En este artículo se plantea que las instituciones establecidas en la Provincia de Mérida entre 1830 y 1855 encargadas de administrar justicia, tuvieron una gestión limitada, porque aplicaron leyes que por su ambigüedad no estaban acordes con el nuevo cuadro social de la República venezolana. También se analiza cómo en esta época en la Provincia de Mérida no existían los elementos adecuados para una efi caz aplicación de la justicia. ; In this article one raises that the institutions established in the Province of Merida between 1830 and 1855 managers of administering justice, had a limited management, because they applied laws that by their ambiguity were not in agreement with the new social picture of the Venezuelan Republic. The construction of indicators on sexual violence in the Colombian armed conflict result from the statement of the unconstitutional state of affairs issued by the Court in sentence T-025 of 2004 and especially in writ 092 of 2008 through which the Court decided to protect the rights of women who are victims of forced displacement caused by the armed conflict. This construction has been established as crucial for the guidelines of public criminal policy in the country. This process of constructing indicators has been characterized by an active participation of feminist NGOs and by a collective construction process including the women's movements, the Constitutional Court and the Government. This paper aims at illustrating how this way of constructing indicators, especially with the involvement of what I call punishment feminism, may have the potential to determine public criminal policies intended to guide the way the state should deal with sexual violence, even sexual violence that occurs outside the context of internal armed conflict. The discussion will be based on the idea of the indicator as a government technology and its use as a way to legitimize what has been named "new formal punitive control on sexual crimes." ; La construcción de indicadores sobre violencia sexual en el marco del conflicto armado interno colombiano, que se deriva de las órdenes impartidas en la sentencia de la Corte Constitucional T-025 de 2004, y en específico del auto de seguimiento 092 de 2008 —a partir del cual la Corte decidió proteger los derechos de las mujeres víctimas del desplazamiento forzado—, se ha convertido en elemento central para la fijación de políticas criminales en el país en materia de violencia sexual. This article tries to guarantee the human rights of adolescents in conflict with criminal law, by virtue of the fact that in some cases these rights have been violated and they have been treated as adults by entering them in detention centers for adult liberty.In some countries, these rights have been violated since adolescents who have entered detention centers have been raped, tortured, and have lived in overcrowding. It is here that the lack of knowledge of juvenile protection standards can be determined.In Ecuador, the Plenary of the Council of the Judiciary, 2022 dismissed a Prosecutor because he did not order the practice of the necessary investigative procedures to establish the age of the person investigated in the case; and, similarly, in Judgment No. 9-17-CN/19, the Constitutional Court of Ecuador states that in Ecuador there are 358 family judges and only eight judges specialized in this matter of adolescent offenders. The article addresses the political, criminal and legal challenges posed by accountability demands for past crimes by studying the singularities that the Spanish transition from Franco's dictatorship to democracy has raised. Especially, it is analysed the Historical Memory Law of 2007 and the most problematic points of the criminal justice actions that have emerged due to offenses committed during the dictatorship. Despite the existence of international crimes, the elapsed time has brought difficult to overcome, factual and legal difficulties for effective prosecution. This problem, focusing on the prohibition of retroactivity, prescription and effects of the Amnesty Act of 1977 is examined here. ; El artículo aborda los retos político-criminales y jurídicos que plantean las demandas de rendir cuentas con el pasado mediante el estudio de las singularidades que ha planteado la transición española del régimen franquista a la democracia. The analysis of the data from the field research work done in the outskirts of La Plata, Argentina, is the starting point. It included the testimonials of the local female victims, their social background, focal groups work and extensive interviews. The existence of laws for the protection of women does not guarantee an effective judicial protection. As long as, the patriarchal logic which places males as individuals and females as their property does not change, it will be difficult to attain the psychological and/ or legal empowerment of female victims of domestic violence and the establishment of new violence-free bonds. The Law can be an instrument for liberation, but it demands the help of all those who are responsible for the interpretation and the citizen´s determination to defend their personal dignity and lawyers, ready to listen to them. ; Partiendo del estudio de campo realizado en barrios de La Plata, Argentina, que incluyó testimonios de las mujeres, su contexto, observaciones, trabajos en grupos focales y entrevistas en profundidad, analizamos las familias, tomando la violencia de género para relacionarla con la Administración de Justicia. Nuestro recorrido nos lleva a sostener que la existencia de leyes protectivas de distintos niveles no garantiza que las mujeres reciban efectiva tutela jurídica. En tanto no se modifique la lógica patriarcal que ubica al hombre como sujeto y a la mujer como propiedad del hombre, será difícil el empoderamiento psíquico y legal de la mujer víctima de violencia y la construcción de nuevas tramas vinculares libres de violencia. El derecho puede ser una herramienta emancipatoria, pero necesita de sujetos que lo interpreten, de ciudadanos con capacidad para defender su dignidad de personas y sus derechos, junto a profesionales que se comprometan en la escucha. In the Old Regime, even abandoned by the court in 1606, Valladolid was a second court, as seat of the Royal Chancery. This study focuses on the impact caused by the Chancery in the town and its surroundings -the five leagues−, through criminal judges. They were superior judges in criminal cases and they had other responsibilities in justice, government and police. So there were frequent conflicts with various urban institutions. Moreover, criminal judges expanded and strengthened their power in the second half of the eighteenth century, during the Enlightenment, and they became the highest guarantors of public order in Valladolid. ; En el Antiguo Régimen, aun abandonada por la corte en 1606, Valladolid era una segunda corte, como sede de la Real Chancillería. Este estudio se centra en el impacto causado por la Chancillería en la ciudad y su contorno -las cinco leguas−, a través de los alcaldes del crimen. Eran jueces superiores en materia criminal y reunían además otras competencias en asuntos de justicia, gobierno y policía, por lo que fueron frecuentes los conflictos con diversas instituciones urbanas. Es más, las facultades de los alcaldes del crimen se ampliaron y reforzaron en la segunda mitad del siglo XVIII, en tiempos de la Ilustración, erigiéndose definitivamente en los máximos garantes del orden público en la capital del Pisuerga.
