Al giorno d'oggi i minori occupano un posto sempre più rilevante nell'agenda giuridica e politica dell'UE. La promozione e la protezione dei diritti del fanciullo è ora un obiettivo dell'Unione europea ai sensi dell'articolo 3, par. 3, del TUE. I diritti dei minori sono anche sanciti nell'articolo 24 della Carta dei diritti fondamentali dell'Unione europea. L'Unione attualmente possiede molti atti normativi e non relativi ai diritti dei fanciulli o che possono avere un reale impatto sulle loro vite. Questa tesi di dottorato analizza la natura, la portata e il valore delle misure UE che riguardano i minori in due aree principali: la protezione dei minori e la giustizia penale minorile. La tesi indaga se vi è un valore aggiunto nei diritti dei fanciulli stabiliti a livello di UE e cercherà anche di offrire alcuni suggerimenti per migliorare la protezione dei diritti dei minori nell'Unione europea. ; Today children's rights occupy an increasingly prominent place on the EU legal and policy agenda. La promotion des droits de l'enfant représente maintenant un objectif de l'UE, consacré dans l'article 3, paragr. 3, du Traité sur l'Union européenne. Les droits de l'enfant sont également cristallisés dans l'article 24 de la Charte des droits fondamentaux de l'Union européenne. Actuellement l'Union européenne dispose de nombreux actes législatifs et de documents non législatifs relatifs aux droits des mineurs ou qui peuvent avoir des répercussions indirectes sur la vie des enfants. Ce travail analyse la nature, la portée et la valeur des mesures de l'UE dans deux domaines principaux : la protection des enfants et de leurs droits et la justice pénale des mineurs. Le but de la recherche a été d'examiner jusqu'à quel point on peut parler d'une valeur ajoutée de la promotion des droits des enfants au niveau de l'UE, par rapport au niveau national et international et également celui de proposer de nouvelles solutions pour améliorer la promotion et la protection des droits des enfants dans l'Union européenne. ; Al giorno d'oggi, i diritti dei ...

Dottorato di ricerca in Storia d'Europa: società, politica e istituzioni (19.-20. secolo) ; L'unificazione politica e legislativa del Regno d'Italia coinvolse anche l'ordinamento giudiziario. La magistratura che dipendeva per le nomine e la carriera dal Governo centrale e in modo specifico dal Ministro della giustizia, venne inquadrata da subito come un ramo della pubblica amministrazione direttamente dipendente dal Re. La questione dell'indipendenza del potere giudiziario dall'esecutivo e quella dell'autonomia, intesa come sistema di autogoverno, furono i temi centrali del dibattito parlamentare. L'ordinamento giudiziario del 1865, infatti, concedeva ai giudici l'inamovibilità di grado ma non di sede e ai pretori soltanto dopo i tre anni di attività. Per limitare il potere dell'esecutivo fu costituita dal ministro Villa nel 1880 la Commissione consultiva per le nomine, promozioni e tramutamenti dei magistrati che però esprimeva dei meri pareri consultivi di cui il guardasigilli poteva anche non tener conto. Soltanto più tardi, nel 1907, con la legge n. 511 del ministro Orlando fu istituito il Consiglio Superiore della magistratura, un corpo consultivo permanente e parzialmente elettivo a cui vennero attribuite una serie di competenze relative alla nomina e alla carriera dei giudici. Anche il concorso pubblico, come unico mezzo per l'ingresso in magistratura, istituito da Zanardelli nel 1890 e negli anni rivisitato e modificato, venne considerato un mezzo per sottrarre il potere giudiziario al controllo governativo eliminando la nomina politica dei giudici. Zanardelli tentò anche di ridisegnare con la legge 30 marzo 1890, n. 6702 le circoscrizioni giudiziarie ereditate dal passato riducendo il numero delle preture per aumentare, con le risorse economiche ricavate, lo stipendio dei giudici ritenuto esiguo soprattutto nei primi anni della carriera. La sistemazione delle preture, di cui si occuparono anche Ronchetti e Orlando, incontrò sempre una forte opposizione locale più per ragioni di prestigio che di giustizia; il Governo affrontò la medesima resistenza anche per la costituzione della Corte di cassazione di Roma che si concluse soltanto nel 1923. Nel 1875 vennero istituite a Roma due sezioni penali con lo scopo di agevolare il lavoro delle altre quattro Corti regionali con sede a Torino, Milano, Napoli e Palermo. La Corte di Roma assunse la cognizione di tutti i giudizi penali e ridusse le Corti regionali a corti supreme di nome e non di fatto lasciando loro le sole competenze civili. Negli anni successivi si continuò ancora discutere circa l'unicità della Corte ed il ruolo che avrebbe dovuto assumere, se tribunale di terza istanza o tribunale garante della uniforme interpretazione della legge. Intanto si andò consolidando anche la struttura del Ministero della giustizia, al cui interno il guardasigilli, coadiuvato dal segretario, dal direttore generale e dal gabinetto trovavano spazio una serie di uffici ripartiti in divisioni, ai quali tra la fine dell'ottocento e l'inizio del novecento se ne aggiunsero dei nuovi tra cui la Commissione consultiva, l'ufficio legislativo, il casellario centrale. A questi venivano frequentemente destinati magistrati in qualità di applicati o in missione a svantaggio del personale di ruolo che costantemente veniva ridotto. ; The political and legislative unification of the Kingdom of Italy also involved the judiciary. The judiciary that depended on appointments and career from the central government and specifically by the Minister of Justice, was framed from the start as a branch of government directly employed by the King. The question of independence of the judiciary from the executive and that of autonomy, understood as a system of self-government, were the central themes of parliamentary debate. The judicial system in 1865, in fact, granted the tenure of judges but not able to seat and lower court judges only after three years of operation. To limit the power of government was established by the Minister Villa in 1880, the Advisory Commission on appointments, promotions and transmutation of judges. It expressed mere advisory opinions which the Keeper could not even take into account. Only later, in 1907, with Law No 511, the Minister Orlando instituted the Superior Council of Magistracy, a permanent and partially elected consultative body which was attributed a range of skills relating to the appointment and careers of judges. Even the competitive examination, as the only means for entry into the judiciary, established by Zanardelli in 1890 and revisited and amended over the years, was seen as a way to subtract the judiciary to government control by eliminating the political appointment of judges. Zanardelli also tried to reform with the Law of 30 March 1890, No 6702 the judicial districts by reducing the number of the Courts to increase, with the economic resources derived, the salaries of judges considered modest especially in the early years of his career. The Ministers Ronchetti and Orlando have addressed the issue of the Courts and this problem always met strong local opposition for reasons of prestige than of justice. The government has addressed the same resistance also for the establishment of the Court of Cassation in Rome that ended only in 1923. The two penal sections were established in Rome in 1875 with the aim of facilitating the work of four other regional courts in Turin, Milan, Naples and Palermo. The Court of Rome, assumed the full knowledge of all criminal trials, and reduced regional supreme courts in civil courts. In the following years the Parliament continued to discuss its uniqueness and the role that would take: court of third instance court or the guarantor of a uniform interpretation of the law. The Ministry of Justice consolidated its structure: there were the Minister, the secretary, the director and the cabinet. The offices were divided into departments. There were also the special offices: the legislative office, the Advisory Commission, and the criminal records bureau where the judges worked as applied to detriment of staff which was constantly being reduced.

Between 2008 and 2011, the EURO-JUSTIS project designed and tested new social indicators to measure levels of trust and confidence in justice. The aim of the project was to provide the EU institutions and Member States with a new scientifically validated instrument to collect data on the feelings of trust and confidence of the public opinion in the courts and the police. In a political context that seems to favour populistic approaches and the call for "law and order" , such indicators are precious to collect hard data on the attitudes of public opinion, especially in a comparative perspective. Based upon the assumptions of procedural justice theories, the EURO-JUSTIS consortium designed a set of 45 multiple-choice questions that immediately met the favour of the international community and were then inserted as a module in the V edition of the European Social Survey. This paper briefly outlines the foundational assumptions of the project and describe its main achievements. It also analyses some of the results of the pilot survey performed by the EURO-JUSTIS consortium in some European Countries, including Italy. ; Dal 2008 al 2011 il progetto EURO-JUSTIS ha elaborato e testato nuovi indicatori per misurare il livello di fiducia dei cittadini nella giustizia. Obiettivo del progetto era quello di dotare gli Stati Membri e la UE di uno strumento idoneo alla raccolta di dati sui sentimenti di fiducia rispetto al lavoro di magistratura e forze dell'ordine. In un contesto politico che privilegia istanze populistiche e il richiamo all' "allarme sociale", tali indicatori appaiono preziosi per fornire alle istituzioni alcuni punti fermi, anche in prospettiva comparata. Muovendo dagli assunti della procedural justice, EURO-JUSTIS ha elaborato un questionario di 45 domande a risposta multipla che ha incontrato l'immediato favore d2013-06-12ella comunità internazionale ed è stato inserito nella V edizione della European Social Survey. Questo scritto riassume i fondamenti concettuali della ricerca, ripercorrendone alcuni passaggi e descrivendo i relativi indicatori. Analizza infine alcuni risultati dell'indagine pilota svolta da EURO-JUSTIS in alcuni Paesi europei, tra cui l'Italia.

Il sistema giuridico longobardo contemplò diversi strumenti di risoluzione delle controversie, comprensivi del processo, dell'arbitrato, del giudizio secondo equità e della transazione stragiudiziale o giudiziale. La documentazione processuale superstite dimostra che l'ordinamento della Longobardia, lungi dall'essere "primitivo" o "rudimentale", era estremamente complesso e presupponeva la coesistenza - in un'unica compagine politica - di settori normativi diversi per origine e contenuto. ; Lombard juridical organisation had got many instruments for resolution of the disputes: legal procedure, extrajudicial and judicial transaction. Judicial surviving documentation demonstrates that Lombard juridical organization was not "primitive" or "rudimentary", but it was very complex and presupposed the coexistence – in a only state – of many legal systems, distinguished for sources and subjects.
