHP'li milletvekili ve yöneticilerinde tepkiye neden olmuştur. Bir şahsın parti ve ülke yönetimindeki hakimiyetine İkinci Dünya Savaşı'nın da etkisiyle halkın büyük çoğunluğunda oluşan ekonomik sıkıntının ve iktidarın halkın muhafazakarlığı ile çelişen eğitim ve sosyal alanlardaki uygulamaları CHP ve dışındaki siyasi çevrelerde ve halkın büyük bir bölümünde muhalif bir tutumun oluşmasına neden olmuştur. Bu süreç hükümetin birtakım radikal uygulamaları ile birlikte örgütlü bir mu-halif hareketin doğmasına neden olmuştur. Yukarıda belirtilen nedenlerden kaynaklanan ve açıktan açığa bir söylem ve ey-leme dönüşmeyen CHP milletvekillileri içindeki bireysel tavırlar ilk defa Çiftçiyi Top-raklandırma Kanunu teklifi sırasında ortaya çıkmıştır. CHP milletvekilleri Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan, 14 Mayıs 1945 tarihinde bu kanun teklifinin TBMM'de görüşülmeye başlaması ile birlikte hükümetin bu uygulamasına karşı tavırlarını yaptıkları konuşmalar ile ortaya koymuşlardır. Fakat esasen bu kanun tasarısının TBMM'ye sunulmasından önce CHP içinde muhalif bir grubun oluşması Tevfik Rüştü Aras'ın evinde yapılan perşembe toplantılarıyla başlamıştır. 1945 yılının Nisan ayından itibaren Tevfik Rüştü Aras'ın evinde bir araya gelen Emin Sazak, Adnan Menderes ve Fuat köprülü CHP'nin, İsmet İnönü'nün otoritesi altında olduğunu ifade etmişler ve bu durumu değiştirmek gerektiği üzerinde durmuşlardır. İkinci defa bir ara-ya gelen Adnan Menderes ve Fuat Köprülü demokratik bir merkez oluşturma konusun-da görüş birliğine varmışlardır. Daha sonraki toplantılara Refik Koraltan da katılmıştır. Adnan Menderes, partide ve toplum içinde etkili olan Celal Bayar'ı bu gruba katmak gerektiğini açıklamıştır. Celal Bayar ile yapılan toplantı sonunda o da gruba dahil ol-muştur. Grup üyeleri 18 Mayıs 1945 tarihinde yapılan toplantıda CHP Meclis Grubuna vermeyi düşündükleri Dörtlü Takriri hazırlamışlardır.Takrir verilmeden önce TBMM'de 1945 yılı devlet bütçesinin oylamasına katı-lan üç yüz yetmiş üç milletvekilinden İzmir Milletvekili Celal Bayar, Aydın Milletve-kili Adnan Menderes, İçel Milletvekili Refik Koraltan, Kars Milletvekili Fuat Köprülü ve Eskişehir Milletvekili Emin Sazak bütçeye karşı aleyhte oy kullanmışlardır. Cumhu-riyet Dönemi'nde ilk defa bir bütçeye karşı aleyhte oy kullanılmıştır. Böylece muhalif tavırlarını ikinci defa ortaya koymuşlardır. Grup üyeleri 7 Haziran 1945 tarihinde Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan'ın imzası ile Dörtlü Takrir'i CHP Meclis Grubu Başkanlığı-na vererek muhalif tutumlarını somutlaştırmışlardır. Takrirde CHP'nin işleyişinin de-mokratik ilkelere uygun hale getirilmesini ve TC. Anayasası'nda var olan vatandaş hak ve hürriyetlerinin tanınması talep etmişlerdir. Bu takrir 12 Haziran 1945 tarihinde CHP Meclis Grubu'nda görüşülmüş ve red-dedilmiştir. Takririn reddedilmesi ile birlikte devam eden süreçte bu kadronun CHP içinde siyaset yapma imkanı kalmadığı gibi takrirde talep edilen bir düzenin kurulma-sının CHP içinde mücadele edilerek olamayacağı ortaya çıkmıştır. Takririn, CHP Meclisi Grubuna verildiği günlerde Cumhurbaşkanı İsmet İnönü, Rauf Orbay ile görüşmüş yeni parti kurulması fikrini ona açmıştır. Bu görüşmeden, İnönü'nün yaptığı diğer konuşmalardan cesaret alan grup üyelerine karşı CHP'li yöne-tici ve milletvekillerinin olumsuz tavrı, partinin yayın organı Ulus gazetesindeki ağır sözlerle dolu yazılar grup üyelerinin CHP'den ayrılmalarına neden olmuştur. Zaten Adnan Menderes ve Fuat Köprülü Vatan gazetesinde yayınlanan yazıları nedeniyle CHP Divanı tarafından 25 Eylül 1945 tarihinde CHP'den ihraç edilmişlerdir. Diğer isimlerde istifa etmişlerdir. Partisiz kalan grup üyeleri parti kurma çalışmalarına başla-mışlar ve Demokrat Parti 7 Ocak 1946 tarihinde resmen kurulmuştur. Demokrat Parti, Dörtlü Takrir'in imzacıları: Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan tarafından kurulmuştur. Demokrat Parti'nin simgesi "DP", genel merkezi ise Antalya Milletvekili Cemal Tunca'nın Ankara Sümer Sokaktaki sekiz numaralı binası olmuştur. Demokrat Parti'nin kuruluş gerekçesinde ve programında Türkiye'de demok-ratik bir rejimin kurulacağı, TC Anayasası'nda demokrasiye aykırı kanunların kaldırı-lacağı, vatandaşların hak ve hürriyetlerinin anayasal teminat altına alınacağı dile geti-rilmiştir. Muhalefet yıllarında ise CHP ve iktidar demokratik olmayan tutum ve davra-nışlar sergilemekle itham edilmiştir. Muhalefet yıllılarında iki parti arasında demokra-siye aykırı birçok olay yaşanmıştır. Hatta 7 Ocak 1947 tarihinde gerçekleşen Demokrat Parti Birinci Genel Kongresi'nde kabul edilen Hürriyet Misakı'nda TC Anayasası'na aykırı olan kanunların kaldırılması ve demokrasiye uygun kanunların yapılması talep edilmiştir. Bu istekler yerine getirilmez ise Demokrat Parti Genel Yönetim Kurulu'na sine-i millet kararı ( TBMM'den çekilme ) hakkı verilmiştir. Demokrat Parti yönetici-leri iktidara gelmeleri halinde vatandaşlara hak ve hürriyetlerinin tanınacağı, demokra-siye aykırı kanunların kaldırılacağı ve TC Anayasası'nın demokrasiye uyumlu hale ge-tirileceği sözlerini vermişlerdir. 14 Mayıs 1950 seçim faaliyetlerinde aynı vaatler tekrarlanmıştır. Hatta 2 Nisan 1950 tarihinde Kasımpaşa'da konuşan Demokrat Parti Genel Başkanı Celal Bayar, grev hakkının demokratik hak olduğunu ve demokrasinin olduğu ülkelerdeki gibi toplumsal düzene ve ekonomiye zarar vermeyecek biçimde işçilere grev hakkının verileceğini ifa-de etmiştir. Seçimleri kazanan Demokrat Parti adına Adnan Menderes 22 Mayıs 1950 tarihinde hükümeti kurmuş ve 29 Mayıs 1950 tarihinde hükümet programı TBMM'de onaylanmıştır.Hükümet programında partinin seçim beyannamesinde olduğu gibi iktidar deği-şikliğinin ülkede maddi ve manevi hiçbir sarsıntıya yol açmasına imkan tanınmayacağı ve özellikle devri sabık yaratılmayacağı vurgulanmıştır. Programda, TC Anayasası'nda vatandaş hak ve hürriyetlerine ve millet iradesine dayanan kararlı bir devlet düzeninin gerçekleşmesini sağlayacak düzenlemelerin yapılacağı ifade edilmiştir. Ayrıca CHP hükümetlerinden ( tek parti dönemi ) kalan, demokratik olmayan kanunların, alışkan-lıkların ve anlayışların değiştirileceği vurgulanmıştır. Programda, işçilere grev hakkının sosyal ve ekonomik düzeni bozmayacak şekilde tanınacağı açıklanmıştır. Demokrat Parti İktidarı Programı'nda sadece vatandaşlara tanınacak haklar yer almamıştır. Ayrıca o tarihlerde azınlıkta olsa da bazıları tarafından hak olarak görülen faaliyetlerin yasaklanacağı da yer almıştır. Cumhuriyet'in ve inkılapların korunması için aşırı sol akımlara ( komünizm ) izin verilmeyeceği ve bunlarla etkin bir biçimde müca-dele edileceği ifade edilmiştir. Bunlara karşı kanuni tedbirlerin alınacağı çünkü bu tür düşüncelerin günün şartlarında fikir ve vicdan hürriyeti olarak görülmediği vurgulan-mıştır. Bu fikir akımların hürriyet maskesi altında yayın yapmalarına izin verilmeyeceği çünkü bu düşünce akımlarının amacının özgürlükleri ortadan kaldırmak olduğu iddia edilmiştir. Komünizm fikir akımının yanı sıra irticai hareketlere de asla müsaade edil-meyeceği vurgulanmıştır. Demokrat Parti Dönemi'nde iktidarın sivil toplum kuruluşları ile ilişkilerine özetlemeden önce sivil toplumun örgütü tanımını yapmak yerinde olacaktır. Sivil top-lum kavramı farklı biçimlerde tanımlanan bir kavramdır. Özellikle devlet ile sivil top-lum arasındaki ilişki farklı tanımlamalara neden olmaktadır. Bu tanımlardan bazılarında sivil toplum, devletten tamamen bağımsız, devleti kontrol eden ve hatta devletin alter-natifi olan örgütlü bir güç olarak tarif edilmiştir. Diğer tanımlarda ise devlet ile sivil toplum arasında bu kadar keskin bir ayrılığın olmadığı, sivil toplumun devlete top-lumsal katılımı sağlama amacının var olduğu ileri sürülmüştür. Modern anlamda sivil toplum kavramı "Non Govern Mental Organizations" ( devletten bağımsız örgütlen-meler ) olarak tanımlamasının yanı sıra "gönüllü kuruluşlar", "kar amacı gütmeyen ku-ruluşlar" gibi ifadelerle de tanımlanmaktadır. Sivil toplum tanımını yaptıktan sonra Demokrat Parti iktidarları öncesi sivil toplum örgütlenmesine devletin müdahalesinin ne zaman kaldırıldığına kısaca yer verelim. Türkiye'de 28 Haziran 1938 tarihinde yürürlüğe giren 3512 sayılı Cemiyetler Kanunu ile Osmanlı Devleti döneminden kalma 1909 tarih ve 121 sayılı Cemiyetler Kanun'u ve bu kanunda yapılan 353 ve 387 sayılı kanunlar yürürlükten kalkmıştır. Bu kanunun dokuzuncu maddesinin h bendiyle "aile, sınıf, ırk, cins" esasına dayalı der-neklerin kurulması yasaklanmıştır. Bu madde ile sendika ve birçok derneğin kurulması yasaklanmıştır. Bu kanunun kabul gerekçesinde, o dönem de bazı ülkelerde var olan ko-münist ve faşist rejimlerin ülkenin yönetimin ele geçirmesini önlemek olduğu ileri sü-rülmüştür. İsmet İnönü'nün 10-11 Mayıs 1946 tarihinde CHP Kurultayı'nda yaptığı konuşmadan sonra 5 Haziran 1946 tarihinde 4919 sayılı Kanun ile dernek kurma işle-mindeki izin alma formalitesi kaldırılmıştır. Sınıf esasına dayalı dernek kurma yasağı da kalkmıştır. Bu kanunun kabulü sırasında Demokrat Parti adına bir konuşma yapan Adnan Menderes, kanunda yapılan değişikliği demokrasiye giden yolda önemli bir aşa-ma olarak adlandırmıştır. Sivil toplum örgütlenmesinin önündeki engeller Demokrat Parti İktidarı öncesinde kaldırılmıştır. Demokrat Parti İktidarı döneminde sivil toplum kuruluşları ile ilişkiler iki bölü-mde ele alınabilir. Birinci bölüm hükümetin sivil toplum alanında yaptığı düzenleme-lerden oluşur. İkinci bölüm ise iktidarın sivil toplum kuruluşlarına yaklaşımı yani onların faaliyetlerine karşı tutumu, ülke yönetimi ile ilgili alınan kararlara ilgili sivil toplum kuruluşlarının tepkileri ve sivil toplum kuruluşlarının kendi alanları ile ilgili alınan kararlarda bu kuruluşların isteklerinin ve itirazlarının dikkate alıp almamasından oluşur.Demokrat Parti İktidarı döneminde sivil toplum alanında birçok düzenleme yapılmıştır. Hükümetin yaptığı bu düzenlemelere günümüzün demokrasi düzeyi ile yaklaşmak zamanın koşullarını ve demokrasi kültürünün oluşum sürecini dikkate almamak anlamına gelir. Hükümetin sivil toplum alanında yaptığı ilk düzenleme 5680 sayılı Basın Kanunu'dur. Kanunun kabulü demokrasi ilkeleri ile bağdaşan bir uygulama olmuştur. Bu nedenle basın ve basın-yayın örgütleri bu yasayı doğru bir adım olarak görmüşlerdir. Hükümetin sivil toplum alanında yaptığı ikinci kanuni düzenleme 5844 sayılı Komünizm İle Mücadele Kanununu çıkarmasıdır. İktidarın programında komü-nizm fikir akımına ve komünist yayınlara karşı mücadele edileceği, bu fikir akımlarının faaliyetlerinin demokratik bir fikir ve vicdan hürriyeti olarak görülmediği aksine de-mokratik rejimi ortadan kaldırmaya yönelik bir tutum ve tavır olduğu vurgulanmıştır. Muhalefetin de bu konuda iktidarla aynı düşünceye sahip olması bu kanunun çıkarıl-masını kolaylaştırmıştır. Demokrat Parti İktidarı'nın bu tür düşünce akımlarına ve onların faaliyetlerine izin vermemesini değerlendirirken zamanın koşullarını ve demok-rasi kültürünün oluşum sürecini göz önünde tutmak yerinde olacaktır. İktidarın sivil toplum alanı ile ilgili yaptığı bir başka uygulama ise 5816 sayılı Atatürk Kanunu'nun çıkarılmasıdır. Atatürk'ün kişiliğine, ilke ve inkılaplarına saldırıların sonucunda kabul edilmiş olan bu kanun günümüzde de geçerlidir. Bu kanunun çıkarılmasına Atatürk'ün kurduğu parti olan CHP'li milletvekillerinin karşı çıkmış olmaları ise üzerinde durul-ması gereken önemli bir husustur. Hükümetin sivil toplum alanında gerçekleştirdiği bir başka düzenleme ise 6761 sayılı Vicdan ve Toplanma Hürriyetini Koruma Kanunu'nun kabul edilmesidir. Kanun, irticai hareketlerin artarak rejimi tehdit eder hale gelmesinin sonucu çıkarılmıştır. İrticai hareketlere izin verilmeyeceğini, demokratik rejimi koruya-cağını programında ilan eden hükümet bunun gereğini yerine getirmiştir. Dinin siyasi veya diğer çıkarlar için kullanılması ve bu tür örgütlenmelerin kurulmasını demokratik ilkelerle bağdaştırmak mümkün değildir. Hükümetin sivil toplum alanına bir başka müdahalesi Neşir Yolu ile veya Radyo ile İşlenecek Bazı Cürümler Hakkındaki Kanun'u çıkarması ile 6732 ve 6733 sayılı basın kanunlarının bazı maddelerini değiş-tirmesi ile olmuştur. Bu kanunlarda yer alan kişilerin şikayeti olmadan savcıların ya-yınlar ile ilgili kendiliğinden harekete geçebilmesi unsuru haber alma ve verme hür-riyetini engelleyen bir koşul oluşturmuştur. Yine gazetecilerin yaptıkları haberler ve köşe yazarlarının yazdıkları yazılar nedeniyle şikayet edilmeleri halinde kendilerini müdafaa edebilmeleri için ispat hakkının onlara verilmeyişi bazı konularda ( iktidar ve mülki amirler ile ilgili yolsuzluk vb) haber yapmalarına, yazı yazmalarına engel olacak ortamı oluşturmuştur. Ayrıca, halkın haber alma özgürlüğüne, gazetecilerin özgür ve bağımsız çalışmasına engel olmuştur. İspat hakkı verilmediği gibi bu tür yazı ve haberler için cezaların arttırılması basın hürriyetini ortadan kaldırmıştır. Bu nedenle bazı basın mensupları hareket içerikli haber ve yazıları nedeniyle ceza almış olsalar da hükümetin politikalarını eleştiren onlarca basın çalışanına hapis cezalarının verilmesi vatandaşlara hak ve hürriyetlerini vereceğini ve devri sabık yaratmayacağını söyleyen Demokrat Parti İktidarı'nın bu uygulamaları onun söylemleri ve adıyla çelişmesine ne-den olmuştur. Hükümetin sivil toplum alanında yaptığı bir başka kanuni düzenleme 6771 Sayılı Toplantılar ve Gösteri Yürüyüşleri Kanunu'nu çıkarmasıdır. Kanun, siyasi partilerin seçim varmış gibi çok fazla miting yaptığı ve bu mitinglerde konuşanların hükümeti ağır bir şekilde eleştirdiği ve hatta bazı hatiplerin hükümet üyelerine ağır sözler söylediği gerekçeleriyle kabul edilmiştir. Bu kanun ile partilerin miting ve kapalı alan toplantıları seçim zamanı ile sınırlandırılmıştır. Bu nedenle bu uygulama demokrasiye aykırı bir düzenleme olmuştur. Bir parti veya dernek kanunlara aykırı hareket etmediği sürece istediği zaman izin almak koşulu ile miting yapabilmelidir. Hükümetin sivil toplum kuruluşları ile ilişkilerine baktığımızda ise olumlu ve o-lumsuz tutum ve uygulamaların varlığından söz edebiliriz. İktidarın sivil toplum kuru-luşları ile ilişkileri dernekler, sendikalar ve basın teşkilatları ile olmak üzere üç ana bö-lüm halinde ele alınabilir. Derneklerle ilişkilere baktığımızda öğrenci dernekleri ile iliş-kilerin daha yoğun olduğunu söyleyebiliriz. Özellikle TMTF ve MTTB gibi öğrenci dernek federasyonları yönetimleri ile ilişkiler öğrenci dernekleri ile ilişkilerin en önemli bölümünü oluşturur. Bu konuda partilerin bugünde devam eden derneklerin yönetimle-rini elde etme isteği Demokrat Parti İktidarı'nın da faaliyetlerinden birisini oluşmuştur. Bu doğrultuda Demokrat Partili dört milletvekili tarafından öğrenci derneklerine hükümetin verdiği ö-deneği dağıtma ve gençlik sorunlarını çözmek amacıyla kurulmuş olan Gençlik Bürosu' nun TMTF ve MTTB'nin yönetim kurulları seçimlerine müdahale etmesi ve sonrası yaşanan olaylar demokrasi ilkeleri ile bağdaşmamıştır. Ayrıca Türkiye Milli Gençlik Teşkilatı adında bir gençlik derneği varken Türk Milli Birliği'nin kurulması ve böylece geçliği farklı cephelerde örgütleme isteği gençliğin birbiri ile kavgalı hale gelmesine ne-den olmuştur. Çalışmanın odak noktası ise, anayasal düzlemde geniş yetkiler verilen cumhurbaşkanının partisi ile ilişiğinin kesilmemesi nedeniyle anayasal pratikte bu yetkisini daha da arttırabilme ihtimalidir. Yeni anayasal sistemin 09.07.2018 tarihinde tamamıyla yürürlüğe girmesiyle de bu konu hakkında somut ipuçları elde edilebilmemiz mümkün olmuştur. Bu bağlamda hukuki ve siyasi boyutta inceleyeceğimiz, cumhurbaşkanının siyasi partisiyle ilişiği çerçevesinde yeni anayasal sistem, mukayeseli hukuktan da faydalanılarak nitelendirilmeye çalışılmıştır. ; The authoritarian aspect of the 1982 Constitution which has been tried to be changed in every period, has been at the center of the discussions since its entry into force, was further deepened with the 2017 Constitutional amendment. Transition to the presidential regime debates that is in the agenda for many years in Turkey, has evolved into a different dimension with the 2017 Constitutional amendment, which foresees a radical change in management style. Considering the discussions of academics and politicians on the change of management style, in general lines the issue seems to be investigated in terms of; federal-unitary state structure, advantages and disadvantages of parliamentary and presidential regimes within the framework of the constitutional design of powers. Nevertheless, since the specific political party structure and party system of countries play an important role in the functioning of the political regime, the issue should also be addressed from this aspect. The focus of study is, the possibility that the president, who is given broad powers at the constitutional level, can further increase this power in constitutional practice for not being cut off his relationship with his party. It has been possible to obtain concrete clues on this issue with the new constitutional system fully coming into force on 09.07.2018. In this context, within the framework of the president's relationship with his political party, the new constitutional system which we will examine in legal and political dimensions, will be tried to be qualified by also making use of comparative law.
Yürürlüğe girdiği andan itibaren tartışmaların odağında yer alan 1982 Anayasasının her dönemde değiştirilmeye çalışılan otoriter yönü, 2017 Anayasa değişikliğiyle daha da derinleştirilmiştir. Türkiye'de uzun yıllar gündemden düşmeyen başkanlık rejimine geçiş tartışmalarıysa, köklü bir yönetim biçimi değişikliğini öngören 2017 Anayasa değişikliğiyle farklı bir boyuta evirilmiştir. Akademisyenler ve siyasetçilerin yönetim biçimi değişikliği konusundaki tartışmalarına bakıldığında genel hatlarıyla sorunun; federal-üniter devlet yapısı, erklerin anayasal düzlemdeki dizaynı çerçevesinde parlamenter ve başkanlık rejimlerinin avantajları ve dezavantajları yönünden araştırıldığı görülmektedir. Ancak ülkelerin kendilerine özgü siyasi parti yapısı ve parti sistemi, siyasal rejimin işleyişinde önemli bir rol oynadığı için konunun bu yönüyle de ele alınması gerekmektedir. Çalışmanın odak noktası ise, anayasal düzlemde geniş yetkiler verilen cumhurbaşkanının partisi ile ilişiğinin kesilmemesi nedeniyle anayasal pratikte bu yetkisini daha da arttırabilme ihtimalidir. Birbiri ile komşu iki devlet olan Türkiye ile Yunanistan arasında bazı sorunlar vardır. Bu sorunların başında da "Ege Denizi" ve "Kıbrıs sorunları" gelmektedir. İki devlet bu iki konuda çeşitli şekillerde karşı karşıya gelmiştir. Türk dış politikasında, Yunanistan'ın statükoyu bozmaya çalıştığı ve tehdit oluşturduğu bazı durumlarda zorlayıcı diplomasinin, güç tehdidi veya güç kullanımı düzeyinde bir dış politika aracı olarak kullanıldığı beş kriz meydana gelmiştir. Bu çalışmada, Türk-Yunan krizleri özelinde, Türk dış politikasında zorlayıcı diplomasi bağlamında güç kullanımının, ne zaman ve hangi durumlarda gerek görüldüğü ve nasıl yönetildiği incelenmiştir. Bu çerçevede, askeri gücün, tehdit veya kullanım düzeyinde kullanıldığı dış politika krizleri, askeri, politik ve hukuki açılarıyla anlatılmaya ve analiz edilmeye çalışılmıştır. Ele alınan bu krizler, "1963-1964 Kıbrıs Krizi", "1967 Kıbrıs Krizi", "1987 Ege Denizi Kıta Sahanlığı Krizi", "1996 Kardak Krizi" ve "1997-1998 S-300 Füzeleri Krizidir". Çalışmada, Türkiye'nin Yunanistan'a karşı uygulamaya koymuş olduğu zorlayıcı diplomasi stratejilerini, bir tehdidi engelleme ve statükoyu ve menfaatlerini koruma gayesi çerçevesinde savunmacı bir üslupla yürüttüğü, uluslararası hukuka uygun davrandığı ve meşruiyet sorunu yaşamadığı sonucuna varılmıştır. ; There have been problems between Turkey and Greece who are two neighboring state. These problems have been stemmed from the issues related to "the Aegean Sea" and "Cyprus". The two states have faced each other in various ways on these issues. This has led to the five crises in which Greece tried to disrupt the status quo and posed a threat to Turkey's security and in which coercive diplomacy was used by Turkey as a foreign policy tool in the form of the threat of use of force or the use of force. In this study, it has been tried to examine when, how and in which conditions the coercive diplomacy was used by Turkey in Turco-Greek crises. In this context, the use of coercive diplomacy has been explained and examined with a special emphasis on its military, political and legal aspects. The crises examined include "the Cyprus Crisis of 1963-1964", "the Cyprus Crisis of 1967", "the Aegean Sea Continental Shelf Crisis of 1987", "the Kardak Crisis of 1996" and "the S-300 Missiles Crisis of 1997-1998". The study concludes that Turkey carried out its coercive diplomatic strategies against Greece in a defensive manner with the aim of preventing a threat and protecting the status quo and its interests, acted in accordance with international law and did not have a problem of legitimacy.
Bu çalışmanın amacı genel olarak Avrupa'da artan popülizmi ve özel olarak da Macaristan ve Polonya'daki popülist hükümetleri incelemektir. Birinci bölümde popülizmin kavramsal analizi yapılmıştır. Bu bağlamda literatürde yer alan farklı popülizm tanımları ve popülizme dair farklı görüşler ortaya konulmuştur. İkinci bölümde ilk olarak Avrupa'da artan popülizme değinilerek, Avrupa'daki sol popülist siyasi partiler ile sağ popülist siyasi partiler ele alınmıştır. Daha sonra Fidesz öncesi Macar siyasetinin durumu incelenmiş ve böylece Fidesz'in iktidara geliş süreci analiz edilmiştir. Fidesz dönemi gerçekleşen siyasi, iktisadi, hukuki ve sosyal gelişmeler ifade edilmiştir. Bunun akabinde PiS iktidarı ve Polonya'daki dönüşüm değerlendirilmiştir. PiS'in ilk iş olarak Polonya tarihini yeniden yorumlama ve yeniden yazmaya yeltendiği görülmektedir. PiS iktidarının takip ettiği popülist politikaların yanı sıra Katolik Kilisesi ile ilişkilerine de değinilmiştir. Berlin Duvarı'nın yıkılmasıyla Batı sistemiyle bütünleşen ve tercihini kapitalizm ve liberal demokrasiden yana kullanan Macaristan ile Polonya'nın halkın beklentilerine cevap verememesi neticesinde Fidesz ve PiS gibi popülist partilerin bunu kendi lehlerini kullandıkları saptanmıştır. Her iki ülkedeki demokratik standartlarda ve hukukun üstünlüğünde bazı aşınmalar gerçekleşmektedir. Ana akım siyasi partiler inisiyatif almadıkları takdirde bu trendin devam edeceği öngörülebilir. In the first part, conceptual analysis of populism is realized. At that juncture, different descriptions of populism within the literature and distinct views regarding populism are revealed. In the second part, the leftist political parties and rightist political parties are evaluated by touching on the subject of the increasing populism in Europe. Afterwards the Hungarian politics before Fidesz are examined and in doing so, the process of Fidesz's coming to power are analyzed. Political, economic, legal and social developments during Fidesz era are explained. After that, the PiS government and the transformation in Poland are examined. It is observed that PiS tried to reinterpret and rewrite the Polish history. PiS's relations along with Catholic Church are examined as well as its populist policies. It is determined that populist political parties such as Fidesz and PiS utilized the fact that both Hungary and Poland could not respond expectations of their citizens despite they preferred capitalism and liberal democracy by integrating into the Western system after the collapse of the Berlin Wall. Some corrosion happened in the both countries in terms of democratic standards and the rule of law. The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.
ÖZETKamusal hizmetler merkezi idare ve yerel idareler tarafından yerine getirilmektedir. Söz konusu idareler arasındaki mali ilişki gelir paylaşımı ve hizmet bölüşümünden oluşmaktadır. İdareler arası hizmet bölüşümü etkinlik, faaliyetlerin ayarlanması ve yeknesak standart ve politikalar gibi birtakım kriterler ile belirlenmektedir. Bunun yanında idareler arasındaki gelir bölüşümü ise anlaşılabilirlik, yeterlilik, uygulanabilirlik ve gelir esnekliği gibi kriterlere bağlıdır. Etkin kaynak dağılımı için öncelikle idareler arası hizmet bölüşümü, daha sonra ise gelir paylaşımı belirlenmelidir.Yerel yönetimleri temsil bakımından en iyi örnek belediyelerdir. Belediyelerin mali ve idari durumu, şehirlerin giderek artan önemleri ve sorunlarının etkisiyle ön plana çıkmış; mali ve yerel önlemler alma ihtiyacı 1970'lerin sonunda iyice belirginleşmiştir. Bu gereksinimlerin sonucunda mali ve idari alanda birtakım düzenlemeler olmuştur. Mali alanda 1981 yılında 2380 ve 2464 sayılı Kanunlar ile yapılan düzenlemeler sonucunda belediyelere önemli oranda gelir sağlanmıştır. İdari alanda ise 1984 yılında çıkartılan 3030 sayılı Kanun ile İstanbul, İzmir ve Ankara gibi büyük şehirlerin yönetimi özel bir yapıya kavuşturulmuştur. Fakat bu şehirlerin yeni bir uygulamaya geçmesi varolan sorunları çözmede yetersiz kalmış ve merkezi idareyle aralarındaki idari ve mali sorunlar devam etmiştir. Bu sorunların çözümü için çeşitli kanun tasarıları hazırlanmış, fakat kanunlaşamamıştır. Kalkınma Planlarında ifade edilen düşünceler ise uygulamada yer bulamamıştır.Bu çalışmada yukarıda ifade edilen sorunlar çerçevesinde merkezi idare-yerel idare arasındaki mali ilişki incelenmiş ve Dünya ve Türkiye'deki büyük şehir uygulamaları bu açıdan değerlendirilmiştir.Bu çalışma çerçevesinde büyük şehir belediyelerine ilişkin şu sorunlar gözlemlenmiştir: Büyük şehir belediyeleri, kaynak sahibi olma ve kaynak yaratma açısından yeterince güçlü değildir. Belediye bütçe gelirleri, öz gelir payının azlığı ve belediyelerin yeni kaynak yaratma yetkisinin olmaması nedeniyle yetersiz kalmıştır. Belediye gelirlerinin çok büyük bir kısmı merkezi idare transferlerinden oluşmuştur. Bütçe giderleri ise, bazı hizmetlerin düşük düzeyde yapılmasına neden olmuş, personel harcamaları gibi kalemlerin payının yüksekliği bütçeleme alanının daralması sonucunu doğurmuştur. Diğer taraftan, merkezi idare yaptığı kanuni düzenlemelerde öncelikle gelir bölüşümünü belirlediğinden, kaynak kullanımında etkinsizlik ortaya çıkmıştır.Bu çalışmada, sorunların çözümüne ilişkin olarak mali ve idari alanda birtakım düzenlemelerin yapılması önerilmiştir.ABSTRACTPublic services are fulfilled by central and local governments. The fiscal relations between them consist of revenue and service-sharing. The service-sharing between different administrations (e.g. central and local governments) is determined by the criteria such as the setting of activities, uniform standards and policies. The revenue-distribution between different levels of administration, meanwhile, depends on such criteria as comprehensibility, capability, applicability, and income elasticity. For effective resource allocation, first, the service-sharing, and, then, the revenue-sharing between the two levels of administrations (central and local) should be decided.The examples which best represent the local government are local councils (belediye). On account of their increasing significance and problems, the question of the financial and administrative well-being of local councils and the respective need to take financial and local measures to enhance their conditions, have become more marked particularly by the end of the 1970s. As a result of this requirement, new regulations were issued in the financial and administrative spheres. In the financial sphere, the Laws no. 2380 and 2464, adopted in 1981, envisaged significant cash flows to local councils. In the administrative sphere, on the other hand, the Law no. 3030, adopted in 1984, accorded special status for metropolitan cities like İstanbul, İzmir and Ankara. Nonetheless, this new regime proved inadequate in resolving the deep-seated problems these cities had been facing, while their administrative and financial disputes with the central government persisted. A number of draft legislation to resolve these problems were prepared, and yet none were adopted by the parliament as law. The ideas expressed in the Development Plans, meanwhile, did not materialise.This study seeks to examine the financial relations between central and local governments by reference to the problems presented above. The metropolitan city arrangements in Turkey and in the world at large are, likewise, researched through in the same light.In this study, the following observations and findings as regards metropolitan city councils have been reached : The metropolitan cities are not possessed of adequate resources under their disposal and in their capacity of resource-generation. The budget revenue of local councils have remained inadequate due to the insufficiency of their own income and to their lack of power in generating new resources. For the most part, the revenue of local councils consists of funds transferred to them by the central government. The budgetary expenditures, for their part, have resulted in the poor quality of some of the services handled by local councils, while the high share of staff expenditures has limited the scope of budgetary provisions. On the other hand, since the central government first decides upon the allocation of revenues through legal regulations, inefficiency of resource-utilisation accordingly has followed suit. This study suggests a number of new arrangements in financial and administrative fronts to bring about a solution to the problems faced by the local councils in Turkey.

Especially 2001 Afghanistan and March 2003 Iraq military interventions are clear instances.In the 21st century, the concept of the enemy completely changed and the possibility of big powers' fighting with each other by way of alliances fairly decreased. In the 21st century, instead of arsenal wars, there emerged a kind of war against enemy using asymmetric methods. By this thesis, it was mentioned the last position of American power diplomacy in 21st century and the place of military force in its power diplomacy. The national security policy planned by the USA aimed at future, the national security strategy, Joint Vision 2020 and The Army in 2020 established by the USA with direction of military national strategy were researched as bases of military power being basic argument of power diplomacy. It is examined where the USA deploys its forces and gives them which missions by using as an element of foreign policy. Turkey located in the most complicated region of the world is closely influenced by any developments in its region. Therefore, Turkey needs to implement effective power diplomacy in order to manipulate the regional politics and become effective in its region. In this thesis, it is mentioned the practice of power diplomacy of Turkey by taking USA power diplomacy implementation into consideration. It is tried to explain the elements owned by Turkey in order to manage effective implementation of power diplomacy. ABD'nin milli çıkarlarını korumak için dünyada askeri kuvvetlerini nerede konuşlandırarak ve bunlara ne gibi görevler vererek dış politikanın bir unsuru olarak kullandığı ele alınmıştır.Dünyanın en karışık bölgelerinden birinde olan Türkiye, bölgesindeki her gelişmede çok yakından etkilenmektedir. Today the whole world of the moral life are experiencing expatriated state with capitalism's effect, the moral of the community the opportunity to representation in the environment can not be effective, public morality is losing its binding force. Thus, an individuals can not find the opportunity to lean on.top norms which will surround him in all respects. Therefore, in the area of rights and freedoms, interests have been at the forefront instead of universality. Because economic interests have become increasingly active on international relations and foreign policy. Türkiye'deki yerelleşme olgusunun yeterince hızlı ve kuvvetli ilerlemesi önündeki engellerden birisi olarak görülen idari vesayet yetkisinin nasıl ve ne kadar zayıfladığının kamu yönetimi disiplini açısından tespit ve analizi bu çalışmanın ana amacıdır. İdari vesayet yetkisinin idare hukuku içindeki yeri, kamu hukuku açısından reform sonrası hukuki düzenlemeler de dikkate alınarak incelense de kamu yönetimi açısından yeterince incelemeye rastlanmamıştır. İdari vesayet yetkisi kamu yönetimi çalışma alanı açısından ele alınarak değerlendirilmektedir. Ayrıca mülki idare amirlerinin mahalli yönetim türleri (belediye, büyükşehir belediyesi, köy ve il özel idaresi) üzerindeki idari vesayet yetkilerinin, yerel yönetimler reformuyla yürürlüğe giren ve mahalli idareleri yakından ilgilendiren kanunlarla ve Anayasa Mahkemesi'nin aldığı iptal kararlarıyla, nereden nereye geldiği araştırmanın diğer bir yönünü oluşturur. Çalışmada idari vesayet yetkisinin kullanılmasına dair akademik ve pratik öneriler geliştirilmekte ve bu konudaki olası yenilikler irdelenmektedir. Bu bağlamda, mülki idare amirlerinin mahalli idareler üzerindeki idari vesayet yetkilerinin mevcut durumunun ne olduğu ve nasıl olması gerektiğine dair saptamalarda bulunulmaktadır. Türkiye'de mahalli idarelerin özerkliklerinin arttırılması yönünde gerçekleştirilen çabalar da bu çalışmada ele alınmaktadır. Mahalli idarelerin özerkliği yönünde atılan somut adımların idari vesayet açısından kamu yönetimi perspektifinden irdelenmesi çalışmada önemli yer tutmaktadır. Ayrıca Avrupa Birliği'ne uyum sürecinin ve Avrupa Yerel Yönetimler Özerklik Şartı'nın mahalli idareler üzerindeki idari vesayet yetkisine etkileri ile yerelleşmeye ve yerel özerkliğe katkıları da sistematize edilmektedir. Yerel yönetimler reformu öncesi ve reform sonrası idari vesayet yetkisinin mahalli idareler üzerinde kullanımına dair literatür taraması yapılmaktadır. Bu betimleyici ağırlıklı çalışmada mevzuat, mahkeme kararları ve uygulamacıların deneyimlerinden faydanılmaktadır. ; The principal goal of this study is to determine and analyze how and to what extent the power of administrative tutelage that is considered as one of obstacles before sufficiently quick and powerful progress the fact ?localization? in Turkey are attenuated in terms of public management discipline. Significance of the power of the administrative tutelage is reviewed in terms of public law by considering post-reform legal arrangements; sufficient studies for public management are not encountered. The power of administrative tutelage is discussed and evaluated within study scope of public management. Furthermore, progress of the power of administrative tutelage of the local authorities on local administration types (municipalities, metropolitan municipalities, villages and provincial private authorities) by laws, which become into force upon the local authority reform and involve closely local authorities, and cancellation decree made by the Constitutional Court, constitutes another aspect of the study. In this study, any academic and practical advices are developed on use of the power of administrative tutelage and any relevant possible news is addressed. In this scope, any determinations on what and how current situation of the power of administrative tutelage of the local authorities on local administration types must be are made. In this study, any endeavors on increase of autonomy of local authorities in Turkey are also discussed. Any material steps taken toward autonomy of local authorities take a critical place in scrutinizing the perspective of public management in respect to administrative tutelage. Furthermore, the effects of the European Union accession period and the European Charter of Local Self Government and their contribution to powers of administrative tutelage are also systematized. Literature investigations are carried out on use of the power of administrative tutelage before and after the reform of local authorities. In this descriptive study, legislation, court decrees and experience of executers are also utilized.
ABSTRACTFORCE PROJECTION IN INTERNATIONAL LAW AND SOVEREIGNTY BY MEANS OF UNITED NATIONS PEACE SUPPORT OPERATIONSIn the threshold of a new era, starting from early 1900's all nations began to appear dependent on each other in an ever-accelerating global world where the concept of classical total sovereignty transitions itself into a new understanding discribed as partial soverignty, especially by financial means.Threats, today are described mainly at economical level but yet not succesfully resolved without use of force projection. After devastating centuries of wars and conflict all around the globe, nations found themselves in a common urge to unite under the flag of International Organizations in the hope of ensuring a safe platform to negotiate over conflicting subjects and find solutions at political level , thus, preventing the painfull history repeat it self again. " United Nations" (U.N.) is inarguably the most widespread of all international organizations with the participation of almost evey country as amember.This dissertation aims to examine how U.N. finds legal grounds to interfere with governmental issues and under what circumstances U.N. resolutions affect national sovvereignty. Althought the unity is suppossed to be founded upon existence of equal members, U.N. unfortunately has acted more like an oligarchical club so far.This situation brings a lot of criticism especially about the special rights and authority of five permanant members of the Security Concil. It is a fact that thronghout decades, many conflicts have arisen in deffrent parts of the global map just because these privileged members used their authority in favour of their foreign policies. It is also this fact why U.N. today can be described anything but thrustworthy, apart from the motives of its foundation. Ancak devletlerin birbirlerine karşı kuvvet kullanmaları engellenememiştir. Muhtemelen bundan sonrada engellenemeyecektir. Dünyanın artık tek isteği barış ve huzur içinde yaşamaktır. Devletler barış ve huzur içinde yaşamak ve geçmişte yaşanan acıların tekrarını önlemek maksadıyla uluslararası örgütler kurma yoluna gitmişlerdir. Yüzyılımızın bu anlamda en etkin örgütü olarak Birleşmiş Milletler kurulmuştur. Bu gün hemen hemen bütün devletler bu örgüte üye durumundadır.Bu çalışmamızda Birleşmiş Milletler Örgütünün devletin egemenliğine hangi nedenlerle müdahale edebildiği anlatılmıştır. Günümüzde özellikle Birleşmiş Milletler Örgütü devletin egemenliğine İnsani amaçlarla müdahale etmektedir. Kendisine ait bir askeri gücü olmayıp, üye devletlerin gönüllü yardımlarıyla oluşturulan Birleşmiş Milletler maalesef büyük devletlerin güdümü altındadır. Haklı olarak bugünkü yapısı eleştirilmektedir. Bu eleştirilerin büyük bir bölümü Güvenlik Konseyinin beş daimi üyesinin statüsü ve bunların veto yetkileri ile ilgilidir. Bu devletler veto yetkilerini hep kendi ülkelerinin dış politikaları yönümde kullanmışlardır. Bu yönden de dünyanın birçok yerinde çatışmalar devam etmektedir. Bu durum Birleşmiş Milletlerin güvenirliğini zayıflatmıştır. Birleşmiş Milletler Örgütünü, devletlerin gerçek anlamda eşit olarak söz sahibi olduğu yapıya kavuşturmak zorunlu bir hal almıştır. Ancak bu durumda Birleşmiş Milletler güvenilir bir örgüt olabilir.
ÖZETSovyetlerden 15 bağımsız cumhuriyetin ayrılışından sonra Rusya Federasyonu içinde demokrasi ve milli özgürlük uğrunda mücadele devam etmiştir.Bu mücadelenin ayrılmaz parçası olan Azerbaycan Cumhuriyetinde gelişen demokratik olaylar sonucu bağımsızlık ilan edilmiş, çağdaş ülke için değişim yoluna girilmiştir. Tarih boyu demokrasi millet ve halkların, toplumsal kuvve ve grupların keskin mücadelelerinin esas çizgisi olmuş ve olmaktadır. Bu mücadele yolunda bir çok fikir ve yöntemler geliştirilmiştir. Ama Marksist teori demokrasinin mahiyetini yanlış ve hatalı açıklamış, onu sınıfsal bir anlayış olarak belirlemiştir. Tarihi tecrübe bu iddiaların gayri hayatiliğini , insan doğasına aykırı olduğunu kanıtlamıştır. Çünkü demokrasiye sınıfsal yaklaşım bu sınıfın iktidarına, bir partinin diktatörlüğüne , gittikçe bozulan bürokratik bir sistemin yaranmasına neden oldu. Oysa demokrasi genel bir kavramdı, ülkeye, sınıfa, millete has demokrasi olamazdı. Demokrasinin uluslar üstü değerleri, prensipleri, şartları ve uygulanacak aşamaları vardı ve demokrasi her şeyden önce millet ve halkların özgürlüğünü hayata geçirmek yöntemiydi. Sovyetler Birliği yukarıdan aşağıya doğru dikey ve yatay yönlerde her şeyi, tüm toplumu, onun tüm halkalarını, sinir hücrelerini kapsıyordu. Fakat iktidarın milyonları korku altında tutması her zaman mümkün olamaz bu yüzden değişik yöntemlere başvuruluyor, özellikle utopik bir ideoloji ile beyinler yıkanıyordu. Ülkede hem Anayasa hem seçim hem çok sayıda kamu kurumları vardı. Fakat bunların faaliyetleri merkezin karar ve direktifleri ile baştan sona kadar parti strüktürleri tarafından idare ediliyordu. Neticede toplum aşırı merkezileşmiş, otoriter karakter kazanmıştı. Sadece yerel organların değil, Anayasalı federe cumhuriyetlerin yasama, yürütme organlarının da hakları kısıtlı ve kontrole tabi idi. İnsanlar ekonomik yönden tamamen devletten asılı durumda, yaratıcılıktan yoksun yukarının emirlerini uygulayan birer pasif fertlere çevrilmişlerdi. Fakat insanlar durumun farkında olmadan yüzyıllarca yaşayamazlardı. Zengin doğal servetleri olan bir memlekette çok kötü durumda yaşamak insanların akıllarında soru işaretleri doğurmuyor değildi. İşte bu yüzden 70'li yıllarda Sovyetler Birliği çökmeye başlamıştı. Azerbaycan Cumhuriyeti açısından olaylara baktığımızda Sovyetlerin kuruluşunun Rusya için getirmiş bulunduğu artı değerlerin burada kesinlikle olmadığını görüyoruz. Çünkü SSCB'ye katılan ülkenin esas doğal zenginliği olan petrol dünya pazarlarında çok ucuz fiyata satılarak kazanılan değerler Moskova'ya akmış, Hazar denizi derin ekolojik problemleri olan göle çevrilmiş, 1920 işgalinden sonra 48 bin insan öldürülmüş 80 bin kişi Iran da kalan Azerbaycan topraklarına göç etmiş, 1948-1953 yıllarında 140 binden fazla kişi, 1988'den itibaren ise tüm Azeri nüfus Ermenistan'dan zorla kovulmuş , ülke ekonomisi merkezden gelen talimatlara uyulmak zorunda kalındığı için derin yaralar almış, 1930'lı yıllarda toplumun aydın kısmı öldürülmüş veya sürgün edilmiş ; ülke içinde bir bölgeye özerklik verilerek ve 70 yıl içinde nüfus dağılımı maksatlı olarak değiştirilerek bağımsızlık mücadelesi önünde bir engel haline getirilmiştir. Bunlara ülkenin Ruslaştırma politikası yüzünden alfabenin değiştirildiğini, tarihinin tamamen saptırıldığını, geleneklerini zorla unutturulmaya çalışıldığını eklersek manevi olarak de bir milleti yok etmek için yapılabilecek her şeyin gerçekleştirildiğini anlamış oluruz.Maalesef ki Sovyetler dağıldıktan sonra bu topraklarda kurulmuş bağımsız devletlerde ve aynı şekilde Azerbaycan'da totalitar düşünce ve idare sistemi halen devam etmektedir.Fakat bu ülkelerde devam eden değişimler her hangi bir kesin sistemden bahsetmenin erken olduğunu kanıtlıyor.SUMMARYAfter 15 republics separated from the Soviet Union, struggle had went on in Russian Federation to reach democracy and freedom. As a result of some democratic phenomenon assured in The Republic of Azerbaijan which was the most important part of the fight from the beginning, independence had been declared and this was the first step for a contemporary country .To reach liberation was important after that long period of slavery and dictatorship but also to understand the idea of democracy and take lessons from the history was essential and vital. Democracy had always been the base of the nations' contention in the history. But Marxism had explained democracy in a wrong way and showed it as the intelligence of the social groups. But history proved that this idea is against the nature of human being. Cause democracy was a general concept and would not have belonged to a country, a social group or a nation. USSR was dominating all nations in the Union. Any objection used to be removed even through against law actions. Also Federative Republics' rights were limited and controlled. But it was not always possible to dominate people with creating fear over them. And people had started to ask themselves the reason of their poor life's although they lived in a country which is very rich in terms of natural sources. As a result; Soviet Union had started to collapse in the years of 70.If we look at the reason of Union's collapse, we first face with the system of common prietorship which is the vital part of the economy. This system had prepared the base of the collapse causing people lose their idea of ownership and pushing them to stealing, lying and bribery.Single political party was protected by the military authoritarian police system. The gap between the government and the citizen was becoming biger and biger every day.In the social area; everybody was considered equal as the result of social equality which was ruining social justice principles In the field of ideology; Marxism and Leninism were accepted and taught as the sole theory representing community phenomenon.If we examine Azerbaijan's situation in the Union we can say that Soviet Union had not affected this country in a positive way. The basic natural source of Azerbaijan was petroleum which was sold in the world market very cheap and the profit was running to Moskow directly. After the occupation of Azerbaijan in 1920 ,48 thousand of people were killed, 80 thousand had migrated to the land of Azerbaijan which was left to Iran. After 1988 all Azerbaijani population was driven away from Armenia. In 70 years allocation of the population had been changed on purpose to prevent any possible independence fight against the Union.Unfortunately after the Union collapsed , totalitarian opinion and government system is still going on in the Republics that separated from the Union like being in Azerbaijan.During the Soviet period Human Rights was called as the bourgeois theory and never been taught in the Universities. Not until the end of 80's human rights were included in the socialist mechanism. As a result, in Azerbaijan , short past of country's independence is still being used as the reason of limiting people's rights. Although freedom of press was arranged by the constitution in 1995, there are still blank lines and pages in the newspapers.War and interruption of the economic relations as a result of Union's collapse are still used as the defence of the above examples of misrule.
