This article traces the author's involvement in cultural property protect since his role as archaeological advisor to the UK Ministry of Defence in 2003 with respect to the invasion of Iraq. It notes the failure of that work and the concerns raised by it within the archaeological community. The article notes the work of the 'Monuments Men' in the Second World War and calls for closer collaboration between cultural property experts and the military in the future. The article also notes the author's contact and work with the late Donny George. ; Este artículo analiza paso a paso la participación del autor en la protección de la propiedad cultural desde su papel como consejero arqueológico del Ministerio de Defensa británico en 2003 en relación con la invasión de Iraq. Señala el fracaso de este trabajo y las inquietudes suscitadas por él en la comunidad arqueológica. El artículo se fija asimismo en el trabajo que llevaron a cabo los conocidos como 'Monuments Men' durante la II Guerra Mundial y hace un llamamiento a favor de una colaboración más estrecha entre los expertos en propiedades culturales y los militares en el futuro. El artículo también reseña el contacto y el trabajo del autor con el difunto Donny George.

Abstract:Cultural property protection policy as implemented in Syria since 2011 is structured around standards and practices enshrined within the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict (including its First and Second Protocols) and the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. Policy emphasis is on thein situprotection of cultural sites and the recovery and return of stolen or looted cultural objects. But policy initiatives have very obviously failed to stop the plunder and illegal trade of cultural objects in Syria, as they have failed before for neighboring countries. This paper describes why policy initiatives aimed at site protection and object recovery have failed and how policy might be improved by a market reduction approach aimed at subduing demand.

This paper deals with the implementation of the Convention for the Protection of Cultural Property in the Event of Armed Conflict and its Protocols in armed forces focusing on the Austrian Armed Forces as a best-practice example thereof. It argues for: a. the importance of cultural property protection being an integral element of any military doctrine drafted by political authorities, of a special military directive for cultural property protection, and of cultural property protection being an element in all rules of engagement; b. for the concept of a Cultural Property Protection Officer or Liaison Officer: Military Cultural Property Protection as the professional military staff member responsible for ensuring cultural property protection is considered by their commanders in any situation in times of peace as well as during the conduct of missions; c. for also taking cultural property protection into account for multinational missions such as peace support operations, as well as for military disaster relief missions; d. for the cooperation of the military with non-governmental organizations for developing, implementing, and improving principles of military cultural property protection. تتناول هذه المقالة تنفيذ الاتفاقية المتعلقة بحماية الممتلكات الثقافية في حالة نشوب نزاع مسلح وبروتوكولاتها في القوات المسلحة مع التركيز على القوات المسلحة النمساوية مثالا لأفضل الممارسات منه. وتناقش: (أ) أهمية حماية الملكية الثقافية كجزء لا يتجزأ من أي عقيدة عسكرية وضعتها السلطات السياسية كتوجه عسكري خاص لحماية الممتلكات الثقافية ، وان حماية الممتلكات الثقافية هي عنصر في كل قواعد الاشتباك. (ب) لمفهوم موظف حماية الملكية الثقافية أو ضابط الاتصال : حماية الملكية الثقافية عسكريا كمجموعة عسكرية متخصصة و مسؤولة عن ضمان حماية الملكية الثقافية, يعينون من قبل قادتهم في أي حالة في أوقات السلم وكذلك أثناء سير البعثات. (ج). أخذ حماية الملكية الثقافية في الاعتبار للبعثات متعددة الجنسيات مثل عمليات دعم السلام ، و البعثات العسكرية الاغاثية في حالات الكوارث ؛( د). التعاون العسكري مع المنظمات غير الحكومية لتطوير وتنفيذ وتحسين المبادئ العسكرية لحماية الملكية الثقافية.

Preparations for the adoption of the new Law on Cultural Values Protection, its discussion and debates, that seriously puzzled the German Government, and also caused acute criticism from the representatives of the world of art are analyzed. Attention is focused on approaches to the important and quite complex in this regard issue concerning preservation of illegal movement of cultural objects that belong to the cultural heritage of the state. The main purpose of the bill is to enhance the protection of cultural property and effectively combat the illicit trafficking of them. The intentions of the Federal Government to integrate pre-existing laws in the field of cultural values into one law are very important. The main principles of the law in the new edition are protection from being sold overseas collections of state museums, including exhibits from private ownership that are in museums temporarily. It is highlighted that under current legislation, in each federal state of art and other cultural treasures, including libraries, must be entered in the register of national cultural values. These items have privileges in taxation, their export outside Germany requires special permission from the Ministry of Internal Affairs of Germany, which can be stipulated for a number of restrictions and reservations. In the article it is underlined that he XXIcentury has set new challenges and tasks for German scientists that require operational, but balanced approach in their solution. ; Аналізується підготовка нового закону про захист культурних цінностей. Його обговорення та дискусії поставили серйозні проблеми перед урядом Німеччини, а також викликали гостру критику представників світу мистецтв. Зосереджена увага на підходах до важливого і складного у зв'язку з цим завдання запобігання незаконному переміщенню об'єктів культури, які належать до низки культурного надбання держави. Головною метою законопроекту є посилення захисту культурних цінностей та ефективної боротьби з незаконною торгівлею ними. Важливими є наміри Федерального уряду з об'єднання раніше існуючих законів у сфері охорони культурних цінностей в одному законі. Основними положеннями закону у новій редакції є захист від розпродажу за кордон колекцій державних музеїв, зокрема експонатів із приватного володіння, що зберігаються в музеях тимчасово. Підкреслено, що згідно чинного законодавства, у кожній федеральній землі твори мистецтва та інші культурні цінності, включаючи бібліотеки, повинні бути внесені до реєстру національних культурних цінностей. Ці предмети користуються пільгами при оподаткуванні, їх вивезення за межі країни потребує спеціального дозволу Міністерства внутрішніх справ ФРН, яке може бути обумовлено низкою обмежень і застережень. У статті наголошується, що XXI ст. поставило перед вченими та суспільством ФРН нові виклики і завдання, які потребують оперативного, але виваженого підходу в їх вирішенні.
