The article explores the issues of the use of the detention of persons by bodies and departments of the state border protection as an administrative procedural and a temporary preventive criminal procedural measure and the functioning of the institution of detention in the State Border Service of Ukraine. Considering the essence of administrative detention, it is concluded that it is a compulsory short-term restriction of the will to the acts and the movement of a person who has committed an administrative offense and it is carried out only by bodies and officials authorized for that legislative acts. It is noted that the detention of detainees is a system of organizational and practical measures aimed at compliance with the law when moving detained persons to the places of temporary detention, their detention or dismissal, compliance with the regime in places of temporary detention, protection of detainees, their material and material means, food and medical and psychological assistance. Due to its administrative nature, the detention of foreigners and stateless persons should not be punitive as it is not a sanction or a punishment. It is proposed to consider the concept of "placement of a person to the places of temporary detention of the State Border Service of Ukraine" as a temporary measure of procedural coercion applied by bodies (units) of the state border guard against persons for committing administrative offenses or suspected of committing criminal offenses against which the legislation of Ukraine is referred to the competence of the State Border Guard Service of Ukraine, or in the case of the decision to place in the appropriate points of temporary stay foreigners and stateless persons who are illegally present in the territory of Ukraine, before securing their forced expulsion or those persons who have been accepted by the competent authorities of other states on the basis of valid international agreements on the readmission of persons. It is concluded that the placement of persons in places of temporary custody of the State Border Service of Ukraine is used not only to exclude the possibility of committing new offenses, but also to identify and prepare them for forced expulsion or transfer within the framework of readmission agreements. ; В статті досліджуються питання застосування органами та підрозділами охорони державного кордону затримання осіб, як адміністративно-процесуального та як тимчасового запобіжного кримінального процесуального заходу та функціонування інституту тримання в Державній прикордонній службі України. Розглянувши сутність адміністративного затримання, робиться висновок, що воно полягає в примусовому короткочасному обмеженні волі дій і пересування особи, яка вчинила адміністративне правопорушення і здійснюється лише органами та посадовими особами, уповноваженими на те законодавчими актами. Зазначається, що тримання затриманих осіб – це система організаційних та практичних заходів, спрямована на дотримання законності при поміщенні затриманих осіб до місць тимчасового тримання, їх триманні та звільненні або вибутті, дотримання режиму в місцях тимчасового тримання, здійснення охорони затриманих осіб, їх матеріально-побутового, продовольчого забезпечення та надання медичної й психологічної допомоги. Відповідно до своєї адміністративної природи, утримання іноземців та осіб без громадянства під вартою не повинно носити каральний характер: це не є санкцією чи покаранням. Пропонується поняття «поміщення особи до місць тимчасового тримання Державної прикордонної служби України» розглядати як тимчасовий захід процесуального примусу, що застосовується органами (підрозділами) охорони державного кордону до осіб за вчинення адміністративних правопорушень чи за підозрою у вчиненні кримінальних правопорушень, протидію яким законодавством України віднесено до компетенції Державної прикордонної служби України, або у випадку прийняття рішення про розміщення у відповідних пунктах тимчасового перебування іноземців та осіб без громадянства, які незаконно перебувають на території України, до забезпечення їх примусового видворення чи тих осіб, які прийняті від компетентних органів інших держав на підставі чинних міжнародних угод про реадмісію осіб. Робиться висновок, що поміщення осіб в місця тимчасового тримання Державної прикордонної служби України застосовується не лише з метою виключення можливостей вчинення ними нових правопорушень, але й з метою їх ідентифікації та підготовки до примусового видворення чи передачі в рамках угод про реадмісію осіб.

Over the last 27 years, the United Nations Working Group on Arbitrary Detention has developed a rich jurisprudence on the circumstances in which individuals have been arbitrarily detained. Until recently, most of this jurisprudence focused on detention resulting from the exercise of rights and freedoms, and serious violations of the right to fair trial. The Working Group is increasingly receiving communications involving detention on discriminatory grounds and its findings are evolving in response. Despite significant progress, there are several issues yet to be resolved by the Working Group as it moves toward a more comprehensive equality-based conception of arbitrary detention. The unresolved issues include the need for greater clarity on what constitutes discrimination; how to deal with laws that are discriminatory; how to distinguish between detention resulting from the exercise of rights and from discrimination; whether protection should extend to a broader range of individuals and groups; why poverty matters in detention practices, and whether the Working Group's recommendations and follow-up need to be tailored in cases of discrimination. This article offers suggestions on the direction that the Working Group might take in its jurisprudence to resolve these remaining areas of uncertainty, including clarifying the circumstances in which differential treatment will amount to discrimination, determining that detention arising from discriminatory laws has no legal basis, taking a flexible approach to the overlap in the categories it employs to evaluate arbitrary detention, incrementally extending protection to marginalized groups such as those living in poverty, making recommendations to address the structural causes of discrimination, and using its follow-up procedure to highlight cases of detention on discriminatory grounds.
