When we talk about Deliberation, we may define a process of political discussions to resolve disagreements supported by arguments and require the participation of all citizens by encouraging mutual respect. Deliberation is characterized by a specific scenario of structural inequalities, its civil and moral judgments and its ideal rationality to legitimate political decisions. Nevertheless, any deliberation in a democracy is apparently grounds for contradictions because of the actions from the hierarchy of power and the deconstruction of reality through the communication process to obey the rules for the common good. This response paper based on the reflections expressed by Lynn Sanders, Iris Marion Young, Frank Michelman, Jürgen Habermas and William Rehg in some articles focuses on this topic. The response paper will reflect over the different set of assumptions of political and communicative dimensions of this process of Deliberation that seems to be utopian and unequal at the end.
Objective: this article of reflection seeks to dissertate around the incidence, scope, challenges and obstacles that the use of the Internet is conducive to the exercise of democracy. Methodology: from an interpretive exercise of recent literature on the Internet, cyberculture, social movements and democracy, it is stated that these have a dialectical character; That is, they are a place of building power and counterpower. Finding: for some actors like the States and Internet Corporations in a space of manipulation, control and surveillance of citizens; but, for politically active individuals, for social organizations and social movements translates into a new space for interaction, sharing, denounce, cooperate and organize around values or an ideal of democracy. Conclusion: the communicative and deliberative characteristics of the use of the Internet have led to changes in the organizational forms and strategies of collective action of the different social actors, Complicating the democratic exercise and giving it a potential for social transformation. ; Objetivo: con este artículo de reflexión se busca disertar alrededor de la incidencia, alcances, retos y obstáculos que propicia el uso de Internet para el ejercicio de la democracia. Metodología: a partir de un ejercicio interpretativo de la literatura reciente sobre Internet, cibercultura, movimientos sociales y democracia, se afirma que estos tienen un carácter dialéctico; es decir, son un lugar de construcción de poder y de contrapoder. Hallazgo: para algunos actores como los Estados y las Corporaciones Internet en un espacio de manipulación, control y vigilancia de los ciudadanos; pero, para los individuos políticamente activos, para las organizaciones sociales y para los movimientos sociales se traduce en un nuevo espacio para interactuar, compartir, denunciar, cooperar y organizarse en torno a unos valores o a un ideal de democracia. Conclusión: las características comunicativas y deliberativas del uso de Internet han propiciado cambios en las formas organizativas y en las estrategias de la acción colectiva de los distintos actores sociales, complejizando el ejercicio democrático e imprimiéndole un carácter potencial de transformación social.

We are proposing a conception of laicism as a cognitive method in the individual sphere and as a democratic decision making method in the public sphere using discursive procedures. The secular State must fully cover the sector in which the moral (values) dimension is preeminent, but most emphatically, the one regarding the religious dimension. In this sense, laicism in the public sphere should incorporate the autonomy of the State regarding religious doctrines and norms as well as the respect towards the individuals' privacy and freedom of conscience. Through out this paper the reader will find various recent examples in which laicism has been questioned in Mexico, as well as some possible solutions around the ideas of RAWLS, HABERMAS, DWORKIN and LAFONT, among other philosophers. ; Se propone una concepción de la laicidad como método de conocimiento en el plano individual y como método de decisión democrática en el ámbito público mediante procedimientos discursivos. This paper deals with the place of narrative, that is, storytelling, in public deliberation. A distinction is made between weak and strong conceptions of narrative. According to the weak one, storytelling is but one rhetorical device among others with which social actors produce and convey meaning. In contrast, the strong conception holds that narrative is necessary to communicate, and argue, about topics such as the human experience of time, collective identities and the moral and ethical validity of values. The upshot of this idea is that storytelling should be a necessary component of any ideal of public deliberation. Contrary to recent work by deliberative theorists, who tend to adopt the weak conception of narrative, the author argues for embracing the strong one. The main contention of this article is that stories not only have a legitimate place in deliberation, but are even necessary to formulate certain arguments in the fi rst place; for instance, arguments drawing on historical experience. This claim, namely that narrative is constitutive of certain arguments, in the sense that, without it, said reasons cannot be articulated, is illustrated by deliberative theory's own narrative underpinnings. Finally, certain possible objections against the strong conception of narrative are dispelled. ; Este artículo aborda el papel de las narraciones en la deliberación pública. Se diferenciará entre una concepción débil y otra fuerte de las mismas. La primera ve el contar historias como un recurso retórico entre otros muchos con el que los actores sociales crean sentido y se comunican, mientras que la segunda concibe las narraciones como necesarias para la comunicación y el debate sobre temas tales como la experiencia del tiempo, las identidades colectivas o la validez moral y ética de los valores. El corolario de esta idea es que las narraciones deben ser elementos esenciales de todo ideal de deliberación. En contra de las posturas recientes de un buen número de teóricos deliberativos, quienes tienden a adoptar una concepción débil de las narraciones, se argumentará la idoneidad de asumir una concepción fuerte de las mismas. La principal tesis de este trabajo es, por tanto, que las narraciones no solo tienen un papel legítimo en la deliberación, sino que resultan indispensables para formular determinados argumentos en primera instancia; por ejemplo, aquéllos que beben de la experiencia histórica. La idea de que las historias son constitutivas de determinados argumentos, en el sentido de que sin las mismas éstos no podrían ser formulados, se ilustrará poniendo de relieve el propio sustrato narrativo de la teoría deliberativa. Finalmente, se despejarán ciertas posibles objeciones a la concepción fuerte de las narraciones.
Tradicionalmente, se ha considerado que las pasiones eran algo que debía dejarse de lado en la deliberación sobre cuestiones políticas o sobre asuntos de justicia. Sharon Krause denuncia que esta ha sido la visión dominante en la historia del pensamiento político de Occidente. Su libro consiste en una réplica a esta tradición. La autora se suma así a un conjunto de pensadores que en los últimos años viene reivindicando la necesidad de incluir los afectos en la deliberación ética y política o, por decirlo de otro modo, recuperar la importancia de los sentimientos para la racionalidad práctica.
Many deliberation problems are multidimensional: the arguments for and against the proposed solutions appeal to values that belong to different dimensions. Thus, for instance, the arguments in favor of the proposal to negotiate to solve the problem of a domestic armed conflict may draw upon peace, whereas the arguments against it may invoke justice. This enables spokespeople to accept the premises of an argument without committing themselves to agreeing to its conclusion and justifying such an argument by emphasizing the premises of the opposing argument. "Yes, a negotiation would reduce the number of deaths caused by political violence, but it would also lead to impunity; therefore, we should not negotiate." If this situation were indomitable, the deliberation arguments could never be valid; they could never be such to the extent that the acceptance of the premises would force whoever accepts them to agree to the conclusions. In this paper, some of the answers to this problem are considered: the answers of Kock (2009), Govier (2010), and Olmos (2016) as well as the response of Macagno and Walton (2018). Furthermore, several issues found in these answers are pointed out, and in an attempt to provide a solution, a distinction is made between the cases wherein it is possible and those wherein it is impossible to overcome the problem of deliberation multidimensionality. ; Muchos problemas deliberativos son multidimensionales: los argumentos a favor y en contra de las soluciones propuestas apelan a valores que pertenecen a distintas dimensiones. Así, por ejemplo, los argumentos a favor de la propuesta de negociar para resolver el problema de un conflicto armado interno pueden apelar a la paz mientras que los argumentos en contra pueden apelar a la justicia. Esto hace posible que los interlocutores acepten las premisas de un argumento sin comprometerse con su conclusión y que lo justifiquen haciendo énfasis en las premisas del argumento contrario – "sí, una negociación reduciría el número de los muertos por violencia política, pero generaría impunidad, así que no debemos negociar"-. Si esta situación fuera insuperable, los argumentos en la deliberación nunca podrían ser válidos, nunca podrían ser tales que la aceptación de las premisas comprometiera a quien las acepta con las conclusiones. En este artículo considero algunas respuestas a este problema: las respuestas de C. Kock, T. Govier, P. Olmos y la respuesta de F. Macagno y D. Walton; señalo algunos problemas que encuentro en estas respuestas e intento resolverlos distinguiendo los casos en que es posible de los casos en los que no es posible superar el problema de la multidimensionalidad en la deliberación.
Suivant Ricoeur, pour l´exercice de la médecine ce qui se passe au chevet du malade n'est pas séparable de ce qui travaille la société, de l'évolution des moeurs, de la représentation par les individus de la santé, voire du bonheur, et de ce qu'ils peuvent demander aux médecins. Du côté des soignants, les possibilités techniques obligent à redéfinir le sens du soin, penser la proportionnalité des traitements et à réfléchir à la place de l'éthique. Le problème est de savoir comment articuler le droit et la morale. L'éthique de la discussion de Habermas séduit les médecins et ils parviennent, au deuxième niveau du jugement médical, à dégager des normes valides et universalisables. Mais au troisième niveau, la question est de savoir si cette éthique de la discussion est applicable au niveau politique, qui nous concerne tous. Parler des valeurs des patients, des normes des professionnels, des conflits et de la délibération publique invite à proposer une conception rénovée du sujet qui serve de fondement au politique, à penser la modification des instances délibératives et de la démocratie représentative et à répondre à la demande d'intelligibilité du public qui est mûr pour une autre démocratie.
This paper addresses the connection between rational justification and effectiveness of laws under the light of a theory of parliamentary argumentation. Within this framework, here the focus is on how problems concerning legal effectiveness are dealt with and what relevance they may have in legislators' discourse. The paper firstly considers the role of effectiveness in legislative rationality and discusses to what extent argumentation during and after the making of statutes may contribute to their steering or regulatory function (in this respect, the symbolic dimension of norms comes to the fore). Upon this basis, a model is outlined to analyze arguments on effectiveness within parliamentary deliberation about laws. In the last section, I will tentatively apply it to the legislative debates on the Spanish same-sex marriage act. ; Este trabajo aborda la relación entre justificación racional y eficacia de las leyes desde el punto de vista de una teoría de la argumentación parlamentaria. Dentro de este marco me centraré en la cuestión de cómo son tratados y qué relevancia tienen en el discurso de los legisladores los problemas relativos a la eficacia social del Derecho. Intento primero clarificar cuál es el papel de la eficacia en la racionalidad legislativa, para discutir luego, a propósito de la dimensión simbólica de las normas, en qué medida la argumentación durante (y después de) la formación de la ley condiciona su capacidad regulativa. Sobre esta base planteo un modelo para analizar los argumentos de eficacia en la discusión parlamentaria de las leyes y, a modo de ejemplo, lo aplico a los debates sobre la modificación del código civil español en materia de matrimonio.

Do citizens' perceptions and behaviors respond to the requirements formulated by deliberative democracy? This work analyses the magnitude and depth of the crisis of representative democracy, to, based on the keys that characterize this complex context, inquire about the proposals that scientific literature poses to combat this crisis. Among them, are set of approaches around deliberative democracy stand out, which involve moving from a conception of passive citizen, which is limited to casting the vote every four years, to an active citizen involved in the daily life of public affairs. Subsequently, the central objective of this paper is addressed: to identify the greater or lesser predisposition of Spanish citizens to develop the perceptions and required by a deliberative democracy. To do this, the Spanish citizenship is radiographed through an analysis of secondary data from the last CIS barometers. The results of the analysis show the existence of a fragmented citizenship that adopts heterogeneity of positions in the representation-deliberation continuum. ; ¿Responden las percepciones y comportamientos de la ciudadanía a los requisitos planteados por la democracia deliberativa? Este trabajo realiza un análisis de la magnitud y profundidad de la crisis de la democracia representativa, para, a partir de las claves que caracterizan este complejo contexto, indagar en las propuestas planteadas para combatir esta crisis. Entre ellas, destacan un conjunto de propuestas en torno a la democracia deliberativa, que suponen pasar de una concepción de ciudadano pasivo, que se limita a emitir el voto cada cuatro años, a un ciudadano activo que se implica en el discurrir cotidiano de los asuntos públicos. Posteriormente, se aborda el objeto central de este trabajo: identificar la mayor o menor predisposición de la ciudadanía española a desarrollar las percepciones y comportamientos que exige una democracia deliberativa. Para ello, se radiografía la ciudadanía española a través de un análisis de datos secundarios procedentes de los últimos barómetros del CIS. Los resultados del análisis evidencian la existencia de una ciudadanía fragmentada que adopta una heterogeneidad de posiciones en el contínuum representación-deliberación.
Talking shops have played a major role in social and democratic life of societies and, from that position, they have always faithfully portrayed the essence of every political period: the underlying issues, the forces in dispute, the longing for progress. This kind of informal but institutionalized conversation has survived changes over time and successfully adapted to the structural transformations of society. However, that adjustment has been accompanied by some important changes in the very nature of these gatherings —now usually talk shows— that are not very constructive. Throughout this article, we will address some of these elements and we will explore their relationship with the kind of citizenship they contribute to build. ; Las tertulias han jugado un papel central en la vida social y el desarrollo democrático de las sociedades y, desde esa centralidad, han construido un retrato bastante fiel del clima político de cada momento histórico: las cuestiones latentes de fondo, las distintas fuerzas en disputa, los anhelos de progreso. Este tipo de conversación informal, ya institucionalizada, ha sobrevivido a los cambios de época y ha sabido adaptarse a las transformaciones estructurales de las sociedades en las que se inserta; pero esa adaptación ha venido acompañada de cambios en la propia naturaleza de la tertulia que no siempre han jugado a su favor. En este artículo exploramos algunos de esos elementos y analizamos su relación con el tipo de ciudadanía que estas reuniones contribuyen a construir.
Contemporary democratic societies are characterized by two inescapable empirical phenomena: 1) The existence of deep, persistent and ineradicable political disagreements within each democratic society; 2) the need for political action courses common to all citizens (Waldron, 2005: 18). The aggregative democratic conception, receipted by most political constitutions, has shown some weaknesses to address this reality. In response, two rival democratic conceptions have emerged, namely: a) agonistic-pluralist; and b) deliberative-republican. This article aims to: 1) reconstruct the conceptual and normative assumptions of these two conceptions; 2) contrast them; and 3) outline arguments for a deliberative-republican democratic conception. The methodology used is the analytical political philosophy, namely: a) rational reconstruction of concepts; and b) reflective equilibrium. The present work aims to contribute to the ongoing debate about which is the best normative conception of democracy to adopt in non ideal contemporary normative conditions. ; Las sociedades democráticas contemporáneas se caracterizan por dos fenómenos empíricos ineludibles: 1) La existencia de profundos, persistentes e inerradicables desacuerdos políticos al interior de cada sociedad democrática; 2) la necesidad de adoptar cursos de acción política comunes a todos los ciudadanos (Waldron, 2005: 18). La concepción democrática agregacionista, receptada por la mayoría de las constituciones políticas, ha mostrado ciertas deficiencias para atender a esta realidad. En respuesta, han surgido dos concepciones democráticas rivales, a saber: a) agonal-pluralista; y b) deliberativa-republicana. Este artículo tendrá por objetivos: 1) reconstruir los presupuestos conceptuales y normativos de estas dos concepciones; 2) contrastarlas; y 3) esbozar argumentos en defensa de una concepción democrática deliberativa-republicana. Para ello, la metodología a emplear será la de la filosofía política analítica, a saber: a) la reconstrucción racional de conceptos; y b) el equilibrio reflexivo. El presente trabajo pretende contribuir al debate actual acerca de cuál es la mejor concepción normativa de democracia a adoptar en las condiciones normativas no ideales contemporáneas.
