This paper studies the international coordination of monetary policies in the world economy. It carefully discusses the process of policy competition and the structure of policy cooperation. As to policy competition, the focus is on monetary competition between Europe and America. Similarly, as to policy cooperation, the focus is on monetary cooperation between Europe and America. The spillover effects of monetary policy are negative. The policy targets are price stability and full employment.
Eine Sonderwirtschaftszone wird im Allgemeinen als lokal begrenztes Gebiet begriffen, das die Wirtschaft des gesamten Landes fördern soll. Auch in Japan hat es diese Art der Sonderwirtschaftszone seit der Rückführung von Okinawa gegeben. Jedoch können Sonderwirtschaftszonen auch dazu eingesetzt werden, politische Neuerungen einzuführen und zwischen Nationalregierung und Präfektur- und Kommunalverwaltung zu koordinieren. Diese Art Zone wurde zum Beispiel in Japan durch das Gesetz über die Sonderzone zur Strukturreform von 2002 eingeführt. In einer solchen Zone werden Gesetzesreformen und Deregulierungsmaßnahmen "getestet", bevor sie, soweit der Versuch Erfolg hat, in ganz Japan eingeführt werden. Das Gesetz sieht auch ein Verfahren vor, durch das die Präfektur- oder Kommunalverwaltung der Nationalregierung solche Neuerungen vorschlagen kann, und stellt dadurch ein System der Politikkoordination zwischen der nationalen Ebene und der Ebene der Präfekturen und Kommunen zur Verfügung. Dass Sonderwirtschaftszonen zur Abstimmung verschiedener politischer Ebenen eingesetzt werden, hängt eng mit dem status quo der Dezentralisierung in Japan zusammen. Wären Präfekturen und Kommunen befugt, nationale Bestimmungen auszusetzen oder Steuerbefreiungen zu gewähren, oder hätte Japan ein föderales System, bestünde keine Notwendigkeit, Sonderwirtschaftszonen einzurichten. Es ist daher sachdienlich, die Besonderheiten von Sonderwirtschaftszonen in Abgrenzung zur kommunalen Selbstverwaltung und zum föderalen System herauszuarbeiten. Im japanischen Rechtssystem kann die Satzung einer Gebietskörperschaft strengere Bestimmungen enthalten, soweit sie nicht mit nationalem Recht kollidieren. Im Allgemeinen aber kann eine Satzung nicht die durch nationales Recht gesetzten Vorgaben lockern, da sie als untergeordnete Regelung angesehen wird. Einige sprechen sich dafür aus, dass es möglich sein sollte, einer Satzungsbestimmung Vorrang vor nationalen gesetzlichen Vorgaben einzuräumen (sog. Abweichungskompetenz), um dezentrale politische Strukturen zu verwirklichen. Dies könnte jedoch die traditionelle Normenpyramide zerstören und das Rechtsstaatsprinzip aushöhlen. Die Erfahrungen mit dem deutschen föderalen System können für die Beurteilung der japanischen Diskussion über die Abweichungskompetenz fruchtbar gemacht werden, da Deutschland die Abweichungskompetenz für die Länder 2006 eingeführt hat. Obwohl diese in Deutschland zur föderalen Struktur gehört, bestehen einige bemerkenswerte Bezüge zur japanischen Diskussion. Als Instrument der Politikabstimmung tariert sie im deutschen System Flexibiliät und Grenzen politischer Entscheidungen genau aus. Sie ist durch die Landesverfassung begrenzt, da es sich um Landesrecht handelt. Der Bund darf zuerst von seiner Gesetzgebungszuständigkeit Gebrauch machen, wodurch den Ländern ein Gesetz aufgezeigt wird, an dem sie sich orientieren können, und er hat die Möglichkeit, die Anwendung entsprechender Landesgesetze wiederum durch später erlassenes Bundesrecht zu verhindern. In Bezug auf das föderale System enthält das Grundgesetz den Grundsatz der Bundestreue und den Homogenitätsgrundsatz. Auch die Grundrechte bilden wichtige Grenzen. Zusätzlich beschränkt das europäische Recht die Möglichkeit der Abweichung. So werden der Gesetzgebungskompetenz der Länder flexible Grenzen gesetzt. Auch Japan sollte eine ähnliche Herangehensweise wählen, falls die Abweichungskompetenz anerkannt wird. In funktionaler Hinsicht ermöglichen es Sonderwirtschaftszonen, im Rahmen der kommunalen Selbstverwaltung Gesetzgebungskompetenzen auf die Präfektur- oder Kommunalverwaltung zu übertragen. Anders gesagt, sind Sonderwirtschaftszonen ein Mittel zur zentralisierten Übertragung von Gesetzgebungskompetenzen mit dezentralem Element. Sie sind ein Steuerungsmittel, das es der Präfektur- und Kommunalverwaltung ermöglicht, die Anwendung positiven nationalen Rechts auszuschließen, ohne dass ein föderales System mit einer Normenhierarchie aus Bundes- und Landesrecht vorausgesetzt wird. (Übers. d. Red.) ; We usually take for granted the notion that Special Economic Zones (SEZs) are a limited area designed for stimulating the whole national economy. Japan has certainly had this type of SEZ since the return of Okinawa. However, we can also use SEZs as a tool for policy innovation and coordination between national and local governments. For example, Japan has such a type of zone, introduced by the Special Zone for Structural Reconstruction Act of 2002. Regulative reforms and deregulation are "tested" within the zone, followed by the introduction of the same regulative policy all over Japan if the test goes well. The Act also has a procedure in which local government proposes the deregulation or regulative reform to the national government, which creates a policy coordination system between the national and local levels. The reason why SEZs are needed as a tool for multilevel governance is closely related to the status quo of local decentralization in Japan. If a municipality had competence to deregulate national regulations or exempt taxes, or if Japan had a federal system, there would be no need for SEZs. It is therefore very helpful to identify the characteristics of SEZs compared with local autonomy and a federal system. In the Japanese legal system it is possible that an ordinance can have more strict regulations, unless they conflict with the national law. Generally speaking, however, an ordinance cannot relax any national standard established by national law because the latter is considered to set the lower limit of any regulation. Some argue that an ordinance should be able to overwrite national regulatory standards set by national statues ("deviatory competence") in order to realize decentralized governance structure. It could, however, destroy the traditional norm pyramid and trigger a collapse of the principle of the lawgoverned state. It is appropriate to learn from experiences with the German federal system in order to evaluate the deviatory competence discussion in Japan because Germany introduced the deviatory legislative competence of a federal state in 2006. Although this is a subsystem of the federal structure, there are some remarkable and referable points to the Japanese discussion. This system keeps the balance of the flexibility and the limits set scrupulously for political decisions from the viewpoint of a policy coordination tool. The deviatory competence is restricted by the state constitution because the legislation belongs to state law. The federal parliament has initial legislative competence, which shows states a legislative model, and overriding opportunities with enacting a newer federal law against the state law. Constitutional provisions as to the federal system show the principle of loyalty to the federation and the requirement for homogeneity to the free and democratic order. The basic rights provisions also play an important role in setting the limit. In addition, European law puts restrictions on deviation. These limitations softly control the autonomous legislation of a state. Japan should also introduce such a legal scheme if the deviatory competence of an ordinance were acknowledged. From a functional point of view, SEZs provide a tool that enables a system to distribute legislative competence to local governments within the framework of local autonomy. In other words, SEZs are a centralized assignment of legislative competence with a decentralized element. SEZs are a form of governance in which local governments can exclude the national positive law without a federal norm-hierarchy system that consists of federal and state law.
The paper analyses the processes of central government coordination in Denmark, Germany and Sweden. First it gives an account of the existing coordination patterns, second it analyses changes within these coordination patterns over time and finally it asks, whether these changes can be attributed to an intentional institutional design. To answer this set of questions, we introduce an institutional policy analytic perspective to the study of central government change. This perspective focuses on central actors, interests, strategic motivations and the degree of the actors reflexivity as a promoter of intentional institutional change in government coordination. The empirical analysis shows the prevalence of negative coordination as the dominant pattern of coordination in all three countries. However, country-specific constitutional and political traditions result in a variety of different coordination techniques actually used. The paper concludes by identifying three different patterns of change, depending on the degree of change and the reflexivity involved : "fragmented institutional politics" in Denmark, "policy-driven institutional politics" in Germany and "adaptive and symbolic institutional politics" in the case of Sweden.
Am Beispiel der Hamburger Jugendpolitik im Stadtstaat Hamburg wurden Government und Governance in der 18. Legislaturperiode von 2004-2008 analysiert. Im Ergebnis wurde eine überwiegend reaktive, paradigmatisch gewandelte und innengerichtete Jugend- und Familienpolitik des regierenden CDU-Senats deutlich. Die SPD- und GAL-Opposition kontrollierten mit einer Vielzahl an parlamentarischen Initiativen die Implementation, trugen zur qualitativen Optimierung der politischen Entscheidungen bei und waren Umsetzungstreiber. In den etablierten und stabilen Governancestrukturen wurde die Ausgestaltung der Jugendhilfe maßgeblich von den jugendbehördlichen Akteuren gesteuert und koordiniert. Im Zusammenwirken mit den freien Jugendhilfeträgern und Experten gelang eine an der normativen Zielreferenz orientierte, konsensuale Gewährleistung und Weiterentwicklung des Kollektivgutes Jugendhilfe. ; Using the example of the Hamburg youth policy in the city state of Hamburg, government and governance were analyzed in the 18th legislative period of 2004-2008. As a result, a predomi-nantly reactive, paradigmatic and domestic youth and family policy of the ruling CDU Senate became clear. The SPD and GAL opposition controlled the implementation with a large number of parliamentary initiatives, contributed to the qualitative optimization of political decisions and were the drivers of implementation. In the established and stable governance structures, the design of the youth welfare service was largely steered and coordinated by the youth agency actors. In cooperation with the independent youth welfare agencies and experts, a consensual guarantee based on the normative target reference and further development of the collective good Jugendhilfe was achieved.
The article deals with the influence of the European Commission in the field of economic policy in the European Union (EU) since the beginning of the 21st century. Starting from reflections on the guiding idea of supranationality the question arises if and how the Commission has increased its influence on the economic policies of the EU Member States. The role of the EU's long-term strategies like the European Green Deal are analysed by applying the approach of Evolutionary Institutionalism. Has the European Commission induced institutional change and improved its own institutional fitness? Which role does the European Green Deal play in European economic policy?
During the nineties of the last century, several formerly monopolistic markets (telecommunication, electricity, gas, and railway) have been deregulated in Germany based on European directives and theoretically inspired by the theory of contestable markets. The original contestable market theory implied three assumptions necessary to be satisfied to establish potential competition: Free market entry, market exit possible without any costs, and the price adjustment lag exceeding the entry is shows that if the incumbent reduces its prices slowly (high adjustment lag) and the market entry can be performed quickly (low entry lag), a new competitor will be able to earn back sunk costs. Therefore it is not necessary that all three conditions are complied with for potential competition to exist. Applying this 'revised' contestable market theory to the deregulated sectors in Germany sections, natural monopolies can be identified in telecommunication local loops and local/regional connection networks, in the national electricity grid and the regional/local electricity distribution networks, in the national and regional/local gas transmission/distribution sections, and in the railroad network only. These sections are not contestable due to sunk costs, high entry lags expected and a probable short price adjustment lag. They are identified as bottlenecks which should be regulated. The function of system operators in energy and railroad are closely related to the non contestable monopolistic networks.
Am 14. und 15. Februar 2011 fand am IWH erstmalig in Zusammenarbeit mit dem International Network for Economic Research (INFER) der Workshop "Applied Economics and Economic Policy" statt. Wissenschaftlerinnen und Wissenschaftler europäischer Universitäten und internationaler Organisationen stellten einem breiten Publikum neueste Forschungsergebnisse zu aktuellen ökonomischen Fragen und Problemen vor. Der Workshop richtete sich neben einem wissenschaftlichen Publikum vor allem auch an Mitarbeiterinnen und Mitarbeiter internationaler Organisationen, wie beispielsweise der Europäischen Kommission und der Europäischen Zentralbank (EZB), sowie der verschiedenen Ministerien, wie z. B. der Wirtschaftsministerien. Ziel der Veranstaltung war es somit, nicht nur aktuelle Forschungsergebnisse vorzustellen, sondern auch mit Vertretern aus Wissenschaft und Praxis über aktuelle Wirtschaftspolitik und über das Spezialthema "The Empirics of Imbalances and Disequilibria" zu diskutieren. Mit Lorenzo Bini Smaghi, Mitglied des Direktoriums der EZB, und Martin Hallet aus der Generaldirektion Wirtschaft und Finanzen der Europäischen Kommission konnten zwei hochrangige Vertreter aus den politischen Institutionen als Keynote-Speaker gewonnen werden.
Heterogeneous networks of sensors and unmanned vehicles open avenues for a class of novel applications. Tasks ranging from environmental monitoring to user support within emergency-response scenarios require fundamental, multidisciplinary research, typically spanning Computer Science, Electrical Engineering and Mechanical Engineering topics. The overall goal is to enable the transition towards a cooperative, adaptive and responsive monitoring using networked, autonomous entities. The solutions will comprise an array of devices ranging from inexpensive, tiny, low power sensor nodes, through unmanned autonomous vehicles, and all the way up to resource rich, powerful command stations. The heterogeneity in communication mechanisms, processing capabilities and inherent mobility of the different devices has been defined to be the Mixed-Mode Environment. Goals: This international summer school sets out to survey the state of the art in several highly important subareas of the above research domains. The lectures and tutorials will be held by renowned speakers from academia and industry. The summer school will also provide a good opportunity to get to know other academic, industry and government researchers working in this field, to meet distinguished scholars, and to establish contacts that may lead to research collaborations in the future. This 5-day event will feature a number of different activities like lectures, hands-on tutorials, reading sessions and social events. The summer school is organized by the Research Training Group Cooperative, Adaptive and Responsive Monitoring in Mixed Mode Environments, funded by the German Research Foundation, DFG, under grant GRK 1362 and endorsed by the EURON SIG on Cooperative Robotics.
This paper reviews changes in migration policies as a response to the 2008 financial and economic crisis and examines issues of migration governance. Countries in Europe opted to make new immigration more difficult, protected their labour markets for native born workers, encouraged the return of migrant workers and intensified efforts to curb irregular migration. Clear patterns or reasons for variation in policy responses are not discernible, but it is safe to say that only countries with a significant recent influx of migrants have taken high profile measures at all. The crisis has led to a shift in perspective of the State and its role in economics which is now seen as useful instead of undesired. Previously prevailing neo-liberal thought relegated the State to the "high politics" of sovereignty and security issues. The crisis has highlighted labour market issues, and migrants are now increasingly portrayed as economic agents instead of security threats. This offers room for the State to assert its protective role vis-à-vis migrant workers – a welcome development. The analysis has an International Relations/Political Economy perspective and is largely based on (official) news releases and secondary sources. ; Im Rahmen dieses Beitrages werden Kursänderungen in der Migrationspolitik infolge der Wirtschafts- und Finanzkrise 2008 sowie Aspekte des Migrationsmanagements untersucht. Europäische Länder entschlossen sich dazu, Neuzuwanderungen zu erschweren, ihre Arbeitsmärkte für einheimische Arbeitskräfte zu schützen, die Rückkehr von Arbeitsmigranten zu fördern und die irreguläre Migration verstärkt zu bekämpfen. Klare Muster oder Gründe für unterschiedliche politische Reaktionen sind nicht auszumachen, man kann aber mit Sicherheit sagen, dass nur Länder, die in der jüngeren Vergangenheit signifikante Migrationszuströme verzeichneten, überhaupt Maßnahmen mit hoher öffentlicher Wahrnehmung ergriffen haben. Die Krise hat zu einem Perspektivwechsel geführt, was den Staat und seine Rolle in Bezug auf die Wirtschaft betrifft, die nun als nützlich statt unerwünscht betrachtet wird. Die bisher vorherrschende neo-liberale Sicht billigte staatliches Handeln lediglich im Bereich der "Hohen Politik" von Souveränitäts- bis Sicherheitsfragen. Die Krise hat Arbeitsmarktfragen in den Vordergrund gerückt; Migranten werden nun zunehmend als ökonomische Akteure anstatt als Sicherheitsrisiken betrachtet. Dies lässt dem Staat Spielraum, seine Schutzfunktion gegenüber ausländischen Arbeitnehmern wahrzunehmen – eine begrüßenswerte Entwicklung. Die Analyse wurde aus dem Blickwinkel internationaler Beziehungen bzw. aus volkswirtschaftlicher Perspektive durchgeführt und beruft sich größtenteils auf (offizielle) Pressemitteilungen und Sekundärquellen.
The semantics of the coordinators 'and' and 'or' play an important role in the multilingual legal acts of the European Union with its 24 official languages. The multiple readings of 'and' and 'or' can lead to ambiguities and content divergences both within a single language version and across several language versions in the synoptical perspective. Therefore, they are frequently at issue in legal interpretation at the Court of Justice of the EU. The present analysis of exemplary cases heard by the CJEU distinguishes different types of ambiguities and divergences which are based on the use of coordinators: ambiguity of 'and' and 'or', of enumerations, and of scope ("ambit") are discussed here with the help of Germanic and Romance language examples. Scope ambiguity arises in the interaction of coordinators with each other and with other grammatical operators such as negation and modification. Divergences are based on semantically non-convergent uses of coordinators. Context may cancel out the ambiguity or divergence effect of a coordinator. Several linguistic means are shown to serve as scope barriers which block ambiguities. Awareness of these facts is of help in drafting legal texts and furnishes pertinent argumentation modules in comparing and interpreting multilingual legal acts.
The essay analyses the progress and the setbacks in China's external economic reforms to facilitate the implementation of an export-led development strategy.A distinction is made between reforms of the international trade system and of the foreign exchange allocation system. Notwithstanding the interdependencies in both reform processes, separate analysis of each shows different ways and different degrees of implanting market forces into an otherwise centrally controlled socialist system. Thus, it is documented that open-door policy and reforms were not intended to restructure the socialist system itself, but were introduced as means of acquiring foreign capital and technology needed to speed up China's export growth, overall growth and industrialization. The trade reform, by abolishing the state monopoly of foreign trade, was governed by the principle of administrative decentralization. Foreign exchange reforms were mainly considered to be experiments with limited regional foreign exchange markets under persisting currency inconvertibility. This subordination of market forces under the principle of state control raises doubts about the effectiveness of these reform policies.
The Open Method of Coordination (OMC) has received much attention in the recent EU-literature. The predominant view claims that the OMC is not only a new but also an effective policy-making instrument. This paper raises doubts about both claims by offering a comparison of soft law policy coordination in three international organizations. More specifically, this paper compares the European Employment Strategy - which was the first use of the OMC - to the Broad Economic Policy Guidelines of the EU, the OECD Economic Surveys, and the IMF Article IV Consultations. Based on expert interviews, it seeks to demonstrate that these procedures are forms of multilateral surveillance that do not differ in kind. Such a comparative analysis of the OMC refutes claims to its novelty. Having compared the four procedures, a more general model of multilateral surveillance consisting of six elements is generated that facilitates further comparisons. This paper concludes that governments select voluntarist procedures mainly to secure their own competencies rather than to realize common goals. Effective problem-solving is therefore not necessarily the dominant objective of soft law. ; Die EU-Literatur der letzten Jahre hat der Offenen Methode der Koordinierung (OMC) viel Aufmerksamkeit zukommen lassen. Die vorherrschende Sichtweise behauptet, dass die OMC nicht nur ein neues, sondern auch ein effektives Instrument der Politikgestaltung sei. Dieser Aufsatz stellt beide Aussagen infrage, indem es einen Vergleich verschiedener soft law-Verfahren von drei internationalen Organisationen vorlegt. Im Einzelnen vergleicht dieses Papier die Europäische Beschäftigungsstrategie - mit der die OMC zuerst entstanden ist - mit den Grundzügen der Wirtschaftspolitik der EU, den Länderberichten der OECD sowie den Artikel-IV-Konsultationen des Internationalen Währungsfonds. Auf der Grundlage von Experteninterviews wird gezeigt, dass alle vier Verfahren multilateraler Überwachung zugeordnet werden können und kein kategorischer Unterschied zwischen ihnen besteht. Eine solche vergleichende Analyse widerlegt die angenommene Neuheit der OMC. Aufbauend auf dem Vergleich der vier Verfahren wird dann ein allgemeines Modell multilateraler Überwachung entwickelt, welches aus sechs Elementen besteht und zukünftige Studien erleichtern wird. Dieser Aufsatz schließt mit der Beobachtung, dass Regierungen voluntaristische Verfahren eher deshalb wählen, um ihre eigenen Kompetenzen zu verteidigen als gemeinsame Ziele zu verwirklichen. Effektive Problemlösungsfähigkeit erscheint nicht als vorrangiges Anliegen von soft law.
The article deals with the role of slogans in Japanese firms and in economic policy. After defining slogans and distinguishing them from keywords, the usage of slogans is traced in history, in current business, and in political economy. It is tentatively concluded that slogans are generally meant to create loyality, not for altruistic reasons, but for the egoistic motives of the promoters. Slogans do work to some extent because in the Japanese context open criticism is rare. They may serve the public good because actors can compete through these long-term concepts, without attacking each other face to face.
In der klimapolitischen Debatte stehen meist einzelne Instrumente und Maßnahmen im Vordergrund, wohingegen die Frage der ökonomischen Rationalität der Klimapolitik als solcher häufig vernachlässigt wird. Eine Klimapolitik wäre dann ökonomisch rational, wenn politisch vorgegebene Klimaziele mit geringstmöglichen Kosten realisiert werden würden. Notwendig hierfür ist eine umfassende und einheitliche Bepreisung der Treibhausgasemissionen. Dieser rationalen Klimapolitik wird die aktuelle deutsche und europäische Politik gegenübergestellt, die sich als ineffektiv und ineffizient erweist. Ursächlich hierfür sind die Anreize, denen die politischen Akteure unterliegen und die zu einem Widerspruch zwischen ökonomischer Rationalität und politischer Opportunität führen. ; The debate about climate policy is mainly concerned with particular measures and instruments. Only rarely is the economic rationality of climate policy as such discussed. Climate policy would be economically rational, if climate objectives, which are to be determined politically, are realized with minimum costs. To this end, a comprehensive and uniform price on the emission of greenhouse gases has to be established. The actual climate policy, in Germany and in Europe, is far from being economically rational: It is both ineffective and inefficient. This is due to political incentives which make inefficient policies politically more attractive than efficient ones.
This article throws some light on the post-war development of the Japanese economy using new approaches in monetary theory. In the framework of this theory, the Bank of Japan is integrated into the model as a market participant. The article provides a historical survey of the interaction between monetary policy and the financial system on the one side and economic development on the other side. It also discusses the responses of both monetary policy and the financial system to changing market conditions. In the 1950's and 1960's, monetary policy and the structure of the financial system were directed toward spurring investment and economic growth. Beginning in the mid 1970's, we observe the development of a monetary policy that tried to stabilize the monetary frame of an industrialized economy.
