The analogy suggesting that public debt is a particular form of private debt not only tends to set aside important theoretical issues such as the constituent elements of definitions, but also leads to ignoring the fact that in the present system the public debt does not seem to have either a debtor or a creditor, any more than a patrimony as a security or a coherent legal system. What appears to be a lack seems, on the contrary, to mean that the public debt operates according to its own logic. This thesis proposes to defend an organic approach to public debt by putting at the heart of research what the positions of public debtor and creditor can mean, and by highlighting the competition between the law, the economic rules and the political principles in the system. The public debt also carries important consequences in terms of distribution or redistribution of the nation's wealth, so the "choice of the debt" is eminently political. This subject also testifies to the evolutions of the place of law in our societies, by being doubly in line with the perspective of the globalization of social phenomena, and seeing the State abandoning some of the elements of its power against the Markets, to position itself as a regulator of the financial system. ; L'analogie laissant penser que la dette publique serait une forme particulière de dette privée tend non seulement à mettre de côté d'importants problèmes théoriques tels que celui des éléments constitutifs des définitions, mais conduit aussi à ignorer que dans le système actuel la dette publique paraît connaître ni débiteur, ni créancier, pas plus que de patrimoine servant de gage ou de régime juridique cohérent. This doctoral dissertation has for main focus the analysis of the optimal level of public debt in an economy where agents face idiosyncratic risk, credit constraints and can only partially insure against future risks because of incomplete markets. It extends the existing literature with three original contributions. The first chapter investigates the optimal level of public debt in presence of macroeconomic fluctuations. The second chapter models a stylized economy with entrepreneurial and working households and determines the impact on the optimal level of public debt. The third and last chapter revisits the optimal level of public debt in a time-consistent economy where the government does not have access to a commitment technology. En juillet 2015, le sommet de la zone euro fait part de l'existence de "sérieux doutes" sur le caractère soutenable de la dette grecque. La possibilité d'un reprofilage de la dette est envisagé et sa discussion reportée à la réalisation de la première évaluation des mesures d'ajustement mises en oeuvre par la Grèce. Toute décote nominale est cependant formellement exclue, car contraire au droit de l'Union. Les discussions se sont ouvertes au printemps 2016 sur les modalités d'allègement de la dette publique de la Grèce. Le sujet a été au coeur de la réunion de l'Eurogroupe du 22 mai. Aucun accord n'a été trouvé, mais les discussions continuent. Dans ce contexte, Frédéric Allemand a présenté le 17 mai dernier une communication sur la saisine des opérations de restructuration par le droit de l'Union lors du séminaire de recherche pluridisciplinaire "Les administrations publiques à l'épreuve de leur dette" organisé par Jean-François Boudet (Université Paris II) et Caroline Lequesne-Roth (Université de Nice). L'auteur conclut à la compétence de l'Union pour encadrer la restructuration des dettes publiques des États membres.

The main income of the government earned by the tax collection is not enough for its missions and the other necessary things. That's why it had to loan more and more money from the domestic and international financial institutions. In Thailand, money has been loaned since the reign of King Rama V. After the Siamese Revolution of 1932, Thailand has incurred more public debt from the international financial institutions and foreign governments for country's development. Public debt of Thailand and different countries has enormously increased while the notion of public debt management has also developed and the special acts on public debt management have been issued in many countries, because of the necessity of incurring public debt of several countries as well as economic crisis happened around the world. In Thailand, the Public Debt Management Act B.E. 2548 (2005) is considered as the principal law authorizing the government to incur and manage public debt in various ways for adapting to changing circumstances such as public debt incurred for social and economic development, for debt restructuring and financial transaction used for reducing the risk on public debt, etc. Moreover, it authorizes the establishment of a central organization only responsible for public debt management. The said act makes the public debt creation and management more unique and efficient. Nevertheless, according to study carried out on legal measures prescribed by the Public Debt Management Act B.E. 2548 (2005), there are two major problems of public debt management: the public debt creation is contradictory to the good fiscal discipline. This allows the stable and efficient systems of public debt management in Thailand. ; Les fonctions administratives, du gouvernement consistent à fournir les services publics, et à opérer la gestion publique et administrative. Cela nécessite l'utilisation en continu d'importantes sommes d'argent. Or, le principal revenu provenant de la collecte des impôts, ne suffit pas pour opérer les missions et les nécessaires activités de l'Etat. C'est la raison pour laquelle, celui-ci doit emprunter davantage aux institutions financières intérieures et extérieures. En Thaïlande, le premier emprunt fut créé à l'ère du Roi Rama V. Et après la Révolution siamoise de 1932, le pays commença à en emprunter de plus en plus aux institutions financières internationales et aux gouvernements étrangers pour son développement. Ce sont les crises économiques mondiales qui ont obligé divers pays dans le monde à contracter la dette publique et qui ont fait accroître ladite dette en Thaïlande. La notion de gestion de la dette publique devient alors indispensable et, à cet égard, plusieurs pays ont rendu des lois spéciales. En Thaïlande, la Loi portant sur la gestion de la dette publique B.E. 2548 (2005) et la désignation d'un mandataire constitue la loi fondamentale autorisant le gouvernement à contracter la dette publique et à la gérer diversement -en raison d'un changement de situation- comme la dette contractée pour le développement économique et social, pour la restructuration de la dette et la mise en œuvre de la politique sur les transactions financières en vue de réduire le risque de dette publique, etc. En outre, une organisation centrale uniquement responsable de la gestion de la dette publique a été fondée. La présente loi rend l'emprunt ainsi que la gestion de la dette publique thaïlandaise plus spécifiques et efficaces. Néanmoins, l'étude menée sur les mesures juridiques dans la Loi portant sur la gestion de la dette publique B.E. 2548 (2005), révèle deux grands problèmes concernant la gestion de la dette publique en Thaïlande : le problème sur la contraction de la dette publique en contradiction avec de bonnes disciplines financières et le problème concernant la non-diminution de la dette publique ainsi que le non-maintien de la stabilité économique à long terme à cause de l'ambigüité et de l'inefficacité de l'entrée en vigueur de la loi portant sur la gestion de la dette publique. Nous proposons alors une solution concrète pour résoudre de tels problèmes avec la mise en place de mécanismes juridiques pour une bonne application des disciplines financières et l'amendement de la Loi portant sur la gestion de la dette publique B.E. 2548 (2005) qui s'appliquerait -dès à présent- afin que les systèmes liés à la gestion de la dette publique en Thaïlande soient davantage stables et efficaces.

The public debt is as old as the State. So is the question of its legal framework. At the turn of the 1990s, the Maastricht Treaty renewed the issue. Within the eeconomic and monetary union (EMU), the member states and the Union shall act with respect, in particular, to the guiding principle of sound public finances. The objectification of the capacity to control public debt is achieved through the constitutional enunciation of a new budgetary normality in which the flow and stock of debt are judged on the basis of fixed reference values.This rule of prudence is the basis for surveillance from the dual point of view of investors and other member states. The Maastricht Treaty constitutionalizes the marketization of public debt in connection with the normalization of the status of the State issuer. Although fiscal policy remains a national competence, belonging to the euro zone makes each State responsible to its partners and to the Union. As part of a logic of coordination, this rules-based discipline must prevent and correct any excessive indebtedness. The sovereign debt crisis has undermined the effectiveness of this model and underlines the reluctance of the Union to take over what has become a major issue in the EMU: the public debt. Drawing on the author's previous work, this thesis identifies the main features of a legal regime for public debt, from its birth to its extinction. as a background, it questions the principle of financial responsibility of the Member States and the possibility of a socialization of public debt. ; La dette publique est aussi ancienne que l'État.
