In this essay, I argue that the alleged failure of the Copenhagen climate summit in December 2009, rather than labelling it as the collapse of climate politics, should be embraced as an essential political fact. Admittedly, Copenhagen was a failure, albeit of a populist consensual policy practice that invokes an apocalyptic doomsday scenario to make everybody toe the neo-liberal line. In my view, consensus-driven UN policy is running into its own limits as was clearly illustrated at the climate summit in Cancun (December 2010) where the blame was pinned on Bolivia for its fierce resistance against a weak agreement. The time has come to revive the climate and, by extension, the environment as a matter of genuine political concern, open to struggle and contestation, in this way constituting an essential component of social change. The goal of the article is the presentation of the chosen aspects of the evolution of the European Parliament. The author presents the beginnings of this body in the structure of the European Coal and Steel Community, the European Economic Community and the European Atomic Energy Community. The leitmotiv of the article is to show the increase of the importance of the European Parliament during almost 60 years of its existence, from the advisory body to the co-deciding institution in the area of legislation of the European Community. The important manifestation of the European Parliament's aspiration to strengthen its prerogatives was also the struggle to introduce the general election to this body. In the final part of the article the author tries to analyze the current position of the European Parliament in the institutional structure of the European Union.

An alternative approach to studying the relationship between the working class & authoritarianism is presented to overcome the difficulties found in the debate between C. P. Middendorp's & J. D. Meloen's "Over het autoritarisme van de arbeidersklasse" ([Working-Class Authoritarianism] Acta Politica, 1989, 24, 83-96) & P. Dekker's & P. Analysis of statistical data compiled in A. Felling, et al (Religion in Dutch Society 1985. The monograph provides a new analysis of the international aspects of the Polish-Soviet War (1919–1920). The conflict has often been marginalised in the history of Europe, while being decisive for the future shape of the European continent, and first and foremost for the Versailles governance. A collapse of the Versailles governance and sovietisation of at least Eastern and Central Europe are difficult to imagine but would have become a reality if the Polish-Soviet War had ended with a defeat for the Polish army. Nowak proposes a study of attitude of the winning Western superpowers to that conflict rather than an analytical monograph. Among the superpowers, Great Britain had the decisive voice. The author perceives the British policy as a prefiguration of appeasement applied in the 1930s. In 1920, the government of the United Kingdom used every effort to facilitate a Polish-Soviet settlement, what in fact would have turned into Soviet hegemony over reborn Poland. The victory of the Polish army in the Battle of Warsaw thwarted the plan. In spite of the word "treachery" in the title and as mentioned by the author in the introduction, the monograph is not a "treatise on morality". No attempt is made to judge the architects of foreign policies pursued by the world's superpowers, which have no obligation to serve the interest of Poland. The author merely undertakes an analysis of a phenomenon in international relations, which does not only belong to history, but continues to resonate throughout the world today. The book may be unfairly considered too Polocentric, yet the author shows awareness of the reality in which the British foreign policy was shaped, and always applies the audiatur et altera pars principle. The work is based on unknown or little examined British archive records. The author introduces the concept of appeasement towards the Soviet Russia in 1920. The book provides a thorough analysis of the attitude of Western elites to reborn Poland, and in this sense constitutes a review of the 20th century political imagination. It casts a new light on Poland's victory in the Battle of Warsaw. Owing to this victory, the Versailles governance was saved and strengthened by the Treaty of Riga (1921) – a fact which remains unnoticed in the historiography of Western nations.

The study is the result of a legal comparative analysis of the directions of reforms in the administrative judiciary in the countries of young democracy: Poland, the Czech Republic, Lithuania, Croatia, Serbia, Hungary, Ukraine, Georgia and Kazakhstan. The analysis was carried out with reference to the patterns developed in old European democracies, mainly in Austria and Germany. Papers on reforms of the administrative judiciary in each of these countries were delivered at the international scientific conference: Reforms of administrative judiciary in the countries of young democracy (10–11.06.2021, Faculty of Law and Administration, University of Lodz). They focused on three issues: 1) contemporary challenges of the rule of law and administrative judiciary, 2) directions of changes in the national systems of administrative judiciary, 3) the future of administrative judiciary. The content of the study refers to this system of issues, which reflects the stages of development of administrative judiciary in the countries of young democracy. The conclusions drawn from the analysis show the results of reforms at each of these stages – from the constitutionalization of the rule of law, through the independence of the court-administrative procedure, to the stage of the present, extremely difficult challenges, not only of a procedural nature. ; Opracowanie stanowi wynik prawnoporównaczej analizy kierunków reform sądownictwa administracyjnego w państwach młodej demokracji: Polski, Czech, Litwy, Chorwacji, Serbii, Węgier, Ukrainy, Gruzji i Kazachstanu, w nawiązaniu do wzorów wypracowanych w starych demokracjach europejskich, głównie w Austrii i Niemczech. Treść opracowania nawiązuje do tego układu zagadnień, który odzwierciedla etapy rozwoju sądownictwa administracyjnego w państwach młodej demokracji. Płynące z przeprowadzonej analizy wnioski pokazują wyniki reform na każdym z tych etapów – od konstytucjonalizacji zasady praworządności, przez usamodzielnienie się procedury sądowoadministracyjnej, aż po etap obecnych, niezwykle trudnych wyzwań nie tylko procesowej natury.

This article presents a critical analysis of insurance fraud with a legal comparative perspective. In the author's opinion, it is beyond doubt that the Polish solution needs change. Nonetheless, the scope of this change may vary. A look at this type of prohibited act regulated in foreign legal systems may be helpful in formulating conclusions for the Polish law as it stands and proposals for the law as it should stand. Considering the above, part one of this article focuses on the legal-dogmatic analysis of the crime under Article 298 § 1 of the Polish Penal Code, and its counterparts in the subsidiary model (i.e., in Germany, Austria and Finland). A detailed study precedes the process of modelling the liability for the commission of an insurance fraud, taking into account the specificity of economic crime and the various approaches taken by European legislatures, while preliminary conclusions resulting from the analyses carried out have been formulated in the summary. However, it should be pointed out at this point that the presentation of the final conclusions will take place after the discussion regarding the independent model, which will be presented in part two of the article. ; Niniejszy artykuł zawiera krytyczną analizę oszustwa ubezpieczeniowego przy wykorzystaniu ujęcia komparatystycznego. W ocenie autora nie ulega wątpliwości, że polskie rozwiązanie wymaga zmian. Różny może być jednak ich zakres. Pomocna w formułowaniu wniosków de lege lata oraz postulatów de lege ferenda może być optyka na ten typ czynu zabronionego w obcych porządkach prawnych. W związku z powyższym w części pierwszej skupiono się na analizie dogmatycznej przestępstwa z art. 298 § 1 Kodeksu karnego oraz na jego odpowiednikach w subsydiarnym modelu w Niemczech, Austrii i Finlandii. Szczegółowy wywód poprzedza proces modelowania odpowiedzialności za realizację oszustwa asekuracyjnego, uwzględniający specyfikę przestępczości gospodarczej oraz różnorodne podejścia ustawodawców europejskich. W podsumowaniu pokuszono się o sformułowanie wstępnych wniosków, wynikających z przeprowadzonych analiz. W tym miejscu należy podkreślić, że finalne konkluzje zostaną zamieszczone w drugiej części opracowania, po uwzględnieniu rozważań dotyczących modelu samoistnego.

The concepts of recognizing elements of nature as having legal personality have been appearing for many years as proposals for a new approach to ecology. Recent years have brought specific solutions in this regard. Attempts to recognize rivers (but not only rivers) as separate legal entities can be found in various places around the world. This is not a common trend, only a few such cases can be identified in the applicable legislation. The article is devoted to the analysis of the best-known examples of this type of activity. In 2017, the legal system of New Zealand recognized the Whanganui River as a legal person. Talks are ongoing about further solutions of this kind. Apart from environmental protection reasons, the basic motives for this type of solution are cultural considerations – connected with Maori beliefs and values. In the legal systems of India and Colombia, the courts have attempted to recognize the rivers (Ganges and Yamuna in India, the Atrata River, and the entire Amazon ecosystem) as legal persons. The motives for this type of activity were primarily ecological – protecting priceless parts of nature from destruction. ; Koncepcje uznania elementów natury za mające osobowość prawną pojawiają się od wielu lat jako propozycje nowego podejścia do ekologii. Ostatnie lata przyniosły w tym zakresie konkretne rozwiązania. W różnych miejscach na świecie spotkać można próby uznania rzek (ale nie tylko) za odrębne podmioty prawa. Nie jest to powszechna tendencja, tylko kilka takich przypadków można zidentyfikować w obowiązujących ustawodawstwach. Artykuł poświęcono analizie najbardziej znanych przykładów tego rodzaju działań. W systemie prawnym Nowej Zelandii uznano w 2017 r. rzekę Whanganui za osobę prawną. Toczą się rozmowy na temat dalszych tego rodzaju rozwiązań. Podstawowym motywem takich rozwiązań, oprócz względów ochrony środowiska, są względy kulturowe – związane z systemem wierzeń i wartości Maorysów. W systemach prawnych Indii i Kolumbii sądy podjęły próby uznania rzek (Gangesu i Yamuny w Indiach, rzeki Atrata oraz całego ekosystemu Amazonki) za osoby prawne. Motywy tego rodzaju działań były przede wszystkim ekologiczne – ochrona bezcennych części przyrody przed zniszczeniem.

The consequences of these elections encompassed the loss of seats in both houses of Congress as well as the much more painful outcome of the Republican Party winning a majority in the House of Representatives. President Obama assumed complete responsibility for this defeat, and the next two years for him will mean cooperation with the GOP, which will be difficult given the financial crisis. Midterm elections traditionally undermine the party of the President in office – power drains from those who wield it. There always are people who are disappointed with the current policy of the administration, however, in 2010 we can talk about a political earthquake. Apart from the 'midterm elections effect', the success of the Republican Party partly resulted from the difficult economic situation and the reform of the health care system. The article is a hypothesis on to what extend international or regional organizations act as effective mediators during mediation process. Attempt of conflict regulation and work of the mediation platform created after Russian-Georgian war are discussed.The theory discussing main variables for evaluating international mediation represented in mediation literature have been used for evaluating mediation factors. The article shows the level of mediation effectiveness in international conflicts, when it is not clear which are the conflicting sides; it shows that when there is an influential country, considering its capabilities, it has enough power to act as effective mediator, only in case if it does not have direct interest in the conflict.We have concluded that mediation can be effective only when it is clear which the conflicting sides are. Joining the European Union has had a significant impact on the process of urban regeneration in Poland. In 2004–2006, the funds have been launched in the framework of the Integrated Regional Operational Programme to support the recovery of degraded areas. In the next programming period 2007–2013, the amount of resources available for action in this respect, included in the Regional Operational Programmes, many times increased. As a result, after 2004 in many cities in Poland revitalization has become an important part of development programming.The impact of European funds relates primarily to the following aspects:1. The development of local regeneration programs and the inclusion of renewal of degraded areas to the urban development strategy.2. The creation of organizational units within the municipal offices responsible for the revitalization and presidents appoint proxies for the revitalization.3. Obtaining EU funds for revitalization, while involving funds from the budgets of cities, as well as measures of private entrepreneurs,4. The involvement of residents, associations and non-governmental organizations in regeneration activities.This article aims to analyze the impact of the above areas in the seven largest cities in Poland: Warsaw, Krakow, Lodz, Wroclaw, Poznan, Gdansk and Szczecin. ; Wejście Polski do Unii Europejskiej wywarło znaczący wpływ na proces rewitalizacji miast w Polsce. W latach 2004–2006 uruchomione zostały środki finansowe w ramach Zintegrowanego Programu Operacyjnego Rozwoju Regionalnego na wsparcie odnowy zdegradowanych obszarów. W kolejnym okresie programowania na lata 2007–2013 kwota dostępnych środków na działania w tym względzie, uwzględniona w Regionalnych Programach Operacyjnych, jeszcze wielokrotnie wzrosła. Warunkiem ubiegania się o dofinansowanie było opracowanie programów rewitalizacji, a co za tym idzie – stworzenie ram organizacyjnych dla zarządzania odnową w ramach jednostek samorządu terytorialnego. W rezultacie po 2004 r. w wielu miastach w Polsce rewitalizacja stała się ważnym elementem programowania rozwoju. Celem artykułu jest analiza wpływu, jaki wejście do Unii Europejskiej wywarło na rewitalizację zdegradowanych obszarów w Poznaniu na tle największych miast w Polsce: Warszawy, Krakowa, Łodzi, Wrocławia, Gdańska i Szczecina.

The contemporaneity has been redefined, the transition has happened. Symptoms of its end were as follows: redefinition of the concept of democracy, crisis of the classic notion of value and the failure of U.S. unilateralism. Objective determinants of the new order – arising from the crisis of sovereignty – are grounded in the separation of legitimacy and effectiveness. The constituent power is redefined as immanent tool for ordering actions. On the one hand, the biopolitical structure of reality nowadays enters the conflict with the old concept of law, on the other, it dislocates the relation between technical and political composition of the labor force. A loss of a control over a new, socialized form of living labor by the power becomes paradigmatic for the contemporaneity. Worker doesn't contact with profit but rent, he stands in the front of "collective capitalist", who is now a forger of the social work. In this situation, a constituent resistance is realized in a practice of exodus. The resistance becomes also a process of reclaiming the common. The common, which is opposed to the private, as well as to the public, becomes a dispositive of radical and democratic form of governance. ; Współczesność została zredefiniowana, przejście się dokonało. Władza konstytuująca zostaje zredefiniowana jako immanentna dla działań porządkujących. Biopolityczna struktura rzeczywistości z jednej strony wchodzi dzisiaj w konflikt ze starym pojęciem prawa, a z drugiej zaburza relację między technicznym a politycznym składem siły roboczej. Paradygmatyczną dla współczesności staje się utrata kontroli przez władzę nad nową, uspołecznioną postacią żywej pracy. Dobro wspólne przeciwstawiając się "temu, co własne", będącemu podstawą zarówno tego, co prywatne jak i tego, co publiczne, staje się urządzeniem radykalnego demokratycznego zarządzania.

Given the growing popularity of biometrics, doubts about the conditions for biometric data processing can be noticed in practice. These inaccuracies take place in various areas of law, including labour law. This article provides a theoretical discussion on the processing of special categories of data. It aims to point to the need for appropriate legal regulations to ensure the security of the processing of biometric data of employees and candidate employees. The article starts with clarifying the concept of biometric data and discusses the practical aspects of the use of biometric tools. Further on, the author analyses the legal regulations concerning the processing of biometric data in the relations between the employer as the personal data controller and the employee as the data subject. As a result of the studies carried out, a position was presented which indicates that the employer who processes biometric data of employees and candidates for employment should always find out whether he has legal justification to process the data in question. This article is one of the few studies on the processing of biometric data in Polish literature on the subject. The main purpose hereof is to present situations under the current legislation, in which the employer can process biometric data of its employees. The article is a form of universal presentation of the problem and may be of interest especially to legal practitioners. ; Z uwagi na wzrost popularności technik biometrycznych w praktyce można zauważyć pojawiające się wątpliwości dotyczące przesłanek warunkujących przetwarzanie danych biometrycznych. Niniejszy artykuł zawiera rozważania teoretyczne dotyczące przetwarzania danych szczególnej kategorii. Jego celem jest zwrócenie uwagi na potrzebę stworzenia odpowiednich regulacji prawnych służących zapewnieniu bezpieczeństwa przetwarzania danych biometrycznych pracowników oraz kandydatów do pracy. Artykuł rozpoczyna się od wyjaśnienia pojęcia danych biometrycznych oraz traktuje o praktycznych stronach wykorzystania narzędzi biometrycznych. W dalszej części autorka poddaje analizie regulacje prawne dotyczące przetwarzania danych biometrycznych w relacjach pomiędzy pracodawcą jako administratorem danych osobowych a pracownikiem jako podmiotem, którego dane są przetwarzane. W wyniku przeprowadzonych badań zaprezentowane zostało stanowisko wskazujące, że pracodawca przetwarzający dane biometryczne zatrudnionych pracowników oraz kandydatów do pracy powinien każdorazowo ustalać, czy dysponuje przewidzianą przez przepisy prawa przesłanką legalizującą przetwarzanie tych danych. Niniejszy artykuł jest jedną z niewielu prac w polskim dorobku piśmienniczym na temat przetwarzania danych biometrycznych. Głównym celem jest zaprezentowanie sytuacji, w których pracodawca może zgodnie z aktualnie obowiązującym stanem prawnym przetwarzać dane biometryczne swoich pracowników. Artykuł stanowi formę uniwersalnego przedstawienia problemu i może być przedmiotem zainteresowania zwłaszcza praktyków prawa.
