; Today children's rights occupy an increasingly prominent place on the EU legal and policy agenda. ; The political and legislative unification of the Kingdom of Italy also involved the judiciary. The judiciary that depended on appointments and career from the central government and specifically by the Minister of Justice, was framed from the start as a branch of government directly employed by the King. The question of independence of the judiciary from the executive and that of autonomy, understood as a system of self-government, were the central themes of parliamentary debate. The judicial system in 1865, in fact, granted the tenure of judges but not able to seat and lower court judges only after three years of operation. To limit the power of government was established by the Minister Villa in 1880, the Advisory Commission on appointments, promotions and transmutation of judges. It expressed mere advisory opinions which the Keeper could not even take into account. Only later, in 1907, with Law No 511, the Minister Orlando instituted the Superior Council of Magistracy, a permanent and partially elected consultative body which was attributed a range of skills relating to the appointment and careers of judges. Even the competitive examination, as the only means for entry into the judiciary, established by Zanardelli in 1890 and revisited and amended over the years, was seen as a way to subtract the judiciary to government control by eliminating the political appointment of judges. Zanardelli also tried to reform with the Law of 30 March 1890, No 6702 the judicial districts by reducing the number of the Courts to increase, with the economic resources derived, the salaries of judges considered modest especially in the early years of his career. The Ministers Ronchetti and Orlando have addressed the issue of the Courts and this problem always met strong local opposition for reasons of prestige than of justice. The government has addressed the same resistance also for the establishment of the Court of Cassation in Rome that ended only in 1923. The two penal sections were established in Rome in 1875 with the aim of facilitating the work of four other regional courts in Turin, Milan, Naples and Palermo. The Court of Rome, assumed the full knowledge of all criminal trials, and reduced regional supreme courts in civil courts. In the following years the Parliament continued to discuss its uniqueness and the role that would take: court of third instance court or the guarantor of a uniform interpretation of the law. The Ministry of Justice consolidated its structure: there were the Minister, the secretary, the director and the cabinet. The offices were divided into departments. There were also the special offices: the legislative office, the Advisory Commission, and the criminal records bureau where the judges worked as applied to detriment of staff which was constantly being reduced.

Between 2008 and 2011, the EURO-JUSTIS project designed and tested new social indicators to measure levels of trust and confidence in justice. The aim of the project was to provide the EU institutions and Member States with a new scientifically validated instrument to collect data on the feelings of trust and confidence of the public opinion in the courts and the police. In a political context that seems to favour populistic approaches and the call for "law and order" , such indicators are precious to collect hard data on the attitudes of public opinion, especially in a comparative perspective. Based upon the assumptions of procedural justice theories, the EURO-JUSTIS consortium designed a set of 45 multiple-choice questions that immediately met the favour of the international community and were then inserted as a module in the V edition of the European Social Survey. This paper briefly outlines the foundational assumptions of the project and describe its main achievements. It also analyses some of the results of the pilot survey performed by the EURO-JUSTIS consortium in some European Countries, including Italy.

; Lombard juridical organisation had got many instruments for resolution of the disputes: legal procedure, extrajudicial and judicial transaction. Judicial surviving documentation demonstrates that Lombard juridical organization was not "primitive" or "rudimentary", but it was very complex and presupposed the coexistence – in a only state – of many legal systems, distinguished for sources and subjects.

The paper summarizes the evolutionary course of the discipline of personal precautionary measures in the light of the rights enshrined in the Italian Constitutional Charter and in the supranational charters, noting how the regulatory perimeter already marked for some time in this regard - and today inserted in the context of a multilevel system - did not prevent discussed application practices and cyclical legislative fluctuations. Valuable in its original structure, although always perfectible, the discipline of personal precautionary measures remains a sectoral legislation, outlining a subsystem highly sensitive to the balance of the criminal process that cannot find autonomous pacification without a contextual revision of the penal and procedural system. The exceptional political-economic situation caused by the health emergency gives hope that the delegated law for the reform of justice that is currently being approved will finally let the phoenix appear of an efficiency of the criminal process unknown - in the memory of a living man - to our legal system.

The fight against corruption in Hungary – The fight against public corruption in post-communist Hungary is mainly entrusted to criminal law. A good number of criminal judgments for events of political-administrative corruption have been pronounced. The European anti-fraud office (OLAF) also investigated Hungarian cases. However, the level of perception of corruption in public administration remains high. The paper examines these aspects, highlighting the criticalities of the Hungarian system of combating corruption also in relation to the alternative institutional forms of corruption prevention s well as the 2018 constitutional reform on administrative justice, the role of the Ombudsman and the legislation on whistleblowing. Finally, the essay tries to identify possible paths for the improvement of the legislative/regulatory framework and of the application practices in the anti-corruption sector. ; 1 ; open ; Non definito ; open ; Mazza, Mauro ; Mazza, Mauro

For any legal system, having a genetic database for the purposes of criminal justice represents an unavoidable but particularly delicate challenge. Unavoidable, because storing DNA profiles that belong to a given subjective population for computer comparison means providing investigators with resources of undeniable probative value. Particularly delicate, as the choices that determine the acquisition, conservation and consultation of genetically significant data generate the impact of the "biologisation of security" on so-called informational privacy, namely the right of the individual to check information that regards his/her personal sphere, defined by article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. In Italy, the DNA database has recently become operational, following a laborious legislative procedure. This contribution sets out to analyse the technical and value-related bases for law no. 85 of 2009 and the provisions for its introduction. It also proposes to assess this law's capacity to ensure an adequate balance between contrasting interests that keep within the parameters of reasonableness and proportionality, as well as being in congruence with the jurisprudence of the European Court of Human Rights. It is only on these conditions that the sacrifice required of "genetic privacy" for the pursuit of the aims of criminal justice could be deemed culturally and socially acceptable, as well as juridically legitimate. Indeed, there is no doubt that the collective demand for security has become progressively more insistent, also in view of the growth of terrorism. Just as undeniable, however, is the public's growing sensitivity towards the various aspects of personal confidentiality, especially regarding a genetic heritage that is now seen as a mark of subjective individuality. No modern law system can thus avoid the task of making technology an ally of privacy, especially in the ambit of criminal justice.
