The research is aimed to explore the role, impact and importance of emotional intelligence in the law and concerned social relations. The article defines emotional intelligence as an ability of people to recognize, name, control and understand their own emotions and the emotional condition of other people, using emotional skills to achieve some goals. This research paper argues that a high level of emotional intelligence in each member of the legal relationship is important for the law in order to become the law in action. The study gives some examples of positive and negative impact of emotional intelligence on law. The accent is made on public sphere oflaw, especially in criminal and constitutional relationships, for example the role and impact of low-level emotional intelligence on the commitment of crimes, execution of public duties by representatives of the government etc. The attention is also paid to the importance of emotional intelligence on democracy and the impact on the deliberative possibilities of democracy. This work outlines the possible future implementation of the evaluation of emotional intelligence in legal order, for example in criminal, civil, labour law. The evaluation of emotional intelligence can be used in sentencing, remission from the punishment during the amnesty or oblivion, the author proposes to organize special courses that are aimed to raise the emotional intelligence of the perpetrators. In the end the author describes the ways of future development of the researched question, gives some ideas about empirical researches of the level of emotional intelligence among lawyers in order to find correlation between the level of emotional intelligence and the professional success. Also, there is a proposal to create special educational courses for the students in law in Ukraine that will help them to improve their emotional intelligence and subsequently can lead to better communication between people and lawyers. ; У статті розглянуто поняття, особливості, роль та вплив емоційного інтелекту в різних проявах права та правовідносин. O estudo teve como objetivo compreender de forma crítica como se caracteriza a gestão participativa no campus Serra do Ifes, a partir do entendimento e do processo interativo dos servidores Técnico-administrativos (TAEs) das classes C, D e E, e das chefias imediatas. Para tanto, a Teoria da Ação Comunicativa (TAC) de Jürgen Habermas, bem como sua proposta de democracia deliberativa foram empreendidas como marco teórico para compreensão desse processo e os conceitos norteadores da TAC (atos de fala, mundo da vida, sistema, colonização do mundo da vida, esfera pública, ação comunicativa e instrumental ou estratégica) foram empregados como elementos de análise das estruturas relevantes identificadas na pesquisa. Esse trabalho caracteriza-se como uma pesquisa de abordagem qualitativa e possui um enfoque crítico com visão dialética da realidade social. A análise foi realizada considerando o duplo efeito que a prática da gestão participativa pode significar: como comprometimento com o desempenho e reforço do sistema capitalista; e como resistência dos trabalhadores organizados às formas de dominação e controle. Os dados empíricos foram produzidos por meio de pesquisa documental, observação participante e entrevista semiestruturada. Foram entrevistados oito TAEs subordinados e 13 chefias imediatas, selecionados conforme o critério da bola de neve. Utilizou-se a análise de conteúdo para o tratamento das informações obtidas nas entrevistas. Os resultados apontam para a construção de ações participativas de cunho instrumental, estabelecidas a partir dos interesses da gestão, de grupos específicos e individuais. Sendo assim, a prática da gestão participativa caracteriza-se como um espaço estratégico para alcance do êxito e não do entendimento, onde os TAEs são corresponsáveis no processo de manutenção e construção dos fenômenos que emperram o desenvolvimento de uma participação democrática. ; This study aimed to understand, critically, as is characterized the participative management on IFES – Campus Serra, from the understanding and the interactive process of the administrative technicians staff (TAEs) classes C, D and E and immediate supervisors. Thus, Jürgen Habermas's Communicative Action Theory (CAT), as well as its proposal for democracy deliberative, were undertaken as a theoretical framework for understanding this process, and the guiding concepts of CAT (speech acts, the life-world, system, colonization of the lifeworld, public sphere, communicative action and instrumental or strategic) were employed as elements of analysis of the relevant structures identified in the survey. This work is characterized as a qualitative research and has a critical approach with dialectical view of social reality. The analysis was conducted considering the dual effect that the practice of participative management may mean: how commitment to performance and strengthening the capitalist system; and how the resistance of organized workers to the forms of domination and control. Empirical data were produced by desk research, participant observation and semi-structured interviews. Were interviewed eight TAEs and 13 immediate supervisors that were selected according to the criteria of the snowball. The content analysis was used for the treatment of interview. The results point to the construction of participatory actions of instrumental nature, established based on the interests of the management of specific and individual groups. Thus, the practice of participative management is characterized as a strategic space to reach the success and not the understanding, where the TAEs share the responsibility in the process of maintenance and construction of the phenomena that hamper the development of democratic participation.
Neste artigo são analisadas duas situações de integração no campo político. As situações foram identificadas, por meio de pesquisa qualitativa, em Territórios Quilombolas e em Reservas Extrativistas Marinhas situados no Pará. Uma corresponde a instrumento jurídico constitucional para reparar injustiças históricas, mobilizador de identidade específica em ação para interferir no poder local no município de Salvaterra (Ilha do Marajó). O caráter identitário dos pleitos e a inexistência de espaços públicos para negociá-los, reduz a possibilidade de alcance de direitos sociais. A segunda forma, a Resex – instrumento de política pública relacionado à mobilização mais social do que identitária – referida no reconhecimento das populações tradicionais e seus saberes-fazeres adequados às exigências ambientais. Ferramentas, como o Conselho Deliberativo, em determinadas circunstâncias, constituem espaços favoráveis a inovações no modo de vida, na produção econômica, no engajamento dos atores locais na ação coletiva, renovando-se assim a democracia local em um contexto de ambientalização.Palavras-chaves: Campo político. Ambientalização INTEGRATION PATHWAYS FOR SOCIAL MOBILIZATION IN THE POLITICAL ARENAThis article analyzes two situations of integration in the political arena. The situations were identified through qualitative research in Quilombola Territories and in Marine Extractive Reserves in the State of Pará. One situation corresponds to the constitutional judicial instrument for reparation of historical injustices, mobilizing of specific identities in mobilization to interfere in the local government of the Municipality of Salvaterra (Marajó Archipelago). The identity character of the claims and the inexistence of public spaces to negotiate them reduce the likelihood of achieving social rights. The other, known as Resex (extractive reserve) – instrument of public policy related more to social than to an identity mobilization instrument – referred in the recognition of traditional populations and their adequate knowhow in relation to environmental demands. Tools such as the Deliberative Council, under certain circumstances provide favorable spaces for innovation in livelihood, economic production, involvement of local players in collective action, consequently renewing local democracy within an environmental context.,Keywords: Political arena. Le caractère identitaire des revendications et l'absence d'espaces publics pour les négocier réduisent les possibilités de faire valoir les droits sociaux des communautés. La seconde situation, la Resex – un instrument de politique publique à l'origine d'une mobilisation plus sociale qu'identitaire – privilégie la reconnaissance des populations traditionnelles et de leurs savoir-faire susceptibles de satisfaire les exigences environnementales. Les outils que la Resex mobilise, comme le Conseil Délibératif, contribuent, selon les circonstances, à favoriser des innovations tant en matière de modes de vie et de production économique qu'en matière d'engagement des acteurs locaux dans des actions collectives, contribuant ainsi à la rénovation de la démocratie locale dans un contexte d'ambientalização.Mots-clés: Champ politique. [ES] sta tesis se ubica dentro de las investigaciones sobre aprendizaje ciudadano desarrolladas por el grupo INTER (investigación en educación intercultural) de la Universidad Nacional de Educación a Distancia (UNED) y tiene como finalidad "formular propuestas educativas para el aprendizaje de la ciudadanía activa desde un enfoque intercultural". Partiendo de la premisa de que los espacios ciudadanos son lugares privilegiado de aprendizaje de la práctica ciudadana, la investigación trata de responder a la cuestión; "¿cómo las personas que tienen una práctica ciudadana critica, participativa y transformadora aprenden y enseñan a ejercer dicha práctica?" El marco teórico profundiza y relaciona tres elementos: 1) El "enfoque intercultural" que se configura como una visión compleja del mundo al reconocer su diversidad y dinamismo. La realidad es compleja porque se construye y reconstruye mediante la relación y comunicación de individuos que son a su vez diversos y cambiantes. Por ello el enfoque intercultural se constituye como una praxis, y un proyecto ético-político crítico y transformador comprometido con la equidad, la justicia social y la emancipación. 2) Desde aquí la "participación ciudadana" es la metodología propia del enfoque intercultural, pues garantiza que la transformación social que se persigue sea realizada desde el mayor número de grupos e individuos involucrados, desde el reconocimiento de la diversidad de conocimientos e intereses en el diseño, ejecución y control de su praxis coherente con los principios de equidad y justicia social, es decir, desde unos principios democráticos. Además la "participación ciudadana" se concreta a través los distintos enfoques teórico-normativos y los modelos de democracia que les son afines concluyendo que son los modelos de democracia deliberativa, participativa y radical los que pueden ser coherentes con el enfoque intercultural. 3) Por último se relaciona "la educación y la participación ciudadana" pues se defiende que los espacios de participación ciudadana son los lugares privilegiados para aprender ciudadanía puesto que se aprende a participar participando. Esta idea implica que la ciudadanía es una praxis colectiva, y por tanto la propia practica ciudadana produce significados y conocimientos sobre la misma democracia y su propia práctica. Implica así mismo, que para mejorar los aprendizajes ciudadanos hay que mejorar la propia democracia, pues es su ejercicio el que produce dichos aprendizajes. A nivel metodológico se utiliza un acercamiento etnográfico por ser coherente con el enfoque intercultural y la más adecuada para responder a las preguntas de investigación. Realizándose observación participante durante más de un año en tres espacios ciudadanos autónomos de la ciudad de Madrid, más un espacio institucional que sirve de "contraste". Además se han realizado 29 entrevistas en profundidad a informantes clave buscando la mayor diversidad posible (edad, género, posición grupal y formas de participación). Entre las conclusiones más relevantes de la tesis se encuentra la construcción de un modelo sobre el ejercicio y aprendizaje de la práctica ciudadana que combina, de forma compleja, los elementos crítico, participativo y transformador de la práctica ciudadana a través de su praxis (práctica reflexiva). La cual se desarrolla dentro de un marco axiológico y epistémico que deriva de la cosmovisión o visión del mundo de las personas integrantes de estos espacio. Esta visión asume la complejidad del mundo y la valora positivamente. El mundo social es complejo porque es diverso, cambiante y relacional estas ideas constituyen la línea base sobre las que se produce la praxis ciudadana crítica, participativa y transformadora. Además se formulan propuestas educativas organizadas en tres apartados: a) las propuestas educativas para profesionales de la educación; b) las propuestas pensadas para mejorar la acción educativa de los propios espacios ciudadanos; y c) ideas para la formación de profesionales de la educación. [EN] This thesis is located within the research on citizen learning developed by the INTER (research group in intercultural education) of the National University of Distance Education (UNED) and aims to "formulate educational proposals for the learning of active citizenship from an intercultural approach ". Starting from the premise that citizen spaces are privileged places for learning about citizen practice, the research tries to answer the question; "How do people who have a critical, participative and transformative citizen practice learn and teach how to exercise this practice?" The theoretical framework deepens and connects three elements: 1) The "intercultural approach" is configured as a complex view of the world by recognizing its diversity and dynamism. So reality is complex because it is constructed and reconstructed through the relationship and communication of individuals who are in turn diverse and changing. Therefore, the intercultural approach is constituted as a praxis, and a critical and transformative ethical-political project committed to equity, social justice and emancipation. 2) From here the "citizen participation" is the methodology of the intercultural approach, to ensure that the social transformation involves the largest number of groups and individuals, as well as recognizes the diversity of knowledge and interests in the design, execution and control of their praxis developed from democratic principles. In addition, "citizen participation" is connected throughtive approaches and the models of democracy, concluding that the models of deliberative, participatory and radical democracy could be coherent with the intercultural approach. 3) Finally, "education and citizen participation" are related, understanding that spaces for citizen participation are privileged places to learn citizenship because people learn to participate by doing it. This idea assumes that citizenship is a collective practice therefore the practice itself produces meanings and knowledge about democracy and its own practice. It also implies that in order to improve citizenship learning, one must improve democracy itself, since it is their exercise that produces such learning. At the methodological level an ethnographic perspective is used because it is coherent with the intercultural approach and the most appropriate to answer the research questions. It has been made participant observation for more than one year in three grassroots citizen spaces of the city of Madrid, plus an institutional space that used as "contrast". In addition, 29 interviews were conducted with key informants. it was looking for the greatest possible diversity (age, gender, group position and forms of participation). Among the most relevant conclusions of the thesis is the construction of a model on the exercise and learning of civic practice that relates, in a complex way, the critical, participative and transforming elements of citizen practice through its praxis (reflective practice), which is developed within an axiological and epistemic framework that is related from the worldview of the people who make up these spaces. This worldview assumes the complexity of the world and values it positively. The social world is complex because it is diverse, changing and relational. These ideas constitute the baseline on which critical, participatoive and transformative citizen praxis is produced. In addition, educational proposals organized in three sections: a) educational proposals for education professionals; b) proposals to improve the educational action of the citizen spaces themselves; and c) proposals for the training of education professionals.
El trabajo aquí propuesto aborda la revocatoria del mandato inicialmente desde la perspectiva histórico-evolutiva desde la democracia participativa y de forma específica en cuanto al ejercicio del control político de los ciudadanos como quiera que se constituye en un mecanismo inclusivo que es necesario validar en su efectividad práctica frente a la regularización y accionar que pueda existir por parte de los entes estatales encargados de estructurar y controlar su ejercicio. Se busca además, dilucidar algunas dudas y ambivalencias que de acuerdo a la lectura de los estudios que en la materia han realizado otros investigadores, interpretando de su análisis, que se presentan en gran parte de los casos, a la hora de convocar las revocatorias por parte de los comités promotores, y así tener un análisis empírico que acerque un poco más a conocer el porqué de que las revocatorias no hayan prosperado en el país, más allá de los resultados electorales obtenidos. Aunado a lo anterior, es de resaltar inicialmente, que puntualmente no existen investigaciones sobre procesos revocatorios en municipalidades pequeñas, donde los procesos revocatorios hayan logrado llegar hasta la elección, como tampoco estudios sobre los comités promotores, su caracterización, miembros, su activación y papel dentro de los procesos revocatorios. De esta manera, se podrá tener una visión objetiva cuyos resultados conlleven a la apropiación de dicho mecanismo de control e inclusión ciudadanos en los procesos de desarrollo de una eficiente democracia participativa y a la vez deliberativa. Así, bajo tales presupuestos, este trabajo monográfico se enfoca básicamente dentro de un procedimiento metodológico de estudio de caso que se delimita al análisis de procesos revocatorios representativos que se han invocado en los municipios de Iza (Boyacá) y Líbano (Tolima). Lo anterior, en razón a que son estos dos municipios colombianos en los que se observan diferencias tanto de procedimientos como de causalidades invocadas por los comités promotores y que por tanto ofrecen distintas perspectivas de abordaje del análisis acerca de la efectividad de los resultados esperados por quienes han adelantado tales procedimientos. Además, se toma en consideración que fue precisamente el municipio de Iza, el primer caso en donde se promovió el referendo revocatorio en Colombia, de acuerdo con lo establecido inicialmente por la Ley 134 de 1994, y en el que prácticamente se dio comienzo a su implementación. Por otra parte, a que en la municipalidad de Líbano se aplicaron las reformas legislativas dispuestas en la Ley 741 de 2002 acerca de dicho mecanismo. Igualmente, se ha escogido estos dos municipios por la divergencia que presentan las convocatorias de referendo revocatorio, pues en el primer municipio, Iza, fue promovido por grupos copartidarios del mandatario local (quienes le acompañaron en campaña) y en la segunda localidad, Líbano, el comité promotor, hacia parte en su columna vertebral, del grupo opositor a quien había sido elegido como alcalde. En ambos casos, los ciudadanos acudieron a las urnas para decidir la permanencia o no de los mandatarios. Así mismo, la escogencia de estos dos lugares, fue determinada por pertenecer a contextos geográficos de carácter rural, donde al parecer es mayor el número de Municipios en el que sus ciudadanos invocan esta figura, pero donde eventualmente es más incierto el adelanto de la revocatoria que en ámbitos de carácter urbano o de las grandes ciudades donde hay mayores intereses políticos y económicos. En consecuencia, tomando en cuenta las anteriores consideraciones, surge la pegunta sobre, ¿cuál es el papel que cumple los comités promotores y cuáles son sus incentivos e intereses?, cuya comprensión y explicación se tratan de concretar teniendo como objetivo general caracterizar los comités promotores de referendos revocatorios, a partir de la experiencia de los municipios de Iza en el departamento de Boyacá y de Líbano, en el departamento de Tolima. Este objetivo se espera cumplir teniendo como objetivos específicos: Identificar las implicaciones prácticas en los casos objeto de estudio, en la revocatoria del mandato como mecanismo de control político. Para ello, se hace un breve esbozo histórico de los alcances de la participación ciudadana frente a las dimensiones que adquieren la democracia representativa y deliberativa hasta culminar en los casos particulares. Otro de los objetivos propuestos consiste en identificar la normatividad y jurisprudencia que regulan la revocatoria del mandato en Colombia y describir los procedimientos en los que se amparan los comités promotores de la revocatoria del mandato, a nivel subnacional. Asimismo, como objetivo específico, se busca hacer un análisis que determine en casos analizados, si se realizó una verdadera Inclusión de los ciudadanos, teniendo en cuenta que ese fue la motivación del Constituyente en la carta política y posteriormente del Legislador en su desarrollo legal. Como cuarto objetivo específico se ha definido analizar la dinámica interna de la convocatoria previa a la elección de la revocatoria del mandato y los incentivos generados para ello, en los municipios de Iza (Boyacá), Líbano (Tolima), señalando su pertinencia dentro de la juridicidad y jurisprudencia de Colombia. ; The proposed work addresses the revocation of the mandate initially perspective historico-evolutiva from participatory democracy and specifically with regard to the exercise of political control of citizens as it is in a inclusive mechanism that is necessary to validate in its practical effectiveness against the regularization and actions that it can occur by the State bodies responsible for structuring and control its exercise. Taking into account the above considerations, therefore, arises the question above, what is the role that meet promoters committees and what are their incentives and interests?, whose understanding and explanation are treated to realize with the general aim characterize promoters committees revocatorios referendums, based on the experience of the municipalities of Iza in the Department of Boyacá and Lebanon, in the Department of Tolima. This goal is expected to comply with the specific objectives: identify the practical implications in the cases under study, in the revocation of the mandate as a mechanism for political control. To do so, is a brief historical outline of the scope of the participation front dimensions acquired democracy representative and deliberative culminating in particular cases. Another of its objectives is to identify regulations and jurisprudence governing the revocation of the mandate in Colombia and describe the procedures that will protect promoters committees of the revocation of the mandate at the subnational level. Lukijoiden osallistuminen journalismin tekemiseen on ollut viime vuosien nouseva trendi sanomalehdissä. Yleisön kommentteja, kuvia ja vinkkejä pyydetään ja hyödynnetään toimituksissa yhä enemmän. Making News with Citizens -tutkimuksessa tarkastellaan, millaista lukijoiden osallistuminen sanomalehtijournalismiin on ollut vuosituhannen alussa ja kuinka siitä voisi jatkossa tehdä entistä mielekkäämpää. Yleisön osallistumista käsitellään kansalaisjournalismin ajatuksen kautta. Kansalaisjournalismilla tarkoitetaan sellaista ammattimaisesti tehtyä journalismia, jossa toimittajat tekevät juttuja yhteistyössä kansalaisten kanssa. Idean taustalla on demokratiaa tukeva ajatusmalli: osallistumalla journalismin tekemiseen ihmiset voivat tulla tietoisemmiksi omista vaikutusmahdollisuuksistaan ja tuoda julkiseen keskusteluun tavallisten ihmisten kokemuksia. Tutkimuksen kohteena on kolme erikokoista sanomalehteä: Helsingin Sanomat (valtakunnallinen), Aamulehti (maakunnallinen) ja Itä-Häme (paikallinen). Tutkimuksessa tarkastellaan näissä lehdissä tehtyjä kansalaisjournalistisia hankkeita toimittajahaastatteluiden ja lehtijuttujen avulla. Aineisto on analysoitu laadullisen tutkimuksen menetelmin. Väitöskirjan teoreettisessa osassa määritellään kansalaisjournalismin käsitettä ja sen suhdetta professionaaliseen journalismiin sekä julkisuusteorioihin. Tutkimuksen aineisto-osassa puolestaan tyypitellään lehtien erilaisia jutuntekokäytäntöjä ja osallistavia juttuelementtejä sekä analysoidaan, millaiseksi muutokseksi toimittajat ovat kokeneet kansalaisjournalismin omassa työssään. Helsingin Sanomissa on tehty lyhytkestoisia vaaliprojekteja, joissa lehtijutut ovat pohjautuneet äänestäjien näkemyksiin ja kysymyksiin. Toimittajien mukaan kansalaisjournalismi näyttäytyi kevyehkönä muistutuksena siitä, miten journalismista voisi tehdä lukijoille ymmärrettävämpää. Aamulehdessä kansalaisjournalismin ajatusta on sovellettu erilaisissa keskusteluun pohjautuvissa juttusarjoissa ja -formaateissa, ja toimittajien mukaan kansalaisjournalismi vaatii koko toimitukselta henkistä suunnanmuutosta. Heinolalaisessa Itä-Hämeessä on toiminut erityinen kansalaistoimittaja, joka on ollut vastuussa lehden kansalaisjutuista . Itä-Hämeessä kansalaisjournalismiin suhtauduttiin käytännöllisenä työtapojen muutoksena. Väitöskirjan keskeinen tulos on, että kansalaisjournalismia on perusteltu demokraattisesta näkökulmasta mutta myös taloudellisin syin. Hankkeet ovat tuottaneet toimituksissa sellaisen ilmapiirin, jossa tavalliset ihmiset on otettu osallistujina tosissaan, vaikka yhteistyö ei aina ole ollut ongelmatonta. Kokemukset kansalaisjournalismista voivat siksi myös auttaa toimittajia suhtautumaan teknologian mukanaan tuomaan muutokseen eli jatkuvasti lisääntyvään vuorovaikutteisuuteen. ; Participation has become a central notion in journalism. The trend has been intensified due to the possibilities of online interaction, but collaboration with citizens has been part of journalism practices for quite some time, for example in public journalism initiatives. Public journalism is an American-based journalistic reform movement and an idea which aims at connecting the media more closely with its readers, and readers with public life. "Making News with Citizens" scrutinizes public journalism in a way that deconstructs both parts of the concept: "public" and "journalism". Therefore, it draws from theories of the public sphere and professionalism. This dissertation discusses practices of public journalism in three Finnish newspapers: Helsingin Sanomat (national), Aamulehti (regional) and Itä-Häme (local). The overall research task is: What is public journalism, how and why has it been applied and interpreted in three Finnish newspapers, and what kind of professional reflections by journalists have these approaches elicited? Qualitative content analysis of news stories and journalists' interviews has been utilized as a method of analysis. The results indicate that public journalism has invoked journalists in all the three newspapers to reflect on a variety of practices that range from newsroom management to concrete modes of journalistic work and from organization and execution of public events to participation of citizens in the journalistic process. The approach has been seen either as a reminder of what is good journalism, as a mental change or as a practical change for professional journalism. This research suggests that demanding and truly deliberative forms of journalism are quite unlikely to be assumed in everyday news work embedded in competitive media environment. However, various participatory methods are and will be utilized and developed independently in the newsrooms. Public journalism has been appropriated to the mainstream newspapers in a way that addresses both the normative and the economic foundations of journalism. It does not radically challenge the professional self-understanding of journalists, but provides such an input to the newsroom cultures that makes it possible for journalists to consider their profession as an interactive and collaborative territory and see citizens as capable public actors and participants in making news. The research contributes to our knowledge of public journalism in the Finnish national context but also comparatively to international forms of democracy-supporting journalism. The conclusions point towards participatory elements that might persist and evolve in the online environment.
Carl Schmitt je jedan od najposvećenijih protivnika liberalnog univerzalizma sa svojim pojmom pluralističke, racionalne i uključive konsenzualne politike kao progresivnog demokratskog projekta i svojeg razumijevanja političke arene kao pročišćene, od sukoba slobodne, i na taj način progresivne kretnje demokratske logike. U ovom radu nastojat ću pokazati Schmittove pesimističke i negativne stavove, zasnovane na ontološkim i teološkim temeljima, o deliberativnom modelu politike koja tvrdi da partikularna volja može doći do koncepta zajedničkog javnog interesa ili zajedničkog dobra kroz raspravu i dijalog. Nadalje, pokušat ću pokazati da unutar Schmittovog projekta koncept diktature suverena postoji kao nužni kontrapunkt pojmu politič- kog. Schmitt odbija razumijevati politički život kao medij dijalog koji vodi razumskom konsenzusu. U ovom kontekstu, suveren iz Schmittove teorije mora se razumijevati upravo kao sila napravljena da proizvodi homogenost kroz hegemoniju. Hegemonija, u Gramscijevom smislu, nije gola opresivna sila. Namjesto toga, odnosi se na vladajuću silu sposobnu upisati vlastitu ideologiju i pogled na svijet u javnost kroz uvjeravanje. U tom okviru, ljevičarski mislitelji poput Mouffea, koji preporuča da moramo misliti »sa Schmittom protiv Schmitta« kako bismo razvili novo demokratsko političko razumijevanje, svraćaju pozornost na Schmittovu tezu da je svaki politički identitet u funkciju »mi–oni« antinomije, ali im promiče činjenica da je nemoguće deducirati koncept zbiljski demokratske javne sfere iz Schmittove teorije. Kao što će biti naglašenu u radu, demokracija u Schmittovom smislu može biti savršena forma suverenosti, takva kakva usuprot liberalnoj demokraciji rezultira homogenizacijom i isključenjem heterogenosti, te na taj način mora biti začeta kao fundamentalno hegemonijski sistem. Schmittov ideal demokracije zahtijeva da politički identiteti, javno mišljenje, javna sfera i formiranje volje vudu rezultati suverenove volje i bez prostora za raspravu. ; Carl Schmitt is one of the most dedicated opponents of liberal universalism, with its notion of pluralist, rational and non-exclusivist consensus politics as a progressive democratic project and its understanding of the political arena – "purified", being free from struggles and conflict – as the progressive move of democratic logic. In this paper I will first try to show Schmitt's pessimistic and negative stance based on ontological and theological grounds on the deliberative model of politics with its claim about the possibility of making particular wills reach the conception of common public interest or the common good through discussion and dialogue. Secondly, I'll try to show that, within Schmitt's project, the concept of the sovereign dictatorship exists as the necessary counterpoint to the concept of the political. Schmitt refuses to understand political life as a medium of dialogue leading to a rational consensus. In this context, the sovereign in Schmitt's theory should be precisely understood as a force constructed to reproduce homogeneity in a hegemonic manner. Hegemonia, in a Gramscian sense, is not a bare oppressive force. Rather, it refers to a ruling force which is able to inject its own ideology and world view into the public through persuasion. In this framework, leftist thinkers like mouffe, who recommended that we should think "with Schmitt against Schmitt" in order to develop a new democratic political understanding, draw attention to Schmitt's thesis that every political identity functions as "we-they" antinomy, yet they miss the fact that it is impossible to deduce a conception of a truly democratic public sphere from Schmitt's theory. As it will be emphasized in this paper, democracy in the Schmittian sense can be the perfect form of sovereignty, one which in contrast to liberal democracy results in homogenization and the exclusion of the heterogeneous and thus must be conceived as a fundamentally hegemonic system. The Schmittian ideal of democracy requires that political identities, public opinion, public sphere and will formation are the products of a sovereign will and not of open and free discussion. ; Carl Schmitt est l'un des opposants les plus puissants de l'universalisme libérale de par sa notion de consensus politique pluraliste, rationnel et non exclusiviste en tant que projet démocratique progressiste, mais aussi de par sa compréhension de l'arène politique - « purifiée », libre de toutes luttes et de tout conflit – en tant que mouvement progressiste de la logique dé- mocratique. Dans cet article, je vais en premier lieu tenter de montrer l'opinion pessimiste et négative de Schmitt – basée sur des fondements ontologiques et théologiques – concernant le modèle délibératif de la politique et sa prétention à penser que la formation de volontés particulières pourrait toucher l'intérêt public commun ou le bien commun à travers la discussion et le dialogue. En second lieu, je vais tenter de montrer qu'à l'intérieur du projet de Schmitt le concept de dictature souveraine existe comme contrepartie nécessaire au concept du politique. Schmitt refuse de penser la vie politique comme instrument de dialogue menant au consensus rationnel. Ainsi, le souverain dans la théorie de Schmitt doit précisément être compris comme une force construite pour reproduire une telle homogénéité de manière hégémonique. Hegemonia, au sens gramscien, n'est pas une simple force oppressive ; il s'agit plutôt d'un terme qui se réfère à une force dirigeante capable d'injecter sa propre idéologie et vision du monde dans le domaine public à travers la persuasion. Dans ce contexte, certains penseurs de gauche telle que mouffe qui nous recommande de penser « avec, et contre, Schmitt » dans le but de développer une nouvelle compréhension de la politique démocratique, attirent notre attention sur la thèse de Schmitt où chaque identité politique fonctionne par l'antinomie « nous/eux ». Toutefois, ces penseurs passent à côté du fait qu'il est impossible de déduire une conception de réelle sphère publique démocratique sur la base de la théorie de Schmitt. Comme cet article le souligne bien, la démocratie au sens schmittien peut être la forme parfaite de souveraineté, une forme qui – en contraste avec la démocratie libérale – aboutit à une homogénéisation en excluant l'hétérogé- néité, et ainsi doit être conçue comme un système fondamentalement hégémonique. In diesem Beitrag werde ich zunächst versuchen, Schmitts pessimistische, negative und auf ontologischer und theologischer Grundlage ruhende Haltung zum Beratungsmodell der Politik darzulegen, mit dessen Behauptung über die möglichkeit, partikulare Willen zu veranlassen, durch Diskussion und Dialog die Konzeption des gemeinschaftlichen öffentlichen Interesses oder Gemeinwohls zu erreichen. Zweitens werde ich versuchen zu zeigen, dass im Rahmen des schmittschen Projekts der Begriff der souveränen Diktatur als notwendiger Kontrapunkt zum Begriff des Politischen existiert. Schmitt weigert sich, das politische Leben als ein medium des Dialogs zu begreifen, das zu einem rationalen Konsens führt. In diesem Zusammenhang soll das Souveräne in der schmittschen Theorie eben als eine Gewalt aufgefasst werden, die konstruiert ist, um eine solche Homogenität in einer hegemonialen Art zu reproduzieren. Die hegemonia im gramscischen Sinne ist nicht eine bloß repressive Kraft; vielmehr bezieht sie sich auf eine herrschende Kraft, die imstande ist, durch Überzeugungsvermögen ihre eigene Ideologie und Weltanschauung in die Öffentlichkeit zu injizieren. This HDR research paper aims at reconsidering the notion of "rural" in the light of the recent contributions of the spatial justice theory. One shall consider how such a category can make social inequalities embed into space, or even reproduce injustice against some of the inhabitants of the countryside.According to a systemic model, the analysis scrutinizes the meanings of "rural" after several of its dimensions: into academic, statistical and teaching discourses; into norms that rule local finances and the ongoing process of territorial reform; and into the practices of territorial planning, farming, leisure and nature conservation. Those three intersected levels - discourses, norms and practices - make appear a very efficient rural "dispositive", in the sense of Foucault, which is able to produce different faces of oppression and a political heteronomy against rural populations and stakeholders.However, spatial justice is also a moral project seeking the reduction of the above stated injustices. Against the Weberian model, which isolates science from politics – but keeping a the same time the formal requirements in the construction of the scientific discourse – this research opens up to an applicative field and suggests some interventions on the spatial levers of injustice. By doing so, we try to validate a deliberative approach of the scientific work where the scientific fact cannot be distinguished from its moral value anymore, as soon as it helps extending the scope of democracy in a more equitable way. ; La notion de ruralité, longtemps centrale dans les démarches d'analyse de la géographie, a été largement remise en question par les sciences sociales depuis plus d'un demi-siècle : il est devenu difficile, sinon suspect, d'assigner un contenu propre à cette catégorie d'espace et à ses populations. Les dangers du spatialisme, mais aussi la naturalisation fréquente des faits sociaux relatifs aux espaces ruraux ont déjà été largement démontrés. Poursuivant une telle approche critique, le présent travail d'habilitation à diriger des recherches se propose cependant de décentrer légèrement l'analyse en revisitant une fois de plus la notion, mais cette fois-ci à la lumière des apports récents de la théorie de la justice spatiale.À la suite d'un parcours de recherche positionné à l'interface entre géographie sociale, géographie rurale et géographie de l'environnement, avec l'étude de nombreuses formes de conflictualité et d'inscription spatiale des logiques de pouvoir dans les campagnes, il est en effet apparu clairement en quoi la catégorie de « rural » pouvait servir de support à l'imposition de formes d'inégalités sociales dans l'espace, voire à la reproduction d'injustices s'exerçant à l'encontre des catégories sociales les plus vulnérables parmi les habitantes et les habitants des campagnes.Pour mener à bien une telle démonstration, on propose dans le volume inédit de ce mémoire la construction d'un modèle d'analyse systémique qui questionne le potentiel effet discriminant associé à la catégorie de « rural » dans plusieurs de ses dimensions : dans les discours produits par la sphère scientifique, les institutions statistiques et le système scolaire ; dans les normes qui régissent les finances locales, mais aussi le processus en cours de réforme territoriale ; et dans les pratiques relatives à l'agriculture, à l'urbanisme, aux loisirs de nature et à la protection de l'environnement. Ces trois niveaux d'analyse intersectés – discours, normes et pratiques – permettent d'identifier un « dispositif » foucaldien de ruralité particulièrement efficace qui favorise, indirectement, des formes préalables d'oppression. On identifie ainsi une marginalisation, voire une hétéronomie politique des espaces ruraux par l'entretien de stéréotypes de lieux. S'y ajoutent des procédures inégalitaires dans la distribution des ressources ainsi qu'une violence symbolique ressentie par l'imposition de normes localement mal acceptées, selon les critères d'évaluation d'Iris Marion Young.La justice spatiale n'est cependant pas seulement une démarche critique, mais aussi un projet moral tendant vers la réduction éventuelle des injustices observées. Réfutant ainsi le modèle wébérien de cloisonnement entre la science et le politique – sans pour autant rompre avec les exigences formelles de construction du discours scientifique – le présent travail s'ouvre volontairement à des propositions applicatives de réduction des inégalités en suivant les principes formels de Rawls. Ce faisant, il cherche à valider au final une conception délibérative du travail scientifique, à la manière de Latour, où le fait scientifique ne peut plus être distinct de sa valeur morale dès lors qu'il concourt à une extension équitable du domaine de la démocratie.

Poursuivant une telle approche critique, le présent travail d'habilitation à diriger des recherches se propose cependant de décentrer légèrement l'analyse en revisitant une fois de plus la notion, mais cette fois-ci à la lumière des apports récents de la théorie de la justice spatiale.À la suite d'un parcours de recherche positionné à l'interface entre géographie sociale, géographie rurale et géographie de l'environnement, avec l'étude de nombreuses formes de conflictualité et d'inscription spatiale des logiques de pouvoir dans les campagnes, il est en effet apparu clairement en quoi la catégorie de « rural » pouvait servir de support à l'imposition de formes d'inégalités sociales dans l'espace, voire à la reproduction d'injustices s'exerçant à l'encontre des catégories sociales les plus vulnérables parmi les habitantes et les habitants des campagnes.Pour mener à bien une telle démonstration, on propose dans le volume inédit de ce mémoire la construction d'un modèle d'analyse systémique qui questionne le potentiel effet discriminant associé à la catégorie de « rural » dans plusieurs de ses dimensions : dans les discours produits par la sphère scientifique, les institutions statistiques et le système scolaire ; dans les normes qui régissent les finances locales, mais aussi le processus en cours de réforme territoriale ; et dans les pratiques relatives à l'agriculture, à l'urbanisme, aux loisirs de nature et à la protection de l'environnement. Ces trois niveaux d'analyse intersectés – discours, normes et pratiques – permettent d'identifier un « dispositif » foucaldien de ruralité particulièrement efficace qui favorise, indirectement, des formes préalables d'oppression. On identifie ainsi une marginalisation, voire une hétéronomie politique des espaces ruraux par l'entretien de stéréotypes de lieux. S'y ajoutent des procédures inégalitaires dans la distribution des ressources ainsi qu'une violence symbolique ressentie par l'imposition de normes localement mal acceptées, selon les critères d'évaluation d'Iris Marion Young.La justice spatiale n'est cependant pas seulement une démarche critique, mais aussi un projet moral tendant vers la réduction éventuelle des injustices observées. Réfutant ainsi le modèle wébérien de cloisonnement entre la science et le politique – sans pour autant rompre avec les exigences formelles de construction du discours scientifique – le présent travail s'ouvre volontairement à des propositions applicatives de réduction des inégalités en suivant les principes formels de Rawls. Ce faisant, il cherche à valider au final une conception délibérative du travail scientifique, à la manière de Latour, où le fait scientifique ne peut plus être distinct de sa valeur morale dès lors qu'il concourt à une extension équitable du domaine de la démocratie.
This HDR research paper aims at reconsidering the notion of "rural" in the light of the recent contributions of the spatial justice theory. One shall consider how such a category can make social inequalities embed into space, or even reproduce injustice against some of the inhabitants of the countryside.According to a systemic model, the analysis scrutinizes the meanings of "rural" after several of its dimensions: into academic, statistical and teaching discourses; into norms that rule local finances and the ongoing process of territorial reform; and into the practices of territorial planning, farming, leisure and nature conservation. Those three intersected levels - discourses, norms and practices - make appear a very efficient rural "dispositive", in the sense of Foucault, which is able to produce different faces of oppression and a political heteronomy against rural populations and stakeholders.However, spatial justice is also a moral project seeking the reduction of the above stated injustices. Against the Weberian model, which isolates science from politics – but keeping a the same time the formal requirements in the construction of the scientific discourse – this research opens up to an applicative field and suggests some interventions on the spatial levers of injustice. By doing so, we try to validate a deliberative approach of the scientific work where the scientific fact cannot be distinguished from its moral value anymore, as soon as it helps extending the scope of democracy in a more equitable way. ; La notion de ruralité, longtemps centrale dans les démarches d'analyse de la géographie, a été largement remise en question par les sciences sociales depuis plus d'un demi-siècle : il est devenu difficile, sinon suspect, d'assigner un contenu propre à cette catégorie d'espace et à ses populations. Dieser Artikel befasst sich mit transnationaler Aktivist/innen, die soziale Prekarisierung, Handlungsmöglichkeiten und Subjektivität von Migrant/innen in der Europäischen Union (EU) kritisch sichtbar machen wollen. Meine Analyse interessiert sich für den Inhalt von Postern und visuellen Bildern, die Aktivist/innen für ihre lokalen und europäischen Protestaktionen ins Netz stellen und über gemeinsame Blogs oder auf Treffen austauschen. Ich vermute, dass die kaum erforschte visuelle Dimension transnationaler Öffentlichkeit in sozialen Bewegungen ein wichtiges Feld soziologischer Analyse politischer Prozesse darstellt. Mein Artikel untersucht, wie wir Möglichkeiten visueller Dialoge in transnationalen Öffentlichkeiten erforschen können, und was sie uns aus der Perspektive diskursiver Demokratietheorien sagen. Meine empirische Fallstudie beschäftigt sich mit "EuroMayday", einem zunächst lokalen, später transnationalen und beachtlich herangewachsenen Netzwerk für kritischen Protest und Paraden zur Prekarisierung in mehreren europäischen Ländern. Zunächst werde ich die Möglichkeit und die kommunikativen Facetten visueller Dialoge im translokalen EuroMayday-Netzwerk betrachten. Anschließend diskutiere ich die soziale Praxis des Teilens einzelner visueller Bilder über gemeinsame europäische Blogs und Kommunikationsmedien von Mayday-Gruppen in Italien und Deutschland. Abschließend zeige ich einige der kulturellen Bedingungen, die einen Austausch visueller Bilder zu einer möglicherweise innovativen politischen Praxis der transnationalen Kommunikation von Migrant/innen und Bürger/innen machen. Ich frage, ob visuelle Bilder eine Politisierung und kritische Umdeutung offizieller Visionen zu europäischer Bürgerschaft, flexibler Arbeit und des Rechts auf Reisefreiheit vordenken. Auch die politischen Grenzen potenziell transnationaler und doch lokal-kulturell kodierter Öffentlichkeitsräume in Bewegungen bringe ich zur Sprache.
In this paper we explore and develop the relationship between math education, democracy and diversity in the possibilities raised by the decentralization of the math syllabus, as it enables a culture in the classroom where cultural difference is a constitutive element based on the recognition of multiple ways of legitimizing teenagers' relationships with math. We introduce the learning scenarios as a framework that guarantees that, during class activities, students build different groups and share different cultures around a variety of mathematical skills, while the role that each student plays in those groups is related to the construction of identity by participating in the activity. The data was taken from two final dissertations from the Master in Math Education written between 2013 and 2015 at Universidad Pedagógica Nacional (Colombia). The first thesis presents the learning scenario "Don't turn your back on your back" and highlights that it is possible, in math class, to approach collective actions among students. The second thesis presents the learning scenario "How much water do we use?" and shows the possibilities and limitations in the assembly of learning scenarios to address and develop collective actions and to engage in deliberative communication processes. To conclude, we present some questions about the devices of closure and control of diversity created by the specific field of mathematical knowledge as the homogenizing and inclusive ideal of math education. We analyze the potential of a widening of cultural practices as constitution of spaces to make cultural diversity visible in the classroom with an "undisciplined" approach (outside the disciplines) because it opens school math in bridging gaps between youth culture and class culture. ; En este artículo se explora y desarrolla la relación entre educación matemática, democracia y diversidad, en las posibilidades que crea la descentralización del currículo de matemáticas al posibilitar una cultura en la clase donde la diferencia cultural es un elemento constitutivo basada en el reconocimiento de múltiples maneras de legitimar las relaciones con las matemáticas de los adolescentes. Se introducen los escenarios de aprendizaje como marco que garantiza que en las actividades en el aula los estudiantes construyen diferentes grupos y comparten diferentes culturas alrededor de una variedad de habilidades matemáticas mientras el rol que cada estudiante juega en esos grupos está relacionado con la construcción de identidad a través de la participación en la actividad. Los datos provienen de dos tesis de maestría en Docencia de las Matemáticas, realizadas entre el 2013 y 2015 en la Universidad Pedagógica Nacional (Colombia). La primera tesis presenta el escenario de aprendizaje "No le des la espalda a tu espalda" y resalta que es posible en la clase de matemáticas acercarse a acciones colectivas entre los estudiantes. La segunda tesis presenta el escenario de aprendizaje "¿Cuánta agua gastamos?". Y muestra las posibilidades y limitaciones en el montaje de escenarios de aprendizaje para abordar y desarrollar acciones colectivas y comprometerse en procesos de comunicación deliberativa. A modo de cierre presentamos algunos cuestionamientos sobre los dispositivos de clausura y de control de la diversidad creados por el campo específico del conocimiento matemático como el ideal homogeneizador e inclusivo de la educación matemática. Analizamos la potencialidad de un ensanchamiento de prácticas culturales como constitución de espacios para hacer visible la diversidad cultural en el aula con un abordaje "indisciplinado" (por fuera de las disciplinas) porque abre las matemáticas escolares en la reducción de brechas entre la cultura juvenil y la cultura de la clase ; Neste artigo exploramos e desenvolvemos a relação entre educação matemática, democracia e diversidade, nas possibilidades criadas pela descentralização do currículo de matemáticas ao possibilitar uma cultura na aula na que a diferença cultural é um elemento constitutivo, baseada no reconhecimento de múltiplas formas de legitimar as relações dos adolescentes com as matemáticas. A segunda tese apresenta o cenário de aprendizagem "Quanta água consumimos?" e apresenta as possibilidades e limitações na construção de cenários de aprendizagem para abordar e desenvolver ações coletivas, assim como se comprometer em processos de comunicação deliberativa. Como conclusão, apresentamos alguns questionamentos sobre os dispositivos de clausura e de controle da diversidade criados pelo campo específico do conhecimento matemático como o ideal homogeneizador e inclusivo da educação matemática. Analisamos a potencialidade de uma ampliação de práticas culturais como constituição de espaços para visibilizar a diversidade cultural na sala de aula com uma abordagem "indisciplinada" (fora das disciplinas), pois amplifica as matemáticas escolares na redução de disparidades entre a cultura juvenil e a cultura da aula.
[spa] Es comúnmente apreciado que el TJUE, junto con los tribunales nacionales, es un importante motor de la integración y constitucionalización de la UE. Este proceso plantea diversos problemas teóricos y prácticos, por lo que necesita una conceptualización cuidadosa para evitar su abuso y reforzar sus potenciales. En el artículo, el papel y la legitimidad de la creación judicial se analizarán en consideración al impacto del "principio de efectividad" en derecho privado a nivel Europeo y nacional. De hecho, de una parte, los jueces están llamados a reforzar el derecho europeo mediante intervenciones negativas y positivas; de otra, están limitados por los principios de separación de poderes, división de competencias, legalidad e igualdad, a menudo en conflicto con los mencionados deberes, quedando entre la espada y la pared. Tal dilema será resuelto indagando por el significado y objetivo del "principio de efectividad", para identificar: (i) en qué condiciones el uso por parte del TJUE puede considerarse legítimo; (ii) en qué medida los jueces nacionales deben aplicarlo, contribuyendo a su realización, en disputas que involucren a sujetos privados. Con este fin, se establecerán dos objetivos preliminares: (a) comprender el significado y la fuerza normativa del "principio de efectividad" en el derecho europeo, y si difiere respecto de la jurisprudencia de los tribunales nacionales; (b) analizar el impacto del derecho a un recurso efectivo (Artículo 47 Carta De Los Derechos Fundamentales de la UE) en disputas horizontales. Partiendo de la metodología ofrecida por la filosofía del lenguaje, el artículo analiza las principales especificidades de la efectividad en la jurisprudencia del TJUE –"efectividad del derecho europeo" y "efectividad de la protección judicial"–, y, de manera crítica, afirma la coherencia y ajuste institucional de cada "Sprachgebrauch", así como sus interacciones. Sucesivamente, el artículo re-conceptualiza la efectividad como un "argumento" que, al ser esencialmente indeterminado, puede ser fácilmente mal utilizado. Mi hipótesis es que a través de una serie de manipulaciones argumentativas, el Tribunal expande sus competencias contra los Estados miembros y otras instituciones de la UE, para fomentar la integración en áreas constitucionalmente sensibles, también mediante la adjudicación de leyes privadas. Este proceso puede ser enmarcado críticamente: según el principio democrático, tal práctica puede aceptarse cuando está legitimada por un consenso preexistente, pero puede ser menos aceptable cuando se necesita una nueva adhesión, configurando un debilitamiento progresivo de la unión política. De acuerdo con una teoría de la justicia en asuntos de derecho privado, las condiciones de legitimidad de tal proceso de creación judicial deben ser re-conceptualizadas, cuestionando así la dimensión regulatoria no restringida atribuida a los casos horizontales en la jurisprudencia del TJUE. En fin, los resultados serán utilizados para evaluar el impacto del principio de efectividad en el derecho privado nacional, así como para guiar su desarrollo en los tribunales nacionales, sugiriendo que los jueces deben desempeñar un papel fuerte y proactivo en su diálogo con el TJUE, obligando a este último a suponer y ponderar más sus decisiones, a fin de abrir nuevos espacios en el proceso deliberativo sobre el proyecto de la UE. ; [eng] It is commonly appreciated that the CJEU, together with national courts, constitute a main driver of the EU integration and Constitutionalization. This process raises various theoretical and practical problems, thus needing careful conceptualization to avoid abuse and reinforce its potentials. This paper analyzes the role and legitimacy of judicial law-making by addressing the impact of the «principle of effectiveness» on private law adjudication at European and national level. Indeed, on the one hand, judges are called to enforce EU law, both through negative and positive interventions; on the other hand, they are constrained by the principles of separation of powers, division of competences, rule of law and equality – often clashing with said duties –, sitting between a rock and a hard stone. Such dilemma shall be addressed by inquiring the meaning and scope of the «principle of effectiveness», to identify: (i) under which conditions its use by the CJEU may be deemed legitimate; (ii) to what extent national judges shall apply it, contributing to its realization, in disputes involving private parties. To this end, two preliminary goals shall be set: (a) understanding the meaning and normative force of the «principle of effectiveness» in EU law, and whether they differ from their national courts' understanding; (b) analyzing the impact of the right to an effective remedy (art. 47 EUCFR) in horizontal disputes. By relying on the methodology offered by the philosophy of language, the paper analyzes the two major specifications of effectiveness in the CJEU case law – «effectiveness of EU law» and «effectiveness of judicial protection» –, and critically assesses the coherence and institutional fit of each "Sprachgebrauch", as well as their interactions. It then re-conceptualizes effectiveness as an «argument» which, being essentially indeterminate, may be easily misused. My hypothesis is that through a series of argumentative twist and turns, the Court expands its competences against MSs and other EU Institutions, to foster integration in constitutionally sensitive areas, also trough private law adjudication. This process shall be critically framed: according to the principle of democracy, such practice may be accepted when sustained by a pre-existing consensus, but might be less acceptable when new adhesion is needed, in the long run weakening the political Union; according to a theory of justice in private law matters, the conditions of legitimacy of such judicial law-making need to be re-conceptualized, thus questioning the unconstrained regulatory dimension attributed to horizontal cases in the CJEU case law. The results is finally used to evaluate the impact of the principle of effectiveness on national private law, as well as to guide its deployment by domestic courts, suggesting that judges shall perform a strong and pro-active role in their dialogue with the CJEU, forcing the latter to second-guess and further weighting its decisions, to open up new deliberative spaces in the EU project.
Väitöskirjatutkimus tarkastelee julkisen diskurssin ja argumentoinnin tilaa Suomessa. Julkisuudessa esiintyvä poliittinen argumentaatio toimii hegemonisen vaikutusvallan areenana, jolla määritellään mistä asioista puhutaan, miten, ja kenen toimesta. Joitain argumentteja edistetään strategisesti poliittisten tavoitteiden saavuttamiseksi, kun taas toisia otetaan itsenäisesti käyttöön niiden toimivuuden vuoksi. Argumentaatio nojaa suostutteluun, eikä suoraan vallankäyttöön. Demokratiassa argumentaatio on tapa saavuttaa tukea omille aloitteille, ja perustella hyväksyttävästi kiistanalaisia päätöksiä. Tässä tutkimuksessa tarkastellaan erityisesti taloudellisiin perusteisiin pohjautuvaa argumentaatiota, sen hyödyntämistä politiikassa, ja sen ylivaltaa päätöksenteon perusteena. Argumentin taustatekijöiden yhteneväisyys auttaa pohjaoletuksia tukemaan toisiaan yli erilaisten yhteiskunnan alojen, kuten esimerkiksi liiketoiminnasta median kautta politiikkaan. Vakuuttavat argumentit yhdellä kentällä houkuttelevat hyödyntämään niitä myös muualla. Esimerkiksi irtisanomistilanteissa yrityksen on kannattavaa korostaa väistämättömyyttä ja välttämättömyyttä, vähätellen näin omaa toimintakykyään ja siten myös vastuuta ulkoisten tekijöiden pakottavista toimista. Poliittinen toimija voi samoin oikeuttaa toimensa vedoten ulkoisiin tekijöihin, koska tämä argumentti on kansalaisille tuttu jo työelämästä. Taloudellista logiikkaa on vaikea kiistää. Tutkimusta ohjaa "kipeiden, mutta välttämättömien päätösten" leviäminen yleiseksi argumentaation muodoksi suomalaisessa yhteiskunnassa. Siinä missä yritysjohtajat perustelevat henkilöstövähennyksiä kipeinä, mutta välttämättöminä ratkaisuina, jotka takaavat yrityksen tuottavuuden tulevaisuudessa, poliitikot puolestaan pahoittelevat joutuvansa tekemään yhtä lailla kipeitä, mutta välttämättömiä leikkauksia hyvinvointiyhteiskunnan palveluihin taatakseen sen kestävän tulevaisuuden. Molemmissa tapauksissa toimijat julistavat ryhtyvänsä näihin toimiin vastentahtoisesti, mutta vedoten pakottaviin tekijöihin. Niin ikään vedoten leikkauksiin nyt, jotta tulevaisuus voidaan turvata – lyhytkestoista kärsimystä seuraa parempi tulevaisuus. Julkisen talouden sopeuttaminen ja yrityksen kulurakenteen tasapainottaminen seuraavat täysin samanlaista argumentaatio-rakennetta. Tässä tutkimuksessa tarkastellaan taloudellisen toimintalogiikan ja argumentaation valta-asemaa demokraattisessa päätöksenteossa. Globalisaation aikakaudella kansantaloudet ovat asettaneet kilpailukyvyn ja vastuullisen taloudenhoidon etusijalle. Kyseessä on suuri muutos tavassa hahmottaa yhteiskunnan ja valtion roolia politiikassa talouden alaisina toimijoina. Tässä tutkimuksessa tätä kehityskulkua ohjaa uusliberaali ideologia, joka suuntautuu markkinavoimien keskeisyyttä korostavien kehysten kautta, ja ilmenee argumentaation tasolla. Laajan yhteiskunnallisen diskursiivisen muutoksen hahmottaminen vaatii kaikkien näiden kolmen teoreettisen tasojen huomioimista: ns. faircloughlaisen koulukunnan (Fairclough & Fairclough 2012) kriittisen diskurssianalyysin argumentatiivinen käänne yhdistetään kehysteoriaan ja ideologiateoriaan selittämään kuinka yhteiskunnallista todellisuutta rakennetaan uudelleen. Vaikka talous pidetään käsitteellisesti erossa politiikasta, talouden prioriteetit ohjaavat kuitenkin politiikkaa keskeisesti. Tämä johtaa siihen, että politiikka menettää osan merkityksestään todellisten vaihtoehtojen harkinnan ja keskustelun areenana. Tutkimuksen teoreettinen kolmijakoisuus yhdistyy tutkimusaineiston omaan kolmijakoisuuteen: tutkimusalueena ovat yhtälailla yritysten, median, ja politiikan diskurssit. Mikäli yhden yhteiskunnallisen alueen puhetapa ja logiikka ylikorostuu todelliseksi hegemoniaksi, kenttien väliset erot muuttuvat pinnallisiksi. Vaikka on ymmärrettävää, että liiketoiminnassa taloudellinen ajattelutapa on luonnollisesti keskiössä, median tehtävä on informoida kansalaisia ja tarjota moninaisia näkökulmia yhteiskunnallisiin asioihin. Yksipuolisen kuvan välittäminen kiistanalaisista asioista vähentää myös median mahdollisuuksia toimia valtaapitävien vahtikoirina. Edelleen, habermaslaisen ideaalin mukaan edustuksellinen demokratia edellyttää harkintaa – deliberaatiota – ja vilpitöntä keskustelua erilaisista poliittisista vaihtoehdoista. Ainoastaan keskustelemalla vaihtoehdot läpi voidaan tehdä päätöksiä, jotka ovat demokratian hengen mukaisia, tasa-arvoisia ja osallistavia. Näihin poliittisen vallankäytön oikeutus nojaa. Jos argumentit eivät kuitenkaan jätä tilaa vaihtoehdoille, poliittisen päätöksenteon rooliksi jää talousdiskurssin vahvistaminen. Toisin sanoen, talouspoliittinen päätöksenteko erotetaan "normaalista" poliittisesta päätöksenteosta. Jos talouskriisi hahmotetaan koko valtion – yhteiskunnan – kriisinä, joka uhkaa olemassaoloamme, tuntuu vastuuttomalta "haaskata aikaa" harkitsemalla eri vaihtoehtoja. Talousdiskurssi tarjoaa valmiit vaihtoehdot. Seurauksena uskottavien tai ylipäänsä hyväksyttävien poliittisten valintojen kirjo kaventuu taloudellisten perusteiden mukaisesti. Suomesta lähtöisin oleva, mutta maailmanlaajuiseen maineeseen noussut Nokia toimii tässä tutkimuksessa suuntaa-antavana esimerkkinä yritysten talousdiskurssista globalisaation aikakaudella. Tutkimus ei siis ole niinkään keskittynyt Nokiaan yrityksenä, vaan Nokiaan tietynlaisena markkinoita korostavan logiikan ja puhetavan malliesimerkkinä Suomessa. Nokian vaikutusvalta Suomessa tekee yrityksestä luonnollisen tutkimuskohteen: 2000-luvun alussa monesti ajateltiin, että se, mikä on hyväksi Nokialle, on myös hyväksi Suomelle. Lisäksi Suomen kansallinen konteksti pohjoismaisena hyvinvointivaltiona toimii tutkimuksessa vastakkaisena kehyksenä uusliberaalin ideologian markkinakeskeiselle ajattelulle. Suomen suhteellisen kapea ja läheisesti kytkeytynyt taloudellinen ja poliittinen eliitti huomioidaan myös tutkimuksessa. Tutkimuksen analyysin ensimmäinen taso kohdistuu Nokian lehdistötiedotteiden yritysdiskurssia seuraavaan argumentointiin keskittyen erityisesti irtisanomistilanteista tiedottamiseen. Nokian kaltaisen suuryrityksen irtisanomiset ovat lähtökohtaisesti merkittäviä, mahdollisesti ristiriitaisia tilanteita, jolloin Nokian on tärkeää onnistua esiintymään vastuullisena yrityksenä. Analyysin toinen taso tarkastelee Nokiaa koskevaa uutisointia irtisanomistapauksissa kolmen eri sanomalehden kautta (Helsingin Sanomat, Kauppalehti ja Ilta-Sanomat). Analyysi osoittaa kuinka voimakkaasti Nokian puoltama markkinakeskeisyyttä korostava kehys kulkee läpi sanomalehtien uutisoinnin. Kolmannella tasolla syvennytään poliittisen diskurssin tasolle, kohdistuen hallituksen esityksiin valtion talousarvioiksi. Analyysin kolmas taso irtoaa Nokiasta ja keskittyy enemmän talouspoliittisen argumentaation kirjoon, seuraten Fairclough & Faircloughn (2012) esimerkkiä. Valtiovarainministerin budjettipuhe sekä eduskuntaryhmien vastaukset käsitellään valtiontalouden tilan ja tulevaisuuden arviointina. Tutkimuksen aikajana sijoittuu vuosien 2000 ja 2013 välille. Tutkimus koostaa yhteen kehyksiä ja argumentaatiota, antaen esimerkkejä sekä lehdistötiedotteista että sanomalehtiartikkeleista, koskien Nokian irtisanomistilanteita tältä aikaväliltä. Poliittisen diskurssin osalta samalta aikajaksolta poimittiin neljä budjettipuhetta – 2001, 2006, 2011, ja 2013 – erilaisin hallituskoostumuksin. Budjettipuheet sijoittautuvat myös mielenkiintoisesti erilaisiin makrotaloudellisiin jaksoihin: vuoden 2001 budjettipuheenvuorossa Suomi astuu aidosti globaalin maailmantalouden piiriin, kun taas vuonna 2006 ollaan taloudellisen nousukauden huipulla. Vuoden 2011 budjettipuheenvuoron aikaan talouskriisistä on ehtinyt kulua jo joitain vuosia kunnes tapahtuu laajamittainen siirros elvytyspolitiikasta talouskuriin koko Euroopassa. Viimein vuoden 2013 talouspuheessa lama jatkuu edelleen ja tulevaisuus näyttää yhä epävarmalta. Samana vuonna Nokian matkapuhelintoiminta myytiin Microsoftille. Tämä tutkimus osoittaa talousdiskurssin – ajattelun, puheen ja toiminnan – voiman suomalaisessa yhteiskunnassa. Vaikkei ole yllättävää, että suuryritys nojautuu voimakkaasti markkinoiden lainalaisuuksiin, on ongelmallista moniäänisen yhteiskunnallisen keskustelun kannalta, että näihin lainalaisuuksiin pohjaava argumentaatio toistuu mediassa. Joissakin tapauksissa tätä argumentaatiota ei ainoastaan toistettu vaan vahvistettiin, jättäen muille näkökulmille hyvin vähän tilaa ja siten vähemmän näkyvyyttä. Yhteiskunnalliset ja työntekijöiden intressit alistettiin säännönmukaisesti kilpailukyvylle ja kustannustehokkuudelle. Samat rakenteet toistuivat erityisen voimakkaina poliittisessa diskurssissa etenkin finanssikriisin jälkeisinä vuosina. Tutkimuksessa käy ilmi kuinka kansantalouden tasapainottaminen ottaa usein talouskurin ("austerity") muodon. Vastuullisuus politiikassa ymmärretään yhtäältä yhteiskunnallisen oikeudenmukaisuuden varmistamisena, mutta toisaalta julkistalouden rajaamisena, joka menee tasapainotusta pidemmälle. Ottaen kuitenkin huomioon, että julkistalouden tasapainotus nähdään yhteiskunnallisen oikeudenmukaisuuden edellytyksenä, näidenkin arvojen välinen järjestys seuraa taloudellisia vaatimuksia. Samanlainen argumentaatio-rakenne löytyy yritysdiskurssista, jossa työntekijöiden oikeudet tai irtisanomisten yhteiskunnallinen vaikutus toki huomioidaan, mutta kustannustehokkuus ja tuottavuus ovat etusijalla. Mediassa tätä logiikkaa ei myöskään kumottu. Ammattiliitot eivät onnistuneet löytämään tukea argumenteilleen ja poliitikot puolestaan käyttivät Nokian alamäkeä vertauskuvallisena perusteena tehdä leikkauksia julkisella sektorilla. Sekä Nokialle että Suomelle tarjottiin kriiseihinsä lääkkeeksi tiukkaa taloudellista kurikuuria. Vaikka hyvinvointivaltion perinteiset arvot, kuten yhteiskunnallinen vastuullisuus ja oikeudenmukaisuus näkyvät usein argumentaatiossa, ne asettuvat argumentaation kokonaisuudessa toissijaisiksi arvoiksi, jotka pehmentävät kovia taloudellisia päämääriä. Tämä kehitys selittää myös osaltaan myöhempien hallitusten linjauksia. Väitöskirjatutkimus sijoittautuu osaksi monipuolista tutkimusperinnettä sekä teorian että empirian osalta. Tutkimus soveltaa faircloughlaista poliittisen diskurssin argumentaatio-analyysiä aiempaa laajemmin. Teoreettinen malli kokonaisuudessaan ottaa laajemmin haltuun yhteiskunnallisten diskurssien muutoksen monelta eri näkökannalta. Tutkimus sijoittuu myös erikoisella tavalla kolmen erilaisen tieteenalan – vastuullisen yritystoiminnan tutkimuksen ja organisaatiotutkimuksen, kriittisen mediatutkimuksen, sekä poliittisen talouden tutkimuksen – risteykseen. Tutkimuksen löydökset vahvistavat kriittisen tutkimuksen aiempia löydöksiä, sekä valottavat suomalaisen yhteiskunnan muutosta. Vaikka tutkimus on keskittynyt osittain Nokiaan ja erityisesti Suomen kansalliseen kontekstiin, on kuitenkin todennäköistä, että tutkimuksen lähestymistapa ja tulokset ovat sovellettavissa laajemminkin eurooppalaisessa kontekstissa. Tutkimus antaa myös viitteitä siitä, että yhteiskunnallisen diskurssin ja argumentaation yksipuolistumisen seurauksia esimerkiksi politiikalle on syytä tutkia edelleen. Taloudellisen teknokratian ylivalta saattaa heijastua poliittisten ja yhteiskunnallisten voimien kanavoitumiseen uusin tavoin. ; This dissertation studies the range of public discourse and argumentation in Finland. Political arguments in public discourse are a site of a struggle over meaning and hegemonic influence, defining what issues get talked about and by whom. Specific arguments are at one hand strategically promoted, and on the other autonomously adopted. Persuasion, rather than coercion, is necessary to convince others of the legitimacy of proposed actions in a democracy. The dissertation focuses in particular on how public economic discourse and argumentation resonates in political discourse. Discourse, after all, reflects social practice. The sharing of similar meanings, premises and arguments informs a specific kind of logic that is not unique to a single discursive field. The mutual supportiveness of the argumentative elements increase their salience. Successful arguments, in particular, lead by example. A corporate actor may find it useful to stress extraneous circumstances over his own agency to claim that controversial actions are inevitable and necessary, and thus not debatable. Lack of agency suggests lack of accountability. Political agents gain more legitimacy for their proposed policy agenda if the assumptions and arguments implicit in that agenda are familiar to audiences from the business context. This research is motivated by a critical examination of the proliferation of arguments of "tough but necessary" decisions, commonplace in the public sphere. The same argumentative structure is visible between CEOs, who argue for downsizings as painful but necessary, even inevitable actions that would safeguard the company's future prosperity, and politicians, who argue that reduction of public expenditures is an equally painful but necessary action to balance public finances in order to secure the future of the Finnish welfare society. In both cases, actors declare reluctance and yet demand decisive action, short-term loss over long-term gain. After all, reducing public expenditure and labour costs both serve the bottom-line. This rationale reflects the economic logic of scarcity in both cases. The dissertation considers the consequences of prioritizing economic discourse in political discourse and democratic practice. The age of globalization has prompted a shift towards conceptualizing politics through competitiveness and fiscal responsibility first. Rather than looking at the arguments presented alone, it is necessary to understand such macro-level shifts in discourse and social practice in broader terms. These arguments and discourse form the operational level of pro-market frames, informed by neoliberal ideology. All three levels – argumentation theory informed by the argumentative turn of "Faircloughian" critical discourse analysis (Fairclough & Fairclough 2012), framing theory, and ideology theory – are necessary to fully encapsulate how understanding and decision-making in society develops not only through sense-making but sense-giving. This approach is integral to producing, reproducing, and sustaining structures of power through an interplay of business and political interests in public discourse. The theoretical triangulation of this work is matched with an empirical triangulation of business, media, and political discourse. The risk posed by hegemonic dominance of one particular ideology and its associated frames and discourse are different depending on the discursive field in question. In business discourse prioritizing corporate logic can be expected to dominate. In media reporting, however, a plurality of viewpoints should be available to inform the citizenry. Moreover, deliberative democracy in particular relies on sincere debates and arguments in order to, according to the Habermasian ideal, achieve equitable and inclusive decision-making. However, if there are no viable alternatives, and discourse links financial survival directly to national political survival, political deliberation becomes fraught. Hesitation and delay are often presented as irresponsible in what is seen as an impending crisis. As such, politics risk becoming a de facto extension of economics. In so doing political decisions necessarily derive their basis and legitimacy from economics, and economic language. This leads to a narrowing of credible and feasible political alternatives, when it is the purpose of politics to find possibilities and alternatives. A singular ideology means there is no choice, and politics lose their raison d'etre. The Finland-originated but multinational telecommunications company Nokia serves in this dissertation as a corporate operative exemplifying the rationale of business argumentation and discourse. This dissertation is not as much an investigation of what kind of a corporate actor Nokia is, but what kind of corporate discourse it promoted in the Finnish context. Nokia's power and influence in Finland make it a suitable example to draw on for the purposes of analysing the interplay of economic and political discourse. What was good for Nokia was often seen as being good for Finland. Furthermore, Finland's position in the tradition of Nordic welfare states makes the competition between the competing frames of pro-market and societal interest also relevant, as the corresponding ideological struggle is between neoliberal ideology and the tradition of the Nordic welfare state respectively. The role of elite-dissemination of hegemonic ideological logic and discursive practice is also explored, given the tightly knit composition of Finnish business and political elites. The first level of analysis focuses on corporate speech via Nokia's press releases, particularly relating to downsizing events, which were controversial and required careful argumentation to preserve the legitimacy of the company as a responsible corporate citizen. The second level of analysis deals with of media discourse relating to Nokia's downsizing. It observes how strongly the media took up Nokia's pro-market framing of the events. Media analysis focuses on three Finnish newspapers: Helsingin Sanomat (a socio-political approach), Kauppalehti (business approach) and Ilta-Sanomat (tabloid with national interest leanings) to provide a broad overview of reporting relating to Nokia's downsizing actions. The third level of analysis looks at political discourse in the form of budgetary speeches by Finnish Finance Ministers and party responses in Parliament. This last level follows the example set by Fairclough & Fairclough (2012) in seeing budgetary debates as key moments that present the state of the national political economy is stated and propose possible ways forward. The research timeline covers business discourse from Nokia from the early 2000s to 2013 – to the point when Nokia's mobile phone business was sold to Microsoft. The same timeline is followed in the media material following Nokia's rationalizations and public reactions to its downsizing events. Political discourse is explored through four budgetary speeches and their responses from 2001, 2006, 2011 and 2013. This allows the research to canvas the state of Finnish public discourse in three fields over a period of time – 12 years. This period covers the rapid globalization process of Finland and Nokia both in the early 2000s, the height of an economic boom in 2006, the shift from stimulus to austerity in 2011, and an uncertain future discussed in 2013. The research shows that economic logic is a powerful means to frame the debate: while it is expected that corporations prioritize economic logic in stating their case, it is troubling from the perspective of societal plurality that the same logic is reproduced in mainstream Finnish media. In some cases it is not only reproduced, but amplified through quoted expert sources, leaving very little room for objections challenging economic logic. This is not to say societal concerns are not addressed, but they are clearly given lower priority. Objections from the point of view of e.g. employee interest are subservient to issues of competitiveness and efficiency. It becomes increasingly problematic when the same logic is applied, most notably after the 2007-2008 financial crisis, to political debates. This argumentative development continues with later Finnish governments. The analysis reveals a powerful preference for pro-market frames that are largely interpreted as austerity policy. While both societal and fiscal responsibilities feature strongly in the arguments deciding the course of Finnish public finances, the arguably more powerful aspect is the latter one. It is only through fiscal responsibility that societal responsibilities can be realized. In essence, this argumentative structure is notably similar to that of a corporation undergoing restructuring: only once the company returns to profitability can the company's responsibilities towards its employees be realized. The media, it is found, often emphasizes this framing of priorities. Indeed, trade unions fail to argue for their members and politicians use Nokia's decline as a direct comparison to the decline of Finnish public finances. Both Nokia and Finland are represented in a crisis, and the only way out for both is fiscal discipline. On the level of discourse, there still exists wide support for responsible, fair, and socially just policies of the welfare state. While these values exist in discourse, they are relegated to secondary positions because they make less sense in the context of pro-market arguments in a competitive state. This research contributes expansively to both theoretical and empirical literature on the neoliberal shift in conceptualizing the political economy in the Nordic states. Theoretical triangulation serves as a workable model of intertwined approaches to qualitative analysis that still presents argumentative political discourse, frames and ideology as separate concepts. It also contributes in the fields of 1) business studies – and organization studies and critical literature of corporate social responsibility in particular – 2) critical media studies and 3) studies on the political economy. The findings are in line with previous literature in the critical tradition, and shed light on the transformation of Finnish society (and welfare state) in the 21st century. While centred on Finland and partially on Nokia, it is unlikely that this homogenizing argumentative this practice is unique to the Finnish context. The consequences of this development for active social and political participation need to be explored further.
