The article deals with certain problems arising out of implementation of criminal liability of legal entities in Ukraine. The author researches experience of criminal liability of legal entities in some foreign countries and analyzes existing problems of this institute. Foreign and national approaches to criminal liability of legal entities have been compared. The issue of incompliance between international standards in criminal law and traditional approaches to the main institutes of criminal law in Ukraine has been considered. The article deals with theoretical and practical application of criminal liability against legal entities. Grounds for criminal liability and types of punishment which can be applied to legal entities and their future implementation in Ukraine have been emphasized. It has been established that economic imfluence is the most effective against legal entities. That is why the most common type of sanctions for legal entities is fine. Implementation of criminal liability of legal entities in foreign legislation was a significant step towards counteraction to illegal activities of these entities. Foreign experience is useful and efficient for future implementation of European integration of Ukraine and attempts to solve existing problems related to bringing of legal entities to liability. At the same time, it would be possible to use experience of the state which implemented the most effective mechanisms of impact on legal entities for corruption and other crimes. For national legislation this step is really revolutionary. But if the legislator is interested that this institute operates effectively certain amendments and supplements to the Criminal Code of Ukraine are needed.

Criminal-legal encouragement is realized also by some norms of a Special part of the Criminal code of Ukraine in the form of special cases of voluntary refusal or active repentance. Incentives of criminal law are some methods provided by the Criminal code of Ukraine, which methods legal regulation of a criminal offence committed (or about to be committed) by means of which the state encourages a person to the desired behavior. Such behavior is aimed at preventing, neutralizing or reducing criminal damage (losses), as well as to facilitate the disclosure of a criminal offense, not committing new criminal offenses. The author has paid attention to a spread of criminal attacks on such types of energy resources as oil and gas, and also he has considered the relevant corpus delicti concerning these subjects in the criminal legislation of Ukraine. Based on the analysis of judicial practice, as well as the existing doctrinal provisions, the author has stated that the criminal law in the part of responsibility for committing these socially dangerous acts seems to be imperfect. On the basis of the study he has proposed to provide a separate criminal legal rule (article 1882) in Section VI "Crimes against property" of the Criminal Code of Ukraine among norms containing corpus delicti encroaching such energy resources as oil and gas.The author has proposed to amend other parts of crimes providing liability for encroachment related to damage of objects of main or industrial oil-, gas-, condensate pipelines and oil product pipelines and violations of their operation order.

The article deals with the issues of legislative expression of special norms (in particular, regarding the formulation of the features of qualified and especially qualified crimes) in the text of the current Criminal Code of Ukraine. For this purpose, all the cases of the use of qualified or especially qualified crimes in the Criminal Code of Ukraine are generalized in the form of a table. The main focus is on the use of the following legal formulas (constructions) for the formation of qualified and especially qualified crimes: «the same act», «the same acts», «the act(s) provided for by Part(s). of this Article», «the same actions», «the actions provided for by Part(s). of this Article», «the same action». An attempt is being made to analyze the content of this construction, taking into account the type of the previous core crime. In this aspect, main attention is focused on the analysis of the norm of Part 2 of Article 194 of the Criminal Code of Ukraine in order to determine the adequacy and suitability of the use of legal construction «the same act» in it. In such situations, it is proposed to assess the degree of social danger of the analyzed act, which is indicated by the so-called crime-forming features. ; Розглянуто питання законодавчого вираження спеціальних норм (зокрема, в частині формулювання ознак кваліфікованих та особливо кваліфікованих складів злочину) в тексті чинного Кримінального кодексу України. З цією метою у формі таблиці узагальнено всі випадки використання кваліфікованих чи особливо кваліфікованих складів злочину в КК України. Чинний на 30 вересня 2017 року КК України дає можливість зробити висновок про те, що він містить 397 кваліфікованих (особливо кваліфікованих) складів злочину. Найбільше проблемних питань кваліфікації з'являється у тих випадках, коли основний склад відповідного злочину матеріальний, а кваліфікований чи особливо кваліфікований як вказівку на основний послуговується термінами «дія(-ї)» чи «діяння».У цьому аспекті, особливу увагу зосереджено на аналізі норми ч. 2 ст. 194 КК України з метою визначення адекватності використання у ній юридичної конструкції «те саме діяння». У подібних ситуаціях пропонуємо керуватися оцінкою ступеня суспільної небезпеки вчиненого діяння, індикатором якого є так звані криміноутворюючі ознаки. У ч. 2 ст. 194 КК України, такими криміноутворюючими ознаками, на нашу думку, є загальнонебезпечний спосіб, загибель людей чи інші тяжкі наслідки. The mere mention of the body captures the attention. However, criminal law considers it only through the human person and the protection purposes of the latter. The human body is reflected through protected social values which are part and parcel of the person, or more generally of the human being, but it is rarely considered as such. The body, being concealed behind these values, questions its position under criminal law. This study is intented to reverse the traditional approach by addressing the body for what it is and not through the values it conveys.The analysis of the position of the body under criminal law reveals its frequent concealment behind the person. When the body is tackled as an individual object, then the legislator seems to associate it with a protected social value. Yet, this first impression is misleading since it forms only the substratum. Life, physical integrity or dignity are certainly inherent to the body but the latter being only the solid support to convey those abstract notions. All this leads to an unsatisfactory legal regime, firstly because the treatment accorded to protected social values is not suitable to the body and secondly, because when treated outside the person lens, the body is the subject of a flawed apprehension. Faced with these inconsistencies, this study aims to renew the legal regime granted to the human body by applying the rules on the pre-existing legal categories- things and people. By taking advantage of the criminal law regarding people and of criminal law regarding property, a renewed understanding of the body emerges in criminal law. ; La seule évocation du corps humain éveille l'attention. This article analyzes the current state of legislation in the sphere of mediation application and separate procedural norms related to this issue. The author raises questions about the preconditions and prospects for the implementation of mediation in the criminal procedural law of Ukraine. Taking into account the Strategy for the Reform of the Judicial System, Judiciary and Related Legal Institutes for 2015-2020, approved by the Decree of the President of Ukraine dated May 20, 2015, No. 276/2015, proposals are made for the adoption of the Law of Ukraine "On Mediation" and the consolidation of the procedural status of a professional mediator. An overview of key terms and stages of mediation in the criminal proceedings of Ukraine is provided. The decision regarding the possibility and feasibility of a mediation procedure should be taken, in the first place, based on the wishes of the suspect or accused to reconcile with the victim, to compensate for the harm done or to eliminate the damage caused, to try to normalize the relations with the victim and the victim's ability to forgive the suspect or the accused and restore relationships. The article identifies the following mediation models: private (extrajudicial) mediation, characterized by complete independence from the trial process by the court; judicious mediation, which is characterized by some coordination with the court process, but separating the procedure of mediation from the court as an institution; mediation within the court process, for which there is a local and personal connection with the court and actions, which are realized within the limits of consideration of a case by a court. Taking into the account positive and negative sides of each of the models, the author suggests a possible choice of mediation model. Complex conclusions are made about the factors on which the success of the mediation procedure depends. The article deals with methodological bases for the of research on the mechanism for of law-making of a unitary state. The article is devoted to the study of the nature and role of methodology in the formation of the Ukraine's legal system during the law-making mechanism. Much attention is given to problematic approaches to determining methodological bases in law-making mechanism. The purpose of this article is to analyze the current state of lawmaking in Ukraine and to make proposals based on the methodology of law. The article explores the concept of methodology on the basis of which the methodological bases of lawmaking are determined. The author states that the methodology of research on lawmaking should cover the analysis of scientific approaches and application of own methods, which allow to identify the most essential characteristics of this legal phenomenon, to distinguish structural elements, to indicate the ways of the most effective preparation and adoption of legal acts. Law-making process is a form of the state activity intended for on the creation (or revision) of legal norms. The law-making process and the role of the legisla- tive bodies in it are based on the constitutional principles of democracy, separation of powers, social state. Scientific search for a theoretical and methodological tool for considering and solving the problems of lawmaking is carried out within the framework of legal positivism – consideration of law as a set of norms established and sanctioned by the state, the violation of which is followed by measures of state coercion. This implies the rejection of the metaphysical side, related to the disclosure of the essence of legal phenomena. The problem of specification as a legal phenome- non is considered. At the heart of the author's research there are the methods used to investigate the elaboration of law-making. Studying the family link from a criminal law perspective may seem paradoxical at first sight. Yet this is not the case since the confrontation between these two concepts is as ineluctable as is it necessary. The examination of the impacts of the family link on the repressive rules falls within a multidisciplinary approach and sheds light on two conceptions, whose limits are constantly changing. The purpose of this study is to analyse the current phenomenon of transformation in the criminal protection of families through observation and research; and to break down the principles governing it, so as to better grasp the situation and to give a new orientation towards future implementations. The study reveals the existence of an overall disinterest of the repressive field in the family link precisely where its consideration is a fundamental criterion in the construction and consistent implementation of criminal rules. The purpose of this research is to analyse the existing body of repressive laws and regulations currently in use as well as to establish an unprecedented classification of family offenses. The creation of a functional typology of family offenses in criminal law will make it possible to provide tailored legal tools to deal with this dilemma and to implement a specific criminal policy regarding the family. This endeavour challenges the very existence of the family link in criminal justice and demands not only that it be reintegrated into criminal law at the initial stage of classifying family offenses, but also that it be subsequently taken into consideration when dealing with these offenses. ; Confronter le lien familial au droit pénal peut sembler paradoxal. La contradiction s'efface cependant devant le caractère inéluctable et nécessaire de cette rencontre. L'étude de l'impact spécifique de la présence du lien de famille sur les règles répressives s'inscrit dans une perspective pluridisciplinaire et propose de mettre en présence deux objets dont les frontières évoluent constamment. À travers une double perspective d'observation et de prospection, cette recherche propose d'analyser le phénomène actuel de mutation de la protection pénale de la famille et de découvrir les principes qui lui sont propres, dans le but de mieux le saisir et de pouvoir en réorienter les applications futures. L'examen révèle l'existence d'un désintérêt répressif global à l'encontre du lien familial à l'endroit où sa prise en compte constitue un atout fondamental pour l'édification et la mise en œuvre cohérente des règles pénales. Cette étude propose d'analyser l'arsenal répressif existant et se donne pour objectif l'édification théorique d'une classification inédite des infractions familiales. La réalisation d'une typologie fonctionnelle de l'infraction familiale en droit pénal permet de pouvoir lui attribuer un outil de traitement procédural adapté à ses spécificités et d'aboutir à la mise en œuvre d'une politique pénale familiale spécifique. Cette ambition questionne la réalité du lien familial pénal et appelle, d'une part, à réinsérer le droit pénal dans le lien familial au stade de la classification des infractions familiales, et, d'autre part, à intégrer le lien familial dans le droit pénal au stade du traitement des infractions familiales.
